emotional while he was speaking, saying that he understands, even though his intentions might've been one thing, it doesn't matter if it made other people uncomfortable. >> i truly and deeply apologize for it. i feel awful about it. frankly, i am embarrassed. by it. >> cuomo apologizing, but says he's not going anywhere. >> not going to resign. i work for the people of the state of new york, they elected me, and i'm going to serve the people of the state of new york. >> former aide lindsay boylan who accuse the governor of unwanted touching, including a kiss, tweeting, how can new yorkers trust you to lead our state if you don't know when you've been inappropriate with their own staff? another former ada, charlotte bennett, claims he made her feel uncomfortable with inappropriate comments. she said she reported his actions, we are confident they made him aware of her complaints. 33-year-old and a rock shared this photo with "the new york times" from a 2019 sending people with covid into nursing homes, causing thousands of deaths, and then the attendant cover-up an end obstruction of justice, potential obstruction of justice. of these things, cuomo deserves due process. that was something he was not willing to give brett kavanaugh when he was accused of something for whom he had never even met the woman, much less that anything untoward had happened. cuomo really lead the charge in calling for cavanaugh's head, as did so many of these media figures like dolly a lift wake, who analyses the need for due process for people who are under allegations. or for people who have photographic evidence, employment track records, and other things as in the case of cuomo. >> shannon: if we're going to be consistent, we have to have due process. i think to be fair, whether you are a guy, or some other guy is being accused, all of us should want that for ourselves, because we will all be accused of something at some point. you mentioned that there's photographic evidence. it let's look at the picture that "the new york times" has published notice must be from a wise dominic wedding reception in which governor cuomo was touching her, he asked if he could kiss her. he said today, want you to know this, he never touched anyone inappropriately ever. there's this picture, and assemblywoman who is a democrat for manhattan tweet says, cuomo keeps repeating he hasn't touched anyone inappropriately when there is literally a photo of him touching someone inappropriately. he says this is just how he greets people. >> i do think this is a thing that the me too movement has prevented proper debate about. what is okay, or even unwelcome contact versus what is criminal or worthy of cancellation or having someone step down? the problem is, we haven't had a really good conversation about these types of workplace interactions, and we've just used them as a political cudgel. that's inappropriate, as he just said, whether the target is a republican or democrat or otherwise. it's not something andrew cuomo believed just a couple of years ago when he was demanding that brett kavanaugh not be placed on the supreme court for allegations for which there was no evidence. i'm sure he has a different -- has a change of heart now that he's in this situation. andrew cuomo has this reputation for hostile behavior with colleagues, with the press, with people who have critiqued him, so that's probably not helping him right now. there's a difference between hugging someone, and truly inappropriate contact that requires greater action, probably. >> shannon: i want to ask you quickly what we have you, because you follow the hunter biden story, fox news today confirming that the federal investigation to his tax affairs is active and ongoing. sources are telling fox that they are treating it seriously. when do you expect we will know anything more about the investigation into hunter biden, do you think we will? >> i don't know, shannon. the fbi has a really bad reputation at this point for whether it can actually see an investigation through for as someone as politically connected as hunter biden. in recent years, we saw the fbi was willing to put people through the absolute ringer and cause them to spend millions of dollars in legal defense, risk jail time if they had any association with former president donald trump. we've not really seen that when it comes to some of their more favored democratic targets. i think we will see precisely how serious the fbi takes this if we ever see charges -- i wouldn't hold breath mounting on the biden administration over a major surge of illegal immigration among our southern border. applications are up as much as 350% in one area, and coronavirus exacerbating the danger. casey stegall is looking at the situation for us tonight in eagle pass, texas. >> and just the last 24 hours, u.s. border patrol agents shut down three stash houses used for human smuggling in the rio grande valley of south texas, yielding more than 50 arrests. one small snapshot, officials say, of a growing migrant surge among the southern border. >> we are looking at 5,000 a day that we are encountering on the southwest border illegally entering. a 400 of those are unaccompanied minors. unaccompanied minors or children under the age of 17 traveling alone and caught entering the country illegally. in the big bend sector of texas, customs and border protection figures show a 141% increase in juvenile apprehensions compared to the same. lack of time last year. if they are up 122% in (laughing) (trumpet playing) someone behind me, come on. pick that up, pick that up, right there, right there. as long as you keep making the internet an amazing place to be, we'll keep bringing you a faster, more secure, and more amazing internet. xfinity. the future of awesome. ♪ ♪ >> shannon: right here on "fox news @ night" last night we showed you how the president of the los angeles teachers union is calling what she calls, wealthy white parents, for pressuring officials to reopen the school district. tonight, minority parents are furious. she breaking news corresponded trace gallagher shows appeared >> first, gavin newsom playing out it planned to open schools, and the teachers association praise part of the plan. at the los angeles teachers union slammed to the plan from top to bottom, calling it "a recipe for propagating structural racism." watch. >> some voices are being allowed to speak louder than others. we have to call out the privilege behind the largely white, wealthy parents driving the push for a rush to return. >> except now, a number of black parents in south los angeles are making it crystal clear, the l.a. teachers union does not speak for them. listen. >> because education for us, for our culture, is just their way out of poverty. every day that our children are not in school, that's a day closer to poverty for them. because the coach of the south los angeles youth football teams as the union should have spoken to the parents before speaking to the public. >> most of our kids before the pandemic were 80% on a roll rate, nelson's distanced landing it has dropped 20%. if they're getting b's and c's. good parents and others are planning on reopening schools. filed a lawsuit against governor newsom challenging his ban on indoor youth sports. at the lawsuit is setting equal protection sane, college and pro sports can play indoors safely, soak in high school. here is one of the athletes. >> i definitely missed most of my teammates. i liked playing with my friends, and being able to feel the connection on the court, and the enthusiasm, and also the adrenaline that came with it. speak of the same law firm handling the lawsuit has already won a won a temporary restraining order against gavin newsom allowing youth sports inc. san diego county. >> shannon: trace gallagher on the west coast, thank you, joyce. the l.a. teachers union looking like it may have some complications and what credits are calling it's attempt to play the race card in the battle over reopening schools. let's dig deeper into this story. jaime daly, west point grad, jeremy hunt, welcome to both of you. >> thank you, shannon. >> shannon: the leader of the teachers union out there said if you give out money on the basis of the plan for reopening schools, it will benefit white and wealthier schools because they don't have the same transmission rates. it's a recipe for propagating structural racism. here's a little more. >> if you can envision funding on the reopening of schools, that money will only go to white and wealthier schools that do not have the transmission rates -- >> shannon: that's the teachers union president. we want to play renee bailey, the mom responding to her. >> that is a very generalized and almost a racist comment in itself. as a culture of black and brown people, we don't want to be generalized. we don't want to be stereotyped. to say that reopening school is structural racism, that's wrong. >> shannon: you are out there in the heart of the battle in california, your response? speak of the center for american liberties filed a civil rights lawsuit back in july of last year within days of the governor announcing the shutdown. before i filed that lawsuit, i spoke to inner-city teachers in los angeles, and many of our 15 plaintiffs are minority plaintiffs, immigrant plaintiffs. these are parents who deeply care about their children's education. closing the schools is the structural racism in california. let's face it, it's the rich white kids, like the kids at gavin newsom or governor, who are able to get around the shutdown and go to schools. it is the inner city children whose schools are already failing them in the best of times where not being punished. it's the parents of those kids who are having to stay home and play teacher him and the older children of those kids were having to leave their jobs to stay with her younger siblings. the arrogance and insensitivity of the teachers union is emblematic of the fact that they run california, they own the politicians, and they are using this crisis to further political agenda, it is disgraceful. bringing it back, we believe firmly there's a fundamental right to education in the constitution, sweetly in the state of california, as well as federal. we are pushing the court to recognize that in the ninth circuit. >> shannon: those parent sound very frustrated, jeremy. >> absolutely. if they have every right to be. my hats are off them for organizing. that they are doing protests, and having the whole rally out there in los angeles. my hat goes off to them, they're doing the right thing. at the teachers union president -- to make this all about race is completely backwards. the real issue here is about people who want to help students and get them back in school, and those who don't. it's about teachers that want to get back and do their jobs. they can get back to helping students, and union presidents that want to exploit the pandemic for political gain. we can see where the battle lines are being drawn on these reopening issues. honestly, you have to wonder, why would they make this all about race? while, in this country, it works. if you have the right politics, you can throw in the race card anytime you want, and you are excused from disenfranchising black and brown kids from getting their education. that's my issue with this entire story. i'm happy to see parents speaking out making their voices heard against these teachers unions. >> shannon: quick comment from both of you two on some race-related curriculum that's popped up in arizona, the department of education. this is according to christopher rufo, who says he's gotten his hands on these materials. racism can be as racist as three months old. you can have a black friend, partner, and child and still be racist. of those two relationships do not give you a one-way ticket out of racism town. quick comments from you both? >> amen. not only should more people fight back, they should be like this principal in the first place, that's who should be educating our children. instead of getting his job back, they should promote him and make him superintendent of men for school so he can teach everyone else to be suspect of what's going on in social media. the idea what we have on what you're seeing on a day-to-day basis is accurate and representative of larger american marketplace of ideas is often wrong. we need adults to be teaching children who spend every waking hour on line to be skeptical of the information that they are finding online. this is exactly what we need educators to be doing. he did exactly the right thing, i'm glad he fought back and i'm glad he won, i'm think he deserves a promotion. >> shannon: speaking of online, there is a mystery with twitter. with this trusted report team's account popped up on twitter. it was going to fact-check thing. it was immediately blue checks. it started putting up defense of the biden administration. it has been suspended, everyone trying to figure out how this account was automatically blue checked. they seem to be leaning left. these are the pages it was following, to left-wing nonprofits, two for the southern -- for twitter employees, the president, cnn, and "the new york times" and the 11 youtube employee. we have no idea how this account got set up to be the arbiter now checking everything. it has since been suspended. it's a mystery. think of this is exactly what the memphis principal was talking about. right, shannon?
