senior advisor may have exposed classified state passwords to her very hackable private yahoo account this as president trump said if navy sailor had to go to jail for taking pictures of his classified submarine so should a bedin, and christian is here with us to might to call out that double standard. we've got an all-star guest line up for you, economist ben stein on that big risk to your money, now sitting right there hiding in plain sight and retired lieutenant colonel on the explosive iran protest and how they are now blaming the u.s. for iran's riots politics, money we've got you covered welcome to risk & reward i'm elizabeth macdonald. we are on the dow closing in the green in its fir trading day of the new year the s & p 500 and nasdac clenching fresh record highs. could the markets rise continue under president trump's new year agenda. the work starts this week. the president is expected to meet with season at majority leader mitch mcconnell, house speaker paul ryan tomorrow at camp david and later in the week , democrats. this as utah senator orrin hatch is retiring, with reports that mitt romney could possibly make a run for his seat. we've got an infrastructure deal , a long term plan to fund the government, immigration reform, possibly more on obamacare reform all on the docket but first to fox business adam shapiro is at the white house with the very latest. adam? adam: and e-mac the plan is do it all before lunch right? so tomorrow let's start where we're headed you'll have this big meeting with the big four they call them mitch mcconnell, paul ryan, nancy pelosi and chuck schumer, they're going to meet with mark short from the administration as well as mick mulvaney as you pointed out talking about some of the primary issues for president trump and the agenda and of course the country, right at the top of that docket is how do you fund the u.s. government past the january 19 deadline. how do you raise spending caps appropriately and/or responsibly along on the domestic side along with the increase in defense spending. that's all what they're going to be talking about in addition to the other issues, so when sarah sanders was asked about this during the press briefing here is what she said. >> the budget is first and foremost one of the biggest priorities right now and certainly the big priority in the immediate term. the president wants a two-year budget deal that provides realistic budget caps and provides certainty for our national security that's our biggest and number one priority and that's the focus front and center of the conversations taking place this week. adam: now, of course the chatter ing class in washington d.c. is all abuzz about the announcement from senator orrin hatch that he is going to retire he has been serving in the senate since 1976 and one of the likely people to run for his seat from utah would be mitt romney. now, romney issued a statement in which he said "i join the people of utah in thanking my friend senator orrin hatch for his more than 40 years of service to our great state and nation." senator hatch has represented the interests of utah with distinction and honor, e-mac as i throw it back to you when you consider he has been in the senate since 1976 to put some reference on all of this the country was trying to go metric when orrin hatch first came to capitol hill, so that worked out so well didn't it but orrin hatch certainly did. liz: great point thank you adam happy new year to you sir thanks again. >> you too. liz: remember the protests when president trump won the election the protests still continued democrats socialistic bernie sanders now hoping for "the resistance to continue into the new year" tweeting"here is the new year's resolution. i hope you will share with me" in 2018 we will intensify not only the struggle against trump- ism but we will increase our efforts to spread to progressive vision to every corner of the land. let's bring in the author of the capitalists code he is economist ben stein good to see you ben. ben: honored to be here happy new year to you and everybody else. liz: same to you. all right tax cuts passed economic growth has doubled so far last two quarters versus what it was under obama. the democrats now doubling down to try to win back control of congress will that work? ben: i don't think it's going to work. if the economy is too strong i think trump personally has a great deal of magnitude left in him and bernie sanders is trying to rework the same old tired democrat line of class envy and class struggle. when he says that word about intensifying the class struggle or whatever phrase he used, that was just barking up the wrong tree for what america is like. now america is not angry, is not as angry as his friends are. most americans pretty happy right nowment liz: okay tis the season for predictions for 2018, okay ben here is the big reveal on the risk to people's money. it's about the stock market bull run. it is a stunning number of media punt its with their parade of wrong predictions of economic collapse in 2017 because trump won. it's about basically what they said and what you should follow when it came to their advice but if you follow these guys and what they told you, and there's a lot of names they're about to tell you who they are you would have missed out on a 35% run up on the dow one of the greatest bull runs in history, a 6 trillion wealth created for americans. the predictions came, the economic collapse so washington post said it politico said it, msnbc anchors too many to name, cnn analysts, citigroup economists, the new york times, mit economist, larry summers, steve ratner, mitt romney and nancy pelosi. your thoughts here? ben: impossible to predict the stock market either up or down. best thing by the index, just hold on for dear life. i personally think the market is a bit high but don't worry about what i say. i'm very often wrong, but the market is not wrong, show stay with the index that's going to keep going with them. it does seem as if the market doesn't have that much room to grow but that's what people often say. markets climb on walls of worry and this is a typical situation for that. what my worry is is inflation. this economy has become so strong, mr. trump was right. we're going to get tired of winning and we keep winning at this rate we're going to have inflation and we do not want inflation, so but i think the economy has been a miracle success story. don't put your trust in pundits but not your trust in prediction s about the stock market by the index hold on to it. liz: you know ben, a lot of companies taking big hits, they're getting hurt on the bottom line from the tax reform bill, that includes big oil, bp announcing it's taking a $1.5 billion tax hit because of the tax reform bill and shell oil is taking a $2 billion hit to the bottom line this as democrats said big oil controls the republican party let's take a listen. we must ask ourselves, who will stand up to president trump? it won't be his cabinet of big oil, big banks, and billionaires >> letting big oil and hedge funds make their own rules. i decided i could not empower big oil to overcome the successes in this bill. >> they would give billions of taxpayer dollars to big oil companies that are already successful. liz: what do you think of those comments in light of the big tax hits that these big oil companies are taking, ben? ben: well, the big tax hits are basically about one thing and one thing only which is the return of money these companies have stashed overseas and bringing them back to the u.s.. there's a one-time charge on that and that's basically what the problem is for goldman sachs or the oil companies. it's a blip for the companies as rich as the u.s. companies and i think we're going to see this tiny little blip, a mean a billion is a lot to you and me, at least to me but not to the big giant companies and then it's going to grow grow grow cutting the corporate tax rate is one of the greatest achievements of any president economically since the end of the great depression and we should be grateful of mr. trump for staying with it, but as to trusting your money with predictions from nancy pelosi, predictions from paul krugman, whose a very intelligent guy by the way, very intelligent i wouldn't trust my money with those people i trust to reality and reality says we have a very strong economy. liz: you know, the deductions for tax losses the deferred tax assets is also slamming a lot of the companies and it includes shops like goldman sachs and citigroup, we know all about the private equity crowd and hedge fund crowd sit getting still getting that lower tax rate roundly criticized by a lot of people but what do you make of basically these companies also saying our bottom line again is going to take a hit because the deferred tax assets we can't take those tax losses as much as we could in years past. here is democrats weighing in on big banks, let's take a listen. >> running trump's white house, for example, trump was quick to name goldman sachs alums to his administration, making steve bannon his chief strategist, nominating steve mnuchin for treasury secretary, and he also appointed gary cohen of goldman sachs lifer. >> creating an administration that looks like goldman sachs. liz: what do you think, ben? ben: well, goldman sachs has an awfully smart people. i'm probably not the right person to ask about this because i've criticized them very severe ly over a many number of years but i don't see anything wrong with getting the smartest possible people to work in your administration whether they have goldman sachs on their resume or not. i want smart people. i don't care where they come from. i don't care where they come from the projects or they come from park avenue. if they're smart, hard working capable well informed and are patriots above all i want them to be working for us and by the way, i have nothing against corporations making lots of money. that goes into people's retirement accounts and college endowments, hospital endowments. that money does not come from buying yachts for people to have wild parties on and bringing out party girls and dancers and strippers and so forth. it goes to pay for people's educations and retirement. there's nothing wrong with having a rise in the stock market and nothing wrong with people that can produce a rising stock market. liz: ben we love having you on great to see you sir. >> it's an honor to be here and again happy new year. liz: happy new year to you too. let's take a look at the market 's biggest winners and losers. the big winner amazon stock rose by about 58%, aerospace and defense company boeing its stock rose by about 89%, stocks in home builders like kb homes doubled so did dr horton doubled as well. let's look at the losers of last year include energy companies like baker hughs, that stock dropped 51%, and ge dropped 45%, the dow closing in the green in the first trading session of the new year, the transports nasdac the russel 2000 also on fire today. nicole petallides is on the floor with the latest. nicole? nicole: liz pretty unbelievable. the first trading day of the year and we're already seeing new records the s & p 500 and the nasdac both gained new record closes and the dow which is 14 points away the dow was led by disney, general eelectric , chevron of course disney did so well with star wars the last jedi which was the top grossing film of 2017. amazon target is there a deal in the works so gene munster saying one of his eight predictions for tech was that amazon will buy target in 2018 saying that the combination is easy and will likely get regulatory approval. the other possible deal that was speculated upon was apple and netflix this came from citigroup saying that once apple brings in all those billions of dollars repatriation well they think that there's a 40% chance that apple could buy netflix, and with all that money, we could likely see the move happen. 40% chance on that one. all of the stocks i mentioned all finished to the upside. liz? liz: thanks nicole great to see you now e-mails emerging showing former hillary clinton senior advisor uma abiden may have exposed classified state passwords to her very hackable private yahoo e-mail account. president trump saying navy sailor had to go to prison for taking pictures of his classified submarine. so should huma abiden. christian is here with us tonight to call out that double standard but first, nearly two dozen people dead, 450 under arrest in iran's bloody week of protest and guess what? now they're blaming the united states. my next guest says it's more proof the obama administration should never have made that deal with these known state sponsors of terror and human rights abusers. he's retired air force assistant vice chief of staff retired lieutenant tom m speaking out after this. stay with us. >> international inspectors will have unprecedented access if i ran cheats, the world will know it. if we see something suspicious we will inspect it. if i ran violates the deal sanctions can be snapped back into place. >> they never should have made that deal it's the worst one ever made by the united states government, liz, and it's now becoming even more evident of all the money, 150 billion plus, plus 1.5 billion in cash that we provided them that most of it has been going to terrorism throughout the region and that's why the iranian revolutionary guard corpse spread to lebanon, syria, iraq and yemen. liz: they're now blaming the united states but isn't it true that iran only has itself to blame? it's practically in a depression right general? >> exactly. if they've got almost 60% unemployment in certain areas you can imagine any country that had that kind of unemployment would have major problems and yet they're spending all this money on icbm's, nuclear development giving it to north korea to develop their nuclear weapons so no wonder the iranian people are rising up. liz: remember when president obama touted the iran deal. let's roll tape. >> do you really think this verifiable deal if fully implemented backed by the world 's major powers is a worse option than the risk of another war in the middle east? liz: obama is saying the deal with iran works and staying silent on protests works, the obama administration effectively stays silent. what works the president trump is now saying no deals with iran , tightened sanctions possibly, and he's saying i will not stay silent on what is going on with iran protests. what do you think will work? >> i think what president trump is saying, hooray for president trump this is a once in a lifetime opportunity and the people are allies in the middle east see this liz and they want to take advantage of it and we're very fortunate to have president trump. it's like when obama said if you like your doctor you can keep your doctor. well that's the same thing with that iranian nuclear deal. it's a disaster. trump is doing the right things and our allies are going to help over there and we should do as much as we can covertly to ensure that this revolution is successful and we get rid of them. liz: switching gears president trump slamming pakistan for not doing enough control islamic militants tweeting out "the united states has foolishly given pakistan more than $33 billion in aid over the last 15 years. they've given us nothing but lie s and deceit, thinking of our leaders as fools. they've given safe haven to the terrorists we hunt in afghanistan with little help, no more." general, afghanistan officials are applauding what the president tweeted out. who is right here? >> i think president trump is spot on again, and if the south korea gets lulled into this and think talks will help them all that does is give the north koreas more time. president trump is right. we need drastic drastic economic measures and we need to be building up our military force at such a mighty force that they know we will strike unless they change. liz: general tom mcinerney good to see you sir, thank you so much and happy new year. >> happy new year to you liz. liz: a new report says amazon has big plans for ads coming through its echo devices into your home. the amazon e-tailer has been in talks with several companies about letting them promote products on the best selling a lex a device including proctor and gamble and clorox take a check of amazon stock closing the day in the green. next up another campaign promise , this time on oil pipelines, watch. >> we're going to aprove energy infrastructure projects like the keystone pipelines. >> he rejected the keystone xl pipeline despite the fact that would have created 42000 jobs. >> aprove vital energy infrastructure projects like the keystone pipeline. a lot of jobs, a lot of good things. liz: a new report shows that the north dakota pipeline looks like it's already paying off the conservative millennial is going to break it down after this stay with us. yea, so, mom's got this cold #stuffynose #nosleep i got it... #mouthbreather yep, we've got a mouth breather. well just put on a breathe right strip and... pow! it instantly opens your nose up to 38% more than cold medicine alone so you can breathe... ...and sleep. go to breatheright.com today to request a free sample. >> i have opposed frack, gas, pipeline. like the keystone pipelines, and other pipelines throughout this country. >> keystone pipeline is not in the national interest of theu u.s. >> state department has decided that the keystone excel pipeline would not serve the national interest of the united states i agree with that decision. liz: democrats railed against and protested against keystone pipeline, throughout obama's administration. despite fact more than 25,000 miles of crude oil pipeline were added for 76,000 miles, criss-crossing united states now a newer respect said that da colta access -- the dakota access pipeline is paying off, cutting energy transportation cost and pollution. it is no surprise that energy production has surged since the dakota pipeline opened. growing by 78,000 barrels a day. north dakota peaked from duck there 1.2 barrels a day that month. we're talking 135,000 barrels more than it produced daily before that pipeline was operational, compared with january 2017, north dakota has an additional 15 drilling rigs in operation. joining me now, of course, conservative millennial, ali, great to see you, there is concern over pollution and pipeline oil spills, your reaction? >> yeah. of course,. this issue involves two main issues that conservative millennials like myself care about, that is the economy. like you said the environment. as it turns out it has been a win in both regards, economically you listed the stats, president trump kept a promise to working class americans by creates jobs, that is what it has done. the numbers don't lie, oil product is up, so unemployment is down. i think state revenue is up by 43.5 million just in first 5 months of production. it is also a impacted the environment, but in a positive way. so oil transportation is down so -- oil train transportation is down, it is good for the environment and public safety, majority of oil leaks come from the railways rather than the pipelines. if democrats were not so controlled by antijob environmentalists they would enjoy it too. liz: more than 850 existing wells are looking for fracking crews, state revenue rose 43.5 million in first 5 months, but remember, ali beth when president obama questioned how donald trump would bring jobs back to the u.s. >> when somebody says, like the person you just mentioned, i'm going to advertise for, that he is going to bin bring these jobs back, how are you going to do that? what are you going to do? >> no answer. he said, i'm going to negotiate a better deal, how are you going to negotiate that, what magic wand do you have. liz: what does president trump yet get that president obama did you not. >> it is not a magic wand bringing jobs back to united states is not that hard, he is doing it in a variety of ways not just allowing production of pipeline, but putting economic pressure on foreign imports. fuel for example, putting tariff pressure on them to make sure we have more product in the u.s., not some magic wand, it is basic economics 101, unfortunately president obama never got that, i love the under estimation that president obama and so many people on did demonstrate, thankfully he has met and surpassed so many of our expectations for those who voted for him. liz: u.s. steel makers, raising their bets on energy and construct, pulling in more peall product, do you worry about the epa cutbacks? we dean have enough watch dogs to oversee pollution? >> no, i don't think so, i think it will is in self interest of the companies to also prevent pollution, i think this a blood beautiful thing about free market. >> all right, ali, great to see you. >> thank you. liz: with new year california now is a state, as prank signs have been popping up, saying, welcome felons, illegal immigrants and ms-13 to california. people in california for first time can enjoy legal recreational marijuana. a cnn reporter, ran with the idea during the network's new year's eve coverage. a creation to the story next. they appear out of nowhere. my secret visitors. hallucinations and delusions. the unknown parts of living with parkinson's. what plots they unfold, but only in my mind. over 50% of people with parkinson's will experience hallucinations or delusions during the course of their disease. if your loved one is experiencing these symptoms, talk to your parkinson's specialist. there are treatment options that can help. my visitors should be the ones i want to see. liz: big changes in new year another sanctuary state, california with 2.3 million americans now a sanctuary state, it has prank signs popping up all over the place. striking accord, your reaction to that? >> thank you, liz. this policy is in direct violation of federal law, trump administration can and should respond. it is sad that these signs are a joke, but their message is accurate. that if you are an illegal alien who has committed a crime, if you are a member of a gang who has committed rape, serious crimes, rapes, murders, then you are welcome here. that is the reason why these pictures are resonating and all over social media, this is sad but the sanctuary policies that california adopted for the state, are what lead to death of kate steinle. liz: we're tracking a story, juxtapose that with this, report coming in half dozen dead bodies found hanging from bridges around california state -- baja california sur. reading this is what will happen to anyone who does not fall into line with us. it has been made more clear that we hold all power and baja north and south are ours, this is a gruesome display, under scores drug and gang problem just south of the border. >> this is serious, i had an opportunity it visit u.s.-mexico border in california. you realize how serious of job that border patrol agencies have and they are putting their lives on line to defend our border. people might think it is altruistic thing to support the sanctuary policy. but reality is criminal organizations that are smuggling drugs and illegal immigrants across border did not care about the well being of those illegal immigrants they care about lining their pockets with money to go back to mexico and continue running their gangs and committing the horrific crimes that you just described. liz: kelsey, another story. in california, people there for first time can now enjoy legal recreational marijuana. new law, at midnight new year's eve, legalize drug expected to be a 3.7 billion business in california, possibly bringing in a billion in tact revenues annualy. >> once again, california is in direct violation of the federal law, marijuana is still federally illegal, it will be interesting to see whether or not the trump administration responds to this. but, we have scenics percent. in colorado -- experiment in colorado when lappe lap happened there, it might be okay for adults to do what they want in their own free time. but in california, more kids and teen are using marijuana there is a 32% increase in teenagers who were expelled and suss sphenned frosuspendedfrom schooa use. and the number of fatalities for persons driving who tested positive for marijuana doubled. this is serious. we need to look at repercussions of legalizing marijuana in a state like california so broadly before enacting the policies. liz: cnn getting criticize, celebrating new year's eve, cutting one ofs had reporters on the kana-bus in denver, colorado, seen wearing pot leaf earrings. >> i saw this clip from cnn, i was pretty much stunned. on new year's eve there are millions of children tunes in to watch the ball drop, cnn puts on a com commercial mr. marijuana r marijuana with with a gas mask with a bong attached, for any kid watching marijuana is not a cool thing to do, particularly in your teenage years, harvard studies have ploa proven a link between your brain development being impaired if you use marijuana at that age. liz: jack in the box, selleh seg merry munchy meals. with greasy snacks. >> we're now encouraging people to use weed go out the their favorite fast-food restaurant and eat greasy food all day, not stheusure if this is message of california wants to send to his citizens, i have seen some call for protest again bojangles we'll let free market decide. liz: thank you so much. heap new year. liz: let's bet to story, new e-mails emerging showing uma abedin may have exposed classified state password in her hackable private yahoo! e-mail account. with us tonight calling out double standards don't go away. liz: welcome back, a new report accuses former hillary clinton aide, uma abedin of neglecting security protocol. a few years lateiar later yahoos hacked, talking billions of user hacked. president trump responding saying, crooked hillary clinton top aide accused of disregarding basic protocol. she put classified passwords into hands of foreign agents, remember picture of sailor on a submarine, jail. some of the act. with me now the sailor, christian, who was in prison for a year for taking photos inside of a sub. sub. >> thank you, liz. liz: you admit it was wrong. >> i accept the responsibility, i never within to trial, i didn't do what hillary clinton did, and say, i didn't do it, then when confronted with empirical data say, i did it, but get over it. i accepted my responsibility. liz: what is your concern with hillary clinton and the abedin e-mails? >> i think president trump spot on with it, calling out a krupp department of just -- corrupt department of justice and fbi under comey, who isrupt corruptd mccabe, with peter strzok's text, clear they were chomping at the bit before they interviewed them, these are very same people at same time, destroyed my life. they turned me to a felon, destroyed my career, over 6 pictures, i took most military members take pictures of their time in service. you know they were classified as confidential, lowest tier, and has come out that hillary clinton and huma abedin were transmitting data that was top-secret fbi. liz: do you think they should be in prison. >> absolutely, at least go through the justice system that i went through, if they went in front of same judge as i did maybe not because he was appointed by bill clinton. if they went in front of a federal judge and use that argument they don't know better, that argument would not fly, the statute i wases from cued -- prosecuted under does not need criminal intent. liz: hillary clinton charged with gross negligence. james comey made a thing about intent, even though it did you not exist in the law, in exonerating hillary clinton, you were accused of showing intent when you destroyed your smartphone devices, do you see the double standard here? >> let's be clear. the crime was unlawful retention of national defense information they charged me with obstructtion of justice, they later jobbe dropped. charge initial charge that i pled guilty to, is unlawful retention of national defense information which is about what hillary clinton did, it means you took classified information from a secure device or area and put it on a unsecure device which is what i did. her transmitting e-mails with the yahoo! servey is the same crime. there is no requirement for intent, no require ament for ben vehiclobstructtion, which she d. liz: and accused of smashing her devices, christian, tell us about life after prison. i know you z a young child, a toddler, how has it been for you in getting a new job?
