from the supreme court. >> does donald trump have immunity from the federal election charges against him? the ruling comes this morning, while democrats are doing damage control over president biden's disastrous debate, cnn has learned his family is telling him to keep fighting new details on their frustrations with his team and talks of possibly filing top aides also, a powerful and life-threatening hurricane taking aim of the caribbean hurricane beryl is poison to be the strongest storm the area has seen in two decades. we're tracking its destructive path. i'm sarah sign-in with john berman, kate bolduan is out today. this is cnn news central hard to remember a monday morning with more hanging in the balance, the political future of president biden and the legal future of donald trump. >> we are on alert for any sign that president biden is wavering in his commitment to stay in the presidential race or any sign of prominent elected democrat calls for him to step aside. so far that has not happened so far. also this morning, the supreme court will rule of donald trump is immune from the federal election subversion charges against him. a case that could shape not just his future but the presidency itself. let's get right to cnn's senior supreme court analyst, job biskupic, joan, give us a sense of what we will see today and when sure. >> jan and good to see you and, you isn't the suspense killing us? i just three more hours, john, before the justices take the bench and they have probably three opinions and say, will announce four cases. i think they're going to condense them to three and the immunity one will come last. so it's likely that it'll be read by the chief justice of the united states, john roberts, because i usually work in reverse seniority. we don't know yet if the chief is the author of this, but we spec he would be something this big that chief would keep for himself. and i have to say you cast the stakes exactly right? this is this opinion is going to decide whether donald trump faces trial for the events that culminated in january 6, 2021? before he sits for this current election, so it's just so much riding in a practical vein for this election, but also the stakes are very high for presidents in the future. can they be immune from criminal prosecution for actions they took while they were serving? now, to lower courts rejected former president trump's claim that he was categorically immune from any kind of criminal prosecution. they handled it straightforwardly without getting down into the weeds of the conduct itself. the dc circuit said for the purposes of this criminal case, former president trump has become citizen trump with all the defenses of other criminal defendants. but any executive immunity that might have protected him while he served as president no longer protects him against this prosecution now, john, i have to say during the oral arguments, the justices went much deeper into trying to look at the various claims by special counsel jack smith, the charges he's brought on behalf of the department of justice on behalf of the american people against donald trump and tried to decide and looked at the justices were looking at whether some of these actions might be considered official actions that could be immune from prosecution, whereas others might have been private actions that he was taking as sort of a candidate trump in the heat of the 2020 election results. so we're going to get we're going to get a definitive word on whether president, former president trump is subjected to trial. but it might be the kind of word that then has to play out through another set of lower court hearings. john, that's right. and it may be the type of rolling you don't know exactly what it says on the first page, you're gonna have to dig underneath to see what the implications here are. gop it's cubic, we know you will be there watching every single step of this. thanks so much. sarah all right. >> let's keep the legal conversation going. now with attorney matthew segal, men. thank you so much for joining us. where do you think the court will land on this issue of presidential immunity? >> thanks for having me, sarah, i think the court is going to land somewhere in-between. >> so unlike the lower courts, i think the supreme court is likely to recognize some form of presidential immunity for core constitutional duties. it can't be a crime for the president, for example, to veto a bill or to recognize an ambassador the question is, how much, if anything, more than that, the court recognizes, does the court go all the way to what president trump had asked it to recognize that all official acts by former president are immune from criminal prosecution and that's the big question going forward. >> i wanted to listen to justice sonia sotomayor. she asked a question about what might constitute an official act where a president would have immunity from prosecution. and the response from trump's attorney as well here is a sound from inside the supreme court if the president decides that his rival is a corrupt person and he orders the military or order someone to assassinate him is that within his official acts that for which he can get immunity. it would depend on hypothetical. we can see that could well be an official that could well be an official act. what could this ruling do in trump's favor if it's in trump's favor, what would it do to the balance of power? >> it would be extraordinarily dangerous. and i think it's important to keep in mind that as justice gorsuch said, there are adopting a rule for the ages and so whatever rule the court hands down right now applies, not just to former president trump's prior conduct, but also to the conduct of the current and next president and so what president trump's lawyer was saying is that the president has criminal immunity for assassinating a political rival, for attempting to stage a military coup on the morning of january 20. that's an extraordinarily dangerous position. now, it's also important to recognize that president trump's lawyer also conceded that the vast majority of the conduct that's alleged in this indictment is not official, even by his own test. and so we live in a kind of split screen reality here, where former president trump is asking for impunity for his next term. but also no matter what the supreme court rules today, it's overwhelmingly likely that if time we're not a factor, he would ultimately face charges for the unofficial criminal conduct that he's charged with in this case. >> i do want to ask you about that, too. if the court does role in trump's favor how does that affect the january 6 case against him? does it diminish it or does it finish it well, i think it's just a matter of time. >> i think the details that are most important in the court's ruling or how long it's going to take to determine that the conduct alleged in the indictment overwhelmingly, his private conduct we're not talking about using the military to assassinate a political rival. what we're talking about is organizing fraudulent slates of electors and then pressuring the vice president to count those fraudulent slates of electors. none of that is part of the president's official responsibilities. and there's no real plausible argument that it is and so we've been in this delay mode for seven months now while we've engaged in this important constitutional question of the president's criminal immunity. but at the end of the day, if time we're not a factor, it's overwhelmingly likely that former president trump would be put on trial. and so the question going forward is given the test that the court hands down today, how much more time is it going to take for the lower courts to determine that this conduct isn't official. >> i do want to ask you about something the court has already ruled on. the january 6 case involving the police officer charged with obstruction of an official proceeding. they said that the police officer within the right here here and that the special counsel or the prosecutors were in the wrong when you hear that they sided with the officer, how might this apply if at all, to this case with donald trump and immunity? does it give him a boost, for example, that you think that maybe this is a pretty precursor to what they supreme court is going to rule i think there's a difference between the headlines and the reality in that case, fisher v. united states, which was decided on friday. so the headline is that the government's position on this statute obstruction in an official proceeding? which former president trump is charged with as well. the headline is the government lost. but if you actually read the opinion, the court adopted a position that almost definitely applies both to the defendant in that case who violently storm the capitol on january 6, and to former president trump. and so we again get a dynamic where the headline says, oh, the january 6, defendant won. but if you look at the details, actually, in a year or two, i think it's overwhelmingly likely that joseph fischer is going to be convicted of of obstruction of an official proceeding, and he'll go to prison. and so so much of what we see right now is the process playing out. and it's playing out much too slowly given the stakes and this election matthew seligman, thank you so much for your analysis there. i appreciate your time this morning thanks for having me all right. the head jill in a presidency and i want you to know that the fact is that the reaction to the lies of donald trump is something that maybe tv is isn't focusing on, but people are of course drawn the big question on friday night, police say when officers approached him, the boy ran and pointed a replica handgun at them. the incident has been captured entirely on police body camera and is currently under investigation. cnn correspondent polo sandoval, joining me now. so if this whole thing was captured on body camera, water authorities gleaning from what they're seeing. so there are two investigations that are running parallel with each other. you have the utica police department is investigating the actions of their police officer and also the new york state attorney general they're going to review basically a mountain of some of his body camera video that was recovered from the scene after this weekend since it actually happened on friday night, we're going to play for you a portion of that. two things. first, a warning, it is a disturbing video, but also let me just set things up for you so, you know, since things happen in a very quick moment here, it was friday night when police in utica received a report about an armed robbery on the city's westside. they arrived and eventually made contact with this 13 now identified by police as neon. why? and also another young individual while speaking to him. that's when police then moved to actually pat him down. and that as you'll see in the video yeah. is when the 13-year-old and runs away police give tastes a few moments later, there's a single shot, one officer fires, one round and fatally strikes is 13-year-old the video that you're about to see though you will see how utica police have actually edit it on purpose to show you with red circles what the officer perceive to be a pistol the moment only to find out later that in fact it was a pelicans. so again, a warning. the video is disturbing to watch, but will give you an idea of what went down on friday night you can use anybody's the reason why we're stopping right in the roadway and you're and you're saying i forgot what that means, forgot about that he was just he was dispatched down and make sure you got no weapons i've had up to to review some other body camera video. there was also released here, sarah, you can see the officer that fired that single round actually recover what appeared to be a pistol. he even pulls back the slide i'd on it. so it certainly bears very striking resemblance as you can see here to what even police officers may carry in their wholesalers so there is, as you can imagine, just a complete sense of devastation among the community. we understand that this was 13 that was a refugee from me and mar and so that community is certainly calling for accountability. there was a protest over the weekend outside the police department. they want a closer look and ultimately again, these two investigations will have to determine whether or not the shooting was justified, but the reality is, this is not the first story of its kind even covered this myself, where police officers will see something that appears to be a weapon on top of that they had received reports of an asian male who brandished a black firearm and stole property in the vicinity. so add all up at that moment, those officers according to what we heard from the police chief recognized that as a threat and use lethal force at night, seeing that gun that looks very similar to a real, real firearm. well, all right. polo sandoval. thank you so much. i think, out over the weekend. many of donald trump's top surrogates we're spanning the airwaves, trying to keep them and tim up from the debate. it was actually a pretty stark contrast to watching democrats who were trying to dismiss and explain away some of what happened with biden's performance over the weekend. take a listen to what trump surrogates were saying he's a decent man. he's a fail president. he is compromised. that's the story line here. that's what the world. so i compromise presidents. there was this 24 hour period where effectively everyone honest that there was an incredible contrast between donald trump's energy and commanded the facts and joe biden's obvious inability to do the job as president. >> and now of course, we've trained this new media cycle where folks are trying to run cover and then all of america sought and you knew who else sought our adversary side of putin side. she sought the iowa total is saddam now john, as you can see, there are many republicans, particularly those backing trump and his fiercest defenders were relishing the criticism being aimed at biden's team and around biden's performance. >> but luck, this celebre tory language is likely to change as early as today at 10:00 a.m. we're going going to see the supreme court deliver their final rulings of this period, including this massive blockbuster, blockbuster decision on whether or not donald trump had quote, unquote full immunity while president that's likely to very much up end this this rhetoric around how wonderful donald trump i'm dead at the debate we're also of course, looking ahead to next week. he has a sentencing on july 11 another crucial date that could really change a lot for his candidacy. and then of course, also he has the convention later this month, but hanging around to all of this is also when donald trump is going to announce who his vice presidential pick is. and that's something that i i'm told donald trump's team has kind of reserving to a card they're going to play when they know they need another distraction as well. all of these moments are also key fundraising moments for them as well. so this is likely to change as early as today, the celebrated rhetoric from the republican's john where lina train, thank you very much for that. so this morning you republic a new reporting, i should say that elected democrats are taking the calls for president bind to give up his campaign. they're taking that discussion seriously. listen to what congressman jamie raskin said about this there are very honest and serious, rigorous conversations taking place at every level of our party. if we're having a serious conversation about what to do well this now sarah matthews from a deputy press secretary for the trump administration, matt bennett, former white house deputy assistant for the clinton administration, and matt gorman, former senior adviser for tim scott, presidential campaign map. >> but and i'm going to start with you because among the four of us, you're the guy who matters here because the activity is within the democratic party. what democrats? are going to do. now, you just heard congressman noah map bennett, not matt gorman you just heard congressman jamie raskin talking about the fact there are serious discussions going on what discussions give us a window as the discussions that are happening right now among members and among serious democrats this morning well, it's just undeniable. we've been hearing it all weekend that people are really worried because the debate performance was obviously extraordinarily bad. all first up, all presidents have bad first debates. all of them going way back. but this was about the worst that we can remember. and so it the trigger, a lot of discussion obviously a lot in the press and then a lot privately among democrats about what to do if the president continues. i think there is unanimity among democrats that he needs to be extraordinarily aggressive, much more aggressive than he has been getting out in front of the public doing town hall i'll meetings with voters doing sit-downs with reporters, doing television interviews, doing press conferences. he needs to prove that was one bad night and not a pattern. and so far at least, we just don't know which it is. and i think that is what is triggering a lot of conversation among democrats today. >> hey, matt better just to be clear here, blaming the press or blaming the pundit saying this isn't what voters are talking about. you guys are all focused on the wrong thing. does that really address the issue mat no. they may be right. i mean, there is some snap polling that shows that there's a lot more chatter among people like us than there is among normal voters. and it may be that the debate did not move the needle very much for ordinary voters. and that will be a significant finding if that turns out to be true. but look they can't deny what we all saw. it was a very, very bad debate and if played to biden's weakness, so he has got to get out there and prove that it was a one-off bad night and not what the kind of thing we're going to see going forward. >> sarah matthews, all three of you have been staffers before all right. in various offices, whether it be the white house or senate, or house or campaign offices. so sarah, over the last few days, when you've heard people publicly saying oh, the president was ill-prepared, it was ron klain, it was bob baer, it was others who let him down. bauer, i should say, let him down in the preparation. how does that strike you yeah, it seems like right now, democrats are just trying to throw any excuse at the wall and see what will stick. >> they've said that it was because biden had a cold or he was over-prepared. they blame the staff. but at the end of the day, the buck stops with the president. there's no one to blame other than president biden for his poor debate chorman's, it wasn't just one bad night. i think that this follows a trend that we've seen of his diminishing decline. and it was obvious to the millions of voters who tuned in, which is unfortunate because obviously the biden campaign were the people who asked for this debate because they wanted to switch that narrative. and it seems like they might have done irreversible damage by having the debate matt gorman, sorry for the fall. start there before so many mask on this panel this morning nikki haley was talk to the wall street journal this morning. she first of all, it was news to me, she called donald trump, i guess a week-and-a-half ago to talk about the fact that she had said that she was voting for him. we didn't learn much more about that conversation, but one of the thing dickey haley told the wall street journal was to republicans be careful what you wish for. here. you might get a younger opponent for donald trump to run against. and that's going to be bad for you republicans. what do you think about that? matt? >> i think first of all, to your point before the voters were kind of on the leading edge of this, they saw this i think before many in the media and pundits were willing to admit this. and i think going into last there's and i think weren't surprised by this. i think the other point look realistically. there is no other option besides kamala harris, if if joe biden were to step aside, breeze, don't complications. but when you talk about certainly the money that the biden campaign raise, the only person that can legally goto is kamala harris and also in this democratic party, there's no way you're going to bypass first african american, first woman to hold that job for some white male governor gavin newsom simply not going to happen the idea that the white knight, no pun intended going to come out of nowhere is just fallacy so matt bennett, what about what matt gorman is saying right there? well, it is true that there are some very significant logistical hurdles to anyone else becoming nominee. it can be done and the money can be spent to support another candidate. but the time is very short. remember, we don't have all the way to the convention. there's gonna be a roll call vote of the delay it gets in early august because there's a glitch with the ohio ballot. so it is it would be an extraordinary political feats to try to get in the race and figure out how to shove aside the vice president in just a couple of weeks. and the other thing i think it's important, remember, is we political obsessively, people who watch this show every morning. of course they know who all these other candidates are, but a lot of voters don't. the vice president has universal name id and i think there would be a really strong move to just consolidate behind her if the president decides to step aside telco viewers names, they're very thoughtful, sensitive if people who weigh everything very, very careful, don't know, your viewers know what i understand sarah matthews first of all, i dispute the notion that it's only pundits and the press talking about this. i mean, i saw and heard from actual human beings over the last three days. i know we all have and this is something that everyone is talking about, but there is an interesting phenomenon here. well, what you do here, i think universal concern in shock about president biden's debate performance. it's not clear to me that there is this wave of people saying, and also donald trump was great or also, i'm switching to trump because of this, it's not clear to me exactly where or if or how he gains i think that a lot of voters watch that debate and we're just even more depressed about the current state of affairs because they're not happy with the options people did not want this rematch. i think the only people who probably want this rematch are joe biden and donald trump's teams because i think that they believe that they can defeat the other opponent when it because i think respectively know that there are candidates are each pretty weak. and so as i've talked with voters who are just everyday americans who maybe aren't tuning in and watching the news 24/7 and they were pretty alarmed when they saw what biden's appearance looked like on that debate stage, i think everyone knows that he's old, but just to see him on that debate stage struggling. it was sad for a lot of people. and i do think that the couch caucus grew much larger after that debate performance because i think they're going to be a lot of people who think i can't vote for either of these guys because they watch trump go up there and just lie. as often as he breeze and refuse three times to say that he would accept the results of the 2024 election. and they think i can't vote for that guy, but then they watched joe biden and thought he might not be up to the job of serving another four years. and so i think they're going to be a lot of people who leave the top of their ballots blank and who maybe just sit at home and don't even take part in the election after last after last thursday. >> sarah matthews, matt bennett, matt gorman. bases across europe are on heightened alert for it because of new concerns over possible terrorist attack. cnn's itasha for trans at the pentagon for us. what are these alerts mean for the troops there yes, there are. >> so the force protection condition of a lot of these military bases in europe, including rammstein and germany, as well as the u.s. army garrison at stood guard. they have been raised to force protection level charlie up from bravo. and what does that mean? well, that essentially means that some kind of intelligence has been received indicating that a terrorist threats targeting us military personnel or us military facilities has been received, that there likely going to be a terrorist attack and the u.s. army uses that word likely, so they have received some kind of pretty alarming intelligence here that has caused all of these bases really two remain on high alert, pretty much indefinitely. we don't know when that status is going to change here, but one us official who is stationed at a base in europe just to kind of underscore how important this is, says that he has not seen this kind of level change in about ten years now. and he said that it usually means the military as received, quote, an active, reliable threat. now, we did ask a spokesperson for us european command for comment, and they would not delve into the specifics of that force protection change other than to say that sometimes things happen where they feel the need to alert us military personnel overseas that they need to remain very vigilant doing things like not going off base in their uniforms, for example, and just being very aware of their surroundings at all times. obviously, the basis that are on this higher alert are going to be more vigilant about cars coming in. they're going to be searches, they're going to be perhaps patrols on some of these bases. but the bottom line here that while we don't know exactly what intelligence was received, indicating a possible terrorist threat it is a very significant move indicating that these personnel, if they don't stay aware of the surroundings could be in dangerous era hitachi of her tran. thank you so much powerful category three storm. let's get right to seen as lisa rafat with the latest on this, what are you seeing? >> we are watching this. i very closely because the only reason why it came down to a category three intensity overnight is because we were going through something called the i will replacement cycle. the structure is changing just a little bit and you can see where it got a little bit cloudy overnight, but it's starting to clear up again. that's telling us that it's gaining intensity and could come back up to that category for status were watching it closely either way, you have outer bands already lashing parts of barbados granada as well. some of these islands category three, as it stands right now, 120 mile per hour winds sitting 125 miles east and southeast of granada, again, already seeing some of these outer bands we've been white watching some of these showers clip parts of barbados and some of these islands as well as some of these windward islands on this radar. and you can see there's that i will, how intense that is and that looks like that. i will heads toward st. vincent and granada as we go through the day today, barbados are ready looking at 43 mile per hour sustained winds ends, gas have already been up to 60 miles per hour. this will continue as we go through the day today. again, you've got hurricane warnings because we're looking at some catastrophic damage possible from those intense winds in the eyewall. we're also looking at some six to nine feet of storm surge possible. there it is with the intensity coming back up to a four like i mentioned then we continue to scrape the caribbean seawater, these islands like jamaica are already have some watches in effect for parts of haiti and the dominican republic. and then eventually headed up towards mexico by the end of the week. the reason we're talking about such an incredibly strong storm so early in the season is because these ocean temperatures are in the middle and upper 80s. this is the first time we've ever had a category four hurricane in june, this early in the season. it underwent rapid intensification over the weekend, took less than 24 hours for it to go from tropical storm to a category four hurricane and we find that that trend getting extremely stronger, faster more recently because of climate change now warming oceans, john, we're talking about barrels, hurricane beryl, there's another tropical storm you're looking at yeah, we're also watching chris that is also a depression right now. >> so there's barrel, there's another chance of development right behind it. chris made landfall in mexico overnight just the latest last couple of minutes. it's down to a depression but could still soak them with some rain couple of inches of rain from the supreme court. >> does donald trump have immunity from the federal election charges against him? the ruling comes this morning, while democrats are doing damage control over president biden's disastrous debate, cnn has learned his family is telling him to keep fighting new details on their frustrations with his team and talks of possibly filing top aides also, a powerful and life-threatening hurricane taking aim of the caribbean hurricane beryl is poison to be the strongest storm the area has seen in two decades. we're tracking its destructive path. i'm sarah sign-in with john berman, kate bolduan is out today. this is cnn news central hard to remember a monday morning with more hanging in the balance, the political future of president biden and the legal future of donald trump. >> we are on alert for any sign that president biden is wavering in his commitment to stay in the presidential race or any sign of prominent elected democrat calls for him to step aside. so far that has not happened so far. also this morning, the supreme court will rule of donald trump is immune from the federal election subversion charges against him. a case that could shape not just his future but the presidency itself. let's get right to cnn's senior supreme court analyst, job biskupic, joan, give us a sense of what we will see today and when sure. >> jan and good to see you and, you isn't the suspense killing us? i just three more hours, john, before the justices take the bench and they have probably three opinions and say, will announce four cases. i think they're going to condense them to three and the immunity one will come last. so it's likely that it'll be read by the chief justice of the united states, john roberts, because i usually work in reverse seniority. we don't know yet if the chief is the author of this, but we spec he would be something this big that chief would keep for himself. and i have to say you cast the stakes exactly right? this is this opinion is going to decide whether donald trump faces trial for the events that culminated in january 6, 2021? before he sits for this current election, so it's just so much riding in a practical vein for this election, but also the stakes are very high for presidents in the future. can they be immune from criminal prosecution for actions they took while they were serving? now, to lower courts rejected former president trump's claim that he was categorically immune from any kind of criminal prosecution. they handled it straightforwardly without getting down into the weeds of the conduct itself. the dc circuit said for the purposes of this criminal case, former president trump has become citizen trump with all the defenses of other criminal defendants. but any executive immunity that might have protected him while he served as president no longer protects him against this prosecution now, john, i have to say during the oral arguments, the justices went much deeper into trying to look at the various claims by special counsel jack smith, the charges he's brought on behalf of the department of justice on behalf of the american people against donald trump and tried to decide and looked at the justices were looking at whether some of these actions might be considered official actions that could be immune from prosecution, whereas others might have been private actions that he was taking as sort of a candidate trump in the heat of the 2020 election results. so we're going to get we're going to get a definitive word on whether president, former president trump is subjected to trial. but it might be the kind of word that then has to play out through another set of lower court hearings. john, that's right. and it may be the type of rolling you don't know exactly what it says on the first page, you're gonna have to dig underneath to see what the implications here are. gop it's cubic, we know you will be there watching every single step of this. thanks so much. sarah all right. >> let's keep the legal conversation going. now with attorney matthew segal, men. thank you so much for joining us. where do you think the court will land on this issue of presidential immunity? >> thanks for having me, sarah, i think the court is going to land somewhere in-between. >> so unlike the lower courts, i think the supreme court is likely to recognize some form of presidential immunity for core constitutional duties. it can't be a crime for the president, for example, to veto a bill or to recognize an ambassador the question is, how much, if anything, more than that, the court recognizes, does the court go all the way to what president trump had asked it to recognize that all official acts by former president are immune from criminal prosecution and that's the big question going forward. >> i wanted to listen to justice sonia sotomayor. she asked a question about what might constitute an official act where a president would have immunity from prosecution. and the response from trump's attorney as well here is a sound from inside the supreme court if the president decides that his rival is a corrupt person and he orders the military or order someone to assassinate him is that within his official acts that for which he can get immunity. it would depend on hypothetical. we can see that could well be an official that could well be an official act. what could this ruling do in trump's favor if it's in trump's favor, what would it do to the balance of power? >> it would be extraordinarily dangerous. and i think it's important to keep in mind that as justice gorsuch said, there are adopting a rule for the ages and so whatever rule the court hands down right now applies, not just to former president trump's prior conduct, but also to the conduct of the current and next president and so what president trump's lawyer was saying is that the president has criminal immunity for assassinating a political rival, for attempting to stage a military coup on the morning of january 20. that's an extraordinarily dangerous position. now, it's also important to recognize that president trump's lawyer also conceded that the vast majority of the conduct that's alleged in this indictment is not official, even by his own test. and so we live in a kind of split screen reality here, where former president trump is asking for impunity for his next term. but also no matter what the supreme court rules today, it's overwhelmingly likely that if time we're not a factor, he would ultimately face charges for the unofficial criminal conduct that he's charged with in this case. >> i do want to ask you about that, too. if the court does role in trump's favor how does that affect the january 6 case against him? does it diminish it or does it finish it well, i think it's just a matter of time. >> i think the details that are most important in the court's ruling or how long it's going to take to determine that the conduct alleged in the indictment overwhelmingly, his private conduct we're not talking about using the military to assassinate a political rival. what we're talking about is organizing fraudulent slates of electors and then pressuring the vice president to count those fraudulent slates of electors. none of that is part of the president's official responsibilities. and there's no real plausible argument that it is and so we've been in this delay mode for seven months now while we've engaged in this important constitutional question of the president's criminal immunity. but at the end of the day, if time we're not a factor, it's overwhelmingly likely that former president trump would be put on trial. and so the question going forward is given the test that the court hands down today, how much more time is it going to take for the lower courts to determine that this conduct isn't official. >> i do want to ask you about something the court has already ruled on. the january 6 case involving the police officer charged with obstruction of an official proceeding. they said that the police officer within the right here here and that the special counsel or the prosecutors were in the wrong when you hear that they sided with the officer, how might this apply if at all, to this case with donald trump and immunity? does it give him a boost, for example, that you think that maybe this is a pretty precursor to what they supreme court is going to rule i think there's a difference between the headlines and the reality in that case, fisher v. united states, which was decided on friday. so the headline is that the government's position on this statute obstruction in an official proceeding? which former president trump is charged with as well. the headline is the government lost. but if you actually read the opinion, the court adopted a position that almost definitely applies both to the defendant in that case who violently storm the capitol on january 6, and to former president trump. and so we again get a dynamic where the headline says, oh, the january 6, defendant won. but if you look at the details, actually, in a year or two, i think it's overwhelmingly likely that joseph fischer is going to be convicted of of obstruction of an official proceeding, and he'll go to prison. and so so much of what we see right now is the process playing out. and it's playing out much too slowly given the stakes and this election matthew seligman, thank you so much for your analysis there. i appreciate your time this morning thanks for having me all right. the head jill be democrats joe biden is our leader and joe biden has earned, and joe biden deserves the confidence, the respect, and frankly, the partnership that we now have to provide to him. i do not believe that joe biden has a problem leading for the next four years because he's done a great job of leading for the last 3.5 years. >> it's not about performance in terms of a debate, it's about performance in a presidency and i want you to know that the fact is that the reaction to the lies of donald trump is something that maybe tv is isn't focusing on, but people are of course drawn the big question is whether this does call nerves, including among donors who have also panicked and our wracked with anxiety over the next steps here in fact, at a fundraising email, the biden campaign also put out polling to show how alternatives would fare against former president donald trump to make the point that president biden is the best candidate. >> so a pretty remarkable step by the campaign that just on friday night, police say when officers approached him, the boy ran and pointed a replica handgun at them. the incident has been captured entirely on police body camera and is currently under investigation. cnn correspondent polo sandoval, joining me now. so if this whole thing was captured on body camera, water authorities gleaning from what they're seeing. so there are two investigations that are running parallel with each other. you have the utica police department is investigating the actions of their police officer and also the new york state attorney general they're going to review basically a mountain of some of his body camera video that was recovered from the scene after this weekend since it actually happened on friday night, we're going to play for you a portion of that. two things. first, a warning, it is a disturbing video, but also let me just set things up for you so, you know, since things happen in a very quick moment here, it was friday night when police in utica received a report about an armed robbery on the city's westside. they arrived and eventually made contact with this 13 now identified by police as neon. why? and also another young individual while speaking to him. that's when police then moved to actually pat him down. and that as you'll see in the video yeah. is when the 13-year-old and runs away police give tastes a few moments later, there's a single shot, one officer fires, one round and fatally strikes is 13-year-old the video that you're about to see though you will see how utica police have actually edit it on purpose to show you with red circles what the officer perceive to be a pistol the moment only to find out later that in fact it was a pelicans. so again, a warning. the video is disturbing to watch, but will give you an idea of what went down on friday night you can use anybody's the reason why we're stopping right in the roadway and you're and you're saying i forgot what that means, forgot about that he was just he was dispatched down and make sure you got no weapons i've had up to to review some other body camera video. there was also released here, sarah, you can see the officer that fired that single round actually recover what appeared to be a pistol. he even pulls back the slide i'd on it. so it certainly bears very striking resemblance as you can see here to what even police officers may carry in their wholesalers so there is, as you can imagine, just a complete sense of devastation among the community. we understand that this was 13 that was a refugee from me and mar and so that community is certainly calling for accountability. there was a protest over the weekend outside the police department. they want a closer look and ultimately again, these two investigations will have to determine whether or not the shooting was justified, but the reality is, this is not the first story of its kind even covered this myself, where police officers will see something that appears to be a weapon on top of that they had received reports of an asian male who brandished a black firearm and stole property in the vicinity. so add all up at that moment, those officers according to what we heard from the police chief recognized that as a threat and use lethal force at night, seeing that gun that looks very similar to a real, real firearm. well, all right. polo sandoval. thank you so much. i think, out over the weekend. many of donald trump's top surrogates we're spanning the airwaves, trying to keep them and tim up from the debate. it was actually a pretty stark contrast to watching democrats who were trying to dismiss and explain away some of what happened with biden's performance over the weekend. take a listen to what trump surrogates were saying he's a decent man. he's a fail president. he is compromised. that's the story line here. that's what the world. so i compromise presidents. there was this 24 hour period where effectively everyone honest that there was an incredible contrast between donald trump's energy and commanded the facts and joe biden's obvious inability to do the job as president. >> and now of course, we've trained this new media cycle where folks are trying to run cover and then all of america sought and you knew who else sought our adversary side of putin side. she sought the iowa total is saddam now john, as you can see, there are many republicans, particularly those backing trump and his fiercest defenders were relishing the criticism being aimed at biden's team and around biden's performance. >> but luck, this celebre tory language is likely to change as early as today at 10:00 a.m. we're going going to see the supreme court deliver their final rulings of this period, including this massive blockbuster, blockbuster decision on whether or not donald trump had quote, unquote full immunity while president that's likely to very much up end this this rhetoric around how wonderful donald trump i'm dead at the debate we're also of course, looking ahead to next week. he has a sentencing on july 11 another crucial date that could really change a lot for his candidacy. and then of course, also he has the convention later this month, but hanging around to all of this is also when donald trump is going to announce who his vice presidential pick is. and that's something that i i'm told donald trump's team has kind of reserving to a card they're going to play when they know they need another distraction as well. all of these moments are also key fundraising moments for them as well. so this is likely to change are taking the calls for president bind to give up his campaign. they're taking that discussion seriously. listen to what congressman jamie raskin said about this there are very honest and serious, rigorous conversations taking place at every level of our party. if we're having a serious conversation about what to do well this now sarah matthews from a deputy press secretary for the trump administration, matt bennett, former white house deputy assistant for the clinton administration, and matt gorman, former senior adviser for tim scott, presidential campaign map. >> but and i'm going to start with you because among the four of us, you're the guy who matters here because the activity is within the democratic party. what democrats? are going to do. now, you just heard congressman noah map bennett, not matt gorman you just heard congressman jamie raskin talking about the fact there are serious discussions going on what discussions give us a window as the discussions that are happening right now among members and among serious democrats this morning well, it's just undeniable. we've been hearing it all weekend that people are really worried because the debate performance was obviously extraordinarily bad. all first up, all presidents have bad first debates. all of them going way back. but this was about the worst that we can remember. and so it the trigger, a lot of discussion obviously a lot in the press and then a lot privately among democrats about what to do if the president continues. i think there is unanimity among democrats that he needs to be extraordinarily aggressive, much more aggressive than he has been getting out in front of the public doing town hall i'll meetings with voters doing sit-downs with reporters, doing television interviews, doing press conferences. he needs to prove that was one bad night and not a pattern. and so far at least, we just don't know which it is. and i think that is what is triggering a lot of conversation among democrats today. >> hey, matt better just to be clear here, blaming the press or blaming the pundit saying this isn't what voters are talking about. you guys are all focused on the wrong thing. does that really address the issue mat no. they may be right. i mean, there is some snap polling that shows that there's a lot more chatter among people like us than there is among normal voters. and it may be that the debate did not move the needle very much for ordinary voters. and that will be a significant finding if that turns out to be true. but look they can't deny what we all saw. it was a very, very bad debate and if played to biden's weakness, so he has got to get out there and prove that it was a one-off bad night and not what the kind of thing we're going to see going forward. >> sarah matthews, all three of you have been staffers before all right. in various offices, whether it be the white house or senate, or house or campaign offices. so sarah, over the last few days, when you've heard people publicly saying oh, the president was ill-prepared, it was ron klain, it was bob baer, it was others who let him down. bauer, i should say, let him down in the preparation. how does that strike you yeah, it seems like right now, democrats are just trying to throw any excuse at the wall and see what will stick. >> they've said that it was because biden had a cold or he was over-prepared. they blame the staff. but at the end of the day, the buck stops with the president. there's no one to blame other than president biden for his poor debate chorman's, it wasn't just one bad night. i think that this follows a trend that we've seen of his diminishing decline. and it was obvious to the millions of voters who tuned in, which is unfortunate because obviously the biden campaign were the people who asked for this debate because they wanted to switch that narrative. and it seems like they might have done irreversible damage by having the debate matt gorman, sorry for the fall. start there before so many mask on this panel this morning nikki haley was talk to the wall street journal this morning. she first of all, it was news to me, she called donald trump, i guess a week-and-a-half ago to talk about the fact that she had said that she was voting for him. we didn't learn much more about that conversation, but one of the thing dickey haley told the wall street journal was to republicans be careful what you wish for. here. you might get a younger opponent for donald trump to run against. and that's going to be bad for you republicans. what do you think about that? matt? >> i think first of all, to your point before the voters were kind of on the leading edge of this, they saw this i think before many in the media and pundits were willing to admit this. and i think going into last there's and i think weren't surprised by this. i think the other point look realistically. there is no other option besides kamala harris, if if joe biden were to step aside, breeze, don't complications. but when you talk about certainly the money that the biden campaign raise, the only person that can legally goto is kamala harris and also in this democratic party, there's no way you're going to bypass first african american, first woman to hold that job for some white male governor gavin newsom simply not going to happen the idea that the white knight, no pun intended going to come out of nowhere is just fallacy so matt bennett, what about what matt gorman is saying right there? well, it is true that there are some very significant logistical hurdles to anyone else becoming nominee. it can be done and the money can be spent to support another candidate. but the time is very short. remember, we don't have all the way to the convention. there's gonna be a roll call vote of the delay it gets in early august because there's a glitch with the ohio ballot. so it is it would be an extraordinary political feats to try to get in the race and figure out how to shove aside the vice president in just a couple of weeks. and the other thing i think it's important, remember, is we political obsessively, people who watch this show every morning. of course they know who all these other candidates are, but a lot of voters don't. the vice president has universal name id and i think there would be a really strong move to just consolidate behind her if the president decides to step aside telco viewers names, they're very thoughtful, sensitive if people who weigh everything very, very careful, don't know, your viewers know what i understand sarah matthews first of all, i dispute the notion that it's only pundits and the press talking about this. i mean, i saw and heard from actual human beings over the last three days. i know we all have and this is something that everyone is talking about, but there is an interesting phenomenon here. well, what you do here, i think universal concern in shock about president biden's debate performance. it's not clear to me that there is this wave of people saying, and also donald trump was great or also, i'm switching to trump because of this, it's not clear to me exactly where or if or how he gains i think that a lot of voters watch that debate and we're just even more depressed about the current state of affairs because they're not happy with the options people did not want this rematch. i think the only people who probably want this rematch are joe biden and donald trump's teams because i think that they believe that they can defeat the other opponent when it because i think respectively know that there are candidates are each pretty weak. and so as i've talked with voters who are just everyday americans who maybe aren't tuning in and watching the news 24/7 and they were pretty alarmed when they saw what biden's appearance looked like on that debate stage, i think everyone knows that he's old, but just to see him on that debate stage struggling. it was sad for a lot of people. and i do think that the couch caucus grew much larger after that debate performance because i think they're going to be a lot of people who think i can't vote for either of these guys because they watch trump go up there and just lie. as often as he breeze and refuse three times to say that he would accept the results of the 2024 election. and they think i can't vote for that guy, but then they watched joe biden and thought he might not be up to the job of serving another four years. and so i think they're going to be a lot of people who leave the top of their ballots blank and who maybe just sit at home and don't even take part in the election after last after last thursday. >> sarah matthews, matt bennett, matt gorman. bases across europe are on heightened alert for it because of new concerns over possible terrorist attack. cnn's itasha for trans at the pentagon for us. what are these alerts mean for the troops there yes, there are. >> so the force protection condition of a lot of these military bases in europe, including rammstein and germany, as well as the u.s. army garrison at stood guard. they have been raised to force protection level charlie up from bravo. and what does that mean? well, that essentially means that some kind of intelligence has been received indicating that a terrorist threats targeting us military personnel or us military facilities has been received, that there likely going to be a terrorist attack and the u.s. army uses that word likely, so they have received some kind of pretty alarming intelligence here that has caused all of these bases really two remain on high alert, pretty much indefinitely. we don't know when that status is going to change here, but one us official who is stationed at a base in europe just to kind of underscore how important this is, says that he has not seen this kind of level change in about ten years now. and he said that it usually means the military as received, quote, an active, reliable threat. now, we did ask a spokesperson for us european command for comment, and they would not delve into the specifics of that force protection change other than to say that sometimes things happen where they feel the need to alert us military personnel overseas that they need to remain very vigilant doing things like not going off base in their uniforms, for example, and just being very aware of their surroundings at all times. obviously, the basis that are on this higher alert are going to be more vigilant about cars coming in. they're going to be searches, they're going to be perhaps patrols on some of these bases. but the bottom line here that while we don't know exactly what intelligence was received, indicating a possible terrorist threat it is a very significant move indicating that these personnel, if they don't stay aware of the surroundings could be in dangerous era hitachi of her tran. thank you so much for that reporting for us this morning. jon, are happening now, hurricane warnings are in effect for parts of the caribbean, including barbados, st. lucia, and the grenadines. hurricane beryl is now a powerful category three storm. let's get right to seen as lisa rafat with the latest on this, what are you seeing? >> we are watching this. i very closely because the only reason why it came down to a category three intensity overnight is because we were going through something called the i will replacement cycle. the structure is changing just a little bit and you can see where it got a little bit cloudy overnight, but it's starting to clear up again. that's telling us that it's gaining intensity and could come back up to that category for status were watching it closely either way, you have outer bands already lashing parts of barbados granada as well. some of these islands category three, as it stands right now, 120 mile per hour winds sitting 125 miles east and southeast of granada, again, already seeing some of these outer bands we've been white watching some of these showers clip parts of barbados and some of these islands as well as some of these windward islands on this radar. and you can see there's that i will, how intense that is and that looks like that. i will heads toward st. vincent and granada as we go through the day today, barbados are ready looking at 43 mile per hour sustained winds ends, gas have already been up to 60 miles per hour. this will continue as we go through the day today. again, you've got hurricane warnings because we're looking at some catastrophic damage possible from those intense winds in the eyewall. we're also looking at some six to nine feet of storm surge possible. there it is with the intensity coming back up to a four like i mentioned then we continue to scrape the caribbean seawater, these islands like jamaica are already have some watches in effect for parts of haiti and the dominican republic. and then eventually headed up towards mexico by the end of the week. the reason we're talking about such an incredibly strong storm so early in the season is because these ocean temperatures are in the middle and upper 80s. this is the first time we've ever had a category four hurricane in june, this early in the season. it underwent rapid intensification over the weekend, took less than 24 hours for it to go from tropical storm to a category four hurricane and we find that that trend getting extremely stronger, faster more recently because of climate change now warming oceans, john, we're talking about barrels, hurricane beryl, there's another tropical storm you're looking at yeah, we're also watching chris that is also a depression right now. >> so there's barrel, there's another chance of development right behind it. chris made landfall in mexico overnight just the latest last couple of minutes. it's down to a depression but could still soak them with some rain couple of inches of rain
