Indeed the case on religious rights is yet another unanimous decision from a court that president Joe Biden had declared out of whack and democratic leaders have declared hopelessly divided along ideological lines that 90 decision is significant in and of itself. It is. This has been a surprisingly unified court. We have had a series of unanimous or nearly unanimous decisions. Other decisions are strikingly nonideological, and it must be quite frustrating for these critics who are claiming thAt The court has to be fundamentally changed. Even the creation of an alternative court because they are so rigidly ideological and divided. The court seems to be speaking through these decisions. It doesnt rent billboards the way that some groups have done to try to force Justice Breyer to retire. It speaks and it is speaking in one voice. And the question is whether people are going to listen to the court or to its critics. Bret so just interpreting between the lines, you heard shannons report. But this is a big progress for religious freedom and the advocates of that. Does it tell you anything of the cases yet to council . Its a huge win for religious rights. The court here is dealing with something becoming a common conflict between antidiscrimination laws and both freedom of religion and free speech. In fact, the people that have sort of engineered this latest Masterpiece Cake Shop litigation may regret that because they could end up taking a narrow victory and making it a broad one. Some of the senators said you have to assure us that youre going to vote to preserve the aca which outrageous departure from precedent to say if you want confirmation you have to guarantee your vote on a pending case. Well, to her great credit, she didnt say i dont think there is any case there. Some of us did. I mean, i went on the air repeatedly saying look, this Aca Case is not a threAt To the survival of that act. It is very likely thAt This case will be dismissed it is essentially unlikely that it would result in the aca being struck down. But the narrative continued in the media and by members of congress that she was this existential threAt To the aca. This is an example where the rhetoric quickly outstrips relates. I doubt many of these members are going to come back and apologize to her. Thats just not done, unfortunately, in our age of rage. But she deserves an apology for that shameful treatment. Bret last thing, quickly, on the substance here, it is becoming clear thAt The aca, obamacare is very tough for republicans to unravel and, in fact, this democratic House And Senate is going to try to beef it up. And it seems like the court is saying that is their right and its going to continue. I think thats right. But, also, i think there are going to be justices unlikely to vote to accept another case of the aca. Been saying this now for weeks, urging the president to go to reconciliation. But you also have the moderate democrats in the senate in particular who are saying, look, we dont want to do it. We think we can get compromise, lets try to get compromise. The White House seems not to be taking a very authoritative hand in pushing one way or the other preferring to let democrats in Congress Work it out. Bret susan, by not doing thAt They are doing something. In other words. They are not pushing the moderate bipartisan approach. Susan actually i think the White House has been patient with stumbling up and down process of trying to seek a bipartisan deal. They have been more patient than i think the democratic leaders in congress might be if they were not dealing with the White House. I think it is always safe to bet against the deal.
