he didn't have my support anymore and he doesn't have the support of a requisite number of republicans to continue as speaker. >> matt gaetz makes his move against kevin mccarthy. what will the speaker do now. >> you always count me out. i'm telling you the same thing i tell you every time. i never give up. good morning to our viewers in the united states and around the world. i'm kasie hunt. it is tuesday, october 3, and this morning the ball is in kevin mccarthy's court after florida congressman matt gaetz made good on his threat, he filed a motion to have mccarthy removed as speaker of the house. mccarthy's message to gatetz ha been bring it on. now that gaetz has, republicans are likely to try procedural maneuvers to kill gaetz' motion without holding a vote to oust mccarthy directly. but mccarthy will need to turn to democrats. the whip count shows five republicans say that they are standing with gaetz. mccarthy can only afford to lose four. >> if kevin mccarthy goes and makes a dirty deal with the democrats to keep power, i think that the people in this country will rise up and go hand that their representatives and their lawmakers accept a more responsible path. >> gaetz calls it a dirty deal because democrats won't give kevin mccarthy anything for free. as one congresswoman put it, the word of the week is leverage. gaetz has been trying to convince progressive democrats to help him dethrone the speaker, one of mccarthy's allies had a warning for those democrats, the ones who might be thinking about that. >> i guess democrats need to determine first and foremost whether they want to align themselves with matt gaetz. >> and as of right now, most democrats are waiting on their leader hakeem jeffries to weigh in with a plan. >> i think our two leaders need to talk and i think that we ought to come to an understanding. i hope we can. >> there is a lot of different considers here. but at the end of the day, i'm waiting to hear from leader jeffries. he has earned that right from ever democratic member. >> to help us game it out, let's bring in michael snell, congressional reporter for "the hill." great to have you back on the show. there is a lot going on here. part of me honestly was waiting last night to see if gaetz was actually going to do it because it seemed like maybe he was going to chicken out honestly at the last minute, but he didn't and here we are. what happens next? >> you are right. matt gaetz went to the floor a couple hours earlier at noon and delivered a floor speech in what many folks thought would be that motion to vacate. at the end of it, he said stay tuned and then we saw it after votes last night. so the question of what comes next, obviously that is key. because it was brought up as a privileged resolution, that meanses essentially gaetz can force a vote in a speedy matter. so gop leadership will have to set a vote on this motion to vacate the chair within two legislative days. so that means either today or tomorrow. and as you laid out at the top, leadership will likely try to quash it with some procedural motion, whether a vote on tabling the measure, a vote on referring it, what have you, and again that would shield lawmakers from having to weigh in directly on whether or not mccarthy should remain speaker. but the procedural votes will still put mccarthy in the hot seat and his colleagues in a tough position deciding do they side with him or go against him. >> no, it is a very interesting came none dunan annone drum for them. let's talk about those who are with mccarthy.none drum for a l them. let's talk about those who are with mccarthy. gaetz doing this derails what they want to do before mid november when the government shuts down again. they have to worry about this first. take a look. >> it is absolutely personal. it is unacceptable. we have a lot of work to do for the american people. he has claimed that the reason he would do it is because kevin mccarthy didn't fulfill his promise of passing all 12 appropriations bills by october 1. guess what? we passed 70% of all the funding for government. we still have the 30% to go. >> so he says it is personal. >> and that idea about a potential government shutdown, i think that is a key point here. i spoke to congressman ryan fitzpatrick last night, he is a moderate republican, and he said because of this effort to force votes on ousting mcquacarthy, wh gaetz said he won't stop at the first one if it fails, he is likely do it over and over again, it will probably lead to a government shutdown because it will take up floor time and a lot of attention of lawmakers. and when you get into the question of is it personal or based on policy, matt gaetz publicly saying that this is because speaker kevin mccarthy has not met a series of demands that have to do with policy and spending. of course the continuing resolution that he put on the floor this weekend to overt a shutdown, that frustrated a lot of conservatives, including matt gaetz. but at the end of the day, this relationship between matt gaetz and speaker mccarthy has always been acrimonious. remember back to january, that matt gaetz never actually threw his support behind kevin mccarthy's bid for speakership. throughout all 15 battles. and they have been engaged in a war of words in the past. so i think that while matt gaetz could be frustrated with some of the demands by mccarthy, i think there is also a personal tinge to it. >> and there is and on going ethics inquiry into gaetz that it seems that people around him people believe kevin mccarthy is allowing to go forward. a lot of deep personal acrimony here in addition to all the politics. thank you very much for being here and getting us started this morning. >> thanks for having he me. and coming up here, does speaker mccarthy have a secret deal with joe biden? >> stop saying something there is not true. s there not a secret plan. >> let's bring inin max foster. always wonderful to see you. we're back explaining this again to everybody because ukrainian official says that ukraine is being held hostage in america's internal games. but that they feel that if washington would stop helping k kyiv, that possibility is slim. my read is that is correct, but i do think that kevin mccarthy needs to get through this this before he can say yes, i'll put it on the floor. that puts them in a tough spot for right now. >> yeah, a lot of european politicians are trying to calm any sense of panic as it were. reality is that ukraine to? extent is hostage to the united states because the united states provides most of the funding in the war. the war can't carry on without the funding from the u.s. but they keep talking about how president biden is so behind ukrainian funding but american politics is incredibly unpredictable as you outlined. and so i don't know how they can be so sure. but i think what americans might want to consider is this show of force yesterday in kyiv. the eu foreign ministers all coming together showing full assume for ukraine. and also adding in hundreds of millions of dollars more money into the war in ukraine. so what they are saying there is we are fully behind ukraine, so if the republicans are those particular republicans do stop funding or push for a stop of funding of the war in ukraine, that undermine those alliances. it is a much bigger problem than just ukraine. >> and i think that it is so important that you undercore that. quite honestly, i think the feeling here in washington is this band of people who oppose this probably don't care about what the view is from europe. but in terms of, you know, the broad kind of diplomatic realities that the broader u.s. government is dealing with, it is actually really important and i do think that the bottom line in terms of whether these officials abroad can be certain about u.s. commitments, it is there, the majority -- vast majority of members of congress want to fund it, but the problem is the system allows for this small group to reek quite a bit of havoc. so let's talk for a second about what is going on in azerbaijan. this is something that doesn't get a ton of coverage over here necessarily day in and day out, but i think it is a really critical possibly unfolding conflict. azerbaijan is againing a cross border attack or a mean armeni. there are more than 100,000 refugees that have fled from nagorno-karabakh and many feel abandoned by russian basically. russian peacekeepers had been keeping the region safe. armenia had previously had a russian alliance -- a military alliance with russia. and now they are talking about leaving it, the russians are saber rattling over this. help us understand what is going on and whether that would be a right move for russia. >> we saw images from there yesterday because there were u.n. peace keepers allowed in and it is like a desert town. there is no one there. so it was extraordinary to sort of see that. there wasn't really much that they could discover. we know that all those armenians have left. and we know that this probably wouldn't have happened if armenia hadn't shifted its focus from russia to the west working much more closely with america and western nations. because when those were forced out, russians didn't prevent it from happening. what does it mean for armenia now? thosele politicians that are pro west are probably going to say russia didn't protect us, we need to move much more closely to the west. meanwhile as you are right to point out very little skirmishes across the border between the two countries, the concern is that if that blows up and other nations that have a role to play here, russia and turkey might get involved in that, we're a way away from that, it is pretty contained at the moment, but we'll have to wait for any further skirmishes on that border. >> as well as humanitarian -- obviously 100,000 refugees, quite a thing to deal with. max foster, thank you very much. a congressman comes face-to-face with three armed men on the street right down from where we're sitting right now. what his office said he had to give up last night. and missing 9-year-old found and a specific in custody. police tell us what happened. just ahead. o the man's camper. charlotte was found hidden in a cub board. she was taken while k56r78ing with her family on saturday. and congressman henry cuellar is unharmed after a carjacking in sweouthwest d.c. he was parking his vague when three armed attackers approached him and stole his car. it was later recovered. capitol police are investigating. and illinois' governor demanding the federal government step up action on the border crisis. in a letter jb pritzker pressed president biden to act saying that the situation is unten only, this as hundreds more migrants arrive in chicago from texas every day. let's get now to weather. record-breaking heat over the midwest and south spreading across the northeast in of course october. let's go to derrek van dam. good morning. always wonderful to see you. i want to put my summer clothes away. you can please tell me when i can do that? just did. all right, good morning, thank you for getting up early with us. i'm kasie hunt. wonderful to have you with us. it is hoist speaker kevin mccarthy's move. matt gaetz made good on the threat to try to oust him from the speakership on the house floor. >> i have enough republicans where at this point next week, one of two things will happen. kevin mccarthiment would be the speaker of the house or he will be the speaker working at the pleasure of the democrats. >> we could find out in a matter of hours. several sowses say mccarthy is expected to make a procedural move as early as today to try to kill the gaetz measure, the first stein of where his support lies or doesn't. mccarthy making a notable shift in tone yesterday. so earlier this month he was placating hardliners by green lighting an impeachment inquiry into joe biden. but yesterday suddenly a need of democratic help, he said this. >> i think this is about the institution. >> so it is up now to hakeem jeffries who has not played his hand yet. but jeffries' team yesterday did point to remarks that jeffries made on a podcast back in january. listen to this. >> once the house laelects a speaker, the house should lelec a speak for that term. that is my view of it. >> and some progressives are saying that they will vote to oust the speaker, but many rank and file members are holding their fire. would you be willing to help kevin mccarthy keep the speaker's gavel? >> this is totally up to our leadership. i expect right now hakeem jeffriesen and the other leaders are negotiating with him. if the good morning democrats save mccarthy, we'll have to have a rearrangement of the power structure within the congress. >> let's bring in jackie kucinich, political analyst and from the boston globe. never a dull moment on both of our former everyday beat. we've not seen anything like this play out in modern times. but let's talk about where the democrats are right now. i thought it was so interesting that they pointed to that hakeem jeffries comment that said the speaker gets elected for a term. it is a very strong suggestion that jeffries is potentially looking to find a way to keep kevin mccarthy hanging on to that gavel. what are the calculations behind the scenes? >> i think it is one thing to find a way, it is what you get for it i think that is really the open question. because it doesn't seem like democrats are just going to capitulate without getting something in return. you heard congress one alexandria ocasio-cortez say that on sunday. you also heard nancy pelosi say that they will follow the leader and really wake in lock step with whatever hakeem jeffries decides that they should do. there is a meeting dade. i bet we'll know more after that later this morning. but you're right, i don't think that anyone wants to see this chaos. on the other hand, the other argument among democrats is why would they reward some of the other things mccarthy has done like, i don't know, impeach the president. >> right. and that -- i keep coming back to that decision. for people who have been paying close attention, we're doing this day to day, but i think in the big picture a couple weeks ago kevin mccarthy was trying to placate the hardliners, trying to avoid the situation. and one of the things that he did in 9 context of being that version of kevin mccarthy is green light the impeachment inquiry over the objections of moderates inside his party so that didn't work but he made democrats angry. gaetz saying help me dethrone kevin mccarthy essentially. where are progressives going to come down on this, will they follow the leader or -- i mean, there is 100 or so members in the progressive caucus. >> i think it is an open question. and not only launching the impeachment inquiry a few weeks ago. just on sunday you heard democrats not be too happy with kevin mccarthy going on the sunday shows and blaming the democrats for almost shutting down the government when it is obvious that it is his own party that got the congress to the brink. so he hasn't really been cultivating that side of the aisle at all. matt gaetz as you rightly point out has been reaching out quite a bit to progressive democrats. but again, i can point again to what congresswoman ocasio-cortez said that her vote is not for free, that they won't just say that being on, whatever you say, sure, we'll keep you in power for the good of the institution as mccarthy decided to pull out yesterday. >> such a cliché. politics ain't a bean bag and they won't give something for free. down to like brass tacks of this, what are the options, like what are the things that democrats could demand in return for having a handful of them assist kevin mccarthy in surviving this vote? i mean, i've heard things along the lines of we use the phrase rules committee. you and i understand that, but for people who don't cover congress every day, that means who controls the house floor and how. it sounds like there are some changes potentially in the works there. what is on the table? >> you mentioned the rules committee. it sets the rules that the house is governed by. it is how things get done. >> power. >> yeah, when the c-span cameras light up, that is what sort of starts it out. that is go. the other thing is reordering how many people are on other committees, how much power democrats would have on committees are two of the things i've heard about. but if kevin mccarthy it that, he would have that kind of rolling like caucus and we haven't seen that for quite some time. and it probably would set him up for another one of these. just because gaetz is filing it now doesn't mean someone like chip roy who is not on board with this particular one but said that if ukraine funding is back on the table on sean hannity's podcast, then the gloves are off. so even if kevin mccarthy survives this one, he is not out of the woods. because they could also change the motion to vacate, they could make it harder for the motion to vacate to be enacted. that said, this also would open up mccarthy if he doesn't do that. so he is not out of the woods even if he survives this. >> it is really -- everything comes home to roost for republicans and mccarthy. he has to deal with what is left. jackie kucinich, thank you for being here. up next, donald trump expected back inside a new york courtroom at 10:00 a.m. this morning. this is going to be the second day of his civil fraud trial. he is accused of in-234r5i9ing the value of his assets by billions to banks and insurers. monday his former long time accountant testified that financial statements would not have been submitted if the numbers weren't verified by the trump organization. let's bring in former manhattan rai prosecutor. jeremy, thank you for being here. trump's appearance was voluntary. he did not need to be there. this is an ice serious day but it became a trump focused spectacle. and in a press conference with reporters, trump be rated the judge and the attorney general and that was before he even sat down. he complained about being there even though he did not have to be there. this was clearly meant to be part of his political campaign. so the question, what bearing does it have on the legal proceedings at hand? >> running your mouth if that is what you want to call it, and i say that not in the courtroom by an attorney who is maybe taking some liberties and telling a story and telling a narrative, quite different. and donald trump as people routinely say is his worst enemy. but at the same time we believe that the court is not going to say, you know what, i heard what happened outside the court, so therefore i'm going to hold it against donald trump. but it is a bad move, bad form and just basically another effort on his part to campaign. >> yeah, it is -- i mean, as a political reporter, i found it rather stunning. he gets off the plane from iowa, goes to this. not sure these courtroom pictures help appealing to independents. but you are obviously the lawyer. one thing that is on the line for trump is his businesses, whether or not he can continue to have these iconic businesses continue to operate in new york. and some of my sources have said that is part of why we saw him do what he did yesterday. i mean, what is a future al risk fundamental risk to the trump business empire here? >> well, it is significant. i said to one of your colleagues the other day, he is a desperate man and these are desperate circumstances. and i think to a certain extent he is reacting to that. though trump doesn't necessarily play by any rules, but that said the law applies to him no matter who he is. so there is a chance oas we've heard setting aside $250 million in fines, his ability to practice in the state of new york and have his business go and thrive and access banks in the state of new york and just conduct business in the state of new york is going to be potentially just cut off. and it is not just for him, it is for don jr., for eric. so there is real significant exposure for the former president. >> while i have you, i also have to ask you about the other legal matter unfolding today which is that hunter biden, son of the sitting president, is set to be arraigned on federal gun charges. first time the child of a sitting u.s. president has been charged like this. what is the significance of what we'll see today? obviously the previous plea deal collapsed. >> i think that it will be boring. it won't be the trump spectacle. i don't expect hunter biden will rant and rave outside the courtroom. it will be an arraignment, it will be pleading not guilty and then the case will be adjourned. i don't think that it will be that exciting. we've already learned from his attorney some of the issues that he will raise and i think some are very fair. there is questions about whether some of the prior agreement is still in place. there are questions about who gets charged with this crime from five years ago and the statute actually challenged constitutionally. so it won't play out now, it will be fairly mundane and i'll use the term boring. just pleading not guilty. but i expect over time as it heads towards a potential trial there will be a lot more interesting fireworks. >> and we should note that hunter biden's lawyers tried to ask the judge if he could do this remotely, and the judge said no, no special treatment. you got to be here. jeremy, thank you for being here with us. up next, gavin newsom's choice for the late dianne fein feinstein's senate seat. what it could mean for next year's election. you're probably not easily persuaded to switch mobile providers for your business. but what if we told you it's possible that comcast business mobile can save you up to 75% a year on your wireless bill versus the big three carriers? >> it is interesting. there is sort of this gop primary general election divide. as he is going through this primary, he has told voters from the beginning that his legal troubles are a result of the political establishment trying to silence him. and by silencing him, they are also silencing the rest of the trump supporters. and we've seen republicans or anti-trump groups that do the focus group, they say they are hearing that republican voters feel like they are under attack and they also feel like if they are doing all of this to trump, it is because he is the strongest person to challenge joe biden in the general election. but then you get to the general election and like you said, this won't play the same way. this is a former president who is facing multiple civil and criminal cases and this is going to be something that voters are really going to have to think about if he becomes the nominee as all the polls seem to suggest. >> how much of this do you think was personal for the former president? i know we've been reporting here that that did have a lot to do with it, this of course is about his personal brand. trump tower is on the line. >> yeah, even before he ran for president, trump was known as a businessman, in pop culture, he would have these movie appearances and he was known as a successful businessman and he runs for president and now someone would say no, trump is not this successful businessman, that he's a fraud, that he is a liar, that he inflated his wealth and everything that he sort of portrayed himself as for going back decades has all been based on misinformation and lies. so i think that is very personal when it goes to -- because it speaks to everything he's told voters and americans that he's been for decades. >> so let's check in on trump's rivals for the republican nomination for a second. he has been very dismissive of them and the reality is that polls show they have all struggled to break out. but now as we're within the window to start -- voters will be voting here in just a couple of months now in iowa and new hampshire, ron desantis, florida governor, has long been considered the chief likely rival to donald trump. he did not perform as well as expected. and in this hour of the campaign he has started attacking donald trump. he has made these attacks a little bit sharper in recent days. take a look at what he had to say. >> i indepunderstand one of my residents was here earl why saying that he turned florida red. all i will say is ronald reagan made the point there is no limit to what you can do when you don't care who gets the credit. i just wish if he was the one that turned florida red that he wouldn't have turned georgia and arizona blue because that has not been good for us. we need snab can serve two terms, we need somebody that can win states like georgia and arizona which president trump condition do or did not do. with all do respect to donald trump, we won't beat the democrats by adopting joe biden's basement strategy. >> arit, i keep wondering what if he had done this right after he announced his presidential campaign saying to people he won't win, he won't become president, i might be able to win, i feel like we might be in a totally different place. but still interesting that gaens desantis is doing this now though. >> it is down to the wire. if not now, when. and i think you're right, the electability, that is the argument because you look at the policies and all these other republican candidates are running more or less on similar platforms and a lot are either endorsed by trump in the past or supported him or are part of his cabinet, part of his administration. so how do you tell voters hey, we all supported trump in 2016 and 2020 and now he's still running. you can still vote for him. and a lot of these voters think that trump can beat biden in the general election. so how do you tell them, hey, maybe you should think about someone else, maybe you should look at me. and i think that this idea of trying to attack trump on electability is also a lot safer than attacking him on the legal cases, on his perpersona. but not clear if it is too little too late. >> well, we'll see. that question is about to answer itself. certainly there are a lot of arm cl chair donors for example who think that may be the case. arit john, thank you for your time. up next, a congressman attacked in an armed carjacking in washington, d.c. welcome back. new york giants laid another egg in primetime. sorry bruce, our producer. this time against the seahawks. coy wire has the "bleacher report." good morning. >> good morning. i didn't know seahawks eat eggs. they just gobbled the giants and everything they put out there on that field. giants are without saquon barkley, they just gave daniel jones a $160 million contract but they can't protect him. seattle's defense sacked jones 11 times. this after he was sacked seven times in the opener against the cowboys. seattle's rookie quarterback devon witherspoon had two of those sacks and snagged his first career interception. 97 yards to the house. seattle wins 24-3 in a blowout. thankfully on the manning cast will ferrell livened things up by teaching eli how to perform one of his famous lines from wedding crashers. >> there is some rage behind it. this guy had some rage. it was more like meatloaf! >> but a little more brow. mom, meatloaf! >> mom, meatloaf! >> whey did you drag it out?
