And the reason hes such an important witness for the prosecution in this case is because he can speak and is the only witness who can speak directly to win the two core parts of the case against donald trump and his alleged involvement both into the decision to pay Stormy Daniels and his alleged involvement to reimburse Michael Cohen after the fact once he one the white house in 2016, now, look, cohen is expected to act as a narrator of sorts, walking the jury through means, keyed meetings that have come up already in other Witness Testimony, one of them is this initial meeting where cohen ami chief executive david becker pecker, who was also testified and donald trump allegedly discussed this decision to make a Hush Money Payment to Stormy Daniels in order to keep her quiet in the lead up to the 2016 election. The other part of this is a meeting that happened in February 2017 in the oval office where trump allegedly agreed to how Michael Cohen would ultimately be reimbursed for fronting the money to pay Stormy Daniels. Now, jurors have already heard a lot about Michael Cohen from other witnesses, and its frankly been largely unflattering. Theyve called him and painted a picture of an attorney who was aggressive, one who was really unpredictable. But at the same time, other witnesses have made queer, including hope hicks, one of trumps closest whiteout is that she doubts Michael Cohen would do anything like this without Donald Trumps approval or knowing. So ultimately, were going to have to see what happens when Michael Cohen takes the stand. You can bet that Donald TrumpsDefense Attorneys will continue to try to undercut his credibility, try to point to the fact that hes a convicted liar and theyll try to essentially say that he was acting on his own accord when he made this payment to daniels, the prosecution has tried to basically prepare the jury for that potential. Theyve made no. Its been no secret that theyve acknowledged that hes a complicated witness, but theyve tried to mitigate that by introducing documents including texts and emails just in the last few days that they say supports what Michael Cohen will testify to when he takes the stand. So ultimately, were enough to see, but the issue of credibility here for Michael Cohen could determine whether or not donald trump is convicted or not all right, as that cohen thanks so much. So how important will it be or maybe even challenging will it be for prosecutors to get more information from cohen more than what the pulp has already heard from him in television interviews, or even in his his testimony on capitol hill well, heres where the rubber meets the road. Im sure the prosecutors have met with mr. Cohen probably ten to 15 times in preparation for his testimony. And i want to stress this. We dont know what he has provided to the prosecutors. That is in addition to what he said publicly either at other hearings, other trials, or debriefings. But i have to say this. If Michael Cohen does poorly and does not connect the false invoices to the alleged catch and kill an effort to affect the election than donald trump will be acquitted or there will be a hung jury. Its as simple as that. What if he does reasonably well in spite of his warrants in his credibility challenges, if he does reasonably well and provide some color, some editorial Real Corroboration as to why they did the false invoices than the prosecutors in closing. We will have a case to prove beyond a reasonable doubt that donald trump is guilty of the crime. They have to connect those false. I call them do souffle invoices. They have to connect to souffle to the alleged attempt to influence the election or to commit tax fraud and those invoices or any other kind of documentation what the Defense Attorneys already know about it wouldnt they have already seen it from say discovery or can they be surprised by new documentation or invoices . During trial, during testimony will fredricka i dont think theyre any new documents that theyre going to provide. But i will say this when a witness is meeting with the prosecutor and provides inculpatory evidence against the defendant. The prosecutor doesnt have a duty to turn that over or disclose it. But if theres evidence said that goes to their credibility, yes so we dont know exactly what he has said. Mr. Cohen, in all of his debriefings, he may be coming out with stuff that we have never heard heard of, conversations that we didnt know about. So thats where the challenge will be for crossexamination if the Defense Attorneys here of something that they never heard about, then thats what they call recent fabrication. And his credibility may take some hits. If its very Important Information it wasnt disclosed earlier so tamara prosecutors will get their first stab. So in their direct will it be their focus, to try to anticipate what that crossexamination is going to be like. I tried to undermine the Defense Attorneys likely questions or even approach to poking holes in the testimony ruined or i should say were winning, but trying to destroy the credibility today of Michael Cohen might that be part of the strategy so that crossexamination is not does not have the fireworks that usually crossexamination has you just you just adopted De Rossi Rule i have witnesses like Michael Cohen. I had witnesses that were ten times worse, frankly, when i have witnesses like that and i was the prosecutor, you hit the nail on the head. I would try to defuse the cross by bringing out on direct there are problems, their lives, their hiccups there, inconsistencies that one crossexamination starts. The jurys already heard it in. I build credibility with the jury because im not trying to hide anything about this witness. I had a witness that had ten fraud convictions, including perjury it was a murder trial, might defendant killed 35 people, did the jury believed that key witness . Yes. I brought it out on direct so that im cross its sort of a a nothing burger okay. So if Michael Cohen is indeed the last witness to take the stand maam, maybe its this week. Are they wrap it all up . That means closing statements are coming. If youre on the team of the prosecution or even the team of the defense . Have you already written have you already planned what youre closing is going to be now absolutely not. Every word. And i dont i didnt like the framework need my closing. Yeah. But the framework what i did after when i had a long trial at the end of each day or even after a week fitness, i would have a note pad of key points that i want to bring out or possible use in closing. So if i had a form of sixweek trial, i already had the Bullet Points for my closing. So the answer is the framework is probably already there do you expect at this juncture and this is just kind of youre i guess gas de do you think . The prosecution has the better framework or do you believe at this point the defense likely has the better framework to convince persuade, get the jurors on board i think frankly, that right now its its like to Kentucky Derby horse for the government is a little bit ahead.
