i'm david culver. we start you off with news out of the white house which says that jill biden has tested positive for covid-19. the first lady spokesperson adding that she is currently experiencing only mild symptoms she will remain at their home in rehoboth beach. the president tested negative. and mr. biden who is 80 will be tested regularly this week and monitored for symptoms. u.s. officials say north korean leader kim jung-un expected to meet face-to-face with vladimir putin to discuss possibly selling weapons to help russia in its war in ukraine. you are looking at footage from previous meetings they have had. a national security council spokesperson urged pyongyang to cease arms talks and stick to its promises not to sell arms to russia. kristie lu stout is live in hong kong this morning. good to see you. so do we have a sense of when or where this in-person meeting between kim and putin might actually take place? >> reporter: we do. according to reports it could take place sometime this month. this is according to the u.s. national security council. they are expected to discuss potential arms deals for russia to get more north korean weapons to use against ukraine. the timing from what we're hearing is unclear, but it was the "new york times" that first reported about this potential meeting saying that kim would travel from pyongyang to vladivostok will he will meet at a forum to take place that this weekend. this is not far from north korea and also where the scene took place in 2019 where kim and putin met for the very first time. and kim made that skrjourney ons famous train, the armored green train. as for the new reported potential meeting, it is said that in exchange for weapons, what the north koreans want is advanced russian technology. technology for satellites and for nuclear powered submarines, also the north koreans desperately need food aid. this potential meeting would follow that recent visit by the russian defense minister who visited north korea in july. and this is also after u.s. officials said that the two countries are, quote, actively advancing their talks over another potential arms deal. last year the u.s. said north korea delivered rockets and delivered missiles into russia for use by wagner forces which was something that north korea has denied. now, both russia and north korea as a fact, they have been edging closer together. we learned that the russian defense minister says that joint military exercises with north korea are currently being discussed. and we also know that kim and putin have been quite recently exchanging letters to each other pledging to increase their cooperation. back to you. >> no doubt this is concerning for u.s. officials, but you have to believe that beijing is watching this closely as well. we appreciate your time this morning. good to see you. just hours from now, the impeachment trial of texas republican attorney general ken paxton begins in the state senate. the fire brand conservative was impeached by a rop controlled statehouse. but as ed lavendera explains, paxton's strategy for keeping his job relies on claiming the impeachment is a part isan witc hunt. >> reporter: ken paxton showed up at a rally to kick off his wife's state senate re-election campaign. >> please welcome to the stage my husband, the love of my life, my best friend, texas attorney general ken paxton. >> reporter: the suspended republican attorney general was impeached on 20 articles, including charges of retaliating against whistleblower, abuse of power and bribery as well as misconduct involving an alleged affair. paxton used this moment to pound the theme that he is the victim of a political witch hunt. >> if you kind of kept up, you can read that i'm responsible for the jfk assassination and for 9/11 and everything in between. >> reporter: paxton's impeachment trial begins tuesday in the texas state senate and it features some of the highest profile and unique legal characters in the state. paxton is represented by dan and ton any and they say it was a drive-by shooting. >> this was a sham. >> to say this case is not about politics has the credibility, believe ability and sincerity of the fellow that is trying to convince his wife that he goes to the strip joint for the food. it is not about the naked women, sweetheart, it is about the food. nonsense. it is definitionally political. nonsense. >> reporter: prosecuting the case against paxton are the legendary rusty harden and dick degaren. for decades they have worked the biggest cases in the state. a few months ago when paxton's lawyers ripped the process, cnn asksrousdy harden to comment and he referred us to this classic scene from the com it i "my cousin vinnie." >> the guy just says [ bleep ]. >> 121-23. and paxton is vowing political retribution against those republicans. >> let's clean house. >> reporter: there are 31 state senator, one is angela paxton, the attorney general's wife, but she will not be allowed to vote on her husband's impeachment. there are 12 democrats in the senate and prosecutors need 21 votes to remove paxton from office. the question is, whether nine republicans will vote against paxton. veteran republican political strategist brendan steinhauser says that it is not clear how this trial will play out. >> there is a lot of political pressure coming from all sides. this is unprecedented so they are trying to do their constitutional duty, trying to do legally, morally ethically right thing. they don't know what that is yet until they dive into it and see the evidence. >> reporter: paxton has enjoyed support from donald trump and among republican voters. >> is he a great man. >> reporter: steinhauser says paxton is benefitting from tumpg's attacks that the justice system is weaponized against politicians like them. >> that alignment is important for paxton because it helps him, gives him some political support among grass roots voters apz and activists in the republican party of texas and makes it more difficult for state senators and state representatives to impeach and then convict him. >> reporter: when proceedings begin tuesday, there is a chance that the majority of articles of impeachment could be dismissed by a simple majority vote in the texas senate, but it is not clear if that will happen, if the impeachment trial moves forward, it is expected to last several week. ken paxton's lawyers say the suspended attorney general will not testify but impeachment managers insist that they will call him to testify at some point. parents as they head back to school here in the u.s. while some of the challenges schools faced in the middle of the pandemic have no doubt subsided, there is growing concern this morning about the learning gap left behind. according to research from harvard center for education policy research, pandemic-related learning losses are historic in magnitude and highly variable among communities. and while nearly all districts experienced some learning loss, the range of these losses were highly variable from near zero to an entire grade level. julia kaufman is a senior policy researcher and she like many are getting up early joining us. we appreciate it. so this is really quite concerning. and gis the question is what will it take to reverse the learning gaps caused by the pandemic. >> yes, great to be here. you know, as a parent myself, i can say in many ways public school feels like what it was pre-pandemic. kids are back in school, athletics and after school activities are happening, but there is a but. nearly all research tells us that the average student lost out about a half a year of learning in math and not as much but still substantive reading achievement losses. so they haven't made up that learning. >> yeah, and we're looking at this graphic here that basically shows for some of those students it will take several months to catch up. you are talking about 4.1 months in readreading, 4.5 in math. and a new gallup poll shows that only 36% of americans are satisfied with k through education quality. and that matches a record low from for ye23 years ago. but 76% were satisfied with their oldest child's education. but the view from americans might be negative when it comes to their own child's -- or really overall education, but when it comes to their own kids, perhaps mostly they are satisfied here, is that your take from all this? >> yeah, k-12 parents are satisfied when you ask them about their own child's education. but when you ask them about the quality of u.s. education at large, they are not as satisfied. only 41% indicate that they are satisfied. and when you ask all americans that same question, only 36% are satisfied. you know, i have a lot of sympathy for teachers. they have been working really hard to support students and school and district leaders have had to make so many hard decisions the past several years. but these data also suggest that public schools have a bit of an image problem which probably means that they need to think about how to communicate the challenges that they are facing and their decisions really clearly to a critical public because they need the public support do the best possible job they can. >> might sound like a strange question, but are there any positives that have come out of covid-19 and the pandemic when it comes to education, anything that has actually moved forward successfully? >> i think so. on one hand a lot of schools have had to go to remote learning and we know that that hasn't been good for kids. we know that they haven't learned as much and they have lost learning especially if they have been in the remote school districts. but at the same time, schools and teachers have learned more about how to use technology well. and potentially be more resilient if something -- a large shock to the system happens again. in addition, a lot of districts have been using funding to pry intensive tutoring, to provide extra periods of instruction, to provide summer offerings. but given these data, i think schools do need to do more. you can't accelerate learning at the level needed for full recovery doing what schools typically do. so they have to do more of what they have been doing as well as potentially think about other kinds of interventions to help students catch office to help a donor among many other accusations. jury selection begins today in the trial of former trump adviser peter navarro, he is charged with contempt of congress for failing to comply with a subpoena from the house january 6 committee. former proud boys chairman enrique tarrio will be sentenced this afternoon for seditious conspiracy connected to the capitol riot. prosecutors have asked for a sentence of 33 years in prison. so a lot of different legal angles to unpack and to help us get to it, we have a former federal prosecutor joining us this morning. she is also author of "a spy in plain sight." a few things to go through. we appreciate your help breaking this down for us. we'll start with what has been lengthy sentences for other proud boys ranging anywhere from 10 to 18 years. but prosecutors are seeking more than 0 years for tarrio. what do you think the liningly hood of that happening is? >> i don't think that he'll get the whole 33, but look for at least 18. the guys sentenced before him with the exception of david rhodes were mostly foot soldiers. they were carrying out the orders of the conspiracy. about enrique tarrio has been found guilty of seditious conspiracy. he was the chairman of the proud boys. he was not on the scene but he orchestrated it. only reason he wasn't there on the scene is because he had been arrested for burning a "black lives matter" banner. so this guy is looking at a harsh sentence, at least 18 years. >> a judge ruled last week former trump white house adviser peter navarro won't be able to argue that trump asserted privilege to shield him from a house january 6 subpoena. do you think this is a big blow to his defense strategy? >> absolutely. unless he can get the former president to come and testify and say at his trial that, oh, yeah, you know, i exerted executive privilege and that is why he didn't testify, unless he gets that, he is looking at he has no defense, right? because he can't rely on the executive privilege when in the face of the fact -- it is just a fact, right? it is a fact that he did not reply, he did not -- he is in contempt. so he has to -- he is on the defensive which is a little bit odd, but he is on the defense receive on this because the evidence is so strong against him and the only allegation that he can make is executive privilege and if the guy who apparently asserted it is not there willing to say that he did it and there is no other evidence of the fact, yeah, it is not looking good for mr. navarro. >> highly unlikely that touch will testify. >> yeah, a good bet. >> so let me get your take on the alex murdaugh case. his lawyers are filing a motion for a new trial based on what they call discovered evidence. so is it fair to say it has to be pretty substantial for this to even be considered here? >> you know, i think you've been going to night school here, law school, but you got it. it has to be material, right? it can't just be impeachment of a particular witness, it can't be cumulative. it has to be brand new and by the way, that it couldn't have been discovered by his lawyers before or reasonably discovered. and then the key is it has to be material, substantial as you said, and it really would lead to an acquittal. i mean, because courts don't want to go around willy-nilly just having new trials. so they won't do it unless they will say, look, this evidence had it been brought to the court, had it been brought in front of the jury probably would have led to his acquittal. now, you are talking about a guy who admitted on the stand that his alibi was a lie and there was a ton of other evidence around him. this is not an easy case. i mean, for the defense. so unless this is a slam dunk, a smoking gun, proverbial smoking gun, i don't think that we'll see a new trial. >> not an easy case, but one that has so much attention. and given that you are on my time zone, that is the west coast, i'm always impressed that you are able to bring the legal mindset and analysis this early your time. so we really appreciate it. >> just always churning in there. >> glad your is. thanks, lis. this morning police hoping the escaped prisoner danelo cavalcante will listen to one person in particular, his mom. they are broadcasting a message from her asking her son to surrender. officials say that there have been four sightings of the convicted killer since he escaped an eastern pennsylvania prison last week. brian todd brings us the latest on the manhunt. >> reporter: an escaped convicted mumurderer who police say they have had four incredible sightings of still remain on the loose. the most recent sighting of danelo cavalcante was on sunday when a state trooper had eyes on him. >> a trooper actually that observed him at some distance, gave chase but unable because of the terrain and some other obstacles was unable to get to him before he disappeared. >> reporter: officials say all four sightings of cavalcante have been within a 1.5 to 2 mile radius of the chester county prison which he escaped from on thursday morning. a residential surveillance camera picked him up at 1:43 a.m. saturday. emerging from a wooded area less than two miles from the prison. police say they have also investigated two burglaries in the area. while they can't confirm the burglaries were committed by cavalcante, residents nearby are getting increasingly nervous. lance says he returned from a holiday trip concerned about his home. >> want to make sure everything is clear and he is not hiding in our structure. >> reporter: and a new tactic from law enforcement, residents near the prison are hearing a message from helicopters and patrol cars, a message recorded in portuguese by cavalcante's mother from her home in brazil urging him to surrender peac peacefully. >> as desperate as he is, maybe he has a change of thought and hears his mother telling him to surrender and his family cares about him, he is desperate, he's hungry, he's fwbeen in the wood he's dirty, perhaps we can get a peaceful surrender. >> reporter: he was sentenced to life in prison without parole for the murder of his former girlfriend. prosecutors say they stabbed her 38 times in front of her two young children. and the motive, she had discovered that cavalcante was wanted for another murder in brazil. >> he has nothing to lose. he is looking at a life sentence without parole and he is out and has another taste of freedom. he won't want to give it up. so when squonomeone has a viole tendency that is a formula for danger. >> reporter: officials say don't play hero. cavalcante is extremely dangerous and citizens should not approach him. the pressure police say will come from them. >> i intend to stress him, i want to push him hard. he will make mistakes and show himself. he has already shown position we beli believe -- himself a few times and we'll eventually catch him. >> reporter: there is a $10,000 reward for information leading to his capture. pennsylvania state police say if law enforcement finds cavalcante and he is not actively surrendering, they are authorized to use deadly force. brian todd, cnn, washington. quick hits across america right now. six people are of hurt after a pier collapses in madison, wisconsin. 60 to 80 students from the university of wisconsin were crowded on to that pier when it gave way. more than 20 people hurt after a car crashed in to a denny's outside of houston. the 30-year-old driver of the jeep did not get hurt. the cause is still under investigation though. firefighters this california rescuing a driver trapped for five days inside a pickup truck that plunged 100 feet into a ravine near bakersfield. they used a human pulley system and a basket to raise the person to safety. russian president vladimir putin says he will consider reviving the black sea grain deal if restrictions on moscow's agricultural exports are lifted. but he is apparently working on a separate grain deal with turkey's president erdogan who he met with on monday. erdogan says that ukraine must soften its approach in order to work with russia. salma abdelaziz is joining us from london. ukraine's foreign minister reportedly called putin's statement classic blackmail. clearly there is a lot to parse through this morning. you can you help us understand what is happening here? >> reporter: what is important to know just in the wider picture here is president erdogan was a key meeting -- a key negotiator in the black sea grain deal that for months allowed tons of grain to be exported from ukraine to countries particularly across africa and the middle east and also you're on that europe. but that deal expired and collapsed over the summer. you have to remember president erdogan toeing the line, saying much of the grain, and again this is according to the turkish president, being exported to europe, he wanted to see more of it go to africa. and that ukraine was being too tough in its stance. putin you'll remember is blaming the west for the collapse of the deal saying that they did not see promises through particularly when it comes to russia's agricultural about ports. the bottom line to take away here though is that president putin seems to be acting unilaterally. he says russia is working on a deal to about port grain directly to six african states for free. now, unclear how that would happen or how that would take place. but what is important to note is that there is a little bit less urgency around this deal because global food prices have stabilized since the deal collapsed in the summer. still very important, you will remember the united nations a few months ago essentially accusing president putin of using food as a weapon. countries like egypt and somalia have seen inflation rates sky rocket because of the issue around grain and president putin continues to use it as a bargaining chip. you will remember many of those ports along the black sea, well, there has been an uptick in attacks on those ports, on those ports s s that export grain ha president 350u cputin negotiate deal. >> a lot of blame but not much movement forward. salma, good to see you. it is day two of the historic african climate summit. john kerry is joining heads of state, climate experts and industry leaders who gathered to raise africa's voice on the krk o climate crisis. organizers say that it is a place for climate investment. larry madowo is in nairobi. good to see you. so african leaders are aiming to address what are devastating natural disasters even though that their part in the human cause climate crisis is really minimal compared to wealthier countries. so how do they plan to address this? >> reporter: that's right, david. africa is only about 3% of global greenhouse gas emissions but the impact here is devastating. so these african leaders hope that they can convince the rest of the world why there is urgent need for financing for adaptation. and i want to hear from a leading environmentalist here with me. what is africa asking for? >> africa is asking for equal access and fairness to markets, to finance, liquidity, debt relief, knowledge, technology, a lot of baskets of things. but those are all part of a legal system to make a few things happen. two realities are happening at the same time. you mentioned one, the reality of climate change. we didn't cause it, we're suffering from it, we can't do much about it. but at the same time is the reality of a confluence of amazing opportunities. the youngest and fastest growing workforce. abundance of renewable energy and resources. our reality could be different. it is about unleashing the potential. >> reporter: john kerry just announced an extra $30 million for food security efforts. is this a droop ip in the ocean? >> it is something, but the speed and scale what have we need is huge before $500 billion in this decade alone. so we are far from close to it, but we need signals like that 100 times over. >> reporter: africans often claim that the global north often makes these commitments but the money never comes. is there a momentum here, is there a difference? >> i think africa is leading and that is a difference, but i don't see the same reciprocity from the north. that is why the climate justice movement is alive and well. we have to keep pushing for those promises made to be kept because we need both sides. we need the justice, we need the finance, but we absolutely have to have some agency and optimism. >> reporter: thank you so crucial. and obviously going to involve a lot of stakeholders to agree on things and as she pointed out there, a lot of money. $500 billion short. so we appreciate you keeping tabs on this and we'll look for your updates in the days ahead. civilian leaders of the navy, army and air force issuing a stark warning to senator tuberville. tuberville has been blocking hundreds of military promotions and this has been happening for months as a protest against the pentagon's policies easing abortion access for service members. right now three of the five military branches do not have a senate confirmed chief in place and instead they have acting officials. in a "washington post" op-ed, they say tuberville's actions are putting our national security at risk as acting fifb officials do not
