delaware and steve wilmington is in the southern border with a closer look at conditions on the ground. let's start with you, what is going on? >> reporter: 19 senators, republicans made it into the border, touring on foot and in gunboats. they saw the facility and donna, texas, a holding facility that has gotten some negative attention for overcrowding conditions. many senators in a fiery press conference later today criticized conditions inside donna and said there should be a change back to trump era policies. here is ted cruz. >> this is wrong and a direct consequence of policy decisions by the biden administration to start building the wall and return to catch and release and end the stay in mexico policy. >> reporter: number of democrats and biden officials toward a different border facility. they made the claim the surge has nothing to do with who is in the oval office, they are life and death and that is driving people to make the long march to the us, not any policies. one thing that cannot be argued are the numbers, looking at numbers of unaccompanied minors in the month of february alone, the border into the us, almost triple the number of unaccompanied minors crossing over. griff: thanks, steve. alicia: the biden administration's firing almost every member of the homeland security independent advisory council including several trump allies as the president faces mounting pressure to address the border surge. mark meredith is live in wilmington, delaware where biden is spending the weekend. >> reporter: president biden is getting updates what is going on at the border but republicans say if that was the case, more would be done to stem the surge crossing into the united states. they are seeing a large number of migrants coming into the country, this is predictable because of the weather this time of year and the economic disruption many latin american countries find themselves in. the white house is working to address migration issues with several countries including mexico. >> there are capacity issues in mexico we are in discussions with them about addressing and not in a position to accept and take the families, that is part of the diplomatic discussion they are having. >> this week the white house announcing vice president kamala harris will lead administration efforts to address what is going on at the border but a spokesman told reporters the vp has no plans to visit the border, no word when president biden may make a trip down there. he does plan to go but no indication when that should happen. there are reports we could see donald trump make a visit himself in the next few days or weeks. what you were talking about at the top, homeland security department shaking up an independent advisory committee, the homeland security secretary alejandro mayorkas dismissing members with trump ties saying the department needs them to advance the mission. griff: joining me as republican congresswoman and member of the house infrastructure committee, beth van dyne. thanks for taking time on a saturday. let me get your reaction to vice president harris spearheading? >> what was happening, you can start making policies without knowing the consequences of the policies. i was able to tour the kay bailey hutchison center in dallas earlier this week and we had at capacity 3 and a half days to create the center. it is very stark and very sterile and at capacity 5 days later and 2300 children in it. we are looking at 13 to 17-year-old males, unaccompanied minors with no idea, the administration had no idea where to put these kids so they are sending them thousands of miles from their families into these decompression centers where you have 2300 cots set up in one huge room, kids being identified, 50 pods where they are lined up to go to the bathrooms and outdoor plastic enclosed showers, no sunlight and this is a direct result of biden's open border policies, for a 100 day stop on deportation and at the same time, and immigrations and customs from doing their job. >> the latest numbers on friday, 18,000 unaccompanied minors in custody and a direct result in the trump era policies, is it your opinion the new administration should have anticipated seeing this happen given president biden was vice president in 2014 when they saw a similar crisis. >> i was on the border, i saw kids in cages and when you go down there they have so many more in these detention centers and they got 700% capacity at some of these centers, kids are showering once a week, they are sending them by bus, by plane to other places around the country but the biden administration has no plan and if they did not foresee that this was going to happen surely they should be able to come down to the border and see it firsthand and stop the policies they have created. >> you are traveling with the texas delegation, where are you going and why are you going? >> we will go to eagle pass and see firsthand how it is happening and talk to people who have feet on the ground witnessing this firsthand, whose responsibility it is to process these folks through and talk to them. that needs to happen right now. anyone who is considered the czar of this crisis needs to see it firsthand. >> another topic since you are on the infrastructure committee i have to ask your thoughts on pete buttigieg saying they will raise money for infrastructure? >> we can at all the taxes we want but until we have an infrastructure bill, $1.9 trillion we passed, what they claimed was covid relief but only 9% had to do with covid relief. with extra money on transportation, worry about increasing people's taxes, adding more money to what they are paying when they can barely afford it now. >> thank you for taking time, report back to us to let you know what you found. >> let's bring in democratic washington state congressman and chairman of the house armed services committee adam smith, thank you for being here. i want to put up some numbers here first, we can take a look at some official numbers, the recent number of migrants taken into custody. you can see there has been such a growing number, more than 78,000, february more than 100,000, october and february almost 400,000 and take a look at the video we have, 19 republican senators went to the border, to cruise, you can see the conditions. what are your thoughts on what needs to be done now? >> you are not showing me the picture. i can't see what you are showing. this is an enormous crisis and has been a crisis for a number of years and every president has had to deal with it, president obama had to deal with it, donald trump in office in 2019, we all remember the surge in numbers but the incredible desire people south of the border to come to this country put an anonymous a lot of pressure and it is an enormous public policy challenge. i agree with the congresswoman, to see how to handle it and make sure we are handling it in as humane a way as possible but involves policy not just in the us, new mexico and latin america to stop what has been happening for years and is an enormous public policy challenge without question. >> you are not able to see that video but with the video shows clearly is you have people laying side-by-side on this incredibly tight, packed and getting worse. this can't wait for a policy change or congress, something the president could address with executive action regardless of what is happening in other countries to deal with what is happening in our own? >> possibly. every president has struggled with this, the demand outstrips what we are able to handle. either they are here, south of the border in miserable conditions, how do we handle that crisis? it needs to be considered no doubt about it. >> take a listen to what the former chief patrol agent had to say about the situation? >> there is a monumental issue at the border overwhelming capabilities at the border because our systems are shutdown. unaccompanied children, takes away from the ability for effective border security. >> roy was from the tucson sector and we he reports that donald trump is interested in heading to the border but we haven't heard the current president or the vice president, and americans live along the border. >> no question the biden administration is taking this very seriously, the homeland security secretary has been to the border, the administration is talking about this the whole time. it would be appropriate for the president and vice president to go to the border. whether the president and vice president go to the border or whether donald trump goes to the border that is not going to change the policy the needs to be changed to address this crisis so i hope we are focusing on the broader crisis. >> while i have you here i want to talk about foreign policy. what should the us role be inferior when you consider russia is trying to expand its power? >> we want to stop isis from presenting a threat to the region. there are broader challenges, chaos in syria under the assad regime. there are a lot of problems but one of the things i hope we learn about the us can't solve every problem. we have to work with our partners to protect our core interests and our core interests are making sure violent extremist group called isis doesn't reconstitute, take territory and threaten and work with the iraqi government to try to maintain their stability and reduce iranian influence. it is not an easy part of the world. alicia: thanks for your time. much more on president biden's agenda tomorrow on fox news sunday. chris wallace talks to white house press secretary jen psaki. check local listings for time and channel. howard kurtz looks at the impact of the biden administration limiting press access to border facilities that are housing migrants tomorrow on media buzz at 11 am eastern. griff: subpoenas into top cuomo aids as workers make their voices heard about the scandal against the governor. alex hogan live in new york city with the latest. >> reporter: many protesters gathering against andrew cuomo who faces several investigations, outside new york city office demanding impeachment, some of them would be subpoenaed over harassment claims. according to the wall street journal she helped handle new york's pandemic response and earlier this year told democratic lawmakers she worried the nursing home death toll data would be used against them. new york republican leaders wanted into investigation whether this time last year governor cuomo gave testing priority to family members and others like the president of region are on, the pharmaceutical company that came up in antibody cocktail the reduced hospitalization. in a letter state senate minority leader robert bork wrote these actions would be agree just during normal times but particularly unconscionable because they heard early on during the pandemic and accusations as well. >> if this is true, transported these samples during a crisis when our first responders were restrained, he felt this was a priority, gross abuse of power. >> reporter: talking to the attorney general's office, she was asked about melissa derosa's work, and they were few and far between. andrew cuomo has denied many of these accusations and apologized about others saying he is sorry if it makes people feel uncomfortable. alicia: a chance of severe weather this weekend as many are cleaning up from storms that hit earlier this week. charles watson is live in alabama with the latest. >> reporter: it has been a long couple of days before the communities affected by the tornado outbreaks across the south including this alabama neighborhood where you can see there is significant damage. this home behind me and a few others in his neighborhood had the roofs ripped off, holes punched into the home where you can literally see into someone's bedroom. there are trees down and power lines down but the community is coming together to clean up. you can see this group out here from the church of highland who have been out here since 8:00 local time, moving large trees, cleaning up the debris that was tossed all over the place and offering support for the people who were affected. >> you never want to disaster to happen, it is not something you would want to happen to anyone but we have always done our best to make sure our church doesn't exist inside the 4 walls of the church, that we go out and help people when they are in need not just after a disaster but throughout the year. >> reporter: these volunteers are in communities all across alabama, they try to gather, when gentlemen we spoke to, doesn't matter if you are democrat, republican, black or white, the community is coming together to get this cleaned up. jillian: charles watson. griff: a new lawsuit over a gender transition cake. weight until you hear what they are telling fox news after the break. — they customize my car insurance so i only pay for what i need. alex: it was and it's a combination of incompetence and not have a plan in place if you want to make changes. hypocrisy because obviously we heard so much about policies in the trump administration and kids in cages all along and shocking lack of transparency. a lot of that is solely within their control and and how they respond and has put the president in a position where he will lose people in the left who was disappointed in his policies. he's going to lose people in the middle because of the incompetence and he may even lose the media because of a lack of transparency. i've seen more legitimate transparency in shooting wars where reporters are embedded than they provided to the american people around what's happening at the border and it's a real problem. griff: laura, let me let you weigh in on how you think. you can respond to that and also how you think the biden administration is handling this so far? >> well, let me first say that this is an enormous logistical challenge and issue president after president, under obama, under president trump, we are at the point where we are seeing the -- the -- every year a seasonal surge in migration anden increase in children because the trump policies kept the children in mexico. i live in a border community, those children were in migrant camps very dangerous in tijuana so biden changed the policy and when a 15-year-old girl knocks on the united states' door is accepted and she's cared for and september safe. now there are a lot of 16-year-olds crossing and that creates logistical challenge. you give biden enough time, he can handle that. he handled it with the vaccines and handled making sure paychecks got to american pockets with can recovery act. i do think it's a tremendous challenge for president after president and biden is no exception. griff: let me go to the transparency point that alex brought up and i agree with you, laura, this is an unbelievable problem. i just came out of tijuana. before i was in juárez and mataromoros in the last two weeks. but the administration refused, president biden to call on peter doocy at the white house. let me play you an exchange with peter doocy and jen psaki. >> we noted starting at the end of the campaign and into the transition and here at the white house, any time that the president has an event where he's given a list of reporters to call. fox is the only member of the 5 networks tv pool that has never been on the list in front of the president and i'm curious if that is official administration policy. >> we are here having a conversation, aren't we? do i take questions from you every time you come to the briefing room? griff: alex, you're in communications, what do you say is going on here? >> i think it's clear what's going on here and, again, it's a mistake. one of the arguments coming from the biden administration was that they were going to change the tone and the interaction not only with the american people but with the media and instead to, again, start with these kinds of heavy decisions about cherry-picking who they are going to call on and, jen knows there's a meaningful difference between her answering the questions and the president answering a question and chosing who he calls on. we will see how it plays out over time and hopefully they correct some of that but the combination of that along with the lack of transparency around things like the border, we will show it to you when we are ready, is a bad way to start in this regard and i think the media at large should try and hold them to account on that. one day it could be peter doocy and the next day it could be their folks. so i think they need to address this and change course. griff: laura, what do you say, can you defend the administration choosing to not call on our own peter doocy at the presidential press conference? >> well, i think if any news outlet under the trump administration you would have a long list as well. i understand being frustrated at not getting called on but if you want to talk about transparency generally, jen psaki is one example, doing press briefings on the regular which is a change from the previous administration, being open about information and sharing that information, having multiple press conferences across the different departments to make sure that reporters have access and can get their questions answered. so i don't agree that the biden administration is not been transparent. i think that they worked really hard to ensure that they broaden media access so the american people know what's going on. biden did incredibly well in press conference and answered tough questions some of which peter doocy would have asked. questions about the issues on the border. tough questions that didn't necessarily fit in line with what he wanted to talk about which are the tremendous success that is we have seen in the first hundred days with respect to the pandemic and the economic crisis. so i think we are doing okay on media access overall. griff: hopefully peter doocy can get to ask those questions. quickly, filibuster, you will hear about that. you can see, we can put up on the board here, democrats have used filibusters more than republicans over the obama-trump administrations, but i want to play for you in the way back machines what i call it which is what obama and biden were saying about being for the filibuster before biden is against it. watch. >> the filibusters is not stopping nominee or bill, that's why the founders put unlimited debate in. >> what they don't expect for one party be it republican or democrat to change the rules in the middle of the game so that they can make all the decisions while the other party is told to sit down and keep quiet. griff: just a few seconds, alex, i will go to you first. >> changing the filibuster is the worst idea since court packing as was pointed out by then senator biden. the senate is designed structured to preserve and protect minority rights. it is a huge mistake to do this and i would argue it's being talked about from a position of weakness. the way to get things done is to convince voters that your ideas are the best, not to change the rules so you can do it without -- without that support. griff: just a few seconds. i have to give laura a chance to weigh in. laura. >> i will just say this, the voters are with democrats and president biden on the stimulus and the republicans voted against it. there are for universal background checks, 96% of people and the republicans are against it. no one should be able to send an e-mail and stop an infrastructure bill from getting passed and americans getting put back to work. no one should be able to send that e-mail. not a single senator and so this filibuster needs to be reformed for the work of the american people, doesn't hit gridlock in the senate floor. griff: we will have to leave it there and pick it up when the issues comes up again. thank you for taking time. >> thank you. >> thank you. ♪ ♪ ♪ alicia: miami beach is under a state of emergency as the city enters another weekend of spring break. the vacation hot spot facing number of restrictions following swarms of tourists and unrests throughout the city, jonathan live with the latest. hi, jonathan. reporter: hi, there, alicia, standing on ocean drive, you can see it's a mellow afternoon. people cruising the streets. we expect it will get busier as we go into the evening hours. but so far this weekend the crowds have not been as large or as rackous as they were during previous weeks. 8:00 a.m. to 6:00 p.m. curfew in the entertainment district after 10:00 p.m. police are limiting car traffic to the island. they're limiting it to residents, hotel guests, delivery drivers and people traveling to work. the neighboring city of miami is called up additional officers to make sure unruly tourists don't take the party to their neck of the woods. >> we will not tolerate any kind of rowdy behavior, breaking personal property, hurting people, lawlessness, that's not going to be tolerated in the city of miami and we just want people to know that. this is not going to be something that will create national headlines. reporter: many island residents and workers say the restrictions are necessary to discourage fights and property damage that have occurred during past weekends. but many spring break tourists say the 8:00 p.m. curfew is way too early. >> you know how much we paid for a hotel room just a night?
