but yet form a conclusion and an opinion are, in my opinion, reckless, and dangerous. because those politicians cuomo is referring to include at least 24 congressional lawmakers. if the majority of the new york delegation now calling for his resignation, including prominent democrats like representative alexander because jo cortez, jamaal bowman, house oversight chair carolyn maloney, and judiciary committee member nadler. at the repeated against the governor and the manner in which he responded had made it impossible for him to continue to govern at this point. a seventh accuser came forward, reporter jessica bateman writing a first-person account in "new york magazine." acclaiming, she's been sexually arrest on the governor. his hands up and on my body, on my waist, and my arms, new york calling for him to resign as a tipping point despite the pushback from the governor every time he answers questions about this. >> i do not believe governor andrew cuomo will resign unless he believes there are the numbers in the state assembly for his impeachment. he believes they will impeachhim, he will resign. if that is all about the state assembly, which is democratic-controlled. until the assembly members come together and say they are willing to do that, i don't think he steps down. >> bret: all right, bryan llenas them brooklyn. thank you. it is taking a victory lap tonight following the passage of his massive stimulus package. the crisis at the southern border is diverting attention from that accomplishment. peter doocy joins us now with the latest. >> president biden history. mitch mcconnell describes it as a multitrillion dollar trojan horse, full of progressive policies. $86 billion bailout for failing pensions to $5 billion were farmers of color. something republican senator tim scott strongly opposes. >> when you have a farm program that is designed specifically to the exclusion of white farmers who are struggling as well, that is un-american. it is exactly what we fought against in the 60s and 70s. >> republicans are also against the $350 billion in aid for state and local government. it's because this is a waste of money, less than 9% going to covid, this is a payoff to pelosi's political friends. >> the president believes it's a payment towards america's future, starting with those $1400 stimulus checks for millions of americans which will start hitting some people's bank accounts as early as this weekend. mixed status families, those with one undocumented parent, are eligible for those checks. if the bill also includes $130 billion for schools, $50 billion for small businesses, and $14 billion for vaccine distribution. >> president biden: if it feels any pace -- i will acknowledge it failed. it will not. >> president biden acknowledged, it's one thing to pass a plan, it's another thing to implement it. it's going to require oversights to make sure there is no waste or fraud, he is hosting an event at the white house on monday to explain how exactly he intends to do that. >> bret: thank you kristen. it the dow gained 293 today for another record close. the s&p 500 rose four, also a record close. the nasdaq lost 79. for the week, the dow surged four percentage points, the s&p 400 gained two into thirds, the nasdaq was up three. it appears things are spiraling out of control in portland tonight. a surge in crime, political uncertainty over police funding and last night, a massive riot in the streets. correspondent dan springer shows us tonight. >> downtown portland again erupted in violence, around 60 protesters dressed in black i checked the federal courthouse, breaking windows, and setting fire. police responded with an array of nonlethal wars, flash bangs, and eventually tear gas. if the anarchists were protesting an oil pipeline from canada to wisconsin. we went inside a bank where a security guard to pulled his gun, at least one arrest was made. portlanders are weary. >> there's a certain of complete lawlessness -- a small element, but it causes a lot of damage. because the mayor who has been heckled by the right and left all but admitted that defending the police last summer was a total failure. with murders and gun violence at all-time highs, ted wheeler announced he wants $2 million for a police unit to focus on the surge in bloodshed. >> the level of violence on streets on the trauma it's causing require a decisive response. >> it's a reversal from the $50 million taken from the police during the black lives matter protest. now, black clergy are demanding more policing. >> we feel the hurt, we feel the pain. >> portland economy continues to suffer. many businesses are still boarded up. in a recent survey, nearly two-thirds of business owners said downtown is not safe. city hall appears ready to finally take action. >> we make sure that we are arresting folks engaged in criminal activity, that the d.a. is able to prosecute them. >> the portland city council still has to approve the mayor's request to at least partially refund the police, and there's no guarantee of that. if this is a turning point with the chance for law and order to be second congressional race. republican congressman mariannette miller-meeks has been determined the winner and iowa over democrat rita hart. she's been seated in the house, but it's not over, and it's hard to believe. we brought you the story, congresswoman miller-meeks joins us tonight. thank you for being here. >> good evening, thank you for having me on. >> bret: i want to put up the boat in the 2nd congressional district, total votes, 300,625. you got 196,000, 964 to 196,000, 958, a six boat difference, certified by the iowa secretary of state. yet, there is this doubt. >> there is no doubt in my mind, no doubt in the executive council who certified me the winner. it not only the secretary of state, but the bipartisan executive council. let me elucidate the facts. i won by a very large margin on election night. per iowa law, all the counties in the 2nd congressional district, they have their county canvas, after that comeau still had in votes. then my opponent requested a recount, throughout the recount process, which is a bipartisan recount board of three members of each county having to recount, i was still had through all of that process. every legal ballot and vote was counted throughout that process, every step of the way, i was the winner. with certified by my stay, and a bipartisan executive council certified meet the winner of that election. i was then sworn in on january 3rd, interestingly enough, during the swearing-in ceremony, there was a vote taken. if all of the members from every state should be seated, every democrat voted that every member should be seated, and no one can test it, no one stood up on the house floor, and contested my being sworn in. >> bret: and yet they are now, there's house it hearing on wednesday, here's congresswoman zoe lofgren. >> the contestant, rita hart, has raised specific writable allegations that ballots were rolling the excluded. it should not be surprised that any candidate in these circumstances with the margin this close would want to exercise their legal right under law to recount the vote. >> bret: there's all this talk about a contested election, once it certified, it's a done deal. in this case, congresswoman, they are continuing to contest it. is there a chance you're not going to be a congresswoman after all this? >> there certainly a chance. i want to bring up, it's not enough to win back in the election by six votes, then why is it enough to have a six votes of democrats on a commission to an election. i will law is what determines what are election processes, how the ballots are included, and all of that was done. what my opponent wants to do is to violate iowa law, go against i will come and go against the representation of the voters of iowa, and to disenfranchise 400,000 voters and i will because she didn't get the results he wanted. she said that ended video. she said she skipped over the iowa courts and had to go to the house committee on administration to get the results we need to, not the results of the voters, not the results of the election law and i will but you have congress decide who gets to represent i was 2nd congressional district. ever run across the country should be outraged by this. i certainly have been encouraged by those people across the country who have reached out to me and told me there contest down my contacting their representatives to let them know their displeasure. state should rule their election, voters in that state should decide who represents them. this is a process where they want to go against the laws of our states, the election laws of our state against the voters of our state, and to determine who they want to seat in congress. >> bret: when i don't know anyone else who is covering this, we will andrew cuomo today saying he's not going to resign, saying that the accusations are part of cancel culture -- there are now seven women who have brought forward specific allegations of harassment. at the latest couple has been very specific, and could go into the realm of assaults. in meantime, the key senators from new york, one of them is senate majority leader issuing a joint statement saying confronting and overcoming the covid crisis requires sure and steady leadership. we commend to be brave actions of the individuals who have come forward with serious allegations of abuse and misconduct. due to the multiple allegations, it is clear governor cuomo has lost the confidence of his governing partners and the people of new york. governor cuomo should resign. happening this afternoon. let's bring in our panel, harold ford jr., former tends the congressman. mollie hemingway, and ari fleischer. molly, your thoughts on this and the governor pushing back saying this is cancel culture. >> i think a lot of people thought if senator schumer and the children called for his resignation, that would mean andrew cuomo had to resign. i'm not sure that's true, i live in virginia, our governor democrat ralph northam was in a horrible scandal involving his support for infanticide and a picture in which he wasn't sure he was the guy dressed up as the kkk member or in blackface. everyone said he had to resign. he chose not to, and these fine a few years later. i think you mentioned there are seven people who have made allegations, seven live women who have made allegations, they are also family members of 10,000 dead new yorkers who are frustrated that scandals not getting more attention. i think a lot of people in the media and the democrats are calling on him to resign for those allegations so they don't have to deal with the fact that the real scandal is how he handled the coronavirus. if it's been so long praising him saying he's done good things, when in fact, he was a very bad leader who made very bad decisions. they're hoping to get rid of him on the sexual assault and harassment allegations rather than face the sun's ability for how they were all involved in this nursing home scandal. >> bret: it is interesting, the new york lawmakers calling for his resignation into impeachment, the process that's moving forward to. the numbers are growing, really by the day. we are 135, 80 of them democrats. here is governor cuomo on the motive of the allegations, according to him. >> i did not do what has been alleged. period i won't speculate about people's possible motives, but i can tell you, as a former attorney general, who has gone through this situation many times, there are often many motivations for making an allegation. >> i'm absolutely shocked by that. i think that seven women have come forward to, i don't think they are delusional. i think that what he is saying is dismissing these women. >> bret: i guess the question is that some democrats talk about it one way when it's not the governor of new york, a fellow democrat, and to talk about it another way if it's allegations against a republican or something else. >> thanks for having me on, i would differ there, bret. i would say it's unfair saying he's not tough on governor cuomo. are you laid out the numbers. 80 of those 135 are democrats. i was in congress when congress voted to impeach bill clinton. it was done along the lines. the most recent impeachment was along partisan lines. this is a bipartisan effort calling on a governor, a democratic governor, arguably, the most well-known democratic governor, if not the most well-known governor in the country for him to resign. he faces two battles, legal, and the other, political. things got trickier and harder today, obviously, with the calling for his resignation by the two senators in the state, but to suggest that democrats are talking about this differently -- i think it's unfair. democrats are the ones leading the charge. frankly, they're the ones on this evening who have made the politics so much more difficult, so much more trickier -- trickier, rather, for governor cuomo. >> bret: my point is, someone like vice president harris who has spoken out many times on the campaign trail about this issue, is not answering any questions about it. here's how the white house responds. >> the president believes that every woman who has come forward, there've now been six, i believe, who have come forward to, deserve to have her voice heard, should be treated with respect, and should be able to tell her story. there also is an independent investigation that's ongoing in the state with subpoena power overseen by the attorney general. he certainly supports that moving forward. >> in your thoughts? >> it tells you how fast a story is moving when she's had, and now the numbers up to seven. look, i'm a new yorker, i've been following this all along. one of the people dominic reasons people don't trust andrew cuomo, he's not part of a political club. he was born into the political club. his father was a governor of new york, he's a former cabinet secretary, he was the attorney general, he is now the governor. he is the leader of the political club, and he leads the political club with a club. that's why he's so unpopular in this state all of a sudden. i want to separate the politics of this issue, the pressure should he resign issue from process. here, i will defend, not andrew cuomo, but a principal. he's been accused, still, without hard proof. the one accusation that worries me the most, here, the most serious one about him fondling a young woman who was invited to go up to the governor's private chambers on a second floor is anonymous. the most serious one. if it's true, of course he asked to resign instantly. we don't know, because it's anonymous. i do worry about the effect on politicians or anybody in society -- any defendant anywhere was an anonymous accuser. even a slimeball like andrew cuomo is entitled to due process. i think you have to let that play out. the state legislature, they can impeach him. if they know him. at that very well may be the route they have to take. >> bret: the question becomes, how much of the covid handling and the nursing home issue factors into this when the focus is now shifted to these seven accusers, and the investigation that goes on there. it's on? >> for many, these questions around the reporting of nursing home deaths and illnesses has been the focus of the concern. in fairness,
