at the border. the number of unaccompanied minors taken into custody has tripled to more than 3,200 in just the past two weeks. former customs and border patrol commissioner mark morgan is sounding the alarm. >> trust me, if we had over 1,000 apprehensions in a single day it was a bad day. we're looking at now getting close to 5,000 apprehensions a day and they still refuse to say it's a crisis. the mandate has been to release them and process them and release them as fast as possible. on the back end prevent ice from deporting them. reception centers on the front end, sanctuary country on the back end. that's where we're at right now. >> harris: from a crisis to what you might call a national emergency. republican congressman andy biggs is here to talk about it. he led a delegation to the southern border and he will join me in just a few minutes. let's begin, though, with white house correspondent peter doocy. peter. >> good morning. it has been a week since president biden said anything about the border, even though the white house admits they're having a problem getting their message to migrants. >> i would say it's clear we need to work more on getting the message out and being very clear now is not the time to come. >> critics are alleging that message is too inviting to illegal immigrants. >> when you tell them look, we aren't going to deport you, might give you asylum and definitely release you, a covid test and bus ticket where you want you get a huge influx of people. >> "new york times" is describing some of the facilities where migrants are being held as akin to jails. the feeds are filling some facilities holding unaccompanied children at full capacity despite covid concerns, but covid concerns are cited as a reason reporters haven't been allowed to scope out these facilities. a decent size government delegation including mayorkas who hadn't still briefed biden yesterday about what he saw after being here for more than a day. he is reaching out to members of his department asking for volunteers to take a trip south. in 2019 over 900 volunteers deployed to support their colleagues during a similar migration surge. please consider joining the volunteer force to again provide needed humanitarian support among the southwest border and relief for our cpb colleagues. the business is attentioning to visit a small business aided by the ppp act. nothing concerning the border. the administration is telling us they won't brief us or fill us in on every private policy discussion. harris. >> harris: we're wondering when they will brief him actually. peter doocy, thank you. republican senator tom cotton says this crisis is happening because president biden and democrats don't believe in borders. >> we've gone far beyond catch and release. this is recruit and release. they are recruiting illegal aliens to come back and let go into the country. almost all of these claims will be rejected. >> harris: i want to bring in congressman andy biggs, republican from arizona. first, congressman, i want to get your reaction to what senator cotton said recruit and release. that sounds like we'll look at this more -- that sounds difficult to fix. >> i seem to think senator cotton is right. during the trump administration when we slowed things down all the left kept bringing lawsuits and that -- they won those lawsuits, some of them. that provided the incentives to come across the border. what we're seeing now is this parole program they implement. if you've been deported they'll search you out and try to find you and bring you back and give you another hearing. people been through due process. it is recruitment and releasing. we are catching and releasing and providing incentives to come across the border illegally and this administration has said they're fine with that. they haven't even acknowledged it as a crisis yet. >> harris: right. i want to get your reaction because so much is popping off now from the direction of the white house. still haven't seen what the president did from people he sent down there. we may never see all of it from private conversations. will he be briefed? here is more from white house press secretary jen psaki on the migrant surge and back to the congressman. >> we have changed the policies of the last administration as it relates to unaccompanied children. the majority of families, adults, vast, vast majority are turned away at the border. that is a message that clearly we need to continue to look for means and ways of getting out more and more out to the region. >> harris: your reaction to that. >> that's just not true. i talked to the folks on the border regularly. that's just not true. they are letting basically everybody in. they aren't turning away people right now. they are turning away a few under title 42 but they are letting people in and releasing them. that's what's happening here. they know there is a huge problem. that's why they a couple of weeks ago opened up and anticipated this surge. that's why they opened up additional facilities. i've seen some of those facilities when there was nobody in them. they're now full and they'll keep getting more and more full and just think about this. we're already almost at the same level that the highest level of apprehensions we ever did in the 2019 surge took place. that's where we are now and we aren't doing anything to slow it down. in fact, they are continuing to encourage people to come across. >> harris: a "new york post" op-ed today reads this way, congressman biggs. it doesn't matter how many times biden and top administration officials deny there is a crisis or claim the u.s. border isn't open. effectively we have open borders. anyone who cares to look at what is happening on the rio grande knows it. everyone seems to know it but biden. congressman. >> it's exactly right. i looked at some shots of what is happening in yuma, in my state. it is a big crowd of people moving out and going forward and we're seeing that all along the border at the ports you see people wearing biden t-shirts and biden flags. >> harris: we have it in the pictures. >> they're there. we know that. and they are denying there is a crisis. so nothing will be done. i would submit to you just like senator cotton said, i believe this is deliberate and what they want. they want open borders and that's why they are not acknowledging that it is a crisis. the crisis is they've been caught and that more and more people are coming through. it is a crime against humanity in my opinion. these people undergo so much. you are familiar with this. sex trafficking and human trafficking is horrible for these people. we are encouraging it. the cartels control everybody coming across that border right now. >> harris: it would seem that the administration is putting the united states and those in harm's way coming from the south as you so rightfully put all of that, congressman, unapologetically in this position they're putting us all. good to see you today. thank you. texas governor greg abbott is going right where congressman biggs was. he will go along the border, though, in his state and he will hold a news conference there addressing the migrant crisis and just after that he will join america reports for an exclusive interview with sandra smith and john roberts. be sure to tune in at 2:00 p.m. eastern on the fox news channel. we're all over this story. hillary clinton says the man who beat her in the race to the white house has transformed the republican party for the worse, she says. is she really the expert on the future of the gop? to sign the massive stimulus bill and border crisis. sounds like a good time to hear from the commander-in-chief and answers to actual questions from the media. kristin fisher is live at the white house for us. day 48, kristin. >> that's right, harris. president biden is preparing to sign the second largest stimulus package in u.s. history while simultaneously contending with the mounting crisis we're seeing at the border. so the timing is really ripe for a formal news conference with the entire white house press corps and if you take a look back at history you can see that the last 15 presidents had all held one at this point in their presidency. but instead of holding his first real news conference the white house is preparing for the president's first prime time address 8:00 p.m. on thursday to mark the one-year anniversary of the covid-19 shutdown. white house press secretary jen psaki said president biden will hold his first formal news conference sometime before the end of the month. in the meantime she is highlighting the roughly 40 times biden has answered shouted questions from reporters and indicating that may be the most reporters ever hear from him. >> we see more of biden, >> more than 40q and as in the last month. >> submitted to more extensive questions and follow up. the kind of thing we're doing today. will we see him regularly? >> i don't know that you'll see him more than 40 times a month but i'm happy to ask him that question. >> as you know, shouted questions as people are moving around the room very different from the kinds of questions that president biden would receive at a formal news conference where reporters have a bit more time and you can actually hear those questions as opposed to the president or reporters being shuffled out of joins me now. your top line thoughts before the q and a. i'm glad you'll take questions. go ahead. >> any time. my answer would be why would joe biden take questions? if they're able to ram through one of the biggest overhauls of our country in the form of a stimulus on the progressive side with only democrat votes and they don't want to talk about what is happening on the southern border, why would he? he would take them off script. if you're ron klain chief of staff or susan rice or nancy pelosi, of course your counsel to president biden is don't take questions. you'll muddy the waters on the messaging. you don't have to be an expert to see there is some level of cognitive decline. he is not what he was five or 10 years ago. it could be confusing and distractions. they would rather have a banner on fox news that says 48 days or that graphic of the former president saying he hasn't done one and say i a dress the american people directly, i take shout ed questions, we're turning the drama down from trump. they know their guy lost his fast ball years ago and distract against their agenda if he speaks to reporters. >> harris: when you roll back the tape on what you were talking about and you talk about his fitness for the job which comes with a tremendous amount of pressure obviously. this is not campaigning. where hip thet calls can be -- this is governing. if you get asked a if you questions you need answers. if you question how he is doing and maybe he has gotten older i want to show everybody else. president biden appearing to forget to name of when his defense secretary yesterday. the moment resembled an incident where the president botched the name of his health and services nominee a couple months back. let's just watch together. >> president biden: i bekerrea. excuse me becerra. >> my thought is bob woodward writes the books inside the white house. he gets inside sources what is really happening. we saw a ton during the bush, obama and trump years. will any journalist have the bravery to do the inside story of the conversations being had in the white house of how they pen in joe biden, how they manage his schedule, what he says, what they put on the cards that he reads from when he signs executive orders, how they managed his messaging. everyone around him knew his cognitive decline was real and they had to only showcase bits and pieces to the press to get away with it. who are the real power brokers driving the agenda insuring he signs something or supports something or doesn't support something? there is a story there and maybe an intrepid journalist willing to ask those questions. we're only seeing 1% of what joe biden says on a daily basis. they see the real deal. i with like to know what the real story is. >> harris: i think it will take more than bravery. it will take access. so far we haven't, as reporters, at journalists, had the access to that president in a news conference socially distanced with six people in the room. we can't even get that with the president. we'll hear from him thursday night 8:00 p.m. eastern in an address about covid. don't you think americans would like to see us ask questions at that event as things move forward? >> of course, but won't happen. thanks, harris. >> harris: yeah. thank you. as new york governor andrew cuomo faces sexual harassment allegations, there is growing evidence the scandal over covid-19 deaths may go beyond the state's nursing homes now. the publisher of cuomo's book on pandemic leadership is making some big changes with how they roll out those books. plus a leaked post on a private teachers union facebook page warns l.a. educators not to sthair their vacation photos publicly as the union is resisting what it calls an unsafe return to school. double standard or something else? >> we're fighting for our rights to go back to school because science says that it's safe and the utla won't let us. ordinary tissues burn when theo blows. return to classrooms yet members of the united teachers los angeles union are warning not to put vacation pictures on social media. a post on the union's facebook page, a group of about 5700 people, notes that such optics make it hard to argue in-person classes are unsafe. the first response a simple amen. then the twitter clap back began. one utla teacher tweeted this is not coming from the union, just a teacher telling other teachers not to be the one idiot who makes the rest of us look bad. every comment on the post said we aren't going to travel. every teacher i know has stayed home since last march. another user posted this. except for the first comment amen, which seems to agree with them. another, this post substantiates what most people suspected. it is not about student or teacher safety, it is about protecting the union's position until more money is milked from the system. dave rubin host of the rubin report. good to see you. first of all your reaction that this was playing out the way it is. again, the group of teachers telling others don't post your vacation pictures. >> this shouldn't surprise anybody and harris as you know i am here in los angeles, which i would say is in the top five most ridiculous cities in the united states at this point. i would put us slightly below san francisco, portland, seattle and new york city. top five. what's interesting about this is they aren't really saying don't go on vacation. they are mostly saying don't get caught going on vacation. and we know that mayors and teacher union people and all sorts of public officials have been caught going on vacation while they are telling everyone else to stay at home. in l.a. today it's another beautiful, perfect, cloudless southern california today. indoor restaurants are still closed. you still can't go to the gym and apparently we'll open up a little bit ironically on april fool's day according to newsom. there are over 2 million signatures on his recall now. the l.a. california is ridiculous. if they tell you something the reverse is usually the truth. >> harris: it starts with a friendly reminder. it is hard to argue it is unsafe for in-person instruction if parents and the public see the vacation photos and international travel. exactly what you say. are you telling us it's hard to lie if you create evidence? is that the message? >> yeah, boy, it sounds like some of these people went to law school. look, this is part of the problem. a year later. we're almost a year to the day of two weeks to flatten the curve. now it's a year later and we have the l.a. teachers union saying we won't go back to school unless you meet all these demands. by the way, it is not just that the demands have to do with physical changes to the buildings related to ventilation or things like that. that perhaps you could argue were covid related. it is also related to specific policies they want related to how they are going to teach and what they are going to teach and critical race theory and the rest of it. it has far more to do with a further injection of a bunch of terrible ideas into the system and acting in many ways like a mafia organization, not a group that is supposedly caring about the students. >> harris: i remember when their argument -- i'm old enough to remember last week when the argument on a different kind of injection. vaccinations and arguing about that. now it moved on to all these other things. those poor kids you can see why they are outside with parents demanding change. dave rubin, good to see you. good for a american people on policy, they seem to side with donald trump more than they do with the american people. the greatest example of this is the past covid relief package. there were things in the package unpopular to republicans. i get that. but to the american people the stimulus package seems to be a popular bill. americans getting checks and folks getting early start on the earning child tax credit. idea healthcare costs will go down and money will go to schools and vaccinations. things the american people agree on. republicans voted against that trying to appease donald trump and his base of voters. >> harris: so let me ask you this quickly and we'll move on. when you list those things you know they are under 10% of the bill. over 90% of the bill is going to other stuff like they haven't broken ground on it northern california the rail project. a big chunk of change in there for that. there are all these other pork projects. please don't go to that tired sermon that some people like the preach about well, every bill is like that. it has stuff mixed into it. this was supposed to be the one to save people at our most dire moment in history. your response to that, richard. >> i sympathize with that argument that there are parts of this bill that folks find unpopular. with that being said when similar covid packages came up under donald trump's presidency when similar bills came up there were things in those bills democrats found to be very unpopular but we understood that the bill was going to make the american people better off. we held our nose and voted for almost every stimulus package. republicans haven't done the same for joe biden. >> harris: we'll move to this. joy reid is taking heat again for a comment about the lone african-american republican in the senate tim scott of south carolina. >> got to love the tim scott standing there to provide the patina of diversity over that round of words, that basket full of words. >> harris: patina of diversity. wow. fox news prime time host and former congressman trey gowdy, a friend of tim scott went after reid big time over that remark. >> tim scott is a united states senator who worked his tail off to be part of nearly every significant policy conversation this country has. he can stand wherever the hell he wants to stand in any group he wants to stand with because he has earned the right to be there. the fact that you see a black man as a prop, joy reid, says a lot more about you than it does about tim scott. >> harris: he gets an amen, richard. >> look, i won't speak to why tim scott was at the press conference or provides adequate diversity to the republican party. it is important that democrats focus on the issues that we care about. foregiving student loan debt. >> harris: you won't respond with that what segment is about. >> my point is simple. that's fair. my point is that tim scott can show up wherever he would like and take positions. he has the right to vote how he wants to vote. i think the democratic party should be more concerned with issues and what our people care about than tim scott. >> i think the democratic party is obsessed with race and they have to go to race and use it as a wedge issue. for joy reid to use that and be insulting and condescending a and calling him a token we parade about the republican party that's about the most racist thing i ever heard. the democratic party needs to take account of it and those in the media. it is disgusting from the party that wants unity sitting there talking about a senator in that way calling him a prop like he is being used and he doesn't do and say the things that he wants to do because he believes them in his soul. that's disgusting. the left needs to answer for that and stop their obsession with race and move on and again to the issues that the american people count on and just to go back because i didn't get to respond to you earlier richard. you talked about the policies. the reason we love donald trump is because of his policies. low unemployment rate, booming economy. i know the democrats would like to start donald trump's term when covid started. let's not forget and erase history here. the policies work for the american people. >> you are right we are concerned. i'm obsessed with diversity and inclusion and i will continue to fight for those
