Theres nothing in the constitution that says the state of Texas Cant build a wall. The constitution does say that the federal government has unassailable authority over The Border. Professor turley went on to tell me that if the biden administration decides to sue texas over the texas Border Wall they are going to have to argue in court that they dont want a wall paid for by texas, built by texas on texas land. They would have to argue it wouldnt be effective or potentially interfere with their own federal operations. There is not lots of victims in this case. The advocates of religious liberty are happy. On the other hand, have the courts has the courts liberal block change their mind . No, i think they view it as a onetime only decision, like the Cake Baking Decision In Colorado a few years ago. They do not change underlying precedent and there will No Doubt be cases like this again in the future. Trace yeah, and we point out that a lower court, a circuit court, this actually, that philly could do this. You talk about the Catholic Church never turned down an lgbtq couple, the Catholic Diocese said if we came to us we would simply send them somewhere else. Chief justice John Roberts said philadelphia has made exceptions before, byron, theyre not making exceptions for the Catholic Church. Its not great. The reason we are going to see more of these cases, this was so clear cut the reason we are going to see more is that the forces of what you call wokism around the country are more and more aggressive these days. I think its going to be interesting is if you do get to a supreme Court Case where the court makes some bigger, more farreaching decision, how it splits up and how you see that 63 conservative majority on the court working out. Maybe even turning away mormon people, et cetera. What do you make of that argument that this could open up a bigger door . It seems implausible. The first thing you need in the case like this is a victim, someone whos been harmed by a practice by open discrimination on the part of some group and thats what we didnt have in this Catholic Social Services case. Thats what we dont have in these theoretical is that the aclu is talking about. So until you see something like that actually happen and it seems unlikely, there wont be any decision.
