joining us, tgif, it is friday december 15th, top stories right now 6:00 a.m. on the east coast. the race to finish the tax reform. senator marco rubio says he's a no in the 11th hour. pushes for last-minute changes to the bill, he'll not alone, the latest as law lawmakers prepare to unveil plan today. president trump with efforts to roll back regulation. >> regulation is a stealth taxation. like opening the wall street journal and looking in the op-ed, section which is the first section that i read and who has an op-ned the journal today? maria bartiromo. there you go. dow 24,000. maria: i was so honored to be op-ed. >> first of many, maria bartiromo. maria: thank you so much. you guys heard my rant over and over again that's in the op-ed, that's the regulatory environment is so important in terms of rolling back the regulations in terms of moving the need until economic growth. so it's really how we got to dow 24,000. >> now we need tax reform to move it higher. hoping we are going to get that before christmas. maria: we talk about marco rubio this morning. dagen: i'm going to -- >> little marco. dagen: i'm not going call the man names but i'm appalled by the maneuver. i'm appalled and we can get into it in the next segment. maria: $650 billion is already being spent on the family tax credit, he wants more on the family credit and we are going to talk about that this morning. we have a lot, former microsoft ceo usa fax founder, philadelphia federal reserve charles is here, ceo of overstock.com patrick, plus dr. mike and house ways means committee member south dakota congresswoman kristi noem is with us. let's kick it off with that, senator marco rubio threatening to vote against tax plan, he's a no unless the child tax credit is expanded. president trump suspects the florida senator will come around after all, watch. >> i would outline the need to increase refundable child tax credit unless they can figure a way to add to 1100 figure, i won't support the bill. >> i think we would be there. he's a great guy and supportive. i think that senator rubbery will be there and we are doing very well on the tax front. maria: with narrow 52-48, republicans can only afford to lose three members to pass a tax bill along party lines we have been talking about this all year, here we are in the 11th hour, these guys think they've got a deal that they are going to bring to the president's desk next week and here you have marco rubio, dagen. dagen: fox learned that the text to the final version of the tax bill is now closed. the conferencees will be signing report tomorrow, once they sign it, no more changes that can be made to it, everything is locked in, when asked about the child tax credit, fox was told the bill moved in marco rubio's direction, so what marco rubio wanted -- by the way, this was proposed in an omit to the bill before the whole senate voted on it by marco rubio and mike lee and that attempt failed, failed 29-71. they had hats handed to them, they sneak this in at last minute. so the child tax credit is $2,000 per child and $1,100 of it is refundable. marco rubio wants to increase the amount that's refundable. refundable means taxpayers get money back even if they don't pay income taxes. so he wants -- maria: that's called welfare. i think the last time i checked it was called welfare. dagen: we have to wait to see what's in the final bill that would be voted on by the house and senate. he wanted refundable against the payroll tax not against income taxes but the payroll tax. let me remind people, the payroll tax goes to fund and benefit for the individual, goes to pay for your social security and your medicare, so when you're asking somebody else to fund that for you, that is welfare. >> it is welfare, look, let's be honest, this bill is a corporate tax cut with a mess of an individual side attached to it but it's still better than what we have right now. to take the rates 35 to 21 to improve incentives with the state and local tax deduction which is going to make states rethink the high tax rates and if you get rid of individual mandate and gives people choice, these are all very good things, so the idea that marco rubio would grand stand like this on a measure that you're right is welfare but also reduces the growth potential of this bill and takes the opportunity away to cut taxes for everybody else because you couldn't use that money to cut the marginal tax rates, get more growth, get more prosperity. dagen: this does nothing. the child tax credit does nothing to juice broad economic growth and help create jobs in the country. maria: winners and losers. dagen: marco rubio to be clear, the tax credit is two grand, double the current amount in the senate bill, he wants to increase the amount that's refundable above $1,100 and change the income level so more low-income families qualify for the whole credit. one thing that they could do and we haven't seen what this final mess is is that lower right now households making $500,000, they could lower that amount which has been one of your issues. maria: i wrote this in op-ed this morning, this morning in wall street journal, dow 24,000 and the trump boom and i'm taking a look back at the economic progress of the first year of the trump administration. we pull up one quote because -- after reaching dow 24,000 where markets and economy can go here, i'm not going to make predictions, the economy is better off when federal policy does not discourage people that have demonstrated ability to earn, work and invest. blocking the so-called conventional wisdom. here is what i predicted on election night of 2016. >> this ultimately will be a huge buying opportunity because when you look at both candidates economic plans, on the trump he wants to lower back regulation, regulation that is been the one barrier for small business and large business by the way in terms of growth. economic growth is the priority, that's what this country needs right now. that's what would be positive for the markets and ultimately people will view this major selloff tomorrow as a huge buying opportunity because of his policies. he's really focused on rolling back the regulations, that's going to be hugely positive. i think it's going to lead to economic growth, that will help the stock market. we see decline in the market today i am buying with both hands, i'm just saying. buying markets with both hands is what investors have been doing ever since. the reason i mentioned that one graph about let's make sure to not forget the people who have demonstrated the ability to work, invest and spend is because what's happening on the individual side, we are talking about tax credit that marco rubio is pushing for and when you look at those people who are working, who are losing all of their deductions and i'm for it, don't get me wrong, but there's such unwillingness to cut taxes for high end, the people who spend, the people who invest, i don't know, the jury is out if that's going to work, mary. >> look, i think that's important to understand why marco rubio is doing this. there's a movement within the conservative sphere called the reform con movement. republicans cannot run on conservative policies and win. we have to adopt democratic policies like welfare and give people money just like democrats do and marco rubio was captured by the guys, american enterprise institute ald elsewhere, okay, we have to give handout ifs we are going to get tax reform done. dagen: just to avoid you catching tsunami online, when you are asking somebody to fund a benefit for you, whether it's help fund your payroll taxes, give you more money that you never paid to the system because you choose to have children that's welfare. kevin: this has been the least volatile year in stock market because rules and regulations are being backtrack and everybody on election night was saying it's going to be armageddon, corporations opened up pocketbook and started spending, hiring, look at the job's numbers. he's doing a tremendous job. 75,000 pages that hampers investment. 25% of the world's economy and you hit the nail of the head with the op-ed. maria: let's show the shot of the president, i thought it was hilarious. i was so happy that they were running the op-id today right after this. it was so funny. that's what we are talking about. that's what we are dealing with today and as i've said many times, this the equivlance of 80 king bible. kevin: do you think small businesses can compete in markets like that? no. dagen: we have to point out what retail sales did yesterday, online sales brick and mortar stores even restaurants up 8 tenths of a percent. 5.8% growth from a year earlier. that's the fastest pace since 2011. maria: that's good. >> so much for secular stagnation and the new normal of 2% growth, guess what, two quarters of 3% growth. maria: look, this economy has responded and it's not in place yet. it's an anticipation. >> get out of the way, marco. maria: if marco rubio stops tax reform from happening, i don't know what he's expecting the reaction. dagen: maria: incredible. kevin: netflix took 40% to have bandwidth. the cost of verizon. lauren: as long as there's competition for consumers, maybe prices aren't going to go up as much as people fear if they go up at all. >> maybe increase investment. dagen: increase investment. >> people hear price discrimination, discrimination is bad, you know what, i don't pay $10 for 100 bottle of wine, i discriminate because there's a difference in quality. companies do it to and it's how markets work. dagen: this was a power grab by a government agency. so if the democrats think that this is just magic for every american, then step up and pass something in congress. maria: by the way, a lot of power grabs. a list of all the regulations and executive orders that president trump rolled back and every once in a while i will throw out another one. the stream buffer rule, would have saddled minds one necessary regulations putting up to 64 of americans putting coal off limits, the bureau of land management venting and flaring rules that was rule 36, anyway. we have the list here whether he recollects go through the list throughout the show. lauren: she's fired up. maria: lauren, thank you. great analysis. by the way, incredible week here in mornings with maria. here are a couple of top moments of the program in case you missed it. >> disney and 21st century fox making it official. why now? >> the debt is a priority for me right now. economy has taken off and i think it's going to take off like a rocket once he signs this legislation and i think we can grow our way out of this problem. >> president trump has been with us every step of the way and saying we need tax relief for middle-class families and we are going to do that. we will deliver -- president trump is going to deliver on yet another promise and he's delivered on many. >> bottom line, every income bracket will receive tax relief, significant tax relief specially target today low and middle-income families. maria: bannon must go and go now. >> to me looks like a drunken off the street. i'm not trying to be sarcastic. maria: right. >> racial division, i think it's backfired in alabama. maria: crypto currency started trading futures last night. >> first futures contract in the world. dollar being backed by the u.s. government, a lot of people would cynically say that's injecting counterparty risks as long as network of people continue to believe in it the same way believe in the united states as a country or gold as a commodity, bitcoin will have value. >> my teenage son three years told me i should buy bitcoin, i should have listened to him. maria: i should have. >> that's the sure sign that the bubble is reaching its final phase. the outside, the new comers pile in and they are the ones that are going to get stung. maria: what was the toughest thing that you faced trying to get people to understand what you were doing and to get your mop out? tax. >> a comprehensive database, to hold government accountable by the numbers. what we are trying to do is show by data what happened to story, and >> let's go through the slides because you do a real specific detailed job in terms of telling us who pays what and who gets impacted. >> let me give you a framework that might be helpful. the least affluent 20%, the third 20, the fourth, the people on the bottom 40% pay taxes but the bulk of what they pays payroll taxes. from an income tax perspective they are getting more credit today so they are not a net payer of income tax unaffected by this tax plan. people who are in the middle 20 or middle 20 or one up are getting tax breaks, something from a rate perspective, 6 to 10%, in the most affluent, a 3% or 4% rate reduction. it is a middle-class tax break but also has a tax break perspective for the most affluent people, who had changg standards of living. and $60,000 a year. as of the last eight for which the government data was available, why it is so slow to do its reporting. and 30 to 60,000 in 2015, came out. that is $850 per year average income tax. a break is a few hundred dollars in the middle, to the top 1%, income tax over $400, and a much bigger amount of money even if it is a smaller rate reduction. will middle-class families be better off? yes. appreciably, and not so much. >> looking at new york and california, illinois, connecticut, new jersey, a lot of people use that deduction, that taxes will go up. >> the rest of the country is subsidizing states that have high state and local taxes. i am not going to argue with her that is good or bad but it biases where people live and how they flow and in a sense, a lot in this tax plan eliminates what i would call incentives for behavior locked in the tax plan. sometimes complex tax plans, the simplification takes away those things. maria: they will have to take entitlements. i know on that debt down, growth is the priority. >> it is great for growth to be a priority and certainly i would expect looking at data from the past, that we should expect to see rapid increase by businesses in the long-term. capital and r&d should fuel growth. on the other hand, as a big proponent my wife and i are in a philanthropic activity to make sure we have a chance at the american dream for even the least affluent kids in america. i would hate to see any support for those kids go out with the bathwater in terms of budget cuts. people can look at entitlements, but we should keep things that are essential for the chance for opportunity for kids because they couldn't control where they were born or who their parents were. maria: you have capital gains taxes paid versus the s&p 500, make that connection. >> the important thing to say is since the time of the last corporate tax change, the biggest dangers if you will have been people who own stocks. wages and salaries have gone up but capital gains have risen much faster than wages and salaries. the benefits have accrued to people who own stocks and with the corporate tax cut being proposed here it is not about the corporations but their shareholders and there will be a return to people who own shares, that tends to be the more affluent people in our society. we see at already, the market seems to have pinned up on anticipation of this corporate tax change which makes equities more valuable. we hope that flows through to wages and earners but pretty sure we can expect to see positive returns to people who are fortunate enough on shares. maria: when you look at the corporate plan coming down to 20%, the pass-through rate getting a big reduction, and companies have more on hand to invest and grow profits. >> i hope shareholders do well but if trade-off shareholders do well and that is having a bigger deficit, as a shareholder myself, i am not generalizeable but dangerous to think that is a simple trade-off. maria: my thanks to steve palmer. check out usafax for more favorite movie characters? >> the biggest media story of 2017, it is a big win for fans because finally the avengers will be reunited with x men. biggest franchises in movie history between the x men, and trading in the market. and they need to get out of that business. when we see the fed balance sheet and look to get unwind as can that's can be a problem because when the fed starts telling that. it will create a market discussion. they want to do it in a predictable way. i would like to see them do it a little faster. the consequences of all of the excess reserves. it leads to unconventional outcomes. would like for them to be shrinking the balance sheet a little faster than they are. when i talk to people about how great things feel and they do feel good. they just raised for the third time this week. were seen a better backdrop. recoveries are usually seven to eight years. and were in our ninth year. i think it's a mistake to think about recoveries. i think that's not the right way to think about it. we had been lucky and nothing bad has happened. it has been a good recovery. has been a little slower than historical but i think things seem to be picking up. you've talked about it. no were stuck in low growth. there's a chance that's not true. the question is having the right policies that ensure that we don't get stuck in that low productivity growth. 90 of some now you have some analysts out there predicting 4% global growth. what are you worried about right now. and worried about trade. i think we need world trade. i'm a little nervous about where that's going. trade it worries me a little bit the efforts to roll back regulations and restore the market. it's a little too early to pass judgment on at this point. what is your thought in terms of how that is the priority that is what this country needs right now that is what will be positive for the markets, and i think ultimately, people will view this major sell-off tomorrow, as a huge applying opportunity, because of his part time he is focused on rolling back the regulation that is going to be hugely positive i think going to lead to economic growth this is a going to help stock market if credit as well, i think the discussion that marco was having, yesterday, had to do with refundability portion i think we can accommodate it costs money doing this tax reform package, and a reconciliation bill you have to make sure that all the numbers work so that was the challenge that we faced the last minute. >> in doing all this you got to choose winners and losers in this isn't that the bottom line here? okay. so you expanded the child tax credit already, you are spending upwards 600 billion dollars on that portion of this 1 1/2 trillion-dollar plan, then you've got the people in high tax states, who are losing salt deduction all people losing all business deductions, coming to realization their taxes are going higher how come that is more important than answering a peter king in o new york, that he wants more movement on these state and local tax deductions? >> i am going to disagree with you a little bit there, all of the discussion that we've had in negotiations and putting bills together was how we can get low and middle income folks more relief they can keep more dollars in pockets, to take care of their families. many by this refundability portion brings leefl to more lower and middle income family salt deduction we keep salt deduction in place up to 10,000 dollars, eligibility property income taxes whatever local taxes may be we made adjustments that will bring high tax states relief i really think that this bill addresses concerns that we have had in this country gives long term tax policy, so that we can bring companies, and jobs back do this country. and strengthens our future meeting needs of families that today don't have 400 dollars in the bank for an emergency situation, almost half people in this country cannot handle an emergency, if i have the costs 400 dollars that has to change stall what this is going to bring relief for them more dollars in pocket higher wages. maria: certainly what we want to see how do you push ban on criticism if you expand this you are talking welfare this is welfare. >> i think that is one of the debates that we've had we've had it extensively i am gratefully expanding child tax credit refundability also a debatable we are coming back in new year make sure we have integrity in poverty program speaker ryan focused on i am focused on make sure our poverty programs lift people out of poverty, so we don't have programs that keep people there that it can be abused we certainly do not want to have fraud, in taxpayer dollars you've got people work hard every day pay taxes, and you don't want somebody getting those benefits, disingenuously, that is the conversation that we are still continuing to have. >> let me ask i walk through numbers for you everybody wants to have an understanding that you have the votes we know that senator john mccain is sick in the hospital right now. we know that you've got this pushback, from marco rubio do you feel that you have the votes for example do you need john mccain to vote yes on this. >> i think we will have the votes we are certainly praying for senator mccain i know his health is in a very serious situation, and so we have been lifting him up -- as well i believe that marco will end up voting for this bill i think senators recognize this is a huge fix to our tax code, what a benefit this is going to be for america not just strength our families but strengthen our futures, that i believe when they recognize that read through bill after we sign the conference report they will get onboard. >> so you think you get the votes you will post it today, and be able to vote next week? >> you know, obviously nothing no bill is perfect, but we think that this is huge victories in it for american people. >> the
