What We Saw then is record numbers. The Processing Center where he visited today, it was beyond at capacity. Now, ive visited the same Processing Center since then. The numbers have gone down in the El Paso sector. Theres other sectors that have the numbers have only increased. Del rio and the Rio Grande valley in particular. So what i get at, this Border-patrol'>Border Patrol is always shifting and always moving. You Cant Land somewhere and become an expert. You have to dedicate the time and effort from all of us, from El Paso to del rio, to Rio Grande valley, laredo. I hope this is the first of many visits that she makes to tackle this problem. This judge has been very tightlipped. I think hes reached his decision before he goes to the courtroom. Gillian i was going to mention that, lawrence. I spoke to a criminal Defense Attorney Last Night that said the reason that chauvin may speak today has nothing to do with the judge. Judge cahill will arrive at sentencing before he sits in court today. Its more down to whether She Vin wants to make a last appeal to the public at large to prove that hes not an evil monster. Who knows if he has any interest in doing that or not. That could be a possibility. That goes into the appeals process, gillian. I think the main concern, when you Look at the mitigating circumstances that the judge is taking in to consideration, i think thats going to be part of it. You have to realize the Prosecutions Defense is always that he was a danger not only to the public but he dishonored his profession in the process of it. I think also the judge will take into consideration that nine minutes and 29 seconds that We Saw the Prosecution Use over and over and over when it came to the jury. They wanted to show the tape and have that description in their head when they made the decision. Gillian so you mentioned the Mitigating Factors there last month or in april. I want to break that down what theyre talking about. The fact that a minor videotape, the fact that he knew that he was a Police Officer. He was a trained officer as well. He treated himself cruel 9 minutes and 29 seconds. The crime was seen by a child. A child videotaped that. We never saw the face of the child. It was a minor. Where do you think The American public comes out on this if he is somewhere in the middle in terms of sentencing . What happens . Where do we go from here . This is a nowin situation. Some people will be upset. Some people will be happy. I do think that this was the catalyst for a movement. We talked about that Loudoun County School Board meeting Last Tuesday at which a number of people were arrested. One of them is a fellow named john tiggis. He said that parents feel helpless in this. As i was standing there, realizing that people felt like they had no options after the School Board left, thats what i felt. The reality is clear that they dont want to listen. John your organization seems to hold School Boards and administrators accountable. How do you propose to do that . So that is exactly right. Thats what we plan to do. We can come in and help to raise awareness and make sure these conversations are truly happening at a hyper local level. I know you reported on this before. As parents start to come forward and the School Boards are not listening to their concerns, theres another layer here where parents are being doxed, being pointed out by members of the community. Other people are calling their place of work. So what we hope to do is give parents this tools to have the conversations with School Boards and also like were doing with this national and threeplace local Ad Campaign is to Shin A spotlight on the big problems so we can activate other parents across the country and have them ask questions and start these conversations. John just hours after a group of bipartisan senators trumpeted their Infrastructure Deal, many ask is this A Trap for the gop. A lot of surprise among Republicans Yesterday when the the president came out to talk about this, chad. Thats right, john. Things were rosy for five minutes and then democrats said they would do the bill and a massive 6 Trillion bill. The gop says why should they play along when democrats push their big bill . We cant have a trillion Dollar Bill on infrastructure and raise taxes and have a green new deal. I dont think it will pass. They killed any opportunity. This bipartisan agreement is brittle. Some democrats may insist on tax hikes. Mitch mcconnell says that is a redline. Members of the Gop Wonder if democrats are hoodwinking them. Democrats could blame the gop of not being bipartisan if they walk away. First you have to come to the table to push back from the table. Other than five people out of several hundred republicans, they havent been coming to the table. President biden says he will only sign both bills. Democrats need the big bill to get progressives on board. Some are wondering why the democrats are negotiating with the gop. John . John thanks, chad. Gillian . He told Mike Emanuel on air Last Night that the president pulled a fast one. Want to get your reaction after. I was optimistic initially, but you can best be described as a tale of two Press Conferences. At the first one, the president walks out with the bipartisan group and blesses the Infrastructure Bill that many of my members are quite optimistic about. After all of those people depart the White House, the president goes out for the second Press Conference and says unless you pass my tax bill, i wont sign the Infrastructure Bill. Gillian harold, let you respond to that first. I guess you dont agree with the senators take. Id say two things. Thanks for having me on. I think its hard to reconcile the two. Id agree with Senator Mcconnell there. I do think the people will be asking about this are Senators Cinema and warner and manchin. Because they have signalled that they are not for theyre more for bipartisan achievement than they are for trying to push something through standalone. I also think its important for both sides to realize that when the country is deeply divided as we are and facing the kind of challenges that were facing at home and abroad, leaders in washington down have the luxury to say no to everything. So when you have ten republicans, democrats come together and say theyre willing to say yes to something, it will force The American people to maybe pressure members of congress pushing from the left or the right against this bill, will push them to want to support something that at least advances the ball down the field. I was encouraged yesterday and remain encouraged this morning as well, early this afternoon as well. Gillian im delighted to hear that youre feeling encouraged. Im not. Charlie, i feel personally hoodwinked as an american citizen in this. All ive been hearing for months is trillions of dollars and infrastructure and every other day theres a big Press Conference because somebody is going to do something. Theres agreement. And then the bottom falls out. Yeah, if Theres Anything that unites democrats and republicans in washington, its spEnding other Peoples Money that they dont have in the first place. So im sort of if the object is to spEnd blow a massive larger hole in our deficit, then im optimistic democrats and republicans will figure out to do that. This is A Trap. Everything is A Trap. If this was about infrastructure, democrats would have joined with Donald Trump over the past four years. Instead of trying to impeach him twice, they would have sat down and come up with a massive Infrastructure Bill that Donald Trump probably larger than this one that he would have been delighted to sign. But thats not what theyre interested in. Theyre interested in their pet projects. Interested in spEnding all of this money they dont have and dumps the debts on our grandchildren for them to pay. But theres No Doubt in my mind that the socalled progressives in congress are starting to Look at this and realizing that it is its a wonderful trap for republicans. They can get them in on this and then try to run and then under the guise of, you know, slipping through another another much larger bill of 6 Trillion. Literally our children for generations that we dont know will still be paying for. Gillian gentlemen, we have to cut it short. Were about to hear from the Vice President. You heard me say many times, i strongly believe that most people dont want to leave home. When they do, its because either theyre fleeing from harm or because they dont provide for the basic necessities of their family. That belief has been reinforced throughout our day today. Whether it was when i met with children who are Unaccompanied Minors or i met with leaders who have been on the ground in El Paso for many, many years doing work that is directly about supporting an interacting with folks that are immigrating to the United States and who are crossing this Border. My trip to Guatemala And Mexico was about addressing the Root Causes. The stories that i heard and the interactions we had today reinforce the nature of those Root Causes. Lack of economic opportunity, very often violence, Corruption And Food insecurity and the basic needs not being met including fear of cartels and gang violence. So the work we have to do is the work of addressing the cause, the Root Causes. Otherwise well continue to see the effects. What is happening at the Border. It is going to require as we have been doing comprehensive approach that acknowledges each piece of this. Informed also by the recognition that the United States is a neighbor in the Western Hemisphere and not only do we have a reason to concern ourselves as the Root Cause issues because of what we see at the Border but also because we are we live in that neighborhood, the Western Hemisphere. Like anyone living in a neighborhood, one most understand the relationship between fellow neighbors. So thats the Work Weve done. I want to in particular recognize Secretary Mayorkas. The time that we spent with the dedicated Men And Women Of Cbp has reinforced the work that Secretary Mayorkas has done in terms of bringing technology, resources, Professionalism And Support to the men and women on the ground. I commEnd all of them for the success that theyve seen thus far. I call it progress. Were not where we want to be yet. Weve made progress the last few months because of his dedications and his effort. So with that, i also want to make a point, when we have this conversation about what is happening at the Border, lets not lose sight of the fact that were talking about human beings. Lets not lose sight of the fact that were talking about stories that as the Bishop Sheridan and many of the communities involve horrEndous tales of Abuse And Fear and harm not only from folks coming here in their home countries experiencing that, but along the path of their migration. So lets recognize with a sense of humanity that these issues must be addressed in a way that is informed by fact and inform by reality and informed by perspectives that actually is actually dedicated to addressing problems and fixing them in the most productive and constructive way. The president and i are absolutely committed to ensuring that our Immigration System is orderly and humane. I do believe that we are making progress in that regard. So with that, im going to introduce the secretary of the department of Homeland Security, Secretary Mayorkas. Thanks very much, madam Vice President. Privileged To Be With You today. I recommEnded to the Vice President that we visit El Paso because it is one of the busiest sectors on the Border. El paso reflects the my diverse elements of our mission. It demonstrates also the progress that has been made in the work that remains. In march this sector experienced overcrowded, unaccompanied children staying in the Border-patrol'>Border Patrol station for more than an average of 120 hours. We saw too many children in a Border-patrol'>Border Patrol facility not designed for them for too long. The president and the Vice President directed me and the execution of my responsibilities as a secretary of Homeland Security to take care of it. Today the situation is dramatically difference. The Border-patrol'>Border Patrol station is not overcrowded with children and unaccompanied child spent an average of less than 30 hours in it Border surges have been a challenge for years and years. To address the challenge successfully requires a multipart plan. We have a plan. The Vice President is leading our Nations Effort to tackle the Root Causes of migration, why people leave their home in the first place. I and my colleagues in the cabinet have been called to execute the rest of the plan to build safe and legal pathways for people that qualify for humanitarian relief under the laws our congress have passed. To rebuild our Countrys Asylum System dismantled under the prior administration. In an orderly and just way to remove those whose claims for relief do not qualify. Im immensely proud to lead the work force, the Men And Women Of Dhs and executing our responsibility to secure the Border and execute safe, orderly and humane process as the president and the Vice President have directed. It grateful to help tackle the Root Causes of migration, her focus on what is happening in the northern triangle countries of origin. Im hopeful that congress will pass Immigration Reform to fit the system that everyone recognizes is broken and i am thankful for the chairmans years long leadership in championing this effort. There was never a doubt in my mind when it came to tissue of immigration that we were of the same mind as to what america needed to do. When she was given an opportunity to join President Biden and leading this country, she was also given an opportunity to use that commitment of immigration to solve one of americas hardest political problems. Congress needs to do its part when it comes to Immigration Reform. Its been 35 years since weve had an immigration bill. Everybody complains about the system and they should. Its broken. When it comes to dealing with it, many of the folks in the senate and the house dont want to lift a finger. We need a bipartisan effort to come up with a humane, sensible policy in america. I believe shes moving in the right direction on Immigration Reform and dealing with not only the challenges of today but what our nation Looks like tomorrow. Thanks for your leadership, Vice President. El paso has been central to what weve seen for decades when it comes to immigration. And i feel very hopeful because for the first time in at least four years, we have an administration interested in addressing this significant challenge. It starts with the work that the Vice President is doing in addressing Root Causes. The work doesnt begin and End with her. As the chairman mentioned, congress has an important role. In the house of representatives, we have passed legislation. We are also working on passing the u. S. Citizen act and we have to get the senate to make this happen. Even then the work is not over. We have to completely reenvision the way that we greet migrants at our nations front door, this will take time and a commitment but we finally have a president and a Vice President that have that commitment and they are in it to create permanent meaningful change, positive change. El paso is the perfect place for the Vice President to continue on her exploration of the issues around why people are leaving their country. In our community, we have not just a central Processing Center that addresses those arriving at our front door but also received migrants from other sectors. We also have Emergency Influx, an Emergency Influx facility. Licensed shelters. We have robust Ngo Group of organizations working together. So im very proud that El Paso is a place that has always met our nations challenges with good will, compassion and kindness, that we were the site of the Vice President s visit and we stand ready to work with her. Thank you. [question inaudible] first of all, what is happening here in El Paso really is in many ways highlighted many hoff the facets of the issues of immigration. Its here in El Paso that the previous Administrations Child Separation policy was unveiled. So we have seen the disastrous effects in this region. It is here in El Paso that the return to Mexico Policy from the previous administration was implemented. We have seen the disaster that resulted from that. Here in El Paso, weve also seen great work happening through the department of Homeland Security under the leadership of the Secretary Mayorkas and the work of the men and women of customs and Border-patrol'>Border Patrol. They have instituted technology that over the last couple months has expedited in a very significant Way Processing of people that are arriving at our Border. We are seeing here in El Paso Unaccompanied Minors who i spent time with who are filled with optimism but theyre without their families. Young children. Theyre being processed through the system. But it really does speak to also the humanitarian of the nature of the work that must be done when were Looking at young children that are not with their families and thinking about how theyre going to institute a humane and comprehensive system that addresses that. So this has been a very important trip. This has been a trip that also is connected with the obvious point. If you want to deal with the problems, you cant just deal with the symptom of the problems. You have to figure out what cased it to happen, which is why after taking a Leadership Role on Root Causes, one of the first trips i took is to Guatemala And Mexico to see what is happening in terms of the concerns about everything from corruption to Food Insecurity to the lack of opportunity for indigenous people, women doing the work first hand, the challenges that that country faces because of extreme climate conditions and addressing the challenges as a neighbor in the Western Hemisphere. Focusing on the actual Root Causes that we can by inference have an impact on the effect. Im very excited about the potential, the focus that we have placed on the Root Causes including bringing together ceos from some of americas largest corporations, bringing together some of the worlds largest foundations here in the United States. Bringing together dealing with what is happening at the Border. I will say that Secretary Mayorkas is doing a great job. Boots on the ground here at the Border, implements reform within the department of Homeland Security that are clearly having an effect of expediting in a fair and judicious way folks that are arriving. [question inaudible] thanks very much for the question. Were very sensitive to the issues that you raised. The decision when to ease the restrictions on travel across the Border is based on the science and the data that the centers for Disease Control has. Its a public health decision, its based on the wellbeing of The American public. Were mindful of the economic consequences of the restrictions that currently exist and those will be eased as the public imperative dictates. [question inaudible] we have imposed restrictions for the Public Health Impair Ty and guided by that. So essential travelers are indeed able to cross through the ports of entry for the reason of their essential nature. So its a very measured calculated approach that addresses the public health imperative and also the objectives of their identity as essential workers. [question inaudible] i met with the children. Young girls. You know, its interesting. They have obviously great harm without their parents. They are also full of hope. They were asking me questions. How do you become the first woman Vice President. But it also reminds me of the fact that this is this issue cannot be reduced to a political issue. Were talking about children. Were talking about families. Were talking about suffering. Our approach has to be thoughtful and effective. We can take all of these perspectives into account and have meaningful public policy. If we stop the Rhetoric And Finger pointing and do what we need to do, including as Chairman Durbin has been doing for years, agreeing that we need Immigration Reform in our Country And Congress must act. Lets do the work of agreeing. You cant just react to a problem without solving it at its roots. So when i think about what i heard inside today, ill tell you very reaffirming of everything that i heard going to guatemala. Everything that i discussed with president president obrador. A very clear and direct connection. Literally direct and clear. But i will tell you one of the things that every place has been a theme has been people dont want to leave home if they dont have to. [question inaudible] im meeting with a lot of folks. The work that we have begun is on going. Theres no question that our approach to this issue has to be with a commitment to a longterm investment and it has to be a commitment to consistency. The United States has to be consistent. There were times when we were more engaged and We Saw good results. Less engaged and we can see where the work and the partnership has deteriorated. Im committed to ensuring that we engage in an active way On The Road causes on addressing the Cause And Effect and being partners in the Western Hemisphere, understanding that we have a responsibility and if we ignore that responsibility, it will visit itself upon us in a very domestic way. Its about 95 degrees taking questions from the pool that has traveled down to the Border along with them. You know, gillian is here with me. She toured a customs and Border-patrol'>Border Patrol facility, talked to a few migrants. Obviously didnt talk to a lot of people outside that including a lot of people deeply affected by the illegal immigration that has been surging across our Border. Gillian good point. Folks dealing with the crisis, The Americans dealing with this crisis in their every day lives week after week now. The farmers and ranchers, the Border-patrol'>Border Patrol agents trying to protect these people. John local sheriffs. Gillian curious to know if she spoke to any americans on this, her trip to The American side of the Border. We dont know. John she clearly wants to get to the Root Causes of immigration. Gillian that was 100 clear. John its not clear indeed how youre going to do that. Shes met with the president Of Guatemala and the president Of Mexico. Theres still two other president s that she hasnt met with and these people coming in from countries that are guatemala and El Salvador. And are the leaders actually interesting in addressing the Root Causes. Thats the big million dollar question. John they are sure are interested in getting hundreds of millions of american money. Well see. Gillian shes for Root Causes. We have no indication from the president Of Mexico that his goals align with hers. John lets talk about this. Lets bring in chris wallace. Chris, a lot of words were spoken, but didnt hear much in the way of solutions presented today. Well, we did hear one solution. That is that nobody is going to be able to ask Kamala Harris why havent you been to the Border yet. She has now been to the Border. So she took care of that. On the question which i think most americans are asking, which is how are we going to prevent hundreds of thousands of people from coming across the Border illegally as they have since Joe Biden became president , there were no answers there. She did talk about Root Causes and reforms at the Border. There was nothing that was go to turn off the spigot and stop this flood of illegal immigrants coming across the Border, which started when Joe Biden lifted some of the restrictions of the Trump Era on people coming across especially Unaccompanied Minors. The problem with the Root Causes and ultimately its selfevident. The reason people make the long trip from guatemala or El Salvador or mexico, think think the situation is better here than it is in their country. That is obvious. To address the crime, the poverty, the corruption in those countries is going to take years and as you talked about hundreds of millions if not billions of dollars. That may be the ultimate solution. Certainly isnt a quick solution and you sure didnt hear a quick solution to try to at least stem the flow of illegal immigration from the Vice President today. Gillian everybody that just spoke right now, chris, was very heavy on diplomatic speak. My notes from listening for the last half an hour read something like Root Causes, Root Causes, Root Causes, humanitarian approach, comprehensive solution. What i didnt hear was anything practical. I didnt hear a single proposal from anybody at this Press Conference that points at a solution. Heavy on diagnosis, very thin on solutions. I agree. I mean, for instance, Dick Durbin came and talked about Immigration Reform. Everybody agree thats is needed as well. But at least at this point, theres zero chance of a comprehensive immigration plan passing the senate and the house. Really no movement towards that right now. A plan that would create a path to citizenship for the people that have been here longterm that would deal with the dreamers, that would vastly increase security at the wall. There was no discussion of increasing the trump Border wall. So do want to listen in here . John hang on for a second. Im not sure what is happening. This Looks more like gathering of a Group Photo than anything. Keep making your point, chris. I dont think shes saying anything. Yes, comprehensive Immigration Reform would go a long way but theres no practical movement in that direction and i dont see the biden administration spEnding a lot of political capitol. Theyre short on capitol after the Infrastructure Bill. I dont see them spEnding a lot of political capital on a are comprehensive immigration package. I agree with you. Shes been at the Border. Checked that off. I dont think its a coincidence that she took this trip right now just a few days before former President Trump is going to the Border and she thinks having gone it will stop the president from criticizing her, i think shes got another thing coming. My guess is hes going to blast her and the biden administration and what he will say is lord knows Theres Plenty of criticism with the trump policies but a policy at least stopping the illegal immigration much more so than under President Biden. John even though the Biden Harris likes to say, there was a broken and inhumane Immigration System under place in the last administration. Couple things that i thought were worthy of note. Veronica escobar said upon arrival to El Paso, welcome to the new Ellis Island, which is suggestive that the democrats might be pursuing an open Border-policy'>Border Policy here in terms of Immigration Reform should they get to that. And then this island that mayorkas was asked about rescinding title 42 exclusions which have allowed Border'>Customs And Border protection to exclude Tens Of Thousands that have come across illegally. Chris, if that is rescinded, i mean, it sounds like Katie Bar the door. Everybody will be coming across and everybody that tried to come across and were sent back will likely try again. Yeah, i agree with you, john. Title 42 was the Policy Put in place under President Trump, particularly with covid, that basically said because of the concern with covid that people might come across the Border and may not be following the same mitigation regiment and that they would be spreading the disease. Theres active talk about not making it harder to get across the Border but easier, particularly by lifting of title 42. If that happens, the kind of Border-flow'>Border Flow that weve been seeing in the first few months, which is at record levels, 180,000 a month, it will be multiples of that if you take away the restrictions that we have now. Gillian chris, theres an iron any today when you Look at World Affairs and what is happening. That on the same day the Vice President travels to the Border and says were here to Look at Root Causes in guatemala and El Salvador where the u. S. Is pulling out of afghanistan where we just lived the past 18 years that the United States despite trillions of dollars, thousands of american lives was not able to affect Root Causes in that country. Theres a certain hubris that comes with now claiming that were going to solve the Border problems by going into these other countries and fixing their problems. Is there not . No, that is a good point. I hadnt thought of that connection, gillian. I think youre quite right there. We have been in afghanistan since the fall, the late fall of 2001. Were basically leaving almost 20 years later and throwing our hands up and saying we werent able to transform afghanistan even with the presence of 100,000 troops at one point, american troops and even more nato troops and the expEnditure of hundreds of billions of dollars, a report that just came out that you talked about today, the projection that once were gone, that the afghan government that we worked so hard could fall to the taliban in six months. So the idea that, you know, with a much smaller scale operation, you know, yes, some money but not nearly the boots on the ground and i dont mean that in terms of military but just personnel that were going to transform the northern triangle of Mexico And Deal with the Root Causes andsuddenly that no person living in guatemala says i wont take this dangerous trip and go to the southern Border because life will be threater there. To stop that desire and that is the practical solution, theres is hubris involved in that. John weve tried to change many countries. That didnt work out well. Gillian is a smart cookie. Ive been coming here five years to this spot. I have never seen it so packed. According to city officials, 2,500 migrants from all over the world. Thats despite what the Vice President said about not coming here and you wont be allowed in. So the question is why and what responsibility does the administration possibly have . Let me tell you what they told me. Three things. It isnt just lifting President Trumps policies but the adoption of new ones. Well go by the traffic here. Its packed. John, i can tell you in the past, under this overpass was parking. Over there was parking. Over there were streets. This has been taken over. People come in and are not leaving. Number 1, the u. S. Is now granting humanitarian parole to 8,000 individuals so far. Basically that is for people vulnerable, lgbt, people trafficked and so forth. People are seeing that happen. Secondly, weve expected eligibility for asylum. In the past, it was politics, race, sex. Now according to the Attorney General, gang and Domestic Violence are also making you eligible for possible asylum and that belief that title 42 will End. Maybe as early as July 22 for women and children. People here see people here going over the Border and that gives them hope. So in essence, you can hear it from the southerned Sound Bites from earlier today. People are going in. That gives you an incentive to stay. We have dreams about going. We hope one day that will be our day, too. So basically the belief is that if youre patient, they have an app. The u. S. Allows you to put your information in saying youre a victim. The u. S. Will take 15, 20 people a day to qualify for that. Now, i talked Border'>Ant Border agents as well as advocates for the migrants. They say hey, you can add 2,000 more Border-patrol'>Border Patrol agents right back there. Its not going to make a difference until you solve basically this issue on the back side. The things that you guys have been talking about, some kind of a legal pathway for people that really are eligible for asylum because right now theyre here, they think theyre going to get in and they stay. It gets bigger and bigger. City of tijuana closed this down. They took away the showers and bathrooms. Its horrible. Its a hell problem. They cant take care of it because they cant open the Border until they clear the camp and that is becoming difficult. Back to you. Gillian so william, Looking at the pictures there, i want to ask you this question because you spent so much time covering this. You said theyre processing, hoping to process 1015 people a day. Looks like theres thousands. Are they going to be there for years . I talked to one gentleman from haiti who has Border-patrol'>Border Patrol agent here a year. The u. S. Allowed 8,000 individuals under humanitarian parole. Its 12,000 that we let in from mpp. A lot of individuals that is giving these individuals here hope. Theyre not going home. Its a violent situation in central mexico. They believe theyre still going to get in at some point. Gillian . John a lot of people that have to go somewhere. Thanks, william. Weve seen urban Rescue Traffic and the Ladder Track in Operation Spaying Water in the damaged condos there, setting the dust and putting out fires. This is still a Search And Rescue operation. Heres what Governor Desantis had to say. They are trying to identify survivors. They have made contact with some and theyre doing everything they can to save lives. They were on the scene before we knew whether there would be more collapse. We didnt know whether the building had any structural in integrity. It was the horrific video where americans watched the death of George Floyd. We know a man has been convicteded in his death. The outrage that emanated from that video from that moment on Memorial Day of 2020 is about to get some sort of finality here. The family says they wont be a closure moment. That is a difficult phrase for these sorts of situations where families are concerned. They probably will never find that completely. Its interesting. One of the things we know the prosecution is asking for 30 years and the range is expected to be something like 12. 5 years to 40 years in prison. Ive read other analysis that says 18 years would be about right. Another question of whether or not he will get time served. I think that anything one former City Councilmember in minneapolis said Anything North of 20 he believes will be seen as a just sentence for Derek Chauvin. John for folks at home hearing the numbers, the Statute Calls for a maximum of 40 years. Its believed that anything over 30 years would likely be overturned on appeal. So the judge doesnt want to do that. Theres this idea of well, what is a presumptive sentence . It falls in the middle, and 12 1 2 years. Those are the numbers were talking about why. Eric nelson, Chauvins Attorney is calling for probation. We know that is not going to happen. Martha he also called to have the trial overturned which was rejected. John and then also this idea of an appeal. The idea of an appeal centers around this jury, Brandon Mitchell who was seen wearing a black lives tshirt at a rally in washington d. C. The judge himself said Look, i dont think that affected the outcome of the trial but may be grounds for reversal on appeal, this is not over by any stretch of the imagination. Martha very exclusive story when it cam out about Brandon Mitchell wearing the tshirt. All the jurors were asked if you were in protests. He didnt consider that to fall in a category. He thought it was a broader protest. I think its unlikely and i think theres a question about redoing there trial and what that would dredge up in terms of what has already come to the service with all of this. Well see. You know, well see if that door is open. I think it will be interesting to see if the judge gives him time served. Just to remind people going back to the numbers here, he was found guilty of second Degree Murder. John sorry to interrupt. The judge is speaking. Ill ask for people that are Smoke Aing to come up and use the microphone. Please remove your mask so we can hear you clearly. Also to maintain the distances that we have set out in the courtroom. With that, well proceed with the state. Mr. Blackwell, you may proceed with victim input. Your honor, we have four victim impact statements. We will start with the 7yearold daughter of George Floyd, Giana Floyd that will present hers by video. What do you miss most about your daddy . I ask about him all the time. And thats about it. Well, when you ask about him, what do you ask about . Well, how did my dad get hurt. Do you wish that he was still here with us . Yeah. But he is. Through his yes. Yeah. And when you see your daddy again one day, what do you want to do when you see him . I want to play with him. What kind of games do you want to play with him . I want to play with him, have fun, go on a plane ride. Thats it. Yeah . We used to have dinner every night before we went to bed. My daddy always used to help me brush my teeth. Do you miss him helping brush your teeth . Yes. How do you hope that the world remembers him . Well, those mean people did something to him. If you could say anything to your daddy right now, what would it be . It would be i miss you and i love you. All right. Thank you, giana. I appreciate you answering questions today. Neil part of the sentencing. Lets bring martha back in. Martha, you heard from his young daughter is. What impact will this have potentially on the sentencing . You know, obviously its always emotional when you hear from Family Members. This is his 7yearold daughter, giana. We expect to hear from a maximum of seven Family Members that will speak today. Youll see a lot of the members of George Floyds family get up and give statements about the impact on their lives. Its interesting to Look at the Aggravating Factors, john, being considered here. Particular cruelty is one that the judge has said hes going to consider. Aggravating factor in this case. Fact that it happened in front of a group and there were children. The judge has said its abuse of office a because of the badge, abuse of your position in the community are Aggravating Factors. These will be big components when he Looks at how much time he believeses that Derek Chauvin should serve in this crime. John we should mention, were expecting the Prosecution And Defense to make their arguments for a long sentence on the part of the prosecution and for no sentence other than probation on the part of the defense. Yeah, thats correct. Judge Peter Cahill has been interesting to watch throughout this process. It was interesting that Derek Chauvin, there were some people that thought he might make a statement during the trial. He might take the stand. He has that Opportunity Today as well. If Theres Anything that Derek Chauvin wants to say at this moment, today would be the opportunity to to do that. We dont know yet whether or not he will take that opportunity. The family has said that they would rather not hear from him today but its his right to do that if he decides to makes a statement. Gillian you listed the Aggravating Factors here. Some of the things counting against chauvin in the judges eyes. On the flip side of that, theres these Mitigating Factors as well. I spoke to an attorney Last Night that said one of the Mitigating Factors that may work to reduce Chauvins Sentence is the conditions under which hes being held. Hes been isolated since he was arrested. Hes been essentially in Solitary Confinement 23 hours a day in a 10 by 10 cell. They take him outside an hour a day to exercise. Hes alone. They say that wont change. Hes many maximum Security Preson already. However long his sentence is, he will stay someplace like this. The judge might choose to take some mercy there and fact for that to the overall Sentencing Guidelines. A great point. Thaw talk about subtracting time served. It will probably be considered as part of that. That was part of the equation that came up with 18 years. I think 18 years would be seen as light. Theres an argument for that amount of time. This judge has been very fair throughout this process. He clearly has brought up the fact that he sees that this was an abuse of power. So you have second degree, unintentional manslaughter, third Degree Murder and the second Degree Man Slaughter charge. The State Law is that they would run currentlily and the consideration of time served. One other quick thing in speaking to the former City Councilmember in minneapolis. He talked about the fact that for a lot of people, they have moved on to a bigger problem. That is the result of what happened in the wake of this. We know George Floyd square became an area where there was additional violence. We know the police have been defunded. The City Council members are in the middle of an election. Most of them different reach the 60 threshold to be reelected. Theres a lot of rethinking on this. People of minneapolis are Looking around and seeing what the impact has been on their Police Force, the safety thats been decimated in their city and giving it thought as they move forward in terms of leadership. John We Saw with the president s statement on crime the other day that hes willing to make available covid funds in order the hire more Police Officers. Gillian martha, stick with us. I want to bring in ted williams. Hes a former d. C. Detective who is also been following this trial, this case for us. Ted, john said a few moments ago that whatever happens today, this is far from over, this is not the End of the road for Derek Chauvin. Theres going to be an appeal. To some degree, a lot of americans are watching this sentencing and acknowledging it is kind of like the pinnacle or the culmination of everything that has come before over the last 13 months. The murder, the video of the murder and the riots and the trial and the verdict. Is there any sense of what martha and john were speaking about a moment ago, people expecting some degree of closure here, at least emotional closure . I think theyre expecting some degree of closure. I think martha has laid it out very, very well. There are both Hit Gaiting circumstances here that the judge will take into consideration as well as aggravating circumstances. The aggravating circumstances, number 1, is how floyd was treated. We all Saw A Man murdered right before our very eyes. Hes going to take in another aggravating circumstance that chauvin did in in front of children that is something else that will be taken in consideration. They will take into consideration that chauvin abused his authority as a Police Officer. On the mitigating circumstances, chauvin is 45 years old. He has some heart problems. He has no criminal record. They believe that clearly he would be a target in prison. So they are also Looking at something else that theyre going to have to explain meaning the defense in this case. That is that he is a product of a broken system. I dont know what that means. Theyre going to have to explain it. The thing i think that is going to hurt Chauvin Today is that he has not shown any remorse. Martha is right. It would be in chauvinist best interest if he could because hes facing an appeal, if he could get up and he remorse for this serious murder and would show some empathy for the victim. That has not happened. John so ted, as we pointed out, martha pointed out, hes been convicted on three counts, second Degree Murder, unintentional. He will be sentenced under the most serious. Second Degree Murder. The statute says 40 years. Practicality says 30 years. Its believed that he may get somewhere between 10 1 2 and 30. Where to you think the judge comes down here . I think okay. The citizen guidelines in this calls for between 10 to 15 year sentence. On the second Degree Murder alone, hes facing up to 40 years in prison. The third degree, hes facing at least up to 25 years in prison. On the second degree manslaughter, hes facing up to about ten years in prison. Those are all as martha explained run concurrently. So i believe if he does not show any remorse and i think the judge will come down a little over 20 years in this case, i would be Looking at 25 years. John really . That much . A lot of the conventional wisdom is leaning towards 12 1 2 years so you think he will get more than 20 . Oh, yes. I may be wrong. Im not the judge. I do believe that under the circumstances here and not having shown remorse. By the way, our audience needs to understand, the reason this man may not show any remorse is because of the appellate issues that martha outlined. One of them is that a gentleman who was on the injury did not inform the injury that he had been to a black Lives Matter Conference and did not expose that to the jury. I do believe it will come down over 20 years. Gillian martha, point to point out here, no matter what Sentence Chauvin receives today, i read this Last Night, the state of minnesota, its presumed a defEndant with good behavior will serve 2 3s in prison and the remainder on parole. So i think people have got to brace themselves for that. Were not going to learn that today. But over the coming years that is a Reality Check that people have to take into consideration and prepare themselves for. Absolutely. Hes likedly to serve a portion of this sentence, not the whole sentence. Thats the way it work in the judicial system. So he is as was just pointed out, 45 years old. He has a heart condition, a number of factors that may come into play here. Yeah, he probably wont be spEnding all the time hes sentenced in prison. So people know what id it is a on the Brandon Mitchell tshirt. It says get your knee off of our necks. Thats obviously a direct reference to the George Floyd case. But he argued that he was at an Mlk March in washington and it had nothing to do with that, that he was supporting the larger black lives matter movement. That is sort of the Life Line that Derek Chauvin has right now. The question whether it can be overturned. This case did not go well for him. Eric nelson, his attorney, did his best to represent him. There was very little ed in his favor when this broke down, a very difficult case from his side. Most of the thinking is that even on appeal, this will be a difficult cause to overturn. Emily compagno is with us. Everybody is waiting to hear what the fate of Derek Chauvin will be and how much time in prison the judge will give him. What is your thinking in terms of the Sentencing Guidelines are, the practical application of those guidelines is and what you think he will get. Ted williams said a moment ago he believes he could get 25 years in jail. What are you thinking . Right. I echo my colleagues comments here today. They provided sound brilliant analysis. Take it a step further. The reason why Defense Attorney Eric Nelson is arguing against this prison time, the underlying argument, he argues that the prosecution did not prove that the four Aggravating Factors exists at the time of George Floyds arrest. So theres a very specific argument. If i can Birds Eye View here. In the larger collective conversation around activist das that we havent seen here, thats what other people are seeing in other counties and jurisdictions. The das are failing to prosecute the enhancement. In this case, weve seen them prosecuted and Judge Cahill ruled they exist. So this is what were seeing play out in real world time, which is the existence of Aggravating Factors that the district attorney, the prosecutor prosecutes and then the judge indeed rules that they exist. Here to my colleagues points, yes, the Statute Guidelines go about 12 1 2 years for a firsttime offEnder. Note in the most relevant Comp Case in minnesota, in 2019, mold noir, deaths of a shooting of a woman there he was sentenced to 12 1 2 years. A lesser conviction there but sentenced to the minimum amount. To everyone elses points, i see an acknowledgement of that likely by Judge Cahill that will lead him short of the 40 years that would lead to a successful appeal. The state Attorney General has requested community impact statements. So not just victim Family Impact statements here but he invited them to submit it online the community impact statements. If i may, john as well keep going one more point further. My colleagues have discussed the appeal versus motions. What we heard in front of Judge Cahill involved the defense moving for a new trial and possible jury misconduct. Those are separate than the appeal. Both of those motions were denied by Judge Cahill. In terms of the sentencing, you guys, another birds eye perspective. A reminder that chauvin is facing a federal indictment for an unrelated event and also hes been indicted with three other officers there that day of a federal civil Rights Infringement there. That is an section 1983 case. So hes facing potentially an Difference Sentence maybe two tacked on in the federal sector in addition to hear what we will learn today will be his state penalty. Gillian emily, this is gillian. If we End up hearing from Chauvin Today, which is becoming less and less likely as the hour wears on, if he decides to speak, any Chance Anything he says will impact the Judges Sentencing Decision or that cake has been baked . You can argue the cake has been baked. We have not seen Chauvin Exhibit Remorse throughout the trial. I think any comments he makes at this point will be serving to create a different or shape a further narrative in the publics minds and also, again on appeal where frankly a lot has much to do with. What can he potentially say, emily, that might seem to be, i guess, for lack of a better word redemptive in the eyes of some people without throwing away grounds for appeal . A very carefully delicately worded exhibition of remorse. The reason i keep using that word is because thats a specific legal term as well. Ive been to many federal sentences where the judge says due to the Endants-acknowledgement'>DefEndants Acknowledgement of his behavior and remorse. That is what moves the needle with the state or the government accepting that. The Endant-pleading'>DefEndant Pleading with him to say yes, i have done this act and im so sorry. Here its delicate because this entire time hes maintained that yes, while he did that act overtly around purposely, that it was legal for certain reasons and that it still wasnt with that depraved intent required for the convictions. So here the element would be an exhibition of remove but so delicately worded not to assume guilt in any of the elements required to prove the three counts in the first place. Gillian ted, what if chauvin didnt talk about remorse or if it was not ever my intent to kill George Floyd. Hes not said that that were aware of to date. The jury in itself, you didnt have to actually have the intent to kill but the person was killed. So if making that statement would help him. I think emily and martha are both accurate. Remorse is something that courts are Looking for, particularly judges in the sentencing phase. That has not happened. I would be very surprised here today if chauvin said anything. When it comes to the appeal here, its more procedural. When i say that, it has really technically nothing to do directly with Chauvin But Everything indirectly. What were talking about is a juror that should have maybe made certain representations in court that that jury did not make. That would be Something Procedure that would not affect anything that he would say or to the court in remorse. He also hasnt shown any empathy to George Floyd. We all Saw A Man murdered before our eyes. We saw chauvin with his knee on this mans neck. The thing about it was that it wasnt like he was letting off of the mans neck. Seems like the long they are went on, he was forcing and pressing his knee further. Theres a lot to unwrap here. No doubt about it. I think the judge is going to be as fair as he possibly can. But i do believe that he will sentence him north of 20 years john well see what happens. When you Look back at that video from last year, you think how many ways that could have been treated differently. Officer chauvin didnt seem interested in any other remedy than The One he applied this child George Floyd. Ted, great to talk to you. Stand by. Martha in the next few minutes will be coming up with the rest of this. The process, this procedure expected to last two hours if not longer. As we await the sentencing here, we want to get in other big news this hour. Were hours away from the president s first face to face with the afghan president. Hes at the White House. The taliban has been gaining ground in half again stan ever since the u. S. Announced the troops would complete withdrawal. Lets bring in general jack keane. Hes a Fox News senior strategic analyst. General keen, its now Looking according to the latest maps that the taliban is controlling more than half of the territory inside afghanistan. Does that shock you . Yes, pretty close. Its not quite half. But nonetheless, this is a worsening situation. Its quite grave. Were at a point where in time President Biden will regret the decision he made to pull out all of the u. S. Troops. What is happening so our viewers can understand is ever since we have gone into negotiations with the taliban, the United States and the taliban itself in the previous administration, something had turned out to be flawed in terms of the deal itself. The taliban have continued to conduct their attacks. They have more casualties on the afghan security forces. The reason for that is because the u. S. Is not providing Air Support for the afghan Security Ground forces that is a fact. This momentum has moved towards the taliban as a result of it. Weve seen it before. An administration when we left iraq in 2011, gillian, the administration said were going to support you, this is vital in terms of United States even though were pulling out the troops. Three years later, we got isis. The person making that recommEndation to pull out to President Obama was President Biden. Were in a similar situation here now. Ive spoken to president ganni a number of occasions. Im confident hes going to want to hear that commitment from President Biden, to stay the course, not with the u. S. Troops but with u. S. Resources certainly to help this government and to help the afghan security forces. Really quiet amazing that the afghan has an Air Force of it left field. A lot of it is u. S. Airplanes, blackhawk helicopters and 18,000 contractors that maintain the planes are also leaving. That doesnt make any sense to the president or to me. He will make a claim on if not those contractors, some other contracts to help maintain that fleet. General, John Roberts here. We have about 90 second left. When we heard the taliban was going to take over broad sectors of afghanistan, i thought when a surprise. What could see that coming. The big question is, are they going to allow Alquaida And Isis to reconstitute in afghanistan. Oh, yeah. Absolutely. You think of taliban, you think of alquaida. They have been brothers. Theyre there now. They will expand and certainly reemerge. Look at this. What is happening is that President Biden by pulling the u. S. Troops out is asking the afghan government and the afghan security forces to ensure is that Alquaida And Isis to not rise to the level that they can attack the United States, which is their aspiration. If that socially that actually is the unwritten contract that is takes place here. It seems like the afghan president has every right to request the resources in support of that goal that this president is passing to him that is kind of where we are. This is a grave situation. Theres a lack of adequate Air Support. Gillian general, if you Look back over the last two decades that this conflict has Border-patrol'>Border Patrol agent going on that the United States has been involved there, has it been worth it when you hold that up to where we are right now today . Oh, yeah. Absolutely. We havent been attacked again. The whole purpose was going there to make sure that didnt happen. What many of us believe to include our European Allies that have participated in afghanistan, its prudent to maintain a small force there the president doesnt agree with that. John thanks, general.
