John, this probe is of Police Practices seems openended. What do you make of it . Neil, it has to be limited in this sense. Its not about isolated wrong doing. If Derek Chauvin is an example of someone who is a Rogue Cop and there was testimony by minnesota Police Department officers saying he violated Practice And Procedure at the department, then a pattern of Practice Investigation is not called for. This is an investigation to the Structure And Way that the whole department does its job. This is another example also that elections have consequences. There was concern that the federal government was becoming too intrusive the way that state and local Police Departments are doing their job. What the Justice Department is trying to get is to get the local and state departments, Police Departments to enter what are called Consent Decrees with the federal government where they agree to change the way they use force, the change their Policing Strategies and so on and then the federal government and the states create a new system of policing and it never goes through congress, doesnt really get to court. Neil you know, john, this is more legal question even though seems like im asking like a dictionaryrelated question. Systemic racism. Systemic, you know, targeting minorities. What is the legal definition of that and if that is what you are addressing, where does it go . Youre making an excellent point. Systemic racism is not in the federal law here. Its a Code Provision called 14141. Talks about systematically violating someones rights. It has to be cant just be Derek Chauvin and the other officers who he was with made mistakes. Were intentionally trying to kill George Floyd. It has to be something in the way the department as a whole does its job. For example, if the department as a whole in minneapolis was using choke holds in a way that was really unsafe and they were being trained to do it, thats the kind of thing that would be a systematic violation. Systematic racism is a rhetorical term. Its a term that the president and Vice President is using and has no way in the way the Justice Department is supposed to carry out its job here. The captured video and corresponding audio can either affirm or refute alleged inappropriate criminal behavior. So the video has the ability to be a very powerful and compelling Eye And Ear witness on both sides of the equation. Refute or affirm. Certainly in the one that became famous or infamous the entire nine minutes and 29 seconds caught on camera here. So im just wondering where this kind of technology takes us because that is fairly black and white issue that we see, what seems to be something senseless. Other times, you know, its kind of in the eyes of the beholder like this girl brandishing a knife and end up shot by a policeman. What are the limitations with this . So there are limitations. Like anything, theres pros and cons. A couple of the central problems with the capture to refute or affirm on a criminal Behavior Allegation is that video first of all can be manipulated. Video can be audio can be muffled or deleted. A lot of manipulation that can happen. One of the central problems, neil, is that the video may not provide the beginning, the middle and the end of The Story. Its absolutely critical that all elements of The Story are presented. When theyre bifurcated or deleted, you have a partial story. What you dont have them is factual context. Without factual context, there may be central elements of The Story that may deliberately not have been provided or indeliberately. Either way, a threatening crowd. Or the existence of a weapon that is outside the focus of the camera. That is a real problem. So bifurcated video, video that does not provide the entire story or The Story in its totally can only be partially informing in many cases. Now its standard procedure, police have the Body Cams on them. Cars and vehicles have them as well. I believe part of the strategy here is to expand that even more. How would you go about doing that . Better technology, number 1. 360degree video as well as video aligned with other video. So the Body Cam might along with a dashboard cam. Dashboard cam might align with a Vehicle Cam strategically positioned in the front or sides of the vehicle. In totality, youd be able to cobble together the separate pieces of video and be able to tell as a factual matter the exact story of what transpired from the very beginning to the very end with no omissions, no deletions, no ambiguity.
