As lawmakers return to albany this week and pressure builds against new York Governor Andrew Cuomo, the former u. S. Acting assistant Attorney General for the Department Of Justices Civil Rights Division is speaking out how the Cuomo Administration withheld nursing home death toll data from the Trump Administration d. O. J. They said their nursing home deaths were very low. That didnt seem right to us at the Department Of Justice. So we asked for information on staterun Nursing Homes which my group the Civil Rights Division has jurisdiction over. And new york provided data to us that showed that they had understated the deaths in those Nursing Homes by 1 3. After we learned this information, we went to our Sister Division the Civil Division, the Department Of Justice, and asked for the same information for the over 600 private Nursing Homes. New york stonewalled and didnt produce anything throughout the rest of the year perhaps waiting for a change in administration. In an oped in the Wall Street Journal why cuomo should be worried about a federal quote. Why this scandal could merit criminal charges. Written numerous federal criminal statutes could apply. It is a crime to make false statements to the federal government and a crime to conceal information and obstruct government investigations. New york may have engaged in a conspiracy to defraud the u. If the Cuomo Administration did get everything to the Department Of Justice in time and it was more partisan back and forth between them and the Trump Administration theyll be cleared of that but if not thats a real problem for them. The Cuomo Administration is in a really delicate position right now when it comes to this. And so i think they ought to welcome that as well. Bill what comes from it, marc . I agree with mo. There was a Civil Rights Division jurisdiction over government Nursing Homes. Only 30 or so of those in the state of new york. They requested the data on government Nursing Homes. Cuomo administration provided it. It showed they had undercounted by a third the number of nursing home deaths. He went to his colleagues in the Civil Division which has jurisdiction over more than 600 private Nursing Homes in the state of new york and they asked for the same information and the Cuomo Administration stonewalled them. Thats whats at stake here. They stonewalled the Justice Department and didnt provide the information a few days before the Trump Administration left office in january. The bigger problem. Stonewalling the Justice Department is bad. They provided false Information Starting in may to Public Health officials in realtime while they were trying to figure out how the pandemic works. The start of this pandemic we didnt know who it was attacking or spreading, whether kids or elderly were vulnerable and they provided false data on nursing home deaths to the department of health and human services. Thats like providing false Data Intelligence to Battlefield Commanders in a time of war. They were misleading them who was dying and where they were dying and why they were dying. Republicans and democrats mixed in. Bill there are billions on the table that havent been spent for schools. We can debate what is and isnt covid relief. The 129 billion for Public Schools. President biden is saying we cant reopen the schools because they need all this money. We need to pass this bill to reopen schools. Congress has passed 119 billion and according to cbo the majority hasnt been spent. The 129 billion for schools he says has to be passed if we want to reopen schools according to the cbo wont be spent until 2022 to 2028. So six years after the pandemic is over. The Obama Administration actually investigated the cuomo government in new york pretty aggressively about five years ago or so. And were in a situation where the Justice Department jumped right in about a week ago when it became clear that they had they were basically admitting they cooked the books on these numbers. There is at least three different Justice Department components investigating cuomo and progressives in the legislature in new york and the Attorney General in new york are investigating cuomo. So that will keep the Justice Department honest independently. I think they will be pretty good on that. Dana one of the things possibly that they will look at Wall Street Journal wrote this morning is that this comes from the oped. If it cant be proved the Cuomo Administration knowingly provided false info that perhaps thats a Criminal Offense. If the intent was to thwart a federal investigation. Lat the Attorney General of new york how does her report lead into this and what would the Justice Department with taking that information and further investigating . I think what the Attorney General did is smoked them out on the fact they had undercut the numbers by about half. And what that enables the Justice Department to do is go back and look at what they were told by new york beginning in august when these investigations opened. And youre right to distinguish the criminal and civil aspects of this. There were two important Civil Law Investigations Being Run by the Justice Department before the criminal investigation opened a few days ago. There was one under Justice Department or federal provision the last Justice Department to investigation the civil rights of institutionalized persons which would cover a lot of people who were in the Nursing Homes. And then there is another Civil Authority that enables the Civil Division of the Justice Department, which i know its confusing but different from the Civil Rights Division, which enforces the civil rights laws. The Civil Division can go after them on false claims and they dont have to prove a criminal case. They can file civil suits. Bill im looking at some of his opening remarks. People that had symptoms that didnt get tested. People that didnt have symptoms that asymptomatic that didnt get tested. People that might have antibodies and tcell immunity. But the cuomo example is the worst because of the deception, the stonewalling, the months that they were violating the states Freedom Of Information Law by refusing to disclose to the public what was happening in Nursing Homes. And i think that had really horrible impact around the world. Dana do you think that andrew cuomo, he has been in office for three terms and wants to seek a fourth term as governor. Is he running out of political road here in new york . I dont know. He has basically responded to these revelations by suggesting that what he needs to do is bully and threaten and shout at his critics more. That he didnt counter disinformation. The disinformation was coming from him as we now realize. But what you are seeing, i dont know if he is out of political road. Some talk of impeachment in the State Legislature. I think at least one thing we would hope would come out of this is reining in the powers he has used to do such harm over the last year both economically and on the covid front.
