now. >> out front next, giuliani pleads not guilty. trump's former attorney skipping arrangement on charges of trying to overturn georgia's 2020 election as all eyes are on a fulton county judge who could change the course of trumpes case. plus the manhunt for an extremely dangerous man authorities expanding search for convicted murderer on the run. we have details on where he could be heading. and video just into our front shows the moment ukranian forces come under attack as putin esz claith his nuclear threat. let's go out front. i'm brianna. the pleas are piling up. as of tonight 12 defendants in georgia's election case have pleaded not guilty, including rudy giuliani, who just entered his plea and opted not to appear in court for arraignment. he joins his old boss, former president trump who also pleaded not guilty yesterday to the 13 counts he's facing in fulton county. it's where the former president's focus is tonight. at any moment a judge could decide if his former chief of staff immediate east will face trial in federal court. according to prosecutors he helped overturn 2020 election results. meadows claims he was carrying out duties and we have seen a transcript from earlier this week. at one point he was asked about why he was so concerned about coordinating fake electors and he responded in part. if meadows success in moving his case to federal court it could have a profound impact on trump's case. the former president could transfer his state out of state court we are geting a glimpse into the cash crunch co-defendants are facing. a source tells cnn none of the 18 asked trump for financial help despite mounting legal bills and we learn four of them turned to fund-raising on line for the money they knee. sarah murray is out front live in washington. how closely are trump and the other co-defendants watching for this judge's decision about meadows? >> they're paying close attention. meadows is arguing that everything he is accused of doing after the 2020 election in georgia was related to his role as white house chief of staff and should be able to move his case to federal court and we expect he's going to argue the charges against him should be dismissed. the district attorney's's office argues the steps you took in georgia were about trying to keep donald trump in power. this is about your on political ambition, donald trump's political ambition. there's no way this could be related to your duties as a federal officer so we are waiting to see where a federal judge is going to rule on that and we expect that trump's team is likely to make a play to move donald trump's case to federal court. donald trump was president at the time. they feel they could make a different argument but may be waiting to see how this goes for meadows. i think the other thing, you mentioned all those defendants who have entered their not guilty pleas. we have a few more either need to enter on paper or show up for arrangement next week but after we get past that wednesday decline for folks to be arraigned and enter pleas then we are in a phase of this case where the state court judge can decide am i going to lump a few people together who want a speedy trial in october, am i setting a trial date for others who may want to start then. we make it more organizational next week. >> we will be looking for that. out front now ryan goodman, former special counsel at defense department, stephanie and anthony michael who is a law professor at georgia state university and following the fulton county probe. anthony to you first, when do you think we might be seeing the ruling whether meadows case gets to move from fulton county or not? >> well i think judge jones has a considerable task in front of him and has admitted in court orders there's a potential novelty to this particular case and whatever rule he decides on once he decides what needs to be done here. so yesterday we had some movement where filings were submitted by the d.a.'s office and by meadows attorneys about whether or not georgia rico would permit or require or whether georgia rico in the way it's struck touchdowns would permit removal if one act was part of the racketeering scheme was within meadows' duties so the d.a. said mark meadows is not being charged for anything he did within the scope of his duties but is being charged for engaging in unlawful conspiracy to overturn election which is not within his prerogative as chief of staff. so we are seeing some movement on those arguments. there's additional hearings that we have other removal remotions in the third week of september so that also might play a role and i think the other thing too of course is state proceedings and continue on so there's really not an imminent rush for the judge to decide this or next week. >> we will be waiting. ryan meadows testified earlier this week he was not involved with the campaign part of this, he wasn't involved with the fake elector's plot but when you look at this newly available transcript we see the fulton county d.a. is trying to pin him down in it because he meadows had emailed about the need for someone to coordinate the fake electors and asked about that meadows tried to explain, quote. he was asked, why did you not want that to happen. meadows says well, because i know i would get yelled at. by whom he's asked, he says by the president of the united states. how bad is that for meadows and for trump ryan? >> it's very bad. i would imagine their defense counsel are quite worried about that testimony. it's bad for president trump because meadows is directly pointing the finger at him saying he would have yelled at me if i didn't do this. that means president trump is directly involved in the elector's scheme showing the intensity of president trump's interest in it plus meadows is saying he would have yelled at me if i didn't do it. that is a validation. it's not just that president trump was involved in the false elector scheme but getting his chief of staff to do it and the chief of staff knows if i don't do this he is going to yell at. that is a provision of the hatch act that applies to the president, you're not as president to intimidate an employee into engaging in political activity on behalf of a candidate. the last is for meadows it's horrible for him. his entire argument is based on what you've described that he was taking everything he was doing was within his authority as chief of staff but he says i did it because i wanted an option for the campaign. that's a pure campaign trying to win the election issue. there's nothing about the federal government's authority with respect to that particular item and there he is saying at the end of the day after lunch that quizzed him and here he admits it was purely the idea of trying to preserve trump's options. >> stephanie, you spent many hours around meadows over your employment at the white house. what do you think about him testifying that he had no role with the fake electors but then explaining he was trying to coordinate them because he would afraid trump would yell at him? >> well i certainly understand the feeling of not wanting the president of the united states to yell at you and in this case, the former president, his anger was swift and it was cruel and we all did everything we could to avoid being yelled at. however, you know to kind of echo what ryan said there is a campaign and there's a white house for a reason. at the least meadows could have don to the campaign manager and say you guys deal with this. we are out of ichltd he should have stuck to our in-house white house counsel who were just telling the president this isn't the case, you did lose the election so i understand it. i do. i was oftentimes in situations where i would do anything to just keep that man from yelling but this is different. i mean you're trying to overthrow the government and take home and keep your power. >> all right ryan i want to ask you about another incident we leshd of having to do with cleeta meadows who was on the call about trying to overturn election results in georgia. he was asked, did you have any role in bringing ms. mitchell to advise the president? he answers, i asked miss mitchell to come down to volunteer. is he making the prosecution's point for them? is there any part of that that he can wiggle out of? >> no. he cannot wiggle out of it and yes he's making the prosecution's point. also it came at the end of the day. he has no other alternative. it has been reported this is what he did. now it's out of his mouth. he asked who brought her on, it's him, why, to help the campaign balance out its lawyers in georgia and that's just kind of like almost like game over because it does mean that he's acting on behalf of the campaign. it's game over. it should be probably game over for getting the case into federal court because he needs to say i was doing everything in my office. he's trying to say i have sovereign immunity. what is that? it's immunity if you were acting in your office. the test is if you go beyond your office in your conduct he doesn't get it. one more point furks look at his testimony the entire testimony is built on this idea everything i did was as chief of staff. then it comes out under cross-examination that's not true. i do think jack smith will have to look at this transcript and think are we going to think about perjury charges because it's that much of a convergence from what he said initially and what his position is and he has to flip later and say i acknowledge. >> anthony do you think that's true? >> yes, i think mark meadows had a bad day in court. i was able to watch the proceedings in federal court on monday and meadows certainly tripped up a number of times in that same line of questioning about coordinating with the campaign about the fake electors, meadows had referred to a royal "we mohamed sadeek odeh and the d.a.'s office said who do you mean and he said something to the effect me and the campaign. when you're trying to claim having you're doing is kund color of office that's not what you want to say so ig think it was a mistake to put him on the stand probably. >> stephanie we talked about how cash strapped these defendants are to raise money for their bills. how worried should trump be right now about that? >> i lament is infirmity that senator mcconnell has displayed. he's done so many things that we should be thankful but i think the question of term limits should be raised. our fore pathers never thought we would have long-term serving officials. hopefully people start to think about that now. >> so, that's pretty broad, right? that would apply to a lot of people. do you think that he should be term legal it out? >> well, my personal feeling is that everybody should be term limited out. i mean i introduced a bill. first of all, all these elected people say i'm for term limits and sign on to bills that require a constitutional measurement which is never going to happen which is unfortunately the way a lot of things happen on the hill. i introduced one that says okay, after 12 years your sal stops. it got a few sponsors but it caused a lot of concern because it might be able to happen. >> there's a difference between someone getting old and comfortable and entrenched in washington and questions of whether they're physically able to carry out the duties and. >> that's true. >> do you have concerns that he is physically unable to carry out his duties? >> well, i think his health has shown in debility that needs to be addressed and term limits would have solved that but i'll grant that's a different issue for sure. >> so considering the reticence of members of congress to pursue term him knits a real way i want to ask you this, the u.s. capitol physician released a letter suggesting he was suffering from light headedness and dehydration. it's vague. term limits aside doug think mcconnell needs to be more trance parent about his health? does he owe that to voteers? >> well, i think he probably owes to his voters the level of transparency that's required. i think politics should be more trance parent than there is. there's too much power of incumbency. i think transparency is the clear light that shows everything and i hope that he would, if he has a serious medical issue that he would come clean on that i don't know. i can't really say. dianne feinstein is the same way. she maybe worse in fact. >> i want to listen to something nikki haley said about mitch mcconnell. >> right now, the senate is the most privileged nursing home in the country. you know, mitch mcconnell has done some great things and deserves credit but you have to know when to leave. >> she's proposeing a competency test for politicians over 75. what do you think about what she suds? >> brianna no. the authorities don't have any concrete idea but we did get new information from a press conference that gives clues what they're thinking. the district attorney here said he believes the escapee is in this general area. she said, quote we believe he's hiding somewhere locally and is alone. there's no evidence to suggest that anyone is helping him be on the lam at this time and the last thing we heard brianna reason to believe they said he might be heading south and the reason for that is basically tied to the reason he was in this prison at all. like you said he was just con addicted of first degree murder brutally killing his ex-girlfriend when that conviction happened just sentenced to life with possibility of parole but prosecutors after the murder in 2021 he tried to flee to mexico ultimately trying to head to brazil his home country. he didn't get that far stopped by law enforcement in virginia but because of those actions back in 2021, that's why prosecutors believed he might do the same thing this time. at this point the message from law enforcement for everyone in this neighborhood please be on alert be cautious especially into this labor day weekend. brianna. >> lot of people on the move out of their houses and danny freeman. out front is andrew mccabe former fbi director and former cnn law enforcement analyst, it's been 36 hours since cabalcante escaped. what do the early hours of the search look like? >> the early hours are always the most important particularly when it comes to the kind of traditional manhunt side of this chase, so you know, if you imagine that this was an escape of opportunity that he's left the facility, and he has no known access to transportation or funds or support structure, then it is literally getting law enforcement officers out in that community trying to find him. it is as you can see from your coverage an incredibly rural place populated by farm and wooded lands. those first hours are essential to try to course through as much of that property as can you. >> right now he's believed trying to make his way to brazil to mexico because that's what he did before. law enforcement says at this point there's no reason to believe he's left that area. why are they thinking that? what do you think? >> it's hard for me to say why they believe that he hasn't left the area. but we know that it would be almost impossible for him to make any progress in that direction, whether he's headed south or someplace else without the assistance of friends family relatives or associates. we know he has some relatives in the area. he supposedly has a sister possibly family in phoenixville. we know he's relied on associates in the past when he tried to escape in 2021 so that's kind of the behind the scenes manhunt with analysts at the state police u.s. marshals or fbi working to identify who those people are, to find out how to contact them, how to potentially surveil them to see if there's any contacted between this gentleman and his support structure. >> how does something like this happen? >> well, certainly anything that has anything to do with nukes is alarming. but, i think icbm's, the inter continental ballistic missiles that can reach almost any part of the globe are always on combat alert they're always ready to be launched so the fact that russia has announced that is really a narrative that is redundancy frankly but we need to take this very seriously. you continue pass these away. what that means is what is our status, what is our capability, what what is our alert capability, our ballistic missile defense alert capabilities and how are we prepared to address these. but the thing about using a nuke, that's the thing we need to keep in mind, bear in mind as much as putin needs to go away, he's chosen not to use a nuke yet and there's no guarantee if he were replaced somebody might choose a different path. bear that in mind but when you use a nuke you use all lavrj. they understand that. >> you see these drones striking inside russia but ukraine hass long-range missile 345 miles it can travel. do you think they'll use that? [ speaking in a non-english language ] >> so, you were in a border patrol van, so you couldn't see the medical attention that they were providing to her. >> reporter: these parents say they felt humiliated and discriminated against throughout the entire process. her parents believe she died inside the jail-like border patrol station. >> you think your daughter died in your arms. >> reporter: an incident report obtained by cnn stated she was unconscious and unresponsive when paramedics arrived. her casket was covered with ribbons, roses, and balloons in her favorite color. and while these parents say they forgive those who didn't save her daughter, they can't forget. [ speaking in a non-english language ] >> reporter: everything reminds them of their little piece of joy taken too soon. now, this family says that they have been struggling ever since they were released from detention. according to their spokesperson, they're having trouble finding housing in new york. according to their attorney, they're in removal proceedings, which means they could get deported at any point in time. customs and border protection did not respond to our request for comment involving the allegations made by this family in this story. but the agency does say that it has taken steps to correct the deficiencies that have been identified through this ongoing investigation into the death. as for the cause of death, according to the death certificate, she had an extreme response to a bacterial infection with acute sickle cell crisis. brianna. >> bacterial. rosa flores, thank you so much for that very important report.
