day, engine failure, need to return immediately. >> left or right turn? >> right turn. todd: pilots landing in denver. >> it was a loud explosion. shook the plane and we started like dropping down, like you could feel like going down in an elevator, like a quick drop. plane started shaking and we knew something major what happened. todd: faa ordering united to step up inspections with the same type of engine. the airline grounding the aircraft. debris began falling from the sky, raining down on this neighborhood outside of denver, remarkably nobody in the air, nobody on the ground was hurt. this is a freight plane flying over the netherlands also suffered engine failure. it was a different model but fitted with the same engine and like steve alluded to earlier coming later this morning, hear from a man who walked outside of his home to find debris from the plane. can't wait for that interview, guys, back to you. brian: that was shocking. the over big story unfolding now for the longest time big deal locally now nationally but the growing nursing home scandal people are looking into what governor cuomo's powers are and i believe they'll be taken away as far as emergency powers this week. what people are focusing on now not only did he cover the number of deaths which his big mistake was not coming down on the lies quicker, but now it turns that he went out of his weigh to lie about the numbers and what took place and the decision that is were made, he could be in federal trouble. here is the quote from the wall street journal today and this is from john dacus, this is how it goes. even if it cannot be proved that the cuomo administration knowingly provided false information, new york's willful failure to provide information may itself constitute offense. they tried to avoid the department of justice investigation inquiry which after all is exactly what ms. de rosa said the administration did on a zoom call that she never wanted out and, of course, dacus is a former u.s. acting attorney general for the doj civic rights division. peter: they are actually -- they are actually the ones who look intoed this back in august because, remember, when governor cuomo ordered people back into the nursing homes, suddenly we saw a spike in the number of people who were dying and yet the governor in public was bragging about how the numbers of nursing home deaths were extremely low in new york and the doj said, that doesn't make any sense. in august they asked the civil rights division, asked if data for new york's publicly run homes, and the new york state produced that underreported because they, you know, they were talking about semantics and the number of people who died in the hospitals versus nursing homes and the data was incomplete and they knew it. and then the feds came back in october and said, hey, we need more information and they stonewalled and that's against the law. hook, we just have to have the numbers to figure out what's going on. ainsley, a trump -- rather a cuomo adviser called a trumped up election scam. you're asking the numbers in october to make us look bad. but as we've heard from melissa de rosa the governor's secretary a couple of weeks ago, they knowingly covered it up. ainsley: john dacus who wrote the op-ed in the wall street journal, he said it's not just negligence but possibly criminal. he served as u.s. assistant attorney general. it's a crime to conceal information and crime to make false statements to the federal government. he will join us along with janice dean at 6:50 this morning. this is a huge story. all over the country but in new york people are wondering would my loved ones would still be here if not for cuomo's decisions. when he tried to hide it and cover it up, it made so many people frustrated and very angry. brien: absolutely. if you take somebody who tested positive and you take them back to the nursing homes it spreads like wild fire obviously and when he was asked about this last week, he said, oh, that's because the hospital workers brought it back into nursing homes. there's no stats that back that up. meanwhile when asked earlier joe biden clearly is a fan of governor cuomo. how do i know, listen. >> i think every state is going to have to be moving in that direction and it demonstrates that it does bend that curve a little bit and does increase the prospects that fewer people are going to catch the virus and the answer is i don't fully know. we are leaving it to the governors. the governor of new york has done one hell of a job. i think he needs to be served the gold standard. brian: gold standard, that's fantastic, that was april before he became president. evidently he didn't come up in the white house meeting. keep in mind he's not out of the woods yet. there are democrats coming after him. isn't that correct, senator lee roy, local senator, leroy gav inch n. ainsley: a lot of democrats. brian: he came out and more than 60 residents in homes were given drug cocktails of hydroxychloroquine without consent from the patients or crew. this is a state senator, a democrat wondering what's going on. jen psaki was asked over the weekend, yesterday, what about joe biden, is he still -- does he still believe that governor cuomo is the gold standard? >> does president biden still believe that andrew cuomo is the gold standard, represents the gold standard on leadership during this pandemic? >> just a yes or no. >> well, john, the president -- well, it doesn't always have to be a yes or no answer, john. the president is focused on his goal, his objective as president of the united states. he will continue to work with governor cuomo as he will continue to work with governors across the country and i'm not here to give labels or names. i'm here to communicate with you about what our focuses are and objectives are as president. peter: okay, so she dodged the fall. she heads up the nga, national governor's association, they would work with him and she also said essentially we are going to leave the investigation to the investigators, so biden's statement about the gold standard stands until he says you know what, what happened there is a big problem, stay tune for that. meanwhile one of the stories during the pandemic has been that it's been hard to find things where you can socially distance and you can be outside and especially important during the winter because it's cold outside. so what can you do outside here in new york city? famously since the 1980's you've been able to use a couple of ice rinks, well, the mayor here announced a couple of days ago that they were pulling the plug on the new york rinks that were operated by donald trump's operation because, well, because. he just wanted to pull the plug. that caught so many people off guard. wait a minute, the season is not over and you are going to close them. we have at least another month on falling on the ice like that guy right there. watch this. here are some of the people who have relied on this ice for leisure time activity outside during the pandemic and they are steamed at the governor, rather, the mayor. >> it's really devastating. my kids have been in this program for 1 years -- six years and we are just one of the families who really enjoy the program and stuck with it. this is like christmas for our kids. this is the one thing that they look forward to every year and to have it snatched away from us without any explanation, it's really crazy. >> it's really upsetting because i was looking forward last of ice hockey, we get each other's phone numbers, we ice skate and say good-bye. to have that end early, that's really sad. peter: sudden, ainsley, he did a 180 yesterday. ainsley: thank the good lord. your daughters classes at the skating rink will be canceled. when we catch our breath -- when we catch our breath we h return your money because you paid in full for the whole season. this was an abrupt closure. they are mad at donald trump but they want today cancel us but it affects you at come because if you come to visit new york, chances are you've probably gone ice skating there. that's where my daughter learned to ice skate. it's such a fun activity for her with her little friends that take the lesson there. you know, it's just a part of our -- this is our backyard. peter: nothing else to do in the winter. ainsley: we go to the playground at central park that are wonderful and my daughter takes classes there and i was devastated when i learned of this, she loves it. she loves it. it's been such a pleasure to watch when she was terrified to go out this. eric trump tweeted out, thank you for keeping walnut rinks open, you made countless of new york families along with 250 employees happy. please know we appreciate and look forward to saying thanks in person. brian: they bailed out the city in 1980's when donald trump emerged on the scene. they came and did something that the city could not do and got it working, multimillion dollar contract and begged the trump family to revitalize a golf course in white stone bridge which they said. now mayor de blasio and few politics have decided that that's more important than the 205,000 kids that used it but the backlash was so loud and so pervasive he's reversed himself but the same mind set that had them paint black lives matter in front of trump tower in the middle of the pandemic, the same mindset that has you shut down every single school in new york city and keep peopling from living their lives and shut them down in apartments, the same mindset for governor and mayor really showed itself and finally hit a stonewall with this latest move because they have so determine today cut contracts with the successful businessman and that was president trump who use today live here. every other business has left here and now you want to oust for political purposes the trump organization. ainsley: during the pandemic. brian: who is paying the bills. ainsley: central park came in and cleaned it all up, donald trump did -- a lot of people play hockey, did the ice skating rink and changed our backyard here in new york city so that it's safe. peter: pinch yourselves, ladies and gentlemen, all across america. new york city actually did something that made common sense because they were going to close it, as of today but because there's one more month, they will leave it open. ainsley: city hall stepped in. brian: they only did something in common sense after they did one of the stupidest ever. peter: we played the soundbites from the people that were outraged. brian: this was a self-inflicted wound. ainsley: de blasio did it but then city hall reversed it. peter: right, ultimately they did the right thing after doing something silly. we are going to talk to eric trump, he will be with us just about 2 hours in 15 right now here in the channel that you trust for your morning news. 6:14 in new york city and jillian joins on this monday with the headlines. jillian: good morning, a lot of news to get to. today asylum seekers to begin to enter u.s. andrew cuomo should be worried about the federal probe of the state's misreporting of covid deaths. joining us right now former acting assistant attorney general for the department of justice's civil rights division john dacus along with janice dean who lost both of her in-laws to covid after they were exposed in new york nursing homes. good morning to both of you. >> good morning, great to be with you. janice: good morning, steve. steve: great to have you, jd and john. john, yo wrote an op-ed that's in the wall street journal right now and essentially it talks about why cuomo should be worried about a federal probe and it all start with the fact that once he via executive order said that people who had been exposed to coronavirus and had been in the hospital to be treated should go back to the nursing homes and the number of people started dying left and right. that was a gigantic number, but in public he was bragging about how the number there was so low, the number of people who were dying and so your former division at the doj started asking questions. >> yes, steve, on march 25th the governor issued order that required nursing homes to accept people who could be infected, still infected with covid and something that's overlooked, the order prohibited the nursing homes from testing those people to determine if they had covid. so those people were put back in with a very vulnerable population. steve: right. >> new york by the summer had by far the highest death rate in the country over 32,000 deaths, twice the deaths of any other state. if new york were its own country, it would have been among the top 10. the governor was going around saying the nursing home deaths were very low and that didn't seem right to us at the department of justice. so we asked for information on state-run nursing homes which my group, the civil rights division has jurisdiction over and new york provided data to us that showed that they had understated the deaths in those nursing homes by one-third. steve: right, and now we know from the attorney general of new york state who said, yeah, they were -- they covered up the number. they underestimated or they underreported and then you have melissa de rosa who is the governor's secretary, john, came out, it was revealed that it was a 2-hour zoom meeting with a bunch of top democrats and she was apologizing not for the number of people that died but because the administration had put those democrats into political peril during the reelection in november and she was apologizing for that. that two-hour zoom meeting i would imagine is great evidence for the department of justice. >> yeah, steve, that's a great point. so what happened after we learned this information, we went to our sister division, the civil division of the department of justice that asked for the same information for the over 600 private nursing homes in the state of new york and new york stonewalled and didn't produce anything throughout the rest of the year, perhaps waiting for a change in administration and de rosa and, she's the governor's top aide, said that she admitted that at that point once the investigation was ongoing, quote, we froze because then we were in a position we weren't sure what we were going to give to the justice department was going to be used against us. steve: they presented that donald trump was going to come after them when in fact, the doj came after them it would be revealed that they had been lying. janice, it's bad enough that you lost both of your in-laws in covid after being in nursing homes but then to have the state of new york lie about it, just is -- adds insult to injury. janice: you know what, i am grateful to john daukas and william barr for opening up the investigation because if it wasn't the brave people like john to do this reporting and to feel like this was important for us families, over 15,000 of us here in new york, i wouldn't be here today and i don't believe there would be an investigation into cuomo and i actually think he would have been in the seat today instead of merrick garland as biden's ag. so i am so grateful, john daukas is a hero and the reporting today in the wall street journal is incredible. it's incredible for all of us, all of the families that want justice. steve: toward the end of john's article it talks about how the, you know, the legal exposure, mr. cuomo and others place and you talk about how it's a crime to lie to the feds, it's a crime to conceal information and obstruct government investigations as well. so john, now that joe biden is president and, you know, you have new leadership coming in at the department of justice, people are looking to what exactly will be done. you know, i saw this story in the new york post last week, melissa derosa who admitted to those democrats on the zoom call that the cuomo administration had lied about the number, her mother-in-law audrey strauss is the u.s. attorney for the southern district of new york. people are going, is the justice department going to really look into it if the attorney for the southern district is her mother-in-law? >> many fine people that i work with, many wonderful career people in the department of justice, four different u.s. attorneys offices in the state of new york. any one of them can investigate this and the news reports are that the eastern district which is in brooklyn has been investigating this. i really can't talk about what i know about an ongoing investigation. but i assume that the fine people at the department of justice will do what they are supposed to do and will take this wherever it leads them. steve: janice, what will justice look like to your family? janice: i want the truth and nothing but the truth. we have talked to reporters and lawmakers that say that cuomo is the terminator and nothing can destroy him but you know what, thanks to john daukas and the department of justice that continue to try to find answers for my family, i hope it continues into the biden's department of justice as well. steve: sure. and while there's different leadership, john, to your earlier point, there's so many honest people at the department of justice who are just trying to do the right thing. you feel confident ultimately we will know the truth and janice's family will get justice, right? >> i do, i do. this is something that's hurt so many different people that we really need to get to the bottom of this. it's not a political issue. it's an issue about justice. steve: indeed it is. if you have a subscription to the wall street journal, check it out. john daukas former acting attorney general for the department of justice civil rights division. john, thank you very only businesses with fewer with 20 employees will be able to apply for ppp loans and also renewed focus on contractors and self-employed americans. this administration also hopes to cut down on some of the red taped in loan applications. this week the white house will once again urge lawmakers to pass the american rescue plan. that's the $1.9 trillion bill that includes billions for covid testing, more money for small business programs and another round of stimulus checks. democrats call this packet essential, republicans say it's too expensive with too much going to projects and including 270 million for arts, 200 million for museums, 50 millions for family planning funding and bart funding, bay area rapid transit. steve: minimum wage. ainsley: that's right. senator: i think we know why democrats decided to make this a partisan bill. didn't want to cooperate with republicans even though we worked on a bipartisan basis. last year, the past 5 bills, almost $4 trillion to help the country get through the pandemic, because they want to use the coronavirus pandemic as an excuse to fulfill a lot of long-standing liberal priorities. if you recall, nancy pelosi did this last march, put brakes on a bill because nancy pelosi wanted money for exact kind of things that you mentioned. what was mass transit in san francisco have to do with a global pandemic. it has nothing to do with it. it only has to do with nancy pelosi getting earmark for her district which this bill does across the country, bringing back earmark that republicans banned for a decade so we don't have bridges to nowhere. brian: this could have been bipartisan. the other rescue bills were bipartisan and there were a group of senators, you were among them, 680 billion, they went and met with the president, that seemed to have gone by the boards. don't forget we also put money aside for native american language preservation. that's everything to do with the pandemic and we are also going to put 1.5 million for the sea wall international bridge that connects new york to canada which by the way no one is allowed to go to back and forth and only allowed to go through southern border, that's a different conversation. you're looking for minimum wage increase, just not up to $15, right? senator: yeah, that's exactly right. mitt romney and i have been working on a bill, we hope to release in day as head. obviously the votes are not there for 15-dollars for minimum wage. we would like to see it go to american workers and we pair it with the the e-verify programs where every business across the country will have to verify that its employees are legally authorize today work in the united states. brian: what number? >> further steps to mitigate the numbers on small businesses. >> it's below 15 but sizable, brian. a real increase in real terms when inflation from the last time congress passed minimum wage increase in 2009 and we are still talking to senators about the details but we want to make sure that americans get a good wage increase and only americans get it and doesn't happen until the pandemic is over and that we take steps to mitigate the impact on the small businesses. steve: wal-mart announced they will start paying $15 per hour to their employees but they're a big company whereas the small businesses, the congressional budget office is estimated that if it went through at least 1 million people would lose their jobs and that seems to defeat the purpose. meanwhile, today some of the biden administration's executive orders are taking effect regarding immigration. the wall -- the washington post has an editorial headline that says, biden is moving to end trump's inhumane border policies. can he avoid triggering a new migrant surge? that really is a question, senator, because we've heard for the last couple of weeks, you know, there are these migrant caravans that are getting started in the triangle countries heading north toward mexico, toward the united states and the administration is going, hey, now is not the time to come. don't come now, but apparently some time in the future will be. senator: yeah, steve, this issue is actually directly connected to the legislation senator romney and i want to introduce. 15 to 20 million illegal immigrants in the country. joe biden want to give them all amnesty and work authorization at the same time they are inviting millions of more people to cross the borders and come here and work. it's crazy. those jobs should go back to the americans who lost those jobs during the pandemic. but to answer the question about sending the wrong signals to would-be migrants, of course, it sends the signal. 25,000 people waiting in mexico under the remain in mexico policy. biden administration is affirmatively going out and inviting them to come to the border and enter the country for claims that are likely to be denied because asylum claims are denied 80% of the time but they don't often get adjudicated for 2 years and they are all communicating with friends, family members and others back in home countries via social media. it is going to go viral and lead to another migrant surge at our southern border at a time when 10 million americans are out of work and we are still facing a global pandemic. you can't fly into the country without a negative coronavirus but fine to cross -- brian: we want to -- acknowledge its harmful impact but rather than get rid of the content which is very expensive, they are putting that label at the beginning of it. what do you think about that? senator: total mickey mouse move, guys. seriously, disney is putting these kinds of disclaimers on the muppets, not removing them from disney plus because they don't want to lose the revenue from subscribers but at the same time last year they thank an agency of the chinese communist party that's responsible for concentration camps for helping them film a movie. it's outrageous and appalling. it's kind of what they did a few years back in the united states, if you recall, they threatened to cut georgia off because the georgia legislature wanted to protect unborn children. yet their perfectly willing to work with chinese communists who are responsible for genocide against their own people. it's really appalling. brian: do you think we will have a muppets commission to look at this, would it be case. the government was simply looking into why mr. cuomo, who had allowed all these people who were in hospitals and sent them immediately back to the nursing homes. the numbers of the people who were dying was breath taking the, and yet mr. cuomo, ainsley, was talking about how the numbers are remarkably low. we've got some of the lowest numbers in the country. and the department of justice a lot of liberal democrats, people on the left, and you know the right was very frustrated they have no power in this state, he's going to have a very hard time getting allies here. but what governor cuomo's great at is throwing somebody under the bus. when he had this buffalo billions scandal, revitalizing buffalo, and they lost billions of dollars in taxpayer money, he threw one of his best friends under the bus, and i think he went to jail. let's see who he does now. another governor in trouble is governor gavin newsom. if he's not giving millions out of unemployment funds to prisoners, he is keeping the whole state locked down and kids out of school. and because of that, there's a massive recall effort. and get this, you need 1.5 million verified signatures? 1.1 million signatures have been submitted, nearly 670,000 validated. now, you may think what's the big deal about that, it's a real big deal because on these recalls they say usually 60% are valid? so far around 83% have turned out to be verified signatures. so they've got a few weeks now to get to 1.5 million, and now there's going to be a big push by some of his allies to stop it, but i think the horse is out of the barn. steve well, if they get enough of these signatures and they are verified, it would be only the fourth taoisming in american history where there is a recall election. and essentially what would be on the ballot, and they would have 60 days to figure out an election, there would be two questions. the first would be should governor newsom be recalled. and the second, if the answer is yes, who should replace him. so that is what, that's what they would like to do. here's the thing, ainsley was talking to -- you had a great interview with somebody, and there are so many small businesses that absolutely have been devastated by his lockdowns. and over the last couple of weeks, we've been talking about how you looked at these two different states, california out west and florida in the southeast, they both had polar opposite reactions to the coronavirus. ron desantis pretty much kept the entire state open, kids went back to school at the end of the summer, and their numbers are pretty much exactly where california's are, but california, ainsley, had a complete welcomedown and really penalized the small businesses that were simply trying to stay alive. brian still locked all of them sign it. very easy to connect the dots. my customers can connect the dots, hey, there's literally one man in the way of letting businesses open and operate. ainsley: that's why he is encouraging people to sign that petition. and when you look at those numbers that we put up on the screen earlier, 670,000 validated signatures, that number's going to continue to go up because they're still looking through all the 1.1 million signatures that they already have, and they're going through the slow process of validating them to make sure that every individual that signed it is legit and didn't sign more than once. brian: and here's what's so unfair about the rescue package that nancy pelosi's crew is jamming down america's throats. these states that are locked down are going to get as much money as their unemployment numbers. so, obviously, when you lock down a state, the unemployment's high like 9%. same with new york. so they're going to get our taxpayer dollars. and states that are trying to work through it like and florida, they're going to get less. what kind of lesson is that? if you destroy livelihoods and lives in some cases and shut down schools, you're [laughter] and that's to spend it on lots and lots of different things. one of the things that people should keep in mind if they see the pork is, look, we had a coronavirus relief bill as recently as december, one that went through the process and was passed, one that included a bunch of relief for states and money toward keeping -- reopening schools and try to keep everyone safe in the process of doing that. that money, much of it, has yet to be spent. it hasn't even gone out yet. and this is the thing that i think people need to put in perspective here. this is another example of washington using an excuse to spend your money on all sorts of different things that are designed to help various or members or to satisfy special interest groups, engage in different pork projects. it's the same old way of washington doing what they do best which is spend your money. steve: sure. but at the same time the, you know, the average american out there, we were just talking about this, they -- regarding that bill, all they want's their check. they don't care what else is in it because that's somebody else. i want my check. and democrats have got enough votes at this point to make this happen. we don't know about the $15 minimum wage, we don't know whether or not the senate parliamentarian is going to let that in, although it sounds like from bernie sanders he's had a conversation with him, and it sounds like it is in. >> i think that's definitely going to be a significant factor in terms of what you see happening to small businesses because of this. a $15 minimum wage for small businesses in different parts of the country where that's a heck of a lot of money, that's going to be very difficult for them to be able to make the kind of hires that we'd like to see. and as you were saying earlier, this is a situation where you're almost being rewarded for having bad policy on a state level, for locking down and keeping people unemployed. it's a completely backwards approach to this, and yet that's the approach the democrats are doing. basically, they're going to bail out these blue states that made all these bad decisions and not have any kind of actual ramifications for them. they want to insulate them from the consequences of those bad choices that they've made along the way. and the upshot of that is, of course, the people who are in states that were well run, states like florida, end up paying the freight for the mistakes of other people. steve: yeah. ultimately, elections have consequences. we heard that a while back. joe biden, after he was elected but before he took office a couple of months ago, made this promise to the american worker. listen. >> we'll make sure that our emergency small business relief is distributed swiftly and equitably unlike the first time around. we're going to focus on small businesses, on main street. steve: okay. so that is the new emphasis from the white house today the, but, you know, the swiftly and equitably part hasn't happened if you're in small business. >> absolutely not. and certainly, i mean, you saw in the georgia special election the promises from ossoff and warnock about having those $2,000 checks flowing immediately if you elected them. this is a situation where i really believe the biden administration in its early days has been no different from what a kamala harris administration would have looked like in terms of the policy priorities that they've had. they've been prioritizing the interests of progressives when it comes to climate, when it comes to shutting down the keystone pipeline killing those energy jobs, when it comes to all manner of different culture war issues, both abortions internationally and, of course, the dispute over trans rights here in america as it relates to, you know, girls' sports and the like. all of these different issues that are pet issues for progressives but have nothing to do with the priorities of american working families. joe biden ran as the guy who was going to prioritize these people, who was going to care about main street and who had a plan on coronavirus. i think we've learned actually none of that is true and instead this looks very much like a typical progressive approach when it comes to the priorities that they've had. it does not look like the kind of administration that he promised to the american people. steve: he is a fox news contributor and the publisher of "the federalist" and our monday morning guest. ben, thank you very much. >> great to be with you, as always. steve: great to have you. meanwhile, former president donald trump returns to the political stage with his upcoming cpac address. what's he going to say on saturday?
