We just wrapped up a Press Conference with the bill sponsors and we asked about House Speaker Nancy pelosi saying she has no plans to bring this bill to the floor while the president s commission is still studying the very proposal. They said they are really not surprised at that answer but they expressed faith that pelosi and others will change their minds and come along as more destructive decisions come down. In fact one of the bill sponsors said today they laid blame on the Supreme Court for the January 6th insurrection saying this Supreme Court has been Dismantling Democracy Allowing Dark Money in politics, gutting Voting Rights and paving the way for racist Voters Suppression and help put Donald Trump in the White House. They reject the assertion that they are packing the court in response. It will enable us to do justice and rectify the great injustice that was done in packing the court. Some people say we are packing the court, we are not packing it, we are unpacking it. Senator mcconnell in the publicans back to the court over the last couple of years. The proposal brings the total number of justices to 13 and the White House gave no comment as the commission is studying the Overhaul Proposal and until thats settled, Nancy Pelosi is out. Is the bill to expand the Supreme Court by 14 and would you commit to that . No. I support the president s commission to study such a proposal but right now we are back, our committees are working and we are putting together infrastructure. A lot of people are asking how likely this is to move forward in the short answer to that is really not likely without Filibuster Reform. Right now Senate Majority Leader Chuck Schumer has asked democrats to work with republicans on other issues, trying to find consensus. The expectation is that wont go very far and that democrats might become more willing to reform the filibuster which would provide an avenue for legislation like this and also other initiatives ranging from guncontrol to immigration. In this moment where the effort is led by his party its important to go back in time and here at Joe Biden in his own words on this issue over a series of decades. Listen. President roosevelt clearly had the right to send the United States Senate and United States Congress a proposal to pack the court but it was a bonehead idea. The senate stood firm in 37 in the Court Packing Attempt ended in this particular example the senate is resolved as distracted in todays debates. The next time we lose control they had three justices. Whoever has the most votes gets whatever they want but president s come and go. Supreme Court Justices say for generations. Sandra they thought it was a boneheaded idea but the party is embracing the very idea. Certain elements of his party are certainly embracing the idea but keep in mind that when roosevelt, fdr proposed the Court Packing Plan he was at the height of its power and popularity. It was just after the 1936 election that not only swept him in by a landslide but swept in big democratic majorities in the house and the senate and still, not only could he not get it passed but it caused a political reaction that permanently harmed the more progressive aspects of his domestic program. So that was a complete disaster. Now, look at us now. We are a deeply divided Country And President biden doesnt have anything like a mandate so i think from a political perspective its wise for him, for Speaker Pelosi to be tabling it at this point and in being in the position of lets form a committee. Sandra we just heard Nancy Pelosi, she supports that but not this. It was quite a News Conference that we heard just a few moments ago from those democratic lawmakers and one of them was rhett montero jones. Some very strong words about our Supreme Court and its justices. What i want people to understand is this crisis did not arrive overnight. Rather the Supreme Court has been an accomplice. In fact the Supreme Court, specifically the Roberts Court has been working to dismantle our democracy for years. Sandra please stand by, Breaking News of the White House and Jen Psaki was just asked about this effort. About proposed potential reform of the Supreme Court in one of the things they will look at is of course the size of the court but they will also look at at the courts in the constitutional system. The turnover of justices, and they will come back to the president with a report on what their discussions are and what their findings are. So we will wait to play out and still read that report. This is coming from some of its current member of congress, this is coming from the chairman of the house judiciary committee. Is the president and White House frustrated that Chairman Nadler didnt perhaps wait for this report from the commission that President Biden just called for last week . No. And thats a different set of legal position. And i expect, you have more to convey about more recommendations until he reads that report. They have a range of interviews and he will propose legislation. He believes that members of congress have the right to put forward at legislation on they support. His view is that he wants to hear from this commission that has a range of viewpoints. One more question. He said it that we must expand the court and we must abolish the filibuster to do it. Its a White House comfortable with a democratic senator explicitly linking those two ideas from the steps of the Supreme Court . The president believes in me Freedom Of Speech and that members can come forward and share their points of views on a range of issues including the future of the court. He has his own view and he looks forward to the senior recommendations that comes out of the court commission. Sandra we were listening to that together, your reaction on that . Shes being very careful like the president is, everybody has the Freedom Of Speech, and the message is clear here. President Biden Isnt supporting that yet at this time but it brings forth an important point. That brings forth those who favor this, over time the public sentiment will change. Thats public sentiment against Court Packing but they are hoping it will change over time. The initial reaction to Fdrs Plan was very negative but he gave a Fireside Chat and public opinion changed but ultimately the institutional conservatism of congress kept it from ever happening. Sandra would been showing the Balance Of Power in the court, also the number of Supreme Court justices throughout u. S. History, going back to number nine starting in 1869, saul. We saw changes before that on the steps of the Supreme Court making the case, this is not written in the constitution and we can change the number of that. To that you say, what . Constitutionally there is no question they are right, you dont need a constitutional amendment to do that. The question is, why are you doing it . If most people get the perception that its being done, that its changing because you dont like the results which again has happened in the situation of fdr, people are going to recoil from it. I think one thing. Justice roberts has really tried to do is put forth the notion that the court really isnt political. It may look that way, and it shouldnt be looked at in political terms. I think hes done a pretty good job of that. Sandra thats a good analysis. Going back to the words of montero jones that we played just before we went to Jen Psaki, he made the case in his own words that this is the Supreme Court that has been dismantling a democracy, that the court has been an accomplice in doing that. There were very strong words and ideas thrown around by the lawmakers when they presented this idea to the american people. John perhaps Congressman Jones forgot that John Roberts and the Chief Justice was the deciding vote in upholding the affordable care act. Thats not exactly vince democratic definition of dismantling democracy i would think. Sandra fair point to. The Demand Justice that was on the steps talks about our democracy depends on this. John, what were your thoughts when this News Conference played out on the steps . John i dont like the fact that there were six conservative leading justices, and we want to straighten things out, but packing the court may not be the appropriate way to do it. I think its worth pointing out that whatever Nancy Pelosi says she wont support the Bill And Wont bring it to the floor, it supports the commission and we will see where we are six or eight months from now. There is also this that we are following. A fourth straight night of protests in Brooklyn Center, minnesota. Officers arrested at least 24 people after hundreds gathered outside of the Police Department demanding justice for Dante Right. The unrest has been spreading to other major cities across the country and this is a former officer who shot and killed him. She is expected to make her first appearance next hour. How does it look there Today Steve . John as usual in the daytime its pretty quiet but when The Sun Goes Down its pretty rough. More than 500 people out last night, many of them throwing rocks and bottles at Police Officers. They pushed out some Concrete Boundaries as well as rebuilding that vents to try to offer more protection for the police station. Among the rioters last night there wasnt one man with a severed Pigs Head on a pike and a Police Hat on the Pigs Head, taunting the police. As for the Police Officer involved in the shooting, Kim Potter, she was charged with second Degree Manslaughter and could face ten years in prison for that shot. As far as who is to blame, we are seeing a wide range of opinions. On one side there is the family, who said this was no accident. On the other hand, on the other extreme, the head of the states police union, he blames not the police, he blames the 20yearold victim, Dante Right. He said in a radio interview, Dante Right if they would just comply was told was under arrest. They were arresting him on a warrant for weapons that set off a chain of events that eventually led to his death. Keep in mind if there was an opens arrest on a charge of attempted Armed Robbery. According to the fbi Crime Statistics for the year 2019, the latest year for which there are statistics, there were 48 Police Officers which were killed in felonious acts. Six of those were killed during Traffic Stops. That means that 13 of Police Officer deaths by felonious acts in 2019 word during Traffic Stops. They can be dangerous, clearly. They absolutely can be on the Watertown Offices eight years ago a couple of years ago were celebrating the marathon bombing, and they conducted a Traffic Stop and were met with gunfire and bombs being thrown. So you never know what is inside a vehicle and who could be there. I would suggest that they may or may be would go out on The Street with the officers and get firsthand knowledge of what Traffic Stop is involved and how they occur. Often times Traffic Stops are nonconfrontational and people go about their business, but those are domestic violence cases. I had the sticker on the tag of my car on the wrong way, silly me. But i was concerned. In a Traffic Stop as to how its going to unfold. So i was going to try to be as polite as possible into everything that the officer asked me to do. They thought just yesterday, an officer in for in Burlison Texas shot multiple times during a Traffic Stop and then you had that car horrible case in New Mexico back in february when an officer made a stop. He noticed the driver had a rifle in his car and asked him if he would turn over the rifle during the stop. At the guide took the rifle and shot the officer in the back of the head. Dante right did have an outstanding warrant against him, so when you go into these Traffic Stop situations you dont always know what you are facing. And that was something that political forces made it, and they meet at a loss. Mcveigh was pulled over for a Traffic Tag Violation and as a result was held quickly responsible for a Terrorist Attack in the united states and oklahoma city. We dont write the citations unless politicians have put the programs in place requesting estimate those sops. John its when the next Hour Ken Potter who is at the center of the shooting is going to have an additional appearance in court. She is charged second Degree Manslaughter which under the statute is someone who again, coupled with negligence, whereby creates a person with an unreasonable risk and causes the chance of causing death or great Bodily Harm to another. She could be facing prison time. The officer in that shooting was convicted and spent two years in prison, think of supervised release after that so she is potentially facing prison time. She has a right to have her day in court and a Due Process, there were defenses that could be raised and im sure she will be a devils advocate trying to raise those defenses but, thats an unfortunate action that happened the other day. Two weeks ago there were more than 4,000 people jammed into a space meant for a 250 here and the idea is to try to move these kids to any Family Member they may have in the united states or to shelters that health and human services operate throughout the country. The persons culpable negligence whereby the person creates an unreasonable risk and consciously takes chances of causing death or great Bodily Harm to another. Take us through that. So basically it says if a person causes the death of another, because they are negligent, that means they made a mistake. They screwed up and they screwed up because they created an unreasonable risk. Then, that person would be guilty of second Degree Manslaughter. It doesnt require any sort of intent to kill, nothing like that at all. It requires that you fail to perform in this case her duty as an officer reasonably and that ended up causing the death. But i have to say every cop creates an unreasonable risk every day to go out on the job because they are armed officers, their jobs have an inherent risk in it. And you have to keep in mind that this officer just as every officer that pulls somebody over runs their name and finds out theres an outstanding warrant, they are armed with that information. Now if its at jaywalking warrant, no big deal. But when you have an outstanding warrant because you failed to keep in contact with your Probation Officer, which is the case here with Daunte Wright, the case, the felony Armed Robbery of two women in an apartment was still pending. Daunte wright was a released pretrial and was supposed to keep in contact with his Probation Officer but he failed to do so. That is why the warrant issued. Officer potter knew this information went after she initiated a Traffic Stop and when the struggle ensued, thats where it leads to the question, whats reasonable and what is unreasonable when you are trying to stop somebody with a Felony Warrant .
