waking up to this reports of tornado damage in the area roughly between indianapolis and dayton, ohio police in logan county, ohio are reporting to people killed we're gonna get much more from our next few hours. uh, judge's expected to announce whether district attorney fani willis will remain as the prosecutor in the georgia election subversion case. the defense is seeking to disqualify willis for having an intimate relationship with her lead prosecutor, nathan wade judge scott mcafee, who is up for reelection, telling cnn affiliate wsb that his ruling won't be based on politics. joining me now is bob q psaki is editor in chief at the hill. bob, good morning. it's wonderful to have you a morning thanks for being here so let's talk about this, judge. i mean, he obviously really in the hot seat here. this is the last day he said he was going to make a decision basically by the end of this week. >> here we are. it's friday. what what are the pressures on him here and what is your sense of which way this is leaning right now? >> well, i this has become such a mess. i mean, i think in many the ways this was the strongest case against trump. but this has become a bit of a sideshow. so in some ways, i think if she is disqualified, it could actually help the prosecution. but this has been a disaster. and as you know, the trump team has been looking to delay and also throw everything at her and it's worked at least in a pr sense. >> yeah. let's watch. actually it mean trump has been pretty straight up about what she's trying to do here. let's just remind everyone wants his comments we don't know what's going to happen. we want plays, obviously, i'm running for election. i get up. >> can you >> run for election and be sitting in a courthouse in manhattan? >> so that was back on february 15th. and this is just one of four of his trials. but so far the delay strategy does seem to be working for him. >> yeah. and certainly in the primary, these indictments did not hurt him, but convictions are a different thing. and now we're moving into the general election. think that there's a real risk that his poll numbers do take a hit. however, right now if you look at the battlegrounds he's winning most of them he is. and this is very different than 2016. remember, he was behind the whole time. now he's winning. you mean in 2020 >> biden, but well against biden, yes. but even in 2016, he was also behind. so this is a new spot for trump but while things are going well this year, you got to expect the unexpected yeah. what is your sense of i mean, he again, that was outside of a courtroom and he been complaining, well, i should be campaigning. i'm in this courtroom. >> he >> usually doesn't actually have to be in court for these things. i mean, he didn't debt that. there will be a time when he may have to be there? yes. >> but we have not gotten to that point yet. correct. what is your sense of the difference >> between a general election decision to show up in the courtroom versus a primary campaign one, because we are firmly in the general election now. >> yeah, i think there's a real danger for trump, as you said, he's making choices now to appear, there are a lot of things going right for trump, but at the same time money is a problem for trump because these legal fees are piling up and i know the rnc republican national committee may help him. but at the same time, i do think there's there's courtroom fatigue, so i think he might be wise to not go in the courtroom at least when he has a choice, because as you mentioned later this year and in multiple cases, he may have to show actually show up. >> yeah. >> what is it? what do you make of what's going on in the new york case? because we learned yesterday, alvin bragg went along with a delay in that trial late april. and it does seem like this was actually a mistake on the part of southern district of new york prosecutors who just turned over a whole bunch of documents that now both sides need time to review that. just play straight into trump's trump's hands. >> i think it played into his hands, yes. but at the same time, it looks like the big question is which trials are going to start before the election? because that's part of trump's game plan. this one is going to start before the election. it looks like, but i think that was a misstep and that's why there's saying okay, we can go for a delay, at least a short delay, a month old what's your sense of where the new york case fits in terms of like if we're going to rank these things as level of risk to donald trump's political fortunes where is the new york case on that list >> i think it's not at the top. >> a harvard harris. >> all recently that if he's convicted on the january 6 charges, the numbers flip for biden, but in these other cases, yes, they get closer. biden gets closer to trump, but he's not winning. so i think the january 6 case is one. he's got to worry about the most. i think the hush money case, it's not as strong as georgia, but as we talked about, georgia does just a mess right now >> we should note in georgia, the judge did leave the central piece of the case standing, the racketeering charges. right. but he did take out six of the charges that were included in there. he said there's no basically legal basis for that. how much weaker do you think that means? the georgia case, if at all? >> i well, it's not a good headline for prosecutors when those things because those charges, according to the judge, too vague. so i think that big picture, it's not a big deal, but pr wise, it's a big deal that when charges are getting tossed, that's at least a mini victory for trump, right? >> well when his whole goal is also to muddy the waters, make it 20 people were killed and more than 150 injured while waiting for food in gaza city. videos sent to cnn from the al-shifa hospital show patients arriving at the emergency unit yesterday? i witnesses say the area was struck by what sounded like tank or artillery if fire. >> the gaza >> health ministry claims the israelis were behind the attack. in a brief statement to cnn, the israeli military denies responsibility. cnn's scott mclean joins us now from istanbul. scott, good morning. what more do we know about this tragedy? >> hey, good morning, casey. yeah. so this happened in an area called the kuwaiti roundabout it is essentially a central area where aid trucks, the ones that are able to get in usually stop and unload what they have. and because of the the levels of hunger, famine in many cases, and really desperation. it obviously attracts a crowd and that it seems is what we had here when this attack took place, as you said, witnesses describe what sounded like tank or artillery fire israeli say it wasn't them. but the hamas-run health ministry says that this was a deliberate attack by israelis. now we know that the idf troops are typically stations near to that round about and there was another incident of violence on wednesday when seven people were killed after the idf idf opened fire, they didn't comment on that particular incidents, but they did confirm that they struck separately on wednesday in aid distribution warehouse run by unrwa killing five people. they they said they they took out a hamas commander, unrwa says that, look, this was in violation of international law in the israelis knew precisely what they were hitting because they had the coordinates in advance as they have with the 150 other unrwa food warehouses or distribution sites that have been hit since the outset of this war scott, how is this going to impact aid shipments that are set to arrive in gaza today >> probably not directly, but obviously it is a reminder for that shift that they are entering an active war zone and obviously given the level of hunger, given the level of desperation than it is all the more risky and all the more challenging to ensure that this is a smooth orderly handoff of these pallets of aid. a packed into this ship, which by the way is a spanish ship. it's called open arms. it is normally used for shipping, search and rescue. it is polls today for day one of a three-day election that is all but decided before a single vote was ever cast. vladimir putin is expected to secure his fifth term in office any credible challenger has been killed, exiled, jailed, or banned. the widow of opposition leader alexey navalny is calling for voters to turn out collectively at noon sunday. that's the last day of voting as a show of opposition support port. cnn's matthew chance joins us live now from moscow. matthew, good morning to you at russians can vote either for putin or for one of three kremlin approved candidates. what's the mood in the city today? >> well, i mean, look, you joined me inside a polling station in central moscow where people have already started to come out and on cast their ballots. the cast their votes for one of four candidates. but as you say, because of the sort of inevitable outcome of this lecture putin victory. there's not a great deal of excitement amongst the voters about what the outcome will be. it's more of a dutiful, patriotic but the thing that people are doing coming out to register their support for that preferred candidate. again, this, this is the polling station. you can see a couple of people here that have come to register that they'll be getting them ballot papers and then they can sort of like tick the box. they want and do that either electronically with these machines here or put them into a halep box over there, look the reason it's such an inevitable outcome is because the opposition in russia has not been permitted to stand in these elections. there's been blanket coverage of vladimir putin on state television. and of course, the really critical that the critics of the kremlin like alexey navalny like people who have been sort of campaigning against vladimir putin for many years, well, they've been silenced, jailed, exiled, or of course, in the case of laminar okay so if alexey navalny he died in his arctic penal colony last month. and so that sort of crackdown has really sort of center a repressive atmosphere across russia. and so again, as i say, this is russia going through the motions of a democratic process, but no one really seriously doubts that vladimir putin at the end of it, is going to emerge as president for our fifth presidential term. kasie preordained matthew >> chance in moscow. matthew, thank you you see here illuminating the funnel cloud to know that they're there is a tornado imminent and about to strike your neighbor hood that's terrifying. you have to have multiple ways to receive weather emergency alerts. whether that's from your cell phone, your radio, your television, but sometimes you know, our power gets knocked out with strong storms that move through like this extremely dangerous. we now have learned a fatalities. you can see just several videos that are coming into cnn of a parent current tornadoes, pretty obvious here, touching the ground as well. so there was significant damage. this is just one of the examples. this is milton, kentucky. look at homes completely destroyed roofs taken off of buildings, and flipping vehicles. look at that that our v yeah, that is very, very scary. can you imagine if somebody was is inside that there were actually reports earlier last night of people trapped inside of their homes and in their structures overall so far, eight tornadoes confirmed. many of them coming across the ohio river valley. this line of storms, which we know have produced tornadoes, continues to advance south and east. the good news is there's a more stable environment in place across the gulf coast states. so these lines of storms are weakening. however, they still have the potential to bring large hail, gusty winds, damaging winds as well. and we can't rule out an isolated tornadoes. i'll show you the specifics in just one moment, but lots of lightning associated with this heads up jackson, mississippi and to birmingham later today and to atlanta. there's the threats, greatest risk of severe storms today, right near the border of mississippi and into alabama. now, check this out. the other part of the storm is the cold air that brought the heavy snowfall. this is coming out of boulder, colorado and you have very challenging driving conditions since to say the lease, some people got more snow than others. check this out. we're talking about five to ten miles separating downtown denver from the airport the big winner, 45 inches of snow and assmann springs, it continues to snow across the san juan mountains and throughout the four corners. so what a wild day of whether we are hard to really break for the people who are impacted by the tornadoes and what happened yesterday evening? >> yeah, hearts go out to to motions to dismiss charges in his classified documents case the former president did get a small win in new york, new court filing show the manhattan district attorney's office is willing to delay trump's criminal hush money trial for up to 30 days that would push the start date of that into april, giving trump's lawyers time to review new materials that were turned over by federal prosecutors this week that had played right into trump's hands we don't know much going to happen. we want delays, obviously, i'm running for election. i get up when you run for election if you sitting in a courthouse we want delays. >> obviously, he says cnn, national political reporter, daniel strauss joins me now with more daniel. good morning. >> good morning to see you. >> so this >> delay, honestly, it was you could probably lay the blame at the feet of prosecutors and the southern district of new york for this delay, alvin bragg's the da going along with it they have to read the material as well, but it really does play right into the trump strategy overall, which is trying to delay all these until the election, right? >> right. >> and that's a big part of i mean, for two reasons, the trump team really wants to hold back on and delay as much as possible. one is just more time for him to be on the campaign trail and two, it raises advance that he won't have to worry about any conviction until if he's elected president being in office and then he can pardon himself. >> yeah. well, i mean, it's more complicated in the new york case specifically, but i take your point, and abroad hadley, especially with the federal cases what else did you see? i mean, we're expecting a ruling from the judge who is considering whether or not fani willis is going to be thrown off of the case in georgia. he's already made a couple of moves that seemed to side at least a little bit with the defendants in throwing out those six charges what is your sense of how this is going to cut? >> i mean, look, it's a funny situation because on the one hand, trump and his team really want to highlight the situation that fani willis is in. they want to argue that this is a larger son in of of unfair play and corruption. but at the end, it really doesn't affect what, what trump is facing the charges he's facing in that whether she had this i mean, whether she's convicted about not convicted, whether she is facing whether she's thrown off the case where there's just thrown off the case or not. thank you. does not affect the weather that trump is still facing these accusations in georgia. and i think in the end, it's for him very much a pr battle. he sees this as sort of a fight in the public arena and public perception and if he can delegitimized his prosecutors, he feels that he's going to win in the end. >> in some ways, he's already made some progress on that, right danielle, let's talk for a minute. change gears and talk about your report. putting because as obviously the legal cases are proceeding against the former president, he is also at moving forward with what is going to be the longest general election campaign one of the things they're doing is trying to consolidate power at the republican national committee. i mean, this is not an uncommon way of doing things, but i know that you've been reporting it out and digging into what they're doing differently. what have you learned? >> well, this is unlike most cycles, this is a campaign that wants to be lockstep with the rnc so much so that they want the rnc to focus only on real acting. donald trump. and usually a national committee has other mandates helping to reelect or elect republicans across the board but here, the new team that trump is putting, installing at the rnc wants the committee to focus on election integrity >> and >> a lot of that and fundraising, but not so much. >> gotv or >> buddha, or boosting lower ticket candidates, which is unusual because again, the job of the rnc in general is to help republicans at every level and really support them across the country, especially among state committees. and the trump team sees this is just something they want to meld. the organization with the campaign as closely as possible. >> yeah. i mean, i will say it's not unusual that a president will not a whole and take over the committee, but it really does become kind of an arm of their campaign. pain and its own way. i find the election integrity focus to be interesting. i'm in the word that they're using is aggressive. what do you how do you see that playing out? >> i mean, it falls into sort of a key sentiment that the former president feels right now about the 2020 election. and the rnc, which is that he feels that the rnc did not do enough to pursue claims of election fraud and he wants to see a more aggressive push on that front. he wants to see more lawyers. he wants to see a more robust election integrity division within the rnc and and he wants to see essentially a more focus committee on that single pillar of its jobs. >> well, we should and we should see that as foreshadowing what we're going to see in november, daniel strauss. daniel. thank you very much for out for that. i appreciate it. >> right this sunday is st. patrick's day and ireland's prime minister, leo varadkar is expected to make his annual visit to washington irish-american members of congress are usually particularly excited to see him. i remember when ted kennedy was a member, right? everyone is in green ties. it's typically festive. >> it seems like this visit is going to have much more serious overtones. why? yeah, absolutely. i mean, this is an annual fund and festive tradition, but this year really overshadowed by israel's war in gaza. and as my colleague kevin liptak reports, that is informed by this very close ties i is between the irish people for the palestinian cause, informed by what many regard as the shared history of oppression and violence. and so there is enormous pressure on the taoiseach this year. it's a fun event. they have the white house fountains dyed green. there's this big lunch, as you mentioned, they exchange a bowl of crystals across so bowl of sham rocks. but this year, that is their overwhelming calls for the to ship, to boycott this visit. and from his constituents and also from a political leaders in ireland >> so how do you expect him to handle this and how do you expect president biden handle this as well because of course, biden is irish american, right? he embraces those ruth, he's visited ireland. this is something that's very personal to him and we know how his personality can come out in these kinds of settings. but potentially there's a difficult line to walk because it's so politically challenging for him here at home as well. >> yeah, that's absolutely right. and the taoiseach has made clear he is not canceling this visit, but he is going to make a very clear, enforceable call for an immediate ceasefire, for a peace process. and that's not that different from what biden recently has been stepping up those calls for ceasefire. the difference here is that the president does not plan to condition us military aid to israel >> betsy more broadly, i mean, how do the irish view what president biden has done for them in looking at how he has navigated for any questions around northern ireland and his general support for them. >> i think there's enormous support for that. and it also comes as he's facing this political pressure at home for his handling of this war more broad oddly, that's width from irish americans and americans in his own party, we saw what happened in minnesota. we saw what happened in michigan where all those democrats voted uncommitted. the white house trying to do this outreach to the muslim and arab american communities. but really struggling to break through a lot of those leaders that we've talked to in the course of our reporting we have said that they're not interested in meeting with the president and having any engagement with any white house officials until there is a full ceasefire >> all right. betsy klein fits, get your slipped >> motion denied us district court judge aileen cannon declining to toss out the classified documents case against donald trump. it was one of two motions heard on thursday. the former president's lawyers tried to make the argument that the law prohibiting the unlawful retention of national defense information was too vague to apply. and that's just one of several trump legal developments unfolding, unfolded thursday more to set to unfold today, joining us to discuss as david shown, trump's trial defense lawyer in his second impeachment trial. david, thanks for being here. thank you very much >> for having me. >> so we've got a lot to get to here. let's start with what happened yesterday. judge cannon told a trump lawyer that throwing out these charges because the law was vague would be quote, unquote extraordinary but there's still another piece of this motion, the chest to rule on a second motion, although she seemed to express skepticism and that's around the presidential records act, which the trump team is arguing requires the case be thrown out. what did you make of the way judge cannon handle this yesterday? and do you think the trump team is going to be successful in this second motion? >> very interesting questions. i think she handled things very well, frankly, i think that she acted in a reasoned and measured manner. i don't think that the denial without prejudice the void for vagueness motion was a critical development. i think she's absolutely right. it would be an extraordinary measure. i say she acted and reasonable measured fashion in the sense that she said, we'll revisit this perhaps during the jury instruction, jury instruction period or something like that she said that they raised serious considerations, but she wasn't prepared to dismiss it. i think that's entirely appropriate on the other issue. i think there are several other issues, but on this presidential records act, the sides are absolutely as polarized as they could be. the government's position is presidential records act is completely irrelevant to the question. it's a different context completely and the trump team is position is it's everything in a sense, presidential records act is somewhat, it's a statute that describes who has the right and responsibilities with respect to presidential records, what the defense team is relying on primarily is this 2012 case from judge amy burma jackson radically. she's not a fan of president trump at some of our past decisions have indicated that case involved for president clinton and in it she said, basically looking at the statute that the statute only designates one person who can determine whether records or personal or presidential. and that's the president. the archives doesn't have a role in it that designation process. and so the defense relies on that. but whether or not one says the presidential records act applies, i think it's directly relevant to the mens rea of the mental state required under the statute, the statute requires that the defendant willfully have misused in one way or another national defense information. i think defense would argue that willfully, by the way, means of course, in the criminal context, the one does something that he or she knows to be wrong are against the law they would say that the presidential records act, at least informs the mental state of the defendant this case president trump, former president trump. and so that when he got advice that he had the right to designate and that he designated while in office, these were personal records. he couldn't have had a criminal state of mind, therefore, shouldn't be prosecuted criminally and so on it's a very interesting and real issue. but there's some other things by the way, i think that primary issues in this case ought to be whether judge, howell in the dc court who ordered evan corcoran, president trump's former lawyer, his records to be turned, his notes to be turned over almost in wholesale fashion, whether that violated attorney-client privilege and tainted the grand jury process. there are a number of interesting issues i'm sorry to talk so long >> yeah, we've kinda dug into a lot of details here why don't we why don't we sort of pull out and do a little bit big picture and then we can drill down we need to. there are obviously four situations playing out now. i mean, three of them have kind of developments over the course of the last couple of days we've been talking about classified documents case. there's this delay in the new york case then there is also the georgia election case. we are anticipating a ruling from judge scott mcafee as to whether or not the da a fani willis can continue in her role there. when you look at these, if you are thinking about all of trump's legal problems in a holistic way, which one. and are you good about and what it's a great great question. >> i don't know the answer that i think that each case blends its own challenges. what i have felt most recently is that the focus really must for the defense team must be on the new york case, whether they and the public thing that's the lead is serious case or not, when one is sitting in a courtroom, especially with a judge like judge merchant who's in my i hate to say, but a real trump haider. he it's not a pleasant situation and i find him to be very prosecution oriented and very sensitive public opinion. go on so i think that's the one that really ought to be the focus. now, the other cases really are sort of on hold in a sense we are waiting for the immunity decision. i think they have to wait for the obstruction of justice decision from the supreme court also for the dc case georgia case, as you say, is playing out with his fani willis issue. i think the conventional wisdom among local lawyers here and both involved in the case and not involved, is that the judge is going to have to disqualify her, especially based on her testimony. and mr. wade's testimony, which many people feel wasn't truthful and i don't know that's kinda where you have it if she were to be disqualified, what do you see as the future of the case? >> i think the case goes on, frank, i know a lot of people have said skeptically that it wouldn't. but as you know, the prosecuting attorneys council then would appoint another district attorney around the state to take over the case. i think politically and otherwise, since the grand jury has returned indictment here, it probably doesn't go away. i think there are a number of issues in the case that could make it go away, but i think politically that would be a tough one. but it certainly would be delayed. >> yeah. >> all right. david shown for us this morning, david, thanks very much for joining us. i
