prison for contempt of congress and make history in the process up on capitol hill, the top military leaders who oversaw the us withdrawal from ghana's dan in 2021 will testify about the chaotic and deadly exit. i'll speak to the chairman of the house foreign affairs committee congressman mike mccall and, and we're following reaction to trump's claim that any jewish person here in the united states who votes for democrats, quote hates their religion and everything about israel hello, i'm wolf blitzer in washington and urine the cnn newsroom we, begin in miami, yeah, former trump adviser peter navarro is set to make history when he reports to federal prison in miami in just a matter of minutes, the 74 year-old will be serving time for refusing to turn over documents or testify before the january 6 select committee. investigators, he will become the first former white house official to ever be jailed for contempt of congress. cnn's randy k is on the c4's in miami. randy understanding navarro will be speaking to reporters any minute as he gets ready to walk in to that prison. any idea what else say? >> that's right? well, if are here in a parking lot just down the road from the prison folks here behind me, of course, setting up for this news conference. we expect that he will hello, express some anger about how all of this went down in some frustration for sure. as you know, he had asked the supreme court to intervene he wanted to remain free while i'll be challenged his conviction and they rejected that request. >> but we can tell you a >> little bit from his prison consultant who has been speaking with cnn. yes, he does have a prison consultant who was and helping him sort of transition to what life will be like on the inside and we can tell you from that prison consultant sam mangel, he is told cnn that navarro will spend about four months it's likely in an air conditioned unit for elderly male inmates. he 74 years old. there were these bunk beds, there'll be about 80 men in that dormitory he will have to take classes. he will have to get a job inside that prison to consultant said he's been urging him to work as a as a library clerk so he can avoid the warmer temperatures will on the outside here in florida and on the inside he will be able to use email. he will be able to make phone calls. he will be able to watch television. we understand there are about 12 televisions that's in that area of the prison where he will be and some of them are in spanish and some of them are in english. and the consultant also told cnn that he actually has two other clients one is a dr. one is engaged in politics and they are both going to help peter navarro acclimate, if you will, to prison life. but just a little bit about him show that he was convicted in september for not complying with a subpoena to share documents and testified before the house select committee, which was looking into the january 6, the attack on the us capitol. he did file that emergency request, as i mentioned with us supreme court, which was rejected. and he now is about to become the first former white house official. >> to >> actually go behind bars, just served time in prison for contempt of congress we know that he was sentenced to four months wolf, but his prison consultant tells cnn that it's likely he will only serve about 90 days of that time depending on how things go, because there are laws in place that allow for early release of federal inmates. wolf the lesson learned is if you get a legal subpoena from congress to testify and provide documents, you should comply with that subpoena, otherwise, >> potentially face as he is about to face four months in prison. ready. k in miami. thank you. very much. meanwhile, here in washington we just a couple of hours away from a very high-stakes hearing on the us withdrawal from afghanistan, members of the house foreign affairs committee are looking for answers about the biden administration's rather chaotic exit from that country back in 2021 to the top military officials who oversaw the withdrawal from afghanistan are expected to testify. the former joint chiefs chairman general mark milley, and the former head of the us it's militaries central command, general kenneth mackenzie cnn national security correspondent natasha bertrand is joining us right now from the pentagon. natasha, what are we expecting at this important hearing? >> well, if this is the first time that these two retired generals will be testifying publicly on capitol hill since they left their posts. and i think one of the really big questions going into this hearing is whether they're going to go further than they had previously in their descriptions of the recommendations they made to the president over the afghanistan withdrawal and further there are in their criticisms of how the withdrawal played out because they are civilians now, they're no longer in government. so whether that gives them a little bit more freedom to discuss that very chaotic exit from afghanistan and 2021 really remains to be seen. we know that the state department and it's after action review of the us withdrawal said that the decision of both president trump and president biden to end the us military mission in afghanistan had serious consequences for the viability of the afghan government and its security state department was pretty scathing here in just how this withdrawal played out and the fact that the biden administration in making that decision to leave actually destabilize flies the afghan government because it made the afghan government believed that they were no longer going to have that support from us troops in the country. so mark milley, who was the chairman of the joint chiefs of staff, he has said publicly that he believes it was a strategic failure by the united states to essentially allow the taliban to take over the entire country, to take over kabul in 2021. he has said that he believes that the evacuation of us personnel of afghan allies should have been done and begun much sooner. and general frank mackenzie, who is the centcom commander at the time he has said that he recommended to president biden that roughly 2,500 american service members today in afghanistan in order to have that stabilizing presence there, the biden administration has said repeatedly in their defense that if they had kept the troops there, they would have been attacked by the taliban because of the decision by the trump administration to strike this deal with the taliban to leave by may of 2021. and so they basically have said their hands were tied. we'll see what mackenzie and merely say today in the hearing, but it should be eye-opening because as i said, they do have a little bit more freedom now that they're not in government wolf, very important point. natasha bertrand at the pentagon. thank you very much for that update, joining us now, the texas republican congressman mike mccall, he is the chairman of the house foreign affairs committee that will hold this hearing later today. chairman. thank you so much for joining us specifically, what answers or you're looking for from general million general mackenzie today? >> why did this go so wrong? i think they're going to set the record straight. they're free to tell their story now they're not no longer within the department of defense. these are the two top generals. whoever saw the evacuation. they will say there was no plan for evacuation. if you don't have a plan, you plan to fail. that's exactly what happened in afghanistan. i think all roads lead to the state department and the white house. and i think that's what you're going to hear from these two commanding officers today? >> you mean. your thick they're going to blame the state department and the white house for the failures of the us withdrawal. is that what you're saying >> absolutely. i think what they're going to say is that there was no evacuation plan. now, the state department by law has to request the evacuation plan. they didn't do that until cobble was actually falling and the embassy was being evacuated that led to the chaos. the drama. it also what's the abrogate bombing the suicide bomber? they killed 13 service members. many of the families, by the way, wolf will be present at this hearing today. and i can tell you they they are not happy with this president. they don't think he's ever publicly apologize to them or even stayed the names of their deceased the fall their children who were killed that fateful day i know you previously threatened chairman macfarlane to hold the secretary of state, antony blinken in contempt of congress over documents related to the us >> military withdrawal from afghanistan, documents, he has since agreed to send you did your office receive all of them? and how will they figure into your investigation? >> we did. and this was a second time it go down this road. i told the secretary is not a conversation. i want to be having, but you're not you're not complying with congressional subpoenas as required by law. so the first one was the dissent cable. imagine the embassy kabul as it's getting ready to fall on the taliban's move began. we had 23 employees and extraordinary number crying for help, essentially, we need to get out of here it's going to get overrun by the taliban. we need to remove employees and the documents and distort classified documents, which by the way, we're not destroyed. and then secondly the notes to the after-action reports. we're not produced. and a second time, going through contempt proceedings, we got those documents. i have say wolf, we're sorting through the classified and unclassified. but niall say it's very revealing about what was happening on the ground at the time a very consistent narrative of chaos no plan, no direction from the white house then lead to the abbey gate suicide bombing are you prepared chairman, to hold any former or even current biden administration officials accountable over the us withdrawal from afghanistan. and what would that look like if the answer is yes? >> well, i think somebody needs to be held accountable. in what form that takes. we'll see where the evidence goes in this matter. i'm a former federal prosecutor. i don't prejudge facts until they come in. but somebody has to be held accountable for them. somebody has to say, i'm sorry for your child being killed at abbey gate. and that really hasn't happened so i do think this will lead to accountability. it should. but the fact of the matter is the commanding officers on the ground at that time were all promoted. there was no accountability within the dod. in fact, also, wolfe after the sniper testified that he had the suicide bomber in his sights and requested permission to engage him he got no response from his commanding officer that does a case where there's no accountability present. the dod has yet to produce any of the documents that the chairman of armed services and myself have including the sniper photos, which were confirm if this was indeed the suicide bomber. we also need to hear from the commanding officers on the ground that made these decisions or lack thereof in terms of dealing with isis k and suicide bombers, this will be a very important hearing because the us has to learn the lessons if there were major blunders that developed during the course of that withdrawal, the uss to learn what happened, to make sure it never happens again, i speak as a former pentagon correspondent right now while i have you very briefly, mr. chairman, let me discuss with you israel's war against hamas in gaza, the white i said yesterday, the president biden made clear to prime minister and ateneo that a ground invasion of rafah in southern gaza would be a mistake and that israel should pursue more precise strikes on hamas us targets. do you agree with that >> well, as i said on sunday, i do believe as i was briefed on for israel, the idf two go after high-value targets in hamas. i hamas high-value targets in gaza. and that would be close to rafah. that's where they are right now. it seems to me you don't have to do that with you know, 100 tanks rolling in you can do that in a very special operator standpoint. and i believe and i i hope that's what israel is contemplating is to target these high-value targets of hamas in rafah hamas is eradicated and they will not stop during ramadan but there's a difference between 100 tanks rolling in and special operators going in with a specific mission to take out high-value targets very briefly before i let you go, mr. chairman, i know you have a lot going on. i want to get your reaction to what former president trump said yesterday saying that any american jewish person who actually votes for democrats in his word, that person hates their religion and everything about israel also hates everything about israel. do you condemn? but the former president is saying, well, i think religion is a very personal matter i think yeah, italy politics out of it but i will say is i mentioned on sunday that even chuck schumer now is being impacted by the base of his own party. there's no longer this traditional alliance with israel that we've seen in a bipartisan fashion ever in my term, terms in congress, over 20 years. now you're seeing a factual within the democratic party. this more pro-palestinian and anti-israel. and i think that's a problem for the democratic party as they deal with their base. >> but you're not prepared to condemn what trump is saying about american jews who are democrats >> now, i can't comment on every trump comment every time i go on cnn ib talking till midnight tonight. so we'll suffice it states a very personal matter, religion and wouldn't be my words, but having said that, i understand is cinnamon but the democratic party's not representing their talks has ended in doha, qatar israel's head of security services, the mossad, david barnea, has just left after meeting with officials from egypt and qatar. that's countries have been the main go-between with hamas, israel's foreign ministry now says a counterproposal is expected to be sent on mass, but no timeline was given barak ravid is joining us right now. he's a cnf political and global affairs analyst and a politics and foreign policy reporter for axios xes barack. thanks. very much for joining us. i know you're doing excellent reporting on all of this was any meaningful progress made in these latest round of talks in doa, what are your sources telling you? >> hi wolff. >> first >> as you said mossad director landed back in israel earlier. today, but why big israeli negotiation team stayed in doha to continue those talks and those talks are taking place in this secluded compound in doha work qatari and egyptian mediators are just sort of like shuttling between two to three months let's i'm talking about i mean, negotiating about how we are going to negotiate now, there's actual negotiations of the details of the deal and this is going to take something like and >> that keeps getting worse. so let me walk you through those two stories >> and again, i'm >> hoping as journalists, you will, you will do some background, some research >> i'm i'm i'm asking you >> to fact check everything i say today. and right. the >> bigger stories here, which i think are the important ones. so let's, let's talk about some facts here. i am the >> first senior white house adviser in the history of our republic that has ever been charged with this alleged crime? and i say alleged because for hundreds of years this is not met a crime and for 50 years, the department of justice has maintain the principle of absolute testimonial immunity. and it was only with my case that somehow that has changed and here's here's where the homework is, because the big constitutional separation of powers are these can congress compel a senior white house adviser, what they call the alter ego of a president to testify before congress and executive privilege goes back to george washington. and his remarks to the congress regarding the jay treaty he said very simply and clearly simply, elegantly that to write to the congress, he said, i cannot command you as members of congress to come to me you cannot command me to come to you. and the reason is the constitutional separation of powers and as legal doctrines have evolved in the supreme court has been very adamant about the sanctity of privilege that privilege has extended to what's called alter egos of the president, which is what i am, as one of his highest advisors and the principle here related to effective presidential decision-making is simply that if a president does not >> have the ability between and among his advisers to get, we're just going to continue to listen a little bit longer to peter navarro is walking into a federal prison. kaitlan collins is with the here. you've been doing a lot of reporting on this story. he received a legal subpoena from the united states congress for the select committee to testify to hand documents. he refused to comply. it went through all the courts, including the supreme court, was just the other day refused his appeal to avoid going to jail. yet he's continuing to insist that what he did was legal right. wolf. i mean, he is saying one thing there that is very much true that this doesn't happen, that he is the first time this has happened, right? a senior white house official >> what happened in his >> case though, is different than even steve bannon who was charged and convicted with a very similar crime for not responding to a house january they six investigation subpoena. the difference is that the courts found that peter navarro, as much as he talks about how he was a white house official. he forfeited any ability to say he had executive privilege in the court system once he received this charge and he still had to appear before congress and turnover document and he did not now, there was a period of time long ago when congress did walk people up on their own whenever officials didn't respond to their subpoenas, we aren't in that era anymore. and it is very difficult for the justice department to decide they want to bring a case like this and take it through the courts but what happened here is he just didn't have this executive privilege bubble as protection. and the court system said this is a prosecution that the justice department can bring at the end of the day. it's good for congress that they can have enforcement like this. peter navarro says, it's very bad for the executive branch. but this is just evidence of the consequence of what happens when you just don't show up for congress. >> the courts rejected all of his appeals over these many, many months and now that's why he's going to go right >> now, voters in ohio are headed to the polls for a very high republican senate primary. the three-way race is a critical test of the power of trump's endorsement. the winner will face off against democratic incumbent senator sherrod brown. in erase that potentially could shape the balance of power here in washington. cnn's chief national affairs correspond to jeff zeleny is joining us now from a polling place in ohio's capital city of columbus. what are you hearing over there, jeff? >> well, of course this is going to be one of the marquee senate races in the fall. senator sherrod brown seeking a fourth term, but that's only part of the story. the other half of the story is playing out here today. that is which republican will be nominated to challenge him in the fall. and it has been a divisive, heated campaign, a three-way contest, as you said, secretary of state frank larose is running as well as state senator matt dolan and cleveland businessman bernie moreno former president donald trump has weighed in aggressively in this race. he is backing bernie moreno, but the governor of the state, mike to wine. he is backing matt dolan. of course, their styles are different. the substance since is different. we could up with senator dole and last night he had this to say about the importance of this race >> i have fought and gotten results because if you're not getting results, you're just shouting. and we've had too much shouting in our country too much shouting in our country. so a bit of a not some veiled reference, perhaps to foreign president donald trump, who was here in ohio over the weekend campaigning for bernie moreno he was aggressively going after matt dolan, whose family happens to own the cleveland guardians. of course, the longtime baseball franchise. trump was criticizing them for changing in the name from the cleveland indians. so that of course has nothing to do with this senate race, but wolf, it just gives you a sense of how expensive and how acrimonious this race has been. some 40 million spent in tv ads alone on this the reason it matters is of course, sherrod brown is one of two incumbent democratic senators. the other being jon tester in montana that really are running in red states in states that trump won significantly. so sherrod brown for him to win a fourth term he clearly needs to win over some trump voters as well. we talked with him yesterday. he said he is running against presidents of both parties. he is a representative of the people. so this will be a test of his strength no doubt wolf. but first things first, this primary tonight we'll show who shared runners running against. and if republicans believe they have a strong chance to beat him in november, we shall see all right. >> jeff let me get your quick reaction. first of all, to these latest trump comments look at this moment when the jewish community feels so very much at risk, it >> is dangerous and it's divisive to bring the jewish community into a debate in a way that tells them what they believe, how they behave as jews how they feel about israel. this is a moment again, where in every part of the country and all around the world, the jewish community is really facing dramatically increasing anti-semitism and where israel is fighting for its survival. as this political season moves forward, i hope that both president the trump and president biden, and every political candidate running for office will understand that the jewish community should not be used in some political purpose and that in fact, wolff, the last thing i'll say here is when you suggest that the jewish people only have feel a certain way about israel there are so many, unfortunately right now, who are at the same time invoking dual loyalty and old anti-semitic trope. this is what we're battling. so let's try to focus on the issues at hand. let's try to think of ways to actually they bring the jewish community together. that's what, that's what we do. that's the way we need to focus and political comments like this make it increasingly more difficult. they're dangerous and we shouldn't hear them any further. >> why aren't republicans publicly and strongly condemning trump's hateful comments? >> well, if i so proudly run a nonpartisan organization now and in that role i don't i don't guess what people are doing politically. i comment on the actual things that are happening and what we're seeing happening is that on the far left and on the far right in america and around the world jews are being put at risk and we need to call that out wherever we see it whatever party we're in, we have to call it out on the left even democrats need to do that. we need to call it on the right. even republicans need to do that this is the in the best interests, not only of the jewish community, but if the world and wolfe, i just have to say that one of the most important things we can do here is to remember that this is taking place in the context of a war in israel. that so often the media forgets was started by hamas when they slaughter 1,200 people, when they use sexual violence as a tool of war. when they continue on by taking hundreds of hostages and when they still hold 134 hostages, including americans now, more than 160 days since they were taken into captivity, the president was right yesterday, jake sullivan talked about this the hamas has blood on their hands, including blood of americans. and the best thing we can do is to rally behind our ally, israel as they seek to defeat hamas. not only for the good of the israeli people, but for the good of the entire region. reading the region of this terror, threat will benefit everyone including and especially the palestinians who have been put at risk by hamas is dangerous vial anti-jewish, anti israel actions. >> you make important points. so let me get back to what trump said. he said, american jews who vote for democrats that's an former democratic congressman hate their religion and hate israel i want specifically, he's really attacking you and all the democrats out there who are american jews, who a vote for democrats. and what do you say to that? >> the jewish community has a range of opinions. i mean wolf, you know, you know, the old phrase to jews three opinions. we have lots of different opinions in politics. that's true as well. and we know heading into an election when people feel so passionately about the knee hey, to defend the jewish community, and about the need to ensure that israel winds its war against hamas, and that the world understands what israel is facing. and that the truth about israel's delivery of now close to 210000 trucks of humanitarian aid is actually told and we don't let hamas draw it drive the narrative coming out of what happens at this moment. let's respect differences we shouldn't have presidential candidates or candidates for any office telling the jewish community what it thinks, how it should feel, let alone what it says, what their views say about them, and their view of their own religion and their view of israel, which is so dear to the vast majority of the jewish community. >> yeah, i know you love israel. i know your love your religion. and it's pretty outrageous with the former president of the united states or current republican presidential presumptive presidential a jackson county sheriff's deputy, hunter elward was given 20 years in prison after pleading guilty in the case where two black men were tortured last year in their home, seen as ryan young is in jackson, mississippi for us. so ryan, explain what happened in court. you watched it all unfold yeah. we did watch it all unfolded and falling this case for over a year. we actually learned about a third victim in this case as well. but the two victims, the two black men, were in court and they got their first chance to stare. a hunter elward as he came into court. he was dressed in all blue and in fact, to protect his identity while he's in jail, they actually had the back of his smock that he was wearing blacked out he at one point turn to the victims to apologize. he said there's never a time where he closes his eyes and he doesn't see those two men on a nightly basis. with all that going on. eddie parker stood up and actually said, i forgive you. it was a moment in court. >> i don't think anybody will >> forget for quite some time as people were in tears at some point during this court proceeding the mother of michael jackson also stood up and said, i am not just a black woman i am a mother who cares about my child. and this broke me because for months she did not know where what would happen. no one believed them for quite some time. well, if they've been people who've been digging on this for quite some time to figure out exactly what happened that night. and we learned but the men showed up to the home, kicked open a door, and just started attacking them over and over, tried to sexually assault though waterboarded >> and tased them over and over. in fact, they one time they had a hot potato where they tried to see who's taser was more effective at creating pain and after this was all over hunter elward is parents were walking out the door. i got a chance to speak with them. it's the first time that we're hearing from that side in terms of what actually happened here. take a listen, wolf that was going on inside that sheriff's department for quite some time in the he was taught that you believe that? >> i do >> absolutely. >> what do you believe? if because once we really couldn't hear it, because it's obviously inquiry. but do you believe there was someone teaching these practices to the loo? >> they >> they as soon as he started seven years ago brett as well. this is a federal court. so obviously we can't have our cameras on the inside. but i do believe and this is the first time that the victims, eddie parker and michael jenkins had a chance to hear from the family and also hunter himself. and when he turned around and looked directly out of me, actually asked a judge for permission to do this the entire court stopped and you could see the tears flowing from their faces when the victim impact statements were red and it talked about how they were brutalized over and over. no one could believe some of the things that were read, especially in 2023, to think that not only did they plan this out, they actually had a text message stream that they would coordinate with each other. they showed up to the house, they made sure there were no cameras that would see them, and then they broke into the home and torture these men's for over two hours. and after this was all done and after the gun was placed in the mouth of mr. jenkins and the shot was fired in his tongue, was severed they cleaned everything up. wolf to make sure there'll be no evidence left behind. and one of the things that we wanted to play in that soundbite and we didn't get all of it to you. was i asked his father, why did he want his son to tell the truth? he looked me in the eye. he said the reason why he wanted his son to tell the truth is there's no way there could be healing. now only for their family family, but for the victim's family and all of rankin county or less. so one step forward and told the truth. so it seems like the families indicating that it was elward who helped give the government evidence and all this case. the government, for its part pointed out very clearly but, they believe these are sort of tears of fiction at this point because at every step of the way they went to show a cover-up and to show that these men intended to put hormone these two men for dating a white woman, and they told him to go about across the river to jackson these are words that were said in open court and let's not forget, there are more sentencing that's coming ahead we have five more men who face charges >> and the other >> victim did come crisis intake form for haiti is approaching 1,000, but it's important to note that doesn't mean that there are 1,000 americans who want to get out of the country. it means that there are i was in americans potentially around that number who have reached out to the state department to be in touch with them about the security situation. listen to how the dot described that outreach did you have
