we want to understand, where exactly we should go! >> reporter: u.n. rights experts on thursday warned that grave violations committed by israel point, in their words, to a genocide in the making. as darkness encompasses doctors in the south, already grappling with the intense bombing campaign, there are growing fears over what could come next. desperate scenes from the north of gaza almost entirely destroyed by israel's unrelenting air strikes, show just how dire the situation can quickly become. >> translator: we have lost contact with our colleagues, patients everyone inside the al shifa complex. >> reporter: israeli forces say they're still active in and around the entrance to the hospital, gaza's largest, claiming to have found a operational tunnel. with no access to the complex, cnn is unable to verify either side's claims. israel says the mel tear operation at al shifa will take time, raising fears over the safety and security of over 1,000 patients and medical staff now trapped inside. >> we are looking at options for medical evacuation, but there are a lot of security concerns, there's a lot of logistics constraints. our options are rather limited. >> reporter: allegations of people being interrogated, even stripped, are beginning to emerge. while doctors are detailing harrowing decision they're forced to make, including amputating limbs to stop the spread of infashionfection. cnn has reached out to the idf for comments. these are some of the last pictures to have been shared with the world. premature babies in intensive care. there's no way to tell if all are still alive. they're crying, some of the last sounds heard before the voices of those inside al shifa were sil silenced. there's other civilians inside the complex. as you heard out there, it's extremely difficult to even think about evacuating some of these patients who remember medical evacuation. as we now already. there's some 1.5 million people displaced. while there's been intention focus, what we're seeing across the strip, is continued aerial bombardment, continued concern over the mounting death toll we're seeing. >> nada bashir, thank you very much. let's get to more of all these developments. lieutenant colonel shelfver. is that the extent of what they have found so far, when it comes to tunnels, or is there more? >> this shows clearly there is a tunnel infrastructure underneath the al shifa hospital. we found also today a lot of explosives and other munitions in that courtyard of the hospital. also, together with what we found yesterday in the mri room, also the car that you just shown that was similar to the cars used on the october 7th massacre, and it was booby-trapped. once again showing how hamas did not care and was looking forward to explode a car inside the al shifa hospital that would have killed patients and staff in the hospital. >> can you unequivocally shows this was a major hamas command center? what do you exactly define's a command center? >> yes, we can say that now clearly. we're also showing it, on top of the evidence that we knew from the intel and that our u.s. counterparts have also verified. what we are seeing here is a place where hamas can gather. we saw the communication tools, the intel tools they needed in order to facilitate any kind of terrorist activity and carry it out from that infrastructure that they used. again, another civilian infrastructure, similarly like they use schools, like they use mosques, and like they used this hospital and qods hospitals, and another hospital, to carry out terrorist activity. >> the director of al shifa says patients are going untreated, including a lot of children. >> we have a moral obligation, and we wish to. that is why today we brought 4,000 liters of water to the hospital. that is why we brought today 1,500 prepared meals to the hospital. that's why we are continuously talking to the administration of the hospital, and the doctors to see what is needed. based on what they say, we brought in the incubators, baby food. we have designated an area of the hospital, the eastern side of it that civilians and patients that can leave should leave through the humanitarian corridors we are continuously protecting and allowing those civilians to leave. >> are you planning to deliver fuel to the hospital? >> we have offered fuel, 300 liters that our soldiers brought wile taking a risk to the hospital. sadly, the hospital did not take it in, probably because the hamas was threatening what would happen to them if they do. as i mentioned, we are in continuous communication. whatever the hospital says they need, we will try to facilitate that. >> the body of an israeli hostage, a woman, was found near the hospital. the idf says she was killed by terrorists. can you explain the exact circumstances of her death, the 65-year-old grandmother? >> 65-year-old ms. weiss was brought back to israel to be buried next to her husband, who was also murdered on the 7th of october by hamas. we have two goals in this war that hamas launched. one is to dismantle hamas. the second is to bring back the hostages now on day 41 are still being held by ha mis. the safest and fastest way for them to come home is for hamas to release them and the international community kinning to pressure hamas to do so. >> do you know exactly how this 65-year-old grandmother died? >> we know she on october 7th was alive in her bed any cubs butte be 'eri. and now we know she's sadly passed away. >> as you know, israel has dropped leaflets in the largest city in southern gaza. they previously told people to move south for savedr safety. where are they supposed to go. we knew that hamas has mare nine headquarters in gaza city, that's where we start, but sadly, they prayed over more all over the gaza strip more than 10,000 rockets have been launched. they're nom operating in gaza city, but also in the south. in order to reach or number one goal, which is to dismantle hamas, we'll go wherever they are. but we're looking for the safest places for. and now we're telling them specifically where to move within that area, and also while doing so, we're continuously in communication with any international organization that wants to aid the gazans, bring in any international medicine, facilities, food that can be helped, including field hospitals that we're inviting any country that wants to donate, so we can help the palestinians. as we said, reaching the goal of dismantling hamas will nom bring it safer for safer for israelis, but also for the palestinians. lieutenant colonel amnonshelfer, thank you for joining us. we'll be right back. a new york appeals court has just lifted a gag order on donald trump, at least temporarily. the ruling comes after trump's attorneys argued his right to free speech was being unfairly restricted. kara, what is the impact of this order? >> reporter: a new york appeals court judge has lifted a gag order, at least for now after trump's claims that it was unstill. there was an emergency hearing on that today. after that hearing, the judge issued that ruling from the bench. the gag order was put in place by judge engoron. for violating the gas order, but now after this appellate judge stepped in, trump is free to say whatever he wants about this case. trump's attorney chris kis ed said this, this will remain in effect under briefing is heard. the briefs are not due until the end of the month. this trial wraps next month, so this could be lifted for the duration of the trial. kara scannell, thank you for the update. now to an exclusive new cnn report on the special counsel's hunter biden investigation. we want more from our chief correspondent paula reid. i understand you have learned joe biden's brother has been subpoenaed? >> reporter: that's right. prosecutors are now using a los angeles grand jury to gather evident related to hunter biden's finances, signaling that additional charges could be coming for the president's son. multiple witnesses have received subpoena, one is james biden, hunter's uncle. he was also a former business partner. it appears this investigation is looking into hunter biden's alleged tax violations for allegedly not paying taxes in certain years. now, the special counsel has already filed gun charges against hunter biden in delaware, where most of the investigation into the president's son has been conducted, but these alleged tax crimes happened in southern california. that's also where he lives. the fact they're now using a grand jury there signals more charges could be coming. >> paula, i understand there's also new information about another special counsel regarding biden's handling of classified documents. >> reporter: we are told that no charge, on the mishandling of classified materials at two locations connected to president biden. he will, though, issue a report, which we are told is expected to be extremely detailed and also critical of the president and his team for how they handled the sensitive materials. now, a lot of comparisons will likely be made, especially by republicans and trump allying between the biden documents case and the trump documents case, which of course will now be a criminal trial next year. three key differences -- first volume, second cooperation, and last discementation. also, the trump team did not fully cooperate when the government signaled they wanted these documents back. of course, there is no evidence suggesting the president disseminated any of these sensitive materials, while former president trump is heard on tape appearing to share some of the sensitive information with people who did not have clearances. paula reid, thank you. just ahead, the damning house ethics record on congressman george santos. where the committee says the republican lawmakers spent campaign cash for many personal purposes, and what it means for his political future. c'mon, we're right there. c'mon baby. it's the only we need. go, go, go, go! ah! touchdown baby! -touchdown! are your neighbors watching the same game? yeah, my 5g home internet delays the game a bit. but you get used to it. try these. they're noise cancelling earmuffs. i stole them from an airport. it's always something with you, man. great! solid! -greek salad? exactly! don't delay the game with verizon or t-mobile 5g home internet. catch it on the xfinity 10g network. george santos said he will not run for reelection after ethics committee has released a scathing report, alleges that santos used campaign cash for personal expenses. >> reporter: he's been under scrutiny all year, and for the 23 federal charges he's facing. >> i have no clue what you guys are talking about. >> reporter: now gop congressman santos could be expelled from the house. >> george santos is a fraud. he should not be a member of congress. >> reporter: this from the bipartisan ethics committee, saying he's set to fraudulently exploit every aspect of his house candidacy for his own personal financial profit. the committee found he blatantly stole from his campaign, even making a payment to onlyfans. also alleging he reported fictitious loan and sustained it all through a constant stream of lies. >> i think the people from his district need representation, and they're not getting that right now. >> the damning report concludes that he knowingly filed fraudulent reports. he could be just the sixth house member in u.s. history to be expelled. >> that should be enough for members to make a decision whether or not they believe it would be proper to expel representative santos. >> reporter: in an interview he acknowledged mistakes. they said you made up your income. what happened? disnot list the income properly? >> all i can say, first, no, that's not true. second, were there mistakes made on the forms? now i know they were. was i -- were they malicious? no. i didn't understand how that worked. i'm a new candidates. i'm sorry mistakes were made. >> he denied fake loans to the campaign. they say there's a $500,000 loan that you made. >> i made it, $but 800,000 in your bank account and they say there's no evidence. >> i made -- i can guarantee you i made the financial loans on the record. >> reporter: blasting the committee calling the report biased, and a disgusting politicized smear, yet announcing he would not seek a term next year, saying hi family deserved better. despite saying this two weeks ago. >> so they expel you, you're going to run in 2024? >> absolutely. >> reporter: support is growing for george santos' expulsion. there's over a dozen republicans who previously opposed it, now supporting it. about 50 republicans needs to be there to get to the two thirds majority. for expelled that would narrow the majority to 213, means any three republicans who defect could scuttle part line votes, but it could be historic. never before in american history has someone was expelled who was not convicted or fighting for the confederacy. speaker johnson putting out a statement, saying he considers the findings very troubling, but to consider the impacts on the institution as members weigh their next step. >> manu raji, thanks. i want reaction from your political reaction. the level of detail in this report is really, really intense, stunning. have you ever seen anything like this before? >> i have. i have covered a case of louisiana congressman who was found to have $90,000 in his freezer. he alsoly also ran for reelection, was not elected, and was not voted to be expelled. lawmakers are loathe to kick people out. what's interesting about this report, though, it's so specific. not just about botox or some of the funnier stuff, but him manipulating and lying to donors. that's a no-no. you're tapping into the pool of everyone else, messing with everyone's money. i think that's something lawmakers don't like in the party. it was showing that he was double dealing with the loans, et cetera, but he was also using the fact he was in congress to continue to reach out and continue with some of those manipulations. >> i totally agree. kevin mann, what are you hearing from republicans about the truly shocking details in this extensive report? >> there's been a big shift in sentiment, about whether or not they should put a premium on defending the republicans majority. this would reduce the margin to about three votes. that is very quickly dissipating. the big concern has to be about whether or not you have members of congress to ever go home and defend an institution that would then say, we have to give everybody due process, when you have a report like this that is as scathing with as much details about the malfeasance that took place. if they're ever going to defend their own majority, they have to take action. the one thing i think you're seeing now is growing sentiment, growing levels of pressure on members to take action against representative santos. >> including a lot of republicans. kate bedingfield is with us. he's survived one vote already. you think he can survive another? >> it's hard to imagine, given the specificity in this report, and it's a bipartisan report. the previous votes were, again, prior to this report coming out. there's more sort of substance, and to kevin's point, you know, they're going to have to go home to their districts and defend it. i don't think anybody wants to defend payments of bilking donors to payments to onlyfans or botox. it's going to be a very narrow -- create a very narrow margin. there's always some desire to try to preserve your majority, but i think the severity and specificity means it's hard to do that. for democrats, for example, who doesn't vote to expel him previously, their objection was largely procedural and largely the fact that historically you would not vote to expel a member of congress who hadn't been convicted. now we have this specific report that makes it easier for them to take that procedural vote. >> and you need two thirds of a majority. audi, there was a new poll released in new hampshire. donald trump is still out in front significantly, but look at nikki haley. she'd jumped to second place. >> i think it's easy to look and thing absolutely, obviously donald trump is so far ahead, but what you also see there are double-digit percentages of people in the electorate who want another choice. they haven't coalesced around one, but that doesn't mean the hunger isn't there. kevin will talk about this more, someone has to drop out. somebody has to say i'm the most likely even if there's a fighting chance to have a conversation about a real choice. >> is nikki haley now the number one threat potentially? >> she's the top one now. clearly she has momentum, right? i would say the three cs are in play. first, more curiosity about nikki haley. that's a good thing, but are you able to convert them into real, genuine supporters? railroad able to get more as fund-raisers on your side? the last part which i think is the hardest, is consolidation. will you see more people drop out and move their support to nikki haley? those last two, i think, are all question marks. we shall see. it's interesting, to say the least. guys, thank you very much. this note to our viewers, you can find audi's podcast entitled "the assignment." wherever you get your podcasts. just ahead, new reaction to the breaking news on israel's claim of a tunnel shaft found at the al shifa hospital. the paleststinian n health mini standing b by to discucuss. we're following breaking news in the israel-hamas war. the israeli military releasing video, claiming to show an operational tunnel shaft at the gaza hospital it raided. israel says it's evidence that hamas had a command center at the hospital, where idf forces are searching and patients are suffering. joining us, the minister of health for the palestinian authority. doctor, thank you for joining us. doctors at the hospital say they've had to amputate patients' infected limbs, have you had any contact with doctors there? what are you hearing? >> yes. we have contact through a focal point that is contacting with them, and we hear the same. we have amputation of legs without answer they're use. a cesarean was done without anesthesia. and the situation is really very different and very horrific. >> israel said they found a hamas tunnel shaft, a command center with guns and ammunition underneath the hospital. how much responsibility, doctor, does hamas bear for endangering doctors, patients, sheltering civilians there? >> i have seen this as everybody has seen this on the videotape that was published. however, actually the hospital al shifa, the patients there shouldn't -- for this -- and they should be protected by the international humanitarian law. as you might know, the international humanitarian law protects hospitals and protects medical staff, ambulances, and the civilians, and this is not the case in this war. you know that the geneva convention, and it's -- and annexes as well as security council resolution 22-86 of the year 2016, affirmed what came in the international humanitarian law, and in the geneva conventions. therefore, the civilians and patients and ambulances should be protected by law. >> as you probably know, there's only one hospital in northern gaza that seems to be left right now. give us your sense of the magnitude, doctor, of this health crisis indeed across the entire hospital system in gaza. >> in gaza, there's 75 hospitals, public and private. out of these hospitals there's 26 who are not in service now because of the bombardment around some of the hospitals or there's lack of fuel and medical supplies and medicines. when we say they're not operating, this means the majority of the hospitals -- nine hospitals are left, and they are -- most of them they are in the south functioning, but still not -- now in the north area there's 24 hospitals, the shifa is the north area, and these 24 hospitals, one is left functioning in the upper north, and part of the arab hospital is working. >> doctor, thank you so much for joining us. >> thank you. coming up, a federal jury reaches a verdict in the trial of the man who bludgeoned paul pelosi with a hammer. we'll have details after a quick break. in that san francisco today, a federal jury convicted. man who brutally attacked the husband of nancy pelosi last october. we're from outside the security house. veronica, what exactly did the jury decide? >> reporter: well, wolf, the jury decided david depape is guilty on both counts. they say he did -- he was facing the attempted kidnapping of a federal official, as well as the assault on an immediate family member of a official. they also found he used a dangerous weapon. he faces a maximum sentence of 50 years in prison. immediately after the verdict was read, a spokes american for speaker emeritus pelosi put out a statement -- the family is deeply grateful for the prayers and warm wishes from mr. pelosi, the this should debt teamsed on the night of the attack a year ago, and in the courtroom this week. we do have video of the attack. it is disturbing. during his testimony this week, he said the last year is incredibly tries. he had to relearn to walk, and still goes under physical therapy to this day, and has dizzy spells and headaches constantly. it's been very traumatic. next he goes to the state trial where he's facing attempted murder as well as others. coming up, why u.s. capitol police believe they were prepared for an anti-warar prott that t turned d violent. tonight, cnn has learned that u.s. capitol police were warned of potential violence linked to events in gaza a day before they clashed with anti-war protesters. we're told the intelligence assessment helped officers preparing for what unfolded overnight here in washington. cnn's brian todd is at the scene of the clash for us tonight. brian, activists are turning up the heat clearly on top democrats, including the president. >> reporter: they certainly are, wolf. the barricades here at democratic national headquarters in washington still up after the violent protests last night. that event plus what happened a short time ago in san francisco, are certainly grabbing the attention of the president and fellow democrats tonight. today on san francisco's bay bridge, pro-palestinian protesters brought traffic to a standstill for hours during rush hour. 80 arrested, 29 cars towed off the bridge, a direct message to the president, who was attending the apec summit nearby. and this last night in washington. peace activists calling for a cease-fire in gaza. police forcefully moving protesters down a flight of stairs. at least ten democratic lawmakers, including top party leaders were inside at the time, had no way out, had to be evacuated. >> we were told we were locked down and would not be allowed to leave. then the police came in and evacuated us in the basement. >> reporter: it's led to a he said/she said as to which side provoked the violence. the capitol police said six officers were treated for injuries. the protest organizer saying the police rushed the crowd without warning and were not provoked. >> they pepper sprayed, kicked and pushed people's hair while he lit candles, prayed and sang. >> reporter: this is a broader political problem for the democrats and president biden. progressives are increasingly splitting over the steadfast port for recall in this war. >> a lot of democrats want to see the president more forcefully call for extended pauses, or a cease-fire. >> reporter: earlier this month, organizer directly told the president what he stands to lose. >> our message is, no cease-fire, no votes. no votes for you anywhere. if you will not call for a cease-fire now. >> reporter: many muss lynn voters, a key constituent in the crucial key state of michigan, have lost enthusiasm for the president, but analysts say there's even more at stake. >> it's also young voters. we're seeing them rally around civilians in gaza, calling for a cease-fire, not happy with the way the president is addressing the war. and so young voters are keyed to biden in states like michigan, in states like arizona, and in states like georgia. >> reporter: now, the president and his team have shifted rhetoric in recent weeks to calling for a reduction of civilians casualties, but the president says he still has israel's back. analysts say that's a tightrope
