immigration bills creating a pathway to citizenship for millions as the white house press secretary slips up and finally calls the migrant surge a crisis. benjamin: one high profile official is heading to the border today. >> reporter: two big immigration bills past the house yesterday and the reactions are along party lines. >> when you have a crisis at the border the last thing you should do is make it worse. that is what this bill does. >> closing the book on four years of disastrous, cruel, and inhumane immigration policies today we begin a new chapter. >> reporter: here's a look at what these bills would do. the first is the american dream and promise act that applies to illegal immigrants who came here as children, creates conditional status before people can apply for citizenship. it is the workforce modernization act, a 2-year temporary residency status for immigrant farm workers that could be relieved indefinitely so long as the person continues to work, they could gain agree card after 10 years work and paying a $1,000 fine and apply for citizenship after five years but the white house seems unclear what is happening at the border whether it is a crisis or challenge. >> that they would be partners in dealing with the crisis on the border. challenges on the border. >> that doesn't reflect any change in the administration. >> no. >> reporter: either way the number of immigrants crossing the border is daunting. the administration admits many are being admitted into the united states without covid tests was there are reports the biden administration is pressing mexico to do more in texas tribune says many immigrants are being sent back to mexico. coming up in half an hour, more from the border and we expect the secretary of homeland security to visit el paso today. clearly this issue is heating up. carley: thank you. benjamin: the other piece of the story, what we don't know because of lack of transparency reporters are moments of the first parlor shooting in atlanta. the suspect watching people at the parlor in one hour rather than walking and finance opening fire. he drives off and heads to two other parlors. and police arriving. the 3-hour crime spree left eight people dead including 6 women of asian descent. they say nothing is off the table. president biden and vice president harris visiting georgia today, increase and $15 minimum wage progressives want. where do you see these policies going? >> after we saw the biden bailout we know where democratic values are, average americans pay progressive liberal agenda. after they passed $1.9 trillion boondoggle they are coming after all americans to pay this off. they will come after job creators, they are not going to stop and will work aggressively to raise taxes and work aggressively to stop the democratic liberal agenda. >> a representative said this on bipartisan support. we can either go green or go bipartisan. i don't think they are ready to have a transformative package. what do you make of that? infrastructures should be bipartisan. what can you do? >> what we saw is congress passed major pieces of legislation in a bipartisan way to address the coronavirus pandemic. they go to the far extreme left. we have to go and push aggressively to try to stop what they are trying to do in washington. jillian: you introduced legislation on wednesday that would prevent federal prisoners from receiving those $1,400 stimulus checks. are those checks already out. is it too late? >> a process of getting these funds back. we should be asking nancy pelosi why they went out in the first place. why prisoners in federal prison, murder and terrorism received $1,400 checks in the first place. they are incarcerated, whenever at risk of losing their jobs, never at risk of losing housing due to coronavirus. it shows where democratic values are providing checks to prisoners rather than letting us get our way of life back. >> they are intended to be spent on the economy. delaware prisoners if we received them. what would be done with 6 extra money? >> we can pay down the debt, the boondoggle rather than raising taxes rather than cutting medicare which they do or we can send it towards actually getting our way of life back, reopening schools, getting children back in school, getting people back to work. there are plenty of options. i would like to see us pay down the debt but democratic priorities are to spend money left and right and make sure we are keeping an eye on what we are doing in washington. benjamin: thank you for >> i saw what is happening across the border. more unlawful entries, 100,000 plus in february up 30% from january so it is getting worse and worse. >> coming here for a better life. we have a legal immigration system to do that. >> one thing after another. the agent running out there said i got to get out of here. another group coming through. that is the difference. >> do you think more will come under the new administration? >> a lot of programs that were there before, policies that were in place are working. when you have a new administration policies change but you need to see what policies are working and continue moving forward to fix the problem. is a crisis or not? we have issues that need to be taken care of. benjamin: alejandro mayorkas will be in texas to meet with them. >> texas governor greg abbott calling out the biden administration for denying access to unaccompanied minor shelters at the border. >> we are having a deal with massive numbers of migrants. jen psaki talking about being transparent, the biden administration is not being transparent, we don't know about that. >> you to react is southwestern border sheriff coalition member clint mcdonald. thanks for joining us. denying state and local officials access to these facilities. what could they be trying to hide? what don't they want people to see? >> we don't know what they don't want people to see and we may never know. that is the situation we are in. i can see where they may say it is a reason of protecting those children, there's a lot coming into play when dealing with a minor child. >> you come from an interesting perspective because you represent 31 border sheriffs from texas to california. what are you seeing on the ground? in terms of safety what are your biggest concerns? >> we have a massive flow of state law enforcement helping those sheriffs, they are not seeing in the central part of the border or western part of the border in the violent hard chases, just last week, with eight migrants being killed. no sheriff wants those things to happen. we are having too many people getting injured. in far west texas we have sheriffs, the last cold snap, picking up bodies died of hypothermia. we are dealing with the massive increase in people across the border all along the border from san diego to brownsville. benjamin: i want to get your views on this, they were released into the us without getting covid tests. and test every one, 108 migrants released into brownsville after testing positive. how serious is that? ( horn blaring ) benjamin: two consulate twin cities under fire is a new report shows the philadelphia district attorney cut plea deals with campaign donors. in california families recall effort against la district attorney george gascon. carley: lawrence jones joins us to react. we've got to get the story out of philadelphia. the attorney accused of cutting plea deals, giving more lenient sentences to criminals whose lawyers donate to his campaign. he did not respond to fox news's chris for comment but we would love to get your comment. >> not surprising. we've been seeing this across the country where his das are active. it is not surprising when you see they are taking plea deals based on people who gave the money on their campaign because the whole reason they are promoting this activist agenda that is not criminal justice reform, releasing convicted killers back on the street, not just drug dealers but people who are risk to society and we saw it in la and chicago and across the country. benjamin: it seems this is part of a trend supporting the criminals over the victims. you've spoken to someone directly affected by this, someone was killed by someone george gascon let out. let's get your response. >> never thought i would have to do that. >> for george kes:someone who murdered something, you know what you are doing. benjamin: that is heart wrenching to watch. how can a plane the southern shift. >> i've spoken to a lot of victims. and i have been advocating criminal justice form. many of us support getting nonviolent offenders out of prison after they have been reformed. this is not what they are doing, they don't believe people who are a risk to society should be locked up. in many cases they cannot be reformed. what do we do with kids in society? this is across the country and americans should wake up to this. they see the interview in la or chicago, easy to say it will come back in my hometown, district attorneys that haven't prosecuted one case for the record that are doing this across the country and running for office more and more. jillian: this is something you will be speaking into, what else can we expect throughout the morning? >> i will be here talking to folks about the first hundred days, what they think is going right and wrong. what about reopening? a lot of states are deciding to put it back in the hands of the residents, not that they are anti-mask or anti-making sure people are here safely but they want to give people control of their destiny. they don't want control of their lives on a daily basis. it is almost a year. nice to have a nice breakfast year, talking to folks all morning. benjamin: thanks so much, don't forget to eat, appreciate it. benjamin: making me hungry too. coming up next congresswoman claudia tenney joins us live, don't miss it. ... carley: new york lawmakers urging the u.s. attorney general to investigate whether new york governor andrew cuomo violated residence civil rights with his group home directives. they say, in a letter quote, given the poor track record of his barely sharing covid related data with the public we therefore call on the department of justice to initiate an investigation into this matter. benjamin: claudia tenney sent that letter to the doj and she joins us this morning. thank you for being with us, congresswoman. i want to put up for the audience a few statistics, 20% of residents in new york is able care homes were infected with covid. 552 residents in new york disabled care homes died from covid. it's a staggering amount and then if you look at the numbers that were originally reported over 9000 reported, over 5000 total towards the end you have asked attorney general garland to look into this. do think there's a common case to be made here two what would you like to see next? >> i do think there is a case to be made and it should be investigated. this is something that happens in the past obviously with the nursing home cover up in the falsification of records and we sing this now with the people with disabilities and there is a state penal statute that protects people with disabilities. michael carey, whose son was killed in a group home, so-called group home or people with disabilities are able to live a more free lifestyle in the communities was killed and his father or his son, jonathan, was wrongly died in that facility. mr. kerry has been a whistleblower and aggressive on this and actually was so such a great advocate for these people that he got a penal statute passed for abuse to people who live in adult homes and i am concerned that the way this policy was done by the office of people with developmental disabilities, which is the office that handles this, was also doing the same thing that governor cuomo was doing with the nursing home scandal. mr. kerry has asked us to look into this. this is another example of governor cuomo either covering up or falsifying records again on our most vulnerable residents in new york state, the people of disability. carley: you want to make sure that number 552 is the accurate number and not unfortunately, higher as we saw in the nursing home case. governor cuomo has blamed federal guidance throughout this whole thing so what you make of that excuse? >> the governor, everyone received federal guidance for the governor took his own rules and they were arbitrary and i would like to see these people helped and i want to make sure we have no future deaths that are untimely as with our seniors in the nursing homes and also the people of developmental disabilities who had untimely deaths and unnecessary because of governor cuomo's arbitrary actions and now his attempt to cover it up. these people deserve justice as everyone does in new york and that is why we are calling on the attorney general to look into these and we are not sure that will happen in new york state and we've also asked that to happen on the near state level but these people need to be protected and they need advocates and, you know, these whistleblowers have been, it's really important, not just on the stateside from the federal side protecting citizens across our nation. benjamin: in the meantime, congresswoman, before the investigations get underway what would you like to see from governor cuomo?
