The New York Times published its first article on the pentagon papers. Reflecting on the significance of the history it created, the New York Times writing today, quote, the lies revealed in the papers were of a generational scale. And for much of the American Public it seeded a suspicion of government that is even more widespread today. Remember a few years later came watergate, a scandal that forced a president to resign and raised even more distrust in government. And now, along with a republican assault on Voting Rights, we are learning more about efforts to dig up dirt on Congressional Democrats and others by Donald Trumps Department Of Justice. We have learned the current doj is revealing the ordeal. But today this New York Times article, trump subpoenaed apple about an account that belonged to don mcgahn. Apple was barred from telling mcgahn about it. Apple has not responded to the times. An attorney for mcgahn and the doj declined to comment. The Senate Majority leader wants answers. What has happened here are finger prints of a dictatorship, not a democracy. No one likes the idea that if a president s mad he can just go forth with setting personal phone data on perceived enemies. When it comes to sowing doubt, they are trying to convince voters that the 2020 election was stolen. It has led to death threats. Threats to take a life based on a lie, and that lay continues on, as reuters writes, trumps incendiary rhetoric could go to the 2022 midterm and 2024 vote. The threats, according to the Associated Press now leading local election workers to quit, raising concerns that partisans could step in to replace them. The attacks on Voting Rights are frankly hard to combat due to a lack of federal protections made possible by the supreme courts 2013 decision. Almost immediately after the ruling, republicanled stating began passing voter id laws. A voting case could be decided as early as tomorrow. Meric garland called often the passage of a bill named for john lewis. Joining us to discuss tomorrows rally, reverend dr. Liz harris. Thank you for being with us. I want to start with tomorrows Moral March On Manchin in West Virginia. What is the strategy behind the march . Well, thank you so much for having me and for being interested in these issues. The Poor Peoples Campaign is organized in more than 40 states across the country. The West Virginia coordinating committee invited the whole country in to West Virginia to stand with impacted leaders. Lowwageworkers, mineworkers, veterans from across West Virginia to hold a moral march to senator manchins office in charleston, West Virginia, calling out the senator, that he has the power, along with other colleagues in the senate to make sure that we do pass a Voting Rights act. We reinstate preclearance, that we make sure that we defend this democracy and raise wages and defend health care and all the things at that are connected to Voting Rights. So tomorrow at 5 00 eastern time, leaders from West Virginia will lead a march in charleston, West Virginia, calling on senator manchin to use his power to make sure that we do good. I want to play some sound from an activist in West Virginia, demanding action. Take a listen. Ive watched my senator sayin, talkin about compromise. And i wonder, what reality is he in . Does he think, is he that delusional . Or does he think we are that stupid . You got to have somebody to compromise to compromise. How long can manchin continue to hold out on this idea of compromise without actually delivering . Well, i think what were haeing from our lead errs in West Virginia, that thats is no time to wait for compromise, what has been compromised is the lives of the 350,000 people in West Virginia who are making less than a living wage, and what were hearing is that peoples lives are being compromised as we wait for folks to come together and push forward policies. The vast majority, the super majority of americans and West Virginians believe in, including and especially voting righting. So, so, so people in West Virginia are crying that the time is up, and its time now to pass all the protections of the 1965 Voting Rights act and caring for the 140 Million People in this country who are poor or one emergency away from desperate poverty. Reverend theo wallace, thank you for joining us. Attorney general Meric Garland announced he will double the staff in the dojs Civil Rights Division dedicated to protecting the right to vote. Garland will also review newlypass The State Laws aimed at restricting Ballot Access to meet the challenge of the current moment, we must rededicate the resources of the Department Of Justice to a critical part of its original mission. And forcing federal law to protect the franchise for all voters. We are scrutinizing new laws that seek to curb voter access and where we see violations, we will not hesitate to act. Joining me now, msnbc contributor joyce vance, a professor at the alabama stool school of law. Is this move alone enough to protect free and Fair Elections . I think the essential its a good first step. What really needs to happen here is restoration of the Voting Rights act, but Attorney General garland has done something i dont think weve ever seen before. Hes committed to fully using all of the statutory resources he has, provisions that are rarely used to fight back against voter suppression, to deal with these postelection audits that violate the law, to make registration easier for all americans. It was a very impressive strategic move by the Attorney General, and it will do a lot of good. Since you are out of alabama, i want to talk about the 2013 Voting Rights act. He wants them to pass the john lewis voting act. Talk about why this piece is essential. So this is the provision of the Voting Rights act called preclearance. And let me give you an example ive actually dealt with. Say you get to be a couple weeks out from an election and all of a sudden a state or municipality starts closing Polling Places in the majorityminority neighborhood, making it much more difficult for people in that neighborhood to go out and vote. Maybe its justified by voting numbers. Or maybe its the result of racial animus and an effort to suppress those votes. Under preclearance, the state of alabama couldnt do that without getting clearance from either doj or a court in washington, d. C. After the Shelby County case, states and municipalities are now free to make any changes that they want to. They can prune people off of voter rolls, they can close polling place. They can have these Id Requirements that are so restrictive for Voting Rights. So we really need a return to preclearance if were going to keep people, texas is a great example, where the courts found that there was intentional discrimination as some of these new rules were passed. If were going to keep those states out of the business of suppressing the rights of legitimate voters to vote. Heres thing. Restoring the Voting Rights act only really makes the difference it is intended to make if you have a Justice Department that is determined and committed to protecting the vote, bidens doj now has Kristin Clark serving in the departments civil rightstive igs. Hows to this new doj stack up against trumps Justice Department specifically when it comes to protecting blt access . Ive had the privilege of knowing Kristin Clark and working with her on Voting Matters for many years. She is extraordinarily talented. Shes smart, shes dedicated. She gets what use she can put these laws to. So we should all be very comfortable with the people that joe biden has appointed to this important work. Kristins boss, the associate Attorney General, vanita gupta is the former head of the Civil Rights Division. No doubt there is an important commitment here. They are used to working with the civil rights community. And nofrn these cases, doj can litigate some claims and private citizens have to step up and litigate others. So im very encouraged that well see the best use possible made of the laws. That said, none of this should take the burden off of the senate to pass the john lewis Voting Rights act and restore the voting acts right. And of course republicans across the country are emboldened by the big lie, now traveling to Arizona Garland called the abnormal methods popping up to review the 2020 election. What can the doj do to look at that arizona audit . So earlier, during the audit, a letter was actually written bay doj pam carland and pointed out that they might be running afoul of the law with this. The requirement for keeping an intact change of custody of ballots and of the equipment thats used for voting. So you cant just take your Voting Machines and go hand them over to a group called cyber ninjas, and some of the ideas, knocking on the doors of voters and scrutinizing their vote, that could run afoul of provisions that could arguably bleed over to prohibit voter suppression. Doj took a pretty strong stand. My guess is if we see early action by doj it will involve this arizona recount, which is absolutely a travesty of justice and just a perpetuation of the big lie. But the larger and more controversial issue has to do with the democratic lawmakers who were the subject of the subpoena, because its such a rare and unprecedented thing to happen. These members of the Intelligence Committee are trusted with the nations most closelyguarded secrets, and the idea that while they were being briefed on covert action, the Justice Department was secretly obtaining their phone and email records. Its stunning and has a lot of people calling for an investigation. And now there will be one. Many of the officials involved at the highest level of the Surveillance Program are still at the white house now. We should expect resignations. Do you have an idea what is going on at the doj . Yes, theres a real tension here, and it goes beyond donald trump and partisan politics. Carooer Justice Department have long been wanting to investigate leaks. Theyre happy to go after Phone Records and whatever else. We rely on senior members of the government to reign those people in. Apparently that didnt happen in this case, in part because we had a president and attorneys general screaming about leaks and had a hostile relationship with the press and only too happy to let these cases go forward. Interestingly, alicia, i should say that a source close to Rod Rosenstein and Jeff Sessions told us that neither of those men remembers or believes they authorized the subpoena of two democratic members of congress. Weve been talking about that piece of it. What do we know about this prosecutor from new jersey who oversaw the Leak Investigation . You know, certainly not a household name, not someone who had experience in these kinds of National Security and leak cases. But it appears that as in so many members, bill barr wanted to bring somebody in to revive what he viewed as these dormant leak cases that werent going anywhere. He wanted to make sure they were thoroughly investigated, turned over every rock. As far as we know, no charges have been brought. Barr said he had nothing to do with any subpoenas of democratic members of congress or stafferes. But its very clear that they were pressing really hard to try to make some of these leak cases, because they viewed some of the disclosures as extremely damaging, but, you know, it didnt go anywhere. And now the Department Of Justice Inspector General is going to get to the bottom, because there are a lot of competing stories about what actually happened. Hopefully is going to get to the bottom of who said what when, and how far did it go, which Career Officials were involved and did anyone violate the policy. Ken delainian, i anticipate you have a very busy week ahead of you. My next guest called on Attorney General Merrick Garland to clean house. With me, a congressman from illinois who sits on the house Intelligence Committee. Your top line reaction to this story. I think its shocking. Its outrageous, something that you hear or expect from Vladimir Putins russia. Or xi jinpings china. Its not something that youd expect in the united states, and this secret subpoena that was issued for the counsels records just begs the question, who else was caught up in this dragnet of secret subpoenas. Which other political opponents were caught up in this target list . And i think we absolutely need an investigation now more than ever. Do you buy this assertion that barr and sessions knew nothing about it . Not, not completely. I have to say that they need to come before congress and testify under oath with regard to that question. But just for a moment assuming that they really did not know, then it begs the question, did the white house create some kind of back channel to Line Prosecutors in the doj to get these secret subpoenas issued. And that, in and of itself is astonishing. Is there any precedent youre aware of, this subpoenaing of records of members of congress . Ive heard about subpoenaing members of congress who may be the subject of a specific corruption investigation, but i have not heard of one where the white house or Executive Branch investigates a coequal branch of government without any Predicate Evidence or reason to do so other than potentially trying to gather dirt on them as leverage. In a Fishing Expedition and a political exercise. The doj wont say whether there were republicans involved in this, if there is an investigation within congress, people found to have broken the law, what consequences might they face . Well, they need to be held accountable. And the various penalties associated with breaking our laws are wellknown, but beyond that, we have to put guard rails in place to prevent this from happening again. That starts with changing doj policy. It then goes to Firing Prosecutors who actually thought it was okay to issue these secret subpoenas against members of congress. And third, it might require legislative reforms that prevent any future administration from doing the same, because, you know, any assumption that only people of integrity would be present or would be running the doj, unfortunately, have been proven to be wrong. I do want to ask you, you had over at the New York Times op ed, he says, quote, theres an of ha measure available that manchin could consider as an alternative to abolition, weakening the filibuster by taking its threshold to 55 votes instead of 60. He argues that would put some of the Things Manchin wants to be put in play while still having ideological legislating, i wouldnt what you think about that idea. Im not sure about that. Unfortunately, the threshold of 55 or 60, i think, would be used in the same way that the current filibuster is used, which is just to basically frustrate every single measure that a tiny minority might oppose. Now, if you were talking about maybe a speaking filibuster, at some lower threshold, perhaps that might make sense, but there has to be a fundamental reform of the nature of the filibuster. It cant just be an email to the Senate Majority Leaders Office saying i filibuster this. I personally think the filibuster has outlasted its usefulness and should go away at this point. Reflecting kind of the mood among israelis, that first they dont have to sit through a fifth election in two years, relief that they now have a sitting government for the first time in a long time, relief that the political stalemate may be over at least for now. Of course there is a very big meeting happening this week. Heres what putin recently said about biden in an exclusive interview with nbc news. Translator we have a bilateral relationship that has deteriorated. Former mr. Trump is a talented individual, extraordinary individual. It is my great hope there are advantages, some disadvantages what are some of the biggest Obstacles Biden is facing ahead of their meeting on wednesday . Right, i think one of the big messages that biden will send to putin is that america is not one cyber yard tale for the russians to really pursue and attack, and i think that has been a real issue for tis administration, not to mention the competition. If theyre talking about human rights and navalny, i think you will see that it didnt go very well, and we will wait to see whether there are things they can agree on, such as opening crossborder areas for relief in syria. And agreements were announced among the g7 leaders on a wide range of topics, such as 1 billion vaccine doses. There was agreement to cut more jobs and cut Carbon Emissions and addressed Ransomware Attacks and china. What does this signal about how World Leaders are welcoming biden, seeking to work again with the u. S. . So the g7 was about covid, about climate and also continued relevance. How do you really create this organization that was born in the 1970s, into an organization thats relevant in 2021 . And President Biden talked about america being back and back at the table. The question is exactly whos following. Because while everybody can sit around the table and have a really wonderful photo, all the divisions within the family, like your family and my family get papered over. And this really is a Clear Division between those on the one side, supporting belt and road, which is chinas real, started in 2019, program, and the now americanled, g7led build back better for the world. And you have really a battle of two different world views. The americans trying to get the italians and germans to say, yes, china is not just somebody you can trade with and not somebody that we just need Climate Change agreements with, but also a potential competitor in terms of values. The answer, which is not that complicated is, yes, there may be jobs. Theyre not necessarily the type of goodpaying job that is going to get someone back on their feet. Whats it going to take to provide not just jobs that are comfortable but jobs under which that people can comfortably live, raise a family . There are two things were tracking closely that are missing from this conversation. The first is where are those jobs come being back . Much of that is in the hospitality and leisure sectors where women have long dominated but also have long paid really low wages, in restaurants, forcing workers to rely on tips. Also these are jobs that are unpredictable and unstable. They make it hard for people to care and work. Until we attend to the low wages in those sectors, but also the care crisis in the country, were going to have women and especially moms in a terrible box. I want to talk about the care crisis. Its more in focus, it seems to me, in part because of the way the administration framed their infrastructure plan. Its unsustainable, right . Its not just about can we get past this bump in the road . It is about the fact that it is not working. There has to be a complete revision of americas care economy. What would that look like in your Perfect World . The pandemic has highlighted what has been long been broken about our care economy. Right now we have a care economy that relies on invisible and unpaid labor of mostly women and very underpaid labor of mostly women to do that work. So when our child care and elder care sector imploded, we shouldnt have been surprised. The challenge is, families cant afford to pay more.
