cnn breaking news costa and washington, we are following breaking news up on >> capitol hill at any minute. house lawmakers are expected to vote on a bill that could effectively ban the social media platform tiktok. here in the us, quarters of a potential ban claim china based parent company bytedance, could somehow use tiktok to spy on americans who use the app if signed into law, the measure would give the company less than six months to sell to a non-chinese owner. if bytedance fails to do so, tiktok could be all but shut down here in the us, users of the platform, which is wildly popular for among younger americans, are trying to stop that from happening >> i know i'm not the only one that relies on this app every single day to provide for their family i know i'm not the only one that relies on this app to get by. >> it's taken me six years to get to this point literally not even a month ago. i quit my job to do tiktok social media full-time and there are 80 years of generation z that are now eligible voters in this election year. >> do you really want >> to them all off by taking away their favorite app where they make friends, where they make contents, where they laugh, where a lot of us creators make our money. you want to take that app away. >> it could happen. let's begin up on capitol hill with cnn chief congressional correspondent, manu raju. manu. a lot of last-minute lobbying, some strange bedfellows on this issue. republicans, democrats who are supportive of this and we're also against this. >> how close is this is going to be? >> while we do expect this to pass in the house, will need two-thirds majority to get there and we do expect a bipartisan majority choosing the concerns over national security, over the concerns of our freedom of speech in the middle of this hotly contested election year, even as donald trump has lobbied against this bill because he contends that it could hurt, it can help facebook who need to test. trump also met with tiktok, megadonor recently as well, reversing his position on this and also warnings that if joe biden were to get behind this bill from some democrats who are warning that, that could actually hurt him with some young voters let's i don't think it'll be helpful with young voters, but, you know, my argument here, yes, it has to do with young people. but taking a step back, i just think it's bad policy, which just for politics is addition, multiplication and cutting out a large group of young voters is not the best known strategy for reelection, but trump's opposition to this >> i agree with him the first time on the first time around on this when he is president tried to ban the foreign presence, trying to kill it. >> well, he's wrong so even though jim, this is expected to pass the house and just a matter of minutes, its future in the senate is much different. there are concerns about the way this language is structured even from proponents who support banning tiktok and gloom. someone like senator mark warner, the senate intelligence committee chairman, who was concerned about naming specific company in this legislation which would force beijing owned bytedance to sell tiktok, if not tiktok will be banned on social media platforms. here in the united states, he's, he has raised constitutional concerns. there are different versions of the bills that are moving around the senate right now in the majority leader in the senate, chuck schumer indicated that he is in no rush that they want to move go to the committee process and figure out the right way to move ahead here. so this is going to take some time to play out in the senate, but that does not mean that the debate on the house floor at the moment, very emotional at this key time where they're trying to get this bill through and we're expected to expect it's expected to pass here in a matter of minutes, jim all right. >> we're gonna be watching that vote. manu raju. thank you very much. in the meantime, china is lashing out at this potential ban and delivering some strong words to the us cnn, international correspondent marc stewart joins us now from beijing, mark, you heard from china's foreign ministry this morning. where do they say? >> india and. look the messaging from beijing to washington is very blunt. it's very direct and the phrasing to washington is you're acting like a bully. this at a time when the united states and china are trying to figure out this working relationship, especially when it comes to these matters of business and economics. i did talk to the spokesperson for the ministry of foreign affairs and i said to him regardless of what happens in washington today, there is still this feeling of distrust from american lawmakers, from american citizens toward chinese companies. let's listen to what he had had to say >> kinga may voucher to me, even though the us has not found evidence on how tiktok and dangerous its national security. it has never stopped going after tiktok such practice of resorting to acts of bullying. 11 could not succeed in fair competition. disrupts the normal operation of the market it turned reminds the is taking all of this. and i asked is the government advising bytedance on how to proceed? the response i got, jim was very much in line with what you've just heard no real insight as to what kind of approach what kind of role the chinese government is taking, if at all? >> yeah, i'm sure that that is not helping tiktok's cause here in washington when they have that kind of posture, our marc group of teenagers buying them. i was just thinking, what would happen and bonnie were to turn around and talk to these teenagers i mean, for the ones who are i guess not in school right now now, they must be looking over their screens and saying, wait a minute, what, what's going on with tiktok >> well, i don't know. i don't know. i don't know if we take our cues from teenagers at the time. you know, this is an could be a national security issue. there's certainly concerns about it and, you know, i wrote about it years ago. this was propaganda and surveillance from the chinese government it is going to be a problem going forward. and so you have to think about that. and i get that they're trying to gin up the teenagers to get all angry and the political aspects of it. but they should make these decisions based on national security issues and whether a chinese own company should have this much access in a media company to the us. they certainly couldn't by cnn, could that hey, or control cnn and they couldn't do other things. so it's a very complex subject. and of course, we'll get an emotional, but it's a complex object >> and what do you make of i mean, i remember i'm old enough to remember covering the white house, donald trump, when he was president he wasn't supportive banning tiktok and now he's changed his tune on this. what's going on? why is that happening >> money? jim? >> he wants money from different people. he of course, met with geoff, yes. who's an investor in bytedance and i think that he suddenly changed his mind. it's being lobbied on by kellyanne on way. in addition, there's a thing called project texas going on that oracle is, which is the border. larry ellison's sportive president trump. for president trump and that's going on to try to make it safe, safer, make it if this doesn't pass there's still a lot of issues going forward, whether the senate will take it up there there have been legal challenges that have one and it's a long road before this happens, but eventually we have to figure out what to do about this. this company and companies like it using being able to have access to our our world here in the united states. and we can't have reciprocal access to. there's that's something people do need to pay attention to. social media sites aren't allowed in china. >> ours aren't certainly no i've been i've been in beijing when you walk outside and who leave your vpn network, you can't get on >> facebook, you can't get on certain apps over there in china. i mean, it just doesn't happen. when i listened to marc stewart reporting from beijing a few moments ago and he was talking about the complaints coming from the foreign ministry about antibusiness practices. i was my head almost exploded because that's pretty much coming from the chinese. >> well, they like having this here, i suspect and you know, the issue was, what do you buy if they sell it, that's another issue. you can't they're not going to let us have the algorithm because the algorithm will prove whether they been manipulating it for propaganda or surveillance and so what is tiktok without its magic algorithm? that's a big question. too, for any buyer >> yeah and we should note to our viewers care. i mean, we're watching this vote right now we're thinking it's going to pass. it could happen at any moment. it will we go i wanted to ask you about your reaction to this it's new reporting that a state department commission report warns that ai could pose an extinction level threat to humans. i can't remember if you and i've talked about this in the past. some of these dire warnings sometimes hear from the business community. now, it's from this report that was funded by the state department. what's your sense of all that? >> overblown? i don't know. i think yes, of course. they have to put that in. right? of course it could. so nuclear weapons, so could a lot of things doesn't mean it has to it has capabilities they need if the wrong person gets in place and says, say they say the ai let's solve world hunger without any rules. you know, what it would do, it would kill people like it. that's what it would do. so there's all kinds of things depending on who maintains it and what guidelines we have and regulations. and that's why regulations are critically important. >> all right. kara swisher, great to talk to the house is voting on a bill that would effectively ban tiktok here in the us, we are monitoring that vote count we'll bring you the latest as it comes in standby for that. in the meantime, new this morning, ukraine is stepping up its drone attacks deep inside russia, targeting three oil refineries overnight. this new video coming in cnn shows one of those attacks ukrainian defense source tells cnn these attacks were part of a special operation to go after russian oil reserves and cut a major source of revenue for moscow. it comes as the white house announced a surprise, $300 million military aid package to ukraine. as kyiv is running dangerously low on ammunition when russian troops advance and its guns fire, ukraine does not have enough ammunition to fire back. that's costing terrain. it's costing lives and it's costing us. the united states and the nato alliance strategically cnn, pentagon correspondent oren liebermann is following the story for us on what's in this new package >> jim, there are some critically needed munitions and equipment for ukraine in this package, but the white house and the pentagon were quick to point out that this is hardly a stopgap measure. the white house said this may last a matter of weeks, perhaps as little as a couple of weeks and that's simply because of the nature of the war in ukraine. it is very heavy on artillery, for example, 155 millimeter artillery is in this package, and ukraine also needs anti-aircraft missiles to repel the repeated russian air assaults that are coming in as well as small arms, ammunition and more. the key here is to keep ukraine in the fight as jake sullivan pointed out there, as we saw him speaking yesterday, the ukrainians need this essentially to hold the line against the russians who have been advancing and have been taking territory from ukraine. so ukraine needs this to be able to keep on fighting against the russians. meanwhile, both the pentagon and the white house very much saying, look, we still need this supplemental, be able to make sure ukraine really stay in this fight because this 300 million package won't last very long. where did it come from? well, the last us security package was back on december 27. at that point, the us had run out of what's called replenishment dollars. it had more authority to send equipment, but it couldn't refill it in us stocks this 300 million cane was actually from savings on the purchase of weapons contracts at enough of that up over years of negotiations and you've got to 300 million that gave the white house and the pentagon a little breathing room to send over a little more aid to ukraine. but jim, the white house, the pentagon, making it very clear this is not enough and it will not last very long >> yeah, it's a this the equivalent of sort of looking under the sofa cushion in the pentagon budget to help the ukrainians over there. it it's a drop in the bucket in terms of what's needed, it is frankly, i'd say pentagon dollars. that is seat cushion you know what were you finding your seat cushions? yeah. it's >> not going to take them very far. i think the key point of this is that there is about $4 billion in presidential drawdown authority. there was not replenishment dollars to be able to refill the stores, but the president does have the ability to use those funds and we need to start thinking about severing the replenishment from the drawdown. >> why? because >> the fact is that we have additional resources. we have padded our stockpiles in stores to fight our own wars in case our own troops are involved but like i said, they're padded. so it means you have some extra breathing room. you could apply some of those resources to help ukraine win and then put the onus on congress to pass additional money to make sure our cupboards aren't bear in case our own troops are at risk we need to move in that direction. now, that's probably one that critical things we could do in order sustain the war effort until congress passes the $660 billion supplemental yeah, and that vote that's ad let's talk about that a little bit why, why use reagan? >> well, i think the fact is that reagan probably is one of the most thoughtful in terms of thinking through. the dangers of authoritarianism. he oversaw the final stages of the end of the cold war and i think he captured the spirit of the united states, which is facing down authoritarianism, nurturing democracy, and we're trying to remind the republicans of their roots that this was, they were the party of national security defense. clearly that's not the case. now, this was reagan. >> reaganism was a stare-down. the russians call their bluff. >> and his through strength now we have a republican party that's willing to cast the cast aside. national security. the potential risk to our troops in order to curry favor with donald trump, who himself is trying to curry favor with vladimir putin. and that's not, that's not the roots of the republican party that is also not going to serve republican party very well. they certainly have lost the brand of national security and defense and frankly they will be held accountable if american lives are lost and that's what we're trying to remind them of. we're having this billboard rotate through where having fox news campaign with this particular ad running the add on, running that ad on fox, or we're going to run this in in several districts for vulnerable republicans, hold him accountable. either they pass the bill or they could it be accountable to their constituents is a full-court press. we're in a narrow window where we could pass this ukraine aid bill. we're going to try to do the best we can talk to, remind waking the republicans to their roots. and if not, we're going to impose some cost. so either they do the right thing for national security reasons, or they get held accountable at the battle. >> i've talked about this a little bit before. an interview with state media, putin is talking. he's doing some saber rattling again and talking about using nuclear weapons. he seems to do that every six months or so. what's your sense of that? >> i think the fact is though those have wrung hollow with me since the beginning, putin acts on the basis of regime preservation regime it's aggrandizing empire building, nuclear weapons, or the road to destruction, mutual destruction. so those are really hollow threats. and we saw a recent report about the fact that the administration was deeply concerned about some saber rattling in the past. i think that's intentional. it's what russia does with regards to information computation, reflexive control, this idea, there's doctrine that they've developed if they do certain things, they elicit certain responses and they've done that successfully with regards to escalation warning off the administration for providing adequate support, this administration, it's on the republicans to pass this bill. it's the most important thing we could do, but this administration has recourse also it could provide additional support to the presidential drawdown authority it could dip into russia central bank assets that are frozen and pass those off to ukraine. and that's easy thing for the administration. do the administration has a decision that it's on with the president? lift some severe restrictions on contractors and country. that's critical because we provided masses of equipment to ukraine without any means to support them. >> the question is whether any of the question is how much the administration can do it this morning? $300 million as an indication that they're running out of unilateral options. but as you as always, colonel vindman. >> thank you. >> thanks a lot for you about out of georgia, the judge in fulton county has just dismiss some of the charges in the georgia election subversion case. cnn's nick valencia has been following all of this for us diligently. nick, what's the latest what are you learning? >> well, jim mnisi are charges that have to deal with the violation of an oath of office. so six of the 41 charges in this case have been thrown out by judge scott mcafee and we want to be very clear. we don't want to confuse our viewers here as we anticipate in wait for his decision as to whether or not he's going to remove fani willis from this case. this is not that order. what this is though is victory for the defendants, including the former president. but one of those charges he was accused of trying to get the secretary of state to unlawfully overturn the election results here, the da's office had said that it is a violation of the oath of office that he was soliciting from the secretary of state. but ultimately the judge in this case ruling that the da's office failed to include sufficient details that would allow of these defendants to intelligently prepare for a future trial. so he's throwing them out. all of these counts have to do as i mentioned, with the violation of an oath of office, we are still reading through this order, but as i mentioned, jim, this does not the ultimate decision as to whether or not fani will be removed from this case. but in the short term, it is a victory for the defense attorneys and defendants in this case, jim, the answer, nick, just to follow on that for right now, fani willis still on the case but a piece of this georgia election subversion case, it looks like it has been dismissed. the rest of the charges are still there, so trump and his alleged coconspirators there in fulton county, not out of hot water by any stretch >> know they're not in fact, the judge went out of his way to save this does not mean that the indictment is dismissed. he wrote that in his order just a short we're time ago, which was handed out some of these counts. we'll just go through them. one of the counts, as i mentioned, has to do with the solicitation of the oath of office for the secretary of state. another one has do with trump and meadows soliciting the georgia secretary of state to violate his oath of office on january 2, 2021, by requesting or importing him to unlawfully influence and so certify election results. all of them, as i mentioned, jim has to do with the violation of oath of office, but the judge ruling here in this case that the da's office just really did not provide enough details about what that oath is that they were allegedly violating so he's decided to throw these charges out. jim >> hard, a fascinating development. nick valencia, thanks for staying on top of it as always, we appreciate it. cnn senior legal analyst, elie honig joins us now, elie, what do you make of this? >> well, jim, this is an undeniable setback for the district attorney, not the entire indictment, but six of the 40 counts have now been dismissed. and here's why it's important to understand georgia state law has this sort of unusual law that says it's a crime to solicit to ask a public official to violate his official oath of office and as nic just laid out there, six counts in this indictment, that say donald trump and other defendants asked various members of the georgia senate and the georgia legislature and the georgia secretary of state, other public officials to violate their oath to the constitution by essentially swinging the election. but what the judge says here is you prosecutors, you have to say what part of the constitution the judge says, there are hundreds of provisions in the us constitution and in the georgia state constitution. and the purpose of an indictment is to give defendants notice so they know what they're defending against and you can't just say, well, you tried to violate the constitution. the judge says what you have they say is what specific provisions of the constitution, what specific sections of the constitution that's not in the indictment. therefore, the judge says those charges are legally unfounded, and now they're dismissed. >> and so elie me for the folks at home and nick valencia brought up the part of this where trump pressured the georgia secretary of state to throw out that election victory for joe biden in the state of the georgia. does that get lifted out of the case? is that still a part of this case? what does that mean? >> it is still part of the case that particular act, that phone call between donald trump and brad raffensberger where trump asks him, do just find 11,780 votes. we've all heard it many times. that is still part of the case. that phone call is still part of the case. there are other charges in the case that squarely relate to that phone call. for example, the first count in the indictment, which is the very broad racketeering count, will still include that conduct. there are other fraud counts that would still include that conduct. so i don't think this ruling changes the type of evidence that the da is going to be able to introduce, but it does knock out some of the charges and look, it's embarrassing for prosecutors. it's a screw up by prosecutors when you bring a charge charge and then a judge throws it out before it even goes to trial >> well, and that leads me to this question because there's so much was made of fani willis and her handling of this case and the hearings that we saw play out on live television was such a spectacle. does this bolster in the judge's mine? the idea that perhaps the fani willis should not be handling this case or is that a step too far? >> it should not bolster the conflict of interest argument. i think these are and should be seen as two entirely separate questions. the question in the decision that we just got is the indictment properly constructed where these charges property or put before the grand jury. and are they sustainable in the judge said with respect to six of the charges in this case, again, not all of them, but just six know they were not properly brought. there is an entirely separate question pending where we're waiting for a ruling any day now, where the judge has to decide whether the da has a financial or other conflict of interest relating to her relations she ship with the outside person brought in to be the lead prosecutor here, nathan wade. those should be completely different questions and completely different considerations by the judge and elie, i mean, the other question i had in my mind and maybe nick valencia could help us on this question as well. this does not bode well for this case, starting in a timely fashion, i mean, this potentially could be another delay in the case theoretically well, i guess i guess you could look at it the other way and say, well now we only have to deal with 34 counts, okay. where do you must try his >> yeah. i mean, look just looking at it pragmatically, but yeah, this case is not going to get tried to verdict before the november 2024 election. there's just no way even the da is currently asking for an august 2024 trial start date. it takes the da months to even pick a jury. there's another racketeering case in georgia, high profile, but not this high-profile that took them i think eight or nine months to pick a jury. so there's just no realistic way that this case gets tried all the way to a verdict before november and the election yeah. >> i guess one thing that we need to look out for is the district attorney, fani willis and her reaction to all of those. i mean, everybody remembers all too well the way she responded to that hearing about whether or not she should stay on the case and she famously said, i'm not the one on trial here. the former president and all those co-defendants are on trial here. i mean, this this is getting to be i mean, this is going to be a very tough, fought out case when it finally gets to court and in front of a jury yes there have been several screw-ups, frankly, by the da throughout the history of this case, going back to the investigative phase, the da god herself >> disqualified from a small piece of the case because she created a political conflict of interest. the judge who was overseeing the grand jury removed fani willis from the case. we've seen fani willis make the public statements in the church and elsewhere that have now been called into question that i think violate to the ethics of prosecutorial rules. >> and now we've seen six >> of the charges thrown out of the case. and unlike the conflict of interest issue, this does go to the charges against the defendant. this does go to the indictment itself. and there is still the case. the lead charge, the racketeering case is still in place but this is a setback. >> all right. >> but as nick valencia was saying at the in the united states. let's go straight to cnn's manu raju. manu, i guess this was expected. how did it play out? >> yeah, overwhelming passage. in fact, a majority of both caucuses in the house voted to pass this bill that would ban tiktok if it were to actually become law, which is an open question. but this final vote, 352 in volts in the affirmative 65 voting against it, one voting present. this is the breakdown. there are 155 democrats who supported 197 republicans who voted for it, 50 democrats voted no law. those progressive members, in particular, some of the younger members as well 15, just 15 republicans voted no 65 in total. now this bill would call on the chinese-based bytedance, the parent company to divest from tiktok, if not this app will pop very popular app of course, would be banned in the united states. this is still an open question though ultimately, how this will play out in the united states senate, there are lots of different ideas about how to do that. there are concerns from the people who support this effort to ban tiktok about the national security implications of this chinese own company having the private, private data of so many mils millions of americans. the question is, how do they deal within the senate? some of them are concerned the top supporters in the senate, we have raised constitutional concerns about naming a specific company, taking punitive actions essentially on a specific company in the legislation. so they want some changes. there are various ideas that are going back and forth. the senate majority leader chuck schumer has indicated that he is in no rush to put this on the floor of the united states senate. they want to work through the committee process, but this all comes, of course, anytime of the hotly contested election and real concerns among some of the opponents of this bill that if joe biden, particular the democratic opponents, that if joe biden were to sign this into law, that this could create a backlash among young voters, in particular, people who rely on this platform, influencers who use this for their business purposes as well, that this could actually hurt him in some key states that will, we'll see how the president ultimately deals with it. although he did indicate previously that he was signed this into law. if it were to come to his desk. so there is still some consternation within the ranks. there are some some republicans who voted against this aligning himself with donald trump, who reversed his position and is opposing this bill as well. so jim, though, we shouldn't take we should also just note it is very rare to see this significant bipartisan majority comforting gather i'm such a controversial issue in the middle of election year. it just shows you the national security concerns really dominating here. and the us house. >> jim, >> absolutely. it's a potent issue. the brakes of different ways we're republicans and democrats, let's talk about that next. joining us now, democratic congresswoman mikey, cheryl, she's a former navy helicopter pilot who serves on the house armed services committee congresswoman, i know you were very much in support of this bill. help us parse this out for the viewers. what happens next? do you think it's going to pass the senate? i mean, that is a big question mark at this point. >> well you know, i was working very hard to make sure we had a big vote today, whipping the votes very hard. we had the intelligence community come in, yes. mr. day, to brief the entire house of representatives to make sure people understood the threat posed and had the details of that because we've been moving quite quickly with the you're standing that this is something that tiktok is going to move against rapidly. we've all ready, seen that many of us have received thousands of calls in our office that's because tiktok is directing people to call the congressional offices before they can get to their feed. we know the ceo of bytedance is over on the senate side, the parent company of tiktok, working hard to kill this bill in the senate. but when you see an overwhelming vote like this, a huge bipartite it doesn't vote like this which is rare in these partisan times. i think that's something the senate has got to take notice of. and i'm hoping very much they will act quickly as well. >> and congresswoman, i mean, based on what you were just saying a few moments ago that members of congress received a briefing on this i'm curious. i mean, can you answer the question as to whether china is using tiktok to spy on americans. is that what's that? what's going on? >> so here's what we know that that bytedance, the parent company of tiktok, under a 20 security law, has to report to the chinese he's communist party has to turn over information when asked. we know that reporters, journalists, like journalists from buzzfeed or financial ties, have had their apps geo-located with whistleblowers. so the chinese communist party could determine who was reporting to the journalist. we know that woman and in new jersey and my own home state of new jersey was banned from tiktok when she was trying to post on the uyghur genocide. so we know that tiktok has been manipulated being information we know that they have access to americans private data, and we know that if they, if asked by the chinese communist party to turn that over, there provide law required to do so. >> and what do you say to i mean, some of the folks on your own party who are nervous about taking this very effective tool away from democrats with the president right in the middle of a heated reelection campaign, a lot of gen z users, like teenagers, are on tiktok that sort of pulls that platform out of the arsenal, doesn't it? if you effectively ban it here in the us >> well, i think what we're so concerned about and we're not we're not trying to ban tiktok. so for all of those users, we want the chinese communist party to divest of tiktok. people can continue to use that platform fact cepheus is an organization that controls some of the investment into the united states from foreign adversaries. they said that grinder had to have a forced sale when the chinese bought that platform because of all the sensitive personal data of americans, it is still up and functioning after that sale. so this is as a platform that we anticipate will still be able to be in wide use by americans, but more safely with their data protected with more in line with the value is that we have here of freedom of speech, freedom of association. and i think that will resonate. i also think though that you raised a good point, we have already seen the former president who, when he was in office, wanted to ban tiktok now realizing that, tiktok has engaged in manipulating elections the, parent company bytedance. we heard that information from taiwan with their election and we've seen the former president now know, you know no stranger to try to get four for an adversaries to support him against our democratic values we've seen the former president now changing his opinion and messaging to tiktok that he would be in favor of supporting them. i think hoping that they will come in and skew our own elections here. and that's what we're guarding against >> but what about a lot of young people? >> i mean, >> really folks across the spectrum use tiktok for their businesses. i suppose they're going to be a little worried about the effect of all of this. i mean, you're saying that tiktok will live on, not everybody feels that that's gonna be the outcome in all of this you know, i think that we will see as china divest of this actually people on tiktok able to have a >> better experience when they know that and they won't be shadow banned if they do something contrary to the interests of the chinese communist party, maybe they switch a business, switches supply chains out of china, and maybe he, they become shadow banned on the platform. there are all kinds of ways in which americans lives can be manipulated by the chinese communist party. if we don't start to take action in some of these very sensitive areas to protect us interests and the interests of the american people all right, congresswoman mikey cherelle, i don't think we've had the last discussion on all of this. we'll see how this plays out mikey, cheryl, thank you very much for your time this morning. we appreciate it so much >> all right. and we continue to follow the breaking news of georgia is a busy hour this morning. the judge in fulton county, justice missing some of the charges in the georgia election subversion case, you heard that, right? cnn's nick valencia is following this >> nic >> recap. if you can, what the judge has just ruled well, we want to be clear that this is not the order on whether to disqualify fani willis from this case. we are still standing by for that. but in the meantime, the presiding judge in this case, scott mcafee, decided that he's going to throw out six of the 41 counts in this indictment. we should also be clear, though the most important count in this indictment, the racketeering count, is still standing in this case, but in the short term, the counts having to deal with the solicitation of the violation of an oath and office. so these defendants that were alleged to have tried to get pumped officials calls to violate their oath by creating this fake elector scheme. or as we saw, the former president and tried to get to the secretary of state to overturn the election results here, those charges are no longer applicable in this case. scott mcafee, the judge ruling that the district attorney attorney's office did not provide enough details as to what part of the oath these defendants tried to get these public officials to violate any called that ultimately a fatal error. so some of these counts, six of the accounts of the 41, all of them, of course, having to do with this violation of oath of office, some of them having to do with the former president and his attempt at trying to get the secretary of state to decertify the election results and try to get him to say that he was the rightful winner here in 2020 when he lost the 2020 election results. so this is in the short term, a major victory or victory i should say, for the defendants in this case, the case though we're still expecting on whether or not the judge is going to remove fani willis and that decision could come at any point. jim >> all right. nic, thank you very much with me as cnn's paula reid, cnn legal analyst, michael moore paula, what does this mean for the timing of this case? i was talking about this with elie there's a little while ago during this program and i guess he was saying it could speed up the case, but i mean, i would have to think it is a complication for the district attorney and that's never a good thing >> no, it's she already has a lot of complications that she's contending with. look, even though some charges against trump and his co-defendants were dismissed, the case remains mostly tact, but it's also in limbo because these efforts to disqualify fani willis have left it unclear as to whether she will be the one overseeing this case and when it will go, because initially, she had said that she wanted to start this case in august, and it's going to last about four to six months but again, that's not likely even if she is not disqualified. now we're waiting for that disqualification decision by the judge is expected to come by friday. if he does decide to remove her and her office from this case, i mean, jim, that means more delays because while the case would survive, it would have to go to another office. so at this point, there is so much chaos surrounding this case as so many questions, i think elie's right technically that for any other case where you weren't dealing with disqualification and the possible election, possibly one of the defendants being reelected to the white house, it could speed things up. but right now, it is unclear if she will be still leading this case and if so, when it will go forward >> yeah. michael, i mean, fani willis has a lot of fierce defenders, but i mean, there's just no mistaking that this case has gotten messy yeah. >> i. mean, that's right. i'm i'm glad to be both of you and it is this case has turned into somewhat of a a tale of many speed bumps as they've tried to move forward. there was one interesting note when the judge through these counts out where he said basically the state could ask for an immediate appeal of this if they want to, and i would likely grant that doesn't. mean that he's thinking that he's not on a fast-track to try this case anyway, whether or not state does that that'll be a decision they make and they may wait and do that depending on how he rules, ultimately on the disqualification issue. but the order today that that is the granting of the special demurrer or the challenge to the specificity of the indictment was a win for the defense, and that they have basically come in and said, look, the indictment in these detail counts and these compound counts that the state is charged against our clients. they haven't been specific enough to place us on notice that is sufficient on the constitution to move forward. >> and the judge said, you know, you're right. >> they have not talked about those counts enough information to do that. so this part was a win. it's not fatal to the case as a whole. but these defendants are known for chipping away, if you will at the rock until sudden, there's nothing left but a pound of dust. and so we'll see how much further i guess that is what's going to happen. my goal right. if you have this many defendants, you have all of those defense teams who are going to come up with all of these different ways to try to unravel the case well that's right. i mean, in the law says that a defendant where do you have one or 19 i mean, they're they're entitled to an indictment. it's perfect in form and substance. that's a little bit of a stretch under the book because the law does give some backup to the prosecution if they need it, but it basically is a way to challenge these hyper technical indictments. is brought. indictments, these broad statements, the say, look, you may have satellite, but you haven't told us specifically why you think we have committed this solicitation to get somebody to violate their oath. you've got to spell that out. so when you put all those defendants together, you end up with these kinds of challenges. and so it's not surprising to see an indictment or this size effect face these challenges. it is. i say it's another speed bump that the prosecution has run into. is they've tried to move the case for all right. >> michael moore. thank you very much. in just a note to our viewers, if you're just tuning in the breaking news, the judge cnn breaking news costa and washington, we are following breaking news up on >> capitol hill at any minute. house lawmakers are expected to vote on a bill that could effectively ban the social media platform tiktok. here in the us, quarters of a potential ban claim china based parent company bytedance, could somehow use tiktok to spy on americans who use the app if signed into law, the measure would give the company less than six months to sell to a non-chinese owner. if bytedance fails to do so, tiktok could be all but shut down here in the us, users of the platform, which is wildly popular for among younger americans, are trying to stop that from happening >> i know i'm not the only one that relies on this app every single day to provide for their family i know i'm not the only one that relies on this app to get by. >> it's taken me six years to get to this point literally not even a month ago. i quit my job to do tiktok social media full-time and there are 80 years of generation z that are now eligible voters in this election year. >> do you really want >> to them all off by taking away their favorite app where they make friends, where they make contents, where they laugh, where a lot of us creators make our money. you want to take that app away. >> it could happen. let's begin up on capitol hill with cnn chief congressional correspondent, manu raju. manu. a lot of last-minute lobbying, some strange bedfellows on this issue. republicans, democrats who are supportive of this and we're also against this. >> how close is this is going to be? >> while we do expect this to pass in the house, will need two-thirds majority to get there and we do expect a bipartisan majority choosing the concerns over national security, over the concerns of our freedom of speech in the middle of this hotly contested election year, even as donald trump has lobbied against this bill because he contends that it could hurt, it can help facebook who need to test. trump also met with tiktok, megadonor recently as well, reversing his position on this and also warnings that if joe biden were to get behind this bill from some democrats who are warning that, that could actually hurt him with some young voters let's i don't think it'll be helpful with young voters, but, you know, my argument here, yes, it has to do with young people. but taking a step back, i just think it's bad policy, which just for politics is addition, multiplication and cutting out a large group of young voters is not the best known strategy for reelection, but trump's opposition to this >> i agree with him the first time on the first time around on this when he is president tried to ban the foreign presence, trying to kill it. >> well, he's wrong so even though jim, this is expected to pass the house and just a matter of minutes, its future in the senate is much different. there are concerns about the way this language is structured even from proponents who support banning tiktok and gloom. someone like senator mark warner, the senate intelligence committee chairman, who was concerned about naming specific company in this legislation which would force beijing owned bytedance to sell tiktok, if not tiktok will be banned on social media platforms. here in the united states, he's, he has raised constitutional concerns. there are different versions of the bills that are moving around the senate right now in the majority leader in the senate, chuck schumer indicated that he is in no rush that they want to move go to the committee process and figure out the right way to move ahead here. so this is going to take some time to play out in the senate, but that does not mean that the debate on the house floor at the moment, very emotional at this key time where they're trying to get this bill through and we're expected to expect it's expected to pass here in a matter of minutes, jim all right. >> we're gonna be watching that vote. manu raju. thank you very much. in the meantime, china is lashing out at this potential ban and delivering some strong words to the us cnn, international correspondent marc stewart joins us now from beijing, mark, you heard from china's foreign ministry this morning. where do they say? >> india and. look the messaging from beijing to washington is very blunt. it's very direct and the phrasing to washington is you're acting like a bully. this at a time when the united states and china are trying to figure out this working relationship, especially when it comes to these matters of business and economics. i did talk to the spokesperson for the ministry of foreign affairs and i said to him regardless of what happens in washington today, there is still this feeling of distrust from american lawmakers, from american citizens toward chinese companies. let's listen to what he had had to say >> kinga may voucher to me, even though the us has not found evidence on how tiktok and dangerous its national security. it has never stopped going after tiktok such practice of resorting to acts of bullying. 11 could not succeed in fair competition. disrupts the normal operation of the market it turned reminds the confidence of international investors and sabotage is the global economic and trade order this will eventually backfire on the us itself. >> i was also curious about the role that chinese government is taking all of this. and i asked is the government advising bytedance on how to proceed? the response i got, jim was very much in line with what you've just heard no real insight as to what kind of approach what kind of role the chinese government is taking, if at all? >> yeah, i'm sure that that is not helping tiktok's cause here in washington when they have that kind of posture, our marc are you this morning? great to see >> what do you think? what do you think about all this? i was just thinking if, good, very good. i was watching manu raju's live shot a few moments ago and he had a group of teenagers buying them. i was just thinking, what would happen and bonnie were to turn around and talk to these teenagers i mean, for the ones who are i guess not in school right now now, they must be looking over their screens and saying, wait a minute, what, what's going on with tiktok >> well, i don't know. i don't know. i don't know if we take our cues from teenagers at the time. you know, this is an could be a national security issue. there's certainly concerns about it and, you know, i wrote about it years ago. this was propaganda and surveillance from the chinese government it is going to be a problem going forward. and so you have to think about that. and i get that they're trying to gin up the teenagers to get all angry and the political aspects of it. but they should make these decisions based on national security issues and whether a chinese own company should have this much access in a media company to the us. they certainly couldn't by cnn, could that hey, or control cnn and they couldn't do other things. so it's a very complex subject. and of course, we'll get an emotional, but it's a complex object >> and what do you make of i mean, i remember i'm old enough to remember covering the white house, donald trump, when he was president he wasn't supportive banning tiktok and now he's changed his tune on this. what's going on? why is that happening >> money? jim? >> he wants money from different people. he of course, met with geoff, yes. who's an investor in bytedance and i think that he suddenly changed his mind. it's being lobbied on by kellyanne on way. in addition, there's a thing called project texas going on that oracle is, which is the border. larry ellison's sportive president trump. for president trump and that's going on to try to make it safe, safer, make it if this doesn't pass there's still a lot of issues going forward, whether the senate will take it up there there have been legal challenges that have one and it's a long road before this happens, but eventually we have to figure out what to do about this. this company and companies like it using being able to have access to our our world here in the united states. and we can't have reciprocal access to. there's that's something people do need to pay attention to. social media sites aren't allowed in china. >> ours aren't certainly no i've been i've been in beijing when you walk outside and who leave your vpn network, you can't get on >> facebook, you can't get on certain apps over there in china. i mean, it just doesn't happen. when i listened to marc stewart reporting from beijing a few moments ago and he was talking about the complaints coming from the foreign ministry about antibusiness practices. i was my head almost exploded because that's pretty much coming from the chinese. >> well, they like having this here, i suspect and you know, the issue was, what do you buy if they sell it, that's another issue. you can't they're not going to let us have the algorithm because the algorithm will prove whether they been manipulating it for propaganda or surveillance and so what is tiktok without its magic algorithm? that's a big question. too, for any buyer >> yeah and we should note to our viewers care. i mean, we're watching this vote right now we're thinking it's going to pass. it could happen at any moment. it will we go i wanted to ask you about your reaction to this it's new reporting that a state department commission report warns that ai could pose an extinction level threat to humans. i can't remember if you and i've talked about this in the past. some of these dire warnings sometimes hear from the business community. now, it's from this report that was funded by the state department. what's your sense of all that? >> overblown? i don't know. i think yes, of course. they have to put that in. right? of course it could. so nuclear weapons, so could a lot of things doesn't mean it has to it has capabilities they need if the wrong person gets in place and says, say they say the ai let's solve world hunger without any rules. you know, what it would do, it would kill people like it. that's what it would do. so there's all kinds of things depending on who maintains it and what guidelines we have and regulations. and that's why regulations are critically important. >> all right. kara swisher, great to talk to the house is voting on a bill that would effectively ban tiktok here in the us, we are monitoring that vote count we'll bring you the latest as it comes in standby for that. in the meantime, new this morning, ukraine is stepping up its drone attacks deep inside russia, targeting three oil refineries overnight. this new video coming in cnn shows one of those attacks ukrainian defense source tells cnn these attacks were part of a special operation to go after russian oil reserves and cut a major source of revenue for moscow. it comes as the white house announced a surprise, $300 million military aid package to ukraine. as kyiv is running dangerously low on ammunition when russian troops advance and its guns fire, ukraine does not have enough ammunition to fire back. that's costing terrain. it's costing lives and it's costing us. the united states and the nato alliance strategically cnn, pentagon correspondent oren liebermann is following the story for us on what's in this new package >> jim, there are some critically needed munitions and equipment for ukraine in this package, but the white house and the pentagon were quick to point out that this is hardly a stopgap measure. the white house said this may last a matter of weeks, perhaps as little as a couple of weeks and that's simply because of the nature of the war in ukraine. it is very heavy on artillery, for example, 155 millimeter artillery is in this package, and ukraine also needs anti-aircraft missiles to repel the repeated russian air assaults that are coming in as well as small arms, ammunition and more. the key here is to keep ukraine in the fight as jake sullivan pointed out there, as we saw him speaking yesterday, the ukrainians need this essentially to hold the line against the russians who have been advancing and have been taking territory from ukraine. so ukraine needs this to be able to keep on fighting against the russians. meanwhile, both the pentagon and the white house very much saying, look, we still need this supplemental, be able to make sure ukraine really stay in this fight because this 300 million package won't last very long. where did it come from? well, the last us security package was back on december 27. at that point, the us had run out of what's called replenishment dollars. it had more authority to send equipment, but it couldn't refill it in us stocks this 300 million cane was actually from savings on the purchase of weapons contracts at enough of that up over years of negotiations and you've got to 300 million that gave the white house and the pentagon a little breathing room to send over a little more aid to ukraine. but jim, the white house, the pentagon, making it very clear this is not enough and it will not last very long >> yeah, it's a fraction of what is said to be needed right now, oren liebermann. thank you very much. the white house is request for $60 billion aid package remains stalled in the house after passing the senate today in washington, a truck with a large screen, we'll circle the capital all day playing an ad, put together by the group of votevets urging action on ukraine funding using the words of ronald this the equivalent of sort of looking under the sofa cushion in the pentagon budget to help the ukrainians over there. it it's a drop in the bucket in terms of what's needed, it is frankly, i'd say pentagon dollars. that is seat cushion you know what were you finding your seat cushions? yeah. it's >> not going to take them very far. i think the key point of this is that there is about $4 billion in presidential drawdown authority. there was not replenishment dollars to be able to refill the stores, but the president does have the ability to use those funds and we need to start thinking about severing the replenishment from the drawdown. >> why? because >> the fact is that we have additional resources. we have padded our stockpiles in stores to fight our own wars in case our own troops are involved but like i said, they're padded. so it means you have some extra breathing room. you could apply some of those resources to help ukraine win and then put the onus on congress to pass additional money to make sure our cupboards aren't bear in case our own troops are at risk we need to move in that direction. now, that's probably one that critical things we could do in order sustain the war effort until congress passes the $660 billion supplemental yeah, and that vote that's ad let's talk about that a little bit why, why use reagan? >> well, i think the fact is that reagan probably is one of the most thoughtful in terms of thinking through. the dangers of authoritarianism. he oversaw the final stages of the end of the cold war and i think he captured the spirit of the united states, which is facing down authoritarianism, nurturing democracy, and we're trying to remind the republicans of their roots that this was, they were the party of national security defense. clearly that's not the case. now, this was reagan. >> reaganism was a stare-down. the russians call their bluff. >> and his through strength now we have a republican party that's willing to cast the cast aside. national security. the potential risk to our troops in order to curry favor with donald trump, who himself is trying to curry favor with vladimir putin. and that's not, that's not the roots of the republican party that is also not going to serve republican party very well. they certainly have lost the brand of national security and defense and frankly they will be held accountable if american lives are lost and that's what we're trying to remind them of. we're having this billboard rotate through where having fox news campaign with this particular ad running the add on, running that ad on fox, or we're going to run this in in several districts for vulnerable republicans, hold him accountable. either they pass the bill or they could it be accountable to their constituents is a full-court press. we're in a narrow window where we could pass this ukraine aid bill. we're going to try to do the best we can talk to, remind waking the republicans to their roots. and if not, we're going to impose some cost. so either they do the right thing for national security reasons, or they get held accountable at the battle. >> i've talked about this a little bit before. an interview with state media, putin is talking. he's doing some saber rattling again and talking about using nuclear weapons. he seems to do that every six months or so. what's your sense of that? >> i think the fact is though those have wrung hollow with me since the beginning, putin acts on the basis of regime preservation regime it's aggrandizing empire building, nuclear weapons, or the road to destruction, mutual destruction. so those are really hollow threats. and we saw a recent report about the fact that the administration was deeply concerned about some saber rattling in the past. i think that's intentional. it's what russia does with regards to information computation, reflexive control, this idea, there's doctrine that they've developed if they do certain things, they elicit certain responses and they've done that successfully with regards to escalation warning off the administration for providing adequate support, this administration, it's on the republicans to pass this bill. it's the most important thing we could do, but this administration has recourse also it could provide additional support to the presidential drawdown authority it could dip into russia central bank assets that are frozen and pass those off to ukraine. and that's easy thing for the administration. do the administration has a decision that it's on with the president? lift some severe restrictions on contractors and country. that's critical because we provided masses of equipment to ukraine without any means to support them. >> the question is whether any of the question is how much the administration can do it this morning? $300 million as an indication that they're running out of unilateral options. but as you as always, colonel vindman. >> thank you. >> thanks a lot for you about out of georgia, the judge in fulton county has just dismiss some of the charges in the georgia election subversion case. cnn's nick valencia has been following all of this for us diligently. nick, what's the latest what are you learning? >> well, jim mnisi are charges that have to deal with the violation of an oath of office. so six of the 41 charges in this case have been thrown out by judge scott mcafee and we want to be very clear. we don't want to confuse our viewers here as we anticipate in wait for his decision as to whether or not he's going to remove fani willis from this case. this is not that order. what this is though is victory for the defendants, including the former president. but one of those charges he was accused of trying to get the secretary of state to unlawfully overturn the election results here, the da's office had said that it is a violation of the oath of office that he was soliciting from the secretary of state. but ultimately the judge in this case ruling that the da's office failed to include sufficient details that would allow of these defendants to intelligently prepare for a future trial. so he's throwing them out. all of these counts have to do as i mentioned, with the violation of an oath of office, we are still reading through this order, but as i mentioned, jim, this does not the ultimate decision as to whether or not fani will be removed from this case. but in the short term, it is a victory for the defense attorneys and defendants in this case, jim, the answer, nick, just to follow on that for right now, fani willis still on the case but a piece of this georgia election subversion case, it looks like it has been dismissed. the rest of the charges are still there, so trump and his alleged coconspirators there in fulton county, not out of hot water by any stretch >> know they're not in fact, the judge went out of his way to save this does not mean that the indictment is dismissed. he wrote that in his order just a short we're time ago, which was handed out some of these counts. we'll just go through them. one of the counts, as i mentioned, has to do with the solicitation of the oath of office for the secretary of state. another one has do with trump and meadows soliciting the georgia secretary of state to violate his oath of office on january 2, 2021, by requesting or importing him to unlawfully influence and so certify election results. all of them, as i mentioned, jim has to do with the violation of oath of office, but the judge ruling here in this case that the da's office just really did not provide enough details about what that oath is that they were allegedly violating so he's decided to throw these charges out. jim >> hard, a fascinating development. nick valencia, thanks for staying on top of it as always, we appreciate it. cnn senior legal analyst, elie honig joins us now, elie, what do you make of this? >> well, jim, this is an undeniable setback for the district attorney, not the entire indictment, but six of the 40 counts have now been dismissed. and here's why it's important to understand georgia state law has this sort of unusual law that says it's a crime to solicit to ask a public official to violate his official oath of office and as nic just laid out there, six counts in this indictment, that say donald trump and other defendants asked various members of the georgia senate and the georgia legislature and the georgia secretary of state, other public officials to violate their oath to the constitution by essentially swinging the election. but what the judge says here is you prosecutors, you have to say what part of the constitution the judge says, there are hundreds of provisions in the us constitution and in the georgia state constitution. and the purpose of an indictment is to give defendants notice so they know what they're defending against and you can't just say, well, you tried to violate the constitution. the judge says what you have they say is what specific provisions of the constitution, what specific sections of the constitution that's not in the indictment. therefore, the judge says those charges are legally unfounded, and now they're dismissed. >> and so elie me for the folks at home and nick valencia brought up the part of this where trump pressured the georgia secretary of state to throw out that election victory for joe biden in the state of the georgia. does that get lifted out of the case? is that still a part of this case? what does that mean? >> it is still part of the case that particular act, that phone call between donald trump and brad raffensberger where trump asks him, do just find 11,780 votes. we've all heard it many times. that is still part of the case. that phone call is still part of the case. there are other charges in the case that squarely relate to that phone call. for example, the first count in the indictment, which is the very broad racketeering count, will still include that conduct. there are other fraud counts that would still include that conduct. so i don't think this ruling changes the type of evidence that the da is going to be able to introduce, but it does knock out some of the charges and look, it's embarrassing for prosecutors. it's a screw up by prosecutors when you bring a charge charge and then a judge throws it out before it even goes to trial >> well, and that leads me to this question because there's so much was made of fani willis and her handling of this case and the hearings that we saw play out on live television was such a spectacle. does this bolster in the judge's mine? the idea that perhaps the fani willis should not be handling this case or is that a step too far? >> it should not bolster the conflict of interest argument. i think these are and should be seen as two entirely separate questions. the question in the decision that we just got is the indictment properly constructed where these charges property or put before the grand jury. and are they sustainable in the judge said with respect to six of the charges in this case, again, not all of them, but just six know they were not properly brought. there is an entirely separate question pending where we're waiting for a ruling any day now, where the judge has to decide whether the da has a financial or other conflict of interest relating to her relations she ship with the outside person brought in to be the lead prosecutor here, nathan wade. those should be completely different questions and completely different considerations by the judge and elie, i mean, the other question i had in my mind and maybe nick valencia could help us on this question as well. this does not bode well for this case, starting in a timely fashion, i mean, this potentially could be another delay in the case theoretically well, i guess i guess you could look at it the other way and say, well now we only have to deal with 34 counts, okay. where do you must try his >> yeah. i mean, look just looking at it pragmatically, but yeah, this case is not going to get tried to verdict before the november 2024 election. there's just no way even the da is currently asking for an august 2024 trial start date. it takes the da months to even pick a jury. there's another racketeering case in georgia, high profile, but not this high-profile that took them i think eight or nine months to pick a jury. so there's just no realistic way that this case gets tried all the way to a verdict before november and the election yeah. >> i guess one thing that we need to look out for is the district attorney, fani willis and her reaction to all of those. i mean, everybody remembers all too well the way she responded to that hearing about whether or not she should stay on the case and she famously said, i'm not the one on trial here. the former president and all those co-defendants are on trial here. i mean, this this is getting to be i mean, this is going to be a very tough, fought out case when it finally gets to court and in front of a jury yes there have been several screw-ups, frankly, by the da throughout the history of this case, going back to the investigative phase, the da god herself >> disqualified from a small piece of the case because she created a political conflict of interest. the judge who was overseeing the grand jury removed fani willis from the case. we've seen fani willis make the public statements in the church and elsewhere that have now been called into question that i think violate to the ethics of prosecutorial rules. >> and now we've seen six >> of the charges thrown out of the case. and unlike the conflict of interest issue, this does go to the charges against the defendant. this does go to the indictment itself. and there is still the case. the lead charge, the racketeering case is still in place but this is a setback. >> all right. >> but as nick valencia was saying at the in the united states. let's go straight to cnn's manu raju. manu, i guess this was expected. how did it play out? >> yeah, overwhelming passage. in fact, a majority of both caucuses in the house voted to pass this bill that would ban tiktok if it were to actually become law, which is an open question. but this final vote, 352 in volts in the affirmative 65 voting against it, one voting present. this is the breakdown. there are 155 democrats who supported 197 republicans who voted for it, 50 democrats voted no law. those progressive members, in particular, some of the younger members as well 15, just 15 republicans voted no 65 in total. now this bill would call on the chinese-based bytedance, the parent company to divest from tiktok, if not this app will pop very popular app of course, would be banned in the united states. this is still an open question though ultimately, how this will play out in the united states senate, there are lots of different ideas about how to do that. there are concerns from the people who support this effort to ban tiktok about the national security implications of this chinese own company having the private, private data of so many mils millions of americans. the question is, how do they deal within the senate? some of them are concerned the top supporters in the senate, we have raised constitutional concerns about naming a specific company, taking punitive actions essentially on a specific company in the legislation. so they want some changes. there are various ideas that are going back and forth. the senate majority leader chuck schumer has indicated that he is in no rush to put this on the floor of the united states senate. they want to work through the committee process, but this all comes, of course, anytime of the hotly contested election and real concerns among some of the opponents of this bill that if joe biden, particular the democratic opponents, that if joe biden were to sign this into law, that this could create a backlash among young voters, in particular, people who rely on this platform, influencers who use this for their business purposes as well, that this could actually hurt him in some key states that will, we'll see how the president ultimately deals with it. although he did indicate previously that he was signed this into law. if it were to come to his desk. so there is still some consternation within the ranks. there are some some republicans who voted against this aligning himself with donald trump, who reversed his position and is opposing this bill as well. so jim, though, we shouldn't take we should also just note it is very rare to see this significant bipartisan majority comforting gather i'm such a controversial issue in the middle of election year. it just shows you the national security concerns really dominating here. and the us house. >> jim, >> absolutely. it's a potent issue. the brakes of different ways we're republicans and democrats, let's talk about that next. joining us now, democratic congresswoman mikey, cheryl, she's a former navy helicopter pilot who serves on the house armed services committee congresswoman, i know you were very much in support of this bill. help us parse this out for the viewers. what happens next? do you think it's going to pass the senate? i mean, that is a big question mark at this point. >> well you know, i was working very hard to make sure we had a big vote today, whipping the votes very hard. we had the intelligence community come in, yes. mr. day, to brief the entire house of representatives to make sure people understood the threat posed and had the details of that because we've been moving quite quickly with the you're standing that this is something that tiktok is going to move against rapidly. we've all ready, seen that many of us have received thousands of calls in our office that's because tiktok is directing people to call the congressional offices before they can get to their feed. we know the ceo of bytedance is over on the senate side, the parent company of tiktok, working hard to kill this bill in the senate. but when you see an overwhelming vote like this, a huge bipartite it doesn't vote like this which is rare in these partisan times. i think that's something the senate has got to take notice of. and i'm hoping very much they will act quickly as well. >> and congresswoman, i mean, based on what you were just saying a few moments ago that members of congress received a briefing on this i'm curious. i mean, can you answer the question as to whether china is using tiktok to spy on americans. is that what's that? what's going on? >> so here's what we know that that bytedance, the parent company of tiktok, under a 20 security law, has to report to the chinese he's communist party has to turn over information when asked. we know that reporters, journalists, like journalists from buzzfeed or financial ties, have had their apps geo-located with whistleblowers. so the chinese communist party could determine who was reporting to the journalist. we know that woman and in new jersey and my own home state of new jersey was banned from tiktok when she was trying to post on the uyghur genocide. so we know that tiktok has been manipulated being information we know that they have access to americans private data, and we know that if they, if asked by the chinese communist party to turn that over, there provide law required to do so. >> and what do you say to i mean, some of the folks on your own party who are nervous about taking this very effective tool away from democrats with the president right in the middle of a heated reelection campaign, a lot of gen z users, like teenagers, are on tiktok that sort of pulls that platform out of the arsenal, doesn't it? if you effectively ban it here in the us >> well, i think what we're so concerned about and we're not we're not trying to ban tiktok. so for all of those users, we want the chinese communist party to divest of tiktok. people can continue to use that platform fact cepheus is an organization that controls some of the investment into the united states from foreign adversaries. they said that grinder had to have a forced sale when the chinese bought that platform because of all the sensitive personal data of americans, it is still up and functioning after that sale. so this is as a platform that we anticipate will still be able to be in wide use by americans, but more safely with their data protected with more in line with the value is that we have here of freedom of speech, freedom of association. and i think that will resonate. i also think though that you raised a good point, we have already seen the former president who, when he was in office, wanted to ban tiktok now realizing that, tiktok has engaged in manipulating elections the, parent company bytedance. we heard that information from taiwan with their election and we've seen the former president now know, you know no stranger to try to get four for an adversaries to support him against our democratic values we've seen the former president now changing his opinion and messaging to tiktok that he would be in favor of supporting them. i think hoping that they will come in and skew our own elections here. and that's what we're guarding against >> but what about a lot of young people? >> i mean, >> really folks across the spectrum use tiktok for their businesses. i suppose they're going to be a little worried about the effect of all of this. i mean, you're saying that tiktok will live on, not everybody feels that that's gonna be the outcome in all of this you know, i think that we will see as china divest of this actually people on tiktok able to have a >> better experience when they know that and they won't be shadow banned if they do something contrary to the interests of the chinese communist party, maybe they switch a business, switches supply chains out of china, and maybe he, they become shadow banned on the platform. there are all kinds of ways in which americans lives can be manipulated by the chinese communist party. if we don't start to take action in some of these very sensitive areas to protect us interests and the interests of the american people all right, congresswoman mikey cherelle, i don't think we've had the last discussion on all of this. we'll see how this plays out fulton county, justice missing some of the charges in the georgia election subversion case, you heard that, right? cnn's nick valencia is following this >> nic >> recap. if you can, what the judge has just ruled well, we want to be clear that this is not the order on whether to disqualify fani willis from this case. we are still standing by for that. but in the meantime, the presiding judge in this case, scott mcafee, decided that he's going to throw out six of the 41 counts in this indictment. we should also be clear, though the most important count in this indictment, the racketeering count, is still standing in this case, but in the short term, the counts having to deal with the solicitation of the violation of an oath and office. so these defendants that were alleged to have tried to get pumped officials calls to violate their oath by creating this fake elector scheme. or as we saw, the former president and tried to get to the secretary of state to overturn the election results here, those charges are no longer applicable in this case. scott mcafee, the judge ruling that the district attorney attorney's office did not provide enough details as to what part of the oath these defendants tried to get these public officials to violate any called that ultimately a fatal error. so some of these counts, six of the accounts of the 41, all of them, of course, having to do with this violation of oath of office, some of them having to do with the former president and his attempt at trying to get the secretary of state to decertify the election results and try to get him to say that he was the rightful winner here in 2020 when he lost the 2020 election results. so this is in the short term, a major victory or victory i should say, for the defendants in this case, the case though we're still expecting on whether or not the judge is going to remove fani willis and that decision could come at any point. jim >> all right. nic, thank you very much with me as cnn's paula reid, cnn legal analyst, michael moore paula, what does this mean for the timing of this case? i was talking about this with elie there's a little while ago during this program and i guess he was saying it could speed up the case, but i mean, i would have to think it is a complication for the district attorney and that's never a good thing >> no, it's she already has a lot of complications that she's contending with. look, even though some charges against trump and his co-defendants were dismissed, the case remains mostly tact, but it's also in limbo because these efforts to disqualify fani willis have left it unclear as to whether she will be the one overseeing this case and when it will go, because initially, she had said that she wanted to start this case in august, and it's going to last about four to six months but again, that's not likely even if she is not disqualified. now we're waiting for that disqualification decision by the judge is expected to come by friday. if he does decide to remove her and her office from this case, i mean, jim, that means more delays because while the case would survive, it would have to go to another office. so at this point, there is so much chaos surrounding this case as so many questions, i think elie's right technically that for any other case where you weren't dealing with disqualification and the possible election, possibly one of the defendants being reelected to the white house, it could speed things up. but right now, it is unclear if she will be still leading this case and if so, when it will go forward >> yeah. michael, i mean, fani willis has a lot of fierce defenders, but i mean, there's just no mistaking that this case has gotten messy yeah. >> i. mean, that's right. i'm i'm glad to be both of you and it is this case has turned into somewhat of a a tale of many speed bumps as they've tried to move forward. there was one interesting note when the judge through these counts out where he said basically the state could ask for an immediate appeal of this if they want to, and i would likely grant that doesn't. mean that he's thinking that he's not on a fast-track to try this case anyway, whether or not state does that that'll be a decision they make and they may wait and do that depending on how he rules, ultimately on the disqualification issue. but the order today that that is the granting of the special demurrer or the challenge to the specificity of the indictment was a win for the defense, and that they have basically come in and said, look, the indictment in these detail counts and these compound counts that the state is charged against our clients. they haven't been specific enough to place us on notice that is sufficient on the constitution to move forward. >> and the judge said, you know, you're right. >> they have not talked about those counts enough information to do that. so this part was a win. it's not fatal to the case as a whole. but these defendants are known for chipping away, if you will at the rock until sudden, there's nothing left but a pound of dust. and so we'll see how much further i guess that is what's going to happen. my goal right. if you have this many defendants, you have all of those defense teams who are going to come up with all of these different ways to try to unravel the case well that's right. i mean, in the law says that a defendant where do you have one or 19 i mean, they're they're entitled to an indictment. it's perfect in form and substance. that's a little bit of a stretch under the book because the law does give some backup to the prosecution if they need it, but it basically is a way to challenge these hyper technical indictments. is brought. indictments, these broad statements, the say, look, you may have satellite, but you haven't told us specifically why you think we have committed this solicitation to get somebody to violate their oath. you've got to spell that out. so when you put all those defendants together, you end up with these kinds of challenges. and so it's not surprising to see an indictment or this size effect face these challenges. it is. i say it's another speed bump that the
