>> john, next up is to discuss the late zest is "boston globe" analyst jackie kucinich. i don't know if you have heard president biden's speech in philadelphia, and let me play a few clips of what he said. >> the last guy who was here, you were shipping jobs to china. now we are bringing jobs home from china. when the last guy was here, when the last guy was here, your pensions were at risk. we helped to save millions of pensions with your help. when the last guy was here, he looked at the world from park avenue. i look at fit from scranton, pennsylvania, and claymont, delaware. >> of course, scranton is about 100 miles away from philly, and is this a sense of what we will hear from the campaign and not leaning in from donald trump by name, but attacking the record of this guy this or that, and not from what i heard saying anything about the indictments? >> i mean, his administration has been steadfast on not addressing any of the indictments, because he wants to maintain that separation between white house and the department of justice which is traditionally before the trump administration was a thing that happened quite often, and that crowd in particular, the union crowd is a very key group for biden, and it is one that he is having trouble right now really hanging on to. he has a uaw president who is upset with him, and some of the regulations that his administration has been pushing, and there is a potentially a strike on the horizon or at least that is what they are threatening at this point. so, i think that not only is that messaging what you are going to be hearing, but a lot of messaging to the unions in particular, and what he has done for them, and tried to make their lives better is a constant theme that we will hear as we go into what is quite the election year. >> that is to say the least, jackie, for sure. circle back to what melanie zanona was reporting, the time is ticking to get this bill done, and lay out, jackie what is at stake here. >> i mean, so many things are at stake. no one really wants a government shutdown, and potentially maybe some of the more conservative members, but the government shutdowns are not good for anyone, and how the avoid one, and there is a bit of a difference of opinion. some of the things that kevin mccarthy is dealing with is his conservative members wanting to attach the culture war issues into the spending bills, and that going to be dead on arrival in the senate as well as at the white house. so, he is going to need to thread the needle. one of the interesting thins that is going to be, one of the interesting points that he is making or trying to make no members is that if they shutdown the government, they won't be able to move forward with the investigations into biden with the impeachment inquiry, and the government will be smhutdown an a fight over the funding and they cannot focus on these thing, and so he is trying to move forward with the governing which is a theme, and we have heard the music before with the kevin mccarthy show. >> so it sounds like he is trying to incentivize some of the hard-line republicans to get things done for the things they care about apparently. and the theme of funding is at the center of this, and the harline republicans want that funding separated from the aid to ukraine, but the white house and the dems see it necessary to get it done, and so what is the likelihood of that happening? >> i think it is anyone's guess, and again, this is another challenge for kevin mccarthy, but as melanie points out, it is potentially removing kevin mccarthy as speaker is hanging over his head, and when you have umpteen votes as speaker, there is always the motion to vacate to be trigger by a few members until we just got become to one. that is always going to be a concern of his and always going to p looking over his shoulder to limit what he is going to do and work with the democrats in order to keep the government funding and make sure that fema funds go through, and get the funding to ukraine which his membership does not want. >> and a lot at stake as he continues to do the dance as we saw with the ceiling deal. jackie kucinich, thank you. john? >> this morning, there is an intensification for the manhunt of a killer in pennsylvania. they believe it is within a two-mile radius of the prison he is being held. some residents expressing the outrage. >> and the fact that he is still out there after all of this time is insane. we thought it would be overwith after this time. >> and so a security camera at someone's home caught sight of him. polo sandoval has more on this. >> we are told that we can expect an update at 1:00 p.m., and along with the state police who is leading the way here in terms of the manhunt entering four days now that they have been searching for danil o k cavalcante. and this area is very wooded area, and they have searching the land around the area. and some background, he is accused and convicted of stabbing his girlfriend over 30 times in front of children. he he is still out there and about 5'5" and 150 pounds and dark curly hair. he had been sentenced to life in prison. >> any idea how he got out of prison? >> yeah, things are much better. all day yesterday, it was rainy and cloudy and as you can see now, the sun is out. this is exactly what they need for that very thick caky mud to dry up. we are right at the main entrance and exit to the festival. this is what they call the eight-mile playa access. behind me is an area that is muddy and wet, but as you can see in the images, there are many cars that are making way out, and in comparison to what i saw yesterday, there is less mud on those cars, and nonetheless, as people are coming out, they are honking and cheering and saying that we made it out, and that is because it has been extremely difficult over the last couple of days. i have talked to people who have walked for miles with their shoes wrapped in plastic bags telling me that the mud was just sticking on their shoes and making it very difficult to walk. other people have told me that they were trying to get out and the cars stuck for hours in that mud. so hopefully, that is not the case today. the shelter in place is still ongoing, and we are waiting to hear from the organizers, but i will say that people who have to leave are making their way out, and they are allowed to do so. i did see my first walker of the day with a suitcase. they are just trying to get a ride from whoever they can. look, they are not the only ones. the celebrities were going through it as well. deejay diplo had to get a ride with chris rock, and he was on cnn this morning and this is what he said. >> i am glad i made it out, but the people at burning man, the organizers were prepared and the first time in history that it rained in the festival, but it rains sometimes, and they are prepare for this kind of situation. everybody is having a good time, and people are making huge sculptures out of mud and continuing with the art. maybe they are there a couple of extra days, but they are having a great time. >> reporter: and just like diplo said, they were prepared for the most part, but the problem is that when you come here, you bring the exact amount ofood and water that you need, and if you are extending it by a day or two, you start to run out of water and food and fuel and supplies and this is a concern for a lot of people, and the fact that they needed to get out, and some people had to go to work for example, but people are positive, rahel, and saying that they are having a good time. >> it is interesting to learn about the burning man community and sharing food and resources. thank you, camila. and what is it like to be mud logged in the middle of the desert in a huge event like this? well, luckily, there is wi-fi and people have been sharing their experiences. >> everything is beginning to dry out, but the roads are still pretty sloppy and in bad shape, and definitely not okay to drive on. >> they are asking people to conserve the food and water and ration, and the problem is the port-a-potties are overloaded. and there is going to be a party tonight, because there is nothing better to do, and we are stuck. >> that is bobby white, and he is joining me now. bobby, you said that there is doing to be a big party tonight, and was there? if so, how was it? >> on saturday night, there were a few parties for sure, but a lot of the camps have started to close down, and especially last night, and there was not too much open last night. >> did it make it more fun? look, sometimes they say when it rains at a wedding it is good luck, and they just say it to make people feel better, but it can make people feel better and is there an element of truth in that? >> oh, sure. this going to be one of the years when you look back and say, oh, i was there in 2023. how was your experience with that? it is kind of a bonding thing, and that is kind of the whole thing about burning man. it is more of a -- it is the journey and not the destination type thingment and this is part of the journey. >> so, how muddy was it at the worst? >> well, you know, i have been coming to burning man for ten years now, and you have to be prepared for that, and even the slightest bit of rain makes everything super slick, and you can't ride your bicycle around, and that is how people get around out here, because the mud cakes up on the tires, and then it just adds up. then you walk around and your feet, you have five pounds of mud on the feet, and yeah, any little bit of rain, and it is going to make the playa untravelable, and you have to be eporaried for that. >> and i don't know exactly what it is that you are wearing whether it is a coat, blanket or shawl, but i know that it is very very white. there is not a speck of mud on that, and how have you kept it clean for the last several days? >> yeah. i don't know. i have had many people say that, and it is cold out here today, and at night it is pretty cold and i have managed not the roll around in it. and normally, i think that it is cleaner than it would be because of the dust normally blowing and catching and all of that, and there is no dust, because it is mud. so it is relatively clean, but at night out here, you have to be lit up, so it is a glowing jacket, because you can get run over by a bicycle if you are not lit up. >> you have chosen to stay, and so have thousands other people, and why? why important to be there until the end? >> well, i think that it is more of, i mean, i have the rv here, and other camp mates have rvs or rental trucks or things like that, and getting them out is basically impossible, and sure, you could have walked out, but what do i do with the stuff? the moment it started to rain, i think that most people here, they were just, you know, just accepted it. there is no reason to get upset, and it is raining, and that means we are stuck here a couple of extra days, and this is just one thing that you to plan for when you come to burning man, it is not always easy. up until friday, we said that it is the best weather at burning man in a decade. >> well, you jinxed it, and clearly, you are partly to blame for having said that out loud. bobby white, listen, thank you. >> i will take responsibility. >> thank you for being with us. >> sure, no problem. >> glad you made it through, and have a great burn if you are there for the burn and the straw man and hope it goes well. >> appreciate it. will do. >> rahel? >> well, the russians care, john, and thank you for having me on. the russians certainly care. they understand the rules of attacking another nato partner or attacking any nato partner and how that would evoke article 5, and all of nato would be involved, and this a big hand and little map in that they are not into the precise details of these strikes and they are launching at a precise area, and if there is spillover, then we didn't attend that, and nato will be professionally breathe through its nose and carefully look through this, and do the forensics and act accordingly, and this is provocative, but understandable. >> and we got word this weekend that the ukrainian president volodymyr zelenskyy has fired the defense minister right in the middle of this counter offensive, and what message did that send? >> well, it is going to tell you that when president zelenskyy was elected, ukraine has a long history of corruption, and he was elected to arrest that, and get his arms around that, and simultaneously russia invaded his country and he has been fighting two enemies the notion of dna inside of the government that has the corruption bent, and he has to get that thing under control, and he has to fight this war of sovereignty against russia. to the soldiers and the leards on ground, this is essentially means nothing. they will continue to focus in on the mission. it is a big deal from the standpoint of zelenskyy and how he can galvanize the cabinet and send a powerful message for them to abide to figures to be relevant to keep driving on. >> most of the counter offensive has been happening in the southern front, and the ukrainians have retaken robitaille here, and going to the south here to mack, and tal to us how they have been consolidating the gains. >> yeah, what you are seeing here is the movement, and they have made a decision here at the operational level to grab a hold of robitaille, and they want to move to tokmak, and this is how the roadwork goes, and then it goes to the sea, and what that does if they can hold that penetration, they have to be able to hold shoulders of the penetration, and then what it is going to do is to dislocate the military term forgiving russians very few options in terms of the resupply. if the ukrainians can hold the penetration, then they can hold one side of it which is the northern shoulder so they can begin the reproduction of the south of crimea and that puts the russians in a predicament. these are the defensive belts that we have talked about before, and the ukrainians have to be deliberate and not get ahead of themselves, and where they can make penetration to hold, and that is going to allow them to make some choices. you want to have the options in combat and eliminate the options to the russians. >> how hard to maintain the control of the city like robotyne, and when they regain control of it, how hard to maintain? >> size of the population and the network look like and what you are trying to achieve. you can hold it and bypass it provided it is not an announce it to have russians sniping at you, and flank you, and you can bypass robotyne and maintain the shoulders of the movement south. that is what is key. it has to be done very deliberately, and it has the been done cautiously, but with strength, because that then puts pressure on the russians who gets isolated and they have fewer options. >> general james "spider" marks, a pleasure and always great to see you. rahel? >> well, seems to me like it is going to be a slow guilty plea. we saw some of this previously with steve bannon's trial. he was given a subpoena to providem testimony and documents and he exerted the executive privilege, and the judge said that he provided no proof, and so the defense is well, tried to get there, and they wouldn't accommodate my schedule, and i showed up and they would not listen to me, and there is no other claim. it is not a special request, but it is a specific date, and you to provide documents and evidence, and you hold the key to the jail cell. if you don't provide the documents or the testimony, then you are given the key to the jail cell. >> and now, with the georgia interference case, and of course, all eyes on mark meadows and his request to move it to a federal court, and what is going to happen wednesday? do you think that there is any trials of how many this could ultimately be? >> we,ll, we may get some sense and look, the arraignments are the most boring parts of the demands of the court. is it going to be speedy trials or sever them out. or maybe going to move to sever. i know the d.a. wants to move them to sever, but it is going to be interesting to see how he rules. >> and the judge asked a question that is a lot of the legal analysts have been cluing into, and the question was essentially if some of the acts alleged met the colorful defense theory, and if some of the acts met that standard and some of them didn't, how should that go? should that then still move to the federal court, and legal minds have been split, it seems, and so how do you believe this is going to go? >> i don't think it is going to work well for meadows. the defense he is asserting here is that based on the job that he was doing that he is exempt from prosecution for state court crimes, but the problem here is that what he was doing was not within necessarily the job description. it is political, and this is what the d.a. has alleged and what the d.a. is questioning here. the d.a. says fine, you have a number of overt acts in the rico conspiracy theory, and what if one of the acts was, and does that mean that i have to grant that motion and bring it into federal court, and the answer is no, because she does not have to prove every overt act, but prove two or more, and if she wants, she can amend and take out the overt act that this judge thinks that perhaps was within the job description, and then meadows is left with nothing to say that it was within the gambit of his job as a government official, and then the judge has every reason to just deny the motion, and send it all back to state court. >> david, before i let you go, i know that you said that arraignments are the most boring court cases and hearings around, but this one may not be because of all of the obvious reasons. >> well, no, you are right about that, and i mean, routine court appearances for arraignments are over in about 30 sek, but this one, because of this speedy trial demand, and because of the scheduling issues and because of the number of defendants and the charges here, the judge may take an opportunity now to address more than just arraignments, because when the people are entering not guilty pleas, some are demanding a speedy trial, and the buljudge may take the b by the horns and say, who is going to be filing this, and motion fos s for severance, and many want a speedy trial, and who doesn't? and the lead defendant wants to delay it into 2024 and beyond, and so it may delay into a proceeding beyond, and they should keep an eye on, and people should watch to see what happens. >> so much to watch, and david weinstein, we appreciate your expertise. >> and supreme court justice clarence thomas has declosed trips paid for by a mega donor, and even though the justices are not bound by a code of conduct, most americans believe they should be. cnn's senior data reporter henry eten is here, and when it is coming to honesty, what do the americans think about the supreme court? >> when i grew up the idea of being a supreme court justice was the highest level of honesty and integrity that you could get, but look at the perceived level of honesty and integrity and 35% is low, and 33% average. and so 68% believe they have average or lower. so that is basically across government that is declining belief that people belief that people in government have honesty and integrity and now it has spread across the court. and john, the fact that the supreme court does not have a formal ethics code and something that ti never had any part of because every other part of the government does, and americans want it, and 90% overall, and it is one of the rare things that we see the bipartisan support, and republicans at 84%, and independents at 83%, and democrats at 96%, and they do believe they should have formal ethics code. >> and most people shocked as you that we don't. and how about the court in general?
