of the federal government which they did not like. lou: that sentiment -- if, indeed, it was that -- was originally shared by house republican leader kevin mccarthy until yesterday when he attempted to walk it all back. >> i don't believe he provoked it if you listen to what he says at the rally. let's get and have all the facts before we accuse anybody of anything, but let's all base it upon the facts and the knowledge that we need to know. lou: and that is what we're going to attempt to do here this evening on this broadcast. and even with that weak effort of retracing his steps, mccarthy still supports liz cheney as house republican conference chair despite her support of impeaching president trump. despite the fact that more than half of the house republicans want her removed from that leadership post. and it appears trump loyalists within the republican party have had enough with rino leadership. congressman greg steube stands firmly with the president, the former president. we'll be talking with him about the future of the republican party and the country. and with the support of establishment rinos, the party of hate just can't contain themselves, their excitement about the prospects of another pathetic effort at impeachment. >> make no mistake, there will be a trial, and when that trial ends, senators will have to decide if they believe donald john trump incited the erection -- insurrection against the united states. lou: little trouble with the language there, a little trouble with integrity as well, in my preponderance -- in my opinion. this continued political persecution of the former president is as stupid as it is vicious on the part of the radical dems. trying to remove a man from office who has left the office from which they want to remove him. ken starr defended president trump in his impeachment trial last year. he joins us this evening on this latest effort to subvert donald trump's agenda when he is no longer in charge of the national agenda. it's an effort by radical lefts to subvert a president. the effort has now reached its sixth year. it is all a continuation of the same stratagem on the part of the democrat party, to persecute, to stop donald trump at all costs, a man who has been stopped. we'll also talk with judicial watch president tom fitton. he's a leading voice defending the trump presidency and the trump presidential administration from the attacks of the deep state and radical dems. president joe biden says and says repeatedly he wants unity. how's that going? the president says he will fight hard for those who did not vote him, which is an admirable, admirable thing to say. but in only a few short days, his actions have been divisive, telling 74 million americans their voices are effectively silenced. the president is inviting illegal immigrants, buddying up again with global elites, telling us that our american heritage is something of which we should be ashamed. we take up the president's new calls for unity later in the broadcast with pastor robert jeffress. the congressional rinos making the profound political mistake of joining the radical dems in their efforts to impeach the president who just left office despite, despite having left office earlier and now out of office, they want to remove him from office. it makes just that much sense. but the democrats are trying to do it here. with more on the impeachment process that we may behold, let's turn to fox news congressional correspondent chad pergram. good evening, chad. >> reporter: good evening, lou. well, the start of the trial is monday. this is when the house of representatives is going to send the article, just one article, singular this time, over to the senate. they've been waiting for about a week and a half since that vote to impeach president trump in the house of representatives. you might remember that house speaker nancy pelosi held the articles of impeachment in late 2019 and early 2020 for 28 days. they're going to send this over on monday. here is republican senator lindsey graham. >> and my hope is we will do this quickly if the articles come over. this shouldn't be drug out. there's not a whole lot of facts to be discussed. >> reporter: now on monday the house impeachment managers, the prosecutors will walk the article of impeachment over to the senate. at that point the acting senate sergeant at arms, jennifer hemingway, informs the senate that, quote, all persons are commanded to keep silent on pain of imprisonment while the house is delivering articles of impeachment against donald john trump. the charge is incitement of insurrection. senators are trying to work out a deal for a trial framework that could push most of the trial until mid february. but here's the problem, if there's no agreement, all other senate business stops. that means no confirmations and no coronavirus relief bill. lou? well, make no mistake, part of their motivation is to divert public attention from their own negligence and failure to act before january 6th to prevent the violence. just days before the january 6th tragedy the fbi knew of the threat of violence and discouraged some individuals who were planning violence from traveling to washington. the day before the attack fbi office in norfolk, virginia, issued a warning that there were the, indeed, plans for violence on january 6th at the rally. in december, in december the new york police department sent intelligence that it had gathered about the potential of violence days before the mob actually attacked the capitol. there are also reports suggesting that house speaker pelosi and senator mitch mcconnell were briefed about potential violence prior to january 6th as u.s. capitol police is overseen by the congressional leaders, the speaker of the house in particular. we have reached, and when asked by "just the news," neither nancy pelosi's office nor senator mcconnell's office would respond as to whether they were briefed about the intelligence that violence would occur or could occur on january 6th. in the weeks since the attack, we've also become aware of radical militia members of the right-wing group the oath keepers, that they coordinated with one another as they stormed the capitol. and according to court documents, one of the rioters alluded to a coordinated attack saying, quote: we have about 30-40 of us. we are sticking together and sticking to the plan. end quote. the democrats who are now trying to blame president trump are also ignoring the timeline of the capitol siege. when rioters arrived at the capitol at 12:40, capitol hill police chief steven sund, who has since resigned, said, quote: i realized at 3 p.m. thing -- 1 p.m. things weren't going well, ant going well, i'm watching my people getting slammed. at 1 p.m. eastern president trump was still talking on stage, talking to his supporters at the save america rally. he remained on stage for another ten minutes. during his speech the president also addressed those who intended on marching down to the capitol. but as they were doing so and preparing to do so, he encouraged them to demonstrate peacefully and patriotically. at no time did he intimate in any way that he expected or encouraged anyone, anyone to invade the nation's capitol or to assault any law enforcement officer. both of those pieces of evidence are ignored in their entirety by the leadership of the democrat party. president trump's right to free speech also being violated. the dems want to strip him of his right to due process. they've done so pretty well to this point. they want to silence as well the 74 million americans who voted for him, and they want to shred the constitution with these proceedings. it's outrageous, simply outrageous. and our next guest defended president trump from the radical left's impeachment farce of last year. here is the prescient warning that he delivered then. >> instead of a once in a century phenomenon which it had been, presidential impeachment has become a weapon to be wielded against one's political opponent. lou: i thought the word prescient was perfect there, don't you? kenneth starr clearly saw the near future. this year, right now. joining us is the former independent counsel, fox news contributor ken starr. ken, great to have you with us. >> thank you, lou. lou: precisely as you, precisely as you projected. we are watching a partisan assault that continues against the president, the former president of the united states that began with his candidacy in 2016. the outrage persists, the persecution continues. your thoughts as we are on the cusp of the beginning of a, the next step in the impeachment, the second impeachment of donald john trump as they like to say giving, i guess, some serious tone to this farce that they are playing out. >> lou, it's a tragedy for the country. it really is a shame. but it's the also unconstitutional. whatever the facts are, and thank you for that timeline, whatever the wisdom may be, i think it's unwise. in my judgment, what is unfolding is a violation of the constitution. that is to say you used the keyword, you said former president. and that's exactly right. and that's where this should end. because when the president left office under operation, under the operation of the constitution, it was over. it should be over. i hope that one of the first steps will be a hearing, so to speak, and a motion to dismiss for lack of jurisdiction. that is to say the president of the united states is joe biden. this is an impeachment against the former president of the united states, and the constitution simply does not authorize that. now, others disagree, but that's my reading of the plain words of the constitution. it's also consistent with our history, lou, and that's richard nixon's resignation as president in 1974. and there were two years to go in his presidential term. the impeachment proceedings came to an abrupt and proper stop, and the democratic-controlled house of representatives at that time. lou: some of -- principally democrats -- have often cited that article ii of the constitution gives the senate and the house sole power over impeachment ask conviction. and conviction. and they use that as a way to respond to the point that you make. the man is no longer president of the united states. he's no longer in office, and impeachmenting laid out by the constitution clearly says it is a device for the removal of the president or other officers. the logic straight the forward. -- straightforward. the language is straightforward and yet here we are. >> and, lou, the logic is so powerful here, but we don't even have to go to the logic of what the founding generation intended to do. and you used -- once again, the keyword, lou -- removal. you don't remove somebody who's already gone. you don't evict a tenant who's already vacated the apartment. it is over. and i, again, hope that cooler heads will prevail in terms of we don't have jurisdiction. it's a very serious issue, it's an up-front threshold issue. but here's another dimension. because we're talking about the former president of the united states, the constitution goes on to provide that when the president of the united states -- those are the words, the president of the united states -- when the president of the united states is the subject of impeachment, then the chief justice of the united states shall preside. and i know there's discussion going on, at least the i gather, with respect to, really? well, the chief justice, will he respond? will he say, yes, i'm going to sit to preside over the trial of a former impeachment when the text of the constitution says when it is the trial of the president, not the former president. so you don't have to go to law school to figure this out. someone who reads thoughtfully and carefully the constitution, sets politics aside will see that the structure, the wisdom of the constitution, the language of the constitution says if you have something against donald trump, then stay tuned, there may be another election in four years. but don't use a device that was never designed, intended nor textually authorizing this kind of proceeding. lou: and with that, it's unlikely based on your reading of the constitution which is absolutely penetrating and esteemed trout the legal -- throughout the legal profession, we wouldn't see kamala harris or patrick leahy then sitting there there as president pro tem of the senate making the decisive vote. [laughter] that's encouraging to all. what is not encouraging, of course, is -- and i have to ask this. we're -- politico reported that justice roberts doesn't want to preside, and one couldn't blame him. but it's also sort of an early reading of what the supreme court would think about this; that is, this is unconstitutional. how soon could the court weigh in on that? >> well, we may hear from the chief justice as to his individual views, but i think let's just assume the worst, absolutely assuming the worst, that the trial goes forward, and let's further assume that the president, the former president is convicted and, therefore the, the punishment is you're disqualified from ever holding office again. let's just assume that, right? i believe the president will then be able to file an action in the appropriate federal court saying essentially what the congress did, what the senate did by imposing this punishment was to create what was called in the constitution a bill of attainder. the legislature is not to single out an individual and visit punishment on his or her head. that happened all the time in the england. that's when parliament -- that's what parliament did. and our founding generation said we want none of that. the congress of the united states will not be able, article i, section nine, right there with ex post facto, you can't make a crime something a crime that wasn't a crime at the time. but bill of i attainder is right there. why? because it would be an abuse of congressional power, of senate power, and it would, frankly, be profoundly -- lou: well, that's certainly -- >> -- to the victim here of president trump of this bill of attainder. lou: well, this -- i'm going to have to research that bill of attainder tonight. one thing i don't have to research, the persecution by the democrats that has been immoral, illegal and outrageous for the past six years. ing i don't think they will be disturbed by continuing their streak. ken starr, as always, illuminating to listen to your analysis. we appreciate it. thanks so much. up next, congressman greg steube. please stay with us, we'll [ thunder rumbles ] [ engine rumbling ] ♪♪ [ beeping ] [ engine revs ] ♪♪ uh, you know there's a 30-minute limit, right? tell that to the rain. >> yeah, there is a lot of us, i voted against the waiver in the house because he hasn't been out of the department of defense for seven years. he was the general in charge when isis came over into iraq during the obama administration. i served in iraq not during that period of time, in '06-ooh '07, but there was a lot of us that served that didn't like the way that was handled. there was also some things in syria during his time there that we don't think that was handled in an appropriate manner. so ill assume that's why they -- i would assume that's why they voted that way. there were 78, i believe, republicans who voted against his nominee in the house. lou: well, let's -- and with that, let's turn to issue at hand, the republican party and more than half, more than half of your conference doesn't want liz cheney in leadership any longer. kevin mccarthy giving somewhat mixed signals about what he wants to do here. your thoughts about what her future is in your conference. >> well, at some point there's going to have to be a vote, and if more than half the caucus has said they've not going to vote to keep her, then i don't see how she stands as conference chair. look, here's where i am on this issue. any member of congress can vote however they want. they're responsible and accountable to the people in their district. every two years they can vote them out of office if they don't like what they're doing. but what chair cheney did as the conference chair of the republican conference is send out a press release prior to the impeachment vote that said things like the president of the united states summoned this mob, assembled the mob and lit the flame of this attack. everything that followed was his doing. making factual assertions that i clearly don't agree with, and then giving -- lou: wait a minute, congressman. i have to interrupt you. she made those assertions. they were hardly factual. congressman, i'd like you to stay with us through the commercial, and we'll come right back and pick it up, if you will. thank you very much. we're with greg steube, congressman steube will be with us right after these words. stay wit research shows people remember commercials with nostalgia. so to help you remember that liberty mutual customizes your home insurance, here's one that'll really take you back. wow! what'd you get, ryan? it's customized home insurance from liberty mutual! what does it do bud? it customizes our home insurance so we only pay for what we need! and what did you get, mike? i got a bike. only pay for what you need. ♪ liberty. liberty. liberty. liberty. ♪ ♪ ♪ lou: we're back with congressman greg steube of florida. and, congressman, i just want to turn to the issue of the party itself. it seems to be riven with some considerable division of opinion and viewpoint in values right now. you have been a big supporter of president trump's. the leadership, kevin mccarthy, the minority leader, has been a big supporter of president trump. mitch mcconnell, perhaps i could just say not so much. this, we've heard very little from a lot of republicans in the house and the senate, but particularly the senate, in the defending trump and basically articulating the absurdity of this effort by the dems to impeach a president no longer in office. >> i have been arguing it on the floor when we voted this out. i mean, it's a travesty from a lot of different perspectives. one, there wasn't a single bit of evidence, not a single hearing, not a single witness that testified as it related to the impeachment. the article that they brought was incitement of violence. there is no evidence that he incited violence under the pursuant case law that's out there related to that issue. so you have a situation this which you have a -- in which you have a president who didn't violate the law, there's no evidence that he violated the law. it passes the house of representatives and goes to the senate for a trial, i don't know what they're going to have a trial on when there are no witnesses and no evidence in the house for this proceeding. to say it's unconstitutional, and then on top of that you put the fact that he's not even the president anymore. i mean, mr. starr talked about it earlier in your show. how can you impeach a former president who's not president anymore? and i agree with everything mr. starr said, i i think that's hugely problematic on the outset, not even getting into the factual issues that plague this impeachment process. lou: well, the dems have made it pretty clear they don't care about the facts, they don't care about evidence because the ed all supports the president -- evidence all supports the president, the former president, and there is no constitutional base for the action they're trying to take. the times we live in. congressman, great to have you with us. thanks so much. we appreciate it. well, turning to the former cia director, john brennan, he is back in the news because he said president biden is targeting his political opposition, which he recommends. listen to what he thinks about the opposition. >> the members of the biden team who have been dominated or have been appointed -- nominated or appointed are now moving in laser-like fashion to try to uncover as much as they can about what looks very similar to insurgency movements that we've seen overseas where they germinate in different parts of the country, and they gain strength, and it brings together an unholy alliance frequently of religious extremists, authoritarians, fascists, bigots, racists, nativists, even libertarians. lou: that man is deranged. it's that simple. brennan's tenuous connection to reality makes him quite a threat to our way of life. here are some highlights. brennan lied about intelligence agencies conducting no spying on the trump campaign. he lied about the steele dossier playing no role in the creation of the i.c.'s assessment of russian interference in our elections. brennan lied to congress when he denied allegations that cia officials had hacked the computers of the senate intelligence committee. he is a liar. and he is an adroit and unabashed liar. joining us now to address brennan's latest remarks is tom fitton, the president of judicial watch. good to have you with us on the broadcast. this, i mean, brennan was really soaring in that fantasy world in which, that he -- which he was trying to concoct there. your reaction to his remarks. >> well, they were dangerous. and if you're, if you're an american who didn't vote for joe biden, john brennan is signaling they're going to come after you, and they're going to treat you like a terrorist, and what follows from his statements, that we start bombing parts of the country, targeted assassinations? i mean, that's crazy for a cia director, former cia director to be talking like that. but that's the result of his and other misconduct being ignored and not pursu add a adequately by the justice -- pursue add adequately by the justice department. they feel they've been ratified in their abuse of power targeting their political opponents, now they're escalating it. joe biden announcing the national security council has an extremism component now. they don't mean antifa, or lou, you know that. they mean you. [laughter] lou: yeah, yeah. >> they're coming after their political opponents. they don't care about the violence. they care about having the tools necessary to suppress their political opposition. it's frightening to hear a senior government official -- and he is, you know, he's out of government, but someone like that never really leaves government, they're always there in the circles of discussion and power. and someone like brennan, god help us if he has the ear of joe biden. lou: well, it also, it would be a little disturbing to think that he has the ear of the deep state, because it sounds very much like he is spouting orders to the deep state. it would be a dog whistle if it weren't so overt on his part. and there is no condemnation of his remarks from anyone on the left. it's really stunning to watch this unfold as they pursue what is obviously an unconstitutional effort again at impeaching a former president. i mean, this is, this is a level, this is not orwellian, this is kafkaesque. this is madness, to watch what the radical dems have become. they're irrational and stunningly so. >> aside from the jurisdiction of the senate, it's anti-constitutional. what they're saying is you speak words we don't like, we're going to pretend it's violet, and we're going -- violent, and we're going to come after you. so any politician left or right who supports this, they're saying that we will target our political opposition potentially for words we disagree with that are perfectly legal, perfectly core political speech. the president did nothing legally or morally wrong on the day of 1/6 or before that. and to say otherwise and to suggest he should be held to account for, as i said, is an at this time call to our constitution, and you're on the wrong side of the first amendment. lou: tom fitton, thank you so much for being with us. good to have you here. tom fitton, the head of judicial watch. up next, president biden's call for unity, a somewhat shaky start. we take it up with pastor robert jeffress. stay w tasha, did you know geico could save you hundreds on car insurance and a whole lot more? and i don't mean just in talk, but actually leading in their communities. >> yes, sir, i think you're going to, and the good news is god is on our side. and as the bible says, if god is for us, who can be against us?
