march 4th, 2024, that is the latest trial date for former president donald trump on charges alleging he worked to overturn the 2020 election. that's just one day before super tuesday, a crucial date in the next election's nomination race. neisin the meantime, in geo, more drama, as co-defendants try to move their trials. the mayor in georgia pleads for the end to the hate. a strengthening storm takes aim at florida. tropt cal storm idalia could turn into a category 3 hurricane. the record heat in the gulf means the storm is more likely to intensify. we are following these major developing stories all in the meantiming into "cnn news central." the date is set. a federal judge just ruling that the trial date will begin march 4th of next year. this comes after a heated hearing today, where judge tanya chutkan warned trump's legal team to, quote, take the temperature down a little. evan perez is outside of the courthouse for us. judge chutkan rejecting both the special counsel and the trump team on this, but in the end a little closer to the prosecution on their request. >> reporter: that's right. brianna, the judge certainly was very clear early on that she was not going to give the former president and his legal team two years to get ready for trial. that's the date they had ask for. jack smith, special counsel, asked for john wear. jeff lauro said the prosecution was looking for a show trial. that is when the judge chutkan asked him to bring the temperature down just a little bit. one of the things jeff lauro was complaining about is there's about 12.8 million pages of discovery, documents that the government is turning over for the defense to get ready for trial. about 47,000 pages of those are what they called key documents. the judge pushed back on the fact that the former president not only has three other indictments, but he also has a political campaign to run in the next few months. what she said was, setting a trial date does everyone sdn depend and should not depend on the defendant's personal oar professional obligations. she said that the public had a right to a prompt resolution of this matter. again, that's something before the 2024 election. she compared it, brianna, to a sports star having to answer charges in federal court doesn't get to say, well, the fact that they have to play in professional games does not allow them to get out of the having to go on trial. brianna? >> yeah. what a day to pick here, evan, a day ago before super tuesday, though. >> reporter: that's right. what we have here is the prospect that the former president will be spending a lot of weekdays or most, right after that period, right after super tuesday, as he's facing other contests in other states, where he will be spending his weekdays here at the courthouse. that's something the legal team is not happy about, but the judge said that she gave it a lot of consideration, and she also even called the judge in new york, the state court judge in new york who is overseeing one of the former president's other trials and consulted with him before picking this day, evan, thank you so much. jim? also today, former chief of staff mark meadows, in a key hearing in the state election case in georgia, he is trying to get his charges moved to a federal court. he argues anything he did related to georgia's election results was part of his job in the executive branch form the prosecution disagrees. the key piece of evidence is a phone call that he made after, a phone call that meadows was on. >> so, look, all i want to do is this. i just want to find, uh, 11,780 votes, which is one more than we have, because we won the state. >> facts show otherwise. kaiind katelyn polantz is outside the courthouse. do we know what mark meadows said under oath? >> i was in there for the testimony of nearing three hours. he's trying to walk a very fine line to say what he was doing after the election, even if he was getting a campaign advocate involved, personal lawyers involved, talking about things that were of the interest of the president as a candidates, that that, he believed, was part of his jobs as chief of staff because of the general interest that he had in making sure the trains ran on time for president trump, and making sure the federal government had some confidence in the election. some of the testimony neuar the end of this hour -- it's very possible he's still on the stand -- that he was dealing with the president's personal positions on a number of things. when he was pressed by the prosecutors over and over again, he grew exasperated, where the prosecutor said, where does the line end? what is the outside the scope of your responsibility as chief of staff? he said, the example he could use is getting up on a stage and campaigning for the president, and even he believed there was a role for the chief of staff to advance that, and this testimony was really astonishing in so many ways. first of all, the fact that meadows is under oath in a courtroom right now talking about what happened after the 2020 election, after avoiding testifying in the house, after not seeing him for so long or hearing what his positions may be. he really is emphasizing how much he's doing things, believe they were part of his jobs, because the president was asking him to do those things. he wasn't working for the campaign and they didn't report to him, but he felt he needed to take certain steps, and so far the testimony has not been about the raffensperger cause. they have walked through every piece of the allegation, text messages he was allegedly sending, a visit he made in georgia to try to watch an audit of one of the county's elections here. all of that they have gotten meadows under oath to say exactly why he was interested in it. many times he has said he didn't recall reaching out working for donald trump or his campaign in setting up they things, but he over and over again is saying i bless there was a general interest of the federal government. we're going to have to see what the judge says to that, and what other testimony might come in the afternoon. >> so we now, relating to the georgia case, we have a date for the next step in the process. that's the arraignment? what is that date? if you can't clair for folks, whether those involved actually have to filly show up for an arraignment. >> reporter: i'm not exactly sure if they have to show up physically for the arraignment. i just got out of court, where there were no phones, no electronics, so many court proceedings are all happens at the same time here, jim. i do understand there is an arraignment date another calendar. there's a lot of moving parts in this case and others. >> katelyn polantz, thanks so much. a group of officials echos the d.a.'s office with a filing with the court, saying removing the meadows case from georgia would be per verse as this arises from interference of state operations, and seeks to vindicate -- our next guest signed on to the brief, former deputy attorney general under george h.w. bush, donald aier, who is with us. boil it down for us non-lawyers, why does this matter, whether it's state or federal court, and why do you think he should be tried in state court? >> well, the norm at process is a federal case is tried in federal court or handled in federal court. a state case goes forward in a state court. this is a special provision that's been around for almost a couple hundred years now that allows -- the purpose is to protect the functioning of the federal governmental roles by officers who were doing their jobs, to allow them to remove the case from state court to federal court. the question is, does it qualify? the supreme court has decided a number of case on the issue, and the basic rules are, the basic requirements are that, first of all, the official, the federal federal who wants to remove the indicate to federal court, has to have been performing his job. he has to have been acting within the scope of his official responsibilities, but the second requirement of that, whiched lead-in didn't really get into, but it's also a clear requirement that the defendant also has to be advancing a federal legal defense that is plausible to the state charges, so it's whether there's a reason for the material government to interrupt that and say, no, it has to go to federal court. >> donald, i want you to respond to something that meadows said in court today. he was asked about some of those points he was making. in his testimony, he said his duties as chief of staff included meeting frequently with state officials. the prosecutor tried to pin him down, asking which federal policy he was advancing when he joined a post-election call with rudy giuliani, who was the president's personal lawyer, not white house counsel, and among his answers, he said he was the timekeeper and schedule manager. he said there was a federal interest in accurate, and -- what do you say to that? >> there's a couple answers that are pretty clear. in general, the federal government and certainly the president and his staff do not have any official role in overseeing the presidential election. that's pretty categorically clear that they don't. there's another point to be made on top of that that was made forcefully in an editorial that came out in the last couple days. that is actually being involved in any sort of political process involving an election violates the hatch act. so it's not only not within the affirmative responsibilities, but it's also contrary to the half act that says federal officials can't get involved in political activities. so those are two answers to that point. remember, though, on top of all of that, in order to remove this case, there has to be a plausible federal law defense being advanced. that isn't even seriously being talked about. the only thing that's really been put forward on that is the crazy idea that donald trump has made and argued really throughout his entire administration and now that, because he was president, essentially he's absolutely immune from being challenged to anything he does. that's a silly and foolish argument, too. so i think he probably clearly loses on both parts. >> interesting interesting points you make that are really informative and to your point, the d.a. arguing the hatch act in court. donald, great to have you. thank you for taking us through that. >> thanks for having me. jim? >> well, people shouldn't be able to buy assault weapons, no matter what they intended to use it for, in my opinion. they should by banned. these are military-style weapons. if you have to handle an ar-15, join the military. otherwise, it just doesn't need to be in our society, in my opinion. >> as so often happens after there, the governor has given a mill from the university to beef up the security. based on what we know from organizations in this country, which the fbi defines as the greatest domestic security threat -- >> security is essentially, and obviously this really highlights the need for that. the security officer we'll hear from shortly did a very good job. something drew his attention to this individual, caused him to confront him. we know that many of these active shooters are really coward. they don't want confrontation with anyone. they want to go into a soft target. how much courage does it take to what you can into a dollar general where you have unarmed people in there simply shopping, and you have around ar-15 and you gun them down? whether it's a college campus, everyone needs to take a look to see what kind of security they have to protect themselves and their customers or students. >> it's now a hate crimes investigation. the targets both appearing in historically black college to begin, and the victims were african american. the gunman in this case killed himself following this. what's the significance of making this a hate crimes investigation after the fact? >> he left a lot of information behind swastikas on his glock. no secret this was definitely a hate crime, but it's important to have an investigation to uncover more in terms of this individual's motivation. go into his social media, interview family, friends, was he part of an organization? not that that organization was necessarily an active part of this particular crime, but are there others out there that could be plotting and thinking the same thing? they'll be looking at everything they possibly can. just because he's dead doesn't mean the investigation is over. they need to be thorough in order to try to prevent something like this from happening in the future. >> was he in communication with others like him? >> right. >> let me ask you this, in the wake of these things we have to cover on an almost daily basis. beef of security or make it harder to get the guns? and of course you have folks who are gun rights advocates will just focus on the security aspect. others perhaps on the other side. you know how police departments work, what it doesn't work, what impacts violent crime rates. if folks were seriously committed to making something less likely in the future, what combination of things would you need to do be done? >> you have to think about all of those things. each will have an impact. we need to sit down and have thoughtful discussions on this whole issue of gun violence. we're talking about this. obviously it was a hate crime, a horrific crime that took place that got a lot of attention, but we have people gunned down on city streets every single day. it may not qualify as a mass murder, but it happens, and ar-15s, other semiautomatic weapons, we want to be able to protect the second amendment, but at the same time keep guns out of the hands of people that do not need to have them. it wasn't long ago legislation was trying to get pushed through quietly to make the purchase of silencers legal. silencers! can you imagine people buying silencers on top of everything else? it's absolutely insane. we had noof to have a discuss, but we need to elect officials that have the backbone. they just talk. thoughts and prayers, if that worked, we would be the safest country on the planet. need action. chief ramsey, thanks so much. brianna? right now we are keeping an eye on the gulf coast, particularly the state of florida, and tropical storm idalia. it's expected to mike landfall as ma major category 3 storm by wednesday. governor desantis said that idali will be a major impact and urged anyone to get ready and be ready to not have power. chat meyers is closely watching the storm's track here. how strong is this storm looking? how close is it? >> right now it's still south of cuba. it's a discombobulated megss. if this were a circulating hurricane, we would be ramping things up. warnings are all in effect all the way around the big bend there. so here is the storm, 65 miles per hour, just to the east of cancun. still will make a pretty big impact in coupa, but then gaining strength in this very warm gulf water. we've been talking about this all season long with the coral and the keys. this is the warmest gulf we have seen with a hurricane on the way. where is that going to be? i know you're looking at the cones at home, but the cone itself is designed and created to only catch 66% of the hurricane eyewall landfalls. a six on one side and a 6 on the other. if you're close, you need to keep watching. look how close very big cities are. another 33% will miss it at this point, because things are not perfect. we do know that the storm surge will be a huge problem. we also know if it's 115 miles per hour and comes on shore, many areas of these look like land, but that's a mangrove swamp. it will have this effect all along the coast here, not very populated. just independence lapped, very populated. so we're have to watch out for these college towns and more, for sure. all the way up to myrtle beach, it won't be over. we know what happens when that happens. matthew a great example of how much rainfall can come down. freshwater flooding can kill more people than surges. brianna? what was the phone call about? it's staggering to me his attorney put him on the stand. as an attorney myself, that's a very, very risky move. but, you know, when i started to think about it, he may be the only person to testing the support of any of these things made. so, i think it's risky if you -- judgment -- but i think there's way too much and i think ultimately the judge will stay this needs to stay in state court. >> he claims this was just a procedural effort by him but you hear his voice in some calls, where in a nice way, but not too subtle ways, talking about the ultimate goal here, right? which was to get a different results. i wonder, from a legal perspective, how far does one have to go to substantiate the charge that this was not just a procedural effort but that the -- what do prosecutors have to prove? >> look, i think what we'll see with respect to the prosecutors, is after meadows gets off the stand, they'll put up the other people, including two attorneys who are repping the trump campaign. if meadow was only in his capacity of chief of staff, any client-privilege that may have inured him otr protected him, that goes away. you can't have it both ways. there are texts showing he's like, look, and i'm paraphrasing, but can't the trump campaign throw some money at this to move this along? if you're only acting in your capacity as chief of staff, you're not offering up funds from the campaign to get to a certain result, and you're certainly not trying to put your thumb on the scale. >> to be clear, the argued that he's acting as a federal official, so it should be in federal court, but to be clear federal official can't do whatever the heck. there's a line, is there not, to criminal behavior. >> even buying that all he was doing was listening to what the president told him told, what the president was telling him to do was part of a criminal conspiracy, if he knew that and was aware of it, he can't use that as a shield from being held responsible. ultimately, at the end of the day, what he was doing really was political in nature. it was electioneering at a minimum, which is in violation of a hatch act, which means you as an employee of the federal government can't do that. there's no way he can legitimately say what he was doing was in furtherance of legitimate goals or, you know, responsibilities associated with the office. >> jen jordan, thank you for breaking it down. we appreciate it. brianna?
