to shut down temporarily. in a statement, the clevelander said it has grown increasingly concerned with the safety of our dedicates employees and valued customers and the ability of the city to maintain a safe environment and is shutting us doors until at least wednesday and will reevaluate then. mike beach's city manager wants to keep the emergency measures in place until april 12th. they will expire tuesday unless something is done at a city meeting scheduled for this afternoon at three. back to you guys. will: ashley, thank you so much. good morning, will cain, pete hegseth and jedediah bila. miami beach is dealing with at least a couple of issues. one with, as every great event in this country has come to be known as a super-spreader event when it comes to covid, it's important to look back at those. we saw jesse watters to that on his program last night. after the super bowl, no great increase. but clearly what's going on in miami beach is something else as well, tourists and some accompanying violence, and that's why we're seeing some of these crackdowns. pete: no, that's right. at first you think s.w.a.t. team for spring breakers? doesn't seem necessary. if there really is violence, if there is, you know, if it's a chaotic scene where less edens there don't feel safe, that's a whole other issue that miami beach needs to address. some of these videos seem to make that case. these spring breakers really failed the basic test. you need to declare it a protest, and then it's all good. then it's open season. they forgot that, jed, so as a result, the s.w.a.t. team is dispersing them this morning. jedediah: i was wondering about the curfew because we know when we put them into effect and people are congregating outdoors, sometimes they go inside x that becomes more of an event. and what i heard from a few restaurant owners this week who are people i know who actually fled new york city during the lockdown went down to south beach to relocate because they couldn't make any money here, and they essentially were facing a lot of property destruction, and a lot of people were afraid to come into typically safe areas. there is something going on there that it seems to be that troublemakers are seizing on an opportunity knowing full well peace of people are -- peaceful people are going down there to have a good time. but i think the curfew was an effort to protect those business owners and establishments in large part. will: and now on to a story, a crisis that not only is not going away, but that is gaining steam, and that is the crisis on the southern border. the customs and border patrol of the united states of america is considering an unprecedented move, and that is releasing illegal immigrants detained without a scheduled court date, basically putting it up to the honor system to come back and adjudicate your own status here in the united states. here is a quote from a senior source inside the cbp. border patrol has no choice but to release people nearly immediately after apprehension because there's no space to hold people even to do necessary work, paperwork, such as the notice to appear. we are, we're learning more and more, pete, to do what's right, we're going to let you continue with the illegal activity that you started to do. please do what's right in the long run. pete: yeah, and we know how that's going to end. this is exclusive reporting to fox, we reached out to multiple officials before publishing the story and confirmed, indeed, that because of the amount of pressure, the inability to hold these people, so we've gone from with the trump policy remain in mexico, remain there while your case is being adjudicated. if it's a legitimate claim of asylum, you will be allowed to go through the process. the next step, now it's reverted back to the notice to i appear, expect notice to appear is a charging document that signals the intention of removal proceeding. if you're released into the country, you have a note to appear before a court in a year or two. we know that rarely happens. at least there's something in the process. this step is there is no notice to appear. you are just released because of, i don't know, covid or crowding or maybe that's what we wanted inside first place is open borders. you swarm the border patrol, they can't handle it. and to think, jed, that at this point you're basically getting people across the border and just releasing them, that's not a policy, that's chaos. jedediah: yeah. i mean, if you look at the images that we've been showing throughout the past couple of weeks, obviously, there is extreme crowding. it's no surprise to anyone that they would run out of space. there's just not unlimited space for an unlimited amount of people. i was surprised to learn that these processes of issuing these court dates takeses hours per person. i don't quite understand why or if there is not a way to kind of speed up that process to make sure that that stayed intact. it seems a bit silly to me to release people who then on their own have to say, oh, let me go appear in court. i don't know how many people would voluntarily take that step. i really don't know, but i can guarantee you there will be plenty that do not. so the question remains, of course, what you do in this situation. obviously, this doesn't even address the unaccompanied minorses, of which there are many. listen to newt gingrich. >> i think the entire left is living in fantasy world where you have thousands and thousands of people, 3,000 teenagers in the convention center in dallas who have come in illegally, when you have night after night of violence in portland at some point normal, everyday americans are going to realize the gap between the fantasy world of biden and harris and the real world of everyday americans. you basically have a fight between the american people and a democratic machine. and on almost every major issue now, the american people are on one side, and the machine is on the other. pete: the machine, actually, that feeds nicely into the next step. jed, you mentioned unaccompanied minors. we said 14,000 yesterday, it's up to 15,500 today. that's your golden ticket to get into the country. anyway, you mentioned the machine and the consequences of elections. this next story caught my eye yesterday and has huge implications. because when the democrats took control, maintained control of the house and took coof the senate, joe biden in the white house, they had complete control. the question is with such a thin majority in the senate, how much could they get pass. what tools would they use. they've done some things through reconciliation which only requires 50 votes plus the vice president. but other big pieces of legislation would require 60 votes because of a policy in the senate called the filibuster. that was between democrats and their utopian left-wing vision. the old school democrats standing in the way like joe manchin who have said we don't want to get rid of the filibuster, and we're going. to stand against it. well, there's a crack in one of those senators on the democrat side who's now saying i'll look at the filibuster, and it's dianne feinstein. here she is from september of 2020. she says i think the filibuster serves a purpose. it is not often used, it's often less used now than when i first came, and i think it's part of the senate that differentiates itself. remember, september 2020, that's before the election. we don't know who's going to win it which she's fearing maybe the republicans have the ability to overcome the filibuster. here's dianne feinstein on friday singing a different tune. ideally, the senate can reach bipartisan agreement. but if that proves impossible and republicans continue to abuse the filibuster by requiring cloture votes, i'm open to changing the way the senate filibuster rules are used. jed, raises eyebrows not just because of the amount of money they would want to spend and crazy programs, but the structure, packing the court, d.c. statehood, this would change the way the senate operates indefinitely. jedediah: it certainly would. and i always advise politicians to make sure that, when you make these rules, make sure you're comfortable with them if someone else is in power. as we know, you know, politicians -- and right my so in some cases -- can get very spiteful. and they'll say, oh, really? you thought this was a great idea when you were in charge, now how to you feel about it when we're in charge? yeah, it's great, you'll be able to push a whole bunch of stuff through now, but when your not in -- you're not in charge? they should really think long and or hard about the implications for the future in terms of policies they actually like and what it does to the power balance and structure itself. will: not to reverse this engine back all the way to step one, but the reason the filibuster is important is the united states is not a true democracy. it's a representative republic with all types of institutions put into place to protect minority interests. the constitution itself is a document designed to essentially protect minority, minority viewpoint interests against a super or a simple majority. the filibuster is one of those tools. it requires the senate to get to 60 votes instead of a simple 51 vote for sheer power to be exerted. we've talked often the democrats would look to change that process. you mentioned d.c. statehood. whatever it may be to increase their own power, to make a simple majority they could enact their will with. and when they were afraid they wouldn't be in power, of course they were in favor of the filibuster. but now that they have power, do away with the guardrails and do anything to check that power. pete: here's the crazy, scary cudgel they're using now, you're racist if -- will: yeah, they're calling it the jim crow filibuster. pete: because it was used to defend some racist laws in the past. can they hold up against the charges of racism, even though it's a fake one? i don't know if they can. will: well, what has? a few additional headlines. protests across the country, rallying against violence toward asian-americans. there are. [background sounds] will: the demonstrations come after eight people were shot and killed at massage parlors in the atlanta area. authorities have no evidence the shootings are a hate crime. a congressman-elect's widow winning a special election to win his seat after he dies from covid complications. she will be the first republican woman to represent the state in congress. her his, luke led low, passed away just days before he was to be sworn in. he was 41 years old. turning now to march madness, vcu exiting the tournament three hours before its round one game due to multiple positive covid-19 tests. meanwhile, virginia going down in the first round. the cavaliers being stunned by 13 seed ohio. i have to read this one -- [laughter] the big upset to of the day, the abilene christian bobcats shocking the world and upsetting the 3 seed texas longhorns. here to break town a busy week, former state department sportswoman morgan ortugas. what's your biggest takeaway? it was a leading question about putin and a killer, you got what every defense secretary would say on north korea, if necessary, we would need to fight. but that showdown in china, what's your big takeaway? they were very kiss respectful -- disrespectful to our delegation there. what's the state of that relationship? >> if you look at russia, china, north korea, these were a serious war of words that this administration was in and, of course, when this happened in the trump administration, we often got accused of president trump being reckless when, in fact, what lloyd austin said right there, the secretary of defense, is the same thing. what's the major difference? so, pete, you have a lot of rhetoric from the biden administration, from president biden himself, from the secretary of state and the secretary of defense that was very similar to what we said in the trump administration, but there is one major difference, pete. and that is we had a policy to back up what we were saying. we have yet to see if president biden and his team will follow through on threats. so what happened in the obama administration is they were very, very good, this is a lot of the same team from the obama administration, they were very good at tough words. but then whenever these actors, whenever these rogue states like russia, for example, invaded crimea, invaded ukraine to take over crimea, wety not back up that tough rhetoric with actual force. so i think these dictators, these people on the world stage know who's serious, and they know who isn't. so i'm happy with the rhetoric and the words. i don't mind tough language at all. we did it a lot in the trump administration. but it has to be backed up with credibility, as a credible threat of force. pete: so, morgan, how do xi jinping and vladimir putin, i mean, he charged joe biden to a live debate. do they take the new administration seriously? what is business like compared to what it was a little over a year ago? >> as you can imagine, it's a nice day. we're right across the street from the arena. it's such a monumental task that the city has taken on, they've tone a fantastic job, and we're excited to be a part of it. will: jenna, what's business been like? what is increasing business at this time? is it the teams themselves? is it the fans in the stands? it's everything -- >> [inaudible] [audio difficulty] and you asked about a year ago. it was exactly march 20th of last year -- [audio difficulty] will: we're having a little trouble hearing you. let's me see if keith's microphone is working more successfully. keith, let me ask you this, the rules dictate that the teams are can order carryout but it has to be from one restaurant. so the entire team has to at any one time patronize a single restaurant the i guess for covid protocols. how has that been for business? >> we've been doing well with carryout, but it's really the fact that we're right across the treat, we have all these people in the street, streets blocked off, so we have a tent outside, we've been seeing a lot more activity. people just want to be downtown and be a part of it all. as far as the carryout goes, that's hit or miss. that's not a significant part of our business, but it was this last year as we were going through this transition of, you know, shutdowns and now having 50% capacity and now 75% capacity, now we have people at the bar. so it's been really exciting to have people come into our restaurant again like they did a year ago. will: 68 teams with the support staff the, you might look into that carry carryout business. somebody's going to go far -- not texas. 25% in capacity in the stood and that has meant people walking into the restaurant, and that's got to be much better than it's been in the past year. >> it's amazing. and being part of a hotel as well has also been a real blessing. will: all right. thank you for getting up this morning. >> thank you so much. will: best of luck. >> thank you. will: take care. all right. one texas border town your warning president biden -- mayor warning president biden to ten up his actions on immigration a month ago. >> we do not have the resources available to house and accommodate these migrants. if you do force these individuals into our community, we will be forced into dire circumstances. will: that mayor joining us next with an update. ♪♪ ♪♪ ♪♪ so you want to make the best burger ever? >> good morning, and thank you for having me this morning on fox and friends. yes, limited resources include police and fire. i have a limited police force to go out and patrol the community, and we have some of these officers at the facilities to insure that lawfulness prevails at the facilities. that's one type of limited resources. they also have to take into consideration that the nonprofit organizations, a volunteer-based organization refs funding through people who -- receives funding through people who provide money, so those resources are limited. and i do think the passing of the $110 million through fema to help facilitate food and some type of -- however, that's just simply not enough. we do need infrastructure, we do need processing facilities, we need facilities that can accommodate migrants. pete: mr. mayor, a couple quick stats here. you've seen over 1300, you know this better than anybody, we were just told, migrant arrivals in your town just this month. there are over 5,000 my grant -- 15,000 migrant children in u.s. custody in total. since you gave that message to the biden administration, is none listening? because anyone care? -- does anyone care? >> well, i've had conversations with different subcommittees and committees in the house and senate, is and i've also talked to mr. rodriguez, who's part of the administration. and it feels like it's falling on deaf ears, it definitely feels that way, because unlike those in federal positions in washington, d.c., they have time. i don't have time. my counterpart and i have to respond immediately to these changing pieces of the puzzle and try to fit them in. i don't have the luxury of time. border governments do not have time to wait while the federal government continues to delay the response. this is a crisis. this is a crisis, period, flat out. calling it anything but is an absolute insult to none that's trying to facilitate the needs of these migrants and trying to insure that our communities are safe and to reinstate security and safety to our residents on the border. will: mayor, i'd love for you to describe that crisis. this is a story told in numbers. we can talk about the percentages, the rise in and increase in migrants crossing the border, but you're actually living it. del rio right there on the southern border of texas. >> right. will: what is it you see today that is vastly from -- vastly different from three, four, five, six, months ago? >> first and foremost, when we had the wasn't storm in texas, you had individuals crossing the river in subzero temperatures trying to get to the united states of america. so weather's obviously not going to be a deterrent. we also see, you know, individuals that are passing through our community golf course, for example, they were asking golfers there at the golf course for food and for shelter. and they asked police and border patrol to respond to that. when you have a breach of security at the del rio toll booth, when you have two breaches of security, that's a national security crisis when you have individuals and small groups trying to cross the fence. that, to me, is an immediate crisis. and to have department of homeland security on march 18th extend the closure, as they put it, of the port of entry to those residents, to those that hold a visa from mexico or canada, it's kind of a slap in the face because we as a community see unlawful entry happening every day, and the numbers are growing. how can you sit there to have one policy to protect american citizens from covid-19 by limiting unessential travel, and on the other hand concern pete: you're saying your port of entry is closed because of covid to nonessential travel. >> exactly. pete: yet you're watching migrantses run across the border, and they're running free. >> we're all scratching our heads because we see this happening every day. i have families hard divided, they haven't seen each other because of covid-19. some have lost members on the united states side, and family members haven't been able to cross to see them. it's really frustrating. jedediah: mayor, quickly, we're going to run out of time, and i really want to ask you what do you want to hear from the biden administration? what can they say to you -- how can they help you and your city? >> i would say provide an actual plan. provide an actual plan and bring us infrastructure and resources, you know? deploy border patrol and cbp officers to the border, insure that you have enough magistrates to process the i migrants. to hear they're going to be released without a court date, it's a failure. and if you could deploy, you know, americans to protect a building in washington, d.c., you could deploy the national guard or military to the border -- [inaudible] jedediah: mayor bruno lozano, thank you for being with us, we appreciate it. >> thank you for having me. jedediah: we're going to target some headlines now at this hour. a man is facing trial for murder in new jersey confesses to killing 15 is other people. sean lannon is already a person of interest in four killings across new mexico including the murder of his ex-wife. he was arrested following a multistate manhunt. and a stranger makes a life saving catch, saving a man from plunging head first off of a balcony. the man reportedly blacking out at a bank in india. watch as the person next to him grabs a single foot, stopping him from going over the edge. several hoars jumping in to help hoist him up. he was taken to the hospital to be checked out. >> and mike rowe announcing on his birthday that "dirty jobs" is getting a reboot. >> what is going to happen to me todaysome. >> today you're going to get covered in sludge. jedediah: discovery network's revealing will celebrate essential workers during the pandemic and their dirty jobs that keep civilization running. those are your headlines. i like that show. i don't know if you guys know it, but it's a good one. will: absolutely. pete: it is a great show. jedediah: yeah. pete: awesome guest, been on the show many, many times and tells the story that needs to be told and industries that people are totally unaware of where you make piles of cash, but you got to get dirty at the same time. he's awesome. we're going to toss it over to rick reichmuth who has not seen dirty for at least a year. but we don't know if he's wearing pants. i think there's a very fair argument the person should be paid fair market value for their unique skills in this world, but then let's not in turn -- this is the second part -- culturally pretend like the ncaa is this great plantation taking advantage of students. charles barkley's pointing out the curl churl side of -- cultural side of this conversation. egg is worthwhile. if -- education is worthwhile. you're saying essentially what you're getting in terms of a scholarship is worthless or even worse than that, jedediah, you're being taken advantage of and you're being the victim of this massive injustice. charles barkley, as always, seeing through with common sense on this issue. jedediah: yeah. you know, i like the way you put it when you talk about -- and, will, i'm sure this is a topic you've thought a lot about, but when you talk about a unique skill. i never really had a problem with college athletes getting paid for their likeness and what not, but i never put it quite so well or thought about it in that way. these are people of that have a gift in many cases that they bring to the table that other could not, so i think that's a really valuable thing. i also think a free education is a very valuable thing. those two conversations can coexist, but i really like the way you put it. i hadn't thought about it that way, but when you look at some of these college players, it's fascinating what they're capable of and what their futures look like. wlwell and i do think this is a debate that's worth while, but what charles is responding to is 90% of sports media that pretend it's one of the greatest injustices in the united states of america, that all college athletes get paid -- pete: and it feel like a really bad policy could eventually come out of it that totally ruins college sports in term of some other professional league. i don't know, i don't know the topic as well as you do, but good on charles barkley for always telling it like it is. all right, up next, instagram could soon expand to kids, but can the version actually be safe and secure? crossing the border illegally may be set free without a court date. jedediah: the unprecedented move comes as a new facility for up accompanied minors is set to open in texas. pete: mark meredith joins us live from washington with the exclusive reporting. >> reporter: good morning to you guys. the surge of migrants crossing into the u.s. is creating major headaches for the border control, and fox has learned officials may choose to release some migrants into the country without a court date for asylum hearings. this idea is reportedly under consideration in the rio grande valley in south texas. not official yet, but this could give us an idea of the challenges on the ground. facilities in the region said to be completely overwhelmed. on saturday the government announced plans to open a new unininflux care facility, repors of some 5,000 minor -- 15,000 minors in custody, and some lawmakers say the situation is out of control as the government considers all sorts of locations for shelters. >> this facility is going to house between 500-2,000 unaccompanied minors. it appears as if they're targeting unused man camps. these are oil facilities where oil workers are housed when they're operating in the oil and gas industry. >> reporter: the department of health and human services says the initial capacity is, quote, urgently needed as officials deal with the surge and also the need for crowd control because of the pandemic. back to you. will: mark if, thank you so much. so this is the story, this is the situation, and nancy pelosi says it's under control. let's take a quick tally, if we might for one moment. the surge is is great that in or to control the influx, officials have now begun to place migrants into unused man camps at oil fields throughout texas, book hotels -- which is another story we're following this morning -- placing migrants in hotels across the state of texas. as of yesterday, we talked about the story potentially shipping migrants to the northern barder of the united states of america -- border to the united states of america for processing. in our previous area we played a sound bite from newt gingrich talking about reality versus the distortion that the democratic machine is selling you. at some point you would have to think reality punctures this complete fabrication of the border being under control. this is your reality. pete: absolutely, it is. and in addition to all of those alternatives, the majority of these unaccompanied minors, kids who came illegally, are held by the standard of the media and the left in cages. because they're being held in the same facilities they were held in under the trump administration which were called kids in cages. so all the hyperbole that was used then, we check our hyperbole on this show. we understand they came here young, they should be cared for properly. but ultimately, because the policy is incentivizing this kind of movement, now we're completely overwhelmed. and you know, this is exclusive fox reporting that they're talking about the, considering releasing migrants, people who came here illegally, without a court date. you know the border patrol doesn't want to do that. you know they believe in the rule of law. they're clinging to the idea that at least there's a notice to appear in a court for a hearing when they release people, if you're considering doing that without -- you're releasing people without that, you've really reached the end of the road. and we had a mayor from a border town, del rio, texas, talking about, well, if you're a mayor in a town there where a lot of these migrants are being released, you don't have the luxury of time. listen. >> it feels like it's calling on deaf ears, it definitely feels that way. because unlike those in federal positions in washington, d.c., they have time. of i don't have time. my counterpart doug owens and i have to respond immediately to these changing pieces of the puzzle and try to fit them in in every single way possible. i don't have the luxury of time. we do not have time to wait while the federal government continues to delay the response -- [inaudible] this is a crisis. this is a border crisis, period, flat out. calling it anything but a crisis is a finish. pete: jed, he says he doesn't have time, and he also doesn't have input. no one's listening. we're in the age of covid, so the port of entry, the legal way to come through, has been closed to anything but essential travel meaning a lot of people can't go either way. but if you jump the border, you're released. so what does that say as far as what incentives are there as well? jedediah: it's utterly ridiculous. right now this is a conversation that's happening largely in these border towns because those are the communities that are being affected. but there's going to be a spillover. now they're looking to facilities that are on the northern border. people are talking about facilities in places like new york. this is just going to expand outward. so this is very soon going to become an issue that people across the country are talking about because it's going to be happening in their neighborhood, potentially, it's going to be un. ing closer x. this crowding, as we saw with that mayor also, he talked about resources, and there are limited resources and what do you do. all these issues are suddenly going to become front and center, and the biden administration better have some answers sooner rather than later because the problem is not going away anytime soon, and it's only progressing. we'll keep you up-to-date -- pete: jed, tell that to long island that has an ms-13 problem, still has to deal with it. jedediah: right. pete: every time it becomes a problem across america. jedediah: that's right. and is we're going to have nicole mag ya tackies on malliotakis on later, and we're going to be talking about what could happen there. this is a very important topic that deserves a lot of questions answered. as does another topic that we have been covering pretty extensively on this show, and that is governor andrew cuomo and the two scandals now sitting at his feet. one, the nursing home scandal and whether or not false information was given to the department of justice, and another you now have eight people that have come forward and alleged harassment or assault on behalf of governor cuomo as well as a hostile work environment, a toxic work environment and a pattern of bullying. now you see protests that are emerging in places like new york, and i guarantee you're going to see places even further out because there are a lot of people outside new york plugged into this issue as well thanks to the like of janice dean and others that have highlighted this. ing this is an anti-cuomo rally, and they were speaking out on saturday about why they are so entour rated with cuomo -- infuriated. >> how many women, how many survivors have to courageously come forward before we act? it is our responsibility to act. and that is exactly why we must initiate impeachment proceedings immediately. >> before the data was released from governor cuomo's a office, we thought it was 89 people we lost to covid inside, but it was 119 people. that is 119 people we will never get back. impeach cuomo! >> abuse does not define itself to one person or one area. someone who abuses their power doesn't just do it to one woman or one community. the only way we can hold this governor accountable is to impeach him. will: this rally as new sound is released from 2018 illustrating, i think, two things. one, the reports we've heard about a bullying style of governance from governor andrew cuomo, and secondarily, he might actually -- what he might actually think of republicans. listen to this call he had with the head of the working families party. in 2018 when it came to who they would endorse. listen to this. will: i don't know what's more eye-opening right there. an illustration of the tile of governing which we talked about or i guess the analogy what he actually thinks of republicans. [laughter] pete: that's true. i hadn't thought about that angle. of he's a partisan through and through, no doubt. here's what a spokesman for cuomo -- is that the most difficult job in america right now? it just might be -- said about this particular release. said this 3-year-old conversation happened after a very contentious political campaign. he doesn't remember it occurring, but from how it has been described, he is clearly being hyperbolic, it illustrates to offensive nature of the wfp's own name calling. so explaining it away he doesn't remember it but t on tape, that might be the best choice of words. will: we might suggest in endorsing you that we prefer you to someone from the other political party. according to cuomo -- jedediah: i -- will: go ahead. jedediah: i also love the timing. he'll say, oh, that was three years ago. it's amazing to me, brett kavanaugh has to remember what he wrote in his high school yearbook, but a conversation three years ago, oh, that was a lifetime ago. the double standard that exists, it's just absurd. absurd. pete: democrats always get away with not remembering. remember hillary clinton? she doesn't remember anything. will: that was -- [inaudible conversations] pete: that's why you do it. will: i will say, i will legitimately not remember anything. if you make me go back and recall something, i will be honest when i tell you i do not remember. [laughter] pete: i agree. it's one of the best parts of my life. i forget everything and, therefore, everything's new the next day. jedediah: well, i will tell you this, and you both know this or you guys both know this already, but women, we remember everything. [laughter] pete: on that note, we will move to some additional headlines. a 12-year-old boy is in critical condition after he's stabbed in the neck at donald's in pittsburgh. police say man, charles turner, lunged onto the boy while he was waiting in line with his family. he's charged with attempted merchandise as well as aggravated assault. no word on a possible motive. and an air force drone measuring 20 feet long washes up on a florida beach. the 650-pound drone was shot down over the gulf of mexico before coming ashore. people first feared it was a bomb or a missile. does look like that. massive drones like this are often used as aerial target for fighter pilots. and workers at the atlanta motor speedway working overtime to fix grass after it causes a crash. talk a look. take a look. >> and the second place finish last year got $100,000 in the dash for cash -- oh, my goodness! pete: i don't know that the grass caused the crash. i feel like he was out of control already. i don't know, let's read. josh berry destroying his car after hitting a bump in the infield. the grass will be leveled with the rest of the track for today's folds of honor. o.k., i get it. you can catch the race this afternoon only on fox, and lieutenant colonel dan on gnu joins us live later in the hour. and those are your headlines. did take a heck of a dig. will: yeah, i'm putting that on the grass. pete: what about the whole slide thing? >> well, i felt, i felt like i needed to do that because it's been a year, and we're concern everyone's really losing their motivation to do work. and it's not fair because all the other schools around the country have at least opened once this year. and it can be done, but it's not being done, and it needs to happen. jedediah: you know, mason, you were very open about talking about some of your challenges, some of the challenges you faced when it came to remote learning, and one thing you said that stood out to me was quite simple but powerful, wert not learning enough. can -- we are not learning enough. can you speak to some of the challenges that you face in. >> well, i think that there's a certain extent that the teachers can do. the teachers are doing amazing, and they're trying their hardest, but there's certain things you can't9 do through a screen. you can't work in groups, you can't, you can't, like, do tests, and they can't help you with them that much. and there's a lot of things that you just can't do through screen. and that the it just, it's not the same and that even if it is the same, we don't have motivation to do it. because what is the teacher going to do the, come into our house and tell us not to do it? we can't -- there's no way for them to do that, there's no way for them to push us so, therefore, we can't -- we really don't have any motivation to do our work. jedediah: you know, mason, when you think about school and the way it was before all of this, what do you miss the most? >> i miss the most probably my friends first and then, secondly, i miss, i miss having after-school clubs. i was in a bunch of clubs. i was in a video club, i was in this club called arts and the mind, i was in, i was in this drawing class. and there were many clubs that i've been through throughout the years, and it would be really nice to see my friends again because we miss being able to socialize with each other. because when we socialize, it makes school fun. and when we have school and it's fun, we have motivation to do our work. and right now it's only virtual school, it's hard to have that because it's not easy to talk with someone and do school through a screen. another reason that i think school, that i -- another another reason that i had after-school clubs that i loved and i still do, and i really miss them, and i was in those clubs before. jedediah: you know, mason, you're right, i used to be a teacher, and you've got to make it fun in order to make it something kids remember. i totally, totally get that. what would be your final message to administratorses or anyone who is saying, you know what? >> the transcription of the american -- description of the american media landscape and big tech absolutely correct. i don't agree with his legal solution of repealing the defamation standards set forth in new york times v. sullivan, which i can explain. it's a bit like using band-aid to cure cancer. will: for any media institution that falls outside of that one-party control whether or not it be this n or any other, whether or not it is individual voices on technology, social media companies, there is a concerted effort to silence what amounts to a very, very small minority when with it comes to the entire media landscape. >> that's ooh absolutely correct. and i think that the particular case that judge was ruling on was about changing the standards for defamation. the problem with the press today isn't defamation or libel, that's not for conservatives, they silence conservatives. and marley with the aid a of big tech, that's what's happening. wee need to see a media and a press that holds the government accountable. that's exactly why the government relaxed the standards for defamation as applied to government officials. the real issue is that we effectively have a state media that's failing and giving up on it obligation to hold government accountable. and big tech is really where the problem is, and those solutions are completely different than changing the new "the new york . sullivan standard -- will: yeah. outside the particulars of that case is his diagnose know sis of the american media is absolutely spot on. we seem to have completely lost the idea that more speech is good speech, that the way to solve our disagreements is by allowing more speech into the public sphere. now we're in a process of reducing the number of voices that you are allowed to hear. and one of the ways that's done, i know you're familiar with this debate, is basically through name-calling, through sullying someone's motivation or, in fact, their name. of course, racism is the bluntest tool being used in the toolbox right now when it comes to silencing people. and, in in fact it's being empld when it comes to senate tools like the filibuster. senator warren said the following: the filibuster has deep roots in racism, and it should not be permitted to serve that function or to create a veto for the minority. in a democracy it's majority if rules. first of all, i think that overlooks the fact that we are a republic, not a democracy. we're not a simple majority rule countriment of we have all types of protections against simple majorities. but the filibuster is racist? >> well, look, calling something racist is the surest fire way in the year 2021 to end the debate about anything. that's particular ironic, because ending the filibuster, it's a tool that's designed to protect political minorities. can we as a society have a reasonable debate about whether the filibuster's a good or bad thing? sure. but let's have that debate. let's not silence or stifle it calling it racist which is a tool the left has weaponized to mean anything that it possibly can whenever it's most convenient as a way of advancing their agenda. and if i'm being perfectly honest, i don't even know what the term racest means anymore -- racist means anymore in the term 2021. to me, racism is discrimination on the basis of racist, if i may say in a week something could happen in colleges and universities across this country, let's talk about the racism on the discrimination of race that actually exists rather than making up statements about the filibuster or math as some activists are saying. something that i think is racist in its own right. will: i know you've said that, calling everything racist is in itself racist. ec plan that. >> yeah. i mean, one of the trends we've heard that particularly strikes a nerve is calling math racist or referring to when word as the hallmark of whiteness. these are the new tools of white supremacy to say certain minorities do worse in math, it's our failure to bring those people up to the same level of educational opportunity. and this is all a way of covering up for that failure of our public systems, the failure of our institutions. instead by calling them racists, it has ab to solved the left of the responsibility to fix the institutions broken in the first place. calling something racist is a way of covering that up. will: i think you're on to something there that needs to be pressed. thank you so much for your time and your perspective this morning. >> thank you. will: all right. coming up, the biden administration promised to bring transparency back to the white house, is but is this actually the least transparent administration in history? pete: here to discuss, former trump white house communications director alyssa farah. thank you so much for being here this morning. we know this president is having a long-awaited press conference in a few days. he announced it ten days in advance which, as you know, is not standard or practice, but when it comes to those promises of transparency and the border or briefingsing, what do you take from this white house about 60 days in. >> well, you said it, this is really the least transparent administration in american history, and i think there was so much biden ran on just wanting to be the anti-trump, but we're effectively seeing them wrapped in bubble wrap by their staffs. they're not taking questions regularly. when they do, even on the campaign trail the, they were prescreened questions. i would like to see not just biden, but i'd like to see vice president harris have an open, lengthy dialogue with press. and just one quick thing, i'm very curious to see the format of this press conference, and all i want to see is peter doocy from fox news get the question, because he's one of the most consistently tough questions, and i wouldn't be surprised if the biden white house was screening in advance of the presser. jedediah: you know, alyssa, i suspect that the biden administration, they're concerned that the president may get some serious and challenging questions particularly with respect to the border and the lack of media access because it's started already. take a look at some exchanges between jen psaki on that media access to facilities. just take a listen what happens. >> is the white house instructing border agents to refuse ride-along requests from reporters? our reporters use to be able to get ride-alongs, and you all came in and promised to be the most truthful and transparent administration, and you all, you know, over' the department of homeland security. so if you all wanted to grant access to the press, couldn't you just tell dhs to do it? >> again, i would encourage you to talk to the department of homeland security for any requests for access or what you're looking to accomplish at the border. jedediah: so that's a pivot and a terrible one at that in her response. will joe biden be able to pivot in the same fashion? because i'm sure he's going to get some of these questions himself as well. >> that's what i think we're all interested to see. joe biden has not been really sharp on the uptake when he has been engaging in pressers even on the campaign trail. i'd be interested to see how he addresses this issue of the crisis at the border because the white house has been very hesitant to call it what it is, which is a self-inflicted crisis, and to defer to dhs, he may try that same term there, but it doesn't work. his white house oversees the department of homeland security, and it's them that is blocking access by the media. will: senator chris murphy, who i believe just completed a tour of the border, said the following when it comes to giving the press access. he said i think the press how far some access, yes, but not unfetteredded. enough for accurate reporting on conditions, but not so much to disrupt the already tumultuous lives of these children. it's just such a stark contrast to the types of things we heard, for example, alyssa, when you were involved in the trump administration. >> absolutely. i visited the border facilities many times. the donna facility which right now is overrun with over 1,000 migrant children, unaccompanied minors, i went there with vice president pence. we tour thed it. we bought -- toured it. we brought our press pool in with us to be able to see the conditions. and now the biden white house is refusing to do so. and it's interesting because i do think the media to some degree has amnesia on this, refusing to call it what it is which is separating children at the border, refusing to call it a crisis but also there's not as much of a demand. we were getting requests all the time to be able to see the border facilities which we allowed to happen. i'm curious if the press will still push to do that with biden. jedediah: alyssa farah, i don't know if it's amnesia, i think it might just be a selective interest in the truth. we'll leave threat. thank you for being with us this morning. pete: thank you. jedediah: we're going to turn to some headlines this hour. wisconsin officials raise the number of reported covid deaths at long-term care facilities. the health department reclassifying nearly 1,000 people who were previously reported as passing away in an unknown location. it now shows 45% of the state's deaths happened in long-term care facilities. officials say the deaths were not undercounted, but were left uncategorized as cases spiked. and tiger woods reportedly did not hit the brakes before crashing last month in los angeles. tmz reports that investigators have not found evidence that suggested the golfer ever took his foot off the gas. the sheriff's office remains he was of not under the influence. woods is now recovering at his florida home. and as airlines scale back allowing animals onboard, results of a new survey could reverse that decision. >> you like dogs? that's right and mean the whole issue of unaccompanied minors also. you have to issue resources, which we talk to officials earlier and this whole topic of compassion comes up and people say you're not compassionate enough. what's going on right now is not compassionate. there is not enough room for these people. they are clustered in close quarters during a pandemic. there's not enough resources. mayors are coming out saying we don't have resources for all these people. we don't have unlimited resources. that creates a problematic situation but often times creates problems of things sanitary, of the things we talked about children in the spaces they aren't supposed to be in for longer periods than they should be there so when you think about compassion you have to think about what compassion is sometimes it's prevention saying we can't do it this way and here is why. that needs to be brought back into the conversation because i know everyone is condemning this saying it's not a situation that's good. another big topic of discussion that we have gotten into is the issue of the filibuster with the debate as of late is whether democrats when it were to the filibuster altogether to require less boards-- votes to push through with debut as a positive means of exchange-- change. senator elizabeth warren made an interesting statement saying the filibuster is racist here's what she has to say that it is permitted to serve that function which create a veto for minority in democracy if majority rules and we are republican not a democracy. she is saying this existed back in the day in the pre-civil war era in ways related to slavery that are not kind, that are not just code this has been used against civil rights issues in a way that's unkind and unjust and i >> we did not have enough room during the nursing home crisis, schools are overcrowded and they say they are reopening because bit on the space to accommodate in person learning. our schools are very much overcrowded for our children. you have a homeless crisis and new york. they are paying tens of millions of dollars in contracts to place homeless and hotels and they are doing that at the southern border for these migrants so it's unfair to the taxpayers who expect a number of services from their city and they can't access it because there are too many people. jedediah: congresswoman, you mentioned cuomo and now the fbi reportedly has its sights on governor cuomo on his aid, looking into an investigating his handling of the nursing homes and whether false data was given to the department of justice with now eight accusers that have come forward alleging sexual harassment. any updated thoughts on this investigation as it stands today? already in custody, that's completely heartbreaking. they were talking about a new facility in texas in that capacity could sustain 2000 people. think of the sheer volume and that's just unaccompanied minors, doesn't account for the adults, so it's going to be a problem where they will look to new facilities and processing centers to pop up in other places around the country. there won't be enough facilities in these border towns come so i don't know what that will mean for communities in terms of their own resources. i don't know how this will land, but it's very sad to see these kids in these crowded conditions very concerning. pete: means it's not just a border problem and hasn't been and will not be in the future. by the standards of the hyperbole of the so-called media the democrat media you have kids in canada camp now taking them north, kids in man camp, these man camps, you have kids in cages still because they are using some of the same facilities, kids in hotels and ultimately give a border under siege. if you border control contemplating, exclusive fox news reported and we verified the multiple sources that there is consideration to ultimately release people without a notice to appear, so are you not only not remaining in mexico and you don't have a court date that you probably won't show up to anyway, now you are potentially released in the hopes someday you will make good on it. if cartels-- cartels in mexico are laughing all the way to the bank. its migrants who are seeking a better life that suffer. taxpayers and citizens who want wages not the fact the fbi is questioning senior administration officials shows there is something there. we have said all along the governor mishandled the nursing homes and we know there was a cover-up because his own chief of staff admitted it. i continue to maintain the governor should resign based on the nursing home scandal whether his resignation of criminal prosecution or we defeat him at the ballot box, i believe the governor's days are limited and we need to continue the investigation with no interference and if there are criminal charges that may need to proceed. pete: if you fudge or on. for the past year, we have had to put up with our failed policies by our democratic government in minnesota. now, we have got the biden administration with their failed policies, and i'm concerned about two things, the southern border of the northern border and that's completely been flip-flopped. the southern border should be closed and the northern border should be open. we lost seven billion dollars in tourism last year because of the northern border closed. now, not only with that, they are talking about sending people appear, i have a quick message for them and it's, we don't want you. if that sounds cold, it's meant to be cold. we have a beautiful country appear. they call it god's country. we don't want immigrants up here. you know what we could appear, pete, the call them immigrants appear. pete: jim, you have lots of immigrants across minnesota, everyone is at some point, but the legality of not going through the process. or do you think lawmakers in dc would have an napa valley and it was not a beautiful fancy building gillian: it was beautiful. the porch was beautiful, you had these beautiful chairs, he was beautiful >> reminded me of the napa valley i grew up in , which was uncomplicated. gillian: take me back a year, march, 2020. >> covid-19 situation was taking off rapidly, the part of the lifeblood of our business is the tourism trade we have a napa valley and revenues generated through wide sales and that was a difficult moment to suspend operations, the difficult part was how do you continue to generate revenues when you don't have the same stream of people visiting you and so the primary pivot for us was to rapidly engage with the virtual tasting. gillian: was there a point in the midst of that where you are like how are we going to survive this year? >> yeah, i mean, if you aren't thinking about that you probably are paying attention to what's going on around you. gillian: you have your fellow winemakers opening up for outdoor tasting and you can't because he suffered this incredible loss in addition to suffering closures from coronavirus going on for almost a year, so what you do? >> we have pivoted quite a bit so that's how we'll get through the other side is to be nimble enough to pivot. gillian: one of the most unique things about this winery and thankfully something that survived the fire is the cave, it's filled with wine barrels and if you are lucky you get a taste. that's not the coolest part, look at this tasting room took this as speaks for itself and while it will be a while before you can come and get the full experience because of covid restrictions and rebuilding from the fire , they have a plan in place for the future. >> temporary environment that we will create will be the tasting environment that will be sort of a garden area right in the knuckles in the heart of the vineyard. i don't think there was a moment where we said we won't do this, we will not rebuild or come back, but i think we were pretty aware of the challenges ahead. winemakers and farmers are very resilient people. gillian: what you think is the long-term effect on the region as a whole, on your industry as a whole when it comes to everything that you have had to endure in the last year? >> that's an interesting question. none of us really know the long-term impacts. it would not surprise me too see it now that spring pretty rapidly. gillian: he inherited the property from his father's would obviously has sentimental value. at the end of the story, we were talking about the tourism industry in napa valley is just one location across the country that really thrives off of tourism. that's how they make most of their money so the people we talked to saying once people are culpable to travel please visit us and there are areas alike that across the country that have been truly devastated because that's the majority of their income is tourism, so one of those things that they just say when you are ready, we are here for you. jedediah: that particular winery mean inside, stunning, i mean, make sure want to get on a plane and go there and i think one of the things you have done with this series and this thought wow, that's a good answer, but what you see now is reporters across the board when it comes to the border issue are definitely saying this is not the case. they do a briefing every day so she's available and i think they made a couple mistakes. want, they should've let the media in and do the regular things they always do at the border. number two, she should've said it was a crisis from the beginning and said it was a crisis for 35 years and we are working on it. she didn't do that so now she's in this box every day and i think the white house owes her a better explanation to get to the american people. they don't have a communications problem as much as a policy problem. fix the policy problem and may be communications will get better. the third thing is they do not allow president biden to take questions regularly from the pressing the back and forth. he used to love that, but from their point of view they are hitting their legislative and policy goals and i don't think they realize how much the crisis at the border will eat up everything else they will want to try to do because reporters won't stand for that and i don't just mean fox news reporters, i mean,
