through the streets because he is about to become assassinated. i think about all those different moments. you are right, not only was that the issue, abby, tonight is also the day that they're great marshall was also sworn in as a supreme court justice. and icon and role roe model -- >> the echoes of history, laura, have a great show. thank you. >> thank you so, much we're gonna talk more all about that later. good evening everyone, i am laura coates. look, there is frankly, there is one big headline after another tonight. you've got the tale of two courtrooms. one is in fulton county, georgia. the other, in washington d.c.. and here we are on the 60th anniversary of the march on washington, learning new details about the latest racially motivated shootings. in jacksonville. we are going to step back tonight. we are going to examine all of the -- michael eric dyson, get his take on the context. plus we will give you the very latest and tropical forms threatening the florida coast as well. we are also gonna talk with olympic gold medalist -- about one simone biles, there she is right there. now the most decorated gymnast in history. but first, i want to introduce you to things. january 6th, well, meet march the 4th. that's the trial date now set by a federal judge tanya chutkan right here in washington d.c.. now trump's attempts to kick the can all the way down the road to 2026, everyone, it failed. the judge funding there was no reason they could not be ready within, really, a year. and neither his personal more his nor his professional life should impact that, even if he is trying to be at the head of a separate but coequal branch of government. now that days interesting for a number of reasons in history, for you buffs out. their 243 years ago, that same day, was the day of the constitution went into effect. and now it's a day 20 former president of the united states will go on trial for trying to subvert that constitution. it also happens to be the day before super tuesday, one about 12 states will vote on who should be the republican nomination nominee. going forward, it is also about eight months from the general election, one where trump is hoping to get a total of eight years in office if reelected. now, that date, of course, it's not set in stone. travel dates have to be pushed back. they can also get moved, up as you know. you know, one way to guarantee maybe it's getting moved up? trump's own conduct. we have already heard the judge chutkan warning that if he tries to intimidate witnesses, or try to poison the jury pool. well, we might have an even earlier trial date. the other way, trump will have to be off the campaign trail to sit at a trial that might take at least eight weeks. here with me on the studio, national security attorney bradley, mosque -- associate white house counsel for president george w. bush, and marcus childress who was investigative counsel to january 6th committee. i am so glad you are all with me here today. first of, all we will take the history dates aside for a moment. march 4th of 2024 is not 2026, okay? it's very obvious. but it's a very soon date considering the fact that, look, we have got four trials. this is one of the most consequential ones. i want to begin with. you because you were on january 6th investigative counsel committee. that notion, the fact that it's gonna be march 4th, before super tuesday, before a general election. is that the right call from this judge? >> i think from the very beginning they set the tone and we're doing a pretty tight indictment here try to troll fast. prosecutors again repeating this notion of providing the documents and actually identify for them them for you in a way that you can see exactly how substantial they are. that's why i'm not gonna say it's the right or wrong decision, but it allows the court to have a little bit of slip to the left, right? if they are offering child motions at the trump team may file. it allows a little time and delay and still have this -- with a busy calendar ahead. >> so to the, left you don't mean politics? you just mean you have had -- >> correct. correct, thank you. the colloquialism, he didn't like, that okay? calm down. i see you, thank you very much. thinking about the room you would have to move, you know what trump would say? election interference! not from his own allegations, but instead, he would, say bradley, this is the judge trying to interfere with an election. and she doesn't care about his campaign schedule, i mean, there are others who have had to prioritize a court hearing over their personal lives. what do you say about argument to a judge? that you are committing election interference, your honor. if you don't have the trial date after the general election. >> let me know when they slap on the cuffs, if i respond. >> okay. >> if the indictments came now and the trial happens in 2020, for he is going to play with election interference. if he loses in 20 foreign runs again? you cannot claim a trial that would be election interference. and the prosecution of this man in his view its election interference, because nobody is ever allowed to prosecute donald trump, no one has ever been allowed to hold him accountable. there are only people who can old him accountable is himself and nobody else is permitted. the idea of holding this in 2026 was preposterous. the charges already that, she still gave him more time which i thought was sufficient. i thought it was reasonable, i thought the government would have been wanting to go way too quickly to january. was it enough time with pretrial motions. you know those are going to get appealed away. putting it in march gives some buffer room. i still think it's actually pushed to the summit this point, almost certainly will have a pile of litigation in this. but i think it was a reasonable compromise given what is essentially a very straightforward case. >> some are still of course not in the elections, and that was an october surprise, i wonder if we will get to that point. i want to tell, you general, there was a moment where the attorney who ordered from before says he doesn't have enough time to get up to speed here. and i tell you what, here's what the judge said. she pushed back, saying any agent diligent, zealous defense lawyer, would not have been sitting on their hand waiting for an indictment. is she right? >> absolutely, i mean, look,. he should have been prepping for a long time, the defendants should have had counsel, they should've been prepped, there is no question she is right about that. the problem with setting this trial, date even if it moves back to the summertime, it plays right into donald trump's hand. he is going to keep saying election interference. he is going to keep saying, i am off the campaign trail, i cannot campaign effectively. this is a democrat appointed judge, trying to prevent me from succeeding in my campaign for the presidency. and this is the challenge, right? when the justice department brings the charge, the president who oversees the justice department is running for reelection, right? this will be a whole different prosecution if joe biden were running for president, if donald trump were running for, president and works literally right in the heart of the primary, and eventually the general election season. >> yet there have been many looking at this and saying, the reason you announced your candidacy mr. trump, was because you are not necessarily running towards the presidency, you are running from an indictment. with incredible weather that is true or not, some say he is walking to the presidency more he is run to the presidency -- by the end of the day, when you look at this and think of the consequential nature of this, right? this is somebody who in the january 6th committee, from liz cheney to adam kinzinger, 80 raskin, and beyond. it was about an ongoing threat. there is an election, as we know with democracy, that's right around the corner. the fact that he is saying, look, this is a politicization of what is happening. are you buying that based on your experience of what you saw with the january 6th committee? >> aquino is today from the members of kinzinger and miss cheney, others saying that laws are just words on paper in less than those who are elected carrying the mountain and force, them and follow them, right? as with so investigation is been about, making sure that our elected officials actually enforce the laws that are on the books, because that is a key to our democracy. >> it's also the actual marching corners of the head executive branch of government, right? who endorsed the laws. think about, this march 4th is but many of the cases that he has. including several, we are gonna talk more about that. but when you look at the references that are being made to the prosecution, and frankly that i read that he had about $7 million that he was able to fund-raise off of the indictments? >> just off that photograph. >> off of the photograph, that crazy photo. >> i mean, that is really telling to me. is it for you as well? how this might in fact how he continues with the defense? he's not saying i didn't, do it he is just saying, yeah, i did, it next? >> to the contrary, he is actually succeeding with his base. this is going to draw his base out to vote. in an election where turnout matters a ton, right? he is going to get his base out to vote every single day of this trial going forward. he's raising more money, this is bad politically for the biden administration. it is a winner for trump, it helps him win reelection. that's a disaster for anybody who thinks donald trump ought to be in jail. >> as they, say but, wait there's more, because georgia is on our mind as well. so shadow to re-charles. thinking about, are you talking about sam cook, why not add him into the mix. let me ask you, georgia in fulton county case, there was a hearing today involving mark meadows, involving raffensperger, facts finding inquiry about whether or not to move that case into the district court of georgia. expanding, of course, the jury pool, based on the fact that mark meadows says, look, i thought this was part of my job. what is your reaction? >> the devil went on to georgia and he found this would have chief of staff, he can do just about anything. it doesn't matter if there is no law on the, books it doesn't matter if there is no policy, i am just a gatekeeper for the president. he wants to make phone calls about things that have nothing to do with the presidency, but have to do with him as a candidate, i am just doing my work as a federal employee. it would be a complete evaporation of the entire idea of what is and is not your role as a federal officer. he was the white house chief of staff, he had any number of responsibilities to serve the president in that capacity. nothing tied to the campaign would have been within that scope, nothing tied to campaign litigation would have been within that scope. the federal government, the executive branch, is deliberately excluded from these parts of the process of deciding who won the presidency. there was no role for the white house there. >> i'm gonna, say i was just happy that mark meadows testified today, i, mean that something we didn't get on january 6th committee. but going back to the evidentiary hearing, this wasn't really an issue of facts. it wasn't. issue of interpretation of law. right? you have the mercado's team on one side saying that there is broad powers and broad scope within the official chief of staff. and then you have the prosecutors saying that it was a political call, right? that secretary raffensperger -- comes down to hope a court interprets and draws the line of what's the official duty reciprocal act. and whether the court actually just draw that line. but there was no real issue or genuine issue a fact. here just gonna be how the court interprets the law. >> well the court did not rule today -- whether it will be a successful claim, we'll have to wait and. see look at, this beginning of a joke right now. fort lawyers walk into a studio. okay, bradley, moss -- marcus, thank you everyone. look, we are never, we have actually, never by the, way seen anything like we are talking about today. a former president facing a total of 91 charges and four criminal cases, four different jurisdictions, two federal, two state cases. all that while he is in the middle of running for a second term? not to mention the jury's selection and then you have got to realize these cases will not happen in a matter of few days. these cases were gone for weeks if not months. and so i think we are gonna see a lot of different adjustments on these counters, the judge in d.c. has been very here that clear this is not going to happen 26 to 2026, it's gonna happen in march of 2024. and so i think that we are going to see that happen, i think we are gonna see that date hold fairly close to that. and d.a. willis. >> you know, d.a. willis a think is very interesting, because she has really called it, they say they want to have a speedy trial and only will i give you a speedy trial but i will even up the ante, we will have a date in october. so, you know, you have to be careful what you ask for. >> we'll be careful what you wish, for because you just might get. it of course, the trial -- five of the defendant in georgia, there is that sort of shorter time frame, but i do wonder, you heard me saying leading up to our conversation here -- to chat it, the idea of the repeat attorneys at your. hearing the idea of trying to coordinate, the idea of trying to say, listen, your honor, in one jurisdiction you have got to cut him some slack, because i have another case and another. the judges aren't going to want to be coordinating with each other and trying to figure out how they can juggle with your schedules. my mom says, your emergency has not become my emergency. but there is a moment, judge, when trump posted on truth social that he is going to appeal at least judge chutkan's decision about having that march 2024 date. and he like to stand on here over a judge setting a trial date? >> i don't think they'll go the same on, and i would think the manhattan d.a. would then concede that they need to let the federal judge go first on this. and if i were in her situation, i would flex my muscles, i would say, listen, i have this. day this is gonna happen. we need to have this happen. and i think really the most compelling cases, frankly, from my perspective, this one in d.c. and the one in fulton county. and frankly, i think that those should take. president of, course it is not my decision. it's going to be very interesting to see others works out. but i think that people have to understand that it's going to take forever to strike juries in these cases, as i said before. and these cases are not civil cases. they will go on for a very, very long time. i think it's also interesting, i had to tell, you laura, that i, i don't mean to talk about this, but everybody thinks and talks about pardons. and i have to say that in georgia, there is no such thing. there is no such thing as getting out of jail free. so i've been watching what is happening in federal court, meadows, perhaps clark, trump will follow. because really you can't get pardoned. the governor no longer can do that. that was changed back in the 1940s. and you have to literally serve your sentence in georgia. in five years, it has to collapse before you can even ask for a pardon. so if they don't get removed, it's very interesting. and i will tell you, in full disclosure, fani considers me a mentor, and i've been encouraging her. i think she is doing an amazing job. and when she says she is ready in october, you can bet she is gonna be ready. >> you have been mentoring her on this case specifically, or just in general? >> no, just in general. generally. >> you've spoken to her about this case in particular. >> no, no, i reach out to her for encouragement, but we have not talked specifically about this case. >> interesting to, know and the point, just to clarify, for the audience. there is pardon rights in georgia, it's just that this would not be a federal pardon noble offense, even if removed according to what happened, because it would still be a state law that would be implicated in georgia. it should be if convicted, a state conviction, which means that it would go to a pardon board. and you have to wait five years to even qualify in georgia electoral. but it's, funny just one more point, judge hatch it, you know, the fact that right now we are at a point when it's the decision between whether alvin bragg's case goes forward first in manhattan, or jack smith's case goes forward in washington d.c.. the child, it wasn't that the first question everyone raised with alvin bragg, why should his case go first? talk to me about just how difficult this really is. >> very. very difficult. i've been in the sport of gymnastics for 18 years and seeing what simone is doing these days, it gives me goose bumps. it makes me think about my olympic pursuits, making it to three different olympic games and she is on track to making it to the 2024 olympic games and paris and, as you are going to experience with your daughter, it is a grind. there's the physical commitment, the emotional toll, the mental toll, the social aspect, and i give it to simone. it she is 26 years, old she is the best that she has been and i think she is only going to get better. it is a delight now for myself as a mother of four to have her as a role model for my little kids. >> it's incredible to think that that journey she has had and you know how invested one has to be. unlike of the team sports of course, it gymnastics is individual. the weight of the world on your shoulders, and the decisions you have to make to make sure that you are safe, no one else gets to decide that but you. two years ago, in tokyo, she suffered what is known as the twisties. tell me about how significant that really is and how do you overcome? >> yes, she is about to be the third american female gymnast to qualify to three olympic games. i was the second at the 2000 olympic games in australia, and as you can tell 23 years later it hasn't been done. she is going to do that and it is on her own terms. i would be remiss in not saying that today's culture and the sport of gymnastics as a healthier culture. i started my own academy in the midst of the global pandemic to be part of this positive change. it is dominic dawes gymnastics academy, i opened my second in rock ville, maryland, and looking at future locations down the road. simone has been a part of that positive culture change and that is why you can see her on the floor smiling, celebrating herself, celebrating her teammates. that is not something that was allowed back in the 90s during my era. she's a part of the positive change and it's why i think she will continue to thrive. >> our best wishes to you, i know that you will thrive in all that you do. you continue to be a champion for so many reasons, not the least of which is an entrepreneur and obviously for the team of gymnastics and the sport in and of itself. something tells me that you say that she is 26 years old and then i read things like she is the oldest gymnast ever i'm thinking, wait a second? i'm sorry? not the oldest ever, but why is that the age? >> yeah, i think being obviously a three-time olympian myself, i was 23 at my last olympic games and i was on arthritic medication that i needed to get off of because it was going to damage my kidneys. it is hard, it is grueling, the physical toll, the commitment, the dedication, the emotional toll, the mental toll. as i even mentioned earlier, the social toll. i'm not by any means, simone biles is not one dimensional. she is married, a businesswoman, but for many gymnast when you are in the grind that is all you do, it's all you, know and that is my life. i lived in a leotard, i would only have friends that war leotard. it's all i did and i think today the culture that is changing in the sport, even at my academies we embrace athletes that want to play multiple sports. i embrace the gymnastics being great for a healthy foundation for that multi sport athlete. i have four beautiful kids, all four of them do gymnastics, but will they become highly competitive gymnasts?
