But donald trump is casting the shadow that leaves his rivals in the awkward thinks of Shadow Boxing trying to explain how they would score points against terrorism if trump if he were there. I think he owe it is to show up, articulate his record, what he would do going forward. And hes not willing to do that. Ron desantis there telling fox that he would highlight trumps unkept promises from 2016 including the border wall, eliminating the National Debt and draining the swamp. Trump himself will be Counter Programming the debate with a speech to union workers. All this just one day after President Biden walked a uaw picket line. He raised a few eyebrows when he answered yes when asked if the striking employees should get the 40 raise that they are demanding. Just a day earlier the white house stressed that the president was there to show solidarity not to get into the specifics of the unions fight with carmakers. He is standing with the workers. Were not involved in negotiations, that is something for them to decide. President s of course have traditionally tried to stay above the fray in labor negotiations. Lets bring in isaac dovar who reports prime minprimarily on d but politics in general. 2023 has been unpredictable. Can we talk about those pictures of the sitting president talking to autoworkers . He talks about how hes the most pro Union President ever. He does not seem happy stance that he showed up in michigan which we know will be a state that there is a lot of focus on, a state trump won in 2016 and that biden carried by a size only margin in 2020. Not a huge margin. Trump going back there tonight as part of the fight in 2024 happening already here now in september 2023. Yes, trump of course trying very hard to project himself as inevitable nominee. And you had a piece published three or so minutes ago and you are writing about a new strategy biden has. As we know from the polling, that people are concerned about President Bidens age. And what it would mean should he get reelected, he will be obviously considerably older than he is now. But he has a new strategy here in trying to deal with it. And i think that we should point out they havent really been dealing with it at all, but now hes using some humor. I want to show everybody one of the quotes that you included in your piece, i wanted to see the video of it and then im hoping that you can explain some of this to us on the other side. Watch. I remember when i was young, we have something in common, i got elected to the senate when i was 29. Only difference was he was eligible when he got elected to take office, i had to wait 17 days to be eligible. That was 827 years ago, but it was a while. And of course standing next to Maxwell Cross who is the gen z person elected to congress. What does this all say to you . Joe biden is old. Just a fact of things. He is the oldest president ever. And he has been sensitive about that fact in the past. As we all are. Sure. And he has been sensitive about it i should say for many years. But one of the things that he is grappling with obviously going into the election is how voters will feel about that. Some advisers have said to him, look, one way to do this, to deal with it, is to make light of it a little bit. Make a joke of it. You see from joe biden coming out more and more where he is behind the scenes often in terms of his sense of humor. He has a sarcastic cunning sense of humor. Ive heard it, you see it pop out over the years some, but it has been showing up a lot lately and one of the ways that he is doing it is to try to diffuse the age questions a little bit. He is referring to hes been around for 800 years, he said last week at a fundraiser i know i dont look it, but i started when i was just 30 years old. This is all trying to take this and move it slightly from the center of peoples minds. And it strikes me that i think one of the things certainly people i talk to this democratic circle, when they hand wring about the age stuff, partly they felt as though the white house was just ignoring it, getting angry at people who brought it up, trying to pretend it didnt exist. There is something that feels more authentic about them actually being willing to say yeah, okay, im old, it is funny, lets move on. Do you think that is part of the calculation too . Because i mean, i do think a lot of people raise questions about the inso he rarity about the Biden White House and how they are defensive about this. R the Biden White House and how they are defensive about this. This is not big Innovation Politics that authenticity is something that people look for these days. But joe biden, that has been a strength of his. People feeling that he is being just a regular joe as he likes to say. This is maybe a way to that in some peoples minds. Some of the people that i spoke to about this felt that way. Brendan boyle, congressman from philadelphia said to me that is the authentic joe, that is the joe that he has seen behind the scenes making jokes about things. But again, he is old as just a matter of fact. And so not letting it be this giant looming subject that nobody can really talk about is part of what is going on here. For sure. Meanwhile the list of lawmakers calling for the new jersey democrat to resign has grown to include at least half the Senate Democratic cause causes. Among them cory booker. What is wrong with you guys . What is wrong with you Guys Menendez says in case it was hard to catch him there at the end. Four codefendants, his wife and three of the new jersey businessmen also named, they will appear in court today. With the Government Shutdown looming now less than four days away, House SpeakerKevin Mccarthy says the house will consider a Stop Gap Funding Bill that includes money for Border Protection likely today. Mccarthy says the republican controlled house will consider the stopgap. They are called continuing resolutions, or crs in the jargon of the hill. And he will consider it whether or not gop leaders are sure the votes are there to pass it. Ill bring up the cr regardless. Remember what it is. This is a Stopgap Funding to keep government open and securing the border. I dont know that anyone is opposed to that. I think that is where people would want to be. Mccarthy there essentially daring his hardline republican members to vote against the measure. Mccarthy dismissed a Bipartisan Senate version of a Stopgap Funding bill floated yesterday. He said, quote, let me know when they actually pass it. Dont forget those hardliners have been more than willing to embarrass Kevin Mccarthy publicly. So something to watch on the house floor today. And what the analysts are telling us is that there is a shift in dynamics there. Imagine that armenia traditionally a russian ally has been upsetting russia recently. Russia has been talking about these unfriendly actions of armenia. So armenia has been sending aid to ukraine. It has hosted u. S. Troops for exercises. Also signed up to the International Criminal court which would mean if President Putin ever stepped foot in armenia, they would have to arrest him. None of these things have been, you know, welcomed obviously in russia. So analysts are suggesting that azerbaijan is seeing an opportunity here to go in, clean out armenians, Ethnically Cleanse is the accusation, and then they would have no response from russia. So they saw an opportunity here and indeed that has happened. Russia has not stepped in to prevent it from happening. And that is such important context. Essentially russia had been a Security Guarantor for armenians in this region. And so with them essentially throwing up their hands, you are left with this really difficult situation. And were seeing increasing calls for western countries to Pay Attention to what is going on. You saw the white house put out a statement yesterday talking about this and about western and american support for those who are fleeing. And of course there is a really dark history here for armenians in terms of whether they have been protected or frankly not protected by the western world. What do you think the imperatives are for supporters of freedom, democracy and human rights . Well, in a way it is contained at the moment because this region is recognized as part of azerbaijan. So while contained, it is difficult for other countries to get too involved as it were. Americans are clearly concerned about the humanitarian crisis, Ethnic Cleansing happening there. They want to send in observers. They are also frankly behind the scenes concerned about It Flaring Up into a wired war. But without russia getting militarily involved, that is not scenes as too much of a concern. But you dont want a situation where the Armenian Military is fighting the azerbaijan military and then another war escalating on the edge of europe. Such a good point. We love our night owls on the west coast, dont we . About 2 30 in the morning there. If they are tuning in, they will see the rainfall and they know it is falling outside their houses from seattle southward into portland. This is the second wave of what we call an atmospheric river, just a river of water in the sky basically producing some rainfall. But what is abnormal about this, it is occurring in this time of the year. We typically get these types of Weather Patterns into the winter. So what were looking forward to is that this could bring an end to what we call the fire season throughout the pacific northwest. And very defined low Pressure System on this Water Vapor Satellite Imagery and that is what is suspiciousing in all the moisture from the Pacific Ocean and centered itself across the State Of Washington and oregon. And much needed rainfall as well. In 39 hours, seattle has received just under an inch and a half of rain. But the entire summer were talking june to september 22nd, we only had about an inch of rain. So we want to see it, we want more of it. Seven candidates not named donald trump will take the stage at the Ronald Reagan president ial library. It is a storied venue that celebrates a man venerated, all but enshrined really by republicans for decades. The man who told gorbachev to tear down this wall, a man who now finds his brand of politics distinctly, well, over. Passe. Old fashioned. Yesterday reporters asked me if i thought President Putin was smart. I said of course hes smart. To which i was greeted with oh, that is such a terrible thing to say. Yes, hes smart. Those comments with are made just days after Vladimir Putins russia invaded ukraine. As noted, trump who is not terribly welcome at the Reagan Library quite frankly wont be on the stage and some of his rivals have started to take him on more directly than they did earlier this year. But is that too little too late for them . Joining us now, elalayna treene. So grateful to have you. Lets talk big picture. We have seen candidates like ron desantis for example take on donald trump in ways that he wasnt willing to at the beginning of the campaign. What do you think well see from him, from others, tonight and does it matter since trumps not going to be there . Right. Well, great to be here with you, kasie. And i do think that youll see a lot of the candidates directly attack donald trump. Of course at the first debate very few questions were about the former president. And many of the candidates were still skeptical going after the former president , attacking him, because they are afraid of alienating the gop base. But you have seen in recent weeks a lot of the candidate, ron desantis but also nikki haley, senator tim scott, starting to take on donald trump directly. Listen, you are totally right, i think this debate is going to be missing the frontrunner star power just like we saw with the first debate in august. But it is going to be deeply consequential for a lot of these candidates particularly as a lot of Republican Voters as well as these big donors are looking at who is going to be the republican candidate that they are going to coalesce around to be the trump alternative. For months now that has been ron desantis. But in recent weeks, he has been faltering in the polls. And you have seen people like nikki haley beginning to gain ground particularly in the early states. And that is another big thing that is weighing on these candidates minds, the timing of this debate. One, they want to impress donors and voter, see a fresh cash infusion for the end of the year, but they are also very worried about the upcoming primaries. They are right around the corner and how they perform in those early states is really going to be make or break for them. So they know this is the best opportunity to gain a lot of coverage, attract the Media Attention that some of them have been lacking. And see if they can become really that second tier candidate versus donald trump. Because as we know the narrative of this race is pretty much locked with trump as the frontrunner. But something unexpected in iowa or New Hampshire could change that narrative real fast. Expectations or pressure really is on ron desantis. Nikki haley has a pretty nice opportunity i think as you laid out there. But lets talk a little bit about trump since obviously frontrunner, he is missing. You have new reporting coming out on the strategy and the thinking behind what they are doing, which is to send him to detroit to talk to these union workers. Right. I think the interesting thing is not that donald trump is giving the speech tonight, but the really the politics of it all. He of course is continuing to by pass these debates and really try to frame the narrative that he is leaving his primary challengers behind him and trying to set up a trump verse biden rematch. We know that he wants to make it looks like it is a General Election fight, that he is not even a factor in the primary. He is already winning it. And i do think what is interesting is where hes going. So he will be talking to a lot of current and former Union Members including those who are on strike in the uaw as well as autoworkers, plumbers, lesk tr elect electricians. They will be in the room tonight. And Trump Campaign advisers say they see an open with these members. Yes, President Biden is the one who is known for and labeled as pro Union President. But many of the voters in the room are people that supported him in 2016. He won michigan in 2016. He lost it to biden in 2020. And so this is a Voter Coalition that he is really wanting to break through in. Particularly around the Working Class voters. And you will hear him talk a lot about attacking joe biden on his policy on electric vehicles, jobs that he thinks will be lost. We see the increase in production. And one thing that i find interesting about the speech as i talk to many of trumps allies and gop strategists and they think that this speech and what he is doing tonight with the Counter Program event is far more effective than the first event Counter Programming with the first debate which was to sit down with tucker carlson. Here he will be on the road, talking to voters that he knows he needs to win over to win in 2024 and they think that is a far better strategy than sitting down with a conservative former fox news host. The audience is completely different, right . Tucker carlson makes sense if you are running in the prp primary. But if you are trying to show that you are running in a General Election, voters that you need in a General Election are by and large independent voters. Your point about the appeal that trump has to some of the workers is very well taken. I remember 2020 was an odd campaign because of covid, but back if 2 in 2016, i spent a to time in union halls you can sometimes there covering republican candidates but sometimes i would cover Bernie Sanders and a lot of voters would telling me i like Bernie Sanders, but if is he not going to on get the nomination, i want to vote for donald trump. And that sentiment i think still very much exists and clearly the Trump Campaign is seeing. Alaina train,een, thank you for being with us. A new york judge finds donald trump and his adult sons liable for fraud canceling the Trump OrganizationBusiness Certificates. Saying that they lied repeatedly about their net worth and assets to banks and insurers for years. This is a key ruling before the 250 million Fraud Lawsuit against trump goes to trial. Lets bring in criminal Defense Attorney and former federal prosecutor. Katie, thank you for being with us to help us understand this. So this judge made a very unusual decision in this and i think that people who are watching this closely didnt expect the judge to go as far as he did with this ruling. Can you explain to us what happened . Because there is still going to be a trial, but this ruling was a choice. Why . Yes, it is very interesting. And this ruling that essentially found the judge determining that the Trump Organization and the defendants that are named in that lawsuit committed fraud in their Business Filings as a matter of law. So the filing was really a pretrial request by both the Trump Organization and by Latitia James and Attorney Generals Office to determine some issues before trial that wouldnt have to go before the finder of fact. One of those issues according to the judge was whether the Trump Organization and defendants had he committed fraud in their filings as a matter of law meaning that there was nothing for any sort of firnd onder of to determine. So even though the case is still scheduled to go to trial, that issue has been established by the judge. So essentially trump and the other defendants Cannot Relitigate whether there were fraudulent filings. And so of course that is being appealed. But that is very significant finding pretrial in this case. And the reality here, there is a big impact on trumps businesses. Those Business Certificates have been canceled now. And my understanding is a judge is going to name somebody that is going to manage the disillusion of the entities which is kind of a fancy way of saying that they have to disband all these llcs because they no longer can legally exist. I mean, does it mean that donald trump and his kids simply cant do business in new york anymore . What is the implication . Well, according to the judges ruling, essentially because he found that the fraud had been committed as a matter of law, automatically that entitled Latitia James to seek the cancellation of those Business Certificates. So i would anticipate that there would be an appeal and that there would be a request for an injunction pending a decision of Appellate Court before it goes into effect. But unless or until a hire Court Decides otherwise, that decision is binding and those Business Certificates are canceled. And whatever that means in terms of who runs the business, it cannot be the folks that were named in that lawsuit. So absolutely very significant and farreaching decision at this point. For sure. There are a few that are raising questions about his conduct but still stopping short of calling for him to step down, among them joe manchin of west virginia. But a funny thing is happening here. Something we hardly ever see in our divided politics. Republicans are defending a democrat. Arkansas senator tom cotton writing, he should be judged by jurors and new jersey voters, not democratic politicians who new view him as inconvenient to their hold on power. Marco rubio tweets in America Guilt is decided by a jury not a party in fear of losing their senate seat. And Kevin Mccarthy reversed course and said he should have his day in court just like george santos. I think george could have his day in court and menendez can have his day in court. Why call for him to resign . It can be his choice. His choice. A lot of ground to cover with my next guest. Former secretary to jill biden an special assistant to joe biden. Thank you for being with us. You of course have been around this town a while, youve been in the white house a while. Senator menendez has obviously been in these legal sticky situations before. He did survive, but those pictures have all these democrats saying, you know, what get out of here, they know that they will spend many more millions of dollars defending that seat as well. Senator John Fetterman was the first democratic senator to call for him to step down. He explains why here. Take a look. It is black and white, it is so clear. Last time there has ever been a man with so much cash in their home in new jersey was tony soprano. You know . I mean, it is not a close call. He is entitled to have his day in court, but is not entitled to remain in the senate. And he needs to go. Michael, where is the white house on this and are you surprised that it is republicans that are coming to his defense here . No, not really. Only because i think that it is a tough circle to square for everybody. But they really have no incentive to go for menendez. Look, it is really not a competitive seat. That is why you are seeing republicans do it. Plus their own president ial candidate or likely nominee donald trump has four indictments under him. So it is sort of expected from republicans, you know. With democrats, all due respect to senator fetterman, many people were calling him to get out of his race too. But we let the voters decide. And ive been sort of the same way about how i feel about sort of the aging senators as well. It is really the voters have the Information Available to them. And the voters of look, bob menendez, if you know anything about the menendezs in new jersey, he is one scrappy fighting politician and has a very loyal base in northern new jersey. He will stay on to the very end. But it is really going to be a primary that will probably be the thing that will force him out. That makes sense. And he already does have a primary challenger out of the new jersey house delegation. And i understand the political comparison you make between fetterman and menendez. There is a big difference between a Health Challenge and a federal indictment. Sure. And the same thing with aging too. And im not defending any of the charges against menendez. But from a political perspective, you know point taken. I think it is best left to the voters to decide. And i want to note for our audience that in the past youve served as paid adviser to a super pac that was helping defend hunter biden publicly. But i do want to ask you about the latest out of this republicanled House Oversight committee investigation. They subpoenaed a bank to get Hunter Bidens records. And what they got, we havent actually seen the wire transfers, but they say that they got two wire transfers from chinese nationals to hunter biden, notably in 2019, joe biden obviously was not president then, but these wires listed President Bidens delaware home as the beneficiary address. And the first example is that the panel found of hunter receiving money directly and not through a shell company. Were still obviously learning a lot about this and again, we should also note to our viewers that hunter biden did use this address as his residence during this time. But the reality is, i mean, this looks bad. Well, i dont know. Im not a lawyer. But what you are saying is that hunter biden who had a job, received money for doing that job, while his father was not a paid Public Servant . In the private sector . Im sort of not understanding the crime or high crime and misdemeanor that republicans are alleging even here when it comes to what hunter biden did or what he received while he was working in the private sector. Yeah, look, i think that we continually note when we cover this story that there has not been any fire shown around the president himself even as they are investigating hunter. But it does seem a little bit tricky. Republicans lets look at it politically for a second. I know youre not a lawyer. Neither am i. Yeah. What they are trying to do from a political perspective is creative enough smoke that President Trump on the general Election Campaign trail can basically point to it and say, oh, you think i did bad things . They did bad things too and essentially try to neutralize the explain indictments against him. Is that working . Except hes not really saying they, he is saying that guys son, the son of my opponent. He is not going after his opponent, his but are voters buying it is my question. No. Are they convincing voters that they should be stressed about it . The answer is yes, voters buying it because you are seeing it in not one poll but every poll. And that is a political problem for the white house. It is a Reputational Problem for joe biden. They need to start confronting it. As you were talking about earlier in the show with his age, finally they came around to sort of acknowledging shining a light on their problem, shining a light on their weaknesses and turning it into a strength.
