connection with the attack on an asian man in the china laundromat. also tonight new york police are looking for tips after an assault against an asian american man in brooklyn is police believe the surveillance video from shortly before the attack, the suspect also hurled racial insults, vandals defacing a seattle church with anti-china graffiti and locals are growing frustrated with whether or not police are on the case. officials to local reporters they say it is safe to say there's an investigation, the graffiti says china, you will pay, go home. local residences we are in seattle which is pretty progressive in a lot of ways it is disheartening a lot of ways. the white house and activists primarily laying the blame on white supremacy and comments by donald trump when addressing the latest violence and attacks on asian americans. we begin tonight with what we know about the motives of the atlanta suspect in a series of tragic shootings last night, eight people left dead. alex hogan has the fact tonight. >> a newly released 9 one one call shows the moment victims called police for help, one woman who was inside one of those businesses terrified and asking police for help. >> what do you see right now? >> i don't know. i'm hiding right now. >> what is he wearing? >> i don't know, please come. >> accredited shooting spree outside of atlanta, eight people are dead. 7 victims were women of which 6 were asian. the violence causing an outpouring of support for the asian american community. the suspect, robert long, confessing the shootings were not over race but his own sex addiction. the first shooting started just after 5:00 pm tuesday, one after another, quickly turned into crime scenes. >> he sees them another outlet for porn and he was attempting to take out the temptation. >> reporter: investigators say too soon to know if race played a factor. >> indicators right now may not be, may be targets of opportunity. >> reporter: friends from heiskell and middle school speaking out surprised and shocked. >> very christian. >> reporter: police really security footage of the suspect prompting his family to step forward. >> very supportive and certainly difficult for them. >> reporter: officers tracked long down 150 miles away, 9 millimeter firearm in his vehicle. the man reportedly told officers of his plan to head to florida and carry out more shootings. robert long is charged with four counts of murder and one count of assault. his initial court appearance was scheduled for tomorrow. that has been canceled but there is no new court date scheduled as of yet. shannon: thank you very much. lindsay boylein wants no part of the impeachment investigation of andrew cuomo. the governor's former radio delegations triggered the sexual harassment scandal called the probe a sham tweeting do not trust the impeachment investigation. it is not designed to be transparent and there's nothing governor cuomo wants more than time. many of us put our lives on the line for this crap. i have not and will not. the speaker of the new york is only overseeing the state's impeachment probe. immigration numbers soar at the southern border, president biden is telling don't come over. will the message be heated after candidate by naps words seem to be directly opposite during the 2020 campaign season? kevin cork is digging into that tonight. >> reporter: no trip to the border planned for mister biden who is at least so far content to let others take the lead in responding to the border disaster. a decision that is getting difficult to defend as the crisis deepens. every day by the hundreds they come. migrant children, part of a tsunami of people looking for a better way of life but the reality on the ground is daunting. customs and border protection sources saying we're taking in more uacs than we can process. i don't see how we can keep this many kids who can't find sponsors was worse there are growing concerns the biden administration may be restricting the information border patrol agents can share with the public nbc reports border patrol officials have been told to deny all media requests for ride alongs with agents, to settle queries even from local press to washington for approval and to not share information about the number of migrants in custody. >> we are not hiding anything. we want to be sure the story is told transparently but we are also in a situation of urgent need for children in need to move children and that has take first priority. >> reporter: the height of the trump administration's child separation policy in june of 2018 it allowed media to toward facilities where separated children were being held. >> he wanted to grant access to the press couldn't you tell them to do it? >> we fully support transparency and i encourage you to talk about any requests you have for access. >> dhs secretary alejandra mayorkas got into a tense exchange over the migrant surge at the border, today's house committee on homeland security hearing. >> how many more members have to be kidnapped across america before you will take action? >> i find it question to be extraordinarily disrespectful. >> i'm sorry you feel that way, i'm sure the american people feel disrespected about the border situation we are facing now. >> since fema the federal emergency management agency is now involved, by definition isn't this an emergency? mayorkas said it was a challenge and he also noted earlier in the hearing that he was, quote, not spending any time on that language that we use, spending time on the operational response to the situation at the border. a terse response to an obviously intense situation. >> one that doesn't appear it will resolve quickly. thank you. 40 republican senators are seeking answers about the legality of president biden's executive order that froze congressionally appropriated funding voted on for the border wall. a letter to the government accountability office seeking a ruling on what they say is an unlawful action infringing on congress's constitutional power. here to respond to the reported gag order on border patrol agents, the president of the national border patrol council brandon judd. i know you're speaking in a specific capacity so i will only ask you to comment from that. you heard the reporting apparently they cannot request ride alongs, all the local and state and other media requests have to go through the washington office, data is not supposed to be given up, what do you make of it? >> i'm going to be perfectly honest, this isn't anything that is extremely strange. most media requests even in the trump administration had to go to washington dc. what is strange and let's talk about what needs to happen. not letting the media into these processing facilities. you let the media into processing facilities or take the media on the border so they can actually see what is taking place so the american public understands what the situation is. when you don't want to call it a crisis you have to look at the definition, why call something a crisis and in my opinion is evidence of crisis is once border patrol resources are overwhelmed and we cannot secure the border based upon what the threat is coming at us and we pull our agents into the processing centers and off the line i would then call it a crisis. a week ago i wouldn't have, now i would. shannon: we were told they would be as transparent as possible, they would allow us to find out what is going on. our reporters are present in the white house briefings to get that information and yet they are being told to go back to dhs and the federal agency, do you think we will get answers? do you think we're going to get access? >> i think you will because you continue to press. if you didn't press you wouldn't get those answers. i couldn't encourage the media more than to continue to press upon the administration, to give you the numbers that you need, the access you need so you can paint the full picture for the american public. speaking on behalf of the national border patrol, i patrol the border, i put on that uniform and do the job, and there would be no reason for the administration to act appropriately in trying to secure the border. that's why i encourage the media to continue to push forward that if it has to go through washington dc so be it, push it to washington dc, push it to headquarters but get that access. shannon: thanks to you and every other man and woman who puts on that uniform every day doing a job that is much harder than we understand, thank you for that and your time tonight. let's bring in leslie marshall and deputy assistant attorney general john you, good to see you both tonight. i want to play president biden when he was a candidate in 2019 versus what he is saying today, we will talk about the messages. >> i would make sure that we immediately search the border, all of people seeking asylum deserve to be heard. that is who we are. we are a nation that says if you want to flee a version you should come. >> we are in the process of getting set up and it's not going to take a whole long time, to be to apply for asylum in place, so don't leave your town or city or community. >> even those in the biden administration admit they have a messaging problem because we have reporters and folks are talking to people at the border say we believe he is going to help us and that is why we are coming, that is the message we are getting. >> not just a messaging problem, president biden is creating new incentives. we shouldn't assume immigrants are irrational. they are rational actors, they are coming because they are getting new information that immigration policies are changing. with you agree with them or not trump's immigration policies made it harder for people to cross the southern border. president biden has overruled the trump executive orders, announced he is restoring the diesel the aca program, introduced a bill that make it easier for aliens to become citizens. i don't blame people who want to leave countries where the economy is terrible and is a lot of instability to come to the border, president biden -- that will make the problem at the border worse and worse, not better. >> it is not just conservatives or republicans are saying that. we have a number of democratic lawmakers on the border and in texas, members of congress saying you're making it harder for us. here is congressman henry cuellar. >> we need a more concise, clear message. was we are hearing is people are coming across. they see >> he himself by tweet put out some video of the border and the situation there. there are enormous crowds, people who feel hopeless and are fleeing to a place where they think there will be opportunity for them, to a system that is overloaded and we are hearing of thousands of kids being held far beyond the legal limit, being grouped together and convention centers and other places, not a situation anybody wants. >> it is not an ideal situation. democrats and republicans in the house and senate can pass bipartisan multifaceted immigration reform yesterday and they don't do it. they want to take pictures, they went to visit the border. it is good to be informed but the reality is the covid-19 pandemic reduced beds for children specifically, 14,000 to 8000. the reality is the kim jong un for pandemic increased violence in this country, reduced financial and economic opportunities for these individuals and we have to remember a lot of people don't understand you can apply for refugee status from your home country but not asylum so you have to come to the us border to apply for asylum which is why the president said we are working on the ability to be able to apply for asylum from your home country and president biden can't do it alone, no president can do it alone, they need congress to help. shannon: the fact is covid started very early in 2020 and this surge started in the last eight weeks. >> the numbers are incredible. the increase in encounters at the border in the last month is up over a third, of over 175, 175% in the last year so i don't think it is just covid-19. covid-19 should be slowing it down, not increasing it. the question is going to be whether president biden is now in charge and one of the jobs of the president is to protect the sovereignty of the country which involves sitting security at the border and making sure the laws -- i agree it is up to congress to set those numbers for the president's job is to enforce them. shannon: they need to clean up the overloaded immigration system and there never seems to be appetite for the parties to do it regardless who is in control. we will keep watching and asking questions. thank you both. biden doj nominee grouped under fire for business ties to accompany the allegedly profited off of the chemical use in the production of apps. asking senator joe manzella chen who states of greatly under the epidemic if he knew. how the white house is responding next. .. an for your period's... what the gush moments. but the right pad can. only always ultra thins have rapiddry technology and, they absorb 40% faster. the gush happens fast. that's why always absorbs faster. shannon: president biden have to take for attorney general is coming under increasing scrutiny for his stake in a company that makes an ingredient drug dealers have used to make apps and this. doctor mark siegel has the latest. >> bonita group to, attorney of corporate programs currently awaiting confirmation to be president biden's associate attorney general. it is worth noting there could be more issues holding up her confirmation than previous attacks against republicans. gupta is worth somewhere between 42, and $187 million with much of her assets tied to her father's company. according to filings obtained by abc news perhaps most significantly bonita group tones between 11, and $55 million in shares of the pennsylvania chemical and material company, her father is chairman of the board. the plot thickens, they make a cedric anhydride and selling it in mexico. according to bloomberg, $324 judges enough to produce 90,000 hits of high-grade china white, otherwise known as apps. 80 pounds of china white is a street chemicals to keep them away from narcotics syndicates. acidic hydride was placed in the category of controlling 2000 world. while it is true that if you cannot drive his legal uses including the production of cigarette filters, making narcotics is big business. the white house tells us to never had a direct role, and will divest herself of the stocks that she owns so at least according to the white house there would not appear to be an ethical issue but senator chuck grassley, ranking member of the judiciary committee has submitted some questions for gupta to answer. shannon: thank you very much. the conservative group judicial crisis network is targeting joe manchin in his own backyard over grouped's potential confirmation. let's bring in the president of the judicial crisis network, good to see you back here. i am going to play a little bit of the ad. it is very pointed to say the least. here is a bit of it. >> we see drug overdoses, death. bonita group to saw money, profit, tens of millions invested in a company that made the hidden agreement in apps. tell joe manchin bonita group to for west virginia. >> the message is specific to west virginia where they had a shocking, horrific outcome with regard to the opioid epidemic but is it fair to link her to what happened based on the reporting you heard from doctor siegal? >> at this point she is bowing to divest herself of these stocks but her father remains chairman of the board. he is the other challenge. already radical and extreme positions on other issues that i think are disqualifying already, she is positions that tie in with these concerns, advocating legalization of all drugs, advocating the same policies that are benefiting the illegal drug industry. that is a real concerning overlap and something we can't overlook. west virginia lost 142,000 people to drug overdoses. it is very concerning to see someone in leadership at the department of justice and forcing drug laws who expressed opposition to them on principle. >> senator manchin said i've spoken to mary garland who is attorney general, i have all the respect in the world on his decision-making and will be leaning towards a yes vote because of his support. do you think this will be enough to change his mind? >> i hope so. i would think someone with her record, merrick garland likes to present itself as a fair-minded person but look at the people working with him they are the hardest left, he advocated reducing sentences even for white nationalists and terrorists, is he going to stand up to those things? i question i don't see evidence of that and senator manchin has to be particularly cautious when you look at her view of drug policy in particular and when you see the damaging effects, the tragedy that happened in west virginia and so many states across the country because of the problems with the opioid crisis. shannon: senator hirono and others who made a similar point talking about the gop and the right encouraging no votes against women of color, she said vanita gupta, highly respected women, singled out by gop senators for being outspoken and critical of trump. is anyone else noticing the pattern of types of nominees republicans are singling out for criticism? how the response? >> the pattern is we will criticize people of any gender or color who are radical liberals and this is just absurd name-calling, they are trying to change the subject, the same ones who oppose bush's appointee at the dc circuit who was filibustered because she was appointed by a conservative, what about amy barrett? because she was a woman. we need to be concerned about making sure people who are enforcing our laws are not people who are going to be undermining vote of law in this country and was we are seeing from biden is he likes to talk unity when he is trying to move voters but we are seeing a radical person like vanita gupta appointed to these positions and we will call it out for what it is. shannon: confirmation battles will continue, thank you. how will the biden administration stand up to china in the first face-to-face meeting of the two countries top advisers? senator tom cotton has a thought. he will way and on that and more next. that's why we're a fiduciary, obligated to put clients first. >> if that is their attitude we need to disabuse them of that. i we rolled out the unwelcome madison the mom disappointed available for relief from tariffs and sanctions and some of the other policies put in place for the last 4 years to confront china and punish them for their depredations against america's interests. if however the biden administration agrees to start rolling back some of those sanctions, to start removing those tariffs we will know that joe biden and the democrats want to go back to business as usual against our number one competitor in the world, a country that is responsible for stealing millions of american jobs and threatening our national security and oppressing and persecuting their own people. shannon: county respond to those where critics of the trump administration who say he and the administration. up important international relationships around the world and didn't make any progress in relations in pushing back on china the last 4 years. how the response? >> that's not the case at all. if anything donald trump helped realign the political consensus to recognize china as a serious and grave threat and around the world we have so many partners who want to work with us and have been grateful that america has finally gotten more aggressive in confronting china, the great nations in the western pacific and indian ocean like india and australia and japan to smaller countries all around the world and don't want to be bribed by china and become essentially facile states or have their communication networks infiltrated. countries around the world recognize china is a threat to their interests but they need america to lead. that's what we've done the last 4 years and what we will continue to do. jillian: let's turn back here domestically, the quality act is something that will be working its way through the senate and there's a lot of back and forth on this. if you question it you are a big it and undermining and supporting discrimination against the lgbt q community was the washington post says this is a fast-moving discrimination based on gender identity and sexual orientation. more than 6 in 10 americans say business owners should not be allowed to refuse services to lgbt q people on the basis of religion. is that an accurate portrayal of the equality act as you see it? >> know. this is a radical proposal was of course americans think everyone should be treated with dignity and respect but they also want to respect the religious freedom of all americans and they want to uphold what until just yesterday seemed to be common sense notions. more than 20% of the largest charities in america are faith-based, more than $1 trillion of social goods are performed by those charities but the quality act with threaten them all. if you are in a battered woman shelter and the man shows up saying he wants to be admitted, where women are hiding from abusive violent boyfriends and husbands you might be sued, you might lose your government contract, or churches and christian schools and hospitals could lose their tax-exempt status or be sued by the department of justice were if you want a forcible but well example notorious democratic mega donor and serial sexual predator harvey weinstein could transition to being a woman tomorrow and the equality act would require the government to put him in a women's prison. this is the height of folly. we need to respect the rights of all americans while continuing to treat all americans with dignity and respect but we shouldn't impose these kind of radical laws on our society. shannon: we reported this back and forth when former secretary john kerry being photographed by a passenger on a commercial flight today with his mask off. it would have been only momentarily the passengers says it was at least 5 minutes. we are being asked to do things that feel inconvenient sometimes and not exactly what we want to do but again and again we have leaders who are out there and not obeying the same as. >> i guess we considered is better than john kerry finally deciding to fly commercial as opposed to doing well in gulfstream's around the world, but readers should try to set a good example of that going to impose rules of the american people they should follow those's, we can recognize everyone is struggling to keep their mask on, i don't know the circumstances here but john kerry has a long record of imposing one set of rules on americans and not following those rules as evidenced by his just sitting around the world to save it from climate change when he's burning more carbon than one person does in an entire year. shannon: i was surprised he was on a commercial flight that there are people who sign, all of us all the time are being washed so we have to behave ourselves, great to see you. >> thank you. >> la district attorney george gascon putting the gang unit on the chopping block. we investigate and get reaction from la deputy da who joins us live next. that takes wealth. but this is worth. and that - that's actually worth more than you think. don't open that. wealth is important, and we can help you build it. but it's what you do with it, that makes life worth living. principal. for all it's worth. hey, i just got a text from my sister. you remember rick, her neighbor?
