Whats your gut reaction. Everybody thought he would get two game suspended . No way, its all four games suspended. The nfl got it right. The nfl told tom brady, no matter how big you are, what name you have, no matter what superstar status you have, you are not bigger than the shield. Yes, he did compromise the integrity of the game. When you do not cooperate with the nfl, its like not cooperating with the feds, almost. If you lie to them, if you dont cooperate to them, they will come down hard you on, and they did that today. And with him destroying potentially some evidence in this case that let them know right there, they werent going to put up with it and showed him today by upholding the suspension. Liz erik, to you, you have faced off against tom brady in a game or two in your career. What was your thought . My thought was i was happy with it. Roger goodell stood by his guns. Initially, i thought it would be reduced to a twogame suspension, that was before me knowing about tom brady destroying his phone. Thats admitting you are guilty. If you destroy the evidence thats needed to make a correct judgment, you pretty much say you did it. I wish Roger Goodell will be this strong and uphold decisions in more cases like, this like the greg hardy case. Liz people are saying, well, he always destroys his cell phones, but thats what celebrities do, really . Look, ive changed my phone several times in the course. Im not a celebrity whatsoever. Liz yeah, you are. I cant think of any time ive gotten rid of a phone, and ive had things that could be damning evidence of things that have been on my cell phone that i didnt even think about destroying. So for tom brady to come out and its a great excuse and im sure hes going to use this in the court if he takes it to the next level, which everybody says he is, how many times have you, liz, erik, gotten rid of cell phones and fought to destroy the cell phone. You can change the number but to destroy the cell phone right before an investigation like that, its a little fishy. Liz bad form, right, erik . Yeah, very bad form. Especially since it was destroyed right before his interview with the nfl. Very convenient. Liz well, look, now as we go forward here, heres whats interesting. One million fine against the patriots upheld. They lose the draft pick. Mike, how crazy is that going to be, or does it really make a dent for an organization that has done very well and won many super bowls . Yeah, thats the drop in the bucket. Thats the quarter lost between the cushions for the Patriots Organization as far as the fine is concerned. Draft pick, they always have a really good draft anyway, they always draft 25 or below in the first round. It wouldnt have hurt them at all. Tom brady missing the first four games of the season possibly, that could hurt the team. They got a really good backup in jimmy garoppolo, but you dont want to go into the season with a backup quarterback no matter how he fills in for tom brady. Tom brady is an elite quarterback. Longer this goes on, lets say tom brady goes the course and gets to play at beginning of the season. What if he goes to court and the court rules theyre going to uphold the suspension because the evidence is against him and he misses critical games in the middle of the season and you have to bring in a guy like garoppolo. These are things that the patriots and brady and the organization have to think about. Liz lets bring it back to the beginning and the deflategate, where the balls truly were deflated before a game, when the weather is cold and the receiver can grab it more easily, the passer can grip it, being tom brady, and all this bizarre behavior in the wells report, some who hated it did it was deeply flawed. Erik, talk about being a Football Player and how a less inflated ball helps a quarterback . I think it would help with the grip. When they get those footballs, theyre blown up big, theyre slick, theyre hard, and very hard to handle. Thats why the teams get the football and theyre able to doctor them a little bit, within the rules, and you know deflating it will help the quarterback grab the ball better and like you said, let the receiver catch the ball better. I think its more about them cheating. More about the action of them advertently breaking the rules like spygate in order to win. I believe thats the same reputation about the Patriots Organization, not necessarily about him deflating the footballs, its about deflating the footballs and not owning up to it. If you do not cooperate with the nfl, its like not cooperating with the fbi, the cia or the federal government. Liz theres a little arrogance there, i stress little, meaning it was a lot. A lot. And for him to come down and say he had nothing to do with it, i think all indication, all the reports are saying he strongly believes he didnt do anything wrong. I think if you lie to yourself enough, you start to believe that lie. Hes gotten into it right now. There is probable cause more than not, thats what the wells report said, more probable than not he knew something about it. As a quarterback, and erik can tell you as someone who played in the league as a quarterback, you know whether or not those balls have been deflated. You know how he likes the footballs. Liz he loves them deflated and youre just not supposed to mess with that. In fact, in the wells report, the part that stunned me is when you had one of the Officials Say we went to go find the balls 30 minutes before the game, and in my entire lifetime of officiating Football Games i have never not been able to find an entire bag of balls. This official could not find the balls. They had disappeared. It never happened before, and suddenly they magically reappeared. Erik, i have to really press this issue because were looking at these pictures of tom brady, the hero, right after hes won not one, not two but many super bowls and this aerial shot of wfxt, right over foxboro stadium. You can see the players through the haze of foxboro. They still play at foxboro, right . Everything changes since i left. But im looking at this thinking what must they as a team be thinking . Erik are they going to be distracted by this . I dont think theyll be distracted. And just like the spygate. I think the winning supersedes them getting caught. This is like a slap on the wrist. They have a super bowl trophy to back it up, so i think the super bowl trophy overshadows what theyve done. Of course, its going to be embarrassing, of course a distraction, theyre going to have to answer the questions, theyre a mature enough team. Theyve been through diversity from the spygate to the Aaron Hernandez situation to get over. This so i think theyll be fine. Liz does it bother you guys, and last hour, and as soon as this news broke, we had our teams at fox business getting people on the phone, and somebody i believe a former nfl player said, you know, they would have won that game, anyway. I said how do you know . I said how does anybody really know whats going to happen, and when you tip a balance like that, you may have its like butterflies flap wings over singapore and it rains in new york, you never know what is going to know. Funny you say that. The colts say it had nothing to do with the outcome of the game. I remember herm edwards saying there are three or four plays that decide the game. You never know if something happens in the beginning of the game where the colts make an interception or somebody drops a pass, the whole waist game changes with. That being said, you never know what could have happened. You play within the rules and you dont have to ask these questions. But there is some bending of the rules or manipulation of the rules. Theyre doing it this way, and all of a sudden you see it in College Football all the time. You dont care about the teams that go 38 about their recruiting violations. You dont look at them and they dont get on probation when they go 38. When they start winning championships and conference championships every single year, thats when other coaches look into the program, and with the patriots on top for the last 15 years, since the year 2000, the patriots are just set up for other teams to look at or other players to look at and say this is what theyre doing wrong, while they know that people on their team, and erik can talk about this as well, are doing the same thing. Not as egregious but doing things to bend the rules as well. Liz in the end, youre going to hear belly aching about Roger Goodell, the commissioner, he was the judge, the jury. He had his moment in the sun to appeal. He did not win the appeal on suspension, tom brady loses, what happens next . Nothing, he service the punishment because even though this seems odd to our notion of fairness and due process, that as you said so nicely, the commissioner Roger Goodell could be judge, jury and executioner. Thats the process agreed to by the Players Union in the closing argume collective Bargaining Agreement. The collective Bargaining Agreement requires you to cooperate with investigators, allows them to draw negative inferences if you destroy evidence. So tom brady basically said to the nfl, come and get me, and they came and got him. Liz and therefore to quote the song shut up and dance. Thats it. They chose it, right, mike . The judge is right on here. You adhere to the rules that you agree to in the beginning. Thats what ive been saying is that tom brady because hes so popular, because hes so big, hes a superstar and a household name, he felt how can do you this to me of all people . I am the poster child of your league, of the nfl, and Roger Goodells decision saying i dont care who you are, no one player, and it should be this way, is bigger than the shield. And i think a lot of players around the league who dont play on the new England Patriots are applauding this decision as well because there have been times in the past where other players, other teams felt like the patriots have been treated different way than the other players of the other teams because of the relationship that Roger Goodell has with kraft, the owner of the new England Patriots. Theyre looking at that saying if it can happen to tom brady, it can happen to anybody. There is a procedural quirk here, and im interested what our colleagues think of it. The punishment is not only against tom brady, but the new England Patriots who lost a first round draft choice. Liz and a million. And a million bucks. They caved, they decided not to appeal. There was some reports that came out and said because the patriots did what they did by falling on the sword, they were hoping that Roger Goodell will look at that as a sign to say look, be easy on our guy, take it easier on our guy. But that wasnt the case. Liz that didnt quite work. The fine is nothing for the patriots. Liz erik, as a player, when you hear the judge say look, you sign on, you are part of the Players Union, thats what you agree to and you follow those rules . Yeah, i agree with what mike said. I was a representative in the union, and that was a big issue in all of our meetings, we need to change something about Roger Goodell being the judge, the jury, and having the final say on appeal, but it was never changed. It was agreed upon and something they have to follow. Its frustrating as a player, but at the same time, those are the rules and you have to follow it. I just watched a documentary, judge, about Lance Armstrong, and the lying and the believing, and i believe it was mike who said, you Say Something long enough, you start to believe it. Right.
