Joining us tonight. Cnn prime time with abby philip. Starts right now. These days it seems like the epicenter of american secrets isnt the cia, the pentagon or even the white house. Its maralago, where donald trump apparently likes to keep and tell those secrets. Good evening, i am abby philip, and tonight, abc and the New York Times both reporting that, after lady leaving the white house, trump told a club member at maralago Sensitive Information about u. S. Nuclear submarines. That number is not only a for national, but hes also an australian billionaire who allegedly spread that information to more than a dozen foreign officials. Among the allegations that trump shared the number of nuclear warheads, those submarines carried. And how close they can get to russian submarines without being detected. Now, trump is, of course, already under investigation for his handling of government secrets, and for keeping classified documents at maralago. And they certainly fits into that pattern. But in the early stages of his presidency, trump reportedly did other things, including using an unsecured phone, in 2017 at maralago. The terrorists became a situation room, as you can see there. For trump and the japanese javanese i lie about ices. He also told the philippine president about two Nuclear Submarines off the korean peninsula, and a couple of years later he tweeted a classified picture of an iranian launchpad. And his former aide suggests it was common for trump to ever share this kind of information. The short answer is yes. I watched him show documents the people at maralago on the dining room patio. So, he has no respect for classified information and never did. And its not just witness testimony. Here is trump himself in his own words. All sorts of stuff, pages long. Wait a minute. Lets see here. [laughter] i just found isnt it amazing . This totally my case, you know . Except it is highly confidential, secret. I was just saying, because we were talking about it. And he said, he wanted to attack iran and the military, given to me. And i think we can probably its a declassify. Since president , i cant declassify. I cant. But this is isnt that interesting . Its cool. Where would i even when you probably almost didnt believe me, but now you believe. Me no, i believe you. Its incredible, right . That, of course, from trump at one of his other properties up administer, new jersey, and the stedman reporting, but they did slam leaks and said trump did nothing wrong. I want to now bring in Cnn National Security analyst james clapper, hes also former director of national intelligence. Director clapper, what was your first reaction to hearing these reactions . Shock, Stunning Development but unfortunately not surprising. Im having trouble coming up with new adjectives to describe how serious and how dangerous that this is. And you just presented a very succinct litany of things that the former president has done, and reflects his complete disregard for protection of National Security, Sensitive Information. And for that matter, the very National Security of the country. In this latest episode, one aspect of this that i think is worth mentioning ease when this kind of thing happens, and the essential bit of information is spread out as ubiquitously and pervasively as it was and an adversary gets a hold of it to russia or china they can use that to confirm or refute their own intelligence holdings. So, there is no end to the potential consequences here, where the endangerment to sources and methods. The endangerment of the crews that man these multibillion dollar submarines. So, from all perspectives, this is really egregious. Assuming, of course, the reportings accurate. Thats right. At the moment cnn has not confirmed all the details here. But according to abc, the australian businessman, mr. Pratte, he went on to share this information with a lot of people, just within a few minutes. Dozens of people would have heard some version of what trump told him. When you think about the number of people who could be involved here, what do you think are the consequences of that . Potentially, quite serious, because how many people did those people tell so, there is no knowing, at least, at this point, how many people this information was conveyed to, whether accurate or not. And, again, if it falls into the wrong hands, which it potentially could do, since both the chinese and the russians, certainly look now to the former president , a valuable source of intelligence for them. So, they would go to any lengths to gain information, particularly about the holiest of police for us, which is, our nuclear deterrent. That is the very essence of protecting this country, and the recklessness that has apparently been displayed here, i think, is really reprehensible. So its potentially quite serious. So, i should point out, joe hockey, who is a former australian ambassador to the u. S. , he says that australians of mariners have been on u. S. Subs for years and he is downplaying the significance of at least some of the information being shared with australia nationals. Does he have a point . Not really. And i have Great Respect for the former ambassador hockey. But the fact is that this had been exposed to people who have absolutely no obligation to protect it. There is no inhibition, legally for them legally not to share, not to tell what they heard, what they learned, with many others. So, i suppose it is reassuring that it was not a chinese billionaire. But that is faint reassurance. All right, director clapper. Its always good to have. You think through for joining us tonight. Thanks, abby. Tonight, in a brandnew interview, some former Secretary Of State Hillary Clintons telling Cnns Christiane Amanpour that donald trump will likely be the republican nominee, and shes also issuing a stark warning about a potential 2024 rematch with President Biden. Listen. So, for those outside this country who may not know, it is not so much a fight between two different parties. Its an internecine warfare within one party, the gop. Yeah. So, when you look at how to go forward for the country, as you say, is there any area of Coalition Building that could happen . There are pragmatic republicans, as you say. Could there be a whole new way of trying to get legislation going and cross Party Governance going by democrats and certain republicans forming coalition . You saw the number of republicans who voted along with democrats to keep the government open. So, theres clearly a common sense sane part of the Republican Caucus in the house. But i think they are intimidated. They oftentimes say and do things which they know better than to say or do. And it will require us defeating those most extreme measures, and the people who promote them in order to try to get to some Common Ground where people can, again, work together. Thats the way it used to be. We had very strong partisans in both parties in the past and we had a very bitter battles over all kinds of things. Gun control and Climate Change in the economy and taxes. But there wasnt this little tale of extremism waving, wagging the dog of the Republican Party as it is today. And sadly, so many of those extremists, those mogollon rim us, take their Marching Orders from donald trump, who has no credibility left by any measure. He is only in it for himself and hes now defending himself in civil actions, and criminal actions. And when do they break with him . Because at some point, maybe there needs to be a formal deprogramming of the cult members. But something needs to happen. How do you do that . Because you say we have to do that by defeating their leader. Their leader is donald trump. Even you have said you expect him to be the republican nominee. How does this change at all . At this point i think, sadly, he was still rightfully be the nominee and we have to defeat him. We have to defeat those who are the Election Deniers as we did in 2020 and 2022. And we have to just be smarter about how we are trying to empower the right people inside the Republican Party. Nancy pelosi had a majority of five votes when she was speaker. Kevin mccarthy had a majority of five votes. Nancy pelosi passed consequential legislation. And she clearly had members of her caucus who ranged across a spectrum of political beliefs and ideology. And she kept everybody together. And she kept everybody focused on the future. He could not do that. And so he pay the price. But, more importantly, the country pay the price. And so, when you see another matchup between, potentially, trump and President Biden, what goes through your mind . And particularly, how do you process that this person who defeated you back in 2016 is still at it, given all that you have . That 91 indictments. Civil fraud. Sexual transgressions, according to the courts. How is this still happening . Its a classic tale of an authoritarian populist who really has a grip on the emotion will, psychological needs and desires of a portion of the population. And the base of the Republican Party, for whatever combination of reasons and it is emotional and psychological seeds in him someone who speaks for them. And they are determined that they will continue to vote for him, attend rallies, we are his merchandise. Because, for whatever reason, he and his very negative, nasty form of politics resonates with them. Maybe you dont like migrants. Maybe they dont like people or black people, or the woman who got the promotion at work they didnt get. Whatever the reason. Make America Great again was a bid for nostalgia to return to a place where people could be in charge of their lives, feel empowered, say what they want and insult whoever came in their way. And that was really attractive to a significant portion of the republican base. So, it is like a cult. And somebody has to break the break that momentum. And that is why i believe joe biden will defeat him, and hopefully then that will be the end, and the fever will break, and republicans can try to get back to fighting about issues among themselves and electing people who are at least responsible and accountable. Breaking news tonight, donald trump is no longer coming to capitol hill next week for the speakers election, and he is no longer floating himself as an option for speaker of the house. Instead, sources tell cnn he is able to endorse congressman jim jordan. Jordan has been making that runs rounds and calling around to colleagues, and speaking of jordan, listen to what liz cheney, the former congresswoman, said about the prospect of a speaker jim jordan. Jim jordan knew more about what donald trump had planned for january 6th than any other member of the house of representatives. Now, somebody needs to ask jim jordan, why didnt you report to the Capitol Police what you knew donald trump had planned. If they were to decide that, there would no longer the any possible way to argue that a group of elected republicans could be counted on to defend the constitution. Ed rollins is a republican political consultant and former chief political adviser to president reagan. Also with us, anna navarro, shes a cnn political commentator. Ed, let me ask you about this news that we have tonight that trump, after saying he would go to the capitol and maybe put his name in contention to be speaker isnt doing that and hes going to endorse jim jordan instead. What impact do you think that would have . Its beneficial, but hes not going to. It and its going to be enough of a circus at the end of the day and pick a leader that can lead and i think at a certain form president would be a distraction. The thing i worry about it is i like jim jordan, i like and i know most of these members and im not sure that they have for thought this thing through. Jordan is going to be their candidate unless you get every single republican to vote for your Caucus Conference you are not going to a couple of democrats and unfortunately jim jordan behavior republican perspective certainly is not going to nicely affect democrats and certainly trump is not going to help with it is a good point, and a navarro. Jim jordan is a very polarizing figure. And as liz cheney was pointing out, he does have ties to the stop the steal movement and there are videos and pictures of him outside of the capital with stop the steal signs. All of that ties into it. For moderates, do you think it will matter . Will he be able to get to 218 . I dont think it matters. But listen. Kevin mccarthy, who after 15 rounds to become speaker, he also had some ties. Lets remember, just a few days after january 6th, where was . He hit was in maralago, kissing Donald Trumps ring, among other body parts. And that wasnt enough. So the problem with jim jordan, i think, is for republicans like districts where i live, florida 26, which is represented by representative salazar, a republican, who understands it is a swing district. In swing districts, the polarizing nature and nature of jim jordan is gonna be very hurtful to Republican Congress people. It will be a question of whether the moderates say enough to potentially stop that. And we have to remember that Steve Scalise is super popular and hes running as well. Ed rollins, i want to talk to you, though, about some 2024 politics and earlier today we heard from ron desantis some pretty strong criticisms of former President Trump. Take a listen. Nobody is entitled to be nominated. Nobody, especially anybody that couldnt even stop joe biden. You are not entitled to be nominated. Youve got to earn the nomination. Youve got to show how youre going to be able to get the job done. The reason this is, what im interested in what you have to say, you used to work for the Desantis Super pac. Do you think that is enough to really signal to voters that desantis is going up against trump here . No, no one knows florida better than ana. Shes one of the pros. Shes a next generation. On the old generation. Desantis is not running a good campaign. He cant connect. Hes overspent his budget. Hes lost money. Hes got good operatives, but has chaos and his campaign. And it takes a lot to make this happen. In the meantime, trump and the primaries, beating him is gonna be tough. So my sense today, its gonna go on, but we have basically got to settle our nominee quickly, just as we have to settle on a speaker quickly. We have got a big task ahead of us. The whole house presidency. Back and ana . It has run so many campaigns and hes got experience on this. But i dont think the problem with desantis is he hasnt run a good campaign. I think the problem with desantis is ron desantis. He isnt a good candidate. He frankly a paper tiger. He looked strong on paper because he managed to win in florida, but he was running the second time around, by 20 points, who is running against charlie crist, who i said here on Election Night was like beating a corpse, and i apologize to corpses. So, yes, desantis looked very strong coming out of november, and that election. But he was not. He is a person that lacks charisma, that is not likable. Is very awkward. And he based his entire campaign on this notion of being woke and antiwoke and fighting with disney and fighting with drag queens. Guess what . Taking on the largest employer of florida, which is disney world, because they express an opinion on policy is not a conservative values. So i dont know how he thought that was going to make him that popular. That might be a question for ed at the end of the day. Ed, at some point we will need to discuss what happened there with desantis. But i want to raise this for you. The Trump Campaign says this about desantis. We took out ron, we took out ron, for this talented person than people originally believed. Crooked joe is down to us by 11 points and we have to focus on one of the most overrated people like no, this is trump, nikki. Hes talking about nikki haley. There is this really what the risk is right now . Is trump right that theyve already taken ron desantis out of the race and this is about him and nikki haley . I agree with totally with an evaro on lifetime. Ive never met the person in iowa woke was end was and i think to a certain extent, he didnt define himself. The critical thing is President Trump has got a lot of legal challenges ahead and he doesnt get to define his message of the way as hes done and the past. I think this is still what open. I would bet on him nominate the nomination, but politics is about addition. And thats the new generation, im the old generation. But listen to people is find more voters. We need more voters. Thats how you win races. Its a game of addition. I dont think either the house or the senate or National President ial politics is adding new voters. We need democrats, we need independents, to win in the general. And nikki haley, anna ana seems to be doing just that. Pivoting to the middle. She pivots all over the place. Nikki haley human wind sock. She could whatever way the political winds are rolling and she will be pro trump when she has to be, she will be antitrump when she has to be, shell say anything, shell to anything. I do think that is good news for her in part because she has performed well on post debates stages. But also because everybody around her has been so mediocre or less than mediocre. That reason there is room for nikki haley to the on an upward trajectory is because ron desantis has failed and flailed like fish desperately gasping for some oxygen, when theyre out of water. We will see first of all if there is another debate, and how that one goes for all of those candidates. And ed just let me say one thing. Debates dont win the presidency. Campaigns is getting out and meeting people, articulating issues they care about, and connecting. None of these candidates are connect again either of these debates have been disastrous as far as im concerned. Thats an important point. Ed rollins, ana navarro, thank you both. And another of Donald Trumps legal predicaments, tonight, hes pulling out a variation of the Richard Nixon defense. That is, when a president does, its not illegal. Thats the basic point that the Trump Lawyers are now making and Court Documents today. For why his federal election case is going to be tossed out. The argument is essentially president s and former president s were immune from criminal prosecutions. Before you dismiss it, this argument is not entirely meritless. This is uncharted entirely new ground. The law here is murky and unsettled. And the question of president ial immunity is not in the constitution. It is has really been tested at the Supreme Court level. And certainly never for a president who has been indicted. Richard nixon did come the closest when he fought the infamous oval office type secret. His lawyers argued, quote, an absolute unqualified president ial privilege of immunity from judicial process under all circumstances. Now the justices dismissed a portion of that argument then but what about now . Ive got to perfect voices to give us some information here. John dean, former Nixon White House counsel and cnn contributor, and also with us, jon sale, former assistant special watergate prosecutor. John dean, i want to start with you. The law here is really not settled on this issue. Some legal experts say you cant dismiss it out of hand. How do you see it . It is a gray area. I think reading this motion they have filed to dismiss, because of president ial immunity, kind of got my attention. Its not a frivolous brief. Its well done brief. And theyve got, i have not checked pull the law, havent had a chance to do that. But im very anxious to see the government response. But if anything might delay this case and put it off until after the election, this is the brief that will cause that to happen. While interlocutory appeals are very rare and very significant motion and a motion to dismiss the president because he thinks he has committee, its pretty significant. This could go up on appeal and that would delay everything. And delay is incredibly significant and a case like this. When youre talking about somebody whos actually a president ial candidate right now. Jon sale. The trump team is insisting that the president is not above e w here. And theyre filing they write this. Important, late this edition of absolute immunity rerdless of internal motivation does not place the president Above The Law. But instead, simply clarifies that remedy for alleged efficient misconduct lies as the constitution requires. With congress, through impeachment, and through other informal means. But as weve seen, there have been a couple of impeachments here for this former president. These remedies could still mean that a former president , or a current president , could skirt the law, right . Abby, there is an office of Legal Counsel opinion that goes back years, and it says a sitting president cannot be indicted. Some people even disagree with, that but thats been the practice. But it does not say or imply that a former president cannot be indicted. Impeachment trials and the senate, the remedy, if two thirds of the senators vote to convict is removal from office. Even Mitch Mcconnell said on the floor, he was voting not to convict a president , but he said the president should, can be held accountable in a court of law. And i think that argument is, i dont think its frivolous, but i think its not going to go anywhere. And my friend john dean may remember that the litigation to the Supreme Court of a tapes went in record speed and the d. C. Circuit and an appeal about Executive Privilege recently gave the trump team less than 24 hours to respond. And this can really be fasttracked. And i dont think that anybody concerned is going to let this case be put off a year. John dean, i want you to respond to that. And if the idea that the Trump Lawyers are basically saying, you have been two impeachments, two acquittals in the senate. Does that matter . They appear to be trying to track the constitution on an area that is very unclear, and very muddy. My friend tom, who is an excellent lawyer, and pointed out, there are opinions in the Department Of Justice on this issue for sitting president s. Is right and noting there are no opinions. And that is why i worry about us having to go to the Court Of Appeals process and to the Supreme Court, because it would be a fairly significant issue. And we have a court that is very definitely leaning right now. They might slow it down for the president. I hope they would not. I hope it would be let during watergate, when all the courts acted with incredible speed. I think everyone knows trumps and modus operandi. So theyll know what hes doing. But if they decide for political reasons to slow it down, this could be the motion they do it on. The world is watching. Abby, the world is watching. And i think the principal that no ones Above The Law is going to prevail. And thats going to apply to donald trump. And when hes in the courtroom, hes not President Trump. Hes defendant donald trump. It became one of the most hotly contested issues in the 2020 election, and now tonight President Biden and his administration are tying themselves into knots to explain why they are going to keep building their. There will not be another foot of wall constructed on my administration. The appropriated for the border wall. I tried to get it reappropriated to redirect that money. They didnt. They wouldnt. And in the meantime there is nothing in the law other than they have to i cant stop that. The biden announcing that, yes, it will build more border wall as the Migrant Crisis gets worse. One of his first actions as president was pledging no more of taxpayer dollars for the wall. But biden today insisted today that walls dont work. Secretary of Homeland Security clearly did not get that message. In a statement, Alejandro Mayorkas said, quote, there is presently an acute and immediate need to construct physical barriers and roads in the vicinity of the border of the United States in order to protect unlawful, prevent unlawful entries into the United States in that protected area. And the White House Press secretary also today had trouble explaining the administrations position. The ineffective, why is the Homeland Security secretary saying its necessary to prevent lawful ive not seen that full statement. I know i hear you. Im just saying ive not seen his full statement on that. What i can speak to is for the president and the president has been very clear. Does he have a disagreement with his department of Homeland Security . I want to tell you what the president said and what your colleague asked him, he said, no, he doesnt believe in direct contradiction to his own direct contradiction and speaking for the president. President. He said there will not be another foot of wall constructed in my ministration. So, something changed. You want us to break the law . Is that what you want . You want us to not comply with the law . Im not but you want us to not comply with the law . You want to the administration that in an attempt to clean up, mayorkas would later say the administrations position has not changed. Joining me now, democratic congressman Adriana Espaillat of new york. Congressman, biden did pledge, not another foot, no more money for border wall. Why is this happening . Opinions change. For use change. People evolve, and i trust the president do you think his opinion went by the bull [interpreter] wall itself. I dont think so. I know there is money that was allocated back in 2019 and perhaps they need to access that money. This crisis is a deep pocket crisis, right . For cities in the federal government as well. But i tell you, a wall is a answer to a current problem. It really does not work. And what we really need to do is take a deep dive into what is happening in central and south america. I look at what is happening, for example, in venezuela. Many migrants are coming from their. The maduro regime. But Haiti Being Run by the gangs, cuba. And its not even a right or left wing crisis. Guatemala and honduras. So there is a crisis in latin america. What do you want the president to do at this point as it relates to the wall . You call it a byzantine solution to the problem. But at this point should they or should they not go forward with building this wall. Absolutely not. I think the money should be spent smart, and ports of entry our problem. That cato institute, a very conservative institute, has given us the formation of that shows that only 0. 02 of the fentanyl coming it is being trafficked by migrants. Over 90 by u. S. Citizens. And its coming through ports of entry. But theyre saying, this is what the secretary was saying, there is tweet the 19 law that appropriate this money. If they didnt spend it on the border wall, that would be out of compliance with that law. So if they shouldnt build the wall, do you think they should take that risk of not enforcing that law as it was passed by congress . I dont think they necessarily have to use that money to build the wall. They could build roads near the area of the border. We are living in the age of artificial intelligence. So they have other options . Technology is there. The money is there, available. Based on the law . I believe, i dont think the money is strictly for building all. So i think they have options. I think they should resort to those options. What do you think Secretary Mayorkas said, this was a three star quote, there is a cute and immediate need to construct physical barriers along the southern border. Why would he say that . Look, this is a difficult crisis. Right . There is a lot of stress out there. Cities are stressed because its a budget problem. The federal government has to deal with it on a daily basis. So its very stressful. Im sure that there is space in that debate for boulder Border Security. I support the dignity act, which is a bipartisan piece of legislation for comprehensive immigration reform. It has Border Security provisions in it. So there, is room for that. Yeah. But a wall is not the answer. But physical barriers, fences, while like things have been part of Border Security policy. Even before trump. And they never worked. I guess, what im saying is, isnt there a world in which that is part of a package of Border Security, in the areas where it will be an impact . My question is, did the Berlin Wall Stop Germans from going to freedom . No. Would a Wall Stop Mob Desk traveling 2000 miles with children because they want to be recruited by a gang, and she wants to knock on our door and make a claim . Dont get me wrong, im not trying to make a case for the wall. Im just asking is part of a compromise to get to more comprehensive solutions. Would you be willing to accept somebody for just physical barriers . In order to get that . Id be willing to accept a robust discussion for Border Security and we can discuss the details of that, not outfall. A wall. But there is plenty of Technology Available now that will probably be best suited for the border, and will be more effective than a byzantine wall. So i would people and to discuss that and to see how we provide work permits and the dignity act provides those provisions. It is a bipartisan piece of legislation supported by, me who represents one of the most progressive districts in the country, and by some republicans as well, more democrats supported it. So its a comprehensive piece of legislation and i think it stands a shot, right . Given the time. It is taken up in the house, so far, nothing is being taken up in the house right now. And up next, as George Santos faces an investigation into his actions, one of his aides just struck a plea deal. Laura coates joins me live on what this means for the congressman. Tonight, some more troubling news for George Santos, the embattled congressmans former Campaign Treasurer has now pled guilty to a count of conspiracy to defraud the u. S. Nancy marks oversaw santoss Campaign Finances before being dismissed after a series of filing abnormalities. And that was led to accusations of wrongdoing against both her and santos. She now faces a maximum of five years in prison. This could all signal even more trouble for the scandal tarred Republican Congressman. Marxist case has the same Court Docket Number as the one listen listed for santoss federal fraud case. Hes facing 13 charges, including wire fraud, Money Laundering and theft of public funds. Santos has not has pled not guilty to those charges, i should say. Laura coates joins me now to talk about all of this. So, laura, one of the interesting things here is that the accusations that she pled guilty involve working with, now, a sitting congressman on a fraud against the United States government. So, what does this mean for George Santos . Its not good news for him, abby. And here is, really, why. Not only in her allocation was a fancy way of saying the things you are going to tell the judge you did wrong when you plead guilty. Heres the facts. Heres what we agree on. Its all under the umbrella of elocution and she specifically who also happens to be a sitting member of congress and his lawyer, anderson, object in the courtroom over hearing all of this and did not move to object in any way, which signals to you that his knees maybe shaking a little bit. If he has direct knowledge of his behavior, as alleged, she made it very well and up being a witness against him. There is not correct a cooperation agreement, we are told, but the fact she would have incident allege and be able to testify specifically with actual first hand eyewitness accounts, that can be very damaging for a defendant.
