correspondent peter doocy live on the north lawn. good evening, peter. biko good evening, bret. it has now been six days since president biden said anything about what's going on at the border. members of the administration have been down there gathering facts but officials are trying to get the president's official events more focused on covid-19. >> president biden: i learned from the recovery act you've got to be hands on. >> that was during the visit to a va facility giving a covert shot. no plan right now for a visit to the southern border. >> a trip for the president as many of you know includes air force one, extensive security, includes all of you of course. >> a small white house delegation just got back from border patrol and hhs facility for migrants in the first to quit from someone who is there. >> we inherited a broken system. >> but despite a pledge last week to fix a broken system quickly... >> the urgency cannot be overstated. >> nobody has filled and present biden about the border trip yet. >> we do plan to brief the president this week on it. we have not done so yet. >> but positions did bring back first-hand testimonials. >> we did speak to many of the folks involved, including children. >> the administration recently defended reopening, arguing more space was needed for social distancing but now that's changed and "based on cdc guidance, office of refugee resettlement has notified facilities they may temporarily reactivate capacity within their full licensed capability up to save occupancy levels. >> cdc also put out some guidelines, many of you may have seen, i believe it was on thursday or friday that will allow for increased capacity at some of these sites. >> the president made remarks of an international women's day. >> president biden: many little girls and boys both who have grown up dreaming of serving for their country to know this is what generals in the united states armed forces look like. this is what vice president's of the states look like. >> but still, no formal solo press conference. >> he has had about 40 q&as since office. >> most of those are really short. >> [indiscernible]. >> and that may be the kind of access the white house has in mind after a solo press or they promise will happen this month. >> i don't know that you'll see him more than 40 times a month but i'm happy to ask him that question. >> somebody else tried again today to ask him a question about the senate filibuster and whether or not that is going to affect a voting rights package in the upper chamber, and the president answered that he would talk about that later. bret. >> bret: you've been the most successful getting the news out of those short questions, so peter, thank you. for the situation on the ground across the border, correspondent griff jenkins is at a migrant camp in northern mexico tonight. >> do you think that president biden will help you? >> you know what i need, that's what i need. >> mario from honduras is 1 of thousands of asylum seekers forced to remain in mexico along the border. >> where are you living? >> we don't have an apartment, we know have nothing here. >> for mario and many others, their temporary home was here, and improvised camp. but mexican officials shut it down. 24 hours ago because of the conditions in the camp, what nongovernment organizations described as inhumane and dire. >> if they need a safe place to find respite and they need access to resources that they don't have right now. >> of the approximately 800 migrants that were in the camp, most crossed into the u.s. legally after biden lifted trump's remain in mexico policy. dhs officials do not test the migrants were before releasing them, so that falls on the city of brownsville. of the 1,553 asylum-seekers tested under the catch and release protocols, 185 have tested positive since january according to the city of brownsville. back in mexico, and asylum-seekers from mexico is hopeful the new administration will be a saving grace. >> and waiting for summary like this, for people to help the mexican people, latin people. >> most of the migrants we've spoken to say if they cannot cross legally, they'll do it illegally between the ports of entry where u.s. border patrol agents tell us in the last 44 hours they've had over 1200 apprehensions and that's just in the rio grande valley sector. bret. >> bret: griff jenkins live just to cross the border in mexico. thank you. the biden administration is making contingency plans to house illegal immigrants within the u.s. one of those potential sites is fort lee virginia. that's where correspondent david spunt is tonight. good evening, david. >> bret, good evening to you. republicans are calling this a crisis, democrats are calling it a challenge. no matter whatever the wording is, fort lee virginia, about 30 miles south of richmond, virginia, may, and i want to stress the word may, be the home to unaccompanied children. recently members of the administration were here at this army post conducting a site survey to see if wortley would work. >> we don't have, right now, a request for assistance from ahs to put unaccompanied minors on any military inspiration right now. all that happened was the site survey visit. >> bret, as of a week ago there are approximately 7700 unaccompanied kids in the care of the department of health and human services. it right now are staying in a department for around 42 days. the bite in the administration is working to shorten that time period, that's where a place like fort lee may come in. i spoke to several residents in the area who seem open to the idea. >> i think that that's amazing for the community. i think somewhere for those kids to go and to be safe and protected. >> but not everyone is on board. newly elected republican congressman bob good from virginia says it's a bad idea. he wrote on twitter "open borders turns every state into a border state. it's time for president biden to address this crisis." bret, this would not be the first time such a thing happened. during the obama administration and trump administration and between 2012 and 2017, around 16,000 children were housed at five military bases in texas, california, oklahoma, and new mexico. again, to stress, there has been no formal guidance, no formal request submitted for fort lee virginia. we will continue to watch it. >> bret: david, thank you. the president is offering deportation relief and work permits to more than 300,000 undocumented venezuelans living inside the u.s. the move to grant the venezuelans temporary protected status would fulfill a campaign promise by president biden. senior officials say the u.s. is working to coordinate international pressure on disputed president nicolas maduro to hold free and fair elections there. embattled new york democratic governor andrew cuomo is digging into night insisting he will not resign. that comes after two more women come forward with sexual harassment allegations over the weekend and dozens of lawmakers are now calling for him to step down or be thrown out. correspondent bryan llenas has the latest tonight from brooklyn. >> there's been one bombshell after another. >> tonight republican state lawmakers are circling a resolution to governor into goma. >> i think we will continue to push this because we think is on able to govern. >> it would take 76 out of 150 state a simile members to impeach cuomo according to the latest fox news count, at least 47 new york state lawmakers are now calling for his resignation or impeachment. but in a telephone news conference sunday, cuomo was defiant. >> no, there is no way i resign. that's to the attorney general investigation, let's get the findings and then we will go from there but i'm not going appointed former manhattan attorney's, and employment discrimination attorney to lead the independent investigation into harassment allegations against governor cuomo. kim also put cuomo's former right-hand man and campaign manager behind bars. talks to democratic leaders writing that we need to govern without distraction for the good of the state, governor cuomo must resign. it came as accusation number 5 as to call former aides came forward. she accused cuomo of inappropriate behavior like kissing her hand and says that he hugged her inappropriately in a hotel room. it was once a temporary covid-19 hospital with 2500 beds that nursing home victims families say went underutilized. cuomo's administration remains under investigation for allegedly covering up the number of covid-19 deaths in the state's nursing homes. >> we should never forget about the nursing home issue. >> governor cuomo's refusal to resign, ralph northam, who did not resign in 2019 despite calls from democrats to step down. he is still governor. the question is will cuomo still be? bret. >> bret: we will follow that later. brian, thanks. tonight, we have a better idea of how the vaccine can move about safely between their friends, families, and coworkers. cdc guidelines are now out. jonathan has our report. >> you can go to the per station right here. speak of the cdc issued its first guidance on safe activities for americans who are fully have been vaccinated against the coronavirus. a first step in america's efforts to resume everyday life. >> you can visit your grandparents if you have been vaccinated and they have been too. >> fully-vaccinated people may gather in private without masks for social distancing. they can also visit on vaccinated people living in the same house as long as they have no risk factors from complication. if exposed to an infected person, vaccinated individuals do not need to quarantine or get tested if they have no symptoms. >> more than 60 million americans or 18% of the population have received at least one dose of vaccine. major employers including airlines and meat-packers are setting up clinics to vaccinate workers on site. and the biden administration says it is working with states to make it easier the general public to sign up for vaccinations. >> too many websites are confusing and don't work. there are not enough call centers or other ways to schedule a vaccine. >> connecticut, west virginia, and ohio are using covid restrictions on businesses, but keeping statewide mask mandates in place. governor mike dewine says ohio's mandate reduced case numbers and a deal with educators has 95% of the state school children in class. >> if you go back in school, promised by march 1, we will vaccinate everyone in your school that wants to. it has worked exceedingly well. >> federal health officials say that high school students will likely become eligible for vaccination in the fall and clinical trials of an experimental pill show promising results reducing levels of the coronavirus in infected patients. the cdc still advises against nonessential travel even if you are vaccinated. politico officials planned to update this guidance but then decided to hold off. >> bret: jonathan, thank you. up next, the lieutenant general. he is calling for a quick response team at the capital along with mounted police units. republicans have criticized the task force as being dominated by democrats. missouri republican senator will not run for reelection next year. the two term senator did not give a specific reason for the decision. the 71-year-old served 7 terms in the house and two terms as secretary of state. the fifth senate republican to decide against running for reelection in 2022. it is now the house's turn to pass judgment on the coronavirus relief package. some changes from the original version that came out of the house. chief washington correspondent tells us where things stand tonight. >> it is passed. >> next up, the house will sign off on the modified trillion dollar relief package. democrats are urging their house colleagues to stick together. >> make the case for progressives in the house why they should support this bill. >> it addresses the concerns of getting covid-19 behind us and from a medical point of view, providing the funds to get these vaccines distributed as quickly as possible. >> republicans noted that it includes more than $300 billion to make schools safe. it will be spent until long after the country's vaccinated. $350 billion for state and local governments. though some saw taxes go up during covid. and 15 weeks paid leave for federal workers dealing with covid. >> we did not need to authorize another $1.9 trillion, about $28 trillion in debt. we did not need this. >> federal benefits were trimmed in the senate from $400 per week to $300. some are expressing frustration. $15 minimum wage did not make it through the senate. >> there were a couple people who were concerned and a lot of frustration that the minimum wage increase wasn't in there. >> republican senators offered an amendment to ensure that $1400 rebate checks in the bill are not issued to prisoners. all republicans were on board, but democrats defeated it. >> they had a chance on saturday morning to stop checks from going to prisoners, from going to the boston bomber, for instance. and on that vote, the decline. every single democrat wanted to extend the practice of extending checks to prisoners. >> sending it to president biden for their signature. >> bret: one kiefer republicans going forward is the filibuster. now, signaling that he is open to changes. >> joe manchin says that he supports the filibuster and thinks it should be more difficult to invoke. >> the filibuster should be painful. it really should be painful. we have made it more comfortable. over the years, not intentionally. maybe it has to be more painful. maybe you have to stand up. >> mansions is under intense pressure here they say that he is a moderate has too much power to slow down their agenda. it is not entirely clear with the practical impact of a filibuster would mean. the president's preference is not to get rid of the filibuster. he argues that the white house has already gotten a lot done with it in the first6 weeks. >> bret: mike, thank you. the dow hit an all-time high on the way to gaining 306 points today. the s&p 500 was down 21. the nasdaq lost 311 entering correction territory there. up next, did not take long for the trial of a police officer accused in the george floyd's death. we will tell you what went wrong. first, here's one what some of our fox affiliates are covering around the country. a block party turns violent. police say rioters pelted officers with glass bottles, rocks, and other objects. more than 700 people were involved there. no serious injuries were reported. phoenix says video goes viral of a massive brawl between a customer and two employees at a bath and body works tour. a police spokesman says that the fight started over someone cutting in line. the company that owns the store says that people are concerned and they are investigating the incident. and this is a live look at orlando from our affiliate fox 35. one of the big stories there tonight, walt disney world's blizzard beach reopens after the coronavirus shutdown. the water park did not reopen with disney's other parks last july. it is operating jury selection. correspondent matt finn tells us what happened from minneapolis. >> the highly anticipated trial in george floyd's death came to a screeching halt in the opening moments. >> we are not trying to delay this case. we only have the ability to try it once. >> it is a third-degree murder charge that might be added against former police officer, .the prosecution and defense boh agreed that the trial should not continue until question about the third-degree charge is settled. his defense attorney says that it will file an appeal to review the decision. >> i have an obligation to do so. >> it runs the risk of having a conviction overturned. it wrote in its appeal that there is no need for this kind of uncertainty in any case, let alone a case of this magnitude. >> first they were told something very general and the later they were told something very specific. it does affect the jury selection process. >> it has jurisdiction over adding the charge and that it should continue as they await a decision. juries can adjust if a charge is added. >> at this hour, still no decision from the court on whether this trial will be delayed. jury selection was rescheduled for tomorrow morning. but even that could be postponed. >> bret: matt, thanks. the u.s. is presenting a peace agreement to afghanistan's war inside for review. american officials have told the taliban and the questions to be asked are how many teachers are there? what specific steps can be done to improve the timeline of how quickly kids get from shelter facilities into homes? what is the logjam in the process? >> can we expect to hear from them in the coming weeks ahead? >> anything on his schedule. >> bret: well, the biden administration is scrambling to try to deal with this issue on the border of the legal immigrant children unaccompanied minors showing up in these border patrol facilities. in fact, monday there were some 3200 migrant children stuck in these facilities. nearly half of those over the three day legal limit of the customs and border protection holding facilities can keep them for. so then they have to be sent someplace else inside the u.s. according to the law, more than 200 of them are under the age of 13. just to give you a perspective, back february 21st, cbp health adjust 9 unaccompanied children in those facilities. so, what about this and where it is going? let's bring in our panel. mara lassen, national correspondent, national public radio, and chief correspondent of the "washington examiner." where do you see this going and what about the administration's actions to deal with it? >> well, they are calling it a challenge. maybe we can agree on a better term. a -- of a mess. it took him a while with too many fits and starts and problems. but donald trump and his administration eventually got that border situation under pretty good control under a combination of the law, agreements with the neighboring countries to hold back some of these immigrants and have them apply for asylum from their countries and so on. and biden came in and basically blew it all up and always got a mess on our hands, entirely predictable consequence of a kind of willy-nilly set of executive actions, undoing actions taken by the previous administration. for all political purposes, mr. biden and his team. we won more than 1400 of these kids have now been captured over72 hours. they are now looking at facilities around the country. >> yep. they've got to find a place to put them. they wanted to reunite them with family members. they wanted to see if they could keep them in their own countries and somehow dissuade them from coming. but there are a lot of incentives to come. the biden administration is welcoming to immigrants. the traffickers who take money from these families to get them to the united states. so, it is kind of a supply problem and a demand problem. he said that that is what he was going to try to do. give them aid. try to keep people from coming to the border. >> bret: but isn't president biden one of the reasons? >> absolutely. they think he has a more welcoming approach. absolutely. that is the tension for biden. he wanted to change immigration policy. wanted it to be more welcoming. he wanted citizenship, especially for the dreamers. all of that is a magnet. at the same time, he doesn't want to have a huge influx of people at the border. we are getting to this time of year when border crossings are higher. springtime is when people come. so, it's probably going to get worse before it gets better. >> bret: the trump administration would point to saying that no matter spring, summer, winter, or fall, they had a bigger handle on things as far as enforcement and telling other countries not to send these kids or anybody else. here are some senators on the issue of the border. >> the biden administration is essentially saying if you are willing to make that long dangerous journey -- >> they are rolling back policies to allow the border to be overrun. the asylum claims are going to go through the roof and by the summer you are going to have a million people coming through the country. >> we do not want to see -- we have to have a sensible policy to protect people who are at risk, but also make sure we have secure borders. >> bret: your thoughts? >> well, we know that joe biden was worried about this during the transition. the message has been if you come, you can stay. top officials went to the border over the weekend and actually heard the vice president chief of staff say that they haven't talked to the president about it. all of the policy is devoted to limiting the number of people who crossed into the united states. it is accommodating the number of people who cross into the united states more quickly. if you do see the administration starting to fly people all around the country to try to house them, it would be harder for them when it is just a challenge and not a crisis. >> bret: this is going to shape up to be a big issue ahead of 2022. i want to turn for a second and talk about the covid relief. 50-49 over the weekend. and the prospects of what that means for any other bipartisan legislation. >> it has been pointed out by a number of others, republicans went down in the white house they tried to begin negotiations with the biden administration and nothing ever came of that meeting. they ignored what they said and went ahead and rammed through because they could. the bill that they have now passed, which is now being passed, bret, at a time when all of those signals are claiming that the economy is poised for a rapid recovery, bill or note bill. we've got billions of dollars that have not been spent. so, this may be a triumph and they are all cheering on saturday night, but my guess is this may not end well. >> bret: it is expected to pass in the house even though it is a majority there. >> yeah, i mean a bill this size, we are going to find a lot about. but also, what i think you will see the administration does, taking a real victory it was in their paycheck instead of a check sent to their house. this is a lot of social policy in this bill. it would cut child poverty in half or by 40%. that's really big. i have also heard, although i don't know the details. there were actually some things with specific republicans in this bill. i think the big question for me as this was totally partisan party line vote. when biden turns his attention to the next big project, he will include republicans in the ground floor on the discussions of how to create the package, not at the end after he has his plan and the republican say, well, here is ours. but if he does truly have a bipartisan process on some of that. >> bret: we going to resign because of allegations. the premise of resigning because of allegations is actually antidemocratic. >> i've always believed that sexual harassment is unacceptable and should never be tolerated. a call for our attorney general to do a full and thorough investigation and i have confidence that she will do a thorough investigation. she will turn over every stone and not let any outside interference, political, or otherwise occur. >> bret: investigation of the governor is now moving forward. there are 5 accusers now. two more over the weekend alleging sexual harassment by governor cuomo. as far as new york lawmakers in the state house, 47 lawmakers are now calling for his resignation or impeachment, and you see here, 35 of them democrats. among them, the new york senate majority leader, andrea stewart, calling for him to step back. think that happens? >> well, so far he has cut it out. governor of virginia toughed it out after his blackface scandal in 2019. so, it's possible. one of the things that is frustrating for republicans here is that if cuomo were to go down, it would be because of this me too stuff and not for the horrific handling of the coronavirus pandemic. not just the lying about the nursing home deaths, but his handling overall, which is just absolutely disastrous and he was celebrated for it at the time. but what we have seen with the head of the state senate, comes out and says the governor should resign. apparently did that after the fourth and the fifth came forward to accuse governor cuomo of inappropriate conduct indicating that may be three okay. but four and five is just too money. it is a very fluid situation now. >> bret: the nursing home scandal obviously may be not as much focus as when these accusers came forward over the weekend. but here is one of the state lawmakers. >> andrew cuomo has always been known as a bully. people call him a bully. what does that mean? that means he pushes very hard and doesn't have the sensitivity to what the response is in that other person. and that is exactly what harassment is about. that is why he got himself into this trouble with the nursing homes. >> of any decision a governor makes, whether he protected a nursing home or did not say five also cost a lot of lives if you made the nursing homes hotbeds for transmission. >> bret: your thoughts? >> as he suggested, it is a sign of our times that this terrible decision on the nursing homes and other matters which cost arguably thousands of lives ranked second in the order of things that have got andrew cuomo in trouble. i think he has solid ground to stand on. he is asking that we wait until there has been an investigation. that is a perfectly reasonable position. what is striking to me is the fact that he doesn't seem, you know, all of these democrats that are criticizing him. they are not criticizing him for the national disaster, which is deadly. they are criticizing him on this other matter, which i think really says a lot about americans. >> bret: the white house is obviously waiting for the investigation line as well. >> right. sure, they want to stand back and away from all of this. look, we don't know if this or the nursing home scandal will be the thing that hurt some more. he is going to have due process. there are different models for getting through these things. does either seem worse and potentially more damaging? every time another woman comes forward and the fact that he doesn't seem to have a whole lot of friends even in his own party in new york state makes it tenuous. but you know what? due process like anyone else would be accused. >> bret: do you think they could get through the blackface scandal today? >> well, it wasn't that long ago that he got through it. i mean, it was only 2019. you are saying that it was -- >> has the culture changed? >> that's a really good question and i don't know the answer to that. so confusing that he even said
