What has been really confusing is what the cdc said yesterday. They made recommendations but didnt give the data. Let me be specific. They claimed and im sure Theres Reason to believe this that even vaccinated people can spread the virus because of the high levels in their nose and mouth. What percent is that . Yesterday they said its a rare occasion. Ifts rare, 1 ,. 1 . You dont need to mask and you shouldnt recommend that. If its 20 or 30 , then what they said makes sense. They made the recommendation without being transparent about the data. If you told the american people the data, which they have, then we could have an intelligent discussion. They havent done that. I urged dr. Walensky be transparent so we can talk about it. Charles yeah, to wearing the mask after the vaccine doesnt lend urgency. Major companies like apple, google are pushing back the return to the office policies to october. Some are probably going to go longer than that. Shouldnt more companies be doing the same . Is there enough question marks out there to err on the side of caution . I really dont think so. I think that if its the Companys Decision that being nonvirtual is the right thing to do, if youre vaccinated, youre highly protected. If youre not vaccinated, you can easily get tested once a week or twice a week to make sure that youre not going to pass it to someone else. Having reasonable ventilation. I would feel very safe going back to work under those parameters. Get vaccinated or get tested. Have reasonable Work Space accommodations. You can go back to work if you want to. New York Governor Andrew Cuomo announced by labor day, all State Workers have to be vaccinated or undergo regular testing for the virus. Private companies have made vaccines a requirement for employment. Others say getting the shot is a condition to return to the office. We dont know what will happen if someone is disabled and a doctor says a vaccination could harm them more. Another problem, the unions. The president of the aflcio says he anticipates a mandate for all federal workers. Many individual unions disagree. The largest Workers Union has scoffed at the mayors call for vaccinations. One Union Leader put it that way. New york is a union town. A judge said federal law does not prohibit public and private employers from requiring workers to be vaccinated. Charles . George Washington University Law Professor and Fox News Contributor Jonathan Turley here to weighin. Jonathan . Well, they do have a case in the sense of there can be litigation over particularly certain types of groups opposing a mandatory vaccine requirement. If someone has religious objections, they have valid cases to bring to court. For the most part, private employers will likely prevail in requiring vaccinations for people to return to the office. For those companies that are allowing for virtual work to continue remote work to continue, they will be particularly in a good position in terms of litigation. But the courts are highly differential when it comes to private businesses and the cdc recommendations. What about unions that would force their Union Members to be vaccinated . Well, it comes down to the basis for the challenge here. You know, if its odd for a union to require vaccinations. That doesnt directly apply to people conducting themselves as Union Members. The employer has a claim to say, were trying to protect the workplace. Were very concerned about these variants. Were following the cdc recommendation. For the unions to remember members because theyre unionized to get vaccines is not quite as strong as all of that. What is fascinating is that were moving to different stages. We started out the vaccines were approved. We started out with this type of reason consent model. That they would try to convince people to take it. That failed. Over half be population, at least in the first stage. Then they went to a type of almost purchase consent. There were lotteries in ohio and various gimmicks that failed. Were still about 50 or so of the population. Now we see a move to a different model. The biden administration is all in on a type of coerced consent approach. What that involves is getting private companies to make life as difficult as possible for people who are not convinced. You have like Cnns Health experts saying we have to make their life as miserable as possible. Even in germany an official saying youll have fewer freedoms unless you consent. This is all to force people that are against getting vaccines into sort of a smaller and smaller point of existence. A very difficult space. But it also means that private companies become a type of shadow state. They become the vehicle by which the government can do indirectly what its not doing directly. Charles of course, consent sounds like oxymoronic shrimp. Any legal precedence with the federal mandate for vaccinations . Has that been tested in the courts . Not really. The most important case was the Jacobson Case in 1905. The Supreme Court upheld a state in this case Massachusetts Program for mandatory vaccines. In that case for small pox. We have not seen a Test Case for a nationwide federal mandatory vaccine program. That gets into questions not just of the basis for the vaccination program, but also the questions of whether this is a state or federal power. Usually public health is left to the states. Police said theres a charity rented an entire hotel to House Covid positive migrants. Police say they found out when a customer at a Burger Restaurant flagged down a Patrolling Officer and told them a Family Member Inside was sneezing, coughs and unmasked. They said that customs and Border Protection processed them and they tested positive for covid and were released to the charity. Theyre staying in our city. We did not know this. No one told the city of La Jolla, nobody told the Police Department that these people were here. No one told us that these people were possibly ill. Now, the County Judge here says i call on federal immigration officials to stop releasing infected migrants into our community and im further calling on Governor Abbott to return to Hidalgo County the Safety Tools that he took away that would help us slow the disease. That means Mask Mandates. Abbott issued an order authorizing Texas Law Enforcement to stop vehicles that they suspect are carrying migrants and reroute them to the Port Of Entry trying to get more details of what that means or where specifically that would happen. The Texas Governor has also ordered the states National Guard to assist with arrests. Look, last week in the lower rio grande valley, they had over 20,000 encounters, over 20,000 encounters in one week. What happened is that as The Story, La Jolla is in my district. I talked to the officials this afternoon. Were going to talk again friday. What is happening is when Border Patrol drops folks off at a charity, the charity gets overloaded and then they drop them off at a hotel without telling the local officials. Thats not right. The charity needs to tell the local officials especially if there are covid positive. Its not fair to by local communities, people being released there that might have covid19. We need to just make sure that we communicate with Each Other. What im asking on the biden administration is to do a pause. Do a pause. They need to prioritize Border Communities, they need to prioritize the men and women of dhs. They need to prioritize our Border Communities and dhs. Charles to your point, may 30th, 1,307 of new cases Of Covid19. Yesterday there were 17,000. Thats a 13 times increase in just that very short period of time. Look, they dont need to listen to me. They dont need to listen to they better listen to the Border Communities. Those are people that are at the front line. They also need to reason to the men and women of dhs. Last week, they had 70 positive cases of agents that were sick. Now its 80. They have a little bit over 100, 200 that are selfisolating. The cases are going up. Remember, those men and women have families. If they get sick and go home to the families, its not fair to their families and certainly not fair to the Border Communities to leave people that are sick and not even tell the local communities like La Jolla. Charles what would you like to see done . Are there mixed messages from Vice President harris that says dont come here but they dont publicize as how many people are being deported as a deterrent . I told the White House that they have theyre deporting people under title 42. I support title 42 especially right now. They need to publicize and show images of people being deported. Because i ask you, charles, have you seen one single picture of somebody being deported . No. I havent seen one. I see people coming in. But were not showing people being deported. You have to do that. If you dont have any consequences, theres a green light. March, april, may and june are the peak months. Were now in july and just this morning they stopped a group of 509 people. One single group. I emphasize, 509 people coming in in one group. These numbers are not stopping and without due respect to the administration, they need to put a pause on this now for the sake of our Border Communities.
