signatures. >> we're taking the state back. >> if we don't get moving they're going to eat our of lunch. >> china is going to eat our lunch. come on, man. they're not bad folks. >> nascar fans counting down to the daytona 500. >> i'm excited. it's our biggest day. and to have fox nation on our -- >> good morning, everybody. cuomo coverup, republicans are calling for new york governor andrew cuomo to be prosecuted perhaps for obstruction of justice after the new york post exclusively reported one of his top aides admitting to top democrats that they covered up data on nursing home deaths that were requested by the legislature. ainsley: the secretary to the governor, melissa derosa made these comments during a video call with state democrats, saying, quote, he meaning trump, starts tweeting that we killed everyone in nursing homes and basicallily we froze. we were in a position where we weren't sure if what we were going to give to the department of justice or what we want to give you guys was going to be used against us. they were worried about what was going to be used against them. >> they were afraid of the president. it goes back to trump, always. according to the associated press over 9,000 recovering covid-19 patients were sent to nursing homes in new york and 15,000 facility residents died from the virus in the state. that's up 40% from the 8900 initially reported. the report comes as cuomo, the governor, prepares to meet with president biden on covid relief today at the white house. i guarantee you that does come up. they're on a conference call with democratic lawmakers, at which time the -- we're going to expose it to you, they're apologizing not for the deaths, it seems, they're apologizing for the awkward place they've been in, having to deal with constituents and re-election knowing there's so many questions and so many questions about the number of coronavirus victims. in fact, this democratic assemblyman, ron kim, is kind of telling. his uncle is presumed to have died in the covid-19 nursing home scandal that we're in the middle of now, that happened back in april. he said it's not enough to be contrite with us. they need to show that to the public and the families and they have not done that. steve: when it comes down to it, keep in mind, she was you apologizing because they asked, the legislature asked back in august, give us the numbers. and what they were really afraid of, i don't think they were that afraid of the doesn't of justice or trump. they were afraid of the actual numbers because as we just heard within the last couple of weeks, where they actually admitted that the attorney general for new york state said, right, yes, they did under-estimate the number of people who were killed. the number that cuomo had given was 50% lower than the actual number and the trouble that the legislators, the democrats in the state house, ainsley, were facing in their re-election was -- every time they would go to a town hall, everybody was socially distanced, they go what is the deal with these nursing home numbers, what's the number of people who have died. .it put them politically the democrats in a bad spot and he was through her apologizing for making their re-election tougher. and to brian's point, rather than apologize to the 13,000 families who have loved ones who died, he apologized to democrats who had trouble during their re-election. boo hoo. ainsley: sorry for the position i've put you in, she assumed she was worried about the position they were putting the democrats in compared to the republicans, the position that that was going to put them in when they had to run against different republicans. this all started with this legislative request for numbers and then president trump called for the doj investigation about the same time and she said we were forced out of fear that the true numbers would be used against us. we weren't sure what we were going to do to give the doj or to you guys. but governor cuomo when he -- he's been pressed about this for so many months and when he was recently pressed about it he said, who cares if they died in the nursing homes or if they died in the hospitals, they still died. listen to this, if you haven't seen it. >> if you think there was a mistake, talk to the federal government, it's not about pointing fingers or blame. this became a political football. the report also says the information from nursing homes is often incorrect. doesn't mean people didn't die, doesn't mean people won't die today. that is the curse of covid. why covid? why did god do this? i don't know. but who cares? 33, 28 died in the hospital, died in a nursing home. they died. brian: right. a lot of people care. steve: maybe they don't die, if that decision's not made. have you thought about that? if you missed that press conference, congratulations, you're lucky. i watched it. he goes, you know, my dad passed away. i couldn't be mad at anybody. i wanted to be mad. i couldn't. great analogy. your dad died in his late 70s of natural causes. as opposed to people who died because of a once in two generation pandemic. we didn't know a lot in the beginning. we didn't know if kids would be targeted or older people would be most susceptible. china was not honest with us. seniors are the most susceptible. they're the ones who paid the heaviest price and in new york like pennsylvania and california they made the ill-fated decision to put infected people back in nursing homes. that's why people care. a new york congresswoman says this. governor cuomo, the secretary to the governor, and his senior team must be prosecuted immediately. both by the attorney general of new york state and the u.s. department of justice. this bombshell admission of a coverup and the remarks by the secretary to the governor indicating intent to obstruct any federal investigation is a stunning criminal abuse of power and i'll echo what janice said last night, dean, that democratic lawmaker, whoever leaked out this phone call, the whistleblower, they deserve a lot of credit because this is all democrats talking openly. they think it's secure. but they didn't want to give these answers to the general public. steve: there are calls for cuomo to be prosecuted over the coverup, not just from republicans, but from democrat as well. jermaine williams, the democrat, new york city public advocate tweeted yesterday, to the continual he defenders of new york governor cuomo, how is this okay? you how is it not trump-like? and when forced into admission, the most you get is a sorry, we got caught and not even directly from him or to the families. all while asking new yorkers to trust your decision. that is a democrat. it's also very telling, this was exclusively a new york post story. i did a google search. new york post got the story. and fox news has got the story. i looked down the new york times, i can't find it anywhere on their website. throughout the day, just do a little audience research, see if anybody else is covering this story or if they are covering up this story. brian: can i interject this? how about this, get the attachment, put it on twitter. and put it out there. see if it gets nixed or if it gets frozen or if your account gets suspended because maybe twitter doesn't like this story. ainsley: janice dean will be on with us at the top of the 7:00 hour and when governor cuomo says who cares where they died, she cares. she lost her mother-in-law and father-in-law. she has two sons, they don't have their grandparents. they used to live close to them. they lived in brooklyn, janice is on long island, they used to see them all the time. they don't have their grandparents anymore because of the decision cuomo possibly made. let's talk about schools reopening. all these parents are in an uproar, some of these kids, 60 million -- 20 million kids have been out of school for almost a year, a year at the end of march. when you ask the biden administration, jen psaki said we're planning to open up in the next 100 days, open up 50% of the schools around the country to go back at least one day a week. that got parents all over the country so upset. how are we supposed to do this? we can't do one day a week? kids need their friends, social life. we need to go to work and they need to get off zoom. look at the numbers. we're already there. we're past 50%. so they should open off off the schools -- open up all the schools. look at that. according to a school reopening tracker, 66% of k-12 students have five days a week in-person. >> put the number back up for a second. it says 50 -- biden's goal is for k-8 students be in school one day a week. during the campaign, all he said was i'm going to get america's school kids back to school within 100 days. he didn't say only k-8. he didn't say one day a week. if you're buying something and somebody says i'm going to get your kids back to school, that means they're back to school. doesn't mean they're back to school one day. it is jaw-dropping in the -- just the fact that now there's so much small print to the story they're telling. ainsley: like $2,000, you're going to get a $2,000 check, it turns out to be 1400. you already got 600 under president trump. brian: we're writing checks we can't actually satisfy. it's all going to the debt. that's for another conversation. meanwhile, jen psaki continues to pretend as if she's making sense. listen. >> there's been some confusion as to just what the administration's goals are when it comes to reopening schools. can you clear it up for us? in particular, can you explain to american parents that just one day a week of in-person school, does that count as school being open? why should they be satisfied with that? >> they shouldn't be. i wouldn't be as a parent. and i am a parent, i should say. i have two young kids. many of you have kids as well. the president wants schools to open safely and in accordance with science and we're going to listen to science. the president will not rest until every school is open five days a week. that is our goal. that is what we want to achieve. >> my senses resting now. number two is we're not open five days a week and he doesn't want to pressure the unions. that's what it comes down to. if there's anything good to come out of this, people are realizing they've got to get control of their kids' education. it's no longer okay. look for example in california. in san francisco, you have 49% of the kids are white in the area, 51% are minorities. only 15% of the white kids are going to public schools. the rest have just went the other way. everything shut down the entire state. guess who is paying the price? the people you say you want to help most, minorities. let's talk about one of the big -- steve: can i add one thing? we've waiting for -- teachers have been waiting for the cdc to give their guidelines. the guidelines are pretty much as they were before, social distancing, masks, contact tracing, things like that. the teachers are relick taken to go back to -- reluctant to go back to class because they're protected by the union. joe biden's wife is a union member. as we heard many times. he's been careful about that constituency. in places like arlington, virginia, across the river from washington, d.c., the arlington public schools, they're going to return to in-person teaching for two days a week starting next month. progress, right? ainsley: all right. nursing homes, then we talked about the schools opening back up and now to impeachment. another story we're following this morning. griff jenkins joins us live as former president trump's defense team prepares to make its case today. hey, griff. >> reporter: good morning. it's trump's turn now after house managers spent two days making an emotional case that the former president is guilty of incitement and remains a danger to democracy. >> if you don't find this a high crime and misdemeanor today, you have set a new terrible standard for presidential misconduct. >> impeachment is not to punish but to prevent. we are not here to punish donald trump. we are here to prevent the seeds of hatred that he planted. >> reporter: as trump's legal team takes the floor, look for them to focus on the former president's language before the riot. >> it's a false dichotomy here. it's a powerful speech, when you uses the word fight, it's clear he's talking about legislators fighting for our rights, fighting to advocate and everyone likes to -- >> reporter: trump's lawyers met with senators to discuss strategy. as cruz said democrats failed to prove their case and exposed their own hypocrisy. >> by any measure the rhetoric and angry language from the democrats exceeds that of president trump's. >> reporter: 17 republicans will have to cross the aisle to convict and there's no indication that many have been suede. as for to -- swayed. as for today, the defense is expected to spend one day to make their case and then this heads into the weekend when we find out if any witnesses will be called and senators get their opportunity to ask questions and finally the lawyers will make their closing arguments. it's going to be interesting because evidently the defense will be under four hours. what i thought was ridiculous yesterday was they ended up making it pretty clear they have a problem with with donald trump, from 2015 to today that, tried the to show a pattern. if you open that door, you open up five years of what the democrats put forward and the violence that was ignored and fomented by the now vice president of the united states. if you want to go down that path it will lengthen the whole process. it became clear there was an anti-trump agenda there, less about january 6th, that's why i think yesterday really blew their case. >> the republicans continue to say you cannot impeach a private citizen and that is why they will not wind up, the democrats, with enough votes to convict the president. we've been saying that since the get-go. thank you very much for joining us. jillian joins us on this friday and rather than the news, she's joining us with news about the weather. ainsley: the weather is still news. this is a really serious story here. >> at least six people are dead, dozens hurt after icy conditions led to a massive pileup in fort worth, texas. look at this video. over 130 cars were involved in the crash as first responders battled freezing temperatures to pull people to safety. several winter storms are set to hit the country, impacting nearly 20 million americans over the weekend. airlines delaying more than 1200 flights. janice is tracking all of this. we'll keep you updated. the biden administration announced plans for about 25,000 asylum seekers waiting in mexico for their next immigration court hearings to be released in the u.s. while their cases proceed, beginning february 19th. it comes as president biden ends the national emergency declaration that former president trump put in place to fund the border wall. 3600 troops will remain at the border through september to help the agents. today, major cities are lifting indoor dining restrictions in time for valentine's day weekend. starting today in chicago, new york city and portland, restaurants are allowed to open operate at 25% capacity. philadelphia restaurants getting the the green light for half capacity if they pass an air ventilation test required by the state's health department. and check this out. two nypd horses break free from officers and run through the streets of brooklyn. the two officers dismounted from their horses after one had a minor medical emergency, that's when freedom and samson made a praying for it. officers were able to corral them a few minutes later back onto their trailers. both officers and horses are okay. that is a look at your headlines. that's what freedom looks like. project on this friday morning is facing fierce backlash. ainsley: it's accused of publishing private messages from a former member who tried exposing the inner workings of group. >> todd piro joins us live with more. >> reporter: the messages belonging to one of the co-founders, jennifer horn. she left the committee amid misconduct allegation against the co-founder and has been at odds with the anti-trump group ever since. the lincoln project posting to twitter what appeared to be an exchange that horn had with a journalist, a private exchange. horn tweeting that she did not give her consent for the messages to be shared. it's unclear how the lincoln project got screen shots of her private messages or gained access to her twitter account in the first place. the lincoln project facing a scandal, surrounding we've, who has been accused of sex wally harassing 21 young men, including one who was 14 years old at the time. author ryan james, one of the first journalists to bring the we've allegations to light, says the lincoln project knew of his behavior. >> his he behavior continued and it continued under the lincoln project umbrella and they knew that something was wrong. but they didn't speak up. i mean, most of their companies, their affiliate companies were making millions of dollars. they didn't do anything. and now they're pretending they were on top of it from the moment that it happened. they only spoke up when they couldn't ignore the story anymore. >> reporter: the pac making millions during that time for its founders with only about a third actually going to put totally unpredictable and doesn't make my life easier and by the way, my kids aren't actually learning. that's the most frustrating part of this. take the politics out of it. it is totally disruptive for the lives of parents and kids who deserve better than this and ultimately are sold a promise that he'll check off on a 100 day tracker but has no connection to the betterment of kids. ainsley: so will, we want to get your take on this. the school reopening tracker to pete's point, making a goal that's already been achieved. there are already 66% of k-12 students back in the classroom five days a week in person. it's similar to what he said about vaccines. hey, we want to get 100,000 vaccines out there in the first -- 100 million, and that's already happening. >> that was news to me about pete, already accomplishing goals and then bragging about those goals. it's usually you set low goals and celebrate when you accomplish that. >> is usually the other way. >> setting a lower bar. that's the other way. and that is actually -- actually, that is the way that the biden administration is going about it, setting low goals, accomplishing them and celebrating them. back to the schools for a moment, that is a low goal, one day a week, 50% of students, no one should celebrate it to your point. you all know a district or a friend or if you're lucky enough, your child is in school five days a week right now. it can be done. it is being done. it's being done safely. that should be a requirement for 100% of kids, five days a week. not 50% one day a week. .>> let's talk about china. the goal with china is to somehow recognize that they are a global menace and a global threat and will joe biden ever do that? does he have the gumption to do it? does he understand it? when asked about it, listen to what he said. >> last night i was on the phone for two straight hours with xi jinping and you all know as well as i do, these folks are -- it was a good conversation. i know him well. we spent a lot of time together over the years i was vice president. and -- but, you know, they're going to get moving -- they're going to eat our lunch. china is going to eat our lunch. come on, man. >> his shifting ways with china -- >> 180. >> for two hours they spoke on the phone and he said i brought up hong kong and i brought up taiwan and human rights and i brought up the uyghurs. you know what china's response was? china's internal affairs, they they said that -- three areas. they said very simply, your best opportunity according to their version of the call was to cooperate with china and they also said when they brought up all those issues, china's internal affairs and concerns china's sovereignty and integrity are their concerns only of. doesn't seem like the message got through, pete. pete: no. why are we always talking about eating someone's lunch. it makes no sense, probably doesn't translate well. >> not allowed. pete: no one has ever grabbed someone's lunch and eaten themselves, get it. no one believes joe biden has been tough on china. nobody. their internal affairs will dismiss everything he said he talked about. and climate change, you think beijing is worried about climate change and solar panels for their workers? they ignore and deflect on the majority of what this administration talks about. there is only one president who cared about staring down china, it's donald trump. joe biden is ultimately not serious when it comes to facing down the communists. >> will, 15 seconds. >> let's see if i can do it. do you remember who he learned under, he learned under president obama who on the campaign trail said the 1980s called and they want their foreign policy back when it comes to russia, some five, six, layers, russia is the greatest threat >> i felt grateful to the lawmaker who told the new york post about this meeting where they admitted -- they admitted that had covered up this governor for months, almost a year that we have been wanting answers in the nursing home massacre in new york state, that took the lives of at least 15,000 of our of elderly loved ones and now the trickle, the trickle effect, over 9,000 infected patients that went into those nursing homes that housed our most vulnerable. the governor knew early on, he told us it would be fire through dry grass. he knew. he blamed everyone else except the person that signed the mandate and they covered for him. >> check this out. as you know, the most astounding thing about the two hour call was she was apologetic, she was apologetic to the lawmakers who had a tough time campaigning because there were all these questions about nursing homes that they couldn't answer, not apologetic to the families who lost loved ones, it's unbelievable. instead of a mea culpa to grieving family members, to the 15,000 dead, or the critics who said what will happen in the facilities, he said i know huh a lot of questions to answers but the good news is some democrats, like ron kim, he's upset because he lost an uncle in april, same situation as you. says it's not enough to be contrite with us. they need to show that to the public and the families and they have not done that. not by a wide margin. there's zero contrition, still. >> ron kim is a hero. he called me yesterday and gave me a little bit of information on what that meeting entailed. and i believe he might have played a part in this, giving the new york post the story and if that's true we need to protect him because this governor is very vindictive. he's a bully. and if it is ron kim, i am so grateful to him. he has been a supporter of all of us, all of our families and you know what? it's the ones that suffer the greatest loss that want the change and i commend him and i am grateful to those who want justice for our loved ones. not these democratic lawmakers that are patting themselves on the back and are protecting this governor. this needs to be an investigation. we need the full law on this and i heard that biden, president biden has dismissed the doj lawsuit. so you know what? i'm going to keep crying from the mountaintops, he needs to reopen it and get it done. >> you know, biden may have said that before this story broke. now there's a coverup. there are democrats in new york state including the new york city public advocate who said how is this okay, and another democrat, state senator tweeted you're only sorry that you got caught, because of your decision thousands of people died who did not have to die. we're not offended, melissa, we're furious with extremely good reason. here's the thing. we also heard from another democrat, janice, we heard from the attorney general, latisha james, about two and-a-half, three weeks ago where she said, you know, the cuomo numbers were about half what they really were. the administration had said it was something like 8,000, when in reality it was closer to 13,000. and that's when the governor famously sounded so cold with this sound bite. >> if you think there was a mistake, then go talk to the federal government. it's not about pointing fingers or blame, it's that this became a political football. the report also said information from nursing homes is often incorrect. doesn't mean people didn't die. it doesn't mean people won't die today. that is the curse of covid. why covid? why did god do this? i don't know. but who cares? 33, 28 died in the hospital, died in the nursing home, they died. >> for him to say that, janice, and -- this was initially a story that was leaked to the new york post, new york post has got this story. fox news is doing the story. i did a google search, i don't see it anywhere on the new york times website right now. unless people cover this story in the press, where the governor of the state of new york is accused of a conspiracy to cover up, people should just be outraged as you have been for months. >> i'm grateful to fox news and the new york post and some of the local reporters that follow this story but i agree with you. i am not a political person. i have never spoken out on political matters. but because i did not see the coverage of this story, that's why i became an advocate and i am grateful. i'm grateful to fox news and our wonderful bosses who allowed me this matt form. i don't think -- platform. i don't think we would be at this point if it wasn't for fox. >> we have to cover it. >> i agree. ainsley: for people who are watching that might not have lost a loved one because of covid, these are lives. these are mothers, fathers, they're put into these nursing homes and exposed to a deadly virus, many of them died alone. that's what is -- that's so sad to me. because you know as a mom, all the dads watching, you guys as dads, the hard work that you put into raising your family and to just die alone, not be able to say good-bye to the people that you love and then the governor and possibly being accused of putting these people in there, is being accused of putting these people in there to go through that by themselves. >> my in-laws would have celebrated their 60th wedding anniversary yesterday. we no longer have them with us. we didn't have a wake or a funeral. we did not see them before they died. we could not hug them, we could not touch them and to this day relatives can't see their loved ones in the nursing homes and it's atrocious and this governor deserves to be punished to the full extent of the law and all of those that covered this up. ainsley: sean was not able to say good-bye to his parents in person. >> no, he never saw them before they died. >> he keeps saying, the governor, well, i was just following federal guidelines. what have you found out? what is he grabbing onto, to deflect blame? >> god, mother nature. he's blamed everyone, brian. he continues to put the blame on the federal government. his arrogance knows no bounds and i think that in the end is what's going to get him. the fact that he really thought he was the anointed one and the ruler of new york state. but you know what? sometimes those guys fall the hardest. >> continue to be relentless. i'm seeing nobody else is covering this. let's see if someone else is going to do it. curious to see if you tweet out this story if you're going to be locked out like the hunter biden story. right now, the post seems to be siloed. >> on fox news.com. >> we'll see. >> ten minutes after the hour. the other big story within the coronavirus headline is we're trying to control it and the good news is, 36% decrease in cases over the last 14 days. 15% decrease in deaths over the last 15 days. the numbers are astoundingly good. we're not talking about that because there's a lot of people who want to get the $1.9 trillion passed and if it looks like the numbers are going down, why do we need to give out $2 trillion that we don't have. that's the problem. the other thing, the story that's emerging from this administration, is the focus on florida. they are actually considering a travel ban from florida because they claim the u.k. strand is in that state. this smells like pure politics. because if you're worried about strands and spreads, you would first worry about california, which leads the nation in cases, new york is second, texas is third. florida is a distant fourth, almost half of what texas has. and then in terms of deaths, florida is behind texas, new york and california. this feels like pure politics. >> so there was a story in the miami herald a couple days ago that said that they are -- the federal government apparently, some agency is considering restrictions for florida travelers, which jen psaki was asked about yesterday and she said this. >> does the president support leaving the southern border open to migrants, even before he would even consider this idea of domestic travel restrictions? >> well, the bore of deer is -- border is not open. the majority of people who come to the border are turned away. and we are enforcing our of laws at the border but we are also doing it, attempting to do it in a humane way. and so this is not, again, the time to come but when long-term holding solutions are impossible due to covid-19 capacity limitations or other reasons, some migrants are processed for removal, provided a process to appear. >> you heard her saying our southern border is not open. but yesterday we told you about the numbers from our southern border, year over year, january this year versus january last year. the people trying to get into the country illegally, up 150% so that does sound like the border is open. ron de santis says the border should be open of between florida and every other state and if it's not, listen to the end of the sound bite, it's clearly political. >> i think it would be unconstitutional, it would be unwise and it would be unjust and if you think about it, restricting the right of americans to travel freely throughout our country while allowing illegal aliens to pour across the southern border unmolested would be a ridiculous but very damaging farce. any attempt to restrict or lock down florida by the federal government would be an attack on our state, done purely for political purposes. ainsley: he makes a very interesting point. he says you want to restrict legal americans, yet allow illegal immigrants to come in freely. >> are we testing those illegal immigrants? i don't think so. do they walk with a rapid test in their pocket or a certificate in no. they're flooding in the border. don't let anyone kid you. ainsley: he cares about americans not getting covid and restricting americans but yet not testing the illegals. >> let's add to this to. when they decide to do that with new york, when we were in the first to get slammed by the pandemic, governor cuomo went crazy and everyone said what a leader he is. governor de santis, what he has done has worked. he has people flooding into the state because they allow people to be free like our country used to be. now he is targeted because of if his axioms are correct, it turns out joe biden's aren't. he wants students to go to school one day a week. his kids in florida are going five days a week for the last eight months. that's embarrassing to the administration. >> it's odd that the administration would point out florida because according to the numbers, florida is 28th in the number of cases per capita. nonetheless, jen psaki is very clear, now is not the time to come into the country illegally. apparently she will indicate later when it will be time. ainsley: they're not listening to that message because the numbers are up down there on the border. it's 7:14 on the east coast. turning to former president trump's impeachment trial. griff jenkins joins us live as trump's legal team prepares to present its argument today. hey, griff. >> reporter: good morning. the prosecution has rested. it's trump's turn now after house managers spent two days making the case that the former president is guilty of incitement and remains a threat. >> why did president trump not tell his supporters to stop the attack on the capitol as soon as he learned of it? >> we are not here to punish donald trump. we are here to prevent the seeds of hatred that he planted. >> reporter: trump's legal team will deliver a defense today, look for them to focus on the former president's language before the riot. >> it's a false dichotomy. it's a powerful speech. when he uses the word fight most of the time, it's clear he's talking about legislators fighting for our rights, people fighting to advocate and everyone likes to overlook the word peacefully in there. >> reporter: trump's lawyers met with gop senators to discuss strategy last night. as cruz says, the democrats failed to prove their case. >> in two days, in 16 hours of presenting their case, they haven't come remotely close to demonstrating that president trump's conduct violated the law that it constituted incitement. >> reporter: to convict it takes 67 votes, that means 17 republicans would have to cross the aisle and there is no indication that many have been swayed thus far. as for today, the he defense kicks off at noon and we expect they may only spend one day. we know david schoen, the attorney you saw telling reporters he would probably go three or four hours today. if they rested that would mean a one day defense. they have up to 16 hours. we'll see what happens. as we head into the weekend, we'll find out if any witnesses will be called and senators start to ask their questions. >> griff, you're a nonstop groundhog day. if you're not covering impeachment, what do you do after this? >> no, that is not the question that was asked of the students. the question that the students were asked is, do the positives outweigh the negatives for the meeting of the old world an the new world, it was not a question about slavery. ainsley: mr. russo, i know you're an alum to saint john's. you got a scholarship there too. why did you want to the take that case. >> i didn't know anything about it until a friend of mine told me an adjunct got in trouble for asking a question. i was a graduate of saint johns 50 years ago. i even got a scholarship. it's a great school. this embarrassed me. i took richard as a pro bono client for my law firm. my firm embraced him, begin him a million dollar set of papers. they've gone to the wall for him. i have every reason to believe that the court may very well see saint john's conduct as been arbitrary and capricious. that is what we claim. there was no basis upon which somebody should be fired. i don't see this frankly as a left or right or red or you bluish shy. this is a common -- red or blue issue. it's a common sense issue. he is a great academic. he's given this course since 2015. and by the way, it wasn't some student. it was a single student who objected. and if there are any alums of saint john's out there, i want you to get in touch with the school and tell them they have to grow a spine and they have to do what's necessary to ensure that the liberal education is being given at the university. ainsley: if your students are watching or for all of us talking or listening to you right now remarks do you make of the claims that you're a racist? >> well, there's just no -- there's no proof of that at any point in my life. so the fact that asking a question of students and that that would bring upon the claim that i'm a racist, it's a little -- it's a little disheartening, i would say that would probably be the word i would use. ainsley: let me read the statement from saint john's. i'll get you to react on the other side. they say sense shim to the saint john's university experience are the vital principles of academic freedom and vigorous debate and discussion in the classroom, equally essential is the pursuit of wisdom which flows from free inquiry, religious values and respect for all people. ronald? >> it's very interesting that they say that. we quote that language in our lawsuit. and that's the reason that it was arbitrary and capricious. they violated their standard. that's not what they did. they discharged him based on 300 complaints from a group called sju radicals, that's their name. when they told the professor taylor there were 300 complaints he said how is that possible. i only have 29 students in my class. how could you rely on 300 complaints from people who were not in my class, who may not have been students at saint john's. this can't stand. ainsley: what have other students said and what do you want from the school? do you want your job back. >> i would love to be able to teach at saint john's again. i'm not even allowed technically -- saint john's has deemed me -- i'm not allowed near undergraduate students. i would like saint john's to know that this can't be done to others. i mean, there's no -- there's absolutely no basis for it, ainsley. the question wasn't even about slavery and everyone took a small part of a much larger lesson, not everyone, particular student, and this radical group took a small part of a much larger lesson and focused it all on slavery. this was not a lesson about slavery. this was a lesson about the world becoming what we know it as today and the beginnings of that and there are a lot of positives and negatives that come along with history in general. and just always focus and avoid -- it's impossible to avoid the negatives when we're teaching history. ainsley: have you had some support? have you had some students speak out in your favor? >> i have had past students, i have had current students, last semester when i was removed from my class, i've had former alumni reach out to me. i've had students start a change.org petition. those are students i had last semester when i was immediately removed from my class without even -- without even so much as a hearing from saint john's or discussion with any of my supervisors. and there were over -- last i heard there, were over 500 signatures on that and that was started by my in my class. >> i would suggest that anybody who is interested, go to change.org and pipe -- type in richard taylor's name and you'll see 500 people saying this is wrong and i would love it if your listeners started a campaign and put another 1,000 signatures there, lets saint john's know that what they've done is an outrage to education. ainsley: one last question. when you explained the question that you posed to your students, what you meant by that, and what the real question was, what was the response of the school? they just took the student's reaction and being upset, this one student, over your words? >> i can't speak to the school's action. i reiterated -- when the student initially during the lecture brought up that you can never justify slaifngery and -- slavery and i said no one was justifying slavery. ainsley: you don't justify slavery, right? starts tweeting because everyone in a nursing home, we froze because then we were in a position where we weren't sure if what we were going to give to the justice, the department of justice, or what we would give to you guys would be used against us. >> the original story from the new york post, according to ap, 9000 recovering covid-19 patients were sent to new york nursing homes, and residents who died from the virus in the state. that is a 40% increase from 8900 they initially reported. the report comes as governor cuomo prepares to meet with president biden on covid-19 relief later today. it sounds like according to a letter the new york post's all-star team, new york state is going to get $50 billion according to nancy pelosi, to the delegation in new york. it is impossible for them not to talk about this. this is a big story where potentially the legislature asked for the numbers, the news organization asked for through foia and the governor's office stonewall and now they have covered up, and finally they have been caught. ainsley: they didn't want to give those numbers because the numbers were lower than was accurate. the 2-hour meeting, all these democrats, the democrats in the meeting was the whistleblower, i am sorry we put you in this position, when you are running against these republicans and whistleblower gave the transcript, that is why we are talking about it this morning. the post article they say legislative requests for all the members and president trump calls for the doj to investigate and she says we froze out of fear. the true numbers were going to be used against us. brian: they were thinking they were just talking about other democrats, very telling. the center for the aging committee, representing the syracuse, new york area, they were getting battered during the reelection campaign. the biggest issue of all is feeling i needed to defend or at least not attack an administration that was appearing to be covering something up. she didn't want to appear defense is. what she was doing was indispensable. the guy who could have broken this whole thing open might be the whistleblower. he might not. assemblyman ron kim, boston uncle in april who because of this decision by the governor, not enough how contrite you are with us. they need to show for their families, in addition to stonewalling lawmakers, killed by this virus, the request from the news media, when he was asked what he would refer it and is not being asked, you look at what's the networks covered last night on this story in new york state, 000. you would think so but it was a big story in the new york post 12 hours ago, new york post has got it. the post has got it. fox news has got it. local network affiliates have got it but the new york times does not have this story where it is clear the administration under governor cuomo stonewalled, then covered up and now they have been caught. from new york on the republican side, governor cuomo, to the secretary and the senior team must be prosecuted immediately, the attorney general of new york state at the department of justice, bombshell admission of a cover-up and remarks by the secretary to the governor, intends to obstruct federal investigation, is a criminal abuse of power. they simply want answers now, answers people like news media have been asking for. janice dean lost both of her in-laws to covid-19 after living in nursing home facilities. janice dean says the governor is in trouble now. >> this needs to be an investigation. they admitted they covered up this governor for months. in the nursing home massacre in new york state, took the lives of 15,000 of our elderly loved ones and the trickle effect, 9000 infected patients that went into those nursing homes that housed our most vulnerable. the governor who early on, he told us it would be fire through dry grass. he blamed everyone else except the person that signed the mandate and covered for him. jillian: i hope they questioned her extensively. and each covid-19 patient, knowing they were the most vulnerable. they have serious health conditions. and >> now they have changed the rules. if you're in a separate nursing home, it will be taken care of. ainsley: say that to the people who already lost their parents. let's bring in geraldo. what is your reaction to this when you read this story? >> my first reaction was janice dean should win the pulitzer prize for commentary and investigative reporting on this awful scandal. the whole thing would have gone unnoticed and swept under the rug, she took care of personal tragedy and converted it into a movement for truth and justice when it came to what happens to the elderly. they were sentenced to die in these nursing homes and the numbers are alarming. it is bitterly ironic the two governors who got all the press as the golden boys compared to trump the villain, gavin newsom in california and andrew cuomo in new york heralded as examples, exemplars of what state leaders could do and newsom is facing a recall election, the highest number of deaths and andrew cuomo is apparently facing, if this whistleblower is telling the truth, if they intentionally told lies to the federal government that was probing this issue they are in a heap of trouble. not how up the food chain it goes in albany, the capital but this is a very serious matter. brian: in california they can't stop people from dying, can't get kids in school, they are great at keeping people homeless and can't distribute the vaccine because they have such tight criteria about giving so-called underserved people or minorities, can't get into anybody's arms. this is the example of what happens when democrats control a state. one thing becomes clear, best thing you do is to leave. 135,000 people are leaving california annually than coming in. >> california has its problems but is not alone. i would like to show you the local ohio newspaper. one of the headline state employees single out 4100 and reported deaths, the states were torn between not wanting to look bad and saying vaccines distribution are proportional to the needy population, they were much worse than we said we were. now it is really serious. we need these vaccines na rock and a hard place, what the state so desperately needs. steve: the news media built up cuomo and newsom and fast forward to now. before the election mainstream media didn't cover the hunter biden story, the new york post did, fox news did, peter doocy was asking about hunter biden, joe biden, fast forward to andrew cuomo, very embarrassing for them that they haven't covered the story and for them to cover the story, he covered this up, stonewalled and covered up. >> i was interested in looking at the new york times and try to find that story and could not find it. it must be some mistake. it is not about a republican, in the new york times, negative story. we need truth. we need to know what happened here. we need to know the real fact so we can get these vaccines distributed. we can get past it. people have to be frank, honest, admit their own mistakes and celebrating their own triumphs. remember andrew cuomo
