hello, everyone. i'm kate baldwin, with john berman in new york. sara sidner is in jerusalem. house republicans are headed back behind closed doors. again, trying to fix their mess and come together after no house speaker for three weeks. we're on day 21 without a speaker of the house. there's eight republicans left or still vying for the job. there really is no clear path at this moment for any of them. what is clear, is that republican lawmakers, some of them, are exhausted by the chaos and getting an earful from constituents back home. >> i think people are so discouraged the last few weeks, they want to come together. >> we have to act like mature adults and come to a conclusion. i think with can. >> i think half of them can get their agent together. we need to get it done. new developments out of israel. a top u.s. marine general is now on the ground advising the idf. you see james glen right there. they had troops waiting to cross the border at a moment's notice. they might be able to delay a ground invasion, to allow for more time for hostage negotiations. israel says more could be held captive. this would be day 18 in captivity. and we're getting information from one of the elderly hostages just released. including the tunnel complex she was held in, how many people she was with and the treatment at the hands of her terrorist captors. let's get to jerusalem. that's where s sara sidner is standing by. >> good morning. the stories of the hostages released is truly terrifying. the two ladies were taken. a 75-year-old and 85-year-old were released overnight and finally back in israel today. one is talking about her ordeal. she said she was kidnapped on a motorbike, riding on her side. she was all bruised up taken on that side. here's what she said being a hostage by hamase tunnels. >> translator: i went through hell that i could not have known. people told us they believe in the koran and they will not harm wewalk inside the us. tunnels with the wet ground. there were guards and a paramedic and a doctor who took care of the fact that we would have the same medicine we need. there, we laid on mattresses. they took care of the sanitary side. we had a doctor come to see us every two or three days. >> it is remarkable to hear that. as a peace activist, you can hear she had humanity among her captors. but her heart, by the way, is still in gaza. her husband is still in gaza. so is the other husband. their ordeal is not over by any stretch of the imagination. we should talk about what is happening inside gaza. the israeli military estimates there's 200 hostages that are still there, likely in the l labyrinth of tunnels under the gaza strip. the palestinian population in gaza is a catastrophe. medical care has now collapsed. doctors are saying they are completely overwhelmed. the hospitals cannot maintain service to all of the people who need it. now this. save the children is saying over 1 million children are trapped in gaza with no safe place to go. they have warned the devastating impact of lack of medication and electricity to power, vital health infrastructure in the enclave. israel, for its own part, has intensified its bombing campaign in the besieged strip. the defense minister said the country is preparing for what he called a multilateral operation on the group that controls gaza. it's going to come from the air, the ground and the sea. kate? >> sara, thank you so much. we'll get back to you soon. on this, joining me now is a man whose cousins, they were the first hostages to be released. you'll remember this image. they were freed on friday, after being kidnapped by hamas during the october 7th attack. there's ten of their family members being held by hamas today. thank you very much for coming on. how are your cousins doing right now? >> they are physically well. they need their peace and quiet to somehow maintain some kind of normal life. and try to reconcile all of this. they are surrounded by family. trying to get as much normal as they can after this. >> whatever normal looks like. especially with family still stuck. being held captive over there. you said you want to be careful sharing details of what they en endured. you have family members being held by hamas. we understand your hesitancy given the circumstances. have they opened up to all of you about their experience? >> we did speak about what they've been through. but again, it's not my story to tell. i don't want to say anything that could jeopardize the other hostages. over 200 families that want their family members back home. we need to do everything we can to bring everybody back home. this is the main focus of us right now. >> absolutely. we just heard and played you some of what we heard this morning from another hostage released. and we played what she said at a press conference. she spoke for quite some time. what's your reaction to what you hear her saying? >> well, it's hard to -- we have mixed emotions. yesterday, we were with the fa family and we put our phones aside for a couple of hours to really just be together. after these hours that we even allowed ourselves to be a little happy for these moments since this saturday, when the attack happened, after that, we got the notice that another cousin had been murdered and identified. you know, we can't even mourn the dead family. and the little moments of happiness that some are back are filled with guilt. why they -- why did they come first? go back first? or released first? a ennot someone else? even though we try to stay optimistic at all times because the only way we can function to do what we can to help return everyone else home, we can't sleep. we eat without appetite. we're happy about anyone coming back. this is not the end, just the beginning. we won't stop until every one of the hostages are back. >> you're in the middle of a nightmare still, with families being held hostage. one is 3 years old, you said. that breaks my heart to hear there's any guilty feeling that comes up for being the first to be released. that's heartbreaking to hear. the compounding tragedy of what they're going through, even after getting to physical safety. thank you for coming on. please give a hug to natalie and judith from all of us. >> thank you for having me. and hearing our family's voice. with us, retired general wesley clark, supreme alleyed general. she talked about the tunnel complex she was held in. she mentioned there were other hostage there's. multiple hostages with her. there was one terrorist per hostage underground there. how can israelis use that information as they plan this offensive? >> i'm not sure it is usable. it's what we would expect. they're going to take good care of the hostages because the hostages are valuable. you're going to put guards on each hostage and put an additional gourd in for the medical conditions and so forth. what we don't know is where they were in the tunnel complex. you have the motion of tunnels up there. but we don't know what's up there. >> that's a good point. this is from 2021. you can be sure they have changed, expanded. >> multiple levels, blind alleys, lots of different things going on underground. they are producing weapons. they have stores under there. you don't know until you get into the tunnel complex. i kthink it's a good thing the hostages are released. i don't know what intelligence value it's going to have. >> i want to ask about this general, we learned overnight is on the ground, advising the idf. what do you think is the nature of the conversations? >> this is an important set of operations. we had some early ideas in mostle, working with us to get rid of isis. we learned a lot. the highest, professional levels to be useful. what's the right of a military objective to go into in gaza? we're trying to secure the desalization plants. site a mosque? where are we going and why? what's the next step? how do we support ourselves and secure the lines. we've gone into lots of security informations here. >> let's talk about the offenses. the first piece of other information, even as israeli troops are aligned along gaza. you have infantry and armor. and sea power that the israelis have here, too. axios is considering that there's a pause on the ground operations to give time for discussions. what does the pause do for these troops waiting? you may get night vision goggles or other things. may be able to preplan logistic support and move logistics forward in better areas. the longer we hold this off, the longer for the economy and israelis. l let's get going. the waiting time is extremely valuable. there should be no great rush to cross the line of departure before every detail is thought about and worked. as you get the troops there and thinking about the things, they are asking more questions. they are working through the details. you don't want to go into something like this with ready-fire aim. you want the details of planning to be done. you can use this time. >> meanwhile, the operations from the air continue. and we got word overnight there are targets. one of them includes sites near rafah in the south here. that's the crossing that aid has been coming into from egypt. it's below the lands where israelis told them to move south of. what would the nature of the targets be? >> command centers. logistics. factories, underground. we don't know. one of the things that is interesting is the israelis aren't telling us much about this. i ran an air campaign in kosovo. you run out of targets. how do you get -- for each target, you have to know why you're striking it, how you're going to approach it, what the right weapon is. murs have a lot of intelligence built up on it. as -- if there is a cause and if the israelis have rights, i hope they share with the international community, some of the thinking of the targets and why they are hitting the targets. they are in an information war. when the palestinians report another 500 people killed overnight, there needs to be an explanation for why that is hit. we don't have that. >> the information war can be explosive at times. wesley clark, thank you for being with us. coming up for us, the secret ballots. republican lawmakers meeting right now to try to witle whittn the field and choose a speaker of the house. for the first time in five years, donald trump will be face-to-face with his former attorney, michael collins in a manhattan courtroom. and new details from passengers on the flight where an off-duty pilot has now been arrested for trying to shut off the planes' engines, mid flight. >> the flight attendant came on the loud speaker and said we needed to land immediately. we didn't know where we were landing and we didn't know what was wrong. you know, when they do that, they are going against the conference rule. there should be con consequences for this. in the conference rules you need 50%. and those crazy eight work with all of the democrats. no one thought they would -- i think it sees that it's a failure here, it's hard for them to do it again. i don't know how they will do it again. >> what kind of compromise? >> that was former house speaker kevin mccarthy just moments ago, as he was heading into this room, where happening now, at this very moment, house republicans are voting on a new nominee for speaker. this three-week circus that began. they are choosing from eight candidates. congr one dropped out. they will meet behind closed doors until one of the people gets the majority of the conference. it's on. let's get to lauren fox on capitol hill. where are they now? >> they are heading in, to the meeting behind closed doors. it could take a significant amount of time to get through the secret ballots process. every round of voting takes roughly about an hour to complete. they have to hand count the votes. after each round, the lowest vote getting candidate will be dropped from the race. because there's eight candidates, that could take a significant amount of time. the big question is whoever gets the majority of support in that conference meeting today, that does not necessarily guarantee they will be able to get the votes they need on the house floor. that's the issue that has bedeviled steve scalise and jim jordan. it's a tough climb for any of the kand date candidates to get they need to be speaker. i talked to someone who has a lot of respect within the conference and a good pulse on where republicans are in this moment. he told me, a lot of the blood letting and emotion has started to dissipate within the republican conference, after three weeks after a search for a new house speaker. he thinks they will be able to unite. again, it's a looming question right now. if tom emmer, the remember whip seen as the front rupper, there's some questions about whether members of the house will back him. john? >> that's the big question. the first answer we'll get, which one of these remaining eight gets the lowest vote totals. we're looking at the vote total of the highest earner in this round. how close is he close to getting a majority of the conference. we could get answers in the next 45 minutes or so. keep us posted. joining us for more on this, mark alfred. i know you will have to jump behind closed doors. thanks for this. is this week showing more progress than last week or the week before that? >> kate, it is. we've been three weeks, a ship without a rudder. three weeks since kevin mccarthy was fired. we need to move on with the business of america. ssed, providing aid to israel.s something happened behind closed doors. everyone, the eight remaining fina finalists, if you will, said they would support whoever gat t got the majority of the conference. they are willing to have a roll call vote if they do not get the majority or if they get the majority of votes. if there is some time before we go to the floor. they will have a roll call vote to make sure we have the votes before we go out there again. >> republican congressman matt gaetz says they might have a speaker come tonight. that seems optimistic. kevin mccarthy just told reporters he said, it will get done this week. are you sure it will get done this week? >> i'm hoping and praying it gets done this week. we ended up with eight men of integrity. i don't think they ticked anybody off in our conference. men with different backgrounds. one owned mcdonald's restaurants. a great leader. we don't just need a speaker of the house, we need a listener of the house. i think that's kevin hearn. >> haven't ticked anybody off is a good point, if you want to be speaker of the house. talk about the flipside. we're day 21 with no spoker. is there a chance, that no one is able to emerge with 217? >> it's been kicked around before. we doubt that jesus christ could get 217 votes. i don't think we're at that level of pessimism today. because of the agreements in our conference, we're whittled down to men who can meet people in the middle. people like kevin hearn, mike johnson, who can bring in the freedom caucus and bring in more of the liberal or moderate republicans. the key will be getting the majority today and looking for the roll call vote so everyone can get up and tell where they stand. that person can go to the holdouts if you want to call them that, and try to win them over. >> i will say, people are not afraid to stand up on the ballot. it's not public opposition that's holding this thing up. c kevin mccarthy is calling them the crazy eight as this point. you know who they are. >> well, i'm not into name calling. >> not me. that's kevin mccarthy, to be clear. >> i know. i know. i think the way to get things done is in the family conference. i'm a freshman. there's a lot of hurt feelings in our conference. those are coming out. last week, we had one that lasted three hours. there's a lot of emotion being shared. that's healthy to some degree. people are having conversations after that, one-on-one. if we can reach common understanding and reflect to one another, we'll be better off as a conference. a leader will emerge who can rally everyone around him, to lead america. >> nice. no matter how much therapy you guys are getting in that conference room, i don't think that job will be easier when you do reach a conclusion. congressman, thank you so much for coming in. if you head back into the meeting now. thank you, sir. >> thank you, kate. >> kate is not into name-calling. iranian-backed militia groups in many countries around israel, are planning to amp up attacks on u.s. forces in that region. also, face-to-face for the first time in five years, donald trump and his one-time fixer michael cohen will be in the same manhattan courtroom. we have breaking news about the fulton county courthouse, about one more of the defendants in the georgia election case. i think nick is in the courtroom. >> i'm just outside in the hallway. and things are moving fast and furious. this comes on the heels of two high-profile ceos. and it appears this morning, in an impromptu hearing that a plea deal is in the works for jenna ellis. in the original indictment, ellis is charged with two counts. racketeering count that all are charged, with and violation of trying to solicit false statements from an oath of a public officer. jenna ellis is accused of organizing a handful of meetings with georgia lawmakers, that widespread conspiracy theories, fraud issue were brought up that did not exist. and the meetings were attended by the former attorney for the former president, rudy giuliani. the meetings were set up by jenna ellis. and it looks like this has all of the familiar optics of the past plea deals we've seen. just stepped out of the courtroom. jenna ellis is in the courtroom, along with her attorney and the lead prosecutor from the district attorney's office. all of these look familiar and similar to what we've seen and how it went down with past plea deals. just before i got on the phone with you, john, i stepped out of court. and papers were signed and handed over. all of this is happening in real-time. we're the only network here and the only news group. this is an impromptu hearing that we were tipped off to, by great work for our journalists. baz thing because things are moving fast. several co-defendants have taken plea deals. i told you about sidney powell and it appears another plea deal is in the works for attorney jenna ellis. >> there was a plea deal by scott hall, one of the lesser-known defends. it was sidney powell and ke kenneth. what is inside. it appears that jenna ellis, this trump campaign lawyer, is in the process of entering in a plea deal. i'll circle her with red, that indicates it's different than the others. she did not have a trial date looming. ch jenna ellis was some time in the distance. any reporting on what may have pushed her to this moment today? >> we don't. we've been calling her attorney because we heard whispers this was potentially, discussions were in the works with the district attorney's office, after the others took their deals. we never got comment from her attorney. >> we're looking inside the courtroom. it's all going on. let's listen. >> minimum and maximum sentence with your attorneys? >> i have. >> do you understand that carries one year to five years to serve. >> yes. do you understand that you have the right to plead guilty or not guilty to this charge? and if you plead not guilty, you have a right to remain silent and move forward with a jury trial? >> yes. >> have you reviewed the waiver rights with your attorney? >> i have. >> have you gone over them and signed with your attorneys? >> i have. have you had enough time to speak with your attorneys in regard to the facts in this case? >> yes. >> you must continue to provide additional recorded statements and affidavits to the state, as required. and you must provide any documents as serving this state. that you shall not post anything on social media, including through any agencies about this case, until the conclusion of all trials and appeals. you must continue to fully cooperate with prosecutors, included but not limited to participating with prosecutors, appearing for hearings and assisting in pretrial matters. do you understand this is the recommendations that the state is making to the court? >> i understand. >> do you understand you are waiving all defenses, including mental health defenses by entering the guilty plea? >> yes. >> you understand if you went to trial, you would have the right of troil by jury -- >> we are listening in to what is happening right now as we speak, in fulton county, georgia, courthouse. that's jenna ellis and her legal representation on the right. she is one of the people who has been charged in fulton county, alongside donald trump. it looks like it appears that she is planning to plead guilty in the georgia election subversion case in some agreement with the prosecution. zach cohen is joining us now. you have more background on all of this. as we watch this play out, what are you learning and remind folks what they should know about jenna ellis. >> i think it's interesting. we see the dominos are starting to fall here in terms of the guilty pleas being entered. jenna ellis is the fourth co-defendant of donald trump to enter a guilty plea. you see her doing it as we see now. jenna ellis is an important figure in this investigation. this is a sprawling conspiracy case. looking at overturning the election results in georgia. she was instrumental in a few ways. she was a member of the trump campaign legal team. she was close to people like rudy giuliani. she worked with sidney powell, who entered a guilty plea of her own last week. she also was responsible for organizing the legislative hearings in georgia. basically, baseless claims about election results being tainted there. they were presented to friendly republican lawmakers. she wrote legal memos arguing that mike pence did have the ability to overturn the election results on january 6th, 2021. so, another high-profile lawyer here. co-defendant of donald trump, pleading guilty and taking a deal with the prosecutors of georgia. >> if this case has gone to trial, the state would show the following. on december 3rd, 2020, the defendant did appear before a subcommittee in fulton county, georgia, with co-defendants and other individuals associated with donald j. trump for president incorporated, also nope as the trump campaign. giuliani and smith, acting as attorneys for the trump campaign, made the following false statements. one, that at least 96,600 known ballots were counted in the presidential election in georgia, despite being no record of those being turned to a county election office. two, that 2,506 ballots were counted illegally in the november 3rd, 2020, election in georgia. that underaged people illegally registered to vote, before their 17th birthday, prior to the november 3rd, election in georgia. 3,423 people voted on november 3rd, 2020, presidential election in georgia, who were not registered to vote. that 1,043 people voted in the november 3rd, 2020 presidential election in georgia, who had illegally registered to vote using a post office box. that 10,315 or more dead people voted in the november 3rd, 2020, presidential election in georgia. and seven fulton county election workers at state farm arena, ordered a number of media to leave the tabulation area on the night of november 3rd, 2020, and continued to operate after ordering everyone to lead. the false statements were within the jurisdiction of the georgia secretary of state and the pool of investigation, who are conducting investigations into allegations of fraud in the november 3rd, 2020, presidential election in georgia, once completed, these and other investigations affirmatively determined that there was no widespread fraud, that could have affected the yooutcome of e 2020 election in georgia. the false statements were made with reckless disregard of the truth and with conspicuouse purpose of learning the truth. the defendant abated with the execution of the december 3rd, 2020, senate judiciary committee meeting in fulton county, georgia. the false statements were used as a plan by the trump campaign to solicit the general assembly to disregard the election results of this state and to unlawfully appoint nonelected presidential electors in violation of the oath to the georgia constitution and to the united states constitution. similarly, false statements and solicitations were made to state legislators in arizona, michigan and pennsylvania, and the defendant was present and assisted with execution of those meetings. and she was in attendance with giuliani in arizona and michigan and pennsylvania. that would be the factual basis that the state would have proceeded on, your honor. >> anything furtherer from the state? >> just that we filed a motion. under the original indictment. >> turning to mr. hogue. just a few matters of housekeeping before with you have the floor. would you be requesting automatic sealing in this first position? >> that's one of the two notes here to ask the court to do that, under 428621-b, please. >> and was part of the negotiated resolution, anything about a behavioral date? >> that's three years. >> is that right? >> that's correct, your honor. >> anything else that you would like to add? >> yes. if you could make a note this is not a crime of moral turpitude, that would insist us in other venues, perhaps. >> is that an issue of negotiation between the parties? i know that has differed from resolution to resolution here. where are we with that? >> it is not, judge. we're going to ask that the same verbiage be put on this disposition, as well. it says the defense of the state, have agreed that this is not a crime of moral turpitude. >> just to clarify, it's not a point of contention between the parties. it's being recommended, this language? is that the case for -- we need to enter the sentences. the prior resolution is reflecting that. is that the same for all three prior resolutions in this case? >> yes, your honor. >> if that is the joint recommendation, i -- that will be part of the global recommendation. understood? >> the only other thing is if the court is inclined to accept the negotiated plea, ms. ellis would like to exercise her right of allocution and make a brief statement to the court. >> all right. so, i think i would typically have that as part of the record, before we finalize everything. so, at this point, ms. ellis, you are not required, but the you would like to add anything to the record or address the court, you can do so, and now the appropriate time to do so. >> your honor, i have it in writing of what she is going to say. >> i have it attached as state's exhibit one. >> oh, you have it already. >> and this is going into the state's exhibit one as the written form. >> yes. >> okay. thank you, mr. hogue. >> thank you, your honor, for the opportunity to address the court. as an attorney who is also a christian, take my responsibilities as a lawyer very seriously, and i endeavor to be a person of morale and ethical character in all of my dealings. in the wake of the 2020 presidential election, i believed thatle chaing the results on behalf of president trump should be pursued in a just and ethical way. i endeavored to represent my client in the best of my ability. i relied on lawyers with more experience than myself to give me true and reliable information and especially since my role relied of speaking to the media, and what i did not do is to make sure that the facts that the other lawyers alleged to be true were in fact true. in the frenetic pace of raising challenges to the elections in several states including georgia, i failed to do my due diligence. i believe in and i value election integrity and if i knew now what i did then, i would have declined to represent donald trump, and i look back with deep remorse. vi taken responsibility before the colorado bar who has censured me and i take responsibility before this court and i apologize to the people of georgia. thank you. >> and thank you, ms. ellis for sharing that all too often. i don't get to hear the perspective of the accused in these case, and so that is appreciated. >> thank you, your honor. >> anything else, mr. hogue, that you would like to have as part of the record? >> no, your honor. >> i have a few questions that i have to go over with you, ms. ellis. do you understand the nature of the charge as it is recused against you? >> i do. >> and as going forward, do you wish to waive the rights? >> i do. >> and are you going forward as outlined a factual basis to complete this plea? >> i do. >> and do you believe this is a competent and factual basis to support this plea? >> i am, your honor. >> ms. ellis, do you have a weapons to carry of any kind in this state or any other? >> i do not. >> will i find that there is a sufficient factual basis for the charges and i find that this is knowingly and intelligently entered. you have asked to be sentenced under the first offender act which is a request i will approve and with adjudication, and you cannot withdraw your plea because you don't abide by the terms of the sentence and the terms of the sentence would be as negotiated and agreed to by both par tirs of aiding and abetting both parties and the sentence is five years probation, and you are the pay a $5,000 fine to the secretary of georgia's office within 30 days to enter the final disposition of the office, and complete 100 hours of community service, and you are to cooperate with the state and test truthfully with any legal proceedings in this case and no contact personally or through any other agents with the immediamedia or co-defendan this case. and we will include the language sent to us from ms. young subsequently with mr. hogue attached on the email to make sure that it is the exact language as agreed to by both parties. as requested by counsel as first offender, sealed upon completion, and i have been provided a motion to null process the indictment, and i'm signing that now. is there anything else from the state that you believe that we need to have on the record in case? >> judge, if i misspoke, it should be a $5,000 restitution, because the max fine is only $1,000. it is my mistake. >> no, it is $5,000 restitution, and i did not hear a fine? >> there is no fine, judge. >> understood. anything else that i need to clarify or obviously, we will, as i mentioned go off of the language that we were provided subsequent to the hearing. anything else from the state though? >> so, they will try to get it started with florida, and then if florida states that we have everything, and then she can possibly go back to florida today, but if we don't have everything that we need, and florida does not state that they can take her, then she would have to stay until we can get that taken. >> it is 1:00 p.m., and i would have the court to exercise the court to allow her the travel, and she has been on bond, and it has not been that long, but she has abided by all of the conditions, and everywhere and whenever and we thought perhaps we would have this done yesterday, and that is the problem that it is now. >> any thoughts of the state of including some kind of language to allow some flexibility here on making sure that the probation paperwork is in order?
