"erin burnett outfront" starts right now. out front next, trump returns the favor backing jim jordan in the race to be the next speaker of the house. someone who's leading the way on trying to impeach biden and one of the biggest backers of trump's rigged election claims. plus, breaking news. an appeals judge denying trump's appeal to halt the fraud case. michael cohen will be "out front" tonight. putin's latest strike killing a young boy. tonight there is a threat of more to come. let's go "out front." good evening, i'm erin burnett. "out front" tonight, trump playing king maker backing congressman jim jordan and his bid to become the next house speaker. jim jordan has a long history of doing trump's work for him. in fact, jordan is now one of the heads of the biden impeachment inquiry, something that trump, of course, made clear absolutely had to happen. >> they should investigate the bidens. >> i call them corrupt joe. crooked joe biden. i believe we have a compromised president. >> jim jordan heard trump loud and clear and repeatedly and he's taken action. >> there are some members of your committees that are talking about impeachment. is that on the table? >> it sure is. he actually did what they impeached president trump for. >> well, the impeachment inquiry that jordan is helping lead is just the latest example though of trump -- of jordan going full maga for trump. >> it was a rigged election. it was a -- and it was really a sham. >> i don't know how you can ever convince me that president trump didn't actually win this thing. >> they cheat and they cheat like crazy. >> what are the democrats trying to hide? let's get to the bottom of this. >> this election is a fraud. >> there was fraud. >> the democrats are trying to steal the white house. you cannot let them. >> americans instinctively know there was something wrong with this election. >> that last comment from jordan was january 6th, 2021, as thousands of trump supporters began clashing with police outside the capitol. look, there's been no daylight between jim jordan and donald trump for a long time. jordan attended white house and campaign meetings on overthrowing the election. jordan defied a subpoena by the january 6th committee to testify. jordan has put his career and his reputation on the line for trump and now trump is endorsing him. it may well give jordan the gavel, but he does have at least one declared rival for the speakership, steve scalise. that rivalry evolved into one other example of republican chaos. this morning they agreed to do a debate on fox news. everyone finds out about it and the republican uproar to such a breach of protocol, to such a publicity stunt was loud and clear. one republican calling it a circus. another saying it's, quote, insanity. another saying, quote, people are pissed. a few hours later after it was announced, suddenly the debate was off, it was canceled. that's just another layer in the chaos that's been engulfing the house. melanie zanona is out front on capitol hihill. he played king maker with mccarthy. now here he is, he's picking jordan. will this endorsement will have an impact? >> i think it cuts both ways. this will help jim jordan with the right and with conservatives. we did already see a number of them come out and say they are now backing jumpim jordan becau of trump. i talked to troy nels. he said i am not going to go against the former president's wishes. on the other hand, this endorsement is not going to do anything to win over the more moderates in the party. they have a lot of concerns about a jim jordan speaker candidacy because he's a flame thrower, because he's the face of the impeachment. he's arguing he's best positioned to unify the party. >> i know you've been talking to your sources, melanie, about the chaos. the debate gets planned, canceled. what are you learning? >> reporter: there's a lot of whiplash today inside the house republican party. this all started because i'm told fox news reached out to the speaker candidates doing this televised event in the capitol on monday, after it was announced, almost instantly i was getting messages, my phone was blowing up from moderate republicans who were worried about the optics. ca carlos gimenez said this is a horrible idea. i think all of the backlash speaks to the idea there is so much uncertainty and raw emotion in the house caucus. they want to get this right. they don't want to see more embarrassment or dysfunction on the floor like we saw when kevin mccarthy was removed or in january where it took 15 rounds for kevin mccarthy to get that speaker's gavel. at this point it's unclear whether scalise or jordan can unify the party and go to a floor vote. they'll have a candidate forum on tuesday and they'll huddle behind closed doors to elect their nominee. >> thank you. they'll behind closed doors do that this time. eight took down mccarthy. the vast majority, 210, wanted them to remain. one is anthony desposito. he's with me tonight. and the other is ted lu. i want to begin with you, congressman desposito. you were against that effort to oust speaker kevin mccarthy. >> yes. >> i know that today you had a chance to speak to jim jordan and also with kevin hern who is considering a bid for speaker as well. you've spoken to steve scalise who is declared as the candidate for speaker. have you made your decision? >> i have not. i am constantly in contact with members of the new york delegation. we will vote for this in one unified bunch. we know what's important to the new york voters. we know what's important to long island and we want to make sure that the next speaker of the house understands the unique situation that we have here. >> so when trump comes out with this endorsement of congressman jordan, calls him a, quote, star, does that influence your decision one way or the other? >> it doesn't. my decision is going to be based on the feelings of there is a lot of unifying we have to do in taking part in over the next days and weeks. the party and the members are angry. they are upset. we need to do our best to unify the party and get to work because that's what the american people sent us here to do. >> you sent a letter condemning the chaos caucus. in that letter there's a line, congressman. the injustice we all witnessed cannot go unaddressed. you obviously are taking this with great gravity and seriousness. matt gaetz who led that mocked your letter. tonight he wrote, quote, thoughts and prayers. what's your response to that, to just being, you know, a mocking response to something that you took so seriously? >> yeah. i think that matt gaetz has made a joke of this since day one. this has never been serious for him. this is about a personal vendetta that he had against -- one of this nation's oldest institutions to take out a personal vendetta, and quite frankly he's an egotistical maniac and he's using his extremism to halt government. instead of doing what we should be doing and that is governing and getting appropriations bills on the door, he's concerned about getting retweets and raising money. >> i want to ask you one other question tonight about former president trump. he's coming under fire for making anti-immigrant comments in an interview. this echos language used by a white supremacist. i want to play for you what he said. >> nobody has ever seen anything like what we're witnessing right now. it is a very sad thing for our country. it's poisoning the blood of our country. it's so bad. and people are coming in with disease. people are come being in with every possible thing that you can have. >> just to be clear, congressman, the specific reference to poisoning the blood. blood poisoning was a phrase that was used repeatedly by hitler, very specifically blood poisoning. so what's this -- what's your reaction when you hear this sort of language, what he said all together from the former president? >> well, perhaps not the best choice of words, but ishl that what we're seeing at the southern border is unprecedented. i think we've now seen across the country democrats and republicans. look at new york, for example, i mean, the mayor has flat out said that what's happening at the southern border is going to destroy new york city. >> yes. the. >> the governor has said that it's clear that people from both sides of the aisle agree we have a real problem at the southern border. that's what we should be focused on now, not matt gaetz and the situation he's put us in. >> congressman, i appreciate your time. thank you very much. >> thank you. and i want to bring in now as promised the democratic congressman ted lu of california. congressman, first your reaction to congressman desposito regarding the race. it was very clear that the letter he wrote with 44 other republicans, that he had done so with great seriousness saying how unacceptable the situation was and saying matt gaetz's behavior is that of an e egotistical maniac. >> let me suggest a contrast. when democrats were in control, we reduced the cost of medicines. this year when republicans control they took us to the brink of a default on our debts, they took us to the brink of a government shutdown. this is just the latest example in a string of events showing that the republicans can't govern and they have division, dysfunction and disarray. we support hakeem jefferies for speaker and we ask people to come join us. >> well, i understand that, but of course they have the majority, right? they're going to pick. well, theoretically they're going to pick. on this front you know jim jordan because you're on the house judiciary. you know him. you see him every day. he told manu raju today that he should be speaker because he's someone who can, quote, unite republicans? but in the context, congressman, of what you see, how he conducts himself, how he treats people, how he leads on your committee, what do you think of his leadership? >> let me just say again that jim jordan ignored a bipartisan congressional subpoena. his unprecedented actions have damaged the rule of law and made it harder for all congressional committees to get information from witnesses. that's the first thing american people should know about jim jordan. he violated and totally ignored a bipartisan congressional subpoena. having said that, i'm happy to work with any republican speaker as long as -- that they keep their word and they want to help the american people. >> so that speaker, who knows who that will be, but mccarthy had worked with you on a couple of things. the government had remained open, right? that last minute there were some things that happened -- >> he did not work with us. he did not work with us. he gave us a resolution bill with no notice, called a vote immediately and we asked within 90 minutes to read that bill and he rejected that. he did not work with us. he was surprised that we voted for that bill. >> all right. so i understand what you're saying, but nonetheless, the bill passed. you guys -- you all somehow kept the government open. i put it in this context, congressman, you sometimes have to choose from what you're given. the conservative group heritage action tracks voting members. this is conservative positions. jim jordan's lifetime score is 95%. mccarthy's is 53%. right? democrats chose not to save mccarthy but wouldn't speaker jordan be better for the house, for what you believe in than what speaker mccarthy was? >> i think speaker mccarthy could have made it in a way that democrats could have supported him. this entire year he said he wouldn't work with democrats but he couldn't govern. he brought the nation to crisis after crisis. then he sided with the extreme mag a wing of his party. on top of that, his word could not be trusted. i would rather deal with someone who has principles. i can work with those principles and find ways to help american people. >> like jim jordan? >> it's hard to work with someone who you can't trust. >> all right. congressman lu, thank you very much. i appreciate your time tonight. i appreciate you with us. breaking news, a judge rejecting trump's appeal. plus, 120,000 people pouring into armenia, and we're live there tonight because this growing disaster all comes back to vladimir putin. and new video of the deadly car crash involving the now wife of senator bob menendez. >> didn't do anything wrong. >> why is that crash under investigation again? and does it have something to do with the bribery charges she and menendez are facing? breaking news. an appeals court judge rejecting trump's bid to pause the fraud trial. the judge did agree to temporarily halt breaking up trump's businesses. this as a deputy testified to fraud today. he's a former employee and co-defender. he testified he inflated the value of trump properties significantly and he did so at the direction of eric trump, trump's son. according to him he was told to include the value of seven homes when valuing a development called seven springs even though the homes were not built. he testified he continued to value trump's briar cliff golf club at $104 million. the appraise al was less than half of that value. why did he do it? he says eric trump told him to, quote, leave value as is. former lawyer for donald trump, michael cohen. he is the author of "revenge, how donald trump weaponized the u.s. department of justice." michael, i really appreciate your time. you know more about what they're talking about in this courtroom than anyone. this major development in trump's lawsuit against you happened today. i want to ask you about this. what he said about eric trump, how much trouble is eric trump in right now, do you think? >> it sounds like it could be a lot. you know, the fraud doesn't start and stop with donald trump. it also now of course goes to the children. it was allen weisselberg. it was also jeff mcconnie. i do think the statements that were made by jeff mcconny certainly injurious not just to the trump organization but to eric trump as well. >> you know mcconny and all of these individuals involved. you worked with all of them. >> yes. >> mcconny testified he and allen weisselberg agreed to calculate the value of apartments at trump park avenue without saying that the units were rent stabilized, which of course significantly lowers the value. they calculated mar-a-lago's valuation as if it could be sold as a private residence, meanwhile he didn't know that trump had deeded away the right to do that, right, so that it had to stay a social club. it could not have that private residence value. when you look at all of this, michael, given what you know of every one of these individuals and how things were done because you were in the rooms, is it possible trump was in the dark for all of this? >> no, and i think that mcconny also made a statement to the extent that donald trump had the ultimate signoff on the documents. i also believe that donald bender from mazers stated the same exact thing. look, i also testified before the house oversight committee and said the exact same thing as well, that everything that happened at the trump organization happened at the direction and with the explicit knowledge of donald j. trump. >> and you were, and that's by the way a big part of the reason why this case is happening right now, is because of what you said in that room specifically referring to valuations and trump getting loans from deutsche bank. wil leticia james put out a statement late last night, michael. >> the defendants like to act as though this case is very complicated when, in fact, the fraud they committed is simple. donald trump often calls his business perfect and beautiful, but it's clear that when it comes to running a company, he doesn't care about the real numbers or the facts. >> as i said, michael, you're likely to be a witness here. you're on the list. they all want to hear from you. are you confident that from what you know and saw that you can link donald trump directly to this very clearly established pattern that the judge has accepted, pattern of fraud with your testimony? >> the answer is yes. i don't want to at this point and time go into how i will have that established or the extent to which the attorney general's office will be questioning me, but i can assure you that as i had stated once again before the house oversight committee, everything that happened at the trump organization happened with the direct knowledge and at the direction of and ultimately signed off by donald j. trump. there's no way for him to escape this. >> so you have more examples? you've got the receipts? >> yes. and, actually, the receipts are in the hands of the attorney general. >> all right. and we -- literally, right? we also learned late last night, i wanted to mention this lawsuit against you. donald trump had this lawsuit against you, michael, $500 million he was suing you for. he dropped it. he dropped it four days before he was scheduled to be deposed in the case. now he had claimed you breached your obligations as his confidante and lawyer and by publishing your books and media appearances like this one, but, again, four days before his deposition he drops his $500 million lawsuit against you. why do you think he did that? >> well, he's certainly demonstrated that he didn't want to be deposed by danya perry, my attorney, or her team. he certainly was concerned that some of the information he may have to testify to, because it was an expansive testimony, that it could ultimately implicate him in crimes and that he earlier needed chris keyes to prevent him from implicating himself from being able to assert the fifth amendment. this is the craziest scenario. everybody acknowledges that it was retaliatory for my participation with the manhattan district attorney case, it was done to harass me, it was done to financially harm me and ultimately what we did is we decided that we were going to accept the complaint and we were going to press him for his deposition. as we expected, he certainly didn't want to do that because the second donald trump opens his mouth, he implicates himself in something. he's not a good witness by any stretch of the imagination and he had no interest whatsoever in being deposed by myself or by my counsel. >> that lawsuit, of course, dropped. michael, thank you very much. i appreciate it. >> it was good to see you. >> all right. you, too. next, russia unleashing a second day of strikes targeting civilians, this time killing a 10-year-old boy. there are threats tonight of more to come. plus, new video of the time police arrested a man for the killing of tupac. >> what have they got you for, man? >> reporter: well, we can really see the utter devastation now. want to get out of your way, erin. you can see what was left of the building hit by the missile in the night into thursday. you can see it's basically raised to the ground, there's only the foundations left. one of the interesting things, erin, is this missile was the same missile used on the house in kharkiv. it's a very powerful one with a very powerful warhead and you can see what it does to residential buildings when it hits them. the same happened in kharkiv. what we did today, erin, we managed to fly a drone over the area here. when you see this kind of footage from above, it really giving you a better view of just how devastating this strike was and that basically people who are inside this building, we saw that firsthand when we got here yesterday, had absolutely no chance of survival. now, of course, as you can imagine, all of this is causing huge agony here in this very small village. in fact, about 1/3 of the population of this village has been wiped out. we've spoken to some people who witnessed this attack, who heard this attack and all of them have lost loved ones. here's what folks said to us. >> translator: my neighbors, two women and a man, a lot of our people were killed here. >> translator: maybe the russians thought there was a military man being buried and that other soldiers would gather. i don't know what they thought. maybe they hit him on purpose to make people angry, but it's much more than that. what kind of people should be like that? god bless. it's not christian. it's a sin. >> reporter: so as you can see there, erin, a lot of sadness. a lot of anger towards the russians as well for this strike. of course, we are in saturday here in eastern ukraine, so in a couple of hours the first burials are going to start for the many victims here of this attack. a lot of people here obviously are going to be putting their loved ones -- laying them to rest in just a couple of hours from now. the agony and the anger on the part of the government of kyiv. >> literally people pulverized. 1/3 of an entire village. fred, thank you very much. as putin tries to bring people under control, zaporizhzhia is calling for the invasion and occupation of more territories, latvia, laith thr lithuania, poland, estonia. >> translator: i believe we can return all of this by the force of the russian weapons. bring back our people, our subjects. previously belonged to the russian empire. >> our subjects to the russian empire. it don't get more clear than that. putin using so-called peace keepers has done little to stop a violent military offensive by his ally, azerbaijan, in a region called nagorno-karabakh. that has left 120,000 ethnic armenians to have to flee. putin himself had guaranteed his troops would protect ethnic armenians but now they're not. it comes after armenia's prime minister began criticizing putin's war, even sending humanitarian aid to ukraine. now there is a crisis. matthew chance is "out front" on the ground in armenia tonight. i do warn you that the images he is going to show you may be disturbing. >> reporter: this is where the most desperate from nagorno-karabakh are surviving. abandoning their livelihoods and homes for the safety of these refugee beds. entire families have come, like the vanians who say their remote village was bombarded relentlessly by azari guns forcing them to flee. it was so painful to leave, especially for my children, anaida tells me. we were farmers. we had everything, but it was a massive war and we had no choice, she says. >> these people are the most vulnerable. they would be on the street or in their car if they weren't here. >> reporter: this co-founder from boston has witnessed the physical and emotional impact of the evacuation firsthand. >> reporter: try and give us a sense of the trauma that people have endured. >> it's -- it's mass exodus. these people, some of the people that are here, they -- third day, fourth day, they're still in shock. they don't know where they are. there are families here still saying i'm waiting for the bus to take me back home. >> reporter: the road from nagorno-karabakh is very long. it's very winding as well, it's also very empty, as are the settlements across the border in azerbaijan that we've managed to have a glimpse of because all 120,000 people who once lived there have now evacuated those settlements and they've come to armenia where they're living in hotels, in refugee centers or with family. in border towns like goras where local authorities are distributing basic supplies to eva evacuees, some who spent a lifetime fighting for a homeland that's now lost. azerbaijani government says if you live in nagorno-karabakh or one of those villages, they will protect your rights. do you believe them? >> they will never protect us, they're lying, suzanne na insists. i'll never forgive them for what they did to us, she adds. there are some with far more than emotional scars. we visited one hospital filled with victims of a make-shift gas station blast in nagorno-karabakh where people had been frantically gathering fuel. >> you can hear screaming. as the doctor described the carnage, you could hear the screams of agony from the wounds. >> reporter: can we go and see that now? can we go and see that now? in almost every room here there's a horrific story of pain and loss. 25-year-old victor asked us to hide the burns on his face. it was like hell he told me and now i don't want anyone to see. his friend mikhail says he lost five members of his family in the chaotic evacuation from nagorno-karabakh. but no one seems to care, he told me. when it comes to us, i think the world must be blind. >> matthew, it's just so disturbing and horrific and of course this is -- putin was the one who was going to stop this and is now actively enabling, if not encouraging. what is this doing for the reputation of putin and russia right now? >> reporter: i mean, it's -- it's -- it's devastating really in the sense look how those people have suffered. look at the loss that they've suffered. the territorial loss that armenia and the ethnic armenians in nagorno-karabakh have suffered. russia, as you mentioned, was meant to be the guarantor of security in this region. it was meant to guarantee that azerbaijan would not take over militarily nagorno-karabakh, but that's because russia is distracted in ukraine, it took the eye off the ball and exactly that has happened. it's left russia's reputation really in the dirt at this point in armenia. >> just putting it bluntly. matthew chance, in armenia tonight. the prime minister in armenia speaking out against putin's war, figproviding humanitarian assistance in ukraine. a man struck and killed while crossing the street. the driver is now married. the woman now married to senator bob menendez. police had ruled she did nothing wrong, but is that about to change? plus cnn obtaining new documents tonight revealing what led las vegas police to arrest in the murder of tupac 27 years later. tonight the new jersey attorney general is investigating the fatal 2013 car crash in which the wife of bob menendez struck and killed a pedestrian. this is according to "the new york times." this is coming back under scrutiny after the senator and his wife were charged with bribery offenses. this was to replace the car that was damaged in this crash. jason carole is "out front." >> i didn't do anything wrong. >> reporter: this police dash camera captured nadine arslanian after she hit and killed a 49-year-old man on a new jersey road in 2018. >> we can clear you from any wrongdoing, i want be to get you home and comfortable and not here anymore. >> reporter: the new jersey police department determined the man she killed was jay walking and she was not at fault. >> he jumped on my windshield. >> reporter: according to "the new york times," she was not tested for drugs or alcohol. >> look, i understand. i understand. >> reporter: the crash happened before she was married to senator bob menendez, who along with nadine, is now accused of accepting gold bars, hundreds of thousands of dollars in cash and a new mercedes as bribes to benefit the government of egypt. now new jersey's attorney general's office has opened an inquiry to determine if the wreck and investigation was handled properly according to the "times." her attorney says, quote, this is a case of a tragic accident where nadine menendez was not at fault. it has nothing to do with the current allegations in the indictment. prosecutors say there was a connection. the federal indictment says two co-defendants helped buy her that new mercedes after the crash in exchange for interference in a criminal case. all those dieted pleaded not guilty or denied the charges. the latest development involving the crash not sitting well with some new jersey voters already weary of allegations surrounding the senator and his wife. >> now it looks shifty, definitely. looks like there was some protection going on possibly on the part of the police. >> how could he be possibly helping us when he's helping his self. >> reporter: here in hoboken and hudson county which menendez carried by 76% in 2018, voters like maria kelly who once supported him have had enough. >> he should step down. >> he should step down? >> right. he's got too much going on. >> trump gets his day in court. why can't he. >> reporter: it sounds to me like he's got your vote for now until you know more? >> i didn't say that. i don't know if he has my vote. >> reporter: menendez refuses to say if he'll run again when he's up for re-election in 2024. >> when i make that decision i will announce be it. >> reporter: the embattled senator not stepping down but he says he was targeted because of his latino heritage. this woman says she believes him. she's originally from cuba and has called new jersey home for decades. do you think he's being treated unfairly? >> yes, i do. the yes, i do. the when they want you out they want you out no matter what. they always try to find something. >> reporter: so while it's clear menendez does have his supporters, what's also clear is when we were out here in hoboken, erin, speaking to people going up to them saying i'm doing a story on senator menendez, i can't tell you how many times initially we got the eye roll from voters, what did he do now? >> i ain't worried about it. i ain't did [ bleep ]. >> well, i mean, that's what court's for, right? >> yeah. >> reporter: davis indeed appeared in court this week and was ordered to remain in custody. but many, including member of shakur's family are questioning why it took so long to make an arrest. >> this guy has been telling the whole, the same story the whole time, for 27 years. >> reporter: during numerous interviews, davis admitted to being a passenger in the car where shots rang out that killed shakur. a detective said police were well aware of davis' media interviews about the murder, testifying, there's hour's worth. testifying also why he believes davis would risk publicly talking about a murder not yet solved. he decided to write his own book and start talking on youtube videos in an effort to gain money for the killing of tupac. detective, that's what i believe. another key component of their case, new witnesses. >> we didn't want to proceed just with his admissions. certain witnesses came forward in the last couple of years. >> reporter: now, i spoke with the personal attorney for davis here in los angeles, who told me they are working to obtain a criminal defense attorney in nevada. erin, it is so remarkable watching this police body camera footage, especially considering this was the moment this decades-long investigation seemingly came to an end, this investigation that has generated countless speculation, numerous theories, numerous conspiracy theories. what started in this violent incident, a hail of bullets on the las vegas strip, ending last week with police arresting the only living suspect, as he was out taking a walk. erin? >> so, a cover crop is a crop that's planted in between harvests. and just like the name suggests, it's meant to cover the soil and keep the soil covered. and the great thing about it is it, in the process of covering the soil, it adds nutrients back into the land, making soil even healthier, helps retain moisture. so, imperative when farmers are experiencing unprecedented droughts and floods. and it helps capture carbon from the atmosphere and keep it back in the ground. >> nick, you get in the dirt. i will say, it's in your blood, in a certain way. you were raised in a farm in illinois. you and your wife, megan lawly, obviously moved for "will and grace." you spent a lot of time in an rv. it is part of who you are. how much of this is, sort of, in your soul, for lack of a better word? >> well, i mean, i come from farming families in illinois, and my dad is still the most prolific gardner in our little town. and, i mean, i support farming practices and regenerative farming both here and in england. it's just something that, after reading books by writers like michael pollen and barry who are agrarian thinkers and thinking about the health of who produces or food? we don't think about our farmers anymore. and we're trying to reverse that. we should take care of our farmers so they take care of our food, which takes care of us. >> you also have had a wonderful and long marriage, your wife megan. i want to play a clip of the two of you together on "parks and recreation." a lot of people on our staff remember this. >> you aged horribly. >> you son of a [ bleep ]. oh, my god. what is your problem? "erin burnett outfront" starts right now. out front next, trump returns the favor backing jim jordan in the race to be the next speaker of the house. someone who's leading the way on trying to impeach biden and one of the biggest backers of trump's rigged election claims. plus, breaking news. an appeals judge denying trump's appeal to halt the fraud case. michael cohen will be "out front" tonight. putin's latest strike killing a young boy. tonight there is a threat of more to come. let's go "out front." good evening, i'm erin burnett. "out front" tonight, trump playing king maker backing congressman jim jordan and his bid to become the next house speaker. jim jordan has a long history of doing trump's work for him. in fact, jordan is now one of the heads of the biden impeachment inquiry, something that trump, of course, made clear absolutely had to happen. >> they should investigate the bidens. >> i call them corrupt joe. crooked joe biden. i believe we have a compromised president. >> jim jordan heard trump loud and clear and repeatedly and he's taken action. >> there are some members of your committees that are talking about impeachment. is that on the table? >> it sure is. he actually did what they impeached president trump for. >> well, the impeachment inquiry that jordan is helping lead is just the latest example though of trump -- of jordan going full maga for trump. >> it was a rigged election. it was a -- and it was really a sham. >> i don't know how you can ever convince me that president trump didn't actually win this thing. >> they cheat and they cheat like crazy. >> what are the democrats trying to hide? let's get to the bottom of this. >> this election is a fraud. >> there was fraud. >> the democrats are trying to steal the white house. you cannot let them. >> americans instinctively know there was something wrong with this election. >> that last comment from jordan was january 6th, 2021, as thousands of trump supporters began clashing with police outside the capitol. look, there's been no daylight between jim jordan and donald trump for a long time. jordan attended white house and campaign meetings on overthrowing the election. jordan defied a subpoena by the january 6th committee to testify. jordan has put his career and his reputation on the line for trump and now trump is endorsing him. it may well give jordan the gavel, but he does have at least one declared rival for the speakership, steve scalise. that rivalry evolved into one other example of republican chaos. this morning they agreed to do a debate on fox news. everyone finds out about it and the republican uproar to such a breach of protocol, to such a publicity stunt was loud and clear. one republican calling it a circus. another saying it's, quote, insanity. another saying, quote, people are pissed. a few hours later after it was announced, suddenly the debate was off, it was canceled. that's just another layer in the chaos that's been engulfing the house. melanie zanona is out front on capitol hihill. he played king maker with mccarthy. now here he is, he's picking jordan. will this endorsement will have an impact? >> i think it cuts both ways. this will help jim jordan with the right and with conservatives. we did already see a number of them come out and say they are now backing jumpim jordan becau of trump. i talked to troy nels. he said i am not going to go against the former president's wishes. on the other hand, this endorsement is not going to do anything to win over the more moderates in the party. they have a lot of concerns about a jim jordan speaker candidacy because he's a flame thrower, because he's the face of the impeachment. he's arguing he's best positioned to unify the party. >> i know you've been talking to your sources, melanie, about the chaos. the debate gets planned, canceled. what are you learning? >> reporter: there's a lot of whiplash today inside the house republican party. this all started because i'm told fox news reached out to the speaker candidates doing this televised event in the capitol on monday, after it was announced, almost instantly i was getting messages, my phone was blowing up from moderate republicans who were worried about the optics. ca carlos gimenez said this is a horrible idea. i think all of the backlash speaks to the idea there is so much uncertainty and raw emotion in the house caucus. they want to get this right. they don't want to see more embarrassment or dysfunction on the floor like we saw when kevin mccarthy was removed or in january where it took 15 rounds for kevin mccarthy to get that speaker's gavel. at this point it's unclear whether scalise or jordan can unify the party and go to a floor vote. they'll have a candidate forum on tuesday and they'll huddle behind closed doors to elect their nominee. >> thank you. they'll behind closed doors do that this time. eight took down mccarthy. the vast majority, 210, wanted them to remain. one is anthony desposito. he's with me tonight. and the other is ted lu. i want to begin with you, congressman desposito. you were against that effort to oust speaker kevin mccarthy. >> yes. >> i know that today you had a chance to speak to jim jordan and also with kevin hern who is considering a bid for speaker as well. you've spoken to steve scalise who is declared as the candidate for speaker. have you made your decision? >> i have not. i am constantly in contact with members of the new york delegation. we will vote for this in one unified bunch. we know what's important to the new york voters. we know what's important to long island and we want to make sure that the next speaker of the house understands the unique situation that we have here. >> so when trump comes out with this endorsement of congressman jordan, calls him a, quote, star, does that influence your decision one way or the other? >> it doesn't. my decision is going to be based on the feelings of there is a lot of unifying we have to do in taking part in over the next days and weeks. the party and the members are angry. they are upset. we need to do our best to unify the party and get to work because that's what the american people sent us here to do. >> you sent a letter condemning the chaos caucus. in that letter there's a line, congressman. the injustice we all witnessed cannot go unaddressed. you obviously are taking this with great gravity and seriousness. matt gaetz who led that mocked your letter. tonight he wrote, quote, thoughts and prayers. what's your response to that, to just being, you know, a mocking response to something that you took so seriously? >> yeah. i think that matt gaetz has made a joke of this since day one. this has never been serious for him. this is about a personal vendetta that he had against -- one of this nation's oldest institutions to take out a personal vendetta, and quite frankly he's an egotistical maniac and he's using his extremism to halt government. instead of doing what we should be doing and that is governing and getting appropriations bills on the door, he's concerned about getting retweets and raising money. >> i want to ask you one other question tonight about former president trump. he's coming under fire for making anti-immigrant comments in an interview. this echos language used by a white supremacist. i want to play for you what he said. >> nobody has ever seen anything like what we're witnessing right now. it is a very sad thing for our country. it's poisoning the blood of our country. it's so bad. and people are coming in with disease. people are come being in with every possible thing that you can have. >> just to be clear, congressman, the specific reference to poisoning the blood. blood poisoning was a phrase that was used repeatedly by hitler, very specifically blood poisoning. so what's this -- what's your reaction when you hear this sort of language, what he said all together from the former president? >> well, perhaps not the best choice of words, but ishl that what we're seeing at the southern border is unprecedented. i think we've now seen across the country democrats and republicans. look at new york, for example, i mean, the mayor has flat out said that what's happening at the southern border is going to destroy new york city. >> yes. the. >> the governor has said that it's clear that people from both sides of the aisle agree we have a real problem at the southern border. that's what we should be focused on now, not matt gaetz and the situation he's put us in. >> congressman, i appreciate your time. thank you very much. >> thank you. and i want to bring in now as promised the democratic congressman ted lu of california. congressman, first your reaction to congressman desposito regarding the race. it was very clear that the letter he wrote with 44 other republicans, that he had done so with great seriousness saying how unacceptable the situation was and saying matt gaetz's behavior is that of an e egotistical maniac. >> let me suggest a contrast. when democrats were in control, we reduced the cost of medicines. this year when republicans control they took us to the brink of a default on our debts, they took us to the brink of a government shutdown. this is just the latest example in a string of events showing that the republicans can't govern and they have division, dysfunction and disarray. we support hakeem jefferies for speaker and we ask people to come join us. >> well, i understand that, but of course they have the majority, right? they're going to pick. well, theoretically they're going to pick. on this front you know jim jordan because you're on the house judiciary. you know him. you see him every day. he told manu raju today that he should be speaker because he's someone who can, quote, unite republicans? but in the context, congressman, of what you see, how he conducts himself, how he treats people, how he leads on your committee, what do you think of his leadership? >> let me just say again that jim jordan ignored a bipartisan congressional subpoena. his unprecedented actions have damaged the rule of law and made it harder for all congressional committees to get information from witnesses. that's the first thing american people should know about jim jordan. he violated and totally ignored a bipartisan congressional subpoena. having said that, i'm happy to work with any republican speaker as long as -- that they keep their word and they want to help the american people. >> so that speaker, who knows who that will be, but mccarthy had worked with you on a couple of things. the government had remained open, right? that last minute there were some things that happened -- >> he did not work with us. he did not work with us. he gave us a resolution bill with no notice, called a vote immediately and we asked within 90 minutes to read that bill and he rejected that. he did not work with us. he was surprised that we voted for that bill. >> all right. so i understand what you're saying, but nonetheless, the bill passed. you guys -- you all somehow kept the government open. i put it in this context, congressman, you sometimes have to choose from what you're given. the conservative group heritage action tracks voting members. this is conservative positions. jim jordan's lifetime score is 95%. mccarthy's is 53%. right? democrats chose not to save mccarthy but wouldn't speaker jordan be better for the house, for what you believe in than what speaker mccarthy was? >> i think speaker mccarthy could have made it in a way that democrats could have supported him. this entire year he said he wouldn't work with democrats but he couldn't govern. he brought the nation to crisis after crisis. then he sided with the extreme mag a wing of his party. on top of that, his word could not be trusted. i would rather deal with someone who has principles. i can work with those principles and find ways to help american people. >> like jim jordan? >> it's hard to work with someone who you can't trust. >> all right. congressman lu, thank you very much. i appreciate your time tonight. i appreciate you with us. breaking news, a judge rejecting trump's appeal. plus, 120,000 people pouring into armenia, and we're live there tonight because this growing disaster all comes back to vladimir putin. and new video of the deadly car crash involving the now wife of senator bob menendez. >> didn't do anything wrong. >> why is that crash under investigation again? and does it have something to do with the bribery charges she and menendez are facing? breaking news. an appeals court judge rejecting trump's bid to pause the fraud trial. the judge did agree to temporarily halt breaking up trump's businesses. this as a deputy testified to fraud today. he's a former employee and co-defender. he testified he inflated the value of trump properties significantly and he did so at the direction of eric trump, trump's son. according to him he was told to include the value of seven homes when valuing a development called seven springs even though the homes were not built. he testified he continued to value trump's briar cliff golf club at $104 million. the appraise al was less than half of that value. why did he do it? he says eric trump told him to, quote, leave value as is. former lawyer for donald trump, michael cohen. he is the author of "revenge, how donald trump weaponized the u.s. department of justice." michael, i really appreciate your time. you know more about what they're talking about in this courtroom than anyone. this major development in trump's lawsuit against you happened today. i want to ask you about this. what he said about eric trump, how much trouble is eric trump in right now, do you think? >> it sounds like it could be a lot. you know, the fraud doesn't start and stop with donald trump. it also now of course goes to the children. it was allen weisselberg. it was also jeff mcconnie. i do think the statements that were made by jeff mcconny certainly injurious not just to the trump organization but to eric trump as well. >> you know mcconny and all of these individuals involved. you worked with all of them. >> yes. >> mcconny testified he and allen weisselberg agreed to calculate the value of apartments at trump park avenue without saying that the units were rent stabilized, which of course significantly lowers the value. they calculated mar-a-lago's valuation as if it could be sold as a private residence, meanwhile he didn't know that trump had deeded away the right to do that, right, so that it had to stay a social club. it could not have that private residence value. when you look at all of this, michael, given what you know of every one of these individuals and how things were done because you were in the rooms, is it possible trump was in the dark for all of this? >> no, and i think that mcconny also made a statement to the extent that donald trump had the ultimate signoff on the documents. i also believe that donald bender from mazers stated the same exact thing. look, i also testified before the house oversight committee and said the exact same thing as well, that everything that happened at the trump organization happened at the direction and with the explicit knowledge of donald j. trump. >> and you were, and that's by the way a big part of the reason why this case is happening right now, is because of what you said in that room specifically referring to valuations and trump getting loans from deutsche bank. wil leticia james put out a statement late last night, michael. >> the defendants like to act as though this case is very complicated when, in fact, the fraud they committed is simple. donald trump often calls his business perfect and beautiful, but it's clear that when it comes to running a company, he doesn't care about the real numbers or the facts. >> as i said, michael, you're likely to be a witness here. you're on the list. they all want to hear from you. are you confident that from what you know and saw that you can link donald trump directly to this very clearly established pattern that the judge has accepted, pattern of fraud with your testimony? >> the answer is yes. i don't want to at this point and time go into how i will have that established or the extent to which the attorney general's office will be questioning me, but i can assure you that as i had stated once again before the house oversight committee, everything that happened at the trump organization happened with the direct knowledge and at the direction of and ultimately signed off by donald j. trump. there's no way for him to escape this. >> so you have more examples? you've got the receipts? >> yes. and, actually, the receipts are in the hands of the attorney general. >> all right. and we -- literally, right? we also learned late last night, i wanted to mention this lawsuit against you. donald trump had this lawsuit against you, michael, $500 million he was suing you for. he dropped it. he dropped it four days before he was scheduled to be deposed in the case. now he had claimed you breached your obligations as his confidante and lawyer and by publishing your books and media appearances like this one, but, again, four days before his deposition he drops his $500 million lawsuit against you. why do you think he did that? >> well, he's certainly demonstrated that he didn't want to be deposed by danya perry, my attorney, or her team. he certainly was concerned that some of the information he may have to testify to, because it was an expansive testimony, that it could ultimately implicate him in crimes and that he earlier needed chris keyes to prevent him from implicating himself from being able to assert the fifth amendment. this is the craziest scenario. everybody acknowledges that it was retaliatory for my participation with the manhattan district attorney case, it was done to harass me, it was done to financially harm me and ultimately what we did is we decided that we were going to accept the complaint and we were going to press him for his deposition. as we expected, he certainly didn't want to do that because the second donald trump opens his mouth, he implicates himself in something. he's not a good witness by any stretch of the imagination and he had no interest whatsoever in being deposed by myself or by my counsel. >> that lawsuit, of course, dropped. michael, thank you very much. i appreciate it. >> it was good to see you. >> all right. you, too. next, russia unleashing a second day of strikes targeting civilians, this time killing a 10-year-old boy. there are threats tonight of more to come. plus, new video of the time police arrested a man for the killing of tupac. >> what have they got you for, man? >> reporter: well, we can really see the utter devastation now. want to get out of your way, erin. you can see what was left of the building hit by the missile in the night into thursday. you can see it's basically raised to the ground, there's only the foundations left. one of the interesting things, erin, is this missile was the same missile used on the house in kharkiv. it's a very powerful one with a very powerful warhead and you can see what it does to residential buildings when it hits them. the same happened in kharkiv. what we did today, erin, we managed to fly a drone over the area here. when you see this kind of footage from above, it really giving you a better view of just how devastating this strike was and that basically people who are inside this building, we saw that firsthand when we got here yesterday, had absolutely no chance of survival. now, of course, as you can imagine, all of this is causing huge agony here in this very small village. in fact, about 1/3 of the population of this village has been wiped out. we've spoken to some people who witnessed this attack, who heard this attack and all of them have lost loved ones. here's what folks said to us. >> translator: my neighbors, two women and a man, a lot of our people were killed here. >> translator: maybe the russians thought there was a military man being buried and that other soldiers would gather. i don't know what they thought. maybe they hit him on purpose to make people angry, but it's much more than that. what kind of people should be like that? god bless. it's not christian. it's a sin. >> reporter: so as you can see there, erin, a lot of sadness. a lot of anger towards the russians as well for this strike. of course, we are in saturday here in eastern ukraine, so in a couple of hours the first burials are going to start for the many victims here of this attack. a lot of people here obviously are going to be putting their loved ones -- laying them to rest in just a couple of hours from now. the agony and the anger on the part of the government of kyiv. >> literally people pulverized. 1/3 of an entire village. fred, thank you very much. as putin tries to bring people under control, zaporizhzhia is calling for the invasion and occupation of more territories, latvia, laith thr lithuania, poland, estonia. >> translator: i believe we can return all of this by the force of the russian weapons. bring back our people, our subjects. previously belonged to the russian empire. >> our subjects to the russian empire. it don't get more clear than that. putin using so-called peace keepers has done little to stop a violent military offensive by his ally, azerbaijan, in a region called nagorno-karabakh. that has left 120,000 ethnic armenians to have to flee. putin himself had guaranteed his troops would protect ethnic armenians but now they're not. it comes after armenia's prime minister began criticizing putin's war, even sending humanitarian aid to ukraine. now there is a crisis. matthew chance is "out front" on the ground in armenia tonight. i do warn you that the images he is going to show you may be disturbing. >> reporter: this is where the most desperate from nagorno-karabakh are surviving. abandoning their livelihoods and homes for the safety of these refugee beds. entire families have come, like the vanians who say their remote village was bombarded relentlessly by azari guns forcing them to flee. it was so painful to leave, especially for my children, anaida tells me. we were farmers. we had everything, but it was a massive war and we had no choice, she says. >> these people are the most vulnerable. they would be on the street or in their car if they weren't here. >> reporter: this co-founder from boston has witnessed the physical and emotional impact of the evacuation firsthand. >> reporter: try and give us a sense of the trauma that people have endured. >> it's -- it's mass exodus. these people, some of the people that are here, they -- third day, fourth day, they're still in shock. they don't know where they are. there are families here still saying i'm waiting for the bus to take me back home. >> reporter: the road from nagorno-karabakh is very long. it's very winding as well, it's also very empty, as are the settlements across the border in azerbaijan that we've managed to have a glimpse of because all 120,000 people who once lived there have now evacuated those settlements and they've come to armenia where they're living in hotels, in refugee centers or with family. in border towns like goras where local authorities are distributing basic supplies to eva evacuees, some who spent a lifetime fighting for a homeland that's now lost. azerbaijani government says if you live in nagorno-karabakh or one of those villages, they will protect your rights. do you believe them? >> they will never protect us, they're lying, suzanne na insists. i'll never forgive them for what they did to us, she adds. there are some with far more than emotional scars. we visited one hospital filled with victims of a make-shift gas station blast in nagorno-karabakh where people had been frantically gathering fuel. >> you can hear screaming. as the doctor described the carnage, you could hear the screams of agony from the wounds. >> reporter: can we go and see that now? can we go and see that now? in almost every room here there's a horrific story of pain and loss. 25-year-old victor asked us to hide the burns on his face. it was like hell he told me and now i don't want anyone to see. his friend mikhail says he lost five members of his family in the chaotic evacuation from nagorno-karabakh. but no one seems to care, he told me. when it comes to us, i think the world must be blind. >> matthew, it's just so disturbing and horrific and of course this is -- putin was the one who was going to stop this and is now actively enabling, if not encouraging. what is this doing for the reputation of putin and russia right now? >> reporter: i mean, it's -- it's -- it's devastating really in the sense look how those people have suffered. look at the loss that they've suffered. the territorial loss that armenia and the ethnic armenians in nagorno-karabakh have suffered. russia, as you mentioned, was meant to be the guarantor of security in this region. it was meant to guarantee that azerbaijan would not take over militarily nagorno-karabakh, but that's because russia is distracted in ukraine, it took the eye off the ball and exactly that has happened. it's left russia's reputation really in the dirt at this point in armenia. >> just putting it bluntly. matthew chance, in armenia tonight. the prime minister in armenia speaking out against putin's war, figproviding humanitarian assistance in ukraine. a man struck and killed while crossing the street. the driver is now married. the woman now married to senator bob menendez. police had ruled she did nothing wrong, but is that about to change? plus cnn obtaining new documents tonight revealing what led las vegas police to arrest in the murder of tupac 27 years later. tonight the new jersey attorney general is investigating the fatal 2013 car crash in which the wife of bob menendez struck and killed a pedestrian. this is according to "the new york times." this is coming back under scrutiny after the senator and his wife were charged with bribery offenses. this was to replace the car that was damaged in this crash. jason carole is "out front." >> i didn't do anything wrong. >> reporter: this police dash camera captured nadine arslanian after she hit and killed a 49-year-old man on a new jersey road in 2018. >> we can clear you from any wrongdoing, i want be to get you home and comfortable and not here anymore. >> reporter: the new jersey police department determined the man she killed was jay walking and she was not at fault. >> he jumped on my windshield. >> reporter: according to "the new york times," she was not tested for drugs or alcohol. >> look, i understand. i understand. >> reporter: the crash happened before she was married to senator bob menendez, who along with nadine, is now accused of accepting gold bars, hundreds of thousands of dollars in cash and a new mercedes as bribes to benefit the government of egypt. now new jersey's attorney general's office has opened an inquiry to determine if the wreck and investigation was handled properly according to the "times." her attorney says, quote, this is a case of a tragic accident where nadine menendez was not at fault. it has nothing to do with the current allegations in the indictment. prosecutors say there was a connection. the federal indictment says two co-defendants helped buy her that new mercedes after the crash in exchange for interference in a criminal case. all those dieted pleaded not guilty or denied the charges. the latest development involving the crash not sitting well with some new jersey voters already weary of allegations surrounding the senator and his wife. >> now it looks shifty, definitely. looks like there was some protection going on possibly on the part of the police. >> how could he be possibly helping us when he's helping his self. >> reporter: here in hoboken and hudson county which menendez carried by 76% in 2018, voters like maria kelly who once supported him have had enough. >> he should step down. >> he should step down? >> right. he's got too much going on. >> trump gets his day in court. why can't he. >> reporter: it sounds to me like he's got your vote for now until you know more? >> i didn't say that. i don't know if he has my vote. >> reporter: menendez refuses to say if he'll run again when he's up for re-election in 2024. >> when i make that decision i will announce be it. >> reporter: the embattled senator not stepping down but he says he was targeted because of his latino heritage. this woman says she believes him. she's originally from cuba and has called new jersey home for decades. do you think he's being treated unfairly? >> yes, i do. the yes, i do. the when they want you out they want you out no matter what. they always try to find something. >> reporter: so while it's clear menendez does have his supporters, what's also clear is when we were out here in hoboken, erin, speaking to people going up to them saying i'm doing a story on senator menendez, i can't tell you how many times initially we got the eye roll from voters, what did he do now? "out front" next, arrested 27 years after the murder of tupac. what he told police after they put him in handcuffs and then getting dirty. >> hey. down here. >> it's me. >> that's nick afferman of "parks and rec" fame. he joins me next. . tonight, i ain't worried. that's a direct quote. that's what the man charged with the murder of tupac shakur during his arrest more than 25 years after the rap star was gunned down on the las vegas strip. the new body cam video obtain bid cnn showing the moment that dwayne davis was taken into custody. josh campbell is "out front." >> hey, keefe, metro police. >> reporter: new body cam video showing the arrest of the man charged with the murder of tupac shakur. swarmed dwayne keith davis, aka keefe d, while on first stroll in the las vegas heat last friday. >> i need a drink of water. i'm thirsty. >> reporter: almost 27 years after he allegedly orchestrated the plan that gunned down tupac shakur near the las vegas strip. for almost three decades the pop culture mystery has garnered media coverage and inspired numerous documentaries. shortly after he was handcuffed, davis was put in a police car and began chatting with an officer, who appeared surprised by the man now sitting in the backseat. >> what they got you for, man? >> biggest case in las vegas history. >> oh, yeah? >> yeah. >> like, recent? >> oh, no [ bleep ]. wow. >> reporter: september 7, 1996, the night tupac shakur was gunned down. davis denying any wrong doing. >> not a detective quite yet, but sure took them a while, huh? >> i ain't worried about it. i ain't did [ bleep ]. >> well, i mean, that's what court's for, right? >> yeah. >> reporter: davis indeed appeared in court this week and was ordered to remain in custody. but many, including member of shakur's family are questioning why it took so long to make an arrest. >> this guy has been telling the whole, the same story the whole time, for 27 years. >> reporter: during numerous interviews, davis admitted to being a passenger in the car where shots rang out that killed shakur. a detective said police were well aware of davis' media interviews about the murder, testifying, there's hour's worth. testifying also why he believes davis would risk publicly talking about a murder not yet solved. he decided to write his own book and start talking on youtube videos in an effort to gain money for the killing of tupac. detective, that's what i believe. another key component of their case, new witnesses. >> we didn't want to proceed just with his admissions. certain witnesses came forward in the last couple of years. >> reporter: now, i spoke with the personal attorney for davis here in los angeles, who told me they are working to obtain a criminal defense attorney in nevada. erin, it is so remarkable watching this police body camera footage, especially considering this was the moment this decades-long investigation seemingly came to an end, this investigation that has generated countless speculation, numerous theories, numerous conspiracy theories. what started in this violent incident, a hail of bullets on the las vegas strip, ending last week with police arresting the only living suspect, as he was out taking a walk. erin? >> so, a cover crop is a crop that's planted in between harvests. and just like the name suggests, it's meant to cover the soil and keep the soil covered. and the great thing about it is it, in the process of covering the soil, it adds nutrients back into the land, making soil even healthier, helps retain moisture. so, imperative when farmers are experiencing unprecedented droughts and floods. and it helps capture carbon from the atmosphere and keep it back in the ground. >> nick, you get in the dirt. i will say, it's in your blood, in a certain way. you were raised in a farm in illinois. you and your wife, megan lawly, obviously moved for "will and grace." you spent a lot of time in an rv. it is part of who you are. how much of this is, sort of, in your soul, for lack of a better word? >> well, i mean, i come from farming families in illinois, and my dad is still the most prolific gardner in our little town. and, i mean, i support farming practices and regenerative farming both here and in england. it's just something that, after reading books by writers like michael pollen and barry who are agrarian thinkers and thinking about the health of who produces or food? we don't think about our farmers anymore. and we're trying to reverse that. we should take care of our farmers so they take care of our food, which takes care of us. >> you also have had a wonderful and long marriage, your wife megan. i want to play a clip of the two of you together on "parks and recreation." a lot of people on our staff remember this. >> you aged horribly. >> you son of a [ bleep ]. oh, my god. what is your problem?
