Why dont we start by talking about Harvey Weinstein because that is the story that everybody is talking about right now and every day a new atrocity occurs yesterday o or the day before, whenever it was, three more people came forward with the idea that he had raped them. This has been going on for years and years. There were eight settlements against him and obviously everyone in the company knew about it. I gather how she could possibly not have heard about this but how do you think this happened . How was this allowed to go on and on and never have anybody speak out until now . Guest as a society and a culture, we protect the harassers. Host but why . Guest that is the 20 milliondollar question, why. Is it because we are protecting a person in power those are the top reasons. I get so much credit to the women who were able to tell their stories. Thereve been eight settlements that have been reported. There were three others who come forward who have not reached settlements. What is the statute of limitation . It is a longer statute of limitations but with regard you dont have a lot of time to file a claim. Its different in every state and depends on whether it is a federal violation or state violation so that is another thing we need to look into. There are so many ways we should look into the law. But on an issue you dont automatically switch on a light and say i think i will come forward. Its less than two years. Host but that doesnt excuse the men i man in the comy and the people who had to be involved in the settlements with those eight women that have to know about it. We would have to fill up every newspaper that ever existed because it isnt just that company where its happening. They are covering up hundreds or thousands of Companies Across the world. So why do we protect the harasser . Its not always the most powerful person at the company. Somebody comes into a job and they are warned to be careful of show over there. Hes been here for 30 years and he has a rude sense of humor. Soon enough, she finds out who joe is and goes to complain and who do they protect . Show, he isnt a central person to the company, but they protect joe and that woman is phased out so it is that every level. I have to tell you that i feel bullied by the Harvey Weinstein story. Host i was horrified and also thrilled that this came out he got fired from his company, they are going to take his name off the company, hes going into therapy and thrilled that his wife is leaving him. I think that he should be shunned. Theyve had these experiences and we all have. It is a step forward for the enablers and those who will also be called out. And you know what, they will feel the shame all of those women have felt and shouldnt have. Those people are going to feel ashamed. The neighbors are a huge part of the problem and a huge part of the solution. Sexual harassment training focuses more on the enablers than almost anything else. We should focus on how do we get the courage and the enabler to not be the enabler and also to come forward . Is crucial. Is that not part of the problem that to reach a settlement you have to agree not to talk about it . With regards to the resolution i just want to be clear on that. Settlements . Yes. This is the way society has decided to resolve these types of cases over 90 percent of Sexual Harassment cases what does that mean . And can never talk about it. How else do we solve sexualharassment . And to make that a secret proceeding. Nobody ever files about it if you file a complaint and nobody can talk about it nobody ever knows what happens in your terminated and then you are in the same position. This is the way society has decided to solve sexualharassment cases. And then coming so far. So the reason we are not hearing about the cases is because they are silent. Or through forced arbitration. I dont want the silence clause. And to get the issue. And the way to change the laws and that is rare. To follow a section of Sexual Harassment charge that does not include silencing you. How do we change that . Can to take the employmenemploymen t contract for go to take the secrecy out of that. Because Sexual Harassment bid and ask you what party belong to. With their daughters and granddaughters to meet with them privately to get them on board. And how does that change the landscape . If youre sexually harassed then you can file a public complaint with a jury trial which is your seventh amendment right but the way it works now is if you file a complaint is the secret. You go to arbitration only 20 percent of the time does the victim actually win and it isnt the open court system, you cannot call the same amount of witnesses, depositions are different with no appeal and the people here are retired but lawyers and judges who may or may not be adept at understanding Sexual Harassment with this generation. So maybe they dont send side with the victims. If i could just get a bipartisan bill to pass to take of secrecy at of this this, that is a warning shot. They can hide this behavior anymore. Explained to me why this is not a nobrainer . Talking to members of congress saying that i want this changed, why would anybody say no . Give me a good reason. Number one because republican support big business. Do they say were supporting big business . They are taking the meetings with me. They are . They are listening. They are thinking long and hard of a the ramifications. And even their wives have been sexually molested. This is why people are frustrated with politicians in general speaking of both sides of their mouth. And then should be on board. Not then to have a lot of constituency. Talk about silence. The big business guys go in to talk to their republican senators and congressmen to lobby them the reason you can do this because they are sexually harassing these women and lose a lot of money. Maybe not that blatant. That is the only reason they could be against it. The argument about arbitration is it is cheaper for the employee you dont have to hire lawyers to go through a long process of a trial. Big companies will say theyre doing a service because the courts are already overworked. This is a way to solve Small Business disputes those are the arguments given to the employee. Were just happy to have a worker can get a paycheck youre not thinking of the arbitration clause. And then when you do you realize you dont have the seventh amendment right any more is the daunting day because you realize you have no option and your rights have been taken away. I am optimistic.
