stuffing and everything else going. good morning emily and jason. emily: good morning griff and jason. happy thanksgiving for you both. i'm so thankful to be here filling in for ainsley and happy to be here with you two. we have a great morning in store for you. jason: this is fun. i love turkey day. i don't know if you think i delayed my start to turkey day. i have already had a little stuffing and the cranberries. i don't wait until 5:00 in the afternoon. you don't get a belly like mine by waiting for, you know, the starting bell. you sneak into the kitchen and grab what you can, especially at 2:15 in the morning my wife was just going to bed. i was just getting up and, you know,. griff: fair point, jason, i bought four pies for my family and at least one of them is half gone. i think you win that conversation. send us your -- by the way, send us your -- what you are doing. jason has already got things started. emily, you have got to tell us what you have already done it's friends@foxnews.com. we will show what you are doing to get ready for the big day. jason: it's going to be a big day. i will tell you what, there is a big story we are following this morning. you may have heard about it last night. we want to give you at details. michael flynn and his family feeling extra thankful this morning after president trump pardons the former national security adviser. lauren bran charred joins us live from washington with more and the president's announcement. lauren? >> good morning, jason, emily, griff. president trump tweeted last night at least one person having, quote, a truly fantastic thanksgiving is former national security adviser michael flynn granted a presidential pardon. general flynn is now safe from the possibility of jail time despite two guilty pleas for lying to the fbi. the judge in flynn's case was expected to rule any day on flynn's case to throw out the case. flynn's family said in a statement after the pardon announcement they are grateful to the president and, quote, let our nation never allow this violation of an american civil rights under the law happen again. but not feeling thankful for the pardon top democrats. especially those who led the russia investigation. they called it an act of grave corruption. congressman adam schiff writing trump has once again abused the pardon power to award michael flynn chose little to trump over little to his country. says these are abuse of power and undermine the law. waiting for more possible pardons before president trump leaves office. on the list his 2016 campaign chairman paul manafort sentenced to 7 and a half years and roger stone granted clemency a few months ago. emily, griff, jason? griff: all right. laura, thank you very much. we want to bring in jonathan turley, fox news contributor and legal scholar george washington university. good morning, professor, thanks for joining us, happy thanksgiving to you. >> happy thanksgiving. griff: no one, perhaps, happier than general flynn. for our viewers, just to go back to remember. this is a person whose case dragged on for years. the trump department of justice sought to throw the case out. a judge emmet sullivan kept it going. and, yet, if you look at the history, general flynn, of course, was found by the doj to have not committed any criminal behavior. they tried to end the investigation but, yet, james comey the fbi director second two agents to view him. here w --interview him it. ends like this. what are your thoughts this morning. >> this pardon would not have been necessary if the judge in the case, judge sullivan had simply issued a final decision. this is a bizarre case. because the justice department sought to drop the charges. decided that he was improperly charged because of what has come out recently. what the judge did is refuse to issue that order. he was ultimately taken up on appeal. a panel ruled against him and ordered him to dismiss the case. that was then later reversed by the full court, which said that we have to give judge sullivan a chance to do the right thing, to finish the case and then we will review it. went back in a third sentencing hearing, sullivan again refused to issue a final decision, said that he had still questions about the case. even asked the lawyers in the case what would happen if he just waits for a biden justice department, whether that would change things. and so many of us were highly critical of judge sullivan's handling of the case. and that's why this is a rather unique situation. i do not feel comfortable with the president pardoning associates. i don't feel comfortable with any president pardoning political associates. but this is not your normal case. this case should have been dismissed a long time ago. and, also, he should not have been criminally investigated. general flynn's investigation for criminal conduct fell apart in december of 2016 by january of 2017, the justice department was asking to get to end that investigation. it was stopped by peter strzok. one of the figures that has featured so prominently publicly. he prevented them from closing that investigation. and then james roamy went as described by sally yates, rogue. and sent in these investigators to see if they could get him to trip a wire, which he did. but this has been a really outrageous and in my view abusive case from the beginning. it's important to note that those investigators that he was charged with lying to said they didn't think he intentionally lied to him. when the interview began. he said well, you all have the transcript with my conversation with the diplomat. and they did. and they said that they didn't think he intentionally lied. but, he fought the charges. and what mueller's people did. first of all, there weren't any charges. mueller came in and they resuscitated the charges. they pummeled this guy, drained him of his money and threatened his son with prosecution. and he finally pled guilty to end it. so it's just been an outrageous case from the beginning. emily: professor, to your point about judge sullivan. this is a judge that sat on uncontested motion to dismiss from the department of justice for almost seven months and yet now we are hearing that this pardon, without which it wouldn't be necessary, is somehow a perversion of justice. how is that activist judge not the one sir couple navigating justice? if you will just bear with me for a moment, i will read to you some quotes from democratic lawmakers which can't help but melt down at this. so we have senator richard blume thai that you will saying as rotten as unsurprising. representative adam schiff saying it's no surprise that trump would go out just as he came in crooked to the end. and representative jerry nadler saying one more stain on president trump's rapidly diminishing legacy. your thousand, professor? >> well, i practiced in front of judge sullivan for years. i actually have respect for him. i have been very critical of his handling of this case. i'm baffled by it. i honestly can't imagine how you can justify what has happened in this case. these sentencing hearings have really border derderian oed on . accuse him of doing things he didn't do such as treason and then having to come band and apologize for it. i want to note something adam schiff said. there is no one in this case that has said that president trump withheld evidence against president trump. weighs convicted for making these statements that were viewed as false about his conversations with diplomats. there was nothing criminal in those conversations with russian diplomats. there is notes released later that suggest that comey told president obama and then vice president joe biden that the calls appeared, quote, legit. and they were. there was nothing untoward or even uncommon in an national security adviser weeks before the entry of an administration to reach out to diplomats and that come from countries like russia. nothing uncommon or illegal in those communications. jason: professor. we want to switch to another topic and get your input because overnight the supreme court blocked governor cuomo's capacity to put caps on houses of worship. with justice barrett playing a key role in the ruling, this from justice neil gorsuch, it is time, past time to make claim while the pandemic poses many grave challenges there is no world in which the constitution toler rates color coded executive edigits that reopen liquor stores and bike shops but shutter churches, synagogues and mosques. what else your reaction to what the supreme court did and the action to put down what what governor cuomo trying to do? >> it was a fascinating case. you had the five justices that ruled against new york in this case. it might have been six because chief justice roberts said that he was not saying that the restrictions imposed by governor cuomo were constitutional. he just didn't feel that there was a need at this time for the court to step in. but, that was really swatted back by justice kavanaugh who said look the second circuit can rule on this but we want to make sure that these churches and synagogues know that they can continue in these houses of worship. it's a major case. because we have seen across the country these challenges. not just with religious organizations, but also we saw that very interesting challenge recently in kentucky with regard to schools. now, with that you, they are arguing science. they are saying the science is not supporting these bans, particularly for young children. in these cases they are saying this is a violation of the free exercise of religion. so these are very interesting cases. and last night was a major step for the challengers across the country. griff: all right. professor jonathan turley, we just received a phone call from your family that says you have to get home and start cooking the turkey. >> two turkeys, yes. griff: two. are you deep trying one of them? >> no. we are doing one smoked. one oven. but the smoked one looks like i dragged it behind my car but it's always the first to go. griff: yum, sounds good. happy thanksgiving and thanks for taking time with us today. >> thank you. griff: thank you very much. thinking of gatherings we are going to turn and talk a little bit about the mayor of denver, colorado. michael hancock who decided to take off to his native mississippi but it was obviously after he had first sent out the same warnings we have seen coast to coast from government officials saying do not do anything, cancel your plans. now, here is what he tweeted on wednesday. this is his tweet: pass the potatoes not covid. stay home as much as you can especially if you are sick. host virtual gatherings, instead of in-person dinners. avoid travel puck. if you can. orderly your holiday meal from a local eatery. shop online with a small business for black friday. he was heading for mississippi involved gathering and flying. he tweet i fully acknowledge that i urged everybody to stay home and avoid unnecessary travel. i shared our our plans canceled plans for multihousehold celebration. what i did not share went to mississippi where my daughter recently took a job. i realize my decision disappointed many who believe it would have been better to spend thanksgiving alone. i apologize to the residents of denver who see my decision as conflicting for guidance to stay at home for all but essential travel. i made my decision as a father and husband. for those disappointed i hum bling ask you to forgive decisions that are borne of my heart and not my head. here we are again another government official doin tellins to do one thing and doing another. emily: unfortunately unsurprising this is a pattern that we have seen going on now quite some time with these largely democratic governors and mayors who issue these edigits and issue these override orders and then file comply. the rules don't apply to those lawmakers. and the problem that i see with it as well in addition to the blatant hypocrisy is the fact they only apologize when they got caught. remember governor gavin newsom was caught at french laundry flanked by medical officials and lobbyists. he issued his apology a week later. this is while 500,000 californians under his watch remains jobless and 100 small businesses remains shuttered are you jays jace this is why they call it hypocrisy. unbelievable often this keeps happening and coast to coast. literally put out a tweet and decided to get on an airplane i was being a dad. what about the rest of america? my goodness. anyway. it's quite a story with the mayor of denver. but there is a lot of other things happening in the world and we are about to have jillian share the headlines with us. jillian? jillian: good morning happy thanksgiving to you and to you at home as well. in just hours annual macy's thanksgiving day parade will get underway. the holiday tradition will look a lot different. there won't be the thousands of people standing on the new york city streets you are used to seeing and the parade route will only span one block. giant balloons will fly but won't have hundreds of handlers on the ground. parts of the parade have been pretaped to discourage crowds. the ravens steelers game slated for tonight has been pushed to sunday. the nfl says it's out of an abundance of caution after baltimore reported multiple covid-19 tests. this afternoon you can catch the cowboys hosting washington. tune in for that nfc east divisional match up only on fox. american families have their own thanksgiving tradition, right? i'm sorry, no thank you. what she should be doing is getting her bebehind back on the hill and brokering a deal. this is one where you have the very, very, very progressive left wing congressman ro khanna telling her take the deal. everyone is telling her take the deal. instead all she is doing is deflecting. when cnn is saying you are being a little bit too aggressively resistant at the cost of the american taxpayers and most important americans put out of business that's really telling. jason: the hypocrisy, there is that word again, the hypocrisy coming from the left is really unbelievable. all right. what's your number 3 top turkey? it's actually not true. the only people benefiting now are those who are resources. even this those cases we are not only taxing the teachers, poor teacherrers every day across a zoom or scim call. we are taxing the parents. reality is we know first and foremost that students need education personalized and tailored to their needs and they should have the option and student to have the parents decide how how the students are getting educated. that's how we get will great education for kids. especially for poor kids can't afford their own private tutor. we have to remember that schools are not super spreaders. everyone from unicef to harvard to oecd and international places have said that our kids should be in schools. you can safely distance them. you can spread out teachers so they are safe. and then you can have the kind of environment if people need it and if they choose it. that's really what it boils down. to say have we sent money to the kids and to the parents when this pandemic happened, we would have much better education. our kids would not be going down the tubes in termination of their education. and this is just going to be irreversible unless we head it off at the head right now. emily: that's exactly right, jean yuvment especially stories of special needs students and nonverbal on the other side of a computer screen just not interacting or participating at all. it's frankly heart breaking. thank you so much for joining us this morning and for your insight. coming up, as americans gather to reflect on what they're thankfulful for. our next guest joey jones is here next with a powerful thanksgiving message ♪ ♪ so what can protect you? >> yeah. i think more than anything is just take a minute today and understand that we're living in a time where we literally have to fight for our ability to be around our families today. i understand the virus is a serious thing. and it's a deadly thing. and everyone has to make that decision for themselves. but the opportunity and the freedom to make that decision for ourselves, that's responsibility. you can't sever the two freedom and responsibility. today i hope more people than not are with their families. i lost both my grandmothers and dad this time last year. i couldn't imagine going on through life not having that one last meal with all three of them. so with that being said. >> i hope people are being cautious and taking the precautions they feel are necessary but also hope they are spending time with their family today because that time sin valuable. there is no guarantee of tomorrow. virus or not. and to try to sever freedom from responsibility like some of these politicians are trying to do to tell you are not responsible enough to have freedom. that's not how you honor any kind of service or sacrifice. otherwise, why else are we fighting? >> good morning, jason, emily, griff. thanksgiving will look a bit different today for millions of americans and for the first family it's no different. they are staying at the white house this year rather than heading down to florida. millions of americans have been urged to stay home this turkey day because of surging cases of coronavirus. the u.s. hitting more than 12 million positive cases. plus, new restrictions are in effect all across the country for those who did head to the airport. security areas have plexiglass barriers. a lot of sthirs. mandatory masks for all. although fewer people have traveled this year. still millions packed up and headed out. many state and local leaders are begging people to stay home. but for at least one. they didn't listen to their own advice. denver's democratic mayor flew to mississippi to be with his for the holiday. he tweeted an apology saying quote, i apologize to the residents of denver who see my decision as conflicting with the guidance to stay at home for all but essential travel. the turkey on the table might be a little smaller this year also different the macy's parade will still go on but for only one block. and there will be thanksgiving football, two games today. the third has been moved to sunday. so good luck to my detroit lions and obviously, griff, to the washington football team. guys? jason: , absolutely not. go cowboys. come on, griff. you can't even come up with the name of your team let alone come on. griff: no comment there. but, you know, we are -- some people like the stage manager here in washington garrett who is decked out in cowboys gear, hat, jacket, he is with you, jason. he accused me of my name seeming to be like european soccer. but we will find out. we will see who wins today. i think we have the better defense. emily: i have to tell you guys as a raiders fan first of all, griff, miracle does happen. we are 6-4 now and we actually have a wild card spot. don't lose out hope and secondly today i will root for your washington team, griff. you are welcome in advance. jason: thank you. griff: thank you, emily. now bringing in gregg jarrett our fox news legal analyst for an important topic today. good morning to you, greg. and happy thanksgiving. we bring new to discuss this really important topic the fact that the family of michael flynn is likely celebrating as president trump has pardoned him. granted him a full pardon to the general after his guilty plea earlier notwithstanding sort of the sneaking around in the courts that we saw. so, gregg jarrett. tell us your thoughts on this. >> well, he deserves a pardon because he did nothing wrong. it's not uncommon. it's not illegal during a transition to have a conversation with the diplomat from another country. in this case the russian ambassador. that didn't matter to james comey to mccabe and peter strzok. they targeted flynn in order to prosecute him or get him fired. they set a perjury trap by lying to him. sending two fbi agents over to the white house. it actually didn't work initially. because the agents wrote in the report that flynn told the truth. and he didn't lie. but then bob mueller, the special counsel and his team of partisans resurrected the case. they hid an concealed that exculpatory evidence of innocence and they falsely accused and wrongfully prosecuted an innocent man. so, you know, i know that michael flynn didn't want a pardon. he wanted to be exonerated in court. but, at this point, with a change in administrations appearing likely. he will take it. jason: yeah, gregg, this is a sad case but i think the president definitely did do the right thing in this case. i want to get your reaction to joe biden. you know, there was a lot of thought that maybe joe biden was going to bring in some of the left's all stars. he brought in. so retreads but those that are actually in the senate and in the house of representatives may be sorely disappointed. watch what joe biden had to say on this topic. >> we already have significant representation among progressives in our administration. but, there is nothing really off the table. one thing is really critical. taking someone out of the senate, taking someone out of the house. particularly a person of consequence is really difficult decision to have to be made. i have a very ambitious, very progressive agenda. and it's going to take really strong leaders in the house and senate to get it done. jason: gregg, what's your thoughts on that. >> gregg: wouldn't it be refreshing if he told the truth about the real reason. you can't put a elizabeth warren or a bernie sanders in your cabinet that would leave a vacancy, two of them in the u.s. astronaut. and vermont and massachusetts both have republican governors who would oea point republicans it. would have changed dramatically the equation in the united states senate. he can't do that the real other reason is, you know, he wants to keep these radical progressive socialists as far as away from him as he possibly can. and, you know, it's a longer distance to the capital building from the white house than having these two individuals who, you know, who really are progressive leftists in your cabinet at the white house. you want to keep them away as much as you can. he is going to have enough trouble, jason, with, you know, aoc and the squad pushing him. so, you know. there are a lot of different reasons but those are the main two. griff: gregg, let me tie these together. greg sullivan is the incoming national security adviser. just to give our viewers some perspective. on january 4th, so, when michael flynn was tapped, he wars starting to do the things that he does. and, of course, his conversations with ambassador kislyak were deemed to not violate any crimes that is what he what we presume jake sullivan will begin reaching out to allies. january 4th cross fired fire razor took a look at flynn and then on flynn's first day at the office on january 124th, comey sir couple events protocols and sends two agents in to put him in the perjury trap. do you fear anything like that could be happening now? do you think it will be the same for this incoming administration? >> i don't think so. at the department of justice which, you know, presides over the fbi. i don't think bill barr would ever allow such shenanigans, such corruption and deception and lies to take place incoming administration. what happened to flynn was so reprehensible. gets on the phone and outright lies to flynn to snooker him into an interview. we learned later on in fbi documents it was all done to get him fired or prosecuted. it's not the job of the fbi to get somebody fired within the administration but just shows you how unprincipled, unscrupulous and corrupt people like james comey and andrew mccabe and peter strzok were. this was a set-up and tragically, you know, flynn was the victim. he went in to debt. he had to sell his home. they threatened his son. he finally threw in the towel and pled guilty. and then realized the hidden documents proved his innocence when he tried to withdraw his plea judge emmet sullivan disgracefulfully and shamefully refused to do it. this has been a tremendous miscarriage of justice. griff: all right, gregg. thank you very much. >> thank you, happy thanksgiving. emily: happy thanksgiving. with headlines we have jillian. jillian: good morning. police make an arrest of a shooting death of a texas state university football player. kimbrel was shot outside of an apartment he was a defensive back for the team. overnight police announcing blackman and zanachu charged. looking for two more people in connection with with the shooting. blocking andrew cuomo from capping capacity at houses of worship. the group taking the state to court over covid-1 covid-19 ress limiting the number of people allowed to attend service. areas deemed red zones no more than 10 people allow. in orange zone attendance is limited to 25. cuomo shows off new if he has been face masks for thanksgiving. look. >> we have a special mask don't be a turkey this thanksgiving wear a mask. don't be a turkey how good looking is this mask, right? >> well, emily, anything that is backed by science, of course i am a huge supporter of. one of the biggest challenges right now with covid-19 is getting people to do this mandatory 14-day self-quarantine after they have had an exposure to someone or if they have been in a high risk situation. mainly because most people can't take 14 days off of work or they can't pull their days out of 14 days worth of school. as you know, emily, when you are not sick, it's really hard to stay home for 14 days. unfortunately with covid-19, 40 to 45% of all of people who actually are infected and able to transmit the virus will never develop symptoms. so it's really challenge to discern between the asymptomatic carriers of the virus and those that didn't get infected at all. they are looking to see when the earliest possible time that maybe people can go out again, back out in public, the least risk of being contagious. obviously the more scientific way of determine going someone is not contagious is two back-to-back pcr tests within 24 hours. so there is going to be some combination, probably shortening that self-quarantine down to 10 days, maybe seven days, likely it will require a negative test as well. emily: doctor, given that this holiday looks different for most americans. can you share your thanksgiving message and you and harrison amid the covid-19 pandemic? >> well, you know, for years, as one of the libertarians on this network, i have been saying don't give the state this much power because rarely do they follow the rules that they try to implement on us american citizens. i just think in a period of time where people are going through so much. just struggling to get along and being told to hunker down and follow these rules to have the people that are entrusted to make these rules and enforce these rules not do it, i think it's a slap in the face to every american. emily: lawrence, first, happy thanksgiving. >> thank you. emily: your report something so valuable because of the boots on the ground. can you share with us what average every day americans are feeling about us being demonstrated by lawmakers throughout the country? >> i actually spoke with some folks earlier this week on the street. you know, the thing that messed with them the most is the mental health aspect of this. people have about had it. they were told 15 days to slow the spread. and they have been really trying to do their part and the fact that the elected leaders aren't doing that i think is the most troubling thing for them. also, you have a lot of people that i spoke with that didn't want to be on camera because they wanted to take the risk and go see their family just to get that love and let them know they hadn't seen them for over a year but they didn't want to be shamed. i mean, i have seen people on other news networks shame people for taking this risk of going to go see their parents or their loved ones. even though they are getting tested socially distanced. wearing the mask. still not enough for some folks. again, a lot of americans are choosing, making that choice saying, look, we have given the government this amount of time to get this right. you know, now we want to go see our family. and i don't think they should be shamed for it. griff: lawrence, let me change topics a little bit. because former president obama went on the breakfast club with host charlamagne la god, remember he had a very interesting conversation with joe biden. he was talking to barack obama what he did as president for african-americans in this country and on claims charlamagne pressed him he will didn't do enough for black americans. i want you to take a listen and get your reaction. watch. >> when i got elected, there was so much excitement and hope that we generally viewed the presidency as almost like a monarchy in the sense of well, once the president is there he can just do whatever needs to get done. if he is not doing it he must thought have wanted to do it? >> people want to know what do you specifically for black people. systemic things to get us out? >> what i am saying cheryl la main poverty droppe black poverd faster. black incomes went up more. there is no way in 8 years to make up for 200 years. griff: lawrence, your reaction? >> well, this is personal for me because a, i think charlamagne is one of the best viewers in the business because he is not a partisan is he a progressive but he challenges both sides if there was anybody who hold the president's feet to the fire it was charlamagne. i used to be obama campaign person that was my first campaign at 15 years old on garland, texas on the ground. he was one of the reasons i left because of the inaction. it is true that a lot of us had so much hope because that's what he sold on the campaign trail that he was going to go in there and change washington and it was more of the same. and so, i think when we look at black america and how we look at obama, it was more of an historic moment for us saying, you know, you got the nation's first black president. but when you really look at the numbers and look at things that he could have done, especially when he had control of all branches of government for two years, a lot of use disappointed that he wasn't able to pass certain legislation, especially when you come to -- when you look at the economy and jobs back in our communities. that didn't happen. and so, again, you saw charlamagne holding his feet to the fire. emily: lawrence, part of the criticism as well is president obama's co condescension if you didn't share his values that he thought you were in turn racist or unenlightened as evidenced by his comments on air and also at fundraisers. so my question to you is with his resurgence and obviously doing a book tour, is that same frustration going to appear again? are people going to vote then in 2022? is this going to carry through? because a lot of people credit the fact that trump's initial support in 2016 was because of that revulsion they felt at being condescended to during 8 years. >> i don't think it's just condescension but also intellectual laziness to simply dismiss 70 million people as just racist. remember voters seen on the ground they voted for president obama. president obama right now is the most popular former president and so to dismiss people that were once your supporters as just racist and not look at the circumstance of feeling forgotten and feeling like the country is not focusing on issues that effect middle america, i just think it's laziness and that may have worked this last elections because you had a bowl in a china shop like donald trump. 53% feel they are better off they don't like the personality of the personal that's in office right now. you are going to get someone else. and if democrats don't have a response, to actual policy issues. i don't think they're going to be able to win. remember, this was suppose you had to be a blue wave. and it wasn't. the president lost but gained house -- the republicans gained seats in the house. the senate looks like it is in a dead heat right now. but it's all roads points to the republicans maintaining it. so, again, the democrats going to have to find a message that resonates with the majority of americans. emily: um-huh. jason: yeah. and i just don't think that's going to happen. lawrence, thank you so much for joining us. we really do appreciate it. all the best. happy thanksgiving to you and your best. >> happy thanksgiving to you all you guys and all the audience members at home hug your family members. we're going to get through. this 2020 has been a rough year. if you are stuck at home. invite a few friends over and let them know that you love them since they can't reach their family members. griff: all right, lawrence, happy thanksgiving to you. i know you will be rooting for the washington football team against those cowboys. >> no, no, no. american team all the way. all the way. jason: there you go. i knew lawrence had a lot of sense in him. griff, you are out numbered here. griff: we will see what happens. thanks, lawrence. jason: go to jillian for headlines. jillian: a pennsylvania judge blocks any further election certifications in the state until a hearing. the president called in a meeting challenging the state's mail-in voting system. >> if something was done wrong, if this election was won fraud lengthily, and that's what happened, it was a fraud. and we're talking about very importantly, many more ballots, many more votes than the number we need. >> joe biden has already begun his transition despite president trump's legal challenges. new york city mayor bill de blasio admits he closed public schools without having a reopening plan in place. >> i have to hold myself responsible. the better situation would have been clearly to have that plan all worked through in advance. i think we didn't have a plan b and we should have had a plan b. but i also understand why we didn't because we were really dealing with so many day-to-day hour-to-hour issues. jillian: de blasio closed schools over a rise in covid-19 cases. he promises to have a reopening blueprint ready next week. elon musk says the tesla semi-truck will go 621 miles on a single charge. the company is taking orders on trucks with ranges between 300 and 500 miles. but musk says the next generation battery will be able to go even further. prices range between 150 and $200,000. production is expected to start some time next year. employees at canadian nursing home find ways to keep residents on their toes. armed with nerf guns take aim at the staff dressed at deer. set up a mini forest of christmas trees. some have old memories of hunting. this was a way of remember happier days. i'm sure they are having a blast. jason: i love that we will have to do that in the chaffetz household, too. emily: exactly. all right. take notes on that, guys. thank you, jillian. that was sort of hilarious. awesome. all right. adam klotz. what do you have for us in the way of weather today? emily: i've been hearing all morning about our families' different recipes and how tribal we are with them, right? we are not budging. i decided we should have a cookoff where we treat each other to our different thanksgivings. i can't puck just one dish, so i guess if i had to, it would be that homemade pumpkin pie. to me, there's nothing like it, especially the morning after thanksgiving with coffee for breakfast. jace just a oh, those are all good, all good. it's a wonderful holiday. we've got to turn now to a big story we're following because michael flynn and his family feeling extra thankful this morning after president trump pardoned the national former national security adviser. lauren blanchard joins us live from washington with more on the president's announcement. lauren. >> reporter: good morning. president trump tweeted last night he knows at least one person having a truly fantastic thanksgiving, his former national security adviser michael flynn granted a presidential pardon, and it might not be the president's last in office. general flynn is now safe from the possibility of jail time despite two guilty pleas for lying to the if fbi. the judge -- to the fbi. the judge was expected to rule any day on flynn's request to throw out the case. flynn's family said they are grateful to the president and, quote, he removed the heavy burden of injustice office shoulders of our brother michael with a full pardon of innocence. but not feeling thankful, top democrats, especially those who led the russia investigation. of nancy pelosi writing it's an act of grave corruption and a brains abuse of power. jerry nadler said these actions are an abuse of power and fundamentally undermine the rule of law. we're also waiting on more possible pardons before president trump leaves office. on the list is campaign chairman paul manafort who was sentenced to seven and a half years and roger stone who was granted clemency just a few months ago. jason, emily, griff? griff: lauren, thanks very much. we want to bring in brent tollman, former u.s. attorney to utah. happy thanksgiving to you, thanks for taking time to join us. >> thank you. griff: we've been talking about the pardon all morning long and specifically because you have been a federal prosecutor, what's your reaction this morning? do you feel like the matter was ultimately decided when it came to the fact that the department of justice and president trump dropped its case for good reason against flynn, but yet now it ends this way in? >> look, as a federal prosecutor, you always want to bring a case to the grand jury that you have confidence n. here it's very unusual for the department of justice to go back to the case and take a look. but give credit to flynn, his attorneys, they had issues, they raised those issues. prosecutors went in, they looked at it and, look, i know some of the prosecutors that personally went in and looked at all the evidence again and what happened, the manipulation of the upper echelons at the fbi. they made the right decision when they moved to dismiss it. if there's any abuse with here, it was a federal judge believing that it had authority to approve or disapprove of dismissals. that's not what the federal judge's authority is, and congress certainly didn't grant it to him. so this dismissal, basically, was thrown out by this judge, and he was prolonging it. so i don't see that the president had any other choice but to pardon him. emily: that's exactly right, brent, given that it was an uncontented -- contested message to dismiss. the reason why the pardon was necessary, not the pardon itself. given the fact that we clearly have some judicial activists on the bench, the incoming administration, joe biden, he has said he would not wield the doj like a weapon. what are your thoughts on that? does that necessarily include an audit of the judiciary to hold responsible these kinds of judges that would sit on motions like these for almost seven months because of their own political affiliations? >> yeah. there's so little we can do as a pluck to hold judges -- as a public to hold judges accountable. there are ethics charges you could bring. but take a look at this judge. this judge is also one who has not granted compassionate release amidst covid for inmates that are particularly susceptible. this is a judge that is not make decisions that are in the public interest, not making decisions based on fact or law. it's a shame that we get them on the bench, but i think it tells us why it's so important to have good judges nominated that are really going to follow the law. jason: brent, happy thanksgiving. i want to get your reaction -- >> thank you. jason: overnight the supreme court block ared governor cuomo's capacity cap on houses of worship with justice barrett, obviously, playing a very key role in the ruling. but this very interesting concurring opinion from justice neil gorsuch who i think summed it up nicely, it is time, past time to make plain that while the pandemic poses many grave challenges, there is no world in which the constitution tolerates color-coded executive edicts that reopen liquor stores and bike shops but shutter churches, synagogues and mosques. what's your reaction to this ruling by the supreme court? >> it's a strong ruling. it tells you who right now is leading in the supreme court. it's really justice thomas, and you can see the conservatives are able to finally have a stronger voice. this is a message, i mean, jason, let's face it, we have seen governors across this country through fiat and executive privilege issuing mandates and ordering things that i never thought i'd see in my lifetime. so this is a message that needed to be sent, and i think judges all over the country are paying attention to the fact that we don't want to whittle away constitutional rights based on reaction, emotional reaction to the virus. griff: brent, i'm being texted by at least one friend that works with the religious liberties industry, this person tells me they think it's a positive ruling because of the strong language. in this they find that it was a, quote, very severe restriction on attendance at religious services in areas classified as red or orange zones. do you think this is the beginning of something? >> i do. i think that, you know, there's many people that are talking about it, and they're realizing the dynamic of justice barrett and what she brings to this, and i think the ability for conservative interpretation of the constitution and its application, i think we'll see rulings like in that we haven't for a long time. i think it's what conservatives have been hoping for, and they have a lot of issues over the coming months to decide. emily: thank you so much, brett tolman, happy thanksgiving to you and yours, and thank you again for that legal insight. >> thank you. emily: switching gears here, acting defense secretary christopher miller is visiting our service members in the middle's. it looks a little different this year. and we have joe but jones talking about the importance of visits like this. we had him on the show earlier. take a listen. >> we're away from our families, and it's easy to feel like no one really cares or knows that other than maybe your families themselves. so when some of the leaders that send us to war come by and say hello and ask us how it's going, tell us what their ideas are or i why we're there, things of that nature, it makes a big difference. and to do it on thanksgiving helps a lot too. emily: happy thanksgiving to our troops, indeed. jason: yeah. you can't thank joey jones who lost both his legs serving this nation, and there are people like him across this country who have done similar types of things. there are tens of thousands of people who are away from their families this holiday season. god bless them, thank them. i hope they know, you know, i had a chance in 2016 to go out and visit some of our troops, sailors off the coast of iran on the uss san jacinto in the carrier group, the eisenhower carrier group. and to be out there and shake their hands, thank them for their services is one of the best thanksgivings i ever had. i'll never forget it. and those people who are out there today, god bless you, thank you. emily: absolutely. griff: it is. it's what we're thankful for on this this is. we've got a lot more coming up. first, though, let's check in with jillian. jillian: in less than an hour, the macy's thanksgiving day parade will get under way. there won't be thousands of people standing on new york city's streets, and the parade route will only span one block. the giant balloons will still fly, but they won't is have dozens of handlers on the ground. all apartments are required to -- participants are required to wear a mask. the ravens/steelers game has been pushed to sunday. the nfl says it's off the an abundance of caution after baltimore reported multiple positive covid-19 tests. cowboys' strength toast paul has died after being rushed to the hospital tuesday. he was surrounded by family. paul was in his 21st year in the league and won championships with the patriots and giants. the cowboys are set to honor the former player before today's game against washington. tune in for that divisional matchup only on fox. and you've heard of reindeer but what about rain beer? " emily? emily: thanks, jillian. all right. restaurants in los angeles county are being forced to shut their doors to diners. the ban on all in-person dining going into effect despite local health department admitting there's no scientific links between outdoor dining and the spike in covid cases. our next guest says the new restriction is making it nearly impossible to do business. let's bring in patrick hickey, general manager of reo's hollywood. good morning, thank you for joining us so early on this thanksgiving morning, we appreciate it. first of all, it's absolutely delicious, and i was just telling our producer that i enjoyed your sauce last night, which was amazing. tell us, however, about what you are suffering and what you're seeing in the restaurant industry there. >> well, i mean, it's challenging, to say the least. in optimistic terms, in perfect times the restaurant business is a complete challenge just in general. and one thing that we have going for us here in los angeles is the blessing of weather. welcome quite literally serve people -- we can quite literally serve people 365 days a year al fresco, and for that to be taken away from us in spite of all of the challenges that we've faced with covid is just at this point just demoralizing and -- it takes whatever wind we have in our sails just completely away. it's, it's such a fight these days. you know, we serve people up and down the sidewalk, on the block and space heaters, and there's restaurants that have developed i elaborate tent systems and trying to keep people at least somewhat comfortable through their dining experience that now have to be taken away. it almost seems like all of that effort has gone for naught at this point. emily: right. so, patrick, you're describing the investment that the restaurant industry has made in complying with the orders, and yet now we're learning that there's no actual data that supports a covid contractions with either outdoor or indoor dining. but what we do have is the fact that this restaurant industry is the largest private employer in the united states responsible for 11 million jobs, and it is hanging on by a thread especially in california, 500,000 people are out of work. so talk to us about the employees and talk to us about those members of this huge private employer, that industry. what are they saying? what fears do this right now? >> well, just in general in my restaurant alone, 60% of my staff has still been laid off since march. and that little, small percentage that we were able to bring back for this outdoor dining is now going home on thanksgiving day right before the holidays with yet again another impending layoff. and we've heard the fact that we're going to go home for three weeks, and this is going to flatten out, whatever, then we're going to come right back to business. we've heard this before. and the reality is, is that it will not be three weeks. it'll just continue toing drag on -- continue to drag on should nothing change x. it's so hard to tell our employees i don't know, i don't have an answer for you. they look to us for when are we going to come back, when are we going to, you know, be back to work s and when can i make people happy again, when can we get back to the reality of what we do, and is we have no answer to any of that. emily: yeah. exactly. and what you're echoing is that, you know, one in five business owners anticipate they have of to close their doors perform e innocently by the end of the year because, as your saying, every day the instructions are changing, and three weeks is likely not just three weeks. i spoke to another restaurant industry the attorney, and he said the economics are simple, we just need the support to make it new this time. but for some reason it's the politics that's the hard part. patrick hick key, thank you so much for spending your thanksgiving morning with us. we look forward to dining with you soon. what a's a family to do when you're told to have a small gathering, but your family is huge? [laughter] have you started to decorate? >> no, we're more traditional, it's not until after thanksgiving. we try to keep advent as advent. >> i can't imagine what your trees look like by christmas, it's got to be wilted -- we without until saturday after thanksgiving to get our tree. we hold off. griff: former president obama was talking about evangelical hispanics who support president trump. take a listen, i want to get your reaction. >> people were surprised about a lot of hispanic folks who voted for trump, but there's a lot of evangelical hispanics who, you know, the fact that trump says racist things about mention -- mexicans or puts detainees, you know, undocumented workers in cages, they think that's less important than the fact that, you know, he supports their views on, you know, gay marriage or abortion. griff: rachel, i've got to believe you've got something to say about that. >> oh, boy, do i. so the catholic little sisters, now he's moved on to evangelical hispanics. look, first of all, really quickly, obama's policies encouraged minors to come unaccompanied across that border which is why they had to be separated because they were usually with human traffickers and not always with their parents. and the cages, by the way, were built by his administration. but let's move on from there and get that out of the way. he is angry because evangelical hispanics see themselves first as christians and not as a racial identity group that he and his party can take advantage of. and for barack obama, you can really see that he and his party really just fundamentally don't understand christians. he, you know, abortion is not some woke fad for them. it is central to their religion because our ten commandments say thou shalt not kill. it's also, by the way, griff, central to our constitution where we say life, liberty and the pursuit of happiness x. there's a reason why life is first, because if you don't are have life, liberty and the pursuit of happiness is pretty much a mute point. so i don't think the democrats are learning anything from what happened with hispanicsover this last election, and barack obama is just so disappointing -- >> one of the things, too, if you look at the president and the democrat party, they're peddling socialism. they want freedom, opportunity, they want to make a good wage with, and they had that under president trump. hispanics are americans and everything that you care about and i care about, they care about. they want to take care of their families and make more money in their paycheck, and that's what president trump offered. >> no, they just want to throw around terms, and i think hispanics are a lot smarter than that. emily: overnight the supreme court blocked governor cuomo's capacity cap on houses of worship with justice barrett playing a key role in the ruling. sean, i'll start with you. what are your thoughts on it? >> we're celebrating thanksgiving today, and we look back to the pilgrims, they didn't come here for gold or, you know, the fountain of youth, they came here for religious freedom, right? that's why they came to america, and that's what brought us thanksgiving and our great country. so god bless the supreme court. listen, andrew cuomo is overstepping his bounds. he's going to put limits on churches in the hot zones or red zones of no more than 10 people, and that's synagogues and mosques, all places of worship are going to be able to open back up. thank god for that. and what's shocking is how close the court was because john roberts, who was appointed or nominated by george bush sided with the liberals like he did in obamacare. thank god we had amy coney barrett on this court with gorsuch and others, and they said, listen, how do you say that you can go to a bike shop or go buy a six pack of beer and not have these restrictions, but you're going to put restrictions on our houses of worship? this doesn't make any sense, and as rachel just said, liberty and freedom are protected in the first amendment. there was no bike shops or pot dispensaries -- >> or strip. clubs. that's also allowed. >> exactly. but religious liberty is protected. we might have democrat governors who don't really care about places of worship, at least people on the supreme court still want to protect our right to worship. >> and i'll just add to that, you know, going to church, worshiping god for christians, for jews, it is essential. of it's essential to who we are. for a lot of secular governors and ex-presidentss, they think this is just a hobby for us. it's not. it's central to who we are. and thank god the supreme court right before thanksgiving, which is a religious freedom celebration in our country truly if we look at the history of it, good on them. congratulations to donald trump. we're thankful to you for putting amy coney barrett on the court, because she was decisive in this decision. jason: she was. sean and i had the honor and privilege of serving together in the united states congress and, rachel, you've got one of the most beautiful families out there. i know some governors want to limit the size of households meeting for thanksgiving to 10, but you've got 9 kids and there's 2 of you, and i can do that math. [laughter] griff: happy thanksgiving -- >> happy thanksgiving to you guys as well from the duffy family. you guys have a great one. enjoy turkey. give give all right. thank you very much. see you, guys, have a safe one. >> bye, everybody, happy thanksgiving. griff: now let's check in with jillian. jillian: good morning. it's easier if you don't cook and you provide the wine. if anyone would like to follow my lead -- [laughter] let's start off of with this. disney is planning on laying off more employees, 32,000 workers. that's 4,000 more than previously thought. the majority of the layoffs will be at disney park and are expected to start next year. disneyland has been closed since march in compliance with california's reductions. black lives matter protesters gathered outside the los angeles mayor's home. they demanded eric garcetti not be picked for any positions in joe biden's cabinet as speculation swirls that he's being considered for hud secretary, calling garcetti completely unqualified saying he has failed to house homeless people in los angeles. representative james clyburn also speak out, telling the hill in part, quote: from what i hear, back people have been given fair consideration, but there is only one black woman so far. i want to see what the process leads to, but so far it's not good. president trump, president-elect joe biden and vice president-elect kamala harris are among the list of nominees for time's person of the year. dr. anthony fauci, governor gretchen whitmer and stacey abrams also being considered for the title. the distinction goes to the person or group deemed to have the greatest influence on the events of the year for better or worse. the person of the year will be named on december 10th. it'll be interesting to see who it is, guys. and i name all three of you. [laughter] emily: thank you for that. i was just going to say i'm not, like, a gambling person, but i do have a strong prediction with that, and i was, like, if i wanted to bet, i don't even know what i would do with that. but, yeah, it will be interesting to see. jason: very good, very good. all right, we've got some weather that's affecting people across the country. adam, what's the laidest? adam: along the east coast, a little bit of rain. but, by and large, it's going to turn out to be a really nice day. even if you're dealing with rain now, it might be clearing up. the warmer air right along the coast, that's a warm front. that's typically when you see later bit of activity, and that's what we're currently getting. rain along the mid-atlantic in the south likely going to be clearing off in the afternoon. the new england area is probably thingiest spot, that is going to be -- the soggiest spot. but then you run off to the west, things really clear off x it's going to be a pretty nice day pretty much everywhere getting east of the rockies. those temperatures 50s, 60s, that's above average for where we typically would be this time of year. a lot of sunshine out there. that's just one more thing to be thankful for, a pretty good weather day across the country. back out to you. griff: all right, adam. warm day for what's going to be a good watching fall football. gear up for game time. the dallas cowboys taking on the washington football team today on fox around 4 p.m. we have some great game day predictions. i won't tell you mine, but it could involve a cowboy beatdown. that's coming up. ♪ don't stop the party ♪ ♪ griff: well, one tradition that's not changing in this year, thanksgiving football. jason: today on fox the dallas cowboys will defeat -- i mean, will face -- griff: what?
