border. joe biden, donald trump, both making visits out-of-control, wildfires, scorched more than 1 million million acres in texas. they have now turned deadly. sara is out. i'm john berman with kate baldwin. this is cnn news central are we do have. breaking news out of gaza. eyewitness reports in the hamas-run palestinian ministry of health say more than 100 people were killed in a chaotic incident after idf soldiers open fire as people were trying to get food from aid trucks, seen as jeremy diamond is gathering new details in television we've seen in chief international anchor christiane amanpour standing by in london. jeremy, let's just start with you and explain as best as we understand it now exactly what happened well, john, i actually just got off the phone with whether one of our journalists, local journalists, who was >> on the ground when this incident happened >> and this is kind of the tiktok as he saw it on the ground. these, this convoy of aid trucks apparently passed an israeli military posts about 70 meters after they had passed that point, thousands of people began to swarm around these aid trucks and then it was only minutes after that we're told by witnesses on the grounds, including our local journalists, that the israeli military opened fire on some of those palace cnn's who were surrounding those trucks. now, the israeli military says that it opened fire on individuals who had approached it military of forces, its position there. but what we know ensued after that, after the israeli military open fire, according to people on the ground there was a totally chaotic situation. many of those drivers, amid the gunfire began to drive away out of out of fear for the gunfire that was happening there. we understand that as a result of people were killed there. we understand that altogether 104 people were killed according to the palestinian ministry of health, 760 people were injured according to our journalists, on the ground, the majority of the people who were killed where apparently killed in the ensuing chaos as those trucks drove away. but this journalist says that it was the gunfire that set off that stampede, that set off the trucks driving away in fear. now the israeli military isn't providing many details about why their forces open fire. they say that they are reviewing the incident, but for now, all they are telling us is that that the force is felt like there was a threat on the ground that they were responding to. now, we should note that this comes in the context of the hundreds of thousands of people in northern gaza being really on the brink of famine right now, so few aid trucks have been able to get into northern gaza. and that has largely been due to a lack of coordination with the israeli military with these eight groups to be able to safely get those convoys in. and we know that in addition to that, the israeli military has also been targeting palestinian police forces in the area, resulting in no security for many of these convoys. so you put all of those together, the desperate humanitarian situation, the lack of security for these trucks, and the israeli military apparently opening fire on some of these individuals around this truck. and you have a very, very deadly incident, more than 100 people killed 700 plus injured, according to officials on the ground, john christiane, i keep finding myself staring at those pictures, those drone images of the hundreds of people there jeremy, just described what he called the devastating humanitarian situation. question in gaza. so what does this now put a spotlight on >> look, just listening to jeremy talk about what's happened and what the idf is saying. it's obviously clear that the fire is what caused the panic and the stampede. obviously, the truck drivers tried to get out of that location clearly desperate people were in the way we understand from the idf that they did shoot at they said themselves at some of these people in the legs. well, maybe then they fell over. they were trampled. but the bottom line is that it speaks to a broader context that we've been warning about reporting about getting the expert witnesses if you like. like to talk about an explain to us over the last few months. and certainly this week, yan egeland, who is of the norwegian refugee council spoke to me in detail on monday about the risks of this looming famine in the north they've been able to get no trucks there. and it's not because of lack of coordination and it's because there are checkpoints on the road. they say there aren't allowed to move past a certain position. but by israeli checkpoints and they have not been able to do their job of getting aid to the nearly half 1 million who apparently are on the brink of a looming famine he spoke to me about the dozens and dozens, if not hundreds, of aid trucks that are waiting outside refer and trying to get in from kerem shalom, which is the israeli southern gaza checkpoint. and they just don't get there in time. they're constantly being picked over weight by the people who are checking them and they're not able to get in, in terms of the quote, unquote looting that israel is talking about. i specifically asked yan egeland how he would describe what he told me about voluntarily. the latest convoy got in. and yet it was so rare that cause people started to run off through it and try to get what they could offer because they have had no aid officially aid into gaza has halved according to the un, in the last month alone, halved it hasn't increased, its decreased by half, which means there are people who are starving there. so i asked him, is this looting? he said it is not looting us. it is not looting each other. it is people as we witnessed them rushing to the trucks trying to get whatever they can for their hungry mother, grandmother, niece, nephew, children, you get the picture. they are desperate on top of that, according to the israeli government and the israeli armed forces, the only people responsible for security inside gaza are the israeli idf. they have taken over gaza. prime minister netanyahu says this all the time. nobody else should be in there, just the idf. they are in charge of security and i have witnessed enough food distributions from somalia to sarajevo on the siege and all over the world to know that when you do this you. have to, you have to have proper coordination and security. the only people in charge of security inside gaza or the idf. and again, we've been warning about this in our interviews for the last several days and we are hearing that most of the deaths came from when people were trampled trying to flee the scene. but again, if the situation started with firing and started from the chaos there, it does just shine the spotlight on the desperate situation. christiane, our thanks so much to you, jeremy diamond as well. we're going to follow this throughout the morning >> okay. >> also, this just when you maybe thought that donald trump's chaotic legal political campaign needs court calendar could not get more chaotic. you can cue the supreme court game changer now with another big deal ruling still hanging out there overnight, the supreme court agreed to hear argument on the immunity claim. that was all that was already resoundingly rejected by lower courts in late april. that means trump's federal election subversion trial that was supposed to start next month will be delayed. what we do not know yet is delayed by how much and we also don't know how the supreme court is feeling right now about donald trump's name being on the colorado primary ballot. a big question before them, illinois just became the third state to pull him from the ballot. cnn's kaitlan polantz is in washington. she's following all this. katelyn, walk us through this mess of a calendar, please? >> yeah. kate, let's start with the supreme court in presidential immunity. now saying they're going to look at that question in donald trump's criminal case related to the 2020 election, the allegations of obstruction and conspiracy there. that case cannot go to trial in federal court until the supreme court figures out if donald trump has some sort of presidential immunity. if a president can be charged with a crime for something that they were doing while in office. the calendar there puts that case on hold, very likely until the end of the supreme court term or some time between april and june when they would decide. and then we have learned through the court that if they greenlight the case, if they say trump isn't immune, and that he can be charged and tried for these allegations in federal court related to the 2020 election the judge, tanya chutkin has said that she would give them basically seven months from indictment to trial. so that would put us at her giving them as much as three months to prepare to go to trial. >> he does have one criminal >> case on the calendar already. it looks like it's going to hold at the end of march in new york related to to falsification of business records, hush money payments to stormy daniels in 2016, and then there's a musical chairs of other cases, his georgia case, and the classified documents case in florida, a lot comes down to the supreme court there. of course they're also looking at if states can decide what to do with this insurrectionist ban. the 14th amendment, if trump can be on the ballot, and if states can remove them, now it's going to be impacting three states as of last night, illinois, colorado, and maine, which have all said they don't want donald trump's votes to count in their primary elections. kate all kaitlan, the overarching headline from all of this is just like, but wait, there's more. i mean, there's so once the calendar said but wait, there's more it's going to change. and now we've got more going to the supreme court, more for this room court to consider and so on and so forth. thank you so much for running through it. john all right. with me now, former federal prosecutor and defense attorney shan wu, i just want to ask the question that i think is number one on people's minds, if the supreme court does decide this case can go forward at all, can it get done or even started before election day in november? >> i think it's theoretically possible and most people are agreeing. but it's really hard if you want to use a football analogy, it's like we hit the two minute warning and they just took a ten yard penalty. so i think it makes it much more difficult to do. there are some things that the prosecution jack smith could do to try and streamline the case even more. the judge could give a shorter kind of trial prep time, so it's theoretically possible, but it makes it very, very difficult. >> now, there are people in trump world who say, oh, they're just department regulations that you can't hold a trial within 60 or 90 days of foreign election. they are they are misreporting what the actual regulations or recommendations are. and by the way, this is a case where there already charges here, it says nothing about a judge, but what who would get to decide whether and when this goes to trial? >> well theoretically, merrick garland would be giving jack smith a lot of discretion here. but the attorney general does have the oversight over jack smith because he's still working within doj guidelines and such garland obviously has been very reluctant to take any kind of steps. i think he's been a little bit too timid about things. however, i will say i wouldn't be surprised were he to have a meeting and they're that close to the election that he might actually put his finger on the scale, thumb on the scale at that point and say, this is too close it looks to partisan. you're right, it does not actually run afoul of that doj policy because the charges already started. but i wouldn't be surprised to see garland's sort of like wake up and actually do something there isn't a judge tanya chutkan know who really has almost complete control over the timing of the trial it is. >> and garland said that before that's kind of out of the doj's hands. it's up to her however, obviously, were the prosecution to follow motion with the judge and say, we want to pause this until after the election. the judge would certainly take that into consideration, but the majority of the timing is very much up to her and i also just want to say the supreme court, which has now decided to hear this case granted cert for the end of april. >> could they >> have done this before if ultimately they wanted to take this case up and hear arguments about it, did jack smith asked them to do this a month ago, a couple of months ago? >> that's exactly right. they could have taken it and it's very frustrating to see them not having done that. on the other hand, it does make sense to me that they wanted to have the benefit of the dc circuit taking a look at it, looking at the circuits analysis and they got that benefit. it was a very solid opinion, excellent analysis by the dc circuit. and frankly, they could have they the supreme court could have at that point declined to hear it. they couldn't just let that decision stand. it's not ruling on the merits. it just let's the decision, stan. but as i'd feared, they really couldn't really keep their hands off of it >> so we will hear from them in a month and a half. shan wu. thank you very much >> joe biden and donald trump, both wants a solution, who's been willing to compromise. but donald trump stepped on that solution. so donald trump is there. it's now donald trump's open border. it's republicans open border. if there's that were in place on immigration and on our border that were revoked by then president may or president biden. and mayorkas's out there touting it, that they took wheeled back a law. there's immigration policies and i also then you put vice president harris in charge of the border. so i mean, republicans have missed opportunities to harken back to that because of their complete failure on messaging right here and now. and that's where we're really lucy, because what they're doing is they've let somebody who doesn't really understand and respect the constitution impede on their very constitutional duty and responsibility to pass legislation. >> were you as are both make do you guys are both making the case right now? this is a better issue in a way for president biden than donald trump in that's a stretch, isn't it? because the polls are pretty clear? that voters say that they trust trump more than biden on issues of immigration. so then i understand what you're saying. but as part of this wishcasting maybe it's wish casting, but also its early days everybody has a number that's too many people coming across the border for some people, one person build a wall. we don't want for somebody else might be at thousand 20,000 1 billion at some point, everybody says it's too much. democrats now are agreeing. it's too much, and democrats have been willing to give up a lot of our own principles and demands to get something done about it and been shocked to find republicans will not take yes for an answer and i think the country, it's going to take, it's going to take a while to process the idea that republicans literally refused to do anything about this. democrats going to have to make that case. you are correct right now, republican trusted more on this issue than democrats was they made it an issue, but they also refuse to solve the issue. and so we proved in new york second district congressional district that democrats can run on immigration can be tough and smart on immigration and actually win. and so in the most recent election, democrats ran on the issue of immigration, one on immigration. and i think that's a possible pathway for joe biden do you think or that policy doesn't matter on this at this point, is it all just how harsh the language can be that's that's what's going to get you a boost in the polls. and who can better handle it or do you do hear advance saying that it maybe he's just going to take little time for to set in that in your view, in his that republicans have so screwed this up? well, republicans would normally be wishing winning this issue if they hadn't moved the goalpost as van's talking about and as somebody who worked first you go john painter, i watched the freedom caucus move the goalpost time and time again. and i think right now, but benner clamp down on them and hold of a better a little bit better, but you have somebody who is afraid i'm caucus member who's now speaker. so it's a little bit different. >> but i >> think that it does come down the messaging and pointing things out to people. again, it's 79% thing that this is a real problem and it's gonna be a problem coming up to election day. and it's going be a matter of who can message it better to there citron, there, to the american people and if the republican party doesn't see the opportunity to capitalize on this by giving funding to address the issue i do think that they are going to be hurting for it van jones, big mitchell hall fan, i imagine how do you feel, how do you feel today? now that you've had a chance to process the big announcement that he's stepping down as senate republican leader you know, i guess he couldn't find any more damage due to the country and now he's going to go away, not no offense to my to my colleague here, but, you know, >> this is people called the trump's supreme court. this is the mcconnell supreme court is not the robert supreme court's not to trump's supreme court. it's mcconnell supreme court and he focused like a laser beam on packing the court with his many right-wing charges. he possibly could. in other words, you can't win the game, so you just basically by the refs now that supreme court is ramping down policies that americans do not agree with that supreme court struck down the voting rights act, even though congress had passed at passing on a bipartisan basis to reauthorize it. that's the supreme court that attacked women's rights to control their own bodies. and now the whole countries on a banana peel around ivf. this is all because really unpopular ideas that republicans couldn't get done on a popular basis have been rammed through by a judiciary that he packed and stacked i am not sad to see him go our final word on this. are you concerned at all or do you think people who should be who's going to walk into fill that role given the direction of the republican party right now, absolutely. it's a huge problem looking ahead to the door plug incident itself and into quality control at the boeing factory in renton, washington now the justice department is piling on. what does it all mean? well, this could expose bowing to criminal liability bility. if the justice department finds that boeing violated, their agreement after the 737 max eight crashes of 2,018.20, 19, the deferred prosecution agreement was reached in 2021. it avoided a charge of conspiracy to defraud the united states. boeing admitted to the fraud it's controversial because crash victims families were not consulted in all of this. that was set to expire january 7 two days after the door plug incident on january 5, that agreement cause boeing 2.5 billion back in 2021 and included a 243 million and dollar criminal fine. no comment from boeing on this latest development. also, no comment from the justice department. this is happening as these multiple investigations are appearing to come to a head this week, just yesterday, the faa came down hard on boeing saying it has 90 days to produce a plan to fix its quality control. the faa's audit and a boeing's quality control continues. that report expected sometime in the next week. this is also as ntsb investigators are still probing the quality control issue at the center of all this. why did the 737 max nine used for alaska flight 12, to leave the boeing factory in october without for
