At this point do you think that schools one, should reopen and two, do kids need to wear masks when they go back to class . So absolutely 100 schools need to reopen. The harm were doing to our children particularly those in inner cities and underserved communities and those with disabilities is just immense. I know it from the data but i also saw it when i was doing a clinic last week in mcallen. All the children not getting services. The second thing that we know for sure is that children, if they do wear a mask in school. Im not talking about mandates. If they do wear a mask in school, it doesnt matter if you physically distance or not, the rates of transmission in schools are incredibly, incredibly low. So yes, schools need to open. Masks are protective and it depends where you are. If there is a high degree of spread in your Community Masks in school are reasonable. If the number is low, then i think it should be optional as people are stating. Dana there is some confusion whether you need to get a test. Do vaccinated people need to go Get Tests . Well, you know, its all about risk. Remember that with the Delta Variant if you believe the israeli numbers, you are about 60 protected from infection. You are 95 protected from hospitalizations. If you do get infected you could transmit it to other people. So it is a reasonable thing that if you are in close contact with a person you know who has covid and want to make sure you arent infected go get a test. Dana news about the origins of this Virus And Congressman Mike Mccaul has a New Report coming out. He was on with bill in the last hour and what they found. I think they were involved in a coverup. Its the greatest coverup in human history. I think the Chinese Communist Party are very concerned about this report coming out telling the truth. They were playing with fire. Bill we have a preliminary Hearing Today set for the two men charged in the death of a College Student by the name of Kristin Smart who vanished 25 years ago. Last seen in May Of 1996 leaving a party with prime suspect paul flores. Three months later in August 1996 Dogs Led Investigators to the Suspects Dorm at the university. Smart was not officially presumed dead until may of 2002. 14 years later investigators found some items of interest. In march of this year detectives executed a Search Warrant at the home of flores fathers. In April Paul flores and his father, rueben, were arrested in connection with smarts disappearance. Both pled not guilty. Want to bring in Defense Attorney Jonna spilbor. What happens today in a preliminary hearing for that . You did a good job there. Okay, so today is very important but i dont want anybody to get too excited this 25yearold Mystery is about to be solved. This case is old and cold. Old for obvious reasons, cold because among the items of interest that have been found does not include Kristin Smarts body as far as we know. Trying to build a Murder Case without a body is like trying to build a house with invisible bricks. It is impossible. So todays preliminary hearing will have to show whether or not a crime has been committed and whether or not the two defendants sitting at the Defense Table committed it. Proofing that a crime has been committed is not going to be a foregone conclusion in this case, bill, because there has been a real lack of physical evidence. But because were having a hearing, the defense is going to get everything that the prosecutors have and that is going to be very revealing one way or the other. The charges against paul flores is murder. Weve got physical evidence, we have witness statements, things that in our view in the totality bring us to charging mr. Flores. Bill the preliminary hearing normally takes a few hours. This today could last for weeks. Why is that . This is really interesting. Because the case is so old and the defense is entitled to see all of the cards that the prosecution has, this preliminary hearing which is normally just one step along the way, will probably be close to a trial without a jury because look, when you have a 25yearold Mystery and you dont have a whole lot of physical evidence to connect the dots, the defense is going to want to really, really push the envelope and say hey, judge, if the prosecution doesnt have enough evidence to hold us to trial, youve got to dismiss this case forever. So we might see expert testimony. We might see an Affirmative Defense on the part of the rueben family. We might see all those things over the course of the next week, two or three. This is going to be very interesting from a legal perspective. Bill and to touch on that, you as a Defense Attorney would argue that what is happening today would amount to a mini trial. Would you agree with that . And would you no matter what they conclude would you have grounds for appeal . Well, it will defend what happens. Lets say the ruebens lose and they are bound to go to trial. We are so conditioned by Tv Bill it doesnt happen next week. If they are bound over today we have months before they see the inside of a Courtroom And Jury if that were to happen and other steps along the way they might still get the case dismissed even if the judge holds them over. This from a legal perspective will be a fascinating procedure because you have a cold case, because you have very little solid physical evidence or at least thats what we are led to believe. Well know that for sure when this preliminary hearing is over because the prosecution is going to be forced to turn over everything they have. Bill last point. Why has this been so difficult 25 years later . You know, this is so strange. Mainly because evidence doesnt get better with time. A lot of the things that are happening now actually happened 25 years ago. There was a grand Jury Proceeding that failed to file formal charges against Paul Rueben 25 years ago. Families with older children can be expelled currently under title 42 to mexico. Families with young children are being released in record numbers. You have seen the images.
