>> what is interesting with a large hedge funds normally idea that you hear hedge pungdz these guy must know what they're doing so what happens is when they short stock -- so they have a lot of shares betting that stock will go down right. if they're wrong it turns into a squeeze that's why we're seeing actually some of these stocks rally so much. because not only do you have new buyers saying i want to get a piece of this market and buy it as investment but you have hedge pungdz who are short going oh, my gosh we're wrong and try aring to get out fast. faster than bill cosby beginning to prison. is this such a thing as etf or cannabis mutual fund which brings together all of the pot stock or a lot of pot stocks so you don't put all of your money into one basket. but you spread it around a bit. >> so there's new ones coming online. the thing that right now that has been a new enough industry where it has been more focused on individual stocks. and so part of it is a little bit of a buy or beware to make sure there's due diligence in understanding does this company have revenue, and all of that different stuff. there are some larger companies -- gwph is a large company that not only do they do different medicinal items but they a also have cbd infused method as well so that's a way where it is like this is a proven company been around for a while instead of getting into the more speculative stuff. >> do you think that say five years from now -- marijuana will be a profitable nationwide multibillion dollar industry? joining us. thank you very much mr. secretary general. the security counsel will now consider item two of the agenda. i will make a statement in my capacity as president of the united states of america. it is a great honor to be here today at this u.n. security counsel briefing to discuss a matter of urgent importance concerning and countering proliferation of deadly chemical biological and nuclear weapons and means to deliver them. the nations of the world have long recognized that certain weapons are are so dangerous and can inflict so much suffering that all of us have a vital interest in preventing their further development spread and use. since my inauguration, the united states has taken bold action to confront the sinister threats. many of us are rightly focused on the dangers of nuclear weapons. but we must never forget the risk posed by biological and chemical weapons. the united states was one of the first nations to and we are led international efforts against the scourge of chemical warfare. most recently in syria we have twice imposed severe consequences on the assad regime for using chemical weapons against innocent civilians. i want to thank prime minister mae and president macron for their country's close partnership in those efforts last april. the syrian regimes butchery is enabled by russia and iran. the iranian regime exports violence terror and turmoil elicitly procured sensitive items to advance ballistic missile program and proliferate these missiles all across the middle east. the regime is the world's leading sponsor of terror and fuels conflict across the region and far beyond. a regime with this track record must must never be allowed to possess a nuclear weapon. for this reason, i announced earlier this year, that the united states would withdraw from the iran nuclear deal. this horrible one-sided deal allowed iran to continue it path towards a bomb and gave the regime a cash lifeline when they needed it the most. they were in big, big trouble. they needed cash. we gave it to them. in the years since the deal was insoud, iran's aggression only increased. the regime used new funds from the deal to support terrorism, build nuclear capable missiles and fullment chaos. following america's withdrawal, the united states began reimposing nuclear related sanctions on iran. all u.s. nuclear related sanctions will be in full force by early november. they will be in full force. after that, the united states will pursue additional sanctions, tougher than ever before to counter entire range are of iran conduct any individual or entity who failses to comply with these sanctions will face severe consequences. i ask all members of the security counsel to work with with the united states to ensure iranian regime changes its behavior and never acquires a nuclear bomb. with all of this said i want to thank iran, russia, and syria for at my very strong urging and request substantially slowing down it their attack on idlib province and 3 million people who live there in 35,000 targeted terrorists. get the terrorists, but i hope the restraint continues. the world is watching. thank you also to turkey for helping to negotiate restraint. anything the usa can do to help resolve this problem in order to save perhaps even hundreds of thousands of lives, maybe more, we are willing and able. we china has been attempting to interfere in our upcoming 2018 election. coming up in november. against my administration. they do not want me or us to win because i am the first president ever to challenge china on trade. and we are winning on trade. we are winning at every level. we don't want them to meddle or interfere in our upcoming election. as i also mentioned yesterday we have seen the results of historic efforts to open new pathways to peace on the north korean peninsula, on the korean peninsula and that is something we are extremely proud of. i am pleased to say that north korea has not conducted a missile test since last november. it has not conducted a nuclear test since last september. and the hostages have been returned to us and very importantly the remains of american heroes are now returning home. in june i held an historic summit with chairman kim jong-un in singapore where reaffirmed his commitment to complete denuclearization. last week chairman kim reiterated that commitment to president moon ad their third summit and to me in a very strong letter form. i think we will make a deal but unfortunately to insure this progress continues we must enforce existing u.n. security council resolutions until denuclearization occurs. however, we have detected that some nations are already violating these u.n. sanctions. this includes illegal ship to ship transfers, which must end immediately. the safety of the korean peninsula lashes the region, and the world depends on full compliance with u.n. security council resolutions. very, very important. but most importantly i believe that chairman kim jong-un, a manage i have gotten to know and like wants peace and prosperity for north korea. many things are happening behind the scenes away from the media which nobody knows but they're happening nevertheless and they are happening in a very positive way. so i think you will have some very good news coming from north korea in the coming months and years. i also very much appreciate what president moon of south korea had to say about me last night in television interviews, working with president moon has been by great honor and likewise working with president xi of china and prime minister abe of japan has been a pleasure and an honor. even of us follows in the footsteps of countless world leaders, diplomats and public servants who came here to the united nations with the same noble goal, to build a future worthy of the patriots, true, true patriots, who sacrificed their lives for our nation and for our future. to be successful we need a commitment of every nation representatived in this chamber acting together, we can replace the horrors of war with the blessings of safety, and the beautiful, promise of peace. thank you very much. i of commerce second live vice president a timely appearance. >> always happy to be on the show. stuart: the president made news by saying china attempted to interfere with our election process. this is all tied in with trade, isn't it? you have a strong position on trade with china. >> stuart, first of all the speech was a tough one but not one we should be surprised about because he commented on iran and other countries as well and on message certainly on china he is raising the rhetoric. he is making it clear he is not happy with the progress, not just on trade but also probably on north korea. and he is setting a very clear message to xi xinping. on trade, the chamber is very clear there are a number of concerns about china trade practices, concerns that go to the jobs and economy. stuart: you say it is not a trade war. you say america -- >> we have escalated things for sure. 250 billion -- also we have $250 billion of tariffs in place that is a hit to consumers. it will raise prices in christmastime. a hit to jobs in the united states. hurts farmers and manufacturers. on the other hand i got to tell you we support the president administration trying to address unfair trade practices because china is ripping us off in intellectual property, they're stealing our data. they're making it difficult to play in their markets. stuart: we got it. >> these are legitimate issues the administration is trying to tackle. stuart: but what do you want? you want no tariffs, get rid of the whole idea of using tariffs as leverage on china? you want that? >> we want china to play by fair rules. stuart: how do you get them to do that? >> you have to pet pressure on china. stuart: what does that mean? >> i'll tell you what it means, it means we should restrict some areas china access to our market, so we got tougher on that front. two, we have so get the japanese and europeans involved in this. it is not just about america. it is about europe and sharing that burden telling china is enough. stuart: you don't want tariffs. the chamber of commerce does not want tariffs, right? >> we don't want jobs. stuart: when are you going to say it we don't want tariffs. >> we don't want tariffs. that's right. stuart: shouldn't be pulling teeth for heaven's sake. you have a position, take it. >> our position is clear from day one, we need china to play by the rules. stuart: yes. >> we need to have china do a lot of things currently they're not doing. we agree with the administration on this. stuart: brian kilmeade joining us by the radio, brian, welcome to the show. you always wanted a tough line on china vis-a-vis trade. i think president just laid out a tough line. what do you say? >> it was great. i'm on the air at the same time watching and watching the crawl on the bottom so it is not easy, but i love what he said about china. stuart and i kid around about this before he hops on -- stuart are we talking trade? we'll see what happens with this. one thing chuck schumer, president bush, president trump, president obama all agree on as well as the eu, china does not play the game fairly. as they got stronger and gained strength people are concerned about their market, they're concerned about their product, they're concerned about their manufacturing so they're afraid to take them on. president said, i will take them on. wait a second, mr. president, not everybody at once. south korea, is done. mexico, done. eu, framework finished. canada has a few days. i guess they will get in line. guess what they can all point to, these are the deals we got done, by the way i think brazil will be brought in too. we'll focus on the problem. not so much that they're good but they're not playing fairly. we also know about what they're doing with tech, what they're doing with intelligence. not just militarily. this is the time to face them and the president's not afraid to do it. when you look at the muscle we bring to the table economically outside of our debt we have never been stronger. don't you agree. stuart: i agree. but he brought in another element here. the president brought in extra element accusing china of trying to meddle in the elections. that is an added point on top of going after them on trade. going after china on trade. he has expanded the hard-line. that is what i'm trying to say, brian. >> good. i'm sorry. i know you midterms before they even want to talk to us thinking the president will be in a weaker position. so this is a great bargaining move for the president. maybe they do have intelligence. they probably do. china is looking to infiltrate somehow. they say nobody knows america out side america better than china. they could tell you the districts on long island and in oregon. that is how well they're tapped into our electoral system. thanks to senator feinstein's driver, we know everything that dianne feinstein was thinking the last 20 years. they are tapped into our system. so he is right. game through the united nations and severe consequences for anybody who breaks those sanctions. iran said the president will never get a bomb. then the president broke news on china. he said that they had indeed been trying to meddle in our elections for this november. he doesn't want them to meddle or interfere with those elections. he says china does not want him to win. ashley: that's right. stuart: that is breaking news if i ever i saw it. let's get to the nfl. talk about a change of subject. cowboys owner jerry jones doesn't like the rule of the roughing the passer. roll the tape. >> the amplification of this rule, as much as anyone i have seen makes a change in our past. stuart: as i understand it you can't apply your full body weight to the quarterback when you go after him. i think we should bring in joe theismann super bowl i 7 champion before i get out of my depth. joe, everyone knows one tackle ended your career as quarterback. so how do you feel about the new rule. >> first of all, stuart, nice to see you again. i think the rule crossed the line for safety. i'm all for protecting the quarterback. i'm for how do you stop someone coming after the quarterback and be able to change what your body is going to do? i think the calls against clay matthews are ridiculous. the rule has become so difficult to interpret and implement coaches can't teach it. i agree. mike zimmer the head coach of the minnesota vikings said these rules will affect players pocketbooks, they will affect games and coaches jobs. we've seen in the fir three weeks of the season 34 penalties called, where in the same time a year ago it was only 16. there needs to be something done to make the game more suitable for the fans and the defensive guys that play it. stuart: i'm an outsider to the game, you're very much an insider i don't thinksee how an official make objective the judgment about roughing the passer? how does the official know whether you're full body weight has been applied to the quarterback? how do you judge that. i don't see how you do it? >> i agree with you, it is such a subjective call. the nfl stressed for years they don't want officials determining outcome of games. with the implementation of this rule and interpretation of this rule the officials are a very big part of out come of football games. i think they have to step back. they did it with the helmet rule. they mod fight it a little bit. they need to modify this one a lot. stuart: would you change any other rules? i believe that is some new rules entered into the game in recent years. would you change anything? >> i would like a clarification what a catch is and is not. i would like to see it more simplified. if you have the ball, possess it in bound, it doesn't matter what happens going out of bounds, its can much. leave it at that. if it's a fumble, it's a fumble. i would like simplicity when it pertains to the rules. stuart: would you like the game speed up a little. >> no. i think the game moves quickly. what slows it down are penalties. the game other night was a root canal to watch it. took forever to get through it t was painful the end. you didn't think it would be this painful. but in the end it really was. stuart: what is the general shape of football? what shape is it in right now? it had a bad season last year for all kinds of reasons. you think it is recovering? >> i think it has. i think football fans are there. there is two things that really drive football today. obviously fans love the game is one. the other thing is you have fantasy football. people really don't like it or don't understand it still participate because everybody in the office does. you have the betting. you and i talked about this not too long ago. with sports betting people have the opportunity to bet on football games. we have a lot of young guys coming into the game, josh allen, baker mayfield. they make it exciting. we have infusion of youth where people are getting excited again. stuart: i never thought i would be infused about football news on a day when our president is at the united nations when the president has a go at the iranians. you did it. >> remember about the u.s. a again. we're getting bigger and richer, stronger, way more to go. that message resonates on main street. and look at this, "gallup poll" showed 45% gave the republican as favorable rating. that is a seven-year high. i'll call this a sleeper poll, because it is not what you're used to hearing. so democrats, don't get too confident about that blue wave. america cares about being prosperous again. when we see a strong economy, we like it. five weeks to go. don't count the republicans out. the third hour of "varney & company" is about to begin. ♪ stuart: now we're up 62 points, 26,500. 20 of the dow 30 are in the green, they are up. and joining us charles payne, hosting of "making money." i'm sure you heard my rant of the day. >> i heard it. stuart: you can't, look, we care about prosperity and i think voters care about prosperity. so i am not so sure this blue wave is going to happen. what say you? >> i have a to agree with you and it's interesting that consumer confidence number that president trump tweeted about, one of the lines i caught my eye, there is a line that asks are jobs plentiful t jumped from 42% last month to almost 46% of americans say yeah, jobs are plentiful. i don't know that i saw the number that high. stuart: a huge jump. >> that is magnificent. 46% of people believe, not only if i'm secure in my job, if i need to i can walk out get another job. when they feel that way, they buy cars and suvs. when they feel that way they look for a house. this morning these mortgage applications on purchase side up 3% back-to-back weeks. i'm watching it closely. maybe it is because interest rates moving up but also maybe because people feel like i'm secure. i am financially secure right now. it has been an uneasy feeling for a decade in this country. you go into a voting booth do you give away that security because of scandals and headlines? stuart: the economy is booming. does it last? >> i got to believe it does. the kind of investments we're seeing in this, you know the federal reserve created 4 1/2 trillion dollars out of thin air. they were trying to create a virtuous cycle. my excitement, my enthusiasm leads me to spend, whoever does that, hires people, then they're enthusiastic they didn't have a job before. it is virtuous cycle. i think we're in the midst of an organic virtuous cycle. stuart: fed is likely to raise interest rates. a lot of people think it's a negative. i take it as a positive. they're raising rates in response to a very strong economy. how do you see it? >> i agree with you. it bothers me the notion, the main street, the photos of the mountains and clouds? stuart: sorry about that. >> i feel like it is unfortunate when main street starts to get more prosperity or see raises that wall street is in a big rush for the fed to raise rates or that's the way it works. i think chairman powell understand fed policy goes beyond the elites. i believe he is not going to hurt the economy. he is not going to hurt the market. he will raise rates. he will put an occasional speed bumps but i don't think he will wreck this. that did what i'm comfortable about. stuart: we have the retailers. we have walmart. jcpenney today. proctor & gamble before and they're not a retailer of course, but the fight with china will raise prices to the consumer. is that a big problem for you? >> i don't think it will be a big problem. you know tonight we'll explain how these tariffs work because when you get your receipt at the supermarket, there is no line that says tariffs, right? most people are not aware where the tariffs kick at. they will be shocked where it works, how it works. most every company vocal about tariffs look at the stock charts for the year. proctor & gamble is already down 8% this year. they cannot pass on price increases. you can't have it both ways. i'm not saying that tariffs don't add to cost to consumers but it is not going to derail what we got going on. stuart: you say the consumer is on a roll. does nike's performance reflect that because nike is down today, notwithstanding the kaepernick ad. what does nike tell you about the consumer? >> you know, nike's numbers were great. sometimes you have to look at a stock and put it in perspective. it was the number one performing stock in the dow this year. so a lot of anticipation they would beat. only beat the street by 6%. quarter before was 8%. the quarter before was 20%. you see it is trending lower. by the way, another thing, sort of a yellow flag, in north america, footwear sales only up 5%. they were up in europe 10%, china 22%, asia, latin america, 14%. that north american market, still the largest market not a major impact from the controversial ad, not kind of impact they want. north america is battleground with them and adidas. that is why the stock is under pressure. has no bearing on overall consumer. stuart: would charles payne look into cannabis stocks? >> i am looking heavily. i made people money in cannabis stocks. i am not in any. canopy got upbraid by benchmark. tilray, selling medicinal products in australia. a record can -- cannabis, gross margins expanding. the companies in this starting to be run like real businesses. that is what i like to z their conference call was professional. they know what wall street wants to see. they're focused on margins. bent from three production facilities to 11 in just one quarter. this is one of the smaller, but more organized names. tough keep an eye on it. not going away. i think more of a viable investment than cryptocurrencies. stuart: a lot of people want to get in on the ground floor. they see cannabis as multibillion-dollar industry just a little ways down the road but getting in on the ground floor you have to take a lot of risk. >> i have a private placement memorandum for a company not public yet, trying to raise a certain amount of money. i'm flipping through it. it is intriguing. stuart: wait a second. they come to you. want to go public. they're a cannabis company tell you -- >> they want me to invest in it. stuart: they do? >> of course. i don't know. it intriguing. ashley: i can't say on live tv. >> it has to be full disclosure. it is intriguing. think about the automobile industry when it first started. there were hundreds of car companies and eventually became the big three. almost every industry is like that. there will be some distinct winners when the dust settles here. i wanted to say when the smoke clears that was too much of an obvious pun. stuart: i want to tell our would you say he will be confirmed? can you say that to us now? >> well i cannot say he will be confirm. it comes down to a few senators at the moment, republican senators deciding which way they're going to vote. all eyes will be on the hearing tomorrow. and stuart, in fairness both sides need to be heard. that is the right thing to do. this needs to be handled professionally. the problem i have is this is moved into about power and politics versus about the truth and what the facts are. i commend chairman grassley in setting up an environment tomorrow that will be conducive to getting to the truth, getting to the facts. and for heaven's sakes that is what we're called upon been the constitution for united states senators to provide that consent and approval to the president's nominee. everything i have heard so far on judge kavanaugh tells me i'm voting yes. he would be an outstanding, outstanding supreme court justice. we'll all be watching tomorrow. stuart: yes, sir, we will. i do have to ask but the vote expected on friday on tax cuts, 2.0, that would make tax cuts permanent. however, it is likely to be a yes vote, that is for sure. would it pass the senate? it is not likely to get through the senate, is isn't. >> i sure wish iit would. only thing better than a temporary tax cut is a permanent tax cut. for heavens's sakes, look what is going on in the economy. viewers see it every day. permanence would be a wonderful thing. i support that. that shows you how important the next election is in 41 days. the other side, democrats want to raise taxes. we want to make tax cuts permanent. there is one of the choices for the american people. stuart: if it is put to the senate, the senate takes it up, would it pass the senate? >> we would need, we would need a 60 vote threshold right now on that. so most likely we would have to go through the reconciliation process, going into next year for permanence. the house would likely pass that but we would hit a 60-vote threshold on that. stuart: that is quite a roadblock. senator steve daines, montana. we appreciate it. >> thanks, stuart. stuart: breaking this morning, fox said it plans to sell its entire stake in sky to comcast. that is for about $15 billion. that will give comcast full control of sky. as we usually do at this time we'll check other markets for you. we'll start with bitcoin. still at the 6,000 mark. 6500, one bitcoin. how about gold? i don't think i have. >> stuart, good to be with you again. the truth is we are seeing this play out in slow motion because the president and ministration have been laddering up the announcement of these tariffs. at the moment i thank you are right that in many cases consumers have not felt the pain yet but on the other hand there are questions in our economy where there's a great deal of pain. last week we launched coalition called tariffs for the heartland and highlight the scores of people across the country been hurt by higher prices are jobs. it will play out over time and we get into next year and everything that comes in from china has a tariff on it than a certain consumers will feel pa pain. stuart: calls, the trying to hire 90,000 workers for the holiday but i understand a few retailers you want to hire people for the holiday and we have trouble finding workers because it's a tight labor market. in fact it so bad i thank you guys have to start - you are, i believe, offering benefits to people that work at kohl. is that true? >> in early august we updated our forecast and predicted we would see retail sales increas increase-percentage and maybe in the mid- fourth and we bump that up to four and a half, likely to be close to 5%. if not more and things continue the way they gone thus far and back in the tariff issue if this gets pushed into 2,019 or receive the escalation maybe or see deals get made between the us and our partners in canada and in europe that will take some of the pressure off and we could get a happy holiday seas season. stuart: when i go to - when i buy something, i use a credit card. some of my credit cards have perks attached. you build up mileage and allies and the judge is laughing with me because i'm kind of cheap but nonetheless i use these credit cards that have perks. i understand retailers are not happy about this because you guys get landed with the cost of the perks. in some of you are about to say were not taking that card because it's too costly for us, is that accurate? >> you touched on the whole issue of the relationship between the card issuers and the banks and the merchant partners. the interchange is the fees that the merchants pay whenever the cards are presented for payment for a product at one of the stores or online. a number of the cards that a been issued in last three years have higher rewards but higher interchange fees so these premium cards that come out in the last three years that you may carry a wallet as they say in some of those have much higher interchange fees. just in the last five years interchange speeds paid by retailers have increased by nearly 70%, up to close to $45 billion last year. it's big money and cost consumers money and cost merchants money and the subject that we debated is what level of fairness and balance between the actual services be provided and the price being paid. that's the topic of retailers and card issuing partners are discussing. stuart: matt shea, retail guy, squeeze by tariffs, squeezed by tight labor market, possibly squeezed by all the fees you have to pay because of the perks on credit card and yes, you are smiling but you will have to have a great christmas and holiday season, aren't you? >> we will try but i think the economy is poised for soliday holiday season. we had a great year thus far and we want to come up and see you in december. we can tell you in the studio and celebrate together. stuart: guarantee. we will do that. now this, microsoft - more disclosure, i do own a little of the stock but it's at a record high. microsoft could face a class-action lawsuit. it's accused of gender explanation. judge napolitano is here. accused of gender discrimination. what are the practice of alleging? >> three female plaintiffs claim a systematic institutional effort by microsoft to fail properly to evaluate the worth of female employees. microsoft denies it. they are willing to settle with them. but that is not the issue. the issue is they want to represent a class of all 8600 present and past female employees of microsoft and a federal judge in san francisco through it out. the announced last night they will appeal to the ninth circuit. stuart: are the other plaintiffs making a statistical argument which is - not enough women in higher levels of management or are they making an actual implication that you will not promote me because i'm a woman and happened in this instance? >> is a hybrid of both. because this is microsoft there is a computer program that managers apply to evaluate and these people have found an expert to say there is a gender bias built into the computer program. this federal judge spent 68 pages of singlespaced print, which i read for you this morning blowing at out of the water. i showed how it is not - this is a trial judge. it was not systematically biased against women. last night the lawyer for the women announced they would repeal it to the ninth circuit but that's where this case stands. did you know this before you ask the question?
