you are live in the cnn newsroom. good evening, tomorrow is labor day. that means this week, the presidential campaign will get a lot busier. the same for capitol hill as lawmakers begin to return from their biggest recess. big item, passing a short-term spending bill to keep the government funded. if a spending bill is not passed , four weeks from today on october 1, members of both parties say they want to avoid that. >> a government shutdown is not good for anybody. we want to avoid that. that means republicans and democrats are going to have to come together to get a consistency to avoid a government shutdown. let's begin the process of talking about our spending. >> joining us, commentator and democratic strategist maria cardona. ladies, happy labor day weekend, to have you both on. outlets, let me start with you. kevin mccarthy has urged fellow republicans to back the short- term spending deal to avoid a short-term shutdown. what do you think his chances are given what we have seen before and his dealings with that far right wing of the caucus? >> unfortunately, they are pretty slim. kevin mccarthy is having a difficult time wrangling fellow republicans together. the very vocal, far right fringe of the republican party, marjorie taylor greene and the band of brothers are being vocal in their request. kevin mccarthy is in a pickle, really. he is faced with the decision, does he fight with the far right wing of the party and not get anything done and in essence, have a government shutdown or do they work across the aisle with the democrats and get something actually passed, but that does him in because we have republicans with their hand on the motion to vacate. in essence they could kick him out of his position. he has some very serious consensus building over the next few days and weeks ahead. >> if you are over at the white house, do you let this play out, let this fight layout? and just sort of pop the popcorn and enjoy the show? >> i wouldn't say the enjoy, i wouldn't say enjoy the show. playing this kind of game with the american economy and american families is not what the president wants or any democrats, either. i think what they will be doing is making sure republicans stick to the promise they made when they did the debt deal earlier this year. this is what they promised. they promised to fund the government and they are expected to keep their promises to the american people. but, this is what you get when somebody like kevin mccarthy goes into a corrupt bargain with the hardliners in his party, this is what he gets. this is what he negotiated in order to get the speaker's gavel. you can look at it from what marjorie taylor greene is sing, she very vocally said, she is going to push for a government shutdown unless she gets promises unless she gets an inquiry into the impeachment of president biden. that would mean such a huge lack of leadership and frankly, republicans acting like babies. and that is not what americans deserve. >> the possibility of a government shutdown is not the only thing on mccarthy's plate. this impeachment inquiry of president biden? former president donald trump says they will be pressured to vote for one. >> i think there would be pressure on democrats. how do you run as a democrat when you see such unbelievable corruption and then you say joe biden is innocent? >> i am not even sure that makes any sense. alice, what of this impeachment staff, is this real? stuff >> kevin mccarthy needs to work across the aisle to get this appropriations agreement has. past. aside from that, the impeachment is absolutely valid. there are serious questions about biden's foreign business deals and hunter by and the possibility of influence peddling. we do have evidence as my friend love to say, president biden had nothing to do at this. their narrative has changed from , he had no knowledge to now saying he wasn't in business with them. the fact that their story has changed goes to the need to have a further investigation. i think republicans should fully move forward with the investigation and potential impeachment. democrats need to let the information flow as it well. whether or not there is a vote for impeachment will determine once all the information is on the table. >> information has flowed for five years. that is how long the investigation into hunter biden has lasted. they have found absolutely nothing. all the headlines coming out of this suppose it was a lower actually said there was nothing there. the actual whistleblower said they could not prove anything, that there was absolutely no evidence. so my dear friend alice is saying we should go forward this impeachment, i say to the gop, bring it on. it will only underscore what a lack of leadership the republicans are demonstrating and how the american people are going to look to them in 2024 and say, they don't deserve another run at leading the house of representatives. you get someone like kevin mccarthy trying to point to something shiny to make sure that his immature, incredible lack of leadership, full of extremists republicans don't try to shut down the government and ruin the american economy. >> alice, if i could come back to you, impeach the president for what? >> obviously there are questions about poor business dealings. i know maria likes to talk about how there is no evidence from these whistleblowers, there is evidence. we have testimony about hunter biting having dinner meetings with these foreign business dealers and president biden or vice president biden calling into those meetings. >> and saying hello and talking about the weather. >> exactly. i had doubt very seriously, my father never called in on business meetings. this does raise the question does influence have anything to do with it? >> people are positive, but it is definitely a mess. the people that tried to leave today have already done so. there was a line and we saw dozens and dozens of cars trying to get out. all those cars have already left this area. what you are seeing now is just a few of those stranded vehicles that are left behind. they were even digging, trying to get those vehicles from that mud because they were completely stuck in some cases. the video you saw those cars coming out, those are the people who decided not to listen to the shelter in place. the people that said we need to get out. i talked to many of them who said it took them hours. some of them said about three hours. there was the concern about food, supplies, a lot of people just plan for a few days instead of planning for more which is what this weather situation has created. it has forced people to stay longer than they initially had. that is the concern for a lot of people. they are very possible, positive. they are help ring each other and doing everything they can to remain positive and helpful to each other. here is one of the attendees that walked all the way out to where i am, now. >> we planned on leaving right after the burn which is saturday night. then it started raining on us that night. we were like oh, it is fine, everybody took shoes off and started dancing in the mud. it was a great. the reality sunk in that we couldn't leave. we were stuck. people could barely walk let alone ride their bikes or drive out of here. that's when it started getting a little scary. we were running low on food and water. >> i don't think people are going to starve or anything. i was waiting for the looting. i thought that would've been great. no, the community in itself would help each other. there were a lot of people start for this thing. it is really beautiful when you go into the camps. everybody is helping each other out. >> just to give you some perspective, what you are seeing behind me is --. the event is only a few miles from where i am. organizers are trying to figure out what they are going to do tomorrow depending on the weather and the conditions. they are going to try to get as many people out tomorrow if conditions allow for it. >> glad to see things are starting to get a little bit better. thank you very much. in the meantime, police in pennsylvania believe an is gaped convict is within two miles of where he was being held. he was spotted on a residential security cam. an active manhunt is still going on. police received more than 100 tips since he broke out. what can you tell us? >> here we are, over three days into the search. it remains very much active as authorities continue to try to track down this escaped inmate. initially, they believed he was potentially headed toward mexico and then eventually toward brazil. but yesterday, he was captured on camera about 1:30 in the morning in this surveillance video. this is only about a mile and a half from the chester county prison where he escaped from. it is kind of tough to see but nonetheless, breathing new life into the search. yesterday's citing also narrowing the area. today, authorities said hundreds of s.w.a.t. team members, u.s. marshals, local, state, federal law enforcement officers are focusing on the area where he was seen. he had just been convicted of first-degree murder in mid august after being found guilty of stabbing his girlfriend to death in front of her two young children. the district attorney has urged residents to remain on high alert. he called this individual an extremely dangerous man. take a look close look at the screen. if you spot him, pick up the phone and call authorities. >> definitely be on the lookout in pennsylvania for that man. thank you very much. when does legal advice go from being guidance to being a crime? the judge has said, meadows should show up for his arraignment. i can't imagine being mark meadows right now. he has got to be on the edge of his seat in terms of, what does he do next in all this? what is your sense of what might happen? >> i think there is a fair chance it could be removed. if this case is removed to federal court for mark meadows, that will really hurt --'s case. he is a key player in the rico charge against president trump. if president trump gets removed, that is a problem, too. willis does not want a separation of the federal people from the others. you want about nine people sitting at the table with the president in the middle who is the center of this conspiracy, allegedly. >> he believed he was just acting as the white house chief of staff. he is trying to make that kind of comparison. do you by any of that? what is the bottom line, here? >> the first hurdle he has, he probably violated the --. he is going off and doing things way outside the scope of the white house chief of staff. the second thing he did and this was brought up, whenever he did all these things, making calls, contacts, emails, he was never consulting the white house counsel's office or the doj. if you are not consulting white house counsel or the doj, the lawyers with the brains, you're probably not acting within the scope of your duties as the chief of staff. plus, there was an offer to give money to the secretary of state to do a count. that is way outside your role as chief of staff. >> if this doesn't get moved over, what happens next? >> if they don't go to federal court, then you just go back to --. >> he is going to fight it out in fulton county? >> absolutely. and that is the home-court advantage for it is extremely difficult to get a fair jury in a pool that is weighted. it will be in her favor time. >> what about trump, is he going to want to separate his case? >> >> they are moving in all kinds of different directions, here. >> after this you need a margarita to put it all together. donald trump needs to sever from this case. he cannot be in a room with about eight other people. he is not only physically large but he commands the stage. if he is there with other minions, it does not look good for him. he wants to be mono a mono. he wants to be fighting it out so he can get some punches in and hopefully persuade one juror. you only need one for --. does this make a mess for fani willis? >> it does. >> she wants to keep all these defendants corralled. >> jim, she is never going to have a trial with 19 people. it is physically impossible. it may be nine, it may be eight, but it has to be trump with eight or nine other people. for fani willis, if they started the trial in october, jury selection will take two to three months. we are looking probably at a trial in march, april, or may. you will have a perfect storm of three or four cases going together. you will need another margarita. >> what is your sense of it? do you think we see donald trump going to trial before the election, november, 2024? >> i think they will begin jury selection in may of next year if i had to bet money. >> by that point he might already be the nominee. >> absolutely. >> here's the thing, the trial will probably last four months. it will not end until after the election. if there is a guilty verdict in any of these cases, it could be after the election. >> great insights, enjoy that margarita. >> two! >> absolutely, you get a double. >> in the meantime, president trump has spent a lot of time in front of our cameras. all will be televised and live streamed. what do you think? could this become the trial of the century type spectacle, o.j. simpson type spectacle if this whole thing is being televised day after day? donald trump going in and out of the courthouse? >> this is a huge deal, obviously. it is hard to imagine how this won't be the most-watched trial of all time with former president donald trump being in court day after day and week after week. this will help the public have a better understanding of what happens in the courtroom, particularly with donald trump who is used to being able to misinform the public about what happens. so, allowing the public to watch in real-time, a lot of news organizations do have video where they can debunk things and fact check things quickly. i think that will give a better picture to the public of what is happening and what exactly the evidence against donald trump is. >> it is also an environment that he cannot control. he can't throw the camera crew that is live streaming out of the courtroom and do those sorts of things. they are going to be in there. this is an environment that is not really tailored to what he knows how to do. >> it reminds me very much of the conspiracy theorist alex jones was in court. he was similarly used to an environment in which he controlled. suddenly, he was in the court of law, the judge was in control of the courtroom. he could not live freely. you saw a much more subdued allen jones. with trump, you might see a similar person. someone who is used to controlling the cameras, used to controlling the narrative, having to play by someone else's rules and being held accountable, if he tries to tell a lie it will be a totally different environment. it is not one that i think he would do particularly well in. >> forgive me for doing this to you, taylor swift's tour is breaking even more records this time at the box office movie theaters. she is helping save movies just like she is saving concert going. it is incredible what she has been able to accomplish. what do you make of how this might have an impact on the movie theater industry? >> this is going to be huge. amc says it broke the record for first 24 hour presales all- time. she sold $26 million in the first 24 hours just for amc, alone. there is no real telling of how big this movie could be in its opening weekend. of course barbie earlier this year sold about 160 million some dollars within the first weekend in the u.s. but given the way this thing is selling, i don't want to say it is going to be barbie levels, but it is going to be huge. i was talking to a box office analyst who said this is basically a blockbuster that has been invented out of thin air. i will be playing, paying close attention to see how much she is able to sell at the box office. >> she is a force of nature. we should not talk about movie theaters without getting into the strike. summer is coming to a close. any light at the end of the tunnel on this? >> we have not seen any light. earlier, a few weeks ago, i think there was some hope that the studios were going to come to the writers with an agreement that they could negotiate off of. when studios went back to the writers, they scoffed and said it was grossly insufficient. now you are in a standstill. the real worry is, if this isn't solved in maybe six weeks or so, the idea that you are going to have somewhat of a season for a show that normally a show debuts in january, that idea goes out the window, just evaporates as one studio executive told me. studios are really worried that if they can't hammer out a deal, basically this entire season is lost. >> i saw something that the dune sequel might be pushed into 2024?
