A lot of folks on this question of venue have said this is the city where terribly painful, horrible things happen from the death of George Floyd to businesses that were looted and burned down and destroyed, neighborhoods full of fear that it would be hard to have this trial in that city where so many people connected and not connected to the actual death of George Floyd were impacted in some way. I can see the argument, but lets look at obamacare. You dont get a case that should have been transferred because you have the citizens there that were actually forced to stay home. Oklahoma city and the list goes On And On And on. I agree. I dont see it as an appeal. I think the biggest issue on appeal is the Jury Instruction on seconddegree murder. That was essentially a Felony Murder Type statute. The jury was instructed the jury didnt have to have specific intent to injure on the assault. If we are searching for issues on appeal, i think it would happen today, but even more so my think it will be on the seconddegree murder, the highest charge and what the jury was given as instruction onto mens required. Shannon this is a motion for a new trial and the appeal as well but a number of ways the defense will go after this to try to get relief for the client convicted on all accounts. Quickly back to this juror, professor Jonathan Turley says this the same Uphill Battle in the show of an appeal but the question is whether anything in addition to the photo, it will have to be prepared to answer and the roger stone case.
