good morning, everyone. i'm poppy harlow along with phil mattingly live outside of the capitol in washington, d.c., this morning. it is wednesday, october 4th, and there is no speaker of the house. we are going to discuss the politics of how this happened and where we go from here. certainly we're going to talk about the process of what happens next, but we are really focusing on the implications. the people's house is paralyzed. it cannot do its job for you, the american people, after kevin mccarthy became the first speaker of the house in our nation's history to be removed. >> the office of speaker of the house of the united states house of representatives is hereby declared vacant. >> take a look at these, the front pages from the major papers across the country, as you wake up this morning. our nation enters uncharted territory. >> the house is in chaos. republicans are now scrambling to find a new leader after a small rebellion, just eight members, led by matt gaetz, was able to topple mccarthy. >> in today's world if you're sitting in congress and you took a gamble to make sure government was still open, and eight people can throw you out as speaker, and the democrats who said they wanted to keep government open, i think you have a real divide. i think you have a real institutional problem. that is not a government that works. that is chaotic. >> while there is no clear front-runner, some names are emerging as possible successors to mccarthy including his number two, house majority leader steve scalise, jim jordan. lauren fox is here with us on set. the question now, once you pick your jaws up from the floor, this is the first time in the history of the institution this has happened, what happens next? >> we're in unprecedented time. when will a race for speaker begin? it will not start at the earliest until next week. that is when house republicans plan to return to the capitol and begin this process. right now there's no alternative, phil, and that is really why we are in these unprecedented times. former house speaker kevin mccarthy vowing not to run for speaker again after an unprecedented vote tuesday plunging the house of representatives into chaos. >> unfortunately, 4% of our conference can join all the democrats and dictate who can be the republican speaker in this house. i don't think this rule is good for the institution, but apparently i'm the only one. >> the motion to vacate was filed by representative matt gaetz who, along with seven other gop members, voted to oust the speaker. the motion passed 216 to 210. >> those eight people are anarchists. >> mccarthy's speakership was the third shortest in history and was plagued with gop infighting over spending cuts, border security, and providing aid to ukraine. >> you all know matt gaetz. you know it was personal. it had nothing to do about spending. >> speaker mccarthy's time is over. i wish him well. i have no personal animous. >> now the race is on to elect a new speaker as another possible government shutdown is 44 days away. >> what i'd like you to take away from it is i'm tired of being lectured by people who have been here for decades, okay, and have put us in $33 trillion in debt. >> several names have emerged as possible contenders for speaker including house majority leader steve scalise. scalise has already started reaching out to members gauging a possible bid for the role. >> no one really knows who has the votes, so now we're going to go through that exercise right now and see who has our support. >> reporter: another possible name floated is house judiciary chairman jim jordan. >> i thought it was unfair to kevin. he's a good man and he didn't deserve this? my judgment. >> will you run for speaker? >> reporter: one person not interested in the job is gaetz. >> are you putting yourself forward? >> absolutely not. >> reporter: mccarthy, for his part, says he has no regrets about his tenure as speaker. >> i don't regret standing up for choosing governing over grievance. it is my responsibility. it is my job. >> reporter: and house republicans, because they don't have a speaker and because we don't know how long this process is going to take, there is legitimate questions about whether or not the government is going to be funded in just a little over a month and a half at this moment given the fact that right now the house of representatives, the building behind us, has descended into chaos. >> it was so shocking yesterday when the news came they were going home to socialize with others, a different way to interpret socialize, but to come back in a week to get this business done for the american people. lauren, thank you very much. >> let's bring in analyst kasie hunt, axios reporter eugene scott. guys, welcome. eugene, i want to start with you. we can get into the nitty-gritty, in the weeds of the speaker's race and what delegations are meeting and how they will try to play this out, but to start to pull back a little bit, this was a week republicans were supposed to start moving on two more spending bills, which is at the trucks of this entire problem. instead the institution is completely paralyzed. it is a critical piece of one of the branches of the federal government of the united states of america, and no one has any idea if there's a path forward at this point. how is it possible we got here? >> if we think about how this began, mccarthy ascending to the speaker leadership position, we shouldn't be surprised. he had a hard time getting there in the first place. we didn't know it would happen within 12 months, but he would find himself in a state someone would bring forward a motion to vacate based on disagreements on policy, procedure, behavior, ideology, and he had a hard time keeping this party together for various reasons, various ideological diversity. there are also some petty grievances. this is what happens when you have those issues. >> so, phil, i go back to -- and i know you have known kevin mccarthy over the course of your career, and i've been in a lot of different situations with him, public, private, listening to how he talks to people. when you are listening to him, he is almost always telling the person across the table from him what they want to hear. that is how he got into this position in the first place. when your job is to recruit candidates and raise money, it works really well. i think the challenge here, and participate of why you're seeing so many of these hard line members talk about personal reasons they're upset with mccarthy is once you actually have the gavel, once you're in power and you say things, there are actually consequences when you don't deliver on them. i think he got himself into a little bit of trouble here. the way he has done business, the way he rose, simply didn't work once the responsibility was on his shoulders. >> lauren, what about americans waking up to this news, going to work, making breakfast for their kids, can they ask themselves, can we trust republicans to govern, to do their job? >> this is one of the issues democrats were weighing when they were trying to decide how they wanted to proceed. republicans were making the argument to their colleagues that don't you want this institution to function? and i think democrats were thinking to themselves, yes, we do, but not with kevin mccarthy. and there is a possibility this is prolonged, that this goes on for a very long time, and the american people -- >> what's very long, lauren? >> the american people start to see this is what republicans do when they govern. a long time could be weeks. it could be days. but, you know, even if this is wrapped up by next friday, that's still two weeks lost in the appropriations process. and that is two weeks that house republicans want to try to pass standalone bills phil was talking about. those bills are going nowhere in the united states senate, which means it's sort of a shell game happening on the house side before you get to the larger problem of actually negotiating with the senate and getting a deal. and the next person who becomes speaker, that problem that existed for mccarthy will exist for them. >> it's about keeping the government open, right? what are they, 42 days now and counting? >> 43, 42, yes. >> ukraine funding. so many critical issues in these few weeks. maybe they waste two weeks or more. >> they're playing a shell game when it comes to the actual bills themselves, but they haven't even set up the table and put the shells out. they took it all back yesterday, so now everything is frozen. trying to continue the metaphor. >> let's also -- look, i don't want to be doomsday but big picture, this is the united states of america. it's a major player on the world stage. we haven't had a -- the rule that was written that means that patrick mchenry has that gavel, it was actually put into the rule book formally after september 11th because there needed to be a plan for couldn't f continuity for government, what feels very in the weeds, spending bills, the appropriations process is very hard to understand. if there were to be a crisis, which there could be at any moment, the reality is there is no one running this show. and that is potentially a major problem. >> let's play that out for a minute. >> the power patrick mchenry has right now is extremely limited. basically he can run a speaker's race. he cannot take further legislative action, which speaks to kasie's point, if you have the crisis, and we don't want to be doomsday, but if you have a crisis, you don't have a way to solve it in the house of representatives. >> let's play this out, poppy. phil, i think you were there when they passed the t.a.r.p., the plan that bailed out the banks. >> it took a couple of shots. >> if lehman brothers were to fall, the way it did at that time, they can't organize this body to actually do anything quickly. think about what happened when covid was declared a pandemic and they had to suddenly make sure americans had enough money in their pockets to get food. we can hope in the event something like that happened the republicans would recognize if and say let's get steve scalise in the chair so we can quickly do things. i think it's important for people to remember the congress in moments of great national crisis and strife actually plays a significant role. >> let's talk about options for who it could be. >> kasie makes a great point, maybe they'll move quickly on steve scalise, he is number two. he and jim jordan were asked what they want to do. take a listen. >> are you physically up for the job as speaker? do you think can you handle that? >> if the conference comes to you next week, would you do it? >> i'm going to talk to the conference over the next week. i think that's the key. i think this is a day we say, look, what happened here was not good. what happened to kevin mccarthy was not fair. let's figure out how we come together as a conference and focus on our agenda. >> so two things here, one, steve scalise has health issues. he was just diagnosed with cancer of the blood a few weeks ago, at least publicly. he made that clear. there are concerns about that. concerns getting to 218. jim jordan, that answer is very, very telling. he's leaving the door open, which is different than he was during the 300 votes for mccarthy, and he has a lot of support within the conference. >> he has some popularity issues. jim jordan has been a bit of a fire brand in the gop. he's moved to the center the past few months, but he's upset many republicans in how he handled things in january, and some haven't forgotten that. the reality is there are moderate, more centrist republicans, who are in districts that biden won and they're concerned about what they put forward and who they put forward to lead the gop as they try to figure out if they're going to keep the house in the next election. >> there's 18 of them and they're the reason that kevin mccarthy was speaker for 246 days. >> stay with us. we're going to continue to follow all the twists and turns. a mass shooting on the campus of morgan state university in baltimore. those details coming in overnight. happening now, the biggest health care worker strike in u.s. history has just again. kaiser permanente employees will strike at locations across the country in an effort to get better pay, higher staffing levels and guaranteed bonuses. what that means for hospitals nationwide. kevin mccarthy, where is kevin? there is kevin. [ applause ] kevin told me in the heat of battle, right, kevin? kevin mccarthy, the great kevin mccarthy. we have a great man, and he's going to be, hopefully, a great speaker of the house. we have to get him there. >> donald trump did help get kevin mccarthy there, but mccarthy worked for it. we all remember that trip to mar-a-lago mccarthy made to patch things up with trump after criticizing him in the wake of the january 6th attack on the capitol. the man affectionately dubbed my kevin finds himself ousted kevin. >> do you support matt gaetz's efforts? >> i like both of them very much. >> that was on sunday but just yesterday -- >> i don't know the guy. >> after the vote to remove mccarthy as speaker, congressman matt gaetz suggested he may have had the former president's backing. listen. >> my conversations with the former president leave me with great confidence i'm doing the right thing. >> the only official comment was on truth social. why is it republicans are always fighting among themselves? why aren't they fighting the radical left democrats who are destroying the country, closed quote. lauren fox, kasie hunt and eugene scott. the sound says it all. >> the question i was trying to get in right after that was did you talk to the president, former president, today? and he did not answer that question. one of the biggest questions right now are these right-wing hard-liners did this and they had no alternative. there was no plan, no game for here is how we're going to play this out. it was just we don't like mccarthy. we're getting rid of mccarthy. why they're not going to come back today and try to figure this out, the reality is if they did that right this moment they would have a 15-round speaker race. there is no plan b. we are talking about a couple of candidates, steve scalise, kevin hern, that work is beginning for steve scalise and his team. they have done this before. they know how to fundraise. kevin mccarthy likes that life, knows how to do it. there's a question about the other people in the race. do they know how to do that and can they put a team together to try to lock things down? that's why stepheve scalise has such an advantage. >> when the dog catches the car or the car stops and the dog runs into it breaking its muzzle and other bones. trump weighing in on this is not subtle. he holds enormous sway over a significant portion of the house republican conference, more so than he does in the senate. in the house he can control things. he can move things around. when does he get involved explicitly, do you think? >> my understanding from talking to sources the calculation was he didn't see anything in it one way or the other. gaetz heard what he thought he wanted to hear from the former president. mccarthy's team didn't seem to send any signals. on the campaign side, man, i think i'm going to stay out of this. i don't know that he needs to have a dog in the fight as long as he's not unhappy with whoever the choice is going to be. if he weighs in and says i want jim jordan to be speaker of the house, that could change the conversations pretty quickly. i will say, there was a lot of speculation and we covered this when he had those 15 rounds and you tie that back to what happened on january 6th and the way mccarthy switched, the picture of mar-a-lago, that did not come to pass here. so i do think, also, trump -- he knows how to affect what they do here by throwing bombs into it. the number of times paul ryan had to get on the phone with the white house, i need your help. please fix this. we'll see if he ncontinues in that vein. >> you made an interesting point mccarthy, in your view, didn't he ca extend an olive branch. would they have gone their own way and come in to save him? it's true. plus, when you buy your first line of mobile, you get a second line free. there are no term contracts or line activation fees. and you can bring your own device. oh, and all on the most reliable 5g mobile network nationwide. wireless that works for you. it's not just possible. it's happening. all right. as we join you from the nation's capitol this morning, a live look at trump tower in new york city. former president trump says he will go back to court, day three of his civil fraud trial. trump has repeatedly attacked both the attorney general, letitia james of new york, and the judge who has put a gag order on. he says he plans to testify but it could be several weeks before he is called to take the stand. following it live outside the courthouse with more, there are so many things to get to, the fact the judge decides in this case and now he has a gag order on trump. trump says he is going to take the stand. i am dying to know what his lawyers think of all that. this mandated order to keep trump quiet after this -- after what he posted about the judge's clerk. >> reporter: poppy, it was super interesting because after lunch yesterday, the court was sort of delayed, and everybody was wondering what was taking so long. but when the judge went to the bench, he issued this strong rebuke right at the defense table where the former president was sitting with his attorneys, and it was in response to a truth social post that donald trump had posted with a picture of judge engoron's clerk and senate majority leader chuck schumer and in the post claiming, without any evidence, that she is schumer's girlfriend. now there's no clear connection of the relationship, if anything, past that picture at this point. the judge, someone who has been attacked by trump many times throughout the course of this trial and before, this was a bridge too far. he essentially said that he asked it be taken down, it was, but he says that was before it was sent to millions of people via email. and he said personal attacks of any member of my court staff are unacceptable, inappropriate, and i will not tolerate them. he says now that the defense cannot talk publicly, cannot email, cannot post about anyone on his staff, or there are going to be serious sanctions as a result. it's unclear exactly what he means by that because he didn't issue a formal order. everyone was called back in the courtroom without the press in there and there was a conversation to be had before the former president left for the day. >> brynn, trump has pictures with hillary clinton and many other people as well if he wants to play that game going forward. >> at his wedding. just saying. >> glass houses and all that. the idea trump says he's going to testify, he said it in the past, do we have any reason to believe this time he means it? >> reporter: i think he does mean it. he's been on the witness list for the defense. it feels like the state's attorney will call him to the stand and he's eager to defend his brand. this is something we didn't expect him quite honestly to come back to court today. we were hearing that it was going to be a monday/tuesday thing. he is in court, is very engaged with his attorneys. the court reporters noted it's very different when you have the former president sitting there testifying. there may be truth why he wants to be there. we do expect him to take the stand during this trial. elliot williams, the idea of a gag order, a lot of people have been wondering if any of the cases would get to this point. the judge said not abiding by it would involve serious sanctions. what actual teeth does this have? >> not a lot. to have a serious sanction against a billionaire you have to be sanctions him hundreds of thousands of dollars if not millions, and that's just not going to happen under the laws of court policy or procedure. you could put him in prison. >> i was going to ask that. >> it's less likely but it's doable and, frankly, poppy, that's the one thing i think will work at this point. >> that threat? >> nothing has worked whether it is warnings, threats of gag orders or anything else. >> i think you bring a good point. erin burnett was saying this last night and i was saying, yes, through the television. he's been warned so many times on these fronts and nothing has happened. why should he believe it this time? >> what was interesting about this one, he made comments about the judge before. and the judge brushed it off. there's no jury here and there's, in effect, any comment he made wouldn't taint or prejudice the jury pool. he can say anything he wants. going after court staff is a line you just do not cross as an attorney. this is a relatively junior career appointee. it can undermine the integrity of the court. this was a bridge too far. >> i might be jaded and cynical, but the idea trump will testify, we've heard it before. take a listen. >> i would love to speak. i would love to. nobody wants to speak more than me. >> would you be willing to speak under oath to give your version? >> 100%. >> are you going to talk -- >> i'm looking forward to it actually. >> more likely to sit for an interview now? >> my lawyers are working on that. i've always wanted to do an interview. nothing i want to do more. >> that's the basis for my skepticism. what are his lawyers telling him? >> he may not have the choice if the plaintiffs call him to testify. this is a civil case. the other side can -- the state can call him to testify. >> he can plead the fifth but that can be used against him. how would you cross-examine him? >> just let him talk. this is a defendant who seems to know he's going to lose and he's attacking the court and playing to voters. let him talk, run his mouth, contradict himself. shove those reports and pieces of paper in front of him. >> a lot of work cut out for his lawyers if they're going to train him for testimony. imagine telling him short answers, direct -- >> give him a leash. if euroyou're the prosecutor, l him go. every single house democrat in attendance voted to oust speaker mccarthy. who do they think should replace him? we'll ask pat ryan next. a nationwide strike just kicked off, this time among thousands of health care workers from kaiser permanente and what it could mean for hospitals across the country. after florida congressman matt gaetz filed a resolution that would remove kevin mccarthy from the speakership, mccarthy tweeted, bring it on, and gaetz replied, quote, just did. a lot of people think joe biden is too old to govern, but it sounds like these guys aren't old enough. >> back in january congress had to vote a record 15 times for mccarthy to get the speaker's job. to remove him, just one. >> it didn't take long for the writers now back at work, pretty rich content. the building behind us here on capitol hill where the speaker of the house has been forced out of the job. there is no formally elected speaker. kevin mccarthy blaming on eight republicans but also blaming democrats. >> i think today was a political decision by the democrats. i think the things they have done in the past hurt the institution. you can't do the job if eight people, you have 94% -- or 96% of your entire conference but eight people can partner with the hole other side. how do you govern? >> joining us, patrick ryan. he along with every other democrat voted to remove mccarthy as speaker. i want to start there. i don't know that anybody on the republican side wants to get into that argument but more broadly, i was surprised when every single democrat stayed together on this. why? >> we've been together from day one. it is such a stark contrast -- this is my first year in congress, my first full term -- from day one under mccarthy it's been chaos, division, dysfunction, and no results, no delivery. we have been at critical points, the democrats, the saving grace, averting a fiscal cliff a few months ago, averting a shutdown last week. if folks are looking as we go forward, which is what i think we need to do and provide results, the democrats have been the responsible party, the patriots, actually putting the country before the partisanship. mccarthy, unfortunately, has presided over unprecedented chaos. >> mccarthy would say he went along with you guys, worked with you on both fronts to do that. president biden says, consider me versus the alternative. doing this unanimously, do you believe one of the alternatives that is out there, scalise, jordan, hern, are better for the country? >> i think we're thinking about this the wrong way, to be honest. >> mccarthy is not going to run again. >> we need hakeem jeffries as the speaker. he presides over and has unified the plurality of the house. about half of the republicans. >> and you think five republicans agree with you? >> five or more have to zoom out, recognize the moment we're at in history where unprecedented territory. what happened yesterday hasn't happened in almost 250 years. what we're doing has not worked. i'm calling on five to unify with us to support hakeem jeffries and move the country forward, deliver economic relief, defend democracy, reproductive people. that's what people in my district and across the country want. >> one of the things i've heard is of course frontliners would want him out. he's a fund-raising behemoth. he has to try to keep you from a special election. any truth to that, this is a political you want to take out their biggest fundraiser? >> that tells you everything you need to know about how kevin mccarthy thinks of the world as a career politician who just hasn't probably talked to folks, real people, in his district for a long time. i served 27 months in combat. i'm here to try to hold it together to build unity and we store trust. to use those kinds of arguments shows why he failed as a leader. >> everyone wakes up this morning and they now know there's no speaker, and we were talking about the crises that could happen at any moment over the next week when everyone is home and try to get a vote. what do you say to them how you would handle that? what would you do if something catastrophic happened? >> i've been communicating to help them understand why i made the decision and what this means. it is important to reassure we have a speaker pro tem. >> they don't have power. >> the administration will continue to drive forward. we have to focus on we need a speaker, to avert another potential shutdown and get our act together and act as patriots not the same bickering that has gotten us to this point my whole adult life. >> there are republicans who work with democrats, republicans who disagree with the path the conference has gone. i know there was a lot of anger from the republican said. saying that it might fall apart based on the decision by democrats to vote against mccarthy, to vote him out. is there truth to that, this may put things in a worst spot between the members who actually work together? >> i'm not in that caucus and haven't been part of those conversations. i do think mccarthy's decision to cave to the maga extremists, to lower the threshold -- i know this is wonky, to lower it to one vote, he enabled and empou empowered the most extreme forces. some sort of change to get us back to rules that incentivize cooperation is critical. what we've had the last nine months hasn't worked at all. >> they are going to be very upset. i'm slipping. >> phil mattingly never makes a mistake. >> this is devastating to me. i've been gone too long. >> thank you for your service to this country. sad to report a mass shooting at morgan state university that happened overnight during homecoming week. we are live on campus. we'll bring you the latest in the investigation. >> and the man accused of kidnapping charlotte sena. well, this overnight, a mass shooting on an american college campus. baltimore police say five people, four of them students, were injured in last night's shooting on the campus of morgan state university. this happened as students were celebrating their homecoming week. >> we have shots at thurgood marshall. >> shots fired, gunshots heard. >> let's get to gabe cohen live on the scene of this terrible mass shooting. i know classes are canceled. what do we know about the condition of those injured? >> reporter: poppy, the search for the shooter continues. police haven't indicated if they know who did this or what the motive might have been. as for the five people shot, four morgan state students, all are expected to survive. this was, as you heard in that sound, a frantic scene last night around 9:30. police on patrol hearing those gunshots, racing in to five the five injured people. that's when the school went into lockdown, a shelter in place was issued as a s.w.a.t. team combed building to building trying to find whoever did this. as you mentioned, unsuccessful at this point. classes, though, canceled today. this was a time for celebration, it is homecoming week. students were between events and this is the third straight year homecoming has been marred by violence on this campus. take a listen to baltimore mother's mayor speaking of this shooting last night. >> we are dealing with not just here in baltimore, not just at morgan state university, but across this country of the united states an epidemic when it comes to guns and gun violence. we have to stop saying not one more. we need action now. when is enough going to be enough? >> reporter: the growing number of shootings on college campuses including that mass shooting on michigan state's campus, more than 500 this year alone. concerning for students and parents who send their kids, young adults, to places like morgan state hoping that they're going to be safe. >> of course, every parent's hope and three years of homecoming marred by violence says it all. we wish the best for the victims. the abduction of charlotte sena taken from a park while camping with her family. court documents show craig ross owned property only 1,400 feet from the sena family home. jean casarez joins us live. what more have we learned about the suspect? >> reporter: cnn has learned law enforcement has not yet interviewed 9-year-old charlotte sena, waiting for specialized forensic interviewers to arrive. these are skilled interviewers who interview young children involved in horrendous, but survived, situations. a dramatic investigation still unfolding after a miraculous turn of events in the disappearance of charlotte sena. >> tonight our prayers have been answered. >> reporter: the 9-year-old girl found alive monday night appearing to be physically unharmed after disappearing from a campground in upstate new york two days earlier. authorities charging 46-year-old craig nelson ross jr. with her kidnapping. searching the property where he lived in a trailer behind his mother's home and where he allegedly held the 9-year-old captive. the break in the case came at 4:20 a.m. monday, 17 miles away where police were watching the sena family home. a car pulled up, law enforcement observed someone dropping something into the family's mailbox. >> state police go to the mailbox and identify what is a ransom note left behind for charlotte. >> reporter: a fingerprint on the note which demanded money matched those from a 1999 drunk driving arrest that led police to ross and that camper where he lived. monday evening around 6:30 s.w.a.t. teams moved in. >> the suspect was taken into custody after some resistance, and immediately the little girl was found in a cabinet covered, she was rescued. and she knew she was being rescued. >> reporter: the good news delivered to the community during a prayer service for charlotte. >> god has answered our prayers. >> so excited. we came together, opened the doors to pray, and we're seeing a miracle already. >> reporter: charlotte was taken to the hospital to be check out. her family saying in a statement, we are thrilled that she is home, and we understand that the outcome is not what every family gets. a huge thank you to all of the agencies that were mobilized, all of the families, friends, community, neighbors, and hundreds of volunteers who supported us and worked tirelessly to bring charlotte home. >> we're all just breathing a sigh of relief. for them and her children, we feel safe again. >> reporter: at this point ross is charged with first-degree kidnapping. he remains in this jail behind me without bail. at this point he has not spoken with law enforcement. cnn learned when he was arrested, he immediately asked for a lawyer. he is being represented by the public defender. phil?
