after a series of meetings that called between health and communications officials. politico goes on to report an email forwarded to rochelle wilensky concerned health officials who feared that the administration was interfering in their work. an early draft of the new cdc vaccine guidelines reportedly included a section on travel which was later pulled, the cdc director was just asked why the good brother is again on a good feeling but she is glad the process is underway. the process and the message to former officer derek show. >> letting the officer know that my brother was loved. he had a family that loved him. i wouldn't have let it go any other way. >> reporter: the process was delayed by ruling from an appeals court the letter third-degree murder charge in limbo. without knowing the charges or what the appellate court and state supreme court would decide on the third-degree murder charge, the judge since potential jurors home. they will try again the morning to select jurors, third-degree would be in addition to second-degree murder and second-degree manslaughter but when potential jurors were sent home legal teams got into motion. during this process the defense indicated they want to bring all case involving george floyd into evidence and argue that drugs, methamphetamine and fentanyl played a role in george floyd's death. >> drugs were in the car, there were drugs in the squad car and those drugs were identical to the drugs that were in mister floyd -- at the time of autopsy. >> reporter: that is when bridget floyd walked out of the court room. >> i needed to take a breather because i didn't like the things that they were saying, they did not matter. what mattered is that we need a conviction. that is what matters. >> reporter: demonstrators were out today. the minneapolis police chief estimated their number at 1000, no major incident. as for the delay colonel matt langer of minnesota state patrol said the security force they assemble is nimble and can adapt. shannon: very important trial, a lot of eyeballs the next few weeks. security perimeter around the minneapolis courthouse is very tight and all the fencing, barbed wire and boarded up businesses don't fit well with some locals. from the washington post on sunday, quote, some criticize the high-security approach saying residents who feel they are being treated as a threat. instead a heavily armed law enforcement officer in white supremacist, they believe instigated last summer's distraction. discuss that with the commission on civil rights, good to have you back. what do you make of the framing by the washington post. there are all kinds of fences and barbed wire in washington dc. they don't like to see. the washington post saying folks in minneapolis don't like what they are seeing around the courthouse but locals feel it is a bad reflection on them instead of looking armed law enforcement officers and white supremacists they believe instigated the distraction last summer. a response? >> we are hearing about this all along but no one has produced evidence of white supremacist causing insurrection in minneapolis. consistent with washington post narrative that has been incredibly divisive and incendiary and i would argue has caused a lot of division and destruction by continuing to perpetuate the narrative, the story of alleged white supremacists who caused the rioting, they can't find that individual. there is no such individual, no evidence of such individual and this narrative has been going on and on and on and i would say it is incendiary and led to more distraction and violence, pointing the finger in the wrong direction. throughout the summer in every city we saw where the writing came from and those who refuse to condemn the rioting, the destruction, scores of people killed, 700, 800 police officers shot, blamed on the phantom white supremacist. the narrative is false, the media is complicit in a narrative and 13, 14 years ago gallup had rated race relations in this country approximately 72 percent-73% of blacks and whites but relations were good or very good, more blacks on race relations were good but after the drumbeat of false narratives not just with respect to george floyd but going all the way back to before that, michael brown and treyvon martin, it it plummeted during 30 points much during the obama administration with the first black president. continuing to hammer this a falsehood is only dividing americans, not solving any problems. shannon: they spent a lot of money trying to secure that area. mike tobin was there for days, weeks on the ground as we watch distraction that affected people of every race and backgrounds, business owners who were devastated by what happened. today this is what we hear about the area. washington examiner says black lives matter and antifa allied activists shutdown several streets surrounding the courthouse for several hours activists chanted and marched up and down blocks in minneapolis calling for justice and a guilty verdict against chauvin. those who don't like the way this is being set up, others -- they were peaceful today but wants to be heard and they say justice will only be a conviction. >> regardless what you think of the case there is a trial. facts are going to -- we have a justice system in this country, we don't judge somebody however you look at the situation guilty before any facts are tried before a court and jury. what we have is we want a conviction. as to the people in minneapolis or any other city that suffered distraction, violence, looting, people being killed, residents want police protection. they don't care about this ridiculous narrative that is completely false. they want police protection and get their elected officials are asking to defund the police or blaming it on phantom white supremacy movement. we need to protect our citizens. we need less distraction, less violence and this is not solving that problem. shannon: we will watch the trial. there is plenty of evidence there are murder allegations and all kinds of things that need to be vetted that we will watch closely. thank you for dropping in. spring vaccinated, on twitter, good news, fully vaccinated people can safely hang out with fully vaccinated people. fully vaccinated people, do you think do you think there's a point? the cdc is not incentivizing people to get vaccinated, simple as that. if you are told you go through the vaccination, jump through all the hoops that state that can't do this if you thought you would do why would people rush to get vaccinated? >> it is this incentivizing people from doing it. why would you? i saw an article saying russian propaganda trying to do this incentivizing americans from getting vaccinated. why would you need some magazines on twitter when you have the biden administration saying even once vaccinated, once you go through this you shouldn't go for a restaurant or hang out with don't make the rest of the country do it. >> so many folks have been able to work from home but the reality is a lot of people in our economy never got to stay home, they showed up every day. >> beginning where we have to protect the health care system from being overloaded, flatten the curve, now the mindset seems to be no one mister forget this virus, we not only have the vaccine but far >> the street. we have nothing here. >> reporter: for mario and so many others their temporary home was here, and improvised camp on the banks of the rio grande river across from brownsville, texas. mexican officials shut it down 24 hours ago because of the conditions in the camp, nongovernment organizations describe as inhumane and dire. >> a place to find respite and access to resources they don't have right now. >> reporter: of the approximately 800 migrants that were in the camp most crossed into the us legally after biden lifted trump's remain in mexico dhs officials do not test migrants for covid-19 before releasing them so that falls on the city of brownsville. of the 1553 asylum-seekers tested under the catch and release protocols 185 have tested positive since january according to the city of brownsville. back in here, migrants i can asylum-seekers from mexico is hopeful the new administration will be a saving grace. >> i've waited for somebody like this. >> reporter: most of the migrants we have spoken to say if they can't cross legally they will do it illegally between ports of entry where us border patrol agents tell me there were over 1200 apprehensions just yesterday in the rio grande valley sector alone. shannon: thank you so much. on the us side of the border frustration is growing tonight within border communities. leaders say are being left out of the conversation about how best to handle the growing crisis. >> my name is bruneau, i am requesting you to put a halt to any measures about immigrants awaiting court dates, incidents and surrounding areas. we don't have the resources available to house and accommodate these migrants within our community. >> reporter: bring in that man to talk about the impact being felt in his city. great to have you with us. let's talk about something that has been very surprising to a lot of folks, this issue, people coming across the border not being tested for covid-19 or testing positive. the border patrol says he cannot legally force anyone in custody suspected of having the virus to stay in custody for a 14 day quarantine period. agents have been instructed to refer migrants suspected of being coronavirus positive to, quote, local health systems so to you as mayor of one of those border communities how are you managing that risk? >> it is frustrating because unlike cities further south of us, migrants being released into the community, their organizations i'm aware of where things are being done. we have some testing units but during the winter, that placed a lot of pressure on local areas and hospitals doing testing so we haven't been able to do that. it is frustrating to say the least. >> communities all have different levels of resources that you are being taxed as others are. tonight we are getting reports, the dhs requesting volunteers to help with the southern border amid overwhelming migrant surge. secretary kim jong un 3 denied there was a crisis at the southern border so not only are he sending law enforcement personnel but now the call has gone up for volunteers to go to the southern border. what is the situation on the ground? >> there is no plan right now. there hasn't been a plan, basically keeping migrants in the country of origin. it was rescinded. immediately after, we heard about migrants and that is the strain on the committee, pockets are volunteering, we are asking people to donate to the nonprofit organization. as mayor of the city, i do believe the federal government has fallen short of the needs of migrants as they continue their path to the united states. shannon: regardless of politics, everybody wants these people to be treated with safety, dignity and health, many of them escaping bad situations and they are desperate in coming here but an article tonight talking about churches and nonprofits that are being overwhelmed, running out of resources as well. what is your final message to folks about what is going on? >> mayors across the border are taking the lesson hard. we want to find some kind of balance for individuals as they are released into our communities but we have a responsibility to our constituents and citizens in our communities and that is one of our responsibilities, trying to work with individuals by providing cell phone services, computer access to the nonprofit organization, and to help the coalition to donate to because there's volunteer work right now in a federal presence to help businesses in this situation. shannon: we know you have a lot of challenges, thanks for dropping in with us. >> much appreciated. have a great night. shannon: john roberts raising eyebrows, the solo dissenter, turning judges into advice columnists next. ver?
