you say, and so many of the cases there's a white-hot moment it could go either way the jury might give the benefit of the doubt to the defendant, this one is really different and young the entire minnesota police force and you also heard about lieutenant zimmerman on friday circling around and instead of the blue wall of silence it's a blue wall of accusation calling out officer as a rogue in the big difference is the application of force was against a suspect who could not have been a danger to them. it's very well-established in force throughout the country, deadly force must be reserved for situations in which the officer is in danger and as i say their situation where an officer subjectively might think so at the time but you've seen the riveting videos, there is no way that anyone could conclude that officer was in danger as his knees stay on the neck of george floyd. jon: is the case george floyd was 6-foot for inches there were officers try to put them into the patrol car, yes he was handcuffed during the video that we've all seen but does the resisting arrest play any part in the defense. >> the short answer is no, these are really instantaneously decisions all the time the force is applied you are 100% right, he is a big guy, he's intoxicated and acting irrationally, he will not go in the car, all that justifies a certain level of force but now once he is as texas zimmerman said in mobile with his hands cuffed behind him and a prone position there is not a possible justification that's when you have to measure it you will hear the defense say maybe he could come back to consciousness but even so it wouldn't have been in a way that would've been threatening to the officers inconvenient, maybe, take a step back in the unlikely event that he comes back to life as it were, there is just no real argument that at the time he is applying the deadly force and that he's in real danger and that's what's pivotal under the law and the jury will have whether this is justified. jon: i want to take a look at the conclusion of the medical examiner, prosecutors seem to be distancing themselves from the medical examiner. that doctor doctor andrew baker noted that fentanyl in methamphetamine when his body and he had heart disease, heart and artery walls and drug use, he noted the cause of death was cardiopulmonary arrest. in the manner of death is a homicide. but on his physical condition and the drugs that were insistent. >> that is right, that's what's coming after a few more witnesses from the police department juergen have quite a slog, eight total medical witnesses who go both ways but the jury is going to be instructed if the force applies by derek by what killed floyd, then that is enough, yeah i think there's going to be an argument, more boring than my experience the jury if it gets conflicting testimony is likely to set it to the side and 0 in on the real focus that was this last week of the picture of nine minutes 29 seconds of the knee on the neck. jon: eric nelson the defense attorney is trying to raise reasonable doubt about the autopsy and its conclusions, here's what he had to say in court. >> doctor baker found none of what referred to as the telltale signs of his fixation, the evidence will show that mr. floyd died of cardiac arithmetic that occurred of hypertension, coronary disease, ingestion of methamphetamine and fentanyl in the general and flowing through his body. jon: if the jury accepts the findings is certainly could reduce the conviction, it could become a manslaughter if it's conviction at all that the presumption on my part. >> that's the perception on my part, they thought to keep the third degree end, that's what happened in the jury compromise will that play as a loss and reclaim the community, that is something that we do not know. this is the last part that reasonably remains to say it wasn't true asphyxiation but going back to what i said in the way the jury is going to be instructed even if they say it was a heart incident or had to do with the drugs, if the force applied in the knee on the neck is of substantial force, they are gonna be instructed that still counts. i think it'll be hard for the defense to say if other things happen and he was using drugs and had a bad heart then it was almost coincidental that he died when he did but your point about what charge they convicted him is a huge run not just for the trial but the whole way this has become a national event. jon: former u.s. attorney. thank you. jon: fortis governor ron desantis declaring a state of definitely brighter this year than last year we did not know what we were getting into i had the blessing of being there at the services morning it was brighter and he said after we had 50% capacity but trust me we might have a little bit more than that and we let everybody in. that is a reflection of religious leaders today who have said how did we handle this pandemic, especially in relationship to the mandate buyer political leaders, i think there's many religious leaders that said maybe we were a little bit too soft, maybe we allowed our political leaders to tell us that religious public worship was not essential. i think there's a lot of reflection that has to be done in the area but yes resurrection we are beginning again. jon: at the same time there are troubling numbers for christians regarding and for all face really regarding the number of people who profess to be affiliated with a church, synagogue, mosque, 47% say they are affiliated with church synagogue or mosques in this country that is down 20% over a very short period of time. >> 20% in 20 years, that is huge thank god membership in a church or synagogue or mosque is not a requirement to get into heaven, i did not see in the gospel there will be no church membership in heaven but let's be clear when there is no practice of your religion, your religion basically goes away, that is just the reality we have to practice and we have to exercise the muscle of faith and in the united states of america in these days the practice of faith is not being exercised and therefore it will go away. one thing we hear so often people that we run into all the time that i was a catholic priest for so many years and what i saw and i still see it today among friends i am spiritual but i am not religious, i am spiritual but i'm not religious, we are spiritual by the way we were made, it is up to us to practice that and to put our faith into action and is not easy, trust me maybe and maybe a confession to you but i'm not a member at any particular parish, i go every sunday but i'm not a member to join and give our personal data to other people these days, i think if we are not careful the fate that has created the immense values in our country of family and a higher power of objective truth that can go away if we are not careful. jon: we have less than a minute but has covid
