shannon bream in washington pit we begin with democrats tripping governor cuomo of a many of his emergency powers as they call for his resignation continuing to grow. alex olga and joining us live from new york tonight. good evening, alex. >> good evening, shannon. and eric state legislatures said that it is set to strip governor andrew cuomo of his pandemic emergency powers by friday. one assembly member writing on twitter that this would also require the governor to post information online about executive orders and give local governments the right to issue them without state approval. it's to transition through the end of the disaster. among other things. some think this is not enough, especially after cuomo was highly criticized nursing home policy during the pandemic. >> this distraction distracts from the work that we have to do in albany. and i think that is for the good of the state to allow -- the governor should resign. >> he faces sexual harassment claims and now a third woman overseen an independent investigation. >> i can speak on behalf of the president and vice president so let me reiterate that they both believe that every woman coming forward should be heard, treated with respect, treated with dignity. >> the latest woman to speak up sharing this photo with "the new york times." she said in 2019 cuomo put her hands on her face at a wedding asking if she could get there. they have not confirmed -- we've reached out to the governor's office, but have not heard back. the executive director of the women's march tweeting "conduct like this is despicable." senator pierce and joe brennan writing that the behavior described in the allegations completely unacceptable. kathleen rice are urging the to step down. congressman lee zeldin tweeting that because of the seas exploring a 2022 run for governor. cuomo says he never intended to ask inappropriately. he is not held in on camera press briefing in the last 11 days. >> shannon: alex building in new york for us tonight, thank you, alex. we are learning more tonight about the suv involved in today's crash in southern california that left more than a dozen people dead. new pictures showed the suv that driven through a section of border wall with officials telling fox news that the crash happened after a hole was cut into the fence. a second vehicle had entered illegally through the same hole, but was stopped by border agents. 19 arrested in that case. the section of wall had been constructed between 2007-2009. not part of the fencing that was done under the trump administration. breaking tonight, president biden moving up his timeline for getting all american adults access to a covid-19 vaccine. correspondent gillian turner reporting on a busy day at the white house regarding vaccinations. a stunning projections on illegal immigration in the implosion of a cabinet nomination. a lot going on. >> sure a lot to unpack. president biden upped the ante today in the battle against covid-19. he announced a partnership between pharmaceuticals -- it's supposed to speed up the timeline to vaccinate every single american in a pretty big way. >> president biden: we are on track for every adult in america by the end of may. >> he also rolled out a new direct statement that all teachers and school staff by the end of the month. he insists this requirement will speed up the process of reopening schools nationwide. with that done, the white house insists their main focus now is getting the presidents coronavirus relief bill passed in less than 12 days with federal employment benefits run out. but there is also another crisis hurtling towards the president. when asked about a looming surge of 20,000 minus at the border today, the president said this. the department of homeland security projects that up to 117,000 of them will cross the border this year. but press secretary jen psaki insists they've got it handled. >> we have the secretary of homeland security conveying it as a challenge, we are going to approach this without labeling, we are going to approach this with policy, with humanity, and with focus on what we can do to keep these could save. >> blaming the search on covid related -- lawmakers on both sides of the aisle are sounding the alarm. >> all we did in the last four years to stop illegal immigration is going to be damaged within months. >> the number of unaccompanied kids come at the of families that are coming in are just increasing every day. >> shannon: breaking tonight, the president's nominee to lead the largest office at the white, management and budget, has withdrawn her nomination in the wake of bipartisan opposition to her nomination. she says she doesn't want to be a distraction to the biden policy agenda. her decision comes after weeks of public scrutiny focused on her past partisan attacks on twitter. shannon. >> shannon: julien turner, thanks for the wrap up. at least 59 michigan national guard members station up the u.s. capitol are reportedly sick after eating undercooked meals. a bipartisan coalition of michigan's congressional is demanding immediate attention to remedy the situation. calling for an end to all of the capital security measures. in particular, d.c. eight delegate tweeting this "we cannot have the capital complex closed off from the people the people predominantly." there are state-of-the-art ways to protect the complex without fencing which makes the united states look like a totalitarian regime trying to keep its own people out." testifying in front of the senate judiciary committee explaining what the fbi knew and when about the potential threats ahead of the january 6th riot. and about who was and was not responsible for storming the capital. >> certainly looking for violent extremism of any ideology. we have not to date seen any evidence of anarchist violent extremists or people subscribing to antifa in connection with the sixth. that doesn't mean we are not looking. >> shannon: let's discuss what we learned today with retired lieutenant randy sutton and former deputy assistant attorney general, john hume. welcome back to both of you. >> hi, shannon. >> shannon: what's caught my eye today was outlined in the hill, they talked about frustration and capital breached -- the hearing also revealed that he was on aware. specific calls for violence on generally six including those that suggested protesters go to the capital "ready for war." how does that happen? this bulletin and a lot of other agencies -- they didn't get the bulletin either. >> that illustrates the absolute debacle that this became. the fact that the fbi director himself was unaware that there was this threat underscores how the failures of leadership have just been absolutely astounding. you know, here's the thing, shannon. who are the people who actually faced the line of destruction here? it was the officers of the capitol police and these men and women suffered incredible injury. here's one of the things that has not been brought up to the public. and not only were these men and women assaulted physically just by the pushing and shoving and all that, bear spray, wasp spray, a brake fluid, all of this was done and this was done in a coordinated -- this was a coordinated attack. and the fact that the fbi was unaware of it and didn't disseminate this information properly to the capitol police and the other agencies is a incredible leadership failure. >> we know we got a lot at intel that comes in for many, many different troops, but we also learned today that the fbi actually visited some people who were on their radar and dissuaded them from coming to the capital. but how do we get the answer, how is there accountability, legal or otherwise, to make sure this kind of thing doesn't happen again? >> look, i served with chris spray in the days after 9/11 and i have every faith in his ability and his commitment to maintain security in the country. this actually reminds me a lot of what we saw after 9/11. there was intelligence coming into the system, the fbi did know, the failure was of analysis. it's not that there is not a and of collection, they just didn't understand the importance of it and how to bring it out to the right people. i think what you are going to see it, i hope, is not what you saw today in congress where people from both parties were trying to place political pressure on the fbi to prioritize the january 6 riot or prioritize going after people from the summer riots. they have to let the fbi do their job, conduct proper oversight, but not typed on not try to politicize the whole thing. regardless of whatever leadership you may have heard, i think it's a vast improvement over what happened under jen call me. >> shannon: just -- let me ask you about this. shannon: house representatives poised to act on hr one, the democrats saying the measure is about extending voter access. the republicans say it may strip away safeguards and easier to manipulate ballots. digging into the details for us tonight, good evening, chad. >> shannon. numbers matter in congress, there's a reason democrats call this voting rights measure hr one. as in the first bill house democrats assigned a legislative number. >> this is hr one, so this is most important for nancy pelosi to hold onto her power. >> house here speaker nancy pelosi said it's not as nefarious as he suggests. >> this was to end the voter suppression. >> the measure allowed 16 and 17-year-old's to register to vote and requires early voting. ballots arriving late would still be good ten days after election day if postmarked on time. the bill federalize -- it's up to states to assign times, places, and manner of holding elections. >> it's very clear while they watch us to deal with -- so that they can sign for election and everybody all across the country and give it a cookie-cutter reform. >> democrats aren't the only ones dabbling in election law. republicans in iowa state legislature are cutting early voting by nine days. an arizona state legislator crafted a bill which would permit state lawmakers to ignore election returns. and electoral votes as they please. some republicans assert that the 2020 election was fraught with a irregularities. >> and his dad in the senate along with any other voting measure. at that is why some fear election disputes and 2020 could be a dress rehearsal for 2022 and 2024. >> shannon: think you so much. the showdown between voting procedures and a split within the democratic party is wiping now over progressive demands. let's discuss both about this new bill pending it's going to the house right now. headline is "making every election like 2020." if you thought the 2020 election ran like a finely oiled machine, you will love what democrats plan next. guy. >> the editorial in the journal is exactly right, this bill is terrible. and you will will often see democrats highlight little pieces of it, but the devil is in the details and there are a ton of details that are just horrific. pellet harvesting is illegal in most places for good reason, it is legal in california which has a very messy system and in fact we saw illegal ballot harvesting lead to a fraudulent election that had to be redone in north carolina. this bill would make ballot harvesting legal, but also federalize our entire election process rather than decentralizing it to state and local governments which i think is contrary to what the founders wanted and doesn't make sense. i don't think we need to run more out of washington, d.c. it is just one thing after another. it is a power grab for the democrats. i think they might squeak it through the house, but i hope he is right in that report and it's dead on arrival in the senate because it should never become law. >> shannon: it is a big bill, there are a lot of things tucked in. it would also create a scheme of using public funds, taxpayer dollars to match donations six to one. and the money would come from a 4.75 surcharge on fines paid by businesses and corporate officers. it would create an ethics code for the supreme court. it is pretty sweeping, it's not just to make sure people have better voter access. >> 60 per 7% of americans support this and 67% of republican support this. let's just be very clear, ballot harvesting is a piece of lingo that has been put out by opposition groups that are very well-funded. we are talking about -- >> not funded by anyone. >> i didn't say you come i said the people who are using this term to push it out there. the reality here, guide, as you know very well is that we restricted -- early voting in arizona, republican states, has been in effect for over a decade. it is overseen by an independent commission. republicans, democrats, independents, they used early voting. it only became convenient when donald trump wanted to challenge the election because he had his own issues. so yeah, i understand the republican party is in a bit of an existential crisis. they can't decide between qanon or the logic-based people so they have to figure out where to go. but the reality is -- 's view on there's a lot to impact there, think mostly republicans have made it clear they've want nothing to do with qanon. >> writes, but they want -- >> shannon: that is unfair. okay, but let's talk about existential crisis. i want you to get on this idea that progressives are really pushing over the old guard. they feel special urgency to get their policies passed into law. it is propelling their unity against those party leaders and members they believe are not fighting for the policy. quick comment from both of you, guy to you first. progressives really want the democrats to be doing a lot more, they are disappointed in president biden when it comes to the minimum wage and other issues they thought they would have better support. >> it is mach one and they are trying to pass this gigantic so-called covid relief bill, some may be a little bit of patience is in order here. for one, myself, i hope democrats -- there progressive wing remains at each other's throats. for the next four years, that would be fine with me. >> shannon: and what do you think -- is there more unity than it looks like from the outside on some of these issues? >> [laughs] i don't know about that one. i would like to see more, i would like the biden administration to be more receptive to the progressive wing, the working class wing, the union members to help them get elected, the front-line workers who helped get them elected. and then -- he has come of course. the reality is he of a battle between a big business part of the democratic wing and the working class part of the democratic wing. people are struggling. $2 million check that they were promised one time -- it's a promise, so people want to see working people want to be able to afford to pay their rent. listen, they want to make sure that people can afford to pay their rent. this is something about the economy as a whole. it's a consumer-based economy, $50 minimum wage is well overdue. it's been a fight for 15 years. florida voted for it, florida voted for a job and they voted for the $15 minimum wage. >> shannon: okay. we have to leave it there, but clearly there's some things that the two wings within the party have to work out. and inter-piety fighting is not i don't... the strength to break through has always been built together. crafted with the people who stand beside us. introducing career services for life. learn more at phoenix.edu >> shannon: california splint open up at schools again is meeting fierce resistance tonight from the states largest teachers union. sharing a much different message in los angeles, trace gallagher is on the case live. good evening, trace. >> good evening to you. most californian schools have closed. this weekend, california finally thought it had the remedy by finalizing a much anticipated to reopening plan that offers $2 billion in incentives to get younger kids back in the class and an additional $4.6 billion for learning opportunities like summer school, tutoring, and mental health services. the plan would also provide vaccines, but not require students or staff to be vaccinated before returning to the class. the california teachers association praise parts of the plant and gavin newsom thought they were onto something. watch. >> i'm sure you will find some people that have strong opinions, but the bottom line is we created a framework that we believe is consensus. in consensus doesn't mean everybody is happy, it's part of the negotiation, it's part of the process. >> turns out the united teachers of los angeles, the state's largest local union representing the states largest school district, is very unhappy. in fact, the union is slamming the plan for propagating structural racism. >> we are being unfairly targeted by people who are not experiencing this disease in the same way and students and families are in our communities. if this was a rich person's disease, we would have seen a very different response. >> she went on to accuse white wealthy parents of increasing the political pressure behind a rushed return, although students in lower income communities have experienced well-documented and widely reported struggles under remote education. bottom line here, the los angeles union that represents 600,000 students will have a great deal to say about what happens to the states 6 million students. >> shannon: they will. trace gallagher, they could for to get into that for us. good to see you. governor newsom pushing republicans plan to get kids back in the classroom and taking his message to an elementary school in santa clara today. talk about all these latest developments in golden state with congressman darrell, welcome back, sir. >> thanks for having me, thanks for covering this basic attempt to bribe his way into getting the teachers back to work, the teachers who were not teaching while our fire, our police, our emts never stopped working. >> shannon: here's the interesting thing, we have these union leaders same that they do not want to go back, they think it is in some ways promoted systemic racism and that it is favoring certain white families are wealthy families over others. on the other side, you have people very skeptical who say this won't actually put kids back in classes. the editorial board says that is, by the time they get their seat assignments, the school year will be effectively over. they don't see it's going to get back in seeds anyway. what is your day? >> they are talking about phasing in one day a week and so on. but as you know shannon, we have a vaccine. if you take your one or two shots, you are immune. so anyone trying to save this racist or anything else -- once we have the vaccine, which was rushed to market, but now is a proven $50 million plus people have it, myself included, we are immune to the disease. if you are immune to the disease, how is that you say you can't go back to teaching these children when in fact everyone else -- if you are a first responder and the essential industry worked our way through it -- that includes minorities that worked at mcdonald's or denny's or any other of other places in addition to first responders. the fact is, the teachers were offered a bribe, i just wasn't big enough. so they are going to stay home. >> shannon: they say that they feel they are in danger. a tweet from reopen california schools -- and they've been tracking and pushing -- they are certainly activating for getting everybody back says this, only 5% of students are in the classroom full time as of last week while nearly 100% of florida kids are. yet hospitalizations are pretty much the same. gavin newsom and california public health policies are feeling california 6 million schoolchildren. so if you are to follow the signs, what is the argument they are in california against only have been percent of kids in? >> there's no science to justify this. young people have never been the target of this disease. let's remember, in california you must have vaccines before you can come to the classroom. and yet teachers are saying they want the vaccine to be optional and they don't want to come back with or without it. the reality is our teachers union has been driving an agenda for a long time, now they are driving an agenda that they don't want to work, that they want to be paid. a that is to the detriment of this mike these kids. it is racist and it is wrong because the fact is that the most adversely affected are those who need public education the most, that includes our minorities. the fact is our private schools are opening and california and they are not having these problems. so getting the public schools back to school is critical. l.a. is letting us down, but it's really our governor that is letting us down by not ordering them back as he should. >> shannon: it sounds like nobody is really happy with this plan, so we will watch to see how it plays out. congressman, thanks for stopping in. >> thank you. >> shannon: portland cleaning up from yet another weekend of violent protests as resident say they have had enough. r a flare-? unique methods for enforcing the law. what can you tell us? >> yeah, her method is not really enforcing the law. you and i have spoken about her in the past. she keeps popping up on my radar because dangerous suspects go in front of her court and she never requires bail or at least she doesn't seem to. she releases these folks on their own personal recognizance. we have individuals going in front of her including one antifa style member, someone who is trying to join the cause potentially who was involved in vandalism on the inauguration night riot here in seattle released on his own personal recognizance. we had a group of drug dealers, allegedly, who were selling out of homeless tents in downtown seattle. one of them went in front of her release on her own personal recognizance. then you had to suspects in a west seattle robbery involving stealing a gun, hiding the gun, and saying don't tell us where the gun is as long as he let the guy go released on his own personal recognizance. it's what we are seen as a trend here where there isn't really any consequences to begin with when it comes to charges for the most part and even the basics of just saying hey, we are going to keep you in jail and less you pay bail because we want to make sure you actually show back up, even when she doesn't seem to care. >> shannon: really quickly, i want to move on to portland. is there any local pushback on her? has she given any explanation for her judicial philosophy or why she's handling the case in this way? >> no, she's ignoring the questions i'm posing a fair, not specific to these cases either paired i'm trying to get a general sense of where she stands. for example on cash bill, obviously there's a movement right now to get rid of it. i'm curious to see whether or not she is a part of it. the presiding judge is coming on my radio show and podcast tomorrow to maybe do some p.r. for her, so we will see what answers she has. >> shannon: okay, so let's talk portland, because you've covered that quite a bit in the northwest as well. another weekend of a lot of damage, a lot of marching and protesting. you know, that cross the line in a lot of cases. the local seattle new station -- i think it's a cbs affiliate, has this headline, "portland residents angry at what just around the city." they quote one resident who says we want the stuff to stop, they don't have the right to damage our property and to scare people it makes me furious, we are all very, very angry. i mean, this is been going on for months and months they are now. what is the deal in portland? >> the deal is finally people are starting to wake up and take this seriously. and i mean, for anyone in portland or seattle for that matter to actually speak up against these moves shows you the level of desperation for the most part people will stay silent out of abject fear that they will become targeted or because generally they identify what the underlying cause behind the violence. they are now speaking up because it is completely senseless and they have realized that this was never just about donald trump. these are radical activists in antifa, some just other agitators who want to cause this level of violence and chaos because they want to break down institutions and rebuild them in their own image. it is obviously problematic when they are just doing it to rent a businesses during a covid economy where businesses are barely staying afloat. so yeah, they continue with no real goal in mind. and people are fed up, good for them. >> shannon: some of these folks are business owners and residents who say they've had to board up, on board, report their residence and sell. it's been a tough go. we will look for some pieces. thanks for being with us.
