If jpmorgan and goldman sachs, bank of america want to be left to have Elizabeth Warren running their firms they may be, they may need to look to republicans to save them from her. There will be a balancing act but i think its a very bad precedent. There is a big push to do this. They want to effectively can sell the Republican Party like theyre canceling President Trump. I hate to be cynical about this and sound cynical but these companies dont give money to candidates out of the goodness of their heart or because they believe in the principles of democracy or how important their contribution is. Were you there last wednesday in the capitol when those Extraordinary Events took place, and if you were, what did you see . I actually was in the rayburn room about to go over because we were going to be voting on the arizona, and i was ready to go over there, i looked out the window going on. Ive seen protests in the past but they have never gotten close to the capitol. When i saw from the Office Window i could see the crowd at the capitol itself, not the grass area but at the capitol. Then i started seeing some smoke which i guess was tear gas. That is what we saw there. And it was just incredible that somebody would break into the capitol, drag policemen, beat up policemen, hit them with flagpoles and all that. Just incredible. I never seen anything like this before. Gerry shocking very glad that you and others were safe too tragically lives were lost. I want to talk about impeachment. Nancy pelosi making it clear bringing a impeachment resolution to the house. Probably will get voted on it this week. President has eight, nine days to go in office. There are those a week to go, is this really necessary . You know, he is going to be gone anyway. Is it fair to bring an impeachment process which is supposed to be a proper with due process and a proper legal process, is it fair to bring one so quickly and impeach the president like this. The house side does what we call in a criminal case they do the indictment, and then the trial and hearings and evidence all that is done in the senate side. So we can do our job because it is more of an indictment. Look, im an attorney by profession and you know, but what i saw, everybody saw the phone call he made over to the georgia secretary of state, i can tell you, i was texas secretary of state, democrat bipartisan under under governor, anybody call me ask me, to find me some votes i would have called Texas Rangers on the spot because of that. What we saw, what i saw personally, i think we definitely need to move forward. Now what the senate will do, they are going to be doing the trial and evidence but what we do on our side is going to be a very specific indictment, impeachment of what, and i know the clock and the calendars against doing all this but i personally feel that we need to do this to send that message because what the president said and did is just you know, it is surreal, especially what i saw. His own Vice President was there when he sent the crowds over there. His own Vice President , mike pence was there when he said the crowd were trying to break into the house floor. Rescuers are still searching for the wreckage of an indonesian passenger jet that crashed into the ocean on board with 62 people. They say they located the black box flight recorder. Fox news Benjamin Hall has the details. Reporter gerry, this is no longer a searchandrescue mission. This is a recovery mission. They are recovering the black boxes and human remains they can find. It is presumed all 62 people on board the plane have dived. Indonesian divers, navy divers are looking for the black boxes. They have located them. Theyre buried untons of wreckage making it very difficult to recover them. This 26yearold boeing 737500 jet, belonging to ryanair disappeared minutes after taking off from jakarta, in indonesias capitol during heavy rain. It was en route to borneo. Dozen helicopters, 53 navy ships, 100 rescue personnel have been looking since sunday. They found wheels and jet engine. A midair breakup has been ruled out. The debris is concentrated one area. That suggests that the plane hit the water intact. 17 body bags containing human remains have been recovered are being identified. Police connected dna samples from relatives to help with that. 62 people on board, seven were children, 12 were crew. Indonesia has been plagued by accidents because of aging infrastructure and poorly enforced safety standards. There have been three major plane crashes in last 25 years. Dan, is this inquiry going to give honest answers . Certainly time will tell. We dont expect any major breakthroughs in one visit. It will be relatively light in that sense. The big question everyone will look at what kind of access to the w. H. O. Investigators have. That has been under next for almost a year now. Not a lot of details have been reached. What sites will they be able to look at in wuhan and other places. I guess well know by next week. Probably most attempts will focus on what we learned immediately but what kind of access china has granted what information are they saying. Gerry dan, the initial reports were this was all you know, wet market, came naturally out after wet market when somebody ate a bat or pangolin or they shouldnt have done but there is growing more speculation, growing suggestions even some evidence maybe this came out after lab f that is the case the chinese are, back to your original point the chinese will not be open, are they, if it was being conducted, came out of experiments being conducted in a lab . Yeah. China is not sending any signals that it is terribly interested in being transparent on this issue and if it is not much of a natural cause obviously they would be less. We could say three possibilities t came from nature as you said. Second, accidentally released from a lab. Thirdly, somehow something they were experimenting on. We have no evidence of the experimentation but there does seem to be some indication maybe it was released accidentally from a lab. China wouldnt be terribly interested in showing incompetence yet alone malintent we wont get a lot of transparency if that is what is going on. People presumably at the w. H. O. Have been investigations the origins of this. There have been criticisms of the w. H. O. Remember the w. H. O. Was very comply ant with the chinese view early on this. Do we expect real honest think and a real, kind of real aggressive investigation that we would need to get from the w. H. O. . I mean i think the w. H. O. At this point, with all eyes on it will do as much as it can but they cant push around china. They cant get access to things the chinese wont give them. We have to remember the whole world is watching intently right now and if we dont get the kind of information out of china we would expect from another country, trust in china is going to take a big blow. Well have to use whatever data we have otherwise to figure out how this happened but the next time around there will be a lot less trust in china. I hope it doesnt happen for a long time. Im thinking the next time there is even a hint there is something amiss well see countries start to shut flights down from china almost immediately. That will be part of the impact of lower trust in china due to the lack of transparency and access that so far they have been providing on this critical issue for the whole world. Gerry and yeah, exactly. One of the things of course the chinese said, look at the data, they have had extraordinary success supposedly in keeping the lid on this virus. They have one of the lowest death rates to the virus in the world. Can we believe that . Is it partly because they are such an authoritarian society they shut things down or are they just covering up . My view that it is still very early to try to make any of these assessments. I think there will be a lot of data coming out. Im more interest in what countries like taiwan, south korea and japan have to say because they have much lower incident rates than we do, however well get much more transparency and honest at this from them. We can compare to what they have done to what china said. Is china 100 honest about the numbers . I find that hard to believe. Im not sure they ever underestimated by factor of 100. History, i think the transparency issue on healthcare is probably as good as anything ive ever seen this is almost one fifth of the u. S. Economy is not transparent, you dont know what the price of things are or the quality and yet you get a bill three weeks after the service has been delivered, that makes no sense in the transparency done and that executive order is terrific and if you want to look at one thing, an amazing thing is operation warp speed, the country developed vaccines that are delivered now operational within nine months, that is amazing so when i look at what happened this last year on economics, we accept the groundwork for a normatively Strong Economy in 2021, probably not the First Quarter because they still have the lockdowns all of our, once the lockdowns are lifted i think second, third, Fourth Quarter of this year will be extraordinarily strong and as ive said many times, i think joe biden is the best choice from economics from the standpoint of the democrats i think is a good guy and doesnt have a grudge and a chip on his shoulder and i think, let here is is a normal person without a chip on their shoulder and if they can be moderate and Going Forward, i think the u. S. Economy could do really, really well over the next 12 months. Gerry what about the president s trade record and legacy, you work for Ronald Reagan trumps former president in many ways, key advisor very much into free trade following successful president s were promoted free trade, this president has gone very much against that, tariffs against china, tariffs against other countries renegotiating trade agreements, you could tell us if thats a good record, is that going to be the patent Going Forward, much tougher approach in a nationalistic approach in the belief of globalization and free trade . Let me just go back to reagan, we proposed and did nafta and nafta was pushed through much later after reagan but there were certain situations where reagan was a protectionist, if you remember against japan. I could go on and on, all president s have a lot of things to say about trade, trade as a Political Tool in a specific tool for economic recovery, et cetera in trade is one of the biggest generators of economic growth, kennedy tariff negotiation, i think nafta did well in President Trump use trade in many, many ways, he was not into a free trade but he did use trade as every president has before him as a Political Tool to secure behavior in the part of other countries, no one is wanting free trade with north korea and nuclear weapons, that is clearly not appropriate, zimbabwe when he had the problems there we use trade as a tool back in the day, trade is a very complicated subject and i dont think trumps record on trade is bad, im not a big tariff and and i dont like the uncertainty of switching tariffs but i think trump on the north american trade agreement that he brought through isaac was pretty good and some of the stuff with south korea and japan, i think it was also pretty good towards free trade and better trade but i think all these president s have a mixed legacy when it comes to trade because there are so many aspects of trade that have different implications politically, economically and also changes in behavior and other countries, we have a lot of change in against iran because their behavior is not good, its perfectly appropriate that we will put sanctions against them. When i look at the trump record on trade i dont see anything terrible to be honest with you. Gerry briefly to wrap up, the democrats do have a majority of sorts in the congress, 50 50 in the senate with a tiebreaking vote from Vice President kamala harris, biden is committed to reversing a lot of what President Trump did big tech increases, seeking Corporate Tax increases, rollback of the deregulation that President Trump did, is a narrow majority in the senate, do you think that legacy is going to be washed away by the Democratic Congress . I really dont, what people say in the campaigns and what they say in the primary often doesnt materialize, when i look at joe bidens history i find a very excellent senator, a person who has worked with both sides of the aisle, hes been an extreme, he voted for the 86 tax act which cant undercut the highestrated personal income down to 25 , the corporate rate from 46 to 34 , he reduced the number of brackets from 11 brackets to two brackets and he voted for that enthusiastically as did a lot of democrats, what is going to happen after bidens in office for a little while and trump is out of the picture, the democrats are united by trum byt of term, once trump is gone youll have the democrats of not one common mind on raising taxes and really regulating and doing all of that, i surely expect biden to do a good job and i truly believe that he will do the best job he possibly can not to have a downturn in the recession. Gerry democrats launching their second impeachment push after the riots on capitol hill, former whitewater independent counsel robert ray thinks the case for impeachment might be stronger this time around, this is starting to look like a ritual the second time, second january in a row that the house is moved to impeach President Trump and last time and went to the senate and he was acquitted with just one vote from republicans to convict him, any reason at all to think this will play out any different . My only point has been to publicly comment this time around the charge that we have seen from the house of representatives doesnt suffer from the defect it did last time which they did not even charge her crime. At least here they charge the president and cited violence against the United States government, as a factual matter i dont know if thats a better case, he has defenses under the First Amendment and factually the best the house could come up with is the president statement to the effect if you dont fight like hell youre not going to have a country anymore does not seem to be the same thing work waiting that with inciting violence. Im not sure its a persuasive to convict article of impeachment resulting in his removal from office and more importantly the democrats true objective prevent him from holding federal office in the future including to run as a candidate for president in 2024. Gerry as you and i have talked about before, the standard for impeachment is not necessarily a criminal offense, i think the founders were thinking of impeachment in terms of political crimes as much as anything else, it may be unlikely what the president said would get him convicted in a court of law for incitement, the combination of continuing the denied the Election Results and continue to insist it was a fraud and egging on his followers in the way that he did, that presumably is at least evidence there of a politically very questionable behavior. Look i cannot argue with you there and we have discussed many times before that argues in favor, counsels in favor of some kind of a Center Action which seem to be one that would make the most sense given the fact by the time the house ask which is likely to be wednesday there will only be one week left in this demonstration, if theyre inclined to do something that has any chance of bipartisan support which it would have to have in order for it to be successful, i agree with my former colleague David Kendall who represented the president during the clinton impeachment, he had an oped in the Washington Post to the effect that censures anything of any chance that would likely receive bipartisan support. I do know this and we talked practically before about the political context, that would be an awful thing to hangover the first 100 days of the biden the Administration One thing i was proudest of as independent counsel during the Clinton Administration was to resolve the matter before president Clinton Left Office and when the new president took Office President george w. Bush, the whole matter of impeachment and sanction and criminal prosecution did not hangover and disrupt the new administration, although i could not proceed at the time generally speaking, you always understand that may do significant damage in terms of distraction to the new administration and it was only nine months later in the george w. Bush administration that 9 11 happened, we always have to be mindful not just the person of donald trump involved but the institution of the presidency that we should care about and be concerned about and to protect. I think it would be good for everybody to take a deep breath, stand back, but the president leave office and let joe biden take office as president of the United States and january 20th without a cloud been a distraction. We have big problems to solve including covid19 and other things and this is not a problem frankly that warrants this kind of attention and absorbs the country and unnecessarily does whenever youre talking about in impeachment or sanction of the president of the United States or of former president for that matter. Gerry i think it sounds right to me its hard to see joe biden in the 600 days to be dominated as the last four years been dominated. I think he may have to come out and say he can call in and encourage the congress to put in the drawer and shallot.
